The Cincinnati Post May 27, 1986 Wheelchair protesters freed early Post staff report A motion for early release of three wheelchair-bound activists was granted today by Hamilton County Municipal Court Judge J. Howard Sundermann Jr. On Friday, Sundermann sentenced Michael Auberger of Denver, George Cooper of Dallas and Bob Kafka of Austin, Texas, to 10 days in jail for their part in a protest last week at the main office of Queen City Metro. Attorney Joni Wilkens had argued against a jail term for health reasons. Today Sundermann ordered the three released after serving six days of their sentences for trespassing. Before granting the motion for early release, Sundermann asked them if they planned to go to another city and “do the same thing?” Auberger and Kafka said no, that they planned to return to their homes. Cooper did not reply.w “I think we made our point. The issue (of access to public transportation) won’t go away,” Kafka said following the hearing. OHIO DIGEST 5/86 Title: Disabled to protest in Cincy ASSOCIATED PRESS CINCINNATI — About 100 people in wheelchairs plan to disrupt city bus service for four days starting tomorrow because they say public transportation is frequently not available to the handicapped. The action by Americans Disabled for Accessible Public Transportation, or ADAPT, a Denver-based organization, is timed to coincide with a meeting of transportation industry officials here, said Michael Auberger, an ADAPT community organizer. An estimated 800 to 1,000 members of the American Public Transportation Association, the nation’s major public transportation association, begin a five-day regional conference downtown today. “We have not decided upon specific strategy, but some type of civil disobedience will be taken, Auberger said. “We might inconvenience the public, but the fact is, we can’t even get on the bus.” Judith Van Ginkel, a Queen City Metro spokeswoman, said police and the company were prepared for a protests and that a disruption in service was possible. - ADAPT (248)
Cincinnati Enquirer 5/28/86 Disabled protesters released on promise to leave city by David Wells, The Cincinnati Enquirer Leaders of last week's disabled rights protests of Cincinnati left jail four days early Tuesday after Municipal Judge J. Howard Sundermann agreed to reduce their sentences. Last Friday, Sundermann sentenced Robert Kafka of Austin, Texas, George Cooper of Dallas and Michael Auberger of Denver to spend 10 days in jail for disorderly conduct. The judge gave each man credit for two days already served, but said they would have to remain incarcerated until this Friday. He modified those sentences Tuesday, saying the medical condition of at least one man seemed to be deteriorating and all three promised to leave Cincinnati if released. The men are members of American Disabled for Accessible Public Transportation (ADAPT). They came to Cincinnati last week to demonstrate against the American Public Transit Association, which was holding a convention at the Westin Hotel. The group also demonstrated against Queen City Metro in an effort to get the company to include wheelchair lifts on all new buses. The rest of 17 protesters arrested last Wednesday with Auberger, Kafka and Cooper were released by Friday, but Sundermann said the three leaders deserved more severe sentences than the others because they disobeyed an earlier court order. The three first were arrested for disorderly conduct May 18 during a demonstration against Queen City Metro at Government Square. They were released on bond and told to stay out of Cincinnati until their trials. Sundermann modified that order last Wednesday morning, saying the men could rejoin the ongoing protests as long as they did not break any laws. Within three hours, Kafka, Auberger and Cooper were rearrested, accused of blocking the Fourth Street entrance to Metro headquarters by chaining their wheelchairs together. “They apologized for that this morning," Sundermann said. “They said they just got caught up in the spirit of the protest.” Sundermann agreed to reduce the sentences on a motion from defense attorney Joni Wilkens, who noted that Auberger had been taken to University Hospital Sunday because of a recurrent medical problem related to his disability. Assistant City Prosecutor Charles Rubenstein did not object to the reduction of the sentences. All three men are confined to wheelchairs, and Wilkens said she was afraid continued time in jail might impair their health. All 16 protesters pleaded not guilty. "This is the first time in the history of our movement that the disabled haw been locked up in jail overnight for making their protests,” said the Rev. [Headline] Disabled riders hopeful after meeting transport officials San Diego Union By Ric Bucher, Staff Writer 2/11/85 Mike Auberger and Dana Jackson were not smiling when they wheeled out of the Hilton Hotel's Capri Room, but they were hopeful. Auberger and Jackson, along with 13 other wheelchaired members of American Disabled for Accessible Public Transportation, asked board members of the American Public Transportation Association to endorse full accessibility for the disabled to all public transit vehicles. And they aimed their plea at the board members’ hearts rather than their budget. “I think we really shook them up,” Jackson said. “They have come a long way,” Auberger said. “Two years ago, they didn't want us in the room. This time they asked questions.” One of those questions, posed by John Pingree, transit manager of Salt Lake City, Utah, personalized one of APTA’s primary disagreements with the ADAPT group. The transit manager said he has an autistic child whom handicap requires the use of specially equipped vans presently available to the handicapped in most cities. The cost of fitting public transportation system with wheelchair lifts, ramps and wider doorways would take away funds currently subsidizing these van services, APTA members claim. ADAPT members say, however, that the van service method is severely handicapped itself. Van service must be reserved 24 hours in advance for a specific time and destination, and ADAPT members say the vans segregate them from the rest of the public. “Imagine if you had to program your car 24 hours in advance every time you wanted to go anywhere, and that was the only way you could get there,” Jackson said. Jackson is the ADAPT transportation coordinator in Washington, D.C. Wade Blank, who helped found ADAPT 12 years ago, said the group's appeal focused on “the moral imperative” aspect of equal access, instead of “costs and everything else.” Blank, who is not disabled, feels the transit system discriminates against the disabled now as it once did against black people. Blank believes the presentation created a rift between transit managers who have superior handicap access – Seattle was cited as the best – and those with lesser facilities. San Diego is one of the worst, according to Auberger. APTA’s executive vice president, Jack Gilstrap, said the APTA board has appointed a committee to study the ADAPT and give a report, tomorrow. Title: Arresting Theater By JIM FINKELSTEIN, Free Press Staff Writer An estimated 25 handicapped protesters were arrested Tuesday as they charged police guarding the McNamara Federal Building Tuesday in a third day of what one protester called "theater" over public transit's limited use of lift-equipped vehicles. Wave after wave of the estimated 100 protesters — many in wheelchairs and paralyzed, missing limbs, or suffering nerve disorders — were hauled away in lift-equipped vans while police photographers recorded the scene to ensure the protesters were properly arrested. Michael Auberger, a spokesman for the 100-member American Disabled for Accessible Public Transportation, vowed Tuesday that "we're going to escalate" the protest today and Thursday as the convention of the American Public Transit Association concludes at the Westin Hotel. “Everyone's willing to go" to jail. he added, hinting that the protest may move to the Westin today. Seventeen ADAPT members were arrested Monday as they tried to crawl aboard city buses to protest the lack of wheelchair equipment on 80 of 100 buses recently purchased by the city. THE DEMONSTRATORS want lift equipment on all new buses and trains purchased by U.S. public transit systems. The transit association won a court case to prevent more extensive federal regulations requiring lift equipment. Tuesday, the protesters began chanting slogans in front of the McNamara Federal Building just before 1 p.m. ADAPT spokespersons said the group wanted to present a position paper to Sen. Donald Riegle, D-Mich., whose offices are in the building. They refused a police offer to let two representatives meet with Riegle's aides, saying they wanted to send no fewer than nine. Police blocked the entrance and then began arresting protesters who blocked the entrance — both wheelchair users and non-handicapped ADAPT aides. Deputy Police Chief James Ingram said "a couple of hundred" police officers were given special training in arresting people who use wheelchairs. May 22, 1986 - Cheyenne Wyoming State Tribune—27 [Headline] Handicapped Protesters Arrested CINCINNATI (UPI) — A group of handicapped protesters charged with disorderly conduct and criminal trespass refused to post bond and spent the night in the Hamilton County Justice Center. The demonstrators, protesting the lack of access to public transportation for the disabled, were arrested Wednesday for blocking entrances to the Westin Hotel and the building housing offices of the city's bus system. The Westin was singled out because the American Public Transportation Association was holding a regional conference there this week. Barricades had been erected to keep the protesters from entering the hotel. Several of those arrested were released on unsecured appearance bonds for medical reasons. The first defendant's trial was scheduled for next Wednesday. “If the Cincinnati transit system, police and judicial system deny access to disabled people, why can't the disabled block the access to the system,” said Michael Auberger of Denver before his arrest. “We just want to be treated like everyone else.” Auberger was among those who spent the night in jail. About 40 wheelchair-bound members of American Disabled for Accessible Public Transportation, based in Denver, participated in the demonstration. Fourteen were arrested and charged with disorderly conduct. Robert Kafka of Austin, Texas, George Cooper of Dallas and Auberger, all of whom had been arrested earlier in the week, were charged with criminal trespassing for blocking the entrance to the building where Queen City Metro's offices are located. The three men, confined to wheelchairs, had been arrested Monday for refusing to get off a bus they had paid to board. A Hamilton County Judge had ordered them to leave Cincinnati until their trial, but another judge rescinded the order Wednesday morning. Auberger, Cooper and Kafka attempted to speak to Queen City officials but were not permitted to enter their offices. When they returned to the ground floor, they chained their wheelchairs together to block the entrance. One worker was forced to use an alternative route to return to her office. [Headline] 25 arrested on second day of demonstrations [Subheading] Protesters straining nerves, budgets By Faith Bremner Tribune Staff The handicapped protests in downtown Sparks are costing local residents time and money. Time in the sense that police officers who would otherwise be helping local citizens are spending their time keeping the peace on B Street. Money in the sense that the police and the court are working overtime just to keep up with the 100 or so demonstrators who are protesting the American Public Transportation Association's (APTA) convention at the Nugget this week. “ While (the Sparks Police) are out there handling these individuals and if you call 911, the response times change dramatically," Sparks Municipal Court Judge Andy Cray said. The demonstrators come from all over the country and are members of the Denver, Colo. based American Disabled for Accessible Public Transportation (ADAPT). They are demonstrating against APTA because that organization opposes the federal government forcing public transit authorities to install wheelchair lifts on all buses purchased with federal funds. APTA represents public transit authorities around the United States and Canada. In two days of protests, Sparks Police have arrested 72 demonstrators, mostly on charges of blocking fire access to the Nugget, obstructing police officers and assault and battery, Cray said. Most of those arrested Sunday, the first day of the protest, were given warnings and had their fines suspended, Cray said. Those who were rearrested Monday were given three day jail terms and fines ranging from $200 to $500, he said. The arrested were brought into court directly from B Street and checked out by two nurses, then arraigned and transported to jail via a special lift-equipped van, Cray said. The two judges worked until midnight both nights, Cray said, just to handle the crowd. Likewise the sheriff and the police department are working their crews overtime. The Sparks Police have canceled all days off and vacations and during the demonstrations called in all available officers Lt. Tony Zamboni said. "Everybody's tired and we've put in some long hours but morale is still relatively high," Zamboni said. Likewise, the Nugget is working its security guards overtime, spokesman Parley Johnson said. “I think it's hurting us a little bit but you have to feel sorry for these people,"Johnson said. “It's a tough situation. There but for the grace of God go I.” It has been business as usual at the Nugget, Johnson said, and few customers have been inconvenienced. “Most of our customers didn't realize what was going on," Johnson said. Meanwhile, ADAPT co-founder Mike Auberger complained that the Washoe County Consolidated Jail is unprepared to house the handicapped prisoners. As of this morning about 30 protesters were still in jail, Auberger said. Auberger, a quadriplegic, was arrested Sunday and posted bail and was released late Monday night. "There were only three people handling 30 people's medical needs and helping them to transfer from their chairs to the beds or the bathroom, the litany of what it takes for a disabled person to survive," Auberger said. “Most of the nurses and staff at the jail clearly had never dealt with disabled people. They had no idea what you were asking for." But Sheriff Vince Swinney denied that the jail is unprepared to handle the handicapped. “Somebody should realize this is what these people want to do," Swinney said of the group that has staged numerous similar demonstrations around the country. “If they were treated like royalty, they wouldn't be happy. The Cincinnati Post, Wednesday, May 21, 1986 I-B Title: Disabled activists may defy court order in bus protest By Mary Kane, Post staff reporter Wheelchair-bound activists are prepared to defy a court order today and force a showdown with city authorities over what rights the handicapped have to public transportation. The Rev. Wade Blank, a founder of Americans Disabled for Accessible Public Transportation, said three activists ordered to get out of town will hold a news conference at noon in front of the Westin Hotel. Robert Kafka of Austin, Texas, George Cooper of Dallas and Michael Auberger of Denver risk being jailed on disorderly conduct charges if they show up at the Westin. Judge David Albanese of Hamilton County Municipal Court on Monday ordered the three to leave Cincinnati Tuesday or forfeit their $3000 bonds. A pre-trial hearing is scheduled for June 26. The men were arrested Monday during a demonstration in front of the Westin, where conferees of the American Public Transportation Association are meeting. The activists have been staying at a Newport hotel, an arrangement that does not violate Albanese's order. However, once inside Cincinnati city limits they are in violation. Members of ADAPT, a national handicapped rights group, have pitted their wheelchairs against the steel frames of buses to protest what they call a lack of accessibility to public transportation for the handicapped. Mr. Blank, a Presbyterian minister, said 12 severely handicapped ADAPT members also will attend the news conference today and announce their intent to block buses in the street. That tactic is intended to challenge law enforcement authorities. Mr. Blank said police have been reluctant to arrest the most severely handicapped of the group. More than 30 San Antonio police officers were called in to keep the peace as the protesters, who belong to the American Disabled for Accessible Public Transportation (ADAPT), temporarily blocked the Hyatt Regency Hotel lobby yesterday afternoon. The demonstrators – many who had traveled from as far as Denver and El Paso – came to San Antonio yesterday to emphasize the need for wheelchair accessibility to conventioneers attending the American Public Transit Association’s weeklong meeting at the hotel. The group assembled at the Alamo, then moved to the Hyatt, which they circled four times before entering the lobby. “We’re talking about equality.” Mike Auberger of Denver, an ADAPT spokesman, said. “For so long blacks were separated, and that’s what we see happening here. The cost of these lifts isn’t what we’re talking about. It’s integrating everyone into the system.” In addition to the protesting transportation group, ADAPT also condemned the lack of wheelchair lifts VIA Metropolitan Transit buses and trolleys. Auberger said there are about 12,000 people in the San Antonio are confined to wheelchairs. He said only a small number of those are served by special buses provided for the handicapped every day. He said seven of the protesters outside the hostel yesterday were from San Antonio. But VIA General Manager Wayne Cook said local handicapped population does not want wheelchair lifts and instead prefers door-to-door service provided by special buses. “They (wheelchair lifts) are not an option,” Cook said at the hotel. “The local handicapped population does not want it. They want door-to-door service. We spent $1.2 million on the handicapped this year. They told us they don’t want lifts - they want special VIA trans buses instead.” Cook said each wheelchair costs about $15,000 and extra funds would be necessary to train a staff to maintain them. “What’s the point in having the ability to vote if you can’t participate?” Auberger said. “How can you give handicapped individuals jobs if they can’t get to work? Association officials at the hotel said that while they understood the protesters’ desire they agree with allowing each city to decide whether to install the lifts. “I sympathize with their desires and I wish I had the resources to make them (buses and trolleys) more accessible,” said association spokesman Jack Gilstrap, who met with the protesters before they disbanded. “The ironic aspect to all this in that we are on the same side. We want the best for the handicapped. We feel the courts’ decision that each city should decide how it should be handled is correct. Cooley, Times Staff Writer About 20 disabled people blocked a Trailways bus for more than two hours Saturday at the downtown terminal until the terminal manager agreed to ask a company executive to meet with the disabled group concerning difficulties wheelchair-bound people have with bus travel. The group which represents American Disabled for Accessible Public Transportation (ADAPT), was in town to meet with members of the American Public Transit Assn. today. Representatives of ADAPT said they want a legislation requiring all new buses operated by private companies such as Greyhound and Trailways to be equipped with wider doors, lifts and ramps. Most public transportation operators, including San Diego Transit, provide wheelchair lifts on at least some buses. ADAPT member Claude Holcom bought a ticket to Los Angeles, but when Trailways' personnel told him they would have to fold his wheelchair and carry him to his seat, Holcom declined to board the bus. "We don't think a person should have to be carried aboard a bus," said Wade Blank, one of the protest's organizers. “It's very dehumanizing. They’re taking away their legs." Blank and fellow ADAPT member Mike Auberger said the group is trying to draw attention to the frustrations of traveling by bus and being in a wheelchair. Although both Trailways and Greyhound buses are not equipped to handle wheelchairs, Blank said ADAPT met with Greyhound officials last week to discuss the possibility of fitting new buses with lifts. “This is a symbolic protest, just like the civil rights protests of the '60s, but we have the right to travel the same as anybody else," Blank said. "The wheelchair is like somebody's legs." The Los Angeles bus, with its two passengers, was scheduled to leave the C Street station at 4:15 p.m., but by the time terminal manager Fred Kroner arrived and negotiated with the ADAPT members, it was nearly 7 o'clock before it departed. The two passengers appeared surprised and baffled by the protest and by queries from members of the news media. One man opted to go to the Greyhound terminal two blocks away and catch another bus rather than wait out the protest. The other passenger, Mich Galloway, 23, said he was sympathetic to the group wanting equal access to buses and waited patiently until the protesters dispersed. “I see where they are coming from." Galloway said. "I hope something is done about it." After several phone calls to the Trailways corporate offices in Dallas proved fruitless. the ADAPT members agreed to accept from Koner the name, address and phone number of the company‘s public relations officer. who they intend to call Monday. Cleveland Plain Dealer p.8 Title: Cincy frees wheelchair access bus activists CINCINNATI (AP) -- A judge granted early release yesterday to three wheelchair-bound activists who were arrested last week for participating in protests to demand access for handicapped people to public transportation. Hamilton county Municipal Judge J. Howard Sundermann, Jr. granted a defense lawyers request for early release of Michael Auberger of Denver, George Cooper of Dallas and Bob Kafka of Austin, Texas, who had served six days for criminal trespassing. Sundermann had sentenced the three to jail terms of 10 days each for their part in last week’s demonstration at the headquarters of Queen City Metro, Cincinnati's public transit agency. Their lawyer, Joni Wiikens, had argued against a jail term, saying the men could have suffered health problems if they were jailed for an extended period. Before he granted the early release, Sundermann asked the men if they planned to go to another city and repeat the demonstration. Auberger and Kafka said they planned to return home. Cooper did not reply. “I think we made our point. The issue won’t go away,” Kafka told reporters after the hearing. Auberger, Cooper and Kafka are members of Americans’ Disabled for Accessible Public Transportation (ADAPT), a national organization that sponsored last week’s protests outside a downtown Cincinnati hotel where the American Public Transit Association was conducting a regional meeting of bus system executives. The activists were protesting Queen City Metro’s policy of requiring the handicapped ride on separate vans for the disabled rather than on regular buses. ADAPT members urged the system to fit the buses with wheelchair lifts, but Metro officials said they did not have money to do so because of the Reagan administration’s cuts in federal transit funding. The vans must be reserved 24 hours in advance. Some 34 VIA employees held hostage inside their offices were released after police negotiated for a meeting with local and national transportation officials. The later session led to an airing of demands by about 60 members of the American Disabled tor Accessible Public Transportation. Police rented vans, in case the protesters were arrested. Bernie Ford of Chicago, president of the American Public Transit Association, and Wayne Cook, general manager of VIA, met with the ADAPT members Monday afternoon, but both sides stuck to their respective positions on public bus access for the handicapped. Ford was in San Antonio to attend the western conference of APTA, meeting at the Hyatt Regency Hotel through Wednesday. About 15 police officers were on duty there, Toscano reported. Ford refused to grant the ADAPT members 20 minutes of speaking time before the general transit membership, saying that a scheduled Wednesday work session on handicapped access was sufficient for consideration of the problem. Laura Hershey of Denver and Jean Stewart of Poughkeepsie, N.Y. listed the ADAPT demands, which included a policy change by the mass transit system that all new buses purchased be equipped with lifts that allow wheelchair-bound persons to use buses. ADAPT claims that it costs $8,000 to $10,000 to equip a new bus with lifts for the handicapped, while air conditioning a bus costs more “and doesn't always work." “It's a question of priorities," said Mike Auberger of Denver, where ADAPT is headquartered. After a 30-minute session, the only agreement between the ADAPT members and Ford was allow the group to publish an article in the September issue of the association's monthly newspaper. Cook was grilled about the San Antonio situation by Bob Kafka of Austin, a Texas ADAPT official. Cook said the VIA Para-Transit system used in San Antonio, which uses specially equipped vans to transport the handicapped was implemented upon recommendation by a 26-member task force, which included handicapped persons. “This is why you don‘t see San Antonians join your cause,” Cook said. Kafka retorted that numerous San Antonio handicapped members have contacted ADAPT, and refuted Cook's contention that the majority of the local handicapped persons support the VIA Para-Transit program because it is segregationist. “This is not to say you're lying,” Kafka told Cook, “but you are distorting the truth." The ADAPT members then read a statement submitted by Willis Williams on behalf of the San Antonio Citizens Concerned about Handicapism. The SACCH statement said the group declined to participate in the ADAPT demonstration but added: “It is our long-standing position to support the concept of a multimodal system with both lift-equipped mainline buses and door-to door service vans as the best and most economically sound approach for San Antonio." The statement was issued on behalf of Larry Johnson, chairman of San Antonio Independent Living Services, and Joyce Jenks, president of SACCH. "Twenty (VlA) vans cannot possibly serve 50,000 mobility impaired citizens," according to Jenks. The 60-member ADAPT group was composed mainly of Texans, with - others from Colorado, Illinois, and New York. Three people attending the protest identified themselves as San Antonians who came as individuals because their organizations are tax-exempt and do not participate in demonstrations. Tommy Leifester, 1100 Callaghan, said the VIA task force did not represent the majority of San Antonio handicapped. Leifester assisted Toscano in the negotiated settlement. Leifester stated that although local handicapped persons were not very visible at the protest, "This will help get our story out in public. VIA has been putting out only one side of the story." During the shuttle diplomacy segment the protesters chanted: “We will ride! Access now!" and demands for Cook to meet with them. Cook was not in his office since he was attending the mass transit convention at the hotel. He arrived at 12:10pm. During four days of demonstrations there, 17 wheelchair riding protestors were arrested and taken to jail. Fifty disabled Americans went to Cincinnati at the end of May to protest discrimination against people in wheelchairs—and they put together some protests that city authorities will never forget. The wheelchair-riding demonstrators, who came from as far away as Texas and Colorado, are members of ADAPT— American Disabled for Accessible Public Transportation. They're tired of being denied access to public buses, and they went to Cincinnati to confront a meeting of the American Public Transit Association (APTA). APTA represents public transit officials from cities all over the country, and 600 of them were in Cincinnati in May for a regional education and training conference. In the space of four days, ADAPT staged half a dozen dramatic demonstrations, tied up bus service for an entire afternoon, shut down the office of the local transit system, caused havoc at a major downtown hotel, and had 17 of their members arrested, including 3 who were temporarily banned from the city of Cincinnati. “I've been kicked out of a lot of places," says ADAPT organizer Mike Auberger, "but never from a whole city!" ADAPT was formed in Denver in 1983, after Auberger — who is a quadriplegic as a result of a bobsled accident — and other handicapped activists convinced city officials there to put wheelchair lifts on every single bus. “It took six years of street fighting to win in Denver," says ADAPT organizer Wade Blank, a minister who became involved with handicapped issues while working as an orderly in a nursing home. “So then we said, are we going to sit on our laurels, or are we going to expand to other cities?" ADAPT demonstrators have hit APTA events in Washington, DC, Los Angeles, Dallas, Houston, and San Antonio. The demonstrations have a double purpose: to pressure APTA to go on record in favor of accessible public transit nationwide, and to push local officials to change their bus systems. While APTA remains stubborn, ADAPT can point to a number of local successes in cities such as Los Angeles, Seattle, and Kansas City. ADAPT members see their cause as a civil rights struggle, and their actions call attention to the injustice suffered by disabled people who are denied access to basic public services. The first arrests in Cincinnati came on Monday, May l9, when George Cooper and Bob Kaska climbed out of their wheelchairs and crawled aboard a Cincinnati city bus. They paid their fares, but were arrested for “trespassing.” Mike Auberger, who blocked the front of the bus, was also arrested, and the three were banned from the city by a municipal judge. Monday night, APTA conference-goers had a reception scheduled at the College Football Hall of Fame, outside the city limits. ADAPT protestors went out to meet them, but found entrances to the building locked by local sheriffs. They were waiting on the shoulder of the four lane road leading to the Hall of Fame when four buses carrying hundreds of APTA members came down the road, rolling along at about 40 miles an hour. Suddenly, a group of people in wheelchairs bolted out to block the buses. “l remember flashing in my mind that these might be the first deaths of the civil rights movement of the handicapped," recalls Wade Blank. No one was injured: two buses steered onto the shoulder of the road, and two others came to a halt. The conventioneers had to get off the buses and walk the rest of the way to the Hall of Fame. On Tuesday, ADAPT settled for a symbolic action, raising a cross in front of the Westin Hotel, where APTA was holding its meeting. The cross, they said, demonstrated APTA's “crucification" of disabled people. On Wednesday, it was back into battle. The banning order against Kaska, Cooper and Auberger had been lifted, but they got arrested again by chaining their wheelchairs to the front doors of the Cincinnati bus system’s main offices. Fourteen other disabled people, meanwhile, were arrested for blocking entrances at the Westin Hotel. All seventeen of them wound up in a classroom at the city jail. "It was definitely a new experience for the whole justice system,” says Mike Auberger. “Everyone received a real education in disabilities." Most of the protesters were released after a day or two, but Auberger, Kaska and Cooper, who were viewed as the real troublemakers, had to stay in jail for six days. This caused some serious problems, as none of the men can use the bathroom without the help of an attendant—and no one in the Cincinnati jail system was prepared to deal with that situation. Auberger, who had a skin rash and a urinary infection, was eventually hospitalized. All three protestors have now been released, he reports, and they are back home and suffering no serious long term effects from their ordeal in prison. The difficulties in jail, he thinks, “were more of a left hand not knowing what the right hand was doing type of thing than any serious intent to do harm." Their grueling experience, however, shows just how difficult it is for disabled people to stand up for their rights in a society that is not prepared to deal with people in wheelchairs. Despite such obstacles, ADAPT members are determined to continue their struggle for full civil rights. They are already planning for their next confrontation, which will take place on October 6 through 9 in Detroit, where APTA is scheduled to have its 1986 national convention. Without doubt, it will be a memorable occasion. Title: Activists block buses’ route By Edwina Blackwell, Post Staff reporter On a stretch or road near the College Football Hall of Fame, strong beliefs over the rights of the handicapped to public transportation confronted the steel frames of buses. lt happened Monday night when 15 disabled activists rolled into the pathway of vehicles traveling 40 mph. Seven buses carrying conferees attending the eastern meeting of the American Public Transit Association in Cincinnati were on their way to the Hall of Fame at Kings Island in Warren County for a reception. As the buses neared the Hall around 6:30 pm about 15 members of American Disabled for Accessible Public Transportation moved onto the road, blocking a portion of Kings Island Drive. Police had set up barricades by the hall earlier. However, that didn't keep the ADAPT members from rolling onto the roadway. "I remember flashing in my mind that these might be the first deaths of the civil rights movement of the handicapped," said the Rev. Wade Blank of Denver, Colo., co-founder of ADAPT. No one was injured and no arrests were made. But the members of the Denver-based group say their action shows how far they are willing to go. The protesters want the transit officials to change their national policy on accessibility and Queen City Metro to have wheelchair lifts on all new buses. Today ADAPT members plan to demonstrate in front of the Westin Hotel, where the APTA convention is being held. There were also disabled people riding the buses that were halted Monday night. Dixie Harmon was one of the people who got off the bus Monday in the midst of the ADAPT protest. Ms. Harmon, a quadriplegic in a wheelchair. is co-chairwoman of the Specialized Transportation Advisory Committee, a local committee which works with Queen City Metro in reviewing handicapped needs. But when she met her peers on the protest line, the reaction was less than cordial. Both she and Dan Cleary, president of the Greater Cincinnati Coalition of People with Disabilities, were subjected to name calling for their decision not to demonstrate. Wednesday she will be on a APTA panel discussing transit system services to disabled individuals. "I was very uncomfortable," she said of the Monday night confrontation. "(But) I have to understand that they're angry, too." Queen City Metro and Cincinnati police say they are ready for any more protests during the convention, which ends Thursday. Judith Van Ginkel, director of Metro communications, said bus drivers have been instructed to stop immediately and call police if a protester tries to block the vehicles. Earlier Monday, three ADAPT members — Michael Auberger, Bob Kafka and George Cooper—were arrested and charged with disorderly conduct for attaching themselves to Metro buses downtown. Every weekday morning, she can expect to see the specially equipped van in front of her apartment, ready to transport her to work. Confined to a wheelchair because of muscular dystrophy, she needs the lift-equipped vehicle to survive on her own. For many, ACCESS inhibits mobility, however, because it does not travel beyond Cincinnati city limits. "lf we want to go in a closed mall, there is none inside city limits. Most of your movie theaters seem to be in those areas also," said Ms. Geraci, a counselor at Total Living Concepts Inc., an organization that promotes independent living among handicapped individuals. Riders who utilize the curb-to-curb service of ACCESS must make reservations at least 24 hours In advance and preferably one week in advance. The 19 specialized transportation vans used for the elderly and the disabled serve only Cincinnati proper in addition to Elmwood Place, St. Bernard and Norwood. Even short trips like running to the grocery store must be scheduled in advance. "You tell them when you want to go and when you want them to come get you and you hope that your ice cream doesn't melt," Ms. Geraci said. Dixie Harmon, co-chair of the Greater Cincinnati Coalition of People With Disabilities, said the scheduling becomes an invasion of privacy for the individual because ACCESS knows your every move. Several local handicapped organizations have publicly supported the demonstrations of American Disabled for Accessible Public Transportation although they shy away from their methods.
