This is the story, as told in a video Incitement, of ADAPT's national action in Atlanta in 1996. We were fighting for community based services so people don't have to go into nursing homes and other institutions. We were able to get Speaker Newt Gingrich to agree to sponsor our bill, and to get both parties very aware of our issue on the eve of the national election. We challenged the GA Nursing Home Assn and the AHCA (the nursing home lobby group) and pulled off some spectacular actions. - (4.87) ADAPT (90)
Denver Post [This article goes with photo in ADAPT 89] [Headline] Wheel Chair Delegation Accuses Board of Ignoring Them Howard Pankratz, Denver Post Staff Writer A 17-year-old crippled girl Tuesday told the board of the Regional Transportation District (RTD) it cost nine handicapped adults in wheelchairs $90 to take a four-mile trip to a Denver Bears baseball game at Mile High Stadium last summer. Her testimony and that of other Denver handicapped individuals highlighted a public meeting at which the RTD was accused of not caring about the handicapped and elderly. By the time the meeting ended board members voted not only to intensify their efforts to help the handicapped but to do everything in their power to see that 120 new buses the RTD hopes to buy have facilities for the elderly and impaired. The board authorized chairman John Fleming Kelly, to file an application with the U.S. Department of Transportation (DOT) for a $12.4 million grant to finance purchase of the 120 buses; and to build a new bus administration and maintenance facility and 100 bus shelters. At the meeting at the Colorado Highway Department building, it was obvious the board was moved by the presence of approximately 40 persons in wheelchairs, some who accused board members of not being “sincere” in their efforts to help the handicapped. [Subheading] NOT SURE OF CARE “I want to make sure we take care of these people,” board member Leo F. Sullivan, declared near the close of the session. “From the remarks I've heard tonight, I'm not sure we are." John Harper, another board member, assured the group that the RTD is sincere but he acknowledged that he thought maybe the RTD might have been a "bit-remiss" in regard to the handicapped and “could do a better job." The most moving testimony of the night came when Inez Regge, severely crippled and confined to a wheelchair, told of how nine adults from the Heritage Nursing Home had to pay $10 each to attend the ball game. “That is high by any standard, but for these young people whose total income was approximately $20 a month, it was exorbitant," she said. “There have been similar ‘rip offs’ in the past, including a $92 fare for one young man going from Heritage House downtown-and back." She said not all private companies who provide such services to Denver's handicapped are “mercenary,” but overhead forces them to keep their rates high. Until Sept. 7, the day Denverites approved the RTD bond issue, she said “there didn't appear to be any transportation alternatives for most of Denver's disabled. [Subheading] COMMITMENT SOUGHT But she said that a commitment by RTD officials prior to the bond election to provide bus service to the handicapped, plus a provision in the Federal Transportation Act which says special effort must be made to accommodate the handicapped on mass transportation, gave them an alternative. Miss Regge said Denver has one of the highest percentage of handicapped people in the country because of the large number of facilities here. “It is the goal of the handicapped community to see to it that all public transportation is accessible to the handicapped," she said. John D. Simpson, RTD executive director, said RTD had hired Al Coulter of the Denver Board for the Mentally-Retarded and Seriously Handicapped, Inc., to try to find out about the transportation needs of the region's elderly and handicapped. But he said RTD and Coulter had run into a business community which had refused to give the agency help in locating the handicapped. “We have been unable to ascertain where handicapped people want to travel to and from,” Simpson said. “There is some real difficulty in talking to companies — and we have approached half a dozen of the major employers - who have handicapped employees. “They either say ‘We don't know who they are' or ,‘We do know, but we don't want to tell you.'" Les Berkowitz, representing the Citizens Advisory Committee on Transportation for the Handicapped, reminded the RTD that not only does the organization have a moral and philosophical obligation to the handicapped, but also a “specific, expressed requirement” under federal statute. He quoted a public law which directs “that special efforts shall be made in the planning and design of mass transportation facilities and services so that the availability to elderly and handicapped persons of mass transportation which they can effectively utilize will be assured." Berkowitz, sitting in a wheelchair a few feet away from the 15 board members, said despite RTD assurance it is interested in the handicapped. “we have some reason to believe that RTD is not entirely sincere in its efforts." Although seeking assistance from a citizen’s task force, he said RTD has expected from that task force, composed entirely of volunteers, “far more than we can be reasonably expected to give.” He said the volunteers have had little or no training in the collection of data or research design. Further, he alleged that Coulter had only been hired for a 60-day period. While Denver's handicapped community asked that the RTD do more, a wide variety of spokesmen enthusiastically backed RTD's $12.4 million federal government application. They said the buses which the money would buy would do everything from helping alleviate Denver's air pollution problem to providing a badly needed form of economical transportation. State Rep. Richard Lamm, D-Denver, said that after Denver “won the dubious distinction as one of the nation's six most polluted cities.” the Colorado legislature created RTD and charged it with developing a transit plan. “Tonight we are here to publicly discuss the first and a vital phase of this plan -- the early action bus program,” he said. “RTD will be able to improve bus service by more than 60 percent in the region with this one capital grant alone. That, to me, is an important first step toward cleaning up the environment." Gordon Appell, principal planner for the Denver planning office, read a statement by Mayor Bill McNichols in which McNichols said the demand for public transit in the Denver area “has reached almost emergency proportions." McNichols noted that in January, the Denver Metro Transit system had 1.9 million passengers, a 22 per cent increase over the same month a year ago. He forecast that the number of passengers may exceed 25 million this year. Thus, he said, the money for the buses is imperative. - (4.87) ADAPT (54)

[Headline] Atlantis Members Bludgeon Curb in Protest By Bill Scanlon, Special to the Denver Post An 8-inch curb is not much of an obstacle to most pedestrians. But when you are in a wheelchair and you’ve counted 44,000 of them and each one of them is an obstacle to your movement and your freedom, that 8-inch curb can become a symbol of intense frustration. Two handicapped Denverites bludgeoned such a curb with 20-pound sledgehammers Monday afternoon to show their anger at the mayor's office for what they described as a failure to make the sidewalks and streets of Denver safe and accessible to the disabled community. THE DEMONSTRATION at the corner of East Colfax Avenue and Colorado Boulevard was put together by the Atlantis Community, an organization of handicapped people. According to a press release, the group staged the protest to “express our anger and frustration at the 44,000 curbs in Denver which prevent us from using the sidewalks and crossing the streets." A crowd of about 30 people watched and cheered as a like number of handicapped people wheeled their chairs westward down the sidewalk in front of National Jewish Hospital. When they reached a curb that had been cut to provide automobiles access they crossed Colfax Avenue. Then they proceeded eastward along the Colfax Avenue sidewalk until they reached the Conoco service station at the corner. There was a rounded curb there, so the protesters wheeled their chairs across Colfax. They were forced to edge into Colorado Boulevard traffic to go around the concrete median. At the corner they found themselves up against an 8-inch curb, symbolic of thousands of others that had stirred the protest. THERE, LES HUBBARD and George Roberts began wielding their sledgehammers. Amid cheers of “Down with the curbs," they succeeded in inflicting slight damage to the concrete slab. Drivers stopping at the corner traffic light were mostly curious, often supportive, but also a little wary about hitting the wheelchairs. The chairs impeded but did not stop traffic at the busy intersection. During a break from hammering, Hubbard said, “We have the right to go places like anyone else, but we can't. I'd like to put (Mayor Bill) McNichols in a wheelchair tor about a month." Two years ago Atlantis staged a protest against the Regional Transportation District for failing to provide adequate means for disabled people to ride the bus. Bob Conrad, co-administrator of Atlantis, said the group was not protesting RTD this time. By 1982, RTD expects to make its bus system the nation's first that is fully accessible to the physically handicapped. CONRAD SAID the city has been “pretty responsive" in the downtown area to the needs of handicapped people, but it has not responded to particular curb problems elsewhere. He said, “The city only cuts curbs that have been damaged" and added that the city budget no longer provides money for cutting undamaged curbs at particular problem areas. Edward Ellerbrock, a spokesman for Denver's Traffic Engineering Department, said there has been less money budgeted for building wheelchair ramps the past two years only because the demand has been less. He said his department met with Atlantis officials less than a week ago for "some brainstorming." He said both sides agreed that Atlantis would start identifying specific spots where ramps were needed and the Traffic Engineering Department would respond to them within the limits of its budget. Ellerbrock said his department is requesting $100,000 to cut curbs and build wheelchair ramps. He added that there is “no guarantee we're going to get it," so for publicity's sake the protest might have had some merit. CONRAD SAID that for a wheelchair person “one curb is just as bad as a flight of stairs." He said handicapped people usually have to wait in their chairs at an intersection until some people come along to help them up the curb. “Unless you're really trained at doing it he said, “you can dump the person out while trying to lift him." Hubbard said he has been hit four times by automobiles “because of these curbs. Once I had to have back surgery." He said he wanted to hammer the curb “just enough to get the message across." After about a half-hour of hammering, cheering, chanting and impeding of traffic, a Denver police car arrived and the group was told to clear the intersection or the protesters would be ticketed. The group agreed to move, apparently believing the point had been made. Denver Police Sgt. Richard Nelsen later said, "They got the publicity they wanted. They're happy. The Denver Post - Thursday October 2, 1975 [Headline] Muscular Dystrophy Wins Battle [Subheading] Mike Died at Atlantis - a Dream Come True by Fred Gillies Michael Smith died Wednesday afternoon in the place where he wanted to be - the Atlantis Community in Denver. Atlantis was Mike's dream come true: a fledgling community where he and 13 other handicapped persons could live in dignity as individuals, attempting to realize their full potential. But the dream died Wednesday for Mike as muscular dystrophy, the dark angel that lived with him for most of his slightly more than 21 years, won the final battle. Mike and other Atlantis residents came into the public view late in June when a Denver Post story told of the hardships they were suffering as the result of bureaucratic bungling which had delayed the Social Security checks the Atlantis residents needed to pay their living expenses there. At that time, Mike was semiconscious and not expected to live. But he later rallied, as he had three other times in the past year when he was close to death. For the past three months, Mike generally had been confined to his bed and most of the time used an oxygen tank to ease his breathing. In recent weeks, Mike had started composing poetry again — one of his favorite pastimes and the one that seemed to allow, him to escape from the physical helplessness forced upon him by muscular dystrophy. Mike also was following closely the progress of a legal action that he and other handicapped persons had filed in Denver federal court to ensure the handicapped the same rights as all other persons. And with the help of Atlantis staff members, Mike was planning his first vacation in many years: a plane trip to Houston, Texas. Two of the Atlantis staff were to accompany him there. But last Sunday night, Mike's condition suddenly worsened. His kidneys apparently had started to shut down. Carbon dioxide was building up in his body, affecting the brain and causing respiratory problems. Mike was taken Monday to Denver General Hospital, where blood tests were completed. But Atlantis officials said doctors at the hospital concluded that there wasn't much that could be done. And Mike was adamant: he didn't want to undergo another operation to cut into his windpipe to ease his breathing just a little longer. He didn’t want to be hooked up to all kinds of machines and medical equipment. He wanted to be left alone and to he allowed to die in peace and at Atlantis. Mike was permitted to "come home" to Atlantis on Tuesday. But now he was required to wear a full face mask utilizing a nebulizer which sprayed a mixture of oxygen and water steadily into his weakening lungs. On Wednesday morning, Mike twice had been taken off the nebulizer briefly while adjustments were made, and there were no complications, Wade Blank, Atlantis co-director said. But Wednesday afternoon, after the nebulizer had been removed for another swift adjustment, Mike died. “He relaxed, went to sleep and just stopped breathing," said his mother, Mrs. Joanne Davis of Central City, Colo., who was with him. Mike’s mother will fulfill his wish that the only flowers at his funeral be one red rose which she will provide and keep afterward. Mike also had asked that persons planning to send flowers for his funeral might instead send donations to Atlantis at 2965 W. 11th Ave. Early last July, Mike and a friend put together a book of about 35 of Mike's poems, written over the past seven years. At the time of Mike's death, the manuscript still was being circulated among publishers. One of these poems - “With the Wind, I Leave" - tells of Mike’s leaving his love, “leaving the oceans, fields and mountains that were my life.” But then he tells of finding "a peace and wisdom that no one can take away.” And the poem concludes with Mike's quiet admonition: "So when you remember me, think of the oceans, fields and mountains. Think of the wind that blows in the spring and you will know that I am free." Services for Mike will be at 2 p.m. Saturday at the Olinger Mortuary, 16th and Boulder Sts. Rocky Mountain News Sunday March 27, 1977 Disabled are limited by society's attitudes By Alan Cunningham PHOTO by John Gordon, News: A young man (Larry Ruiz) sits in a wheelchair in front of a building. Caption reads: Larry Ruiz is one of those leading better lives of the Atlantis community. Nobody seems to know exactly how many disabled Americans there are - or even how one should define them. In Colorado, the figures are even more sketchy than they are nationally. But one estimate, based on federal statistics, suggests there may be as many as 350,000 disabled citizens in this state. If true, that would mean that 14 percent of the population suffers from some disability. The same projection indicates that as many as 83,000 of these persons as unable to work, keep house or go to school. Gov. Dick Lamm sometimes uses a more conservative figure of 10 percent. But even if that is closer to the truth, it shows that the plight of the disabled is a major problem. It also offers a clue as to why the disabled seem sure to emerge soon as the country's newest civil rights lobby. The have the numbers to make themselves heard - and seen - if they can begin to speak out with a unified voice, demanding their fair share of the American Pie. Until now, they've suffered the fate of most minority groups: invisibility. This is ironic, since most are highly visible if anyone chooses to see them. But for many reasons - not the least a sense of guilt - the able-bodied tend to turn away from those with crutches, wheelchairs and seeing eye dogs. And those who plan public facilities and services often reflect this attitude. It is politically safe for them to ignore the needs of the disabled pretending such persons make up a tiny fraction of the population and thus don't deserve a major share of attention. A myth to be sure. But it is only one of several myths which the Atlantis community, a group home for handicapped persons, in a minority report to the upcoming White House Conference on Handicapped individuals, hopes to destroy. For instance, there is the idea that nursing homes are primarily heavens for the aged and the infirm. The opposite side of that assumption is set forth in the opening chapter of the Atlantis report. Few realize that our nation's institutions also house a great many disabled young persons, some in their early teens. THESE ARE THE victims of our society's response to children and young adults who have muscular dystrophy, cerebral palsy, birth defects, blindness, and neurological disorders, or have survived accidents of varying kinds. But they are there by the thousands, many simply because they were labeled by physicians and psychologists as "retarded" and unable to function normally. It is difficult to imagine a more stifling or inappropriate atmosphere for a young person. It is inhumane to shackle and imprison youthful energy and curiosity into the nursing home routine. Such repressive living leads to anger, hostility and finally to the withdrawal and waste of a battered ego. As the report goes on to explain, the Atlantis group has fought to get more than 30 young men and women out of nursing homes and institutions so as to demonstrate that they can reverse this pattern if given a chance. But, even as it begins to reverse, new problems emerge. Most have to do with obstacles which the world has placed in the way of the disabled person. Again, it has a lot do with society's tendency to act as if he doesn't exist. Funds for rehabilitation programs, both public and private, are so scarce that only a small fraction of the disabled ever benefit from them. A prime example of this comes from State Rehabilitation Director Glenn Crawford, who says his division has determined that 135,000 persons in Colorado are potentially eligible for its services. Yet, in 1976, the division served about 14,300 persons. The figure will inch its way up to 16,000 this year. Such private facilities as the widely acclaimed Craig Hospital also have finite resources. They apply guidelines to decide which applicants will be accepted and which won't. Needless to say, a lawyer whose only disability is the loss of his legs has a better chance than a 19-year-old with no schooling who has lain on his back for most of his life. Funds and facilities for handicapped scarce Those who don't get the help often wind up in the category that Wade Blank of Atlantis refers to as "the losers." He contends that those who work with the disabled have too quickly given up on this group of people consigning them to lives of hopelessness. And he further argues that the implications of this have narrowed opportunities not only for the severely disabled, but for many others with less serious problems. For even those who have escaped the awful label of the "loser" run into obstacles every day. The Atlantis report focuses on many of these obstacles. These are some of the observations: EDUCATION. Many disabled youngsters in the past have failed to get adequate schooling either because they were in institutions or because their families assumed they would never be able to lead normal lives as adults and consequently didn't need to be trained for careers. Even those who went to school often were sidelined into special programs for the handicapped. While academic standards were high in such programs, the students were poorly prepared either intellectually or emotionally, to get along in a world of able-bodied persons. The recommended solution, "mainstreaming"- that is, letting disabled youngsters and adults go to school in the same classroom with everyone else. MONEY. The complexities of the various welfare programs on the county, state and federal level often conspire to keep disabled persons in nursing homes. Counties often find they have to pay more money if a man or woman is living in his own apartments, or in a facility, such as Atlantis, than they do if he or she is in a nursing home. That's because the federal government pays the bulk of the nursing home fee. Likewise, assistance payments are cut off if a disabled person earns more than a pittance in a month's time. The cutoff can be as low as $65. The "maximum level of income"from federal state and county assistance payments is $185. This means many disabled persons are living below the poverty level as it has been defined for other underprivileged groups. The solution as viewed by those who put together the Atlantis report, is to simplify and integrate the complicated payments system. But even more important, to increase payments so that everyone gets the same amount of money whether he is in an institution or out. TRANSPORTATION. The report talks about a number of things here including electric wheelchairs and curb cuts, but is main statement under this heading is that bus systems such as the Regional Transportation District (RTD) should become fully accessible to the disabled. RTD, it contends, has been unresponsive to the needs of disabled would be riders for transportation to work, school and for pleasure trips. Even the special HandiRide service - which RTD often boasts is a frontrunner in the nation - is given poor marks. LAWS. [not legible...] Colorado concerning the disabled in general and the severely physically disabled in particular, the report states. Furthermore, it is not realistic to think that the disabled will get effective legislation passed without having government officials sensitized to the disabled's problems. This may already be changing. Largely due to lobbying by Atlantis, hearings were underway in the General Assembly this week on two bills aimed at helping the disabled. One, a Senate bill now in committee, would allow more Coloradans to receive payments so they could hire home attendants. The other, a House bill, is a "civil rights bill for the handicapped." It would bar discrimination against the disabled. Backers of the latter bill point out that it's needed because the federal civil rights laws, while dealing with the rights of racial minorities and women, have never guaranteed these same rights to disabled citizens. Idealy, says the Atlantis report, Congress and the state legislatures need to weed out laws which are confusing and contradictory, often creating "disincentives"for the disabled to pursue more normal lives. A wholistic approach is needed. JOBS. Virtually every problem mentioned above, plus all the others catalogued in the report, tend to stand in the way of the disabled person who seriously wants to go to work in spite of the lip service paid to the slogan, "Hire the handicapped," many find the doors still closed. The reasons are many and the problems complex. Lack of schooling is a factor. Some disabled persons have languished in sheltered workshops, counting fish hooks and getting paid $10 a month for it, the report says. Others have an education but find that architectural barriers, or the lack of adequate bus service, keep them from getting to jobs they could perform. And attitudes often stand in the way when physical barriers are moved aside. "Perhaps the greatest barrier of all is in the minds of men," the report notes. It advocates more and better training programs, plus affirmative action plans to assure that larger numbers of disabled workers are hired by public and private employers. In an elaborate ceremony several weeks ago, the Atlantis report was presented to Mayor Bill McNichols. But privately some of those connected with the report conceded they didn't expect to see much action on the local level until public policies in Washington and throughout the nation begin to change significantly. That's why the Atlantis group is placing much emphasis on its efforts to make an impression on the Carter administration during its formative period. The time seems ripe for a coalition of disabled groups around the country to launch a concerted civil rights drive on behalf of their "invisible" constituents. And the first test may come April 5, when many groups have threatened to stage a sit-in at offices of the Department of Health Education and Welfare, including the regional office in Denver, if new HEW Secretary Joseph Califano hasn't issued new regulations to implement laws for the disabled. "The disabled have been ignored far too long in this society," declares the Atlantis report. "We are demanding that our rights be addressed. June 12, 1990 - Guardian. 5 Disabled 'ecstatic' as rights act clears House By DIANE COLEMAN The Americans with Disabilities Act, considered by many to be the most sweeping civil rights legislation since the 1964 Civil Rights Act, easily cleared the House of Representatives May 22. It is expected to reach the president‘s desk by July 4. The act prohibits discrimination based on disability in public accommodations, employment, transportation and telecommunications. It is intended to address "rampant, daily discrimination in every sphere of American life,“ Rep. Pat Schroeder, D-Colo., told her colleagues on the House floor. “Mentally retarded persons are kept out of restaurants. Persons with cerebral palsy are turned away from theaters. . . . Employers cite fears of hiring disabled persons because their customers will feel uncomfortable or even repulsed,” Schroeder added. Despite strong opposition from private business and transportation lobbies, chief among them the National Federation of Independent Businesses and Greyhound Lines, Inc. , the Americans With Disabilities Act achieved bipartisan support in both houses of Congress. The House vote was 403-29. Under pressure from the NFIB and the National Restaurant Association, the House version of the bill was amended at the last minute to allow employers to remove people with HIV infection from food handling positions. Sponsored by Rep. Jim Chapman, the amendment passed narrowly, although the Texas Democrat conceded there is no “evidence that‘AIDS can be transferred in the process of handling food.” Tom Sheridan of AIDS Action, representing 500 community-based service organizations, predicted that the Chapman amendment would go down to defeat in the House-Senate conference committee. “It’s a horrible amendment for all people with disabilities because . . . it begins to codify the fact that irrational fear is protected by the law,” he said. Nonetheless at press time Senate conferees had agreed to include the restrictions. “Cheers and tears” filled the House gallery at the moment of the ADA's long-awaited passage, according to Tennessee disabled activist Michael Gibson, “but we all know that the bill is only a first step. Several agencies will be writing key regulations which offer innumerable opportunities to weaken the effect of this legislation,” Gibson said. SOME DELAYS, FEW LOSSES While many activists feared the House would water down the Senate version of the bill, Marilyn Golden of the Disability Rights Education and Defense Fund said that the ADA “has not been weakened anywhere near the extent that much legislation is. " According to Golden, who has worked intensively for the bill's passage over the last two years, various timetables and phase-in provisions were adopted to avoid other forms of compromise. The ADA’s protections against employment discrimination, which parallel those applied to federally funded entities since 1973, do not go into effect for two years. Prohibitions against discrimination in public accommodations, such as theaters and restaurants, will require accessibility in facilities “construct[ed] . . . for first occupancy no later than 30 months after the date of enactment." Telephone companies will have three years to put in place a relay service for deaf people and others who depend on non-voice telecommunication. A requirement that all new public buses be lift-equipped will take effect in only 30 days. Many attribute this to seven years of non-violent civil disobedience by the American Disabled for Accessible Public Transit. Greyhound, a private carrier, was given six years to begin replacing its retired buses with accessible ones. Activists also waged a last-minute battle over employment discrimination remedies. Recently proposed legislation would add damages to the relief available to discrimination victims under Title VII of the Civil Rights Act of 1964. In the face of this, Golden said. the Bush administration tried “to renege on its agreement for parallelism” between the ADA and the 1964 act. It backed an amendment that would have kept remedies for disability-based discrimination at current levels if and when discrimination remedies are increased for other minority groups and women. The amendment was narrowly defeated just prior to the final vote on the bill itself. Overall, Golden said. “We're ecstatic." The ADA “will hopefully begin to convey to the American public. left, center and right (because in some ways I don't think the consciousness of the left is any better), that disability is not a personal issue, that there’s a systematic oppression of people with disabilities. . . . Denver Post 3/13/90 Handicapped stage crawl-in protest up steps of Capitol Slow pace of access legislation attacked By the Los Angeles Times WASHINGTON — Crawling up the Capitol steps to dramatize the barriers confronting them, scores of disabled persons rallied yesterday to protest delays in congressional action on a Senate-passed bill to expand their access to jobs, transportation and public services. The legislation, endorsed by President Bush, has broad bipartisan backing but has been moving at glacial speed through four House committees since it was approved overwhelmingly by the Senate last September. When dozens left their wheelchairs to crawl to the Capitol entrance, spectators’ attention focused on 8-year-old Jennifer Keelan of Denver, who propelled herself to the top of the steep stone steps using only her knees and elbows. The demonstration at the West Front of the Capitol had some of the fervor of a civil rights rally of the 1960s as the demonstrators chanted slogans and sang songs to underscore their message to Congress. Rep. Pat Schroeder, D-Colo., told the crowd: “What we did for civil rights in the 1960s we forgot to do for people with disabilities." Justin Dart, chairman of the President's Committee on Employment of People with Disabilities. told the rally, “Two centuries is long enough for people with disabilities to wait before the constitutional promise of justice is kept.” “If we have to come back, perhaps we’ll simply stay until they pass (the bill),” said I. King Jordan, first deaf president of Gallaudet College for the deaf located nearby, hinting at a disabled camp-in on Capitol Hill. Organizers of the rally said disabled persons from 30 states, including many in wheelchairs, came to demand immediate action on the bill without any weakening amendments. Despite grumbling from rally goers that the Bush Administration and Democratic leaders were relaxing their efforts on behalf of the measure, key advocates predicted the House logjam will be broken in the next few weeks. Chairman Evan Kemp of the Equal Employment Opportunity Commission denied any lack of enthusiasm by the White House. Photo: Tom Olin [Headline] If Heaven Isn't Accessible, God Is In Trouble... by Tari Susan Hartman ADAPT mourns the loss of one of our greatest leaders, Wade Blank, and his son Lincoln. While on a family vacation in Todos Santos, Mexico, Lincoln got caught in an ocean undertown. Wade swam out to save him and both drowned on February 15th, 1993. They are survived by Wade's wife Molly and daughters Heather and Caitlin. Ironically, Wade died in the same way he lived-swimming out into the face of hostile undercurrents, and giving his life to help others fight for theirs. Those who have come to national ADAPT actions remember in the early days Lincoln rode along Wade's back. Later, he walked by Wade's side while Caitlin rode. With his elfish smile, Lincoln quietly drank in all the action at demonstrations, vigils, planning meetings and anything else that came up in his dad's activist life. While other kids play "doctor" or "house", Lincoln played "rally." Wade was born December 4, 1940 in Pittsburgh, PA. After attending an all white high school, he travelled with Dr. Martin Luther King, Jr. to Selma on a dare by a black college roommate. His experiences there taught him the deep oppression perpetuated by our "civilized" society. Once he graduated college, he served as pastor of a church just outside of Kent, OH that became the underground meeting place for the Students for a Democratic Society, SDS. After the Kent State killings, he returned to get a masters degree from McCormick Theological Seminary and was ordained a Presbyterian minister. Burnt out on his past activism and organizing, he moved to Denver and began working in a nursing home. With years of civil rights, war on poverty and anti-war organizing experience, he could not ignore the opression he found there. So he began to deliver Dr. Martin Luther King Jr.'s dream of freedom directly to the doorstep of the disability ghetto: the nursing home. In 1971, while on staff at Heritage House, a Denver nursing home, Wade tried to work within the system to dignifiy the lives of the young disabled residents. A recent ABC-TV movie with Fred Savage entitled "When You Remember Me" chronicled this story. Wade and the resident's efforts were doomed to fail, but they gave birth to a better alternative. In 1974 Wade founded the Atlantis Community-a model for community-based and consumer controlled independent living-named for the lost continent of Atlantis, those easily forgotten and dismissed. The first members of Atlantis were those young adults incarcerated in Heritage House, from which Wade had been fired. Forgotten by [image] [image caption] Wade taking time out from an action. Photo: Tom Olin. [text resumes] the system and often by their families, these individuals were not forgotten by Wade as he began to liberate them from the nursing home into the Atlantis Community. Years later Wade and attorney John Holland masterminded a $32 million lawsuit against Heritage House nursing home for obstruction of justice and violation of civil rights. The case went all the way to the US Supreme Court. Today many of those original nursing home residents are raising families in homes they now own. In 1978, Wade and Atlantis realized that if people with disabilities were to truly live independently, they would need, and should have a right to, accessible public transportation. On July 5-6, 1978 a "gang of nineteen" disability activists and Wade held their first inaccessible bus hostage in the Denver intersection of Broadway and Colfax. Late that night Wade was surprised when US Congresswoman Pat Schroeder handed him a doughnut and a cup of coffee. Atlantis' decision to take the fight for lifts on buses to the national level soon led to the birth of ADAPT (American Disabled for Accessible Public Transit). ADAPT was the nation's first direct action, grass-roots movement of disability activists and mushroomed in over 30 states, Canada, Sweden and England. Like the freedom riders of the 60s, ADAPT's struggle for accessible public transit became a national battle cry of the '80s. Over the course of eight years of bi-annual national demonstrations throughout the country, hundreds of ADAPT activists and their families and friends were arrested for their beliefs and commitment to ensure civil rights for all disabled citizens. Twelve years after the first bus seize, the Americans with Disabilities Act, ADA, mandated lifts on buses. ADAPT's street chant "access is a civil right" echoed in the halls of Congress, as politicians became increasingly aware that ADAPT and the disability rights movement fully expected ADA to be passed as landmark civil rights legislation. ADAPT organized the "Wheels of Justice" march in March of 1990, and Wade played a key role. It was a call-to-action that galvanized the disability rights movement to demand swift passage of ADA with no weakening amendments. Over 1,000 disability Wade, continued from pi rights activists from across the nation joined forces with ADAPT to demonstrate to the world that they were to be taken seriously. On the second anniversary of the signing of the ADA (July 26, 1992), the city of Denver and its Regional Transit District commemorated that historic event by dedicating a plaque to Atlantis/ADAPT and the "gang of nineteen" who held the first bus. Wade refused to have his name engraved on the plaque, but his silent tears at the dedication ceremony revealed the depth with which he felt the issues of disability rights. He had left his mark forever etched in the foundation of our civil rights movement. In 1990, when it was clear that ADAPT had successfully led and won the fight for accessible public transportation with the passage of the ADA, Wade and other national ADAPT leaders convened to plot their next course of action. There was little question for anyone what that next issue would be. ADAPT transformed its mission and became "American Disabled for Attendant Programs Today." Together, ADAPT and Wade returned to the scene of one of society's most heinous crimes the warehousing of 1.6 million disabled men, women and children. These disabled Americans committed no crime, yet were and still are, interred against their wills in nursing homes, state schools and other institutions. They are used as the crop of industries like the nursing home lobby, physicians and their conglomorate owners who continue to get rich by robbing our people of their fundamental civil, human and inalienable rights to life, liberty and the pursuit of happiness. Most of us are spectators sitting on the sidelines of life, learning history from books. Wade, was an active participant in over three decades of political organizing. He taught others how to create and record their own destiny. A brilliant strategist, he helped shaped the tide of the disability rights movement. Yet Wade was never too busy to roll up his sleeves and assist someone with attendant services, push or repair a chair, or drive a van. He stood up for what he believed in and expected others to do the same. In his pursuit to free others [text cuts off] [boxed text] "Some - mostly those who didn't know him - have said that Wade's methods were "extreme." They said that civil disobedience in the eighties and nineties is "passe","obsolete," 'inappropriate." Bullfeathers! The same kind of things were said about Washington, Jefferson, Gandhi, and Martin Luther King. What is extreme, what is inappropriate is millions of human beings living with less dignity than we accord to our pet dogs and cats. What is inappropriate is American citizens imprisoned without due process of law in oppressive institutions and rat infested back rooms. What is inappropriate is tens of thousands of people with disabilities living and begging and dying in the streets. What is inappropriate, what is unspeakably immoral, is a society that cannot be bothered to make the simple changes necessary to give its own children the opportunity of full humanity. "It has been my privilege to work closely with Wade Blank during the last several years. He has demonstrated against a meeting I chaired -when HITS Secretary Louis Sullivan spoke at the 1991 President's Committee on Employment of with Disabilities annual conference in D8118S. We have counseled together by telephone at all hours of the day and mgt. We served together on the ADA Congressional Task Force and in negotiating ADA with the President of Greyhound We marched together for equality in San Francisco, Philadelphia and Washington. We were together in the freezing mid-night outside the barricaded Departmert of Transportation in Washington I never put myself in a position to be arrested. Wade said that was alright, because I could play positive role within the system. I was never sure in my heart if that I was on the right side of the bars. I knew he was. Wade, a passionate Cleveland Browns fan, was a loving husband, daddy, friend, organizer and leader. He valued and encouraged the unique contributions that each of us has to give to ourselves, each other and the world around us. We honor his contribution, value his friendship, and grieve the loss of our beloved friend and colleague. Wade was one of the few non-disabled allies of the disability rights movement who understood the politics of oppression. At times through the years, his leadership role was questioned, but he never lost sight of the vision, nor lacked the support of those he was close with. [Headline] Health-care industry, Newt, Shalala forced to ADAPT or perish The national action of the Americans Disabled for Attendant Programs Today can easily be summarized. As they have for several years, the hundreds-strong national organization of the disabled went to Washington to pursue their goal of more federal support for home care and other programs instead of massive subsidy of the nursing home business. Here's how ADAPT leaders summarized it: Newt saw. Newt ran. Newt slept in a hotel. Donna Shalala, secretary of Health and Human Services, saw (Monday). Donna Shalala came (Wednesday). Donna Shalala was impressed. Donna Shalala wrote a letter supporting ADAPT's Community Attendant Services Act. The Health Care Finance Administration Director saw. HCFA met with more than 30 local ADAPT groups and plans to learn more. HCFA came. HCFA is beginning to understand. Manor Care corporation saw. Manor Care heard the issues and the demands. Manor Care locked their doors. Manor Care learned what nursing home life is like--Welcome to the nursing home, you can't get out! ADAPT's lawyer is working on the tickets given to 110 arrestees. The 700 leaders at the ADAPT conference made progress on their goal of a new law to provide a community-based alternative-to nursing homes and institutions for people with developmental dis-abilities. Called CASA, the Community Attendant Services Act, the law they propose would redirect the huge federal subsidies to the nursing home industry toward community-based alternatives that treat people with dignity. Newt Gingrich's landlords at 110 Maryland Ave., N.E. must be getting tired of seeing activists of every stripe trample their lawn. Just weeks after NPA visited the building on the last Sunday in April, ADAPT showed up twice in two days , barring entrance to the building for most of one day. Although they won't meet with Newt until September, Shalala did come to the conference, where she read a statement of support for the organization's goals. "I want to take this opportunity to reaffirm our support for the principles of emphasizing home- and community-based services and offering consumers the maximum amount of choice, control, and flexibility in how those services are organized and delivered," Shalala told the four hundred people gathered at the conference. Maybe the best summary came from Norbert Holmblad, who wrote in the group's magazine, Incitement: "This is the first time I completely crossed the line on something this large and important....I'm sure they won't forget or easily forget the messages that our pathetic, ragtag, but very powerful group made." - (4.81) Incitement v.1 n.1 p.4
