Title: APTA still says no to lifts Wheelchair activists cross into Canada Wheelchair militants chased their arch enemy over the border into Canada in October, but unfortunately for advocates of accessible transit systems, the American Public Transit Association (APTA) not only came back but found time in between dodging wheelchair barricades and attending panel discussions to veto mandatory lifts on buses. APTA's board of directors voted unanimously at their national convention in Montreal to reaffirm its policy of local option while continuing to study proposals made by its Elderly and Disabled Services Task Force. APTA has been fighting mandatory lifts since the Carter administrations' Department of Transportation (DOT) first ordered transit companies to install lifts in 1979. APTA lost in U.S. District Court in 1980 but won in 1981 when the U.S. Court of Appeals ruIed that the DOT regulations were not required by Section 504 of the Rehabilitation Act of 1973. In 1983 wheelchair activists in Denver formed the American Disabled for Accessible Public Transit (ADAPT) and picketed APTA's national convention being held in Denver. ADAPT chapters rapidly sprang up in other cities, and APTA delegates soon grew used to having their annual conventions and regional meetings disrupted by hundreds of demonstrators in wheelchairs. This year's meeting in Montreal was no different. As usual, local police threw up barricades in front of the conventioneers' hotels, and as usual, wheelchair demonstrators hurled their chairs and bodies at police lines. And, as usual, they were arrested. "City police crush wheelchair protest," headlined the Montreal Daily News, next to a picture of police removing demonstrators from their chairs and passing them over the barricades. Protester Lori Taylor said the police had no right to take her husband's chair away from him. "They separated him from his legs," she said. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Police maintained that they had a right to remove Lester Taylor any way they could after he deliberately crashed his way through a metal barrier in front of the Queen Elizabeth Hotel. Taylor was taken into custody, along with 24 other demonstrators. Many of those arrested were from Colorado, including Mike Auberger, who chained his wheelchair to a handrail in the hotel lobby. Also among those "arrested" was a seven-year-old-girl from Scottsdale, Ariz. Jennifer Keelan, who has cerebral palsy, was taken into custody along with her mother Cynthia. Both mother and daughter were released later that day without charges being filed against them so that they would not be separated overnight. Cynthia Keelan said the police lifted Jennifer and her chair onto a police van using the kind of lift she and Jennifer would like to see put on every bus. She said she was very proud of her "very, very brave little girl," although a police spokesperson was quick to point out that it was the mother, not the daughter, who was actually being arrested. Most of those arrested were U.S. citizens, although a few Canadians did join the pickets. Maria Barila, a Montreal resident who was arrested, said potential Canadian demonstrators had been warned by one government agency that they could lose their welfare checks if they were arrested. Montreal police had received reports from the six U.S. cities in which ADAPT had previously picketed APTA conventions and had prepared accordingly, down to issuing officers kneepads in case wheelchair militants attempted to run their chairs into police. If you have it and can send a picture we would be very grateful. ] Second article: RTD firm in commitment to accessibility RTD has been named one of the nation's most accessible public transit systems by the American Disabled for Accessible public Transit (ADAPT), and it continues to show every sign of improving that system. On Nov. 1, RTD became one of the first transit systems in the country to offer accessible public transportation on intercity routes when 35 lift-equipped buses began rolling between Boulder and Denver. The Neoplan buses replace Yellow Cab service. Critics of lifts on intercity buses argued that they were too costly and took up to much space on already crowded buses, but when Neoplan submitted its bid to RTD, the cost was so low that the transit agency was able to buy additional buses. RTD says its new regional service shouldn't cause any delays, since its buses are already operating at a 95 per cent on-time rate. The lift-equipped buses operate between Boulder, Broomfield Park-n-Ride, Market Street Station, Stapleton Airport. and Longmont. Regular fares on the Regional AFB arc: Boulder to Broomfield, $1.25; Broomfield Park-n-Ride to Denver, $1.25; Boulder-Denver-Stapleton, $2.00. The fare for disabled individuals traveling during off-peak hours (9 a.m. to 4 p.m.) is 104. Regular monthly passes are $68; disabled riders pay $44 with their RTD Handicapped I.D. card. Ten-ride coupons are also available for this service at a cost of $18. For additional information regarding the new accessible regional service or for trip planning needs, call 777-3343 until 10 p.m. RTD also announced a get-tough policy on non-function lifts on buses being operated by private contractors. Some buses on accessible routes are now operated by private companies, even though the drivers still wear RTD uniforms and the buses carry the RTD logo. Every time one of those buses gets stopped and its lift isn't working, RTD will automatically levy a $100 fine against the private transit provider. The Cincinnati Post May 27, 1986 Wheelchair protesters freed early Post staff report A motion for early release of three wheelchair-bound activists was granted today by Hamilton County Municipal Court Judge J. Howard Sundermann Jr. On Friday, Sundermann sentenced Michael Auberger of Denver, George Cooper of Dallas and Bob Kafka of Austin, Texas, to 10 days in jail for their part in a protest last week at the main office of Queen City Metro. Attorney Joni Wilkens had argued against a jail term for health reasons. Today Sundermann ordered the three released after serving six days of their sentences for trespassing. Before granting the motion for early release, Sundermann asked them if they planned to go to another city and “do the same thing?” Auberger and Kafka said no, that they planned to return to their homes. Cooper did not reply.w “I think we made our point. The issue (of access to public transportation) won’t go away,” Kafka said following the hearing. Auberger, Cooper and Kafka are members of Americans Disabled for Public Transportation, which demonstrated against the lack of access by the handicapped to Queen City Metro buses. - ADAPT (201)

RTD Chief Is Given Wheelchair Handicapped Want Official to Experience Bus Problems First By JUDITH BRIMBERG Denver Post Staff writer To promote sensitivity “from the top," Denver's disabled community on Wednesday gave RTD‘s executive director, L. A. Kimball, a wheelchair and urged he ride the bus in it at least once a week. Kimball accepted the chair “in that good spirit“ and promised to use it as time allows. He refused to tell reporters exactly when he would simulate the plight of the handicapped. The exchange occurred at the first of a series of meetings mandated by a court settlement of a dispute between RTD and some handicapped Denver residents. More than 80 handicapped people or their representatives attended the session, held at the Plaza Cosmopolitan Hotel in downtown Denver. The handicapped had objected to the transit agency's reversal of a decision to install wheelchair lifts on 89 articulated buses which will go into service next year, pointing out federal funds are available to pay 80 percent of the cost. Those funds will remain unspent. Until RTD decides upon another operational use for them or the federal government takes the money back. Kimball has acknowledged. Below are the descriptions of the highlighted places: [Headline] "Mapping the Denver Disability Movement's History" [Subheading] McDonald's Restaurant E. Colfax & Pennsylvania St. This restaurant was built in 1985. It replaces an earlier inaccessible McDonald's, which was the first to be blocked by Atlantis activists in 1984. The furniture was bolted to the floor, restricting access for customers with disabilities. Wheelchair users were referred to the drive-up window. After blockades at McDonald's in seven cities, and many arrests for civil disobedience, restaurant officials agreed to develop access requirements so that all travelers could be assured of a meal and restroom. McDonald's also agreed to use disabled actors in their ads, a trend since adopted by many companies. [Subheading] "Groundbreaking" Curb Cuts E. Colfax & Colorado Blvd. At this site in 1980, Atlantis protesters using wheelchairs swung sledgehammers to make way for needed curb ramps. City officials had refused to start planning for curb cuts, stating that it would be impossible to ramp all 44,000 curbs in Denver. Publicity from the sledgehammer action convinced officials to establish a curb cut program, and all Denver curbs are expected to be accessible by the year 1996. [Subheading] Radisson Hotel 16th St. Mall/Tremont Pl. This was the site of the first demonstration by ADAPT (American Disabled for Accessible Public Transit) in October 1983. The nation's transit officials were meeting at the hotel when disabled protesters blocked every entrance. Then Secretary of Transportation Elizabeth Dole, the keynote speaker, was forced to sneak in through a tunnel. During the next seven years, ADAPT continued to protest the policy of “local option," which allowed cities to offer separate, very limited van services, rather than to equip regular buses with lifts. ADAPT members disrupted meetings, blocked inaccessible buses, and committed other acts of civil disobedience for their cause; hundreds were arrested. These actions, and the national media exposure they gained, finally prompted the federal government to require lifts on all new buses. [Subheading] Air Force Academy Chapel Colorado Springs This most-visited tourist attraction on Colorado's front range became accessible only after Atlantis activists staged a “crawl-in" up the steps in 1986. The sight of hundreds of people trying to step over protesters created pressure to force the installation of an elevator in this tax-supported academy. [Headline] Advocates of disability rights hold sit-in in support of transit ruling By CLARENCE MATTHEWS Staff Writer About a dozen members of disability-rights groups held an impromptu sit-in in the lobby of U.S. Attorney Joe Whittle’s office in Louisville in support of a federal court ruling that public transit must be accessible to disabled passengers. The sit-in was orderly, and the group left about three hours after entering the office. A 3rd U.S. Circuit Court of Appeals panel ruled 2-1 last month that lift-equipped buses are part of Congress‘ mandate to make public transportation more accessible to the disabled. The court also ordered the U.S. Department of Transportation to rewrite regulations that let cities offer the disabled alternative services, such as van rides. It said the 24-hour reservations required for such services hinder use of mass transit. Representatives of local disability-rights groups began demonstrating at ll:30 a.m. outside the Federal Building at Sixth and Chestnut streets. They formed a noon-hour caravan of wheelchairs for the trip to the U.S. attorney's office on the 10th floor of the Bank of Louisville building at Fifth Street and Broadway. Demonstrators asked that the U.S. attorney call John Sununu, the White House chief of staff, to tell President Bush to instruct federal officials not to appeal the decision. When told Whittle was ill, the demonstrators asked to meet with an assistant. Arthur Campbell Jr., a spokesman for the group, told Assistant U.S. Attorney Terry Cushing, “This ruling; gives us the freedom that the rest of society takes for granted." Cushing promised to pass their request on to Whittle. "Can’t you do that now?" a demonstrator asked. Cushing said he couldn't because someone was waiting in his office, but promised to do it later. “We’ll wait until Monday if necessary," another group member said. They left about three hours later, after Cashing called Whittle and several members of the group spoke to him. "He (Whittle) asked me to take some additional information from them about the case, and they left," Cushing said. The demonstration was part of a nationwide observance sponsored by American Disabled for Accessible Public Transportation, a plaintiff in the federal Court case, and other disability rights groups. - ADAPT (344)
Cheyenne Tribune 9/27/87 Title: Disabled to Protest for Public Transit Access SAN FRANCISCO (UPI) - Hundreds of disabled activists say they will demonstrate for more access to public transportation during the American Public Transit Association's four-day meeting, which starts Sunday. Organizers of the protests, aimed at making a point to 4,000 delegates from 400 public transit systems, expected more than 600 handicapped and disabled people from all over the country to participate. Groups including the September Alliance for Accessible Transit have been trying for years to get the APTA, the nation’s public transit lobbying arm, to declare a national policy giving disabled people the same access to buses and trains as able commuters. “If it were women or blacks who couldn't get on the bus, it would clearly be a civil rights issue," said Kitty Cone of the Berkeley, Calif., group. Her organization and Denver-based American Disabled for Accessible Public Transit threaten to block city streets, hotel lobbies and entrances to the Moscone Convention Center to show delegates how it feels to be denied access. Some demonstrators also promised to invade banquets and cocktail parties attended by delegates. “We are not going to allow these people to have a good meal,” said Bill Bolte of the Denver organization. He was arrested earlier this year for a demonstration at a transit meeting in Phoenix. The transit group's policy is that questions of access should be left to local transit districts. “Mainstream access may work well in the Bay Area but don't tell systems in Akron, Ohio, or Buffalo, N.Y., that they have to do the same thing,” said Jack Gilstrap, executive vice president of the association. He said many systems in smaller areas cannot afford to renovate buses and trains or to purchase new vehicles, so have chosen to provide door-to-door van service for the disabled. He also said that protests or no protests, no major policy changes were expected to be adopted during the meeting. Federal regulations approved in 1986 give local agencies the option of using mainstream or so-called paratransit services, such as the door-to-door vans. - ADAPT (317)
Tues., April. 7, 1987, The Phoenix Gazette Title: Vice mayor derides disabled group's tactics By Pat Flannery, The Phoenix Gazette Vice Mayor Howard Adams denounced the tactics of a group of wheelchair activists protesting in Phoenix, saying their actions cloud the “tremendous job” the city has done to make public transit accessible to the disabled. The American Disabled for Accessible Public Transit has staged several protests in the city to dramatize its demand that all public transit buses in the nation be equipped with wheelchair lifts. On Monday, about 30 wheelchair-bound protesters blocked two entrances to the Mansion Club in an effort to prevent 40 American Public Transit Association conventioneers’ spouses from attending a luncheon there. The delegation had arrived via a taxpayer-supported Phoenix Transit charter bus. In a later incident at the Hyatt Regency Hotel in downtown Phoenix, police said five protesters were arrested and charged with disorderly conduct. The were: Marilyn Golden, 33, of Oakland, Calif.; Arthur Campbell Jr., 43, of Louisville, Ky.; Kenneth Heard, 36, of Denver; Chris Hronis, 47, of Haywood, Calif.; and Robert Conrad, 38, of Dallas. ADAPT has staged protests in every city in which the APTA - an industry lobbying group — has held a major convention. The APTA is holding its Western regional conference this week at the downtown Hyatt Regency. “Arizona and Phoenix have absolutely nothin to be ashamed of,” Adams, who himself uses a wheelchair, told the editorial board of The Phoenix Gazette and The Arizona Republic Monday. “At this point, disruption doesn't serve the cause," Adams said. The Phoenix Mayor's Committee on Employment of the Handicapped has taken the same position, saying in a position paper that it endorsed the protesters’ goal but not their methods. “The type of demonstration usually conducted by ADAPT serves only to shed a very negative light on a very worthy cause," committee chairwoman Michelle Goldthwaite wrote. APTA has been ADAPT’s primary target since 1982, when APTA successfully fought a federal regulation requiring all city transit systems to equip at least half their buses with lifts to qualify for federal funds. But Adams said the local protests could unfairly malign the city's efforts to meet the needs of the Valley's disabled. "l would hate for the public to think overall that this is aimed at Phoenix," he said. City transit director Richard Thomas said Phoenix is doing “reasonably well" to accommodate the needs of the disabled through a mix of lift-equipped buses, “dial-a-ride” vehicles and an experimental program in which private transportation for the disabled is subsidized by the city. - ADAPT (242)
