June 12, 1990 - Guardian. 5 Disabled 'ecstatic' as rights act clears House By DIANE COLEMAN The Americans with Disabilities Act, considered by many to be the most sweeping civil rights legislation since the 1964 Civil Rights Act, easily cleared the House of Representatives May 22. It is expected to reach the president‘s desk by July 4. The act prohibits discrimination based on disability in public accommodations, employment, transportation and telecommunications. It is intended to address "rampant, daily discrimination in every sphere of American life,“ Rep. Pat Schroeder, D-Colo., told her colleagues on the House floor. “Mentally retarded persons are kept out of restaurants. Persons with cerebral palsy are turned away from theaters. . . . Employers cite fears of hiring disabled persons because their customers will feel uncomfortable or even repulsed,” Schroeder added. Despite strong opposition from private business and transportation lobbies, chief among them the National Federation of Independent Businesses and Greyhound Lines, Inc. , the Americans With Disabilities Act achieved bipartisan support in both houses of Congress. The House vote was 403-29. Under pressure from the NFIB and the National Restaurant Association, the House version of the bill was amended at the last minute to allow employers to remove people with HIV infection from food handling positions. Sponsored by Rep. Jim Chapman, the amendment passed narrowly, although the Texas Democrat conceded there is no “evidence that‘AIDS can be transferred in the process of handling food.” Tom Sheridan of AIDS Action, representing 500 community-based service organizations, predicted that the Chapman amendment would go down to defeat in the House-Senate conference committee. “It’s a horrible amendment for all people with disabilities because . . . it begins to codify the fact that irrational fear is protected by the law,” he said. Nonetheless at press time Senate conferees had agreed to include the restrictions. “Cheers and tears” filled the House gallery at the moment of the ADA's long-awaited passage, according to Tennessee disabled activist Michael Gibson, “but we all know that the bill is only a first step. Several agencies will be writing key regulations which offer innumerable opportunities to weaken the effect of this legislation,” Gibson said. SOME DELAYS, FEW LOSSES While many activists feared the House would water down the Senate version of the bill, Marilyn Golden of the Disability Rights Education and Defense Fund said that the ADA “has not been weakened anywhere near the extent that much legislation is. " According to Golden, who has worked intensively for the bill's passage over the last two years, various timetables and phase-in provisions were adopted to avoid other forms of compromise. The ADA’s protections against employment discrimination, which parallel those applied to federally funded entities since 1973, do not go into effect for two years. Prohibitions against discrimination in public accommodations, such as theaters and restaurants, will require accessibility in facilities “construct[ed] . . . for first occupancy no later than 30 months after the date of enactment." Telephone companies will have three years to put in place a relay service for deaf people and others who depend on non-voice telecommunication. A requirement that all new public buses be lift-equipped will take effect in only 30 days. Many attribute this to seven years of non-violent civil disobedience by the American Disabled for Accessible Public Transit. Greyhound, a private carrier, was given six years to begin replacing its retired buses with accessible ones. Activists also waged a last-minute battle over employment discrimination remedies. Recently proposed legislation would add damages to the relief available to discrimination victims under Title VII of the Civil Rights Act of 1964. In the face of this, Golden said. the Bush administration tried “to renege on its agreement for parallelism” between the ADA and the 1964 act. It backed an amendment that would have kept remedies for disability-based discrimination at current levels if and when discrimination remedies are increased for other minority groups and women. The amendment was narrowly defeated just prior to the final vote on the bill itself. Overall, Golden said. “We're ecstatic." The ADA “will hopefully begin to convey to the American public. left, center and right (because in some ways I don't think the consciousness of the left is any better), that disability is not a personal issue, that there’s a systematic oppression of people with disabilities. . . . STORY 1: by Vonne Worth Protest marches last month may influence passage of a strong Americans with Disabilities Act soon. 1500 join in Washington, DC demonstrations to pass ADA in House On March 12, Americans with Disabilities for Accessible Public Transportation (ADAPT) marched from the White House to the Capitol Building, said Mike Auberger, an organizer with ADAPT. About 1500 people from all over the country with many different disabilities took part, he said. At the White House, a spokesperson "reaffirmed President Bush's position that he wanted to see the Senate version of the Americans with Disabilities Act (ADA) passed intact," Auberger said. The ADA is a civil rights act for persons of disability which prohibits discrimination in employment, transportation, public services, public accommodations, and telecommunications. It has passed the Senate and is now in the House of Representatives, where some business interests are lobbying heavily against it. ADAPT was demonstrating to work for passage of the ADA, according to Auberger. After the march to the capitol, several speakers talked to the crowd. They included Rep. Patricia Schroeder (D-Colo.); Rep. Major Owens (D-N.Y.), one of the sponsors of the ADA; Justin Dart, of the Congressional Task Force on Rights and Empowerment of Americans with Disabilities; Jim Brady, former President Reagan's press secretary; Auberger, and others. Then there was a crawl up the steps of the capitol. "The reason for the crawl was to let everybody in the House know that we're not going to let any obstacle stop us from having the ADA passed," Auberger said. “It wasn't to gain sympathy or to gain votes." ADAPT protesters marched to the rotunda the following day, March 13, and took over the rotunda. 104 of them were arrested. March l4, ADAPT demonstrators went to the Sam Rayburn Building. “We took over [Rep.] Bud Schuster's (R-Pa.) office who's the minority chairman of the Transportation Committee," Auberger said. “He's been the one within the Transportation Committee who's tried to add amendments like ‘Cities under 200,000 would not have to lift-equip their vehicles." “Also he was going after inclement weather—if you had too much snow, like we have here in Denver, you wouldn't have to have lift-equipped vehicles even though we already do. We have an average of 60 inches of snow a year," Auberger related. “Most of those amendments were defeated," Auberger added. “At the same time, we met with Hamilton Fish, (R-NY) who is the minority chairman of the Judiciary Committee," Auberger said. The ADA is undergoing constant attempts to weaken the remedy section; however, Fish didn't seem aware of this, according to Auberger. But Fish sat down in his office with about 30 disabled people and "talked with us probably for about a half hour and made a commitment that he would do everything within his position as minority leader of that Committee to see that there isn't any weakening and we were also at the Judiciary Committee Offices and we were working on setting up a meeting with Attorney General Thornburgh because he was the one who had been raising the issue of weakening the remedies section," Auberger said. “They were working on that and they tried to stall so at about seven o'clock, they were closing the capitol, we all refused to leave from Bud Schuster's office and from the Judiciary Committee and there were 60 people arrested in those offices and we got out about one o'clock that night," Auberger related. He said the demonstrations seemed to work. “lt clearly had this real effect on the hill when you went up there." They clearly were educated very fast over those two days,” Auberger commented. “Now as a result of that demonstration and one in Philadelphia, the Department of Transportation (DOT) has rewritten the final regs to require all mainline systems to be lift-equipped into the future and to provide paratransit for those people who cannot get to the bus stop. These are new regs that have 90-day comment periods—the transit industry is not going" to oppose them,” he explained. Also, ADA should come to the House for a vote soon. It will be brought the the floor within 60 days and there is a lot of support for the bill, said Charles Siegal, from Speaker Foley’s press secretary’s office. ADA went through the Energy Committee without any amendments and no changes from the Senate version, Auberger indicated. “That happened while we were there and I'm sure that's why it happened that way," he said. STORY 2: by Vonne Worth A protest in Washington, D.C. by a disability group has resulted in the filing of a half-million-dollarlawsuit against the District of Columbia Court System. Americans with Disabilities for Accessible Public Transportation (ADAPT), many in wheelchairs, crawled up the stairs to the nation ’s capitol and took over the rotunda on March 13. They demanded to talk to Speaker of the House Tom Foley (D-Wash.) and Minority Leader of the House Robert Michel (R-Ill.) about passage of the Americans with Disabilities Act (ADA). “He [Foley] was not happy to come to meet with us" said Mike Auberger, organizer with ADAPT. "He didn't seem to have met with a lot of disability groups, he didn't quite know how to respond to that many disabled people and he talked about him pushing and speeding up the process and he tried to explain ‘we don’t understand the legislative process,’ and we said, ‘of course, we do, we're not totally stupid, just disabled.” “And Michel pretty much came out with the same sentiment and we let him know that he and other Republicans could be targets of the demonstration later in the week simply because they put more and more and more weakening amendments into the ADA,” Auberger added. The talk seemed to break down and the Capitol Police were called. “They were continuing to speak, we heard enough and so we were pretty much just chanting at that point ‘ADA now, now less,"' Auberger said. “At the point where we decided people could get arrested, all went to the center of the rotunda and circled there and several of us chained ourselves together with kryptonite locks," Auberger related. Within 15 minutes, 104 people, most of them in wheelchairs, were arrested, Auberger indicated. Then the police couldn’t cut through the locks. “They tried bolt cutters, they tried two different types of bolt cutters, they didn't work, so they had to bring in a hydraulic bolt cutter and it finally did work on the first one, but it broke on the second one, so they finally tried the bolt cutters again and they went through this whole process of getting these 104 people who were chanting in the middle of the rotunda ‘ADA now’ out," Auberger said. “It took about two and a half hours to get everybody out of the building since they only used one elevator which could take only one person at a time," Auberger explained. “At 1:28 Eastern time, they had to close the capitol to the public so that they could ‘get rid of all those rowdy disabled people." “They didn't have lift-equipped vehicles, so they had to lift everybody into vans and it took four or five officers to lift each chair into a van and they drive off with two chairs to a van to the police station, and then it took four or five more officers" to get them off, Auberger said. “They took everybody to police headquarters where they booked everybody and released them the next moming about one o'clock," Auberger related. It took 12 hours for the police to book 104 people. “This was a major process, them getting everybody out there," Auberger said, “lt was just a nightmare for them." The next afternoon, they went to the Sam Rayburn Building and took over offices of the congressmen on the Transportation and Judiciary Committees. About 60 people were arrested that day. The next two days were spent in court, Auberger said. “The majority of people ended up paying $10 in court costs and suspended sentences and that was pretty much it,” Auberger said. “There were five people who were given probation in their own cities from six months to a year just for being, I would suspect, ringleaders," he said. The judge in the case was disabled. “He had an arm that he couldn’t use at all,” Auberger said. Auberger said he felt the judge wasn’t sympathetic to the case. “His position was ‘You write your congressman if you want to change things,”’ Auberger said. “We all did that, clearly. It didn’t do a damn bit of good, but he wasn’t going to hear that. He pretty much gave out fines, four of them were for $100 and ten day suspended sentences and mine was $500 and a 20 day suspended sentence plus I have the longest, a year probation in-my city.” Auberger said it was rare for courts to send probation orders back to one’s home city. “Ironically, what was so incredible was the next day, when we went to file our probation papers, the building we were supposed to file our probation papers in was inaccessible,” Auberger said. “We come back to the courthouse, we talked to our attomey; unfortunately, the judge wasn’t around.” “They [had] put us all on probation and then we couldn’t get into the building to do the probation. Well, then, they told us, ‘Do it out in the hall by the courtroom.’.No. That's unacceptable. If everybody else goes into the building, we should be able to as well.” “So we’ve now filed a half a million dollar lawsuit against the District of Columbia Court System for denying us our civil rights.” About 250 people took part in the action. New York Times NATIONAL Tuesday March 13, 1990 Bill Barring Discrimination Against Disabled Hits Snag By STEVEN A. HOLMES, Special to The New York Times WASHINGTON, March 12 — Having strongly supported a comprehensive bill in the Senate to extend civil rights protections to 43 million Americans with physical and mental disabilities, the Bush Administration is balking at efforts to toughen penalties against businesses that do not comply. Officially, the White House has not withdrawn its support for the bill, which would require all new buildings and services used by the public to accommodate the disabled. “We do support the legislation," the White House spokesman, Marlin Fitzwater, said today. "We‘re very supportive of their rights and their cause." But other Administration officials said President Bush was reluctant to support the measure if its backers persisted in seeking penalties for job discrimination that are harsher than those in the Civil Rights Act of 1964. That law bars discrimination on the basis of race, sex and national origin and limits penalties to court injunctions directing a business to stop discriminating and to reinstatement and back pay for those dismissed or not promoted as a result of bias. Both the disabilities bill passed by the Senate and one pending in the House state that penalties for violating the anti-discrimination provisions will be the same as those in the Civil Rights Act. Letter From Attorney General But a new bill introduced in both the House and the Senate last month would toughen the penalties in the 1964 law to allow for compensatory and punitive damages. Thus it would affect those in the disabilities bill as well. Sponsors say chances for passage of the proposed changes in the Civil Rights Act are good. Attorney General Dick Thornburgh, in a letter sent tonight to Representative Steny H. Hoyer, Democrat of Maryland, the chief sponsor of the House bill, said the Administration would seek to amend the disabilities bill to delete any link to the 1964 act and to lay out specifically what the employer sanctions would be. A spokesman for Mr.Thornburgh, David Runkel, said tonight that the Administration does not want the penalties in the disabilities act to go beyond the court injunctions and reinstatement and back pay now in the 1964 law. Senior Administration officials said the White House may withdraw its support from the bill if it is unable to delete any reference to the 1964 legislation. The disabilities measure, which passed the Senate in September by a vote of 76 to 8, has 246 sponsors in the House and passage seems virtually assured. Alixe Glen, a White House spokeswoman, declined to say whether the President would veto the bill if it continues to be linked to the civil rights laws. Rally by Disabled People The maneuvering over the bill came as more than 250 disabled people, many of them in wheelchairs, held a rally at the White House and then moved on to the steps of the Capitol to press for prompt House passage of the disabled rights bill. "Too often disabled people are seen as objects of charity or pity," Bob Kafka, a quadriplegic from Austin, Tex., said. "We're here to change that image. And we're here to send a message to the President and to Congress that this bill needs to be passed with no weakening amendments." If passed in its current form, the Americans with Disabilities Act would be the most sweeping civil rights law enacted since the landmark 1964 act. It mandates that all new buildings used by the general public, including restaurants, lodgings, places of entertainment, doctors’ offices and other establishments, provide the disabled with the means to enter and exit and that existing businesses make appropriate modifications if that can be done without creating a financial burden. The bill would also require that new railroad and subway cars and buses purchased by public and private transportation companies be accessible to people with disabilities and that telephone companies provide public telephones that can be used by persons with speech or hearing impairments. It was to gain the support of the White House and Senate Republicans that the bill's backers agreed to link the penalty provisions to those in the 1964 civil rights law. The bill's supporters had wanted to allow disabled people who proved they were victims of intentional and willful job discrimination to sue for compensatory and punitive damages. But the Administration argued that the disabled should not receive protections that were greater than those accorded to women and minorities. With the Administration's backing, the Senate approved the bill. But as it worked its way through House committees, a separate measure, the Civil Rights Act of 1990, was introduced in Congress with the backing of a coalition oi civil rights organizations that includes groups representing people with disabilities. The new measure amends the 1964 law to permit compensatory and punitive damages for victims of job discrimination. DISABILITY RIGHTS ADVOCATES TURN UP THE HEAT IN CAPITOL In more ways than one, the heat was turned up in Washington, D.C. during the week of March 11 to March 17, 1990. Weather records were shattered as the mercury climbed to 89 degrees on Monday and remained hot all week; the cherry blossoms at the Tidal Basin bloomed three weeks early. There was another heat wave going on as people with disabilities from all over the country converged on the Capitol to push for the Americans with Disabilities Act, which passed the Senate last September and is now stalled in the House. On Monday, March l2, we gathered in front of the White House at noon. Over 1000 strong, most in wheelchairs but including people who are deaf and blind, we marched down Pennsylvania Avenue, the 17 blocks to the U.S. Capitol. We carried signs and chanted “ADA Now!" At the Capitol, Justin Dart, chairman of the President's Committee, said that partial equality is not equality: “We want an end to discrimination against the disabled, the nation's most impoverished, isolated and segregated minority." King Jordan, president of Gallaudet University, warned “If we don’t get what we want, we will be back to stay." Mike Auberger, from ADAPT, closed with a stirring speech. “We are Americans," he said, “and we want the same rights as everyone else." After the speeches, many abandoned their wheelchairs and climbed the 83 steps on the west front of the Capitol, as a symbolic gesture dramatizing the barriers that the disabled still face. On Tuesday, many assembled in the huge rotunda inside the U.S. Capitol and heard speeches by Speaker Thomas Foley, Congressman Robert Michel and Congressman Stenny Hoyer of Maryland, who is coordinating the House legislative effort on ADA. Hearing that no promises could be given as to the date of a House vote, many started chanting “ADA Now!" Many were arrested for illegal entry, carried in police vans to a police facility and then to court for paper work. Many did not get back to the hotel until midnight. It was a matter of individual conscience whether anyone was arrested; many chose not to, believing that the legislative process has been working well so far. On Wednesday. about 60 were arrested at the Rayburn Building in and near the office of Congressman Bud Shuster of Pennsylvania, who had supported some weakening amendments to ADA. On Thursday, a small group (their numbers reduced because so many were in court) assembled at housing and urban development and asked to see secretary Jack Kemp; he was out of town but Undersecretary Alfred Dellabovi came down. There was a productive talk concerning the Fair Housing Amendment Act of 1988. Some weakening amendments to the Housing Act, relating to access standards, had been proposed; the disability groups strongly opposed. On Friday, some members of ADAPT protested at the Greyhound terminal. Some of the strongest opposition to ADA has come from Greyhound and other private bus companies, who fear that the cost of wheelchair lifts will be excessive. But the disability groups claim as much a right to be on a bus as anyone else. After a glorious week, the participants began the long journey home by train, bus, airplane or dust-covered van. Though many other disability groups were involved, much credit goes to Wade Blank, Mike Auberger, Bob Kafka, and Mark Johnson, all of ADAPT. It‘s too early to tell whether our goals have been reached, but there was a feeling of solidarity. and of a successful crusade on behalf of equal rights for disabled people in employment, in transportation, in housing, in places of public accommodation, in every aspect of American life. Ralph Neas, executive director of the Leadership Conference on Civil Rights, said the unusual lobbying effort would provide a "final push" to the legislation, which he forecast would clear the House with no more than 100 votes against it. The demonstration at the West Front of the Capitol had some of the fervor of a civil rights rally of the 1960s as the demonstrators chanted slogans and sang songs to underscore their message to Congress. Rep. Patricia Schroeder (D-Colo.) made the comparison, telling the crowd; “What we did for civil rights in the l960s we forgot to do for people with disabilities." Another member of Congress, Rep. Major R. Owens (D-N.Y.), said there are still threats to passage of the bill from conservative lawmakers and powerful business interests who oppose the legislation's provisions on disabled access to transportation. “All the i’s have been dotted and all the t's have been crossed," Owens said. "There have been enough negotiations-delay is the real enemy." Speaking for the Bush Administration however, Chairman Evan J. Kemp Jr. of the Equal Employment Opportunity Commission denied any lack of enthusiasm by the White House. Kemp, who uses a wheelchair, said: "This Administration is more for the bill today than it was 14 months ago.... We have solidarity. Solidarity made Poland free; It can make us free, too." But James Brady, former press secretary to President Ronald Reagan, expressed impatience with Congress’ rate of progress. “l hope these politicians are awake and listening. If not. we'll be back." said Brady, who was disabled when he was shot in the head during an attempt on Reagan's life. Meantime, Atty. Gen. Dick Thornburgh notified key members of the House that the Administration would seek a change in the Senate passed bill to make clear that disabled persons who are willfully discriminated against would not be entitled to monetary damages. The "clarifying amendment" will be introduced during the House Judiciary Committee's consideration of the bill this month, Thornburgh said, adding; "We will . . . continue to support expeditious passage of the Americans with Disabilities Act with this clarification." The Civil Rights March of 1990 On March 12, hundreds of people from across the United States joined a march for the Americans with Disabilities Act that would give America's 43 million people with disabilities rights that other minorities have had for years. Beginning at the White House and ending at the United States Capitol, the demonstrators marched the 19 city blocks chanting ”Access is our Civil Right" and other slogans in favor of ADA’s immediate passage with no weakening amendments. The procession moved slowly in the 89-degree heat as individuals with disabilities and advocates made their way along the streets of the Nation's Capital. Aside from many demonstrators in wheelchairs, banners, handmade signs and colorful tee-shirts made the procession a media extravaganza, as representatives of national, local and many independent news services from around the country covered the event. Camera crews kept focus on the demonstration well after arrival at the Capitol, where a brief ceremony was held. Mike Auberger, an ADAPT organizer and leader of the march, introduced Justin Dart, Chairman of the Task Force on the Rights and Empowerment of Americans with Disabilities and Chairman of the President’s Committee on Employment of People with Disabilities. He gave a rousing address, followed by remarks from Evan Kemp, Chairman of the Equal Employment Opportunity Commission, Congressman Major Owens (D-NY), who marched in the rally, Representative Patricia Schroeder (D-CO), Dr. I. To prod ADA passage Still a mile high following their victory in Atlanta last fall, disabled activists from across the country are planning on rolling on the Capitol Building in Washington, D.C., to demand that lawmakers pass the Americans with Disabilities Act of 1989. The act, which grants sweeping civil rights to disabled people (much as the 1965 Civil Rights Act aided blacks), has passed the Senate but is currently bogged down in four House committees, and no one expects a vote earlier than Feb. 28 by the full House membership. Disabled militants, mostly members of the Denver-based American Disabled for Accessible Public Transit (ADAPT), are planning on arriving in Washington on March 10. "If the bill is still in committee at that time, we're going to treat it as if the bill is in trouble," said ADAPT founder Wade Blank, co-director of the Atlantis Community, a Denver independent living health care provider. Blank said that disabled lobbyists in Washington have warned ADAPT to avoid the confrontational politics that it has used in other cities while battling its arch-nemesis, the American Public Transit Association (APTA). The professional lobbyists said it is not advisable to upset Congress, according to Blank. That's too bad, Blank said, because "we're telling them right here and now that we're going in and kicking ass.” Blank expects several hundred will participate in the march on the capitol, with about 125 of the protesters prepared to leave their chairs and crawl upon the capitol steps while other militants sneak in and seize the rotunda itself. If all that works out, it could be ADAPT’s biggest action so far in its seven-year struggle to force transit companies to put a lift on every bus in the country. The federal government unofficially agreed to support that goal in a deal hammered out between representatives of ADAPT and President Bush in Atlanta last October. Part of that deal called upon the President to push for disabled rights in his State of the Union address, which he did, much to the satisfaction of ADAPT, which Blank described as being “very pleased” with Bush. “Now we're going to smoke out a few Democrats," he said. When the agreement was reached in Atlanta, two cities had already started the process of purchasing non-lift equipped buses. Since then Pittsburgh has reversed its position and agreed to buy only accessible buses, while Albuquerque refused to consider altering its plans. “They’ll go down in history as the last city in America to buy lift-less buses," Blank said. In the months since Atlanta, ADAPT has switched its attention to pushing for lifts on intercity coaches. To that end some 45 wheelchair demonstrators were in Dallas Jan. 21-24 to picket a joint meeting of the American Bus Association (ABA) and the United Bus Owners of America (UBOA). Greyhound, the largest intercity bus company, is headquartered in Dallas. Most of those demonstrators were participating in their first action, which Blank said proves that ADAPT is continuing to grow in strength and power. On the first day, pickets blocked the entrance to the conference hotel with relatively little fireworks. But on Monday, Jan. 22, the protesters hit the Greyhound depot where some 29 demonstrators were arrested for blocking buses. Twenty of those were first-time arrestees. Trial has been set for Feb. 12. On the third day, protesters stormed in the exposition hall and interrupted a trade show demonstrating the latest advances in bus design. Most of that design had nothing to do with helping wheelchair riders get on board, Blank said. UBOA president Wayne Smith, who has published articles in the New York Times arguing against the transit provisions of the ADA, decided not to call in the police, and for three hours militant wheelchair protesters engaged in debate with professional transit providers. “It was a very successful happening,” Blank said. He said he hoped that spirit would hold true for the Washington, D.C., action, where he expects to see more first-time protesters. A seminar on ADAPT’S history and tactics is set for Mar. 10 at the Comfort Inn on H Street in northwestern Washington, where neophyte activists are urged to go even if they are planning to stay elsewhere during the action. Although the ADA covers all disabilities, this action, called the “Wheels of Justice," will center on the rights of the mobility-impaired. Blank said he tried to coordinate his action with other groups, including the National Federation of the Blind (NFB), but was rebuffed. “They don't think of themselves as disabled,” he said. “And that’s fine.” (For more on this topic see Homer Page’s column on page 2, “The ADA and the Blind.”) Some blind advocacy groups, including the NFB, have argued that they don't want adaptive devices, such as special buttons on street corners, written into the bill. “We don't need them," said Page, who is vice president of the Colorado NFB chapter. The New York Times Sunday March 18, 1990 Growth of a Civil Rights Movement The Disabled Find a Voice and Make Sure It Is Heard by Steven A. Holmes Doing whatever it takes to fulfill the promise of a landmark Federal law. WASHINGTON THE pictures were striking, just as they were intended to be: Children paralyzed from the waist down crawling up the steps of the Capitol, and more than 100 protesters, most in wheelchairs, being arrested by police officers in riot gear after a raucous demonstration in the Rotunda. The aim of the demonstration was to press for enactment of the Americans with Disabilities Act, a comprehensive civil rights bill that extends to physically and mentally disabled individuals the same protections against biased treatment in employment, transportation and public accommodations now accorded women and minorities. You can view disability rights as one of the latest chapters in the overall civil rights movement,” said Wayne Sailor, a professor of special education at San Francisco State University. It was not always so. For years, the agenda for the disabled was set by organizations like the March of Dimes and the Easter Seals Foundation, which focused on providing services for the disabled and prying money loose from government and individuals to find cures for such illnesses as cerebral palsy. In the last two decades, however, the attitude of those with disabilities has shifted from being passive recipients of institutional largess and paternalism to demanding a full role in society. “We're not Tiny Tims, or Jerry’s kids," said Bob Kafka, a quadriplegic from Austin, Tex., as he demonstrated outside the White House last week. The disability rights movement was shaped by' a number of scientific, cultural and political forces. In many ways, it is a by-product of the technological revolution. Breakthroughs in medicine, the development of computers that allow the hearing and speech impaired to use telephones, and advancements in motorized wheelchairs have meant more people with severe handicaps live longer, can do more for themselves and have the potential for enjoying fuller lives. "There are people with serious spinal cord injuries who used to die within two weeks that now live 30 or 40 years," said Dr. Frank Bowe, a deaf scholar whose 1978 book “Handicapping America" is to the disability rights movement what Betty Friedan's “The Feminist Mystique" was to the women's movement. “It’s one thing to say we have this marvelous technology, but if nobody‘s going to hire you, what's the point?” As the most efficient means of creating disabled people, wars have always been a factor in advancing the disability rights movement, and Vietnam was a main force. The war added a large number of disabled veterans, already angry over America's indifference to their sacrifice in Southeast Asia, to an army of people with disabilities demanding fairer treatment. The Library of Congress, for example, estimates there are 43 million Americans with some form of disability. In l973, after two vetoes by President Richard M. Nixon, Congress passed Section 504 of the Rehabilitation Act, which barred discrimination against the disabled by any entity receiving Federal funds. But no regulations were written to put it into effect until 1978, after advocates staged a 28-day sit-in. Entrenched Barriers But barriers remained entrenched in the private sector, where the bulk of the new jobs were created in the last decade. "We had no rights at all there," Dr. Bowe said. During the l980's, the disability rights movement struck an alliance with traditional civil rights and feminist groups. As a result, for the first time, discrimination against the disabled was barred in the sale or rental of housing, “Standing alone, we could not have done that," said Pat Wright, director of the Disability Rights Education and Defense Fund, who is legally blind. “But wrapped in the arms of the civil rights community we had a lot more power." The movement has also gained sympathetic ears both on Capitol Hill and in the Bush Administration. Officials and lawmakers who have relatives with various afflictions are more responsive, as are politicians who are increasingly aware that the votes of the disabled are up for grabs. That point became clear after the Republican National Convention in 1988, when, in his acceptance speech, Mr. Bush became the first Presidential candidate to address the problems of the disabled directly. A poll by Louis Harris and Associates taken after Mr. Bush's speech showed that the lead Michael S. Dukakis held over Mr. Bush among disabled voters fell to 10 points, from 33. But advocates say they have just begun. Just as the Government can pass laws that end racial discrimination, but not racism, it can outlaw biased treatment of the disabled but mot mandate acceptance of them. “You can't legislate attitudes," said Ms. Wright. “But the attitudinal barriers will drop the more disabled people are employed, the more they can be seen on the street and when we become not just a silent minority, but full participating members of society. Denver Post Rights bill OK’d for disabled President expected to sign landmark act By The Washington Post WASHINGTON — Amid rare displays of personal emotion, the Senate gave final approval yesterday to landmark legislation barring discrimination against an estimated 43 million Americans with physical and mental disabilities and sent the bill to President Bush, who is expected to sign it. The legislation was overwhelmingly approved by the Senate after several members spoke with deep emotion of the importance of the legislation to brothers, sisters and children in their own families. The Americans with Disabilities Act, which would give the disabled the same civil-rights protections in jobs, accommodations and services that currently apply to minorities, women and the elderly, was approved by the Senate by a vote of 91 to 6. The House, voting 377 to 28, approved it late Thursday. The way was cleared for final action on the measure when House-Senate negotiators agreed Thursday morning to a Senate proposal to drop a provision that would have let employers transfer workers with AIDS out of food-handling jobs. On the Senate floor yesterday, Sens. Tom Harkin, D-Iowa, Orrin Hatch, R-Utah, and Edward Kennedy, D-Mass, visibly struggled with their own emotions as they told of close relatives who were inspirations to them in spite of — or because of — their disabilities. Simultaneously ,'speaking and giving his summation in sign language in tribute to an older brother who is deaf, Harkin, the bill's sponsor, said it “sends the world a clear and unequivocal message that people with disabilities are entitled to be judged on the basis of their abilities and not on the basis of ignorance, fear and prejudice.” “American will be a better place because of the action we take today,” said Hatch, who fought back tears as he told of the inspiration he drew from a brother-in-law "who was stricken by polio and slept nights in an iron lung after working every day until his death. WHEN IS TOO MUCH: "Helping" the Disabled by Mary McKnew Just as airplane pilots want assurance that a plane's steering wheel won‘t come off while flying over Europe, people utilizing a bus wheelchair lift deserve to expect that the lift will operate in a safe and predictable manner. However, I have to admit that too much focus on “safety” issues has me a little worried. To some transit officials, “safety” issues in providing transportation services for people with disabilities raise old stereotypes of helplessness and can quickly become a rationale for imposing paternalistic policies. For example, here in Olympia, the local Intercity Transit Authority and the state's Department of General Administration are co-sponsoring a shuttle service between the capitol and downtown Olympia with routes passing other major states offices. With the local parking problem, this system is extremely convenient. From the beginning, all vans used in the service have been equipped with wheelchair lifts. All this, of course, is very commendable. So, what's the problem? Unfortunately, the van's tie-down system, lack of grab-bars and driver policies reflect a paternalistic attitude towards disabled passengers by promoting dependence in the name of safety. The tie-down system is one of the most primitive I have ever encountered. It uses straps to bind each of a wheelchair's four wheels to the floor in a rather intricate system that takes the driver approximately five minutes to accomplish. To tie-down a wheelchair, the driver must get on his or her hands and knees. Thus, it is not possible for even very mobile wheelchair users to accomplish this independently. However, once the straps are in place, none of the wheels will move even a centimeter. During this five minute routine, other van passengers wait outside (some glancing at their watches) until the driver folds the lift back in place and allows them to board. After being strapped down, the driver then will place a seat-belt around the wheelchair user. Seat belts are not available for other passengers. If the wheelchair user decides to reject use of a seat belt, the driver will attempt (sometimes loud) persuasion, finally telephoning into the office to report that the passenger has refused use of the belt. I use a wheelchair for mobility due to a low and incomplete spinal cord injury. I object to many of the features in the Intercity Transit system that, to me, are designed on the premise that people with disabilities will always need a lot of assistance from the driver. Although the driver should be trained and willing to provide assistance if it is requested, the system should be designed to promote maximum independence. Most tie-down systems can be easily manipulated by most wheelchair uses with finger movement. Although some wheelchair users need a seat belt due to problems with balance, drivers should not assume they are needed by all such passengers. A policy that requires a driver to phone in to report a passenger's rejection of the seat belt is founded on the belief that people with disabilities are incapable of making sound decisions regarding their own safety. Additionally, although grab-bars are located along the ceiling walls of other seats, none are available near the tie-down area. Thus, if the bus lurches while enroute, a wheelchair passenger has nothing to hold onto. I suppose this makes it more likely a wheelchair passenger will comply with the seat belt policy, recognizing that a passive restraint is better than none at all. Intercity Transit has been providing paratranslt services to people with disabilities for a number of years. They have moved into the provision of mainline transportation services (i.e., access to the regular bus service) only recently. It appears that they have simply shifted their operating policies and procedures from one system to the other without considering if these are applicable to the new service. I have brought my objections to Intercity Transit’s attention. Although the staff disagree with most, they are reconsidering others. Safety is a concern to people who use wheelchair lifts. However, we cannot allow it to become a convenient rationale for either eliminating the service or instituting restrictive policies that treat people with disabilities in a disparate manner from other passengers. In 1987, Mary McKnew tried to get arrested for the first time. She sat in front of a San Francisco police van and refused to move. She sat in her wheelchair directly under the wheels of a bus and refused to move. "I did many illegal things." she says wryly. What she did, she did in the name of accessible public transportation for people with disabilities... a personal and political quest McKnew has been following for the past 12 years. Although McKnew wasn't arrested at that demonstration (in spite of her civil disobedience efforts), many others were. More than 500 people organized by the American Disabled tor Accessible Public Transportation (ADAPT) marched through the streets oi San Francisco to the city hall to protest the continuing discriminatory policies supported by the American Public Transit Association (APTA). ADAPT has been a persistent thorn in the side of APTA for many years. Fortunately, their persistence paid off. With the final signing of the Americans With Disabilities Act (ADA) expected any day, ADAPT—- and McKnew — will see many of their demands for fair, accessible transportation become reality. But McKnew says that just because you pass laws doesn't mean you quit being an activist. "The ADA will bring private transit companies under regulations just like public ones," she says, "but just passing a law doesn't mean we solve the problem. implementation is a whole other thing." In part, McKnew was referring to the possibility that some private companies may reduce the seating capacity in some of their smaller vehicles in order to side-step the accessibility requirements mandated by the ADA. "What the ADA will do is provide a clear avenue for lawsuits," she says. Is McKnew planning on handling some of those lawsuits herself? It may be too early to tell. Currently an executive policy assistant in the Office of the Governor, McKnew is also a second-year law student at the University of Puget Sound. Breaking Down the Barriers Civil Rights for People with Disabilities by Yaél Hana Bethiem In 1983 I considered killing myself. l considered this out of a deep despair, an agony over my life. In 1983 I had been diagnosed with a progressive disease. I could no longer work, could no longer sit in chairs and could stand for shorter and shorter periods of time. In other words, I was becoming disabled. I was panicked. How could I live without my physical life, my strength, my independence? What I didn't see at the time was that I was buying into our culture's attitudes about disability. I could not value myself or value my life because the system I had to fight to get my basic needs met, did not value me; l live in a culture that believes that "out of sight, out of mind" is acceptable policy for dealing with people with disabilities. In a culture that values productivity above all else, those who cannot produce, or who need assistance to be able to produce, are considered a burden. Our culture also has a myth called the “American way," which says that if anyone "tries hard enough" he or she can “make it." When applied to people with disabilities this means that if only we “try harder" we can "overcome." We can rise above the barriers, showing superhuman strength, and then we will be more acceptable. This attitude makes people believe the barriers do not need tn be removed. Instead, they think we, the disabled, need to overcome them. In other words, the closer we cart be to “normal," the more we are accepted. Those who cannot become more normal are locked away, out of sight, out of mind. Those of us living within this oppression, for it is oppression, often internalize the culture's attitudes. We believe there is something wrong with us. Millions of people share this fate with me; we are locked away by a society that would prefer to pretend we do not exist. We are imprisoned by attitudes that do not see people with disabilities as fully human; attitudes that expect us to "overcome" (or heal ourselves); attitudes that create barriers, or do not see the barriers that do exist. There are 43 million people with disabilities in the United States. We are one of the most repressed minorities in this country. We are denied access to basic rights, transportation, jobs, and respect. For people with disabilities there are thousands of ways the oppression affects us, thousands of forms of prejudice and visible and invisible barriers. An example of the effects of this oppression is the story of David Rivlin. David was a quadriplegic who, last summer, chose to have his respirator turned off. He went to court to ask for the right to die. His story was aired on TV. I heard people around me say, “l would do that too. I wouldn't want to live like that." David lived in a nursing home. He lay in bed twenty-four hours a day tied to a stable respirator. David didn't have to live this way. He could have had a portable respirator and thus been able to use a wheelchair. He didn't know about a portable respirator and no one ever told him. The government was paying $2300 day to keep David in a nursing home, but would pay only $207 a month for an attendant so David could live independently. The day before David died, a reporter covering David's story discovered that money could have been gotten for David to live independently if someone had known how lo “work the system." David's struggle reflects the struggle of people with disabilities in this country. If David, and other people with disabilities were given their right to make choices in their lives all along, there would be no necessity of fighting for the right to die. The Americans With Disabilities Act There is a growing awareness of the need for change in policy and attitude toward people with disabilities. Last year a bill was introduced in Congress called the Americans With Disabilities Act (ADA). The ADA would begin to guarantee civil rights for people with disabilities. Although it has already been modified since its inception, the ADA, as it now stands, would be a beginning to removing barriers that prevent people with disabilities from participating in society. Unfortunately, the ADA is facing serious compromise due to powerful lobbies against it. It is also facing changes that would remove its power as a civil rights act. Last summer, the ADA was passed almost unanimously by the Senate. It was endorsed by President Bush. It then moved into the House of Representatives, where it is now stalled. The most powerful lobbies against the bill are Greyhound and the National Federation of Independent Businesses along with the Chambers of Commerce. Greyhound is against the ADA because they will have to equip new buses with wheelchair lifts. They claim it will cost them millions of dollars, yet they are adding in costs that have nothing to do with the Americans With Disabilities Act. While using erroneous concepts for the cost figures, Greyhound is pouring money into Washington to fight the bill. The National Federation of Independent Businesses also base their antagonism to the ADA on erroneous concepts. The NFIB is saying the ADA will cause hardship for businesses. The ADA requires that public facilities constructed after the ADA becomes law be accessible. Existing facilities have to be accessible within two years of enactment if the access is "readily achievable without much difficulty or expense." In other words. businesses can decide for themselves whether they can afford to provide access. On March 10, American Disabled for Accessible Public Transportation (ADAPT) held a march on Washington to promote awareness of the Americans With Disabilities Act. Over 1,000 people with disabilities came from all over the country. They marched from the White House to the steps of the Capitol. The rest of the week was filled with talks with key figures and demonstrations. Many people participated in planned civil disobedience aimed at calling attention to the current injustice. Because the ADA is civil rights legislation, it ties in with the Civil Rights Act of 1964. New legislation has just been introduced that would create real remedies for violations of the Civil Rights Act. Because the ADA is tied to the Civil Rights Act these remedies would also apply to violations of the ADA. Opponents of ADA want to separate the ADA from the Civil Rights Act. For people with disabilities this would be a compromise that essentially negates the purpose of the ADA. People with disabilities deserve to be treated fairly and humanely, which at this point we are not. It is time to remove the barriers, especially the barriers of mind. It is time to break down the walls that have kept people with disabilities imprisoned. The Americans With Disabilities Act is a very important step. Please write to Hon. Afflicted with cerebral palsy, Jennifer has trouble moving around. But Monday afternoon in Washington, she crawled hand-over-hand up the 83 steps leading to the U.S. Capitol, eventually reaching the top. No members of Congress threw obstacles in her path. None stood in her way. But in the eyes of Jennifer and about 60 others who abandoned their wheelchairs to make the Capitol climb, they might just as well have. By failing to protect the disabled from discrimination, they say, Congress is allowing others to throw obstacles in their path every day. They want Congress to stop yakking and start voting on the Americans with Disabilities Act, sweeping legislation that would do for the disabled what the civil rights legislation of the 1960s did for minorities and women. The legislation passed the Senate last year. It has the support of the president. But the House of Representatives, lobbied hard by business interests that fear the bill's costs, just can't seem to get its part of the job done. Justice demands that the stalling end. Today, people in wheelchairs lose job opportunities because they can’t get to work on public transportation. The deaf are often shut off from society because telephones aren't properly equipped. People with mental disabilities are denied jobs by employers who wrongly assume they can't do them. Too often, the only response is: What do they expect? Society can't make them well again. The disabilities act has a better, more sensitive response: * lt bans discrimination against both the mentally and physically disabled. * It requires employers to make “reasonable accommodations" for the handicapped. * It ensures access to bus and rail systems. * It mandates full telephone access for the deaf. * It demands that public accommodations, ranging from hotels to coffee shops to bowling alleys, try to provide equal access for the disabled. Those goals cannot be achieved easily or cheaply. As you can read across this page, they will mean new costs and inconveniences for businesses. New equipment may be needed. Structural alterations may be required. Plans for new building may be altered. Those concerns deserve consideration. But they are not adequate reasons to delay any longer. The legislation specifies that employers not be forced to endure undue hardship. It says the only changes that are required are those that are readily achievable. It affords time to make changes — as long as 30 years in some cases. Every day that Congress delays is another day that obstacles can be thrown in Jennifer Keelan's path. And she, just like the rest of us, deserves every opportunity to reach the top.
