Jr. in Selma, Alabama. Wade didn't know what to expect. However, the experience imbued him with a vision of civil rights which he would never forget. Later. working in the youth wing of a nursing home, he understood clearly that the same issues, freedom. equality, and justice, were at stake for people with severe disabilities. Throughout his life, Wade Blank strove to obtain independent living opportunities and equal access for people who had lone been denied these basic civil rights. Wade died at age 52 on Feb. l5. I993. in a swimming accident in Todos Santos, Mexico, where he was vacationing with his family. He was trying to save his 8 year old son. Lincoln. An undertow made the rescue impossible; both Wade and Lincoln drowned. Wade is survived by his wife, Mollie; his daughter. Caitlin, 6; and his adopted daughter, Heather, 22, who has a disability. All members of the Blank family were actively involved in the disability rights movements that Wade helped launch. On Feb. 2l. a memorial service drew 1,100 people to Denver's Radisson Hotel. the site of the first national protest by American Disabled for Accessible Public Transit, or ADAPT. the grass roots, direct action disability rights movement Wade co-founded. Wade and Lincoln were remembered as spirited, loving people committed to social change. A neighbor remembered Wade helping her fix a broken lock late one night; she recalled Lincoln leading other children in a rousing chant during a make-believe demonstration on his front porch. Wade's colleague Shel Trapp quipped. “lf Heaven is inaccessible. God is in big trouble." Wade believed in the leadership potential of even the most severely disabled activists. He pushed his followers to take charge of the movement, even when it would have been easier to dominate it himself. His ability to alternate between a directive role and a supportive role from manager to attendant. from mentor to messenger kept Wade close to his people. lt also had a tactical value: At a 1991 demonstration in Colorado. police were vainly searching for someone to hold responsible for several dozen unstoppable wheelchair wielding protesters. An officer asked Wade. “Are you in charge here?" "No." Wade answered. “I just help people go to the bathroom." Drawing on his background as a pastor of a diverse and active parish, Wade taught the value of community. He brought people together across disabilities, classes, races, ideologies and other differences. ln ADAPT. Wade created a true community. welcoming anyone committed to the movement's vision of justice. During national actions, people from across the country exchange experiences and expertise. offer each other encouragement and strength, meet friends and even start romances. Just getting to the sites of national protests requires enormous energy expenditures and a myriad of logistical details for people with disabilities, many of whom use wheelchairs. On long. grueling caravan drives across country. Wade met those needs with humor and gentleness. He drove tirelessly, navigated, did attendant care, pumped gas, made fast food runs, hauled suitcases and battery chargers, repaired wheelchairs, even brought coffee to everyone’s rooms in the mornings. When we grew exhausted and short-tempered. he buoyed us with affectionate teasing and terrible, recycled puns. He kept the troops moving, both on the road and during protests. with encouragement, bad jokes. and calm confidence. Protests will be tougher without Wade's bold creativity, irrepressible sense of humor, and reassuring presence. But the movement won’t die with Wade. He knew that. “King‘s organization’s mistake was that they hung it all around his neck,” he told an interviewer last November. “What happened to the movement? It lost its definition. King gave it its definition. If I would get knocked off tomorrow or die of a heart attack, it wouldn’t slow us down a bit. We know what we’re about, and the movement would go on with the same intensity.” In 1971, Rev. Wade Blank arrived in Denver after 10 years of preaching and organizing in the Midwest. He had graduate degrees in divinity and was an ordained Presbyterian minister. But his radical activities had gotten him in trouble with the church authorities and he had been fired from his parish. His experiences had included hosting meetings of the Kent State chapter of Students for a Democratic Society (SDS); helping Vietnam War draftees flee to Canada; and organizing African American youths to demand community water and sewage systems in conservative Twinsburg Heights, OH. Wade was burned out and not sure what he wanted to do next. He ended up at Denver’s Heritage House nursing home, where he tried to make institutional life bearable for young disabled people. He quickly realized that such confinement could never be acceptable. He was fired from his job, but stayed in touch with several of the young residents. Eventually he helped 11 of them move into their own apartments. At first, Wade himself provided all his clients’ attendant care, until finally the State of Colorado agreed to fund home health care services for people living independently. This was the beginning of the Atlantis Community (named for a forgotten continent), today a thriving independent living center in Denver. Even in their newly won freedom, the Atlantis founders discovered barriers to independence all around them. Public buses were inaccessible, so the community members became activists. One July 5, 1978, with Wade’s support and guidance, 19 disabled people blocked buses overnight in the busy intersection at Colfax and Broadway to demonstrate their demand for lifts on buses. Protests continued until, in June 1983, Denver committed itself to a fully accessible bus system. Last summer, the city laid a plaque at the Colfax-Broadway intersection, engraved with the 19 activists’ names. Characteristically downplaying his own key role in the demonstration, Wade asked that his name not appear on the plaque. Wade once described his role this way: “That’s what my job is, to assist my people in gaining the power to make change." Throughout his years of service to “my people,” Wade worked to build strength and leadership among disability activists. Emboldened by success, the Denver activists carried their demands for bus access to the entire nation. Wade‘s vigorous encouragement and organizing skills had helped to transform a group of powerless nursing home "patients" into a band of effective revolutionaries. Now that same savvy spirit found a warm reception among disabled people who were tired of segregation and exclusion. A new movement was born, with the fitting acronym ADAPT, or American Disabled for Accessible Public Transportation. The first national ADAPT protest took place at the Radisson in October, 1983. The nation's transit officials were meeting at the hotel when disabled protesters blocked every entrance. Similar demonstrations throughout the country, involving the blocking of hotels, office buildings, and buses, focused public attention on the fact that access to transportation was a basic civil right denied to people with disabilities. Subsequent protests refined ADAPT ’s brand of protest. With his 1960s civil rights experience, Wade taught his followers how to stage protests that were non violent but direct and confrontational. In the hands of people with severe disabilities, these tactics were astonishingly effective. ADAPT activists baffled police officers, and filled jail cells, in dozens of cities. The public, and ultimately the powers that be, had to respond. The idea of people with severe disabilities, and their allies (including Wade), risking arrest again and again some as many as 20 or 30 times proved not only impressive, but persuasive. After nearly a decade of such protests, ADAPT achieved its goals for the nation’s transit systems. The Americans with Disabilities Act (ADA) included mandates for bus and rail services. All new bus purchases must now be lift equipped, just as Wade and his cohorts had demanded. But before it passed, the ADA became stalled in the U.S. Senate and was in danger of being defeated or weakened by amendments. Wade organized a “Wheels of Justice” campaign that included three days of marching, demonstrating, and civil disobedience. Some 150 people were arrested in the Capitol rotunda. Within a few weeks, the ADA passed the full Senate, and was signed into law by President Bush on July 26, 1990. But Wade and ADAPT spent little time celebrating. They knew there was still much to be done. With over a million people still languishing in nursing homes, ADAPT immediately launched its new campaign, demanding the shifting of federal Medicare/Medicaid funds from nursing homes to in home attendant services that would allow people disabled by birth, accident, illness, or age to live independently. The meaning of the acronym, ADAPT, did just that it adapted. The letters now stand for American Disabled for Attendant Programs Today. The old battle cry, “We Will Ride!,“ was replaced with a new one: “Free Our People NOW!” In a recent interview, Wade said, “My whole commitment in life is to eradicate those nursing homes, to destroy them, bring them down. We will.” He didn’t live to see that goal realized, but he shared that vision with hundreds of others. In the process he helped create a movement that will continue the fight to “Free Our People.” Laura Hershey, freelance writer and poet, is an ADAPT activist. By CHUCK HAWLEY The Arizona Republic Mike Landwehr pushes his own wheelchair, but it's really anger that drives the wheels. "Every day, my anger is brought forward again when l have to push my wheelchair 10 blocks in my own hometown,“ said Landwehr, a Chicago man who has been arrested a dozen or more times since 1978 while demonstrating for access to public transportation for the disabled. “I'm running out of patience.” Landwehr spent much of last week in Phoenix as a spokesman for American Disabled for Accessible Public Transit. The Denver-based group has a reputation of “getting in the face" of public officials by creating ruckuses at meetings of the American Public Transit Association, a group Landwehr describes as "the enemy." Surrounding hotels, restaurants and buses where transportation officials meet, ADAPT members express demands in rhythmic chants: “What do we want? "Access! “When do we want it? "Now!" It is, the group says, a civil-rights demonstration. Howard Adams is not driven by anger, although he was paralyzed from the neck down in a swimming accident 20 years ago. Adams, a Phoenix councilman, said disability is something he lives with, but he doesn't thrive on it. "I‘m not an expert on it,“ Adams said, “it's not the most important thing in my life." He disagrees with the civil-disobedience tactics used by ADAPT. "I guess I pour my anger into other things," he said. Adams, who served in the Arizona Legislature before his election to the City Council, recently was appointed by President Reagan to the 22-member Architectural and Transportation Compliance Board. The board oversees enforcement of federal regulations governing access for the disabled. It can recommend withholding federal funds from any organization or local government that fails to meet federal requirements for access, Adams said. Although Adams does not use city buses regularly, he said, he has used them and believes Phoenix "is in pretty good shape" with respect to disabled people. The demonstrators, he says, have a beef with the American Public Transportation Association, not with Phoenix. "The goal has always been equal opportunity and to participate in all aspects of life as best as they can," Adams said. "I agree with their goals, but I don't agree with their tactics. "They were not here to point a finger at Phoenix. They were here to protest to a group that provides public transportation to people around the country." Public transportation in Phoenix is inadequate for all people, not just the disabled, Adams said. "If I wanted to go to the council chambers right now, (8:30 p.m.) I couldn't get there on the bus anyway," he said. "If I were in a city with a higher population density, such as Chicago or New York, it would be a different story. I would expect to be able to." Adams said there appear to be "some people who are professionally disabled just like there are people who will always be soldiers in World War II." "We all carry burdens with us, but we have to overcome them," he said. "You can't take away all of the problems everybody has; you just can't. "But, to the extent that society has created barriers, you have to remove them, and I think we are doing it here." Because he uses a lift-equipped van, Adams does not ride Phoenix buses often, but he said he is not unfamiliar with the difficulty of getting from one city to another. In Los Angeles recently, he said, he was told that he could board a plane in a folding wheelchair and that his battery-operated machine would have to be left behind for a later flight in a baggage compartment. "I have trouble with airlines," he said. "They don't care. They just want to get you out of there." When his motorized chair arrived in Phoenix on a later plane, he said, "there was $2,000 in damage to it." Landwehr, 43, was born with spinal bifida, a severe birth defect that now often is correctable. New surgical techniques came too late for him, however. He lost the use of his legs during surgery when he was 12 years old. Landwehr remembers that he once tried to deny his disability, shun his wheelchair and be like everyone else. "I would get myself seated in a restaurant and ask the waitress to take my chair away and fold it up in a corner," he said. "It was a way of being like everyone else. Deep down, disabled people strive to appear not disabled.” It was painful, he said, when his parents had to move from Chicago because he could not attend public high schools there with able-bodied teen-agers. The family moved 60 miles to the suburbs after rejecting the Chicago school system's offer to provide a special bus to pick him up and deliver him to a school for the handicapped, the only school he said school officials would allow him to attend. "Thank God they (his parents) knew I would only learn to live in an institution," he said. In the suburbs, Landwehr said, he struggled to lift himself into a school bus unequipped for handicapped people. Daily, he lifted himself up the school steps as other teen-agers watched. "I know what it is like to be stared at," he said. "It's painful." It also is painful, he said, that Chicago, the nation's third-most-populous city, after New York and Los Angeles, has no city buses with wheelchair lifts for the disabled. Landwehr said that the daily difficulty of overcoming obstacles just to gain access to places others take for granted has hardened his stance for total access. He is militant. Arrests and abuse do not appear to faze him. Embarrassing others and taking the risk of alienating the public also do not seem to faze him. "There is nobody more alienated than people living in little rooms in institutions," Landwehr said. "We want to expose the public to the full range of people who are disabled. "I think our presence here at least gives the public the opportunity to reflect upon their perceptions of disabilities and disabled people. "We hope that a byproduct of our presence will give us some leverage with local politicians." Landwehr, who studied journalism and psychology at the University of Illinois but didn't earn a degree, is unemployed. He once worked with the Disability Rights Defense Fund in Washington, D.C., until federal funding for the group was cut. "We fooled them, though," he said. "Twenty-two of us started collecting Social Security disability checks and just kept on working, doing what we had been doing until the money ran out." Public officials sometimes complain that the cost of total access for the disabled is too great and the need too small. Landwehr says he doesn't believe it. For example, Milwaukee once touted the purchase of lift-equipped buses but operated them randomly on unannounced routes. USA Today, Wednesday, March 14, 1990 * 3A CLOSE-UP: RIGHTS OF DISABLED House panel passes landmark bill. As wheelchair-bound activists demonstrated at the Capitol, a sweeping civil rights bill for the disabled survived a key House vote. The Energy and Commerce Committee, successfully fending off an attempt to exclude people with AIDS or the HIV virus from the bill's protection, recommended the measure 40-3. Passed by the Senate last year, the bill gives the disabled the same civil rights and job protections that minorities won two decades ago. It also calls for public places and public transportation to be made accessible to people in wheelchairs and requires telecommunications systems to accommodate the deaf. "Ensuring equal rights for the disabled will result in greater productivity and responsibility for a significant portion of our population,” said Rep. Thomas Luken, D-Ohio. An estimated 43 million disabled could be affected. Meanwhile, police arrested 104 disabled demonstrators who confronted House Speaker Thomas Foley, D-Wash., in the Capitol Rotunda on the second day of intense lobbying by disabled people seeking quick passage of the bill. Foley reassured the demonstrators he is “absolutely satisfied” the measure “will become law.” Earlier, Rep. William Dannemeyer, R-Calif., was rebuffed in attempts to exclude people with contagious diseases or behavioral disorders from coverage. “When the people of this country realize just how far-reaching (the bill) is, they will rise up in opposition,” he predicted. But Rep. Henry Waxman, D-Calif., said the bill does not protect people with diseases that can be transmitted through the air: “If someone poses a threat, they can be discriminated against." Adams Crosscurrents Title: Pretenders to the Civil Rights movement The attempts of minorities of all stripes to identify with the black experience in America to gain even legitimate goals strike me as being a deception and a fraud. It also trivializes the dehumanization the blacks suffered at the hands of the white majority for 350 years. Only one group was brought to this country in chains, treated like animals, sold on the block like livestock, forced to live in shanties and valued only for the labor they could produce. And even after being freed from the shackles of slavery, blacks were denied their civil rights for another 100 years. No other group in this country has had to suffer those indignities. Yet minorities as diverse as militant feminists, homosexuals and the handicapped hoist the banner of oppression and try to do a black face routine as farcical as the old showboat acts on the Mississippi of the last century. The wheelchair protests staged by the Denver-based American Disabled for Accessible Public Transit (ADAPT) here last month are only the latest examples of groups with gripes trying to piggyback on the black civil rights struggle. Let us all agree that more needs to be done to make sure the disabled among us can get where they want to go. And there obviously are cities doing more than Cincinnati to make public transportation accessible. Denver is one. But that is begging the question. Cincinnati is not Denver. Queen City Metro is strapped for funds. It cannot provide all the service it would like for the handicapped—or even the able-bodied. But the issue is money, not civil rights. Determined to get arrested, the wheelchair protesters blocked the Westin hotel entrances, grabbed onto the wheel well of buses to keep them from moving, and one wacko with a death wish even rolled into the path of a bus going 40 mph. Bob Kafka, one of the 14 arrested—and given special treatment at the Hamilton County Justice Center—wrote a letter to The Post that began: “I am writing this letter from the Hamilton County Jail, in which I am spending Memorial Day, for the crime of trying to ride public transportation." Kafka's emotional appeal falls flat. (He obviously was trying to imitate Dr. Martin Luther King Jr., whose famous “Letter from the Birmingham Jail" stirred the conscience of a nation.) Kafka's crime was not that of trying to ride public transportation. He was charged with disorderly conduct for crawling aboard a bus, dragging his wheelchair, dropping 50 cents in the fare box and then demanding to ride - knowing full well the bus could not move with him on it. But Kafka, in his letter, attempts to equate the problems of the handicapped with those of blacks who were forced to ride in the back of the bus: “Those in power have decided to oppress us and make sure disabled people do not ‘step out of line’ and assert their rights," Kafka wrote. “Queen City Metro decided they were going to keep disabled people in their place.” By couching his complaint in vintage 1960s language, Kafka confuses the issue. The disabled should be heard. But they should give rational reasons for their demands for equal access to public transportation and not try posing as an oppressed minority that dares not “step out of line." I didn't see any cattle prods or police dogs used to quell the demonstrations. After the protesters had left town, Council Member David Mann had pangs of conscience that caused him to make some of the silliest statements in the annals of Mann. “It seems to me that every human being in Cincinnati — visitors, handicapped or otherwise — had the absolute right to enter the Fountain Square South complex on equal terms," Mann wrote, as if he had been living in a cave during the four-day wheelchair protests. “If you and I were free to move unfettered into the public areas of the Westin, then those who happen to move by wheelchair should have been treated precisely the same." I know philosophers have struggled for centuries to define reality. After reading Mann’s views on what took place in front of the Westin, I can understand why. His perceptions are unreal. Those who happened to “move by wheelchair” were not treated precisely the same as others because they were intentionally trying to block the entrances and disrupt bus service. That's called breaking the law. It seems to me that even a council member from Clifton, who happens to be a lawyer, should be able to make that distinction. The restrictions were not based on class discrimination. Rather, they were triggered by those misguided handicapped persons who believe they can gain greater access to public places by denying that right to others. The wheelchair protesters would have scored more points with the public by shunning crazy antics and making their appeal in a sane manner. I think it revealing that the Greater Cincinnati Coalition of People With Disabilities refused to participate in the public demonstrations. The coalition leaders believe they can accomplish more by talking with local city and bus officials than by trying to disrupt traffic. They certainly will gain more public sympathy. Wade Blank of Denver, a co-founder of the group American Disabled for Accessible Public Transportation, which staged this week's protests. Seventeen protesters from Texas, Colorado and Utah were arrested Wednesday, when the American Public Transit Association concluded its regional meeting. Some boarded buses and declined requests that they get off. Others blocked a parking entrance to the hotel where the association met, while three others chained themselves together to block a doorway in the Queen City Metro headquarters. - ADAPT (367)

O'Connor OF THE EXAMINER STAFF The Hall of Justice resounded with victory whoops and the whirl of motorized wheelchairs as 43 'handicapped activists arrested for blockading the Powell Street cable car line got their day in court. Protesters used their arraignment Wednesday before Municipal Court Judge Philip Moscone as a platform for a new attack against the American Public Transit Association, which they say has not done enough to provide the handicapped with access to public transit. Moscone allowed designated speakers to address the court after each group of blockaders entered no contest pleas to charges of obstructing a public thoroughfare. The $50 fine the charge carried was dropped as Moscone credited the night the 43 demonstrator spent in jail as "time served." A second charge of failing to disperse was dropped "in the interest of justice," according to Deputy District Attorney Randall Knox. Jane Jackson, who spoke on behalf the first group of 14 wheelchair-bound demonstrators arraigned Wednesday, seized the opportunity to charge APTA with denying handicapped citizens of their civil rights. "It is for this reason that we believe Jack Gilstrap (APTA executive vice president) should be asked to resign or should be forced to resign," Jackson said. "APTA is not acting in good faith." More than 15,000 public transit officials from around North America attended the four-day convention. Officials of the transit group have said they feel the access question should be handled on a local level. Jackson also said the coalition of handicapped-rights `groups`, which captured national media attention with four days of protests and blockades across the city, was pulling out of a scheduled meeting with APTA officials Thursday. "It's the only move left open to us," Jackson said later while members of the September Alliance for Accessible Transit and American Disabled for Accessible Public Transportation cheered her and the other blockaders as they exited the courtroom. About 75 wheelchair-bound protesters lined the hallway outside the courtroom, chanting and clapping in approval and support as each group of blockaders were arraigned and allowed to leave. "They're our heroes," said Connie Arnold of San Rafael. "They're standing up for us." During the arraignments, police, sheriff's and emergency medical personnel stood by as defendants were wheeled in or entered the courtroom under their own power. Jennifer Keelan, a 6-year-old girl from Tempe, Ariz., whose bouncy enthusiasm and apparent unconcern over her handicap captivated the press and boosted the resolve of protesters, was wheeled in by a sheriff's deputy and sat writing her name over and over again in a small notebook. Unlike the group's earlier demonstrations, Wednesday's action was peaceful and there were no arrests. Protesters had staged noisy and sometimes violent demonstrations outside the APTA convention at Moscone Center Monday and on the steps of City Hall Sunday night. Handicapped-rights group organizers said Wednesday was their last day in The City as the APTA convention at Moscone Center ended a four-day conference and transit officials left town. [Headline] "We Will Ride" [Subheading] Disabled Protesters Clash with Transit Authorities National Group Fights for Accessible Transit Disclosure Jan-Feb, 1989 [This article continues on ADAPT 420 but the entire text is included here for easier reading.] "These protests are the continuation of an ongoing assault," says Stephanie Thomas of American Disabled for Accessible Public Transit (ADAPT). In October, ADAPT disrupted the annual convention of the American Public Transit Authority (APTA) in Montreal with a series of protests. "We want all buses to be made accessible to disabled people," says Stephanie Thomas, who lives in Austin, Texas. "And we will continue these confrontations until that happens!" ADAPT is getting closer and closer to that goal. Last year, a task force created by APTA proposed lifts on all new buses. Nevertheless, at the Board of Directors' meeting in Montreal in October, APTA reaffirmed its current policy on transportation for disabled persons. In many cities, transportation for disabled persons means some kind of a pickup service. "It's a segregated system," says Stephanie Thomas, "and it never works out as well as it sounds. Riding public transportation is a civil right." For this civil right, ADAPT turns to civil disobedience. ADAPT has become such a force at APTA conventions that local police now prepare in advance for the group's demonstrations. In Montreal, police watched videos of ADAPT demonstrations in the U.S. and 100 police were put through a day-long training session on how to deal with the anticipated protests. But that didn't stop the ADAPT protesters, who continue to fight tenaciously for accessible transit. The four day series of actions in Montreal began on Sunday, October 1st. Despite a torrential downpour and near freezing temperatures, 120 members of ADAPT marched down Boulevard Rene Levesque to the Hotel Queen Elizabeth, APTA's 1988 convention site. ADAPT protesters were joined by representatives of their local counterpart — Le Mouvement des Consommateurs Handicapes de Quebec (MCHQ) or the Movement of Disabled Consumers of Quebec. ADAPT members swarmed across the road to enter the hotel, despite at least a one-to-one ratio of police to protesters. Even as a wall of police barricades was hastily erected, protesters climbed down from their chairs and crawled under the barriers. They were carried back by the police, but no arrests were made. That evening ADAPT took a more undercover approach. "No small feat for over 100 wheelchairs," commented Stephanie Thomas. Sneaking through back alleys and a back door, 15 people in wheelchairs were carried down a flight of stairs into one of the satellite hotels in which APTA members were staying. Meanwhile, two other `groups` converged on the front door using their wheelchairs to push aside makeshift barriers of luggage carts. Singing and chanting, ADAPT took over the lobby — blocking elevators, escalators, and stairs as APTA members looked on in shock, Finally, the police selectively arrested 28 of the demonstrators, including two who had chained themselves to the stairway. That night, a judge sentenced members of the group to a $50 fine, to be paid on the spot, or they would be faced with three days in jail, with a probation banning those arrested from entering downtown Montreal for six months. Twenty of the group refused to pay the fine and went to prison. Nevertheless, this put no damper on ADAPT's actions. Next hit: the APTA Spouses' Luncheon and Fashion Show, a favorite ADAPT target. The luncheon was held at a chalet atop Mount Royal on Mon-day, October 3. Ten more ADAPT members were arrested, as the APTA buses were stopped and the spouses were forced to walk past chanting demonstrators. On Monday night, October 3, 20 wheelchair users penetrated the Queen Elizabeth Hotel through an underground shopping area. 7 year old Jennifer Keelan, who uses a wheelchair, and her mother, were taken into custody and threatened with arrest, but were later let go. Meanwhile, in two Montreal prisons, the system was showing its inability to deal with severely disabled inmates. The ADAPT inmates were on a hunger strike. Officials decided that, due to good behavior, everyone would be out by Tuesday morning. ADAPT swung into the final phase of operation Tuesday morning. As requested by MCHQ, it was time to hit the local transit system — which is completely inaccessible to people with mobility impairments. Buses were stopped for an hour at a local bus transfer site, while a local woman crawled from her wheelchair aboard a bus and tried unsuccessfully to ride. "We are sorry for the inconvenience, but we are inconvenienced all our lives," said Wade Blank of ADAPT to the crowd. Blank is the founder of ADAPT. On Wednesday, October 5, ADAPT entered the Longueuil METRO subway station and once again tried to ride. The station had no ramps or elevators, and narrow turnstyles. 50 ADAPT members sang and chanted in the cavernous station — and cheered as 15 others crawled out of their wheelchairs, down the steps, and across the floor to the turnstyles where police blocked their passage. From the dirty platform floor, ADAPT held a press conference. We explained our simple desire to use the public transit that our taxes pay for," says Stephanie Thomas. "Lack of access is degrading for people with disabilities." The pressure on APTA is clearly mounting. APTA is now considering a resolution which strongly supports mainline transit access — ADAPT's demand from the start. In addition, Le Mouvement des Consommateurs Handicapes de Quebec has learned first hand the effectiveness of direct action techniques and has vowed to continue the pressure locally in Montreal. Her IQ has increased by 45 points. The source of her improvement was two years in a Denver public school specializing in special education. But Debbie, who was born with cerebral palsy and spent most of her life in institutions for the disabled, is 21 now and Denver school officials say she's too old to remain in public schools. They cite a state law saying the school district is required to educate children only up to age 20. Forty wheelchair-bound young adults converged in front of the school administration building at 900 Grant St. Wednesday to demonstrate their support for Debbie’s right to more education in Denver public schools. Debbie's mother, Elaine Jacoby. says she'll go to court if necessary to fight what she sees as a violation of her daughter's civil rights. She threatened to sue the Denver Board of Education, the state Institutions Department and the State Home and Training School in Wheat Ridge, where Debbie lived for nine years, for misdiagnosing her daughter's mental capacity and depriving her of an education. DEBBIE SEES HER PLIGHT more simply. "I want in go back to school,“she said. "l like it there. I've been learning all kinds of things I didn't know before." Supporting Mrs. Jacoby and Debbie in their fight in the Atlantis Community, an organization which works to remove the severely disabled from institutions and place in jobs and apartments throughout the community. "Debbie is an adult who has been deprived access to the education that would give her the skills she needs to be independent," said Mrs Jacoby, who is divorced from Debbie's father. “l am not asking the taxpayers to finance her until she is prepared for college. But I feel that the Denver public schools owe Debbie more than two years of very basic education before they throw her out into society. I fail to see why my child should be denied what every other child has simply because she is not able-bodied." Mrs. Jacoby said Debbie is a victim of the state's failure to meet the needs of handicapped children. She said Debbie was prohibited from attending public schools and even special education schools because cerebral palsy, a disorder which affects the muscles, had left her without bladder control. For five years, Mrs. Jacoby said she repeatedly tried to get Debbie into public schools. DEBBIE ATTENDED THE United Cerebral Palsy Center for five years. But Mrs. Jacoby said the training there was at pre-school level, directed toward a future in a sheltered workshop. "This was not an acceptable goal for my daughter," Mrs. Jacoby said. During this period, numerous psychological tests were conducted. When Debbie was 10, her mother placed her at Ridge Home. "I thought she would receive educational and social programming that was adequate, but I found again that programs available to able-bodied children," she said. When Debbie turned 19, things began looking up. The state passed the Handicapped Children's Act which, since 1975, has required public schools to provide education for handicapped and disabled persons aged 5 through 20. Debbie moved out of Ridge to the Atlantis Community at 2965 W. 11th Ave. and entered Boettcher Elementary School, a special education facility within the Denver school system. Her progress was remarkable. "When we got her from the Ridge she didn't know her alphabet, she didn't know her colors, she couldn't tell time," said Wade Blank, an executive director of the Atlantis Community. "Now she’s alert and able and eager to learn. She reads the Rocky Mountain News. Debbie had an IQ of 50 when she got out of Ridge. Two years later her IQ is 95. That says a lot to us.” She now functions at the level of a third or fourth grader, according to Blank. “We know she would be a normal functioning adult if only she had been given the opportunity to develop," he said. “Instead, the state shoves everyone into state homes where they vegetate just because they happen to be confined to wheelchairs. It has nothing to do with actual mental ability. " But Debbie is now 21. She has been told that she can no longer attend Boettcher or any other Denver public school. Mrs. Jacoby has appealed this decision to everyone from the Boettcher school principal to Supt. Joseph Brzeinski. LAST WEEK MRS. JACOBY received a letter containing the school officials’ final decision. Debbie could not be allowed to continue to attend Boettcher. But the letter, from James M. O'Hara, executive director of the Department of Pupil Services, suggested that other alternatives existed for Debbie at the Cerebral Palsy Center,the Emily Griffith Opportunity School and at private community agencies. "None of these alternatives are adequate". Mrs. Jacoby said Wednesday in front of the board's headquarters. "They do not meet Debbie's needs. Debbie is not ready for the Opportunity School, but she needs more than the Cerebral Palsy Center can offer. “For 21 years, I’ve put up with empty answers from school officials. I’ve talked and talked to people whose minds are already made up. They aren’t used to persons like Debbie living independently. They're used to them being institutionalized. [Headline] Independence from Nursing Homes - Atlantis' Handicapped Move to New Life by Pat Afzal On the surface, this Sunday is just a moving day for eight Denver area young men and women. Underneath, however, the day emerges as a first, precious taste of freedom for them. They are severely handicapped and will move out of nursing homes Sunday into their own apartments and have a crack at independent living. Sunday will be, oh .... like Christmas,” says wheelchair-bound Glenn Kopp, co-executive director of the Atlantis Community, Inc. The group is leasing the apartments where the young adults will live. Linda Chism, Atlantis' treasurer-accountant, likens the moving experience to “a flower opening up. We don't know how it's going to work out for sure. Things will sort of evolve." Their excitement seems normal because they're helping others embark on a new experience. Then they begin to talk about why the independent-living idea got going. And their comments harden into strong indictments against the institutional way of life for the young handicapped. "You know about civil rights?," Kopp asks a reporter. "Well, a handicapped person in an institution has no civil rights." "That statement about race, creed and color - well, it doesn't apply to handicapped people. We're left out of it." Kopp, who was worked in a Denver area nursing home said that when residents there went against the rules, a punishment was to take their electric wheel chairs away. “That's (the chairs) your freedom, you’re movement. Without it, you can't get around." [Subheading] Rule Ridiculed He ridiculed a rule that said the handicapped had to be in bed by 9 p.m. “Why should a grown man have to go to bed at 9 o’clock?" he asks. “It's a so very dehumanizing way to live, to say the least,” Ms. Chism adds. “You’re without privacy. All your dignity is just gone. You're not recognized as a person. You're a patient and that's it.” Nursing homes "like a lot of young people around, tooling around in their wheel chairs,” Kopp says. “lt adds an air of something nicer than just a lot of people sitting around.” By the same token, there isn't a lot of willingness to give the young people the freedom they feel and need, Kopp says. Those who are “lucky enough to have a taste of living normally really get depressed. It can be a very sad thing." It was soon after Kopp stopped working for the nursing home in Denver that he and a friend — Wade Blank — decided that “there's gotta be a better way to live. There has to be some better options." They slowly began to attract verbal, but not much monetary, support for their idea and Atlantis Community, Inc., was born. Eventually the group wants to build a 140-unit apartment complex for the severely handicapped. Right now, however, their first project is the seven apartment units in Las Casitas complex on Denver's west side where the eight young people will be moving Sunday. The apartments are on the western edge of a larger apartment complex in the 1200 block of Federal Boulavard. Credit for helping to make Atlantis’ dream a reality goes to Dr. Henry A. Foley, state director of social services, and John Helm of the Denver Housing Authority, Kopp said. “We went in cold to Dr. Foley, and he got us $3,000 seed money to apply to a larger grant," Kopp said. The grant, from the Department of Vocational Rehabilitation, made possible almost $20,000 in renovations at the Las Casitas apartments. Helm told them about the apartment vacancies. The new tenants will live on welfare and social service payments, and visiting nurses and on-site attendants will help take care of their medical and personal needs. On July 1, six other tenants will move in. Those slated for the Sunday move are “frightened, understandably,” Ms. Chism says. “When you've lived in an nursing home much of your life, you’re naturally apprehensive about living on your own." She said police were worried about the safety of the tenants because the apartments are in a higher-crime area. “But they (police) don't realize that in an institution, you don’t own anything for very long because it’s stolen," Kopp said. [Headline] Meetings Encouraging Meetings with a tenant union at Las Casitas have been encouraging, he added, and residents already living there have welcomed the idea of their new neighbors. The problem now is for Atlantis Community to stay alive financially so other young handicapped adults also can experience the freedom of independent living. And there are immediate problems like finding things such as kitchen utensils, bed linen and furniture to make the Las Casitas like home. But optimism about the future is apparent. “When you think of how far we've come in a year," Ms. Chism says. “I'd say there's a lot more to come from Atlantis." - ADAPT (567)

May, International Editor 892-2739 House OKs rights bill for disabled Measure would ban discrimination Scripps Howard News Service WASHINGTON — The House yesterday passed legislation to outlaw discrimination against 43 million disabled Americans. The 403-20 vote in favor of the bill, regarded as the most sweeping civil rights legislation in a quarter-century, sends it to conference with the Senate, which passed its version 76-8 last fall. The measure is backed by President Bush, who campaigned on the Americans with Disabilities Act in the 1988 presidential race, when few voters had heard of the bill. Rep. Steny Hoyer, D-Md., who shepherded the legislation through the House, hailed it as “the most significant civil rights legislation since the Civil Rights Act of 1964.” The 1964 law barred discrimination based on race, sex, religion, color or national origin in private employment, public accommodations and government service. The Americans with Disabilities Act would extend civil rights protections to the disabled as well. Passage came despite opposition from business groups, which have complained about the potential for lawsuits along with the cost of adapting offices, plants and stores for disabled workers and customers. Sponsors counter that keeping the disabled out of the economic mainstream costs $170 billion a year in government benefits; they say this bill has been changed to take account of business concerns: Companies with 25 or more workers would have two years to comply with the employment provisions, with four years allotted firms with as few as 15 workers. To ease the expense of making smaller stores, restaurants and other public accommodations accessible to the disabled, the House voted to give small businesses at least two years to conform and exempted firms with fewer than 10 workers for 30 months. In Colorado According to Randy Chapman, director of Legal Services for The Legal Center Serving People with Disabilities. the expected passage or the American Disabilities Act will affect the state in three key ways: protect people with mental disabilities, allow disabled people to collect attorneys fees when challenging discrimination and require private businesses to provide reasonable accommodations for people with disabilities. A state law protecting people with mental disabilities is expected to take effect in about a year, but a federal law would take effect immediately, he said. Chapman said businessmen's fears that the law will cost them in litigation and renovations are somewhat unfounded. "Most (businesses) need little or no accommodations . . . and there was substantial litigation when a similar law (for employers receiving federal funds) was passed." Billings Gazette 6/15/83 Disabled learn persuasion tactics by ROGER CLAWSON, of the Gazette Staff Disabled persons have a right to ride public buses, and — with a bit of political savvy - they can enforce that right. That was the message Wade Blank, a Denver handicapped association activist, brought the Montana Independent Living Project conference in Billings Tuesday. Blank said it would cost $180,000 to equip Billings’s Met transit system buses with wheelchair lifts. The federal government would pay 80 percent of that cost. Blank said public buildings have been made accessible to handicapped persons, public transportation should also be accessible. He outlined how his group, the Atlantis Community, fought to make the Denver bus system provide wheelchair lifts and suggested tactics to those who would make the Met accessible to handicapped: * Lobby for support. In Denver, Blank said, major churches endorsed the Atlantis crusade. * Build public awareness. Because handicapped people are unable to ride the buses, they are never seen by bus drivers or transit officials. Blank suggested putting a person in a wheelchair on every bus to spend the day riding and handing out literature calling for equal access. * Lawsuits may be needed to force public officials to explain how federal money, given with certain strings attached, has been spent. * Serve notice that you won’t be bought off with special transportation systems. “They do not run special buses for blacks,” Blank said, "they should not be allowed to segregate the handicapped.” Participants of the conference noted that the only transportation available to the handicapped in Billings is furnished by Special Transportation Inc. (STI), a private, non-profit corporation that provides transportation for the elderly and handicapped under contract. THE DENVER POST / NATIONAL Friday: September 9, 1989 [Headline] Senate approves bill to guarantee rights of disabled By Knight-Rldder News Service WASHINGTON — An estimated 43 million America with disabilities won a major victory last night as the Senate approved a landmark bill aimed at moving them into the nation’s social and economic mainstream. The Senate, on a 76-to-8 vote, passed legislation that would extend for the first time sweeping civil rights protections to persons with hearing impairments, epilepsy, AIDS and dozens of other physical and mental disabilities. The measure, which now goes to the House for expected approval, would ban discrimination in the hiring of the disabled; require businesses, shops and transit systems to make their facilities more accessible to the wheelchair-bound; and force telephone companies to provide special operators for the deaf. The bill was endorsed last month by President Bush, and administration lobbyists joined advocates for the disabled yesterday in opposing efforts to modify the legislation to meet business objections that it will be too costly to small firms. Business leaders warned that the measure could put some employers out of business if.they were required to make expensive structural changes in their buildings to accommodate disabled customers and workers. Critics also said the compliance provisions of the bill were vague and would result in years of litigation in federal courts over what constituted discrimination against the disabled. Major provisions of the Americans with Disabilities Act would: * Prohibit employers from discriminating against qualified job applicants with disabilities. Changes to accommodate the disabled in the workplace would be required unless they would cause an “undue hardship," a term critics say is too vague. * Require new business establishments to be accessible to the disabled and require existing establishments be made accessible if the alterations are “readily achievable." * Require new buses and trains to be equipped with wheelchair lifts. * Require telephone companies to provide operators who could relay messages from the deaf to hearing individuals. Deaf persons can communicate with each other by telephone now by using Telecommunications Devices for the Deaf (TDDs), but can't communicate with people who don't have the TDDs. “We’re not asking for special treatment," said Pat Wright, government affairs director of the Disability Rights Education and Defense Fund Inc. “Whether it’s putting a ramp in or providing a reasonable accommodation in employment, it makes you equal, not special." The bill, as originally written, would have exempted Congress from its provisions — but that exemption was deleted during debate. And in another concession to the intense interest of the disabled in the measure, the Senate for the first time allowed an interpreter using sign language to translate the televised proceedings of the floor debate so that the deaf and hearing impaired could follow the action. Extending civil rights protections to people with AIDS or the AIDS virus had been recommended by a Reagan administration commission on AIDS, but was opposed by President Reagan himself. Bush, however, has supported the protection. The bill bars employment discrimination against persons with AIDS but does permit employers to deny jobs if the employee poses a significant risk of transmitting the infection to others. However, homosexuals are not covered by the legislation. They can still be discriminated against solely on the basis of their sexuality. After an inquiry by Sen. Jesse Helms, R-N.C., sponsors agreed to delete transvestites from nation protections. The hour-long protest was aimed at demonstrating the lack of access to buses that handicapped persons endure both locally and nationwide. The demonstrators agreed to release the buses—by abandoning their position in front of the vehicles—only after Metro General Manager Carmen E. Turner agreed to meet with them. The demonstrators. representing a national group called American Disabled for Accessible Public Transit, said they wanted all new Metrobuses to be equipped with power equipment that lifts wheelchairs into buses. AIso, they said, they want the Department of Transportation to allocate more funds for equipping buses nationwide with the lifts. "We say it's a civil right, just as they denied black people the right to get on a bus and now allow them access." said Mike Auberger of Denver, a spokesman for the group. “It's a right like being able to go to school." Presently, Metro schedules a limited number of runs with buses equipped with lifts, or dispatches the buses if a handicapped person requests on the day before. The protesters said a lift costs $8,000 on a $180,000 new bus. an amount they said is far below the cost of an air conditioner. "I’ve called for buses, and they break down said Ronald L. Smith, who sat in a wheelchair in front of the Old Executive Office Building. "We want all the buses to be for the handicapped." Beverly Silverburg, director of public affairs for Metro, said last night that the group will meet with Assistant General Manager Theodore Weigle and Turner "will probably meet with the group." The protest began at 1:15 p.m., when the demonstrators announced to reporters that they were going to surround the next bus that stopped in front of the White House. It happened to be one marked "Brookland." Several demonstrators lay down on the street or leaned against the front of the bus while supporting themselves on crutches. A second contingent blocked another bus that had just pulled up behind the first. "What's going on?" Theodore R. Wright, the driver of the Brookland bus, said to no one in particular. The protesters told him they wanted to meet with Turner to present their grievances. As riders disembarked, Wright called his dispatcher. "I'm looking at two buses that are blocked," he said "They want Carmen Turner." Wright said he once drove a bus equipped with a power lift for six months and never had a handicapped rider. But he added, "l sympathize with these people. Probably they have some legitimate beefs." As the impasse dragged on, the protesters took over a third bus as it was trying to pass the first two. Police persuaded the protesters to let it go, but they became more agitated and began blocking buses across the street in front of Lafayette Square. By 5 p.m., police had cordoned off the section of Pennsylvania Avenue NW in front of the White House, disrupting rush-hour traffic in all directions. Metro supervisors came and went, and one protester was taken to George Washington Hospital after he fell off his wheelchair. By 5:30 p.m., the protesters had corralled seven buses, would-be passengers were complaining that they could not find a bus, and bus drivers were lining the streets. At 5:35 pm., D.C. Police Lt. W.R. Sarvis passed the word that Turner had agreed to the meeting. The demonstrators uttered whoops of joy and hugged each other. “No confrontations, no problems," said Sarvis. [Headline] Handicapped Rejoice at Rights Success by Jim Kirksey Flushed with the success of helping secure enactment of a “Bill of Rights" for the handicapped on Thursday, more than 200 handicapped and disabled Coloradans celebrated and demonstrated Friday at the State Capitol. A new set of regulations that puts into effect a 1973 law was signed Thursday by Joseph Califano secretary or the U.S. Department of Health, Education and Welfare (HEW). Its enactment was credited to the efforts of handicapped persons across the country, and especially to a nationwide demonstration by the handicapped three weeks ago. The law extends civil rights to the handicapped those civil rights guarantee already granted to ethnic minorities and women. THE FESTIVE CROWD gathered on the west steps of the Capitol about 10:30 a.m. to hear a number of speakers congratulate them on their success and to caution them about the future. The gathering - many people in wheelchairs, some on crutches, others with white canes or guide dogs - were told they were responsible for the victory, but were cautioned that it "it is only a beginning." not legible ...the HEW regulations would become a reality only if they are pursued, and the crowd was urged to remain united in the future for that effort. THE SPEAKERS included Don Galloway, executive director of the Governors Advisory Council on the Handicapped; Janet Anderson, administrative assistant to the council; Lt. Gov. George Brown; Wade Blank, codirector of Denver's Atlantis Community; Ingo Antonitsch, executive director of the Denver Commission on the Disabled; Diane McGeorge, president of the National Federation for the Blind of Colorado; and Ludwig Rothbein, of the Colorado Developmental Disability Council. After approximately an hour, the crowd moved inside the Capitol and presented legislators with a list urging them to: -- Promote the "deinstitutionalization" of the disabled with increased state supplemental income payments and home care attendants fees. -- Require school districts to integrate disabled students into their classrooms. -- Legislate removal of architectural barriers. -- Limit the growth of the nursing home industry as the wrong answer to problems of the disabled and handicapped. -- Investigate the nursing home industry and state institutions and prosecute cases of abuse and violations of civil rights. -- Expand affirmative action programs to include the disabled. -- Appropriate $188,000 to restore to Denver General Hospital monies for services to the mentally ill. -- Create a permanent advisory council on the disabled with the funding and power to “make effective changes." -- Establish accessible polling places for the disabled. THE GROUP stood outside the third floor office of the legislature's Joint Budget Committee and chanted, "We want to see the JBC.” State Sen. Ted Strickland, R-Westminister, chairman of the JBC, State Reps Belly Neale, R-Denver, Morgan Smith, D-Brighton, both JBC members and Robert Eckelberry consulted with the gathering for 300 minutes. Strickland, who met with them for about 20 minutes, addressed each of the listed demands by telling of action already taken and assuring them that the JBC hearings in next year's budget would be held in facilities where the disabled and handicapped could take part. Neale said the JBC “does have the best interests of the handicapped at heart," and Smith assured them that he would circulate their demands throughout the legislature.
