Accent on Living Summer 1983 Transportation Denver Busing Its Disabled Highlighted text: A failure in many cities, Denver has made accessible mass transportation work as an increasing number of disabled use it everyday. The Rapid Transportation District (RTD) in Denver is one of the most accessible transit systems in the nation – and the disabled community will take credit for it. For the last ten years, since 1973 when the RTD initiated “Handy-Ride,” a door-to-door subscription service, accessible buses have been a real issue. To date, disabled advocates have been the winners. “It has been a political victory for us,” says Wade Blank, co-director of the Atlantis Community, a highly active disabled group in Denver. He explains that they did not rely on 504 but instead used a successful strategy. Blank said that in 1973 when HandyRide was implemented, the disabled took the same stance the Blacks took during the civil right movement. “Separate in not equal. We agree that this type of service was fine, but what we really wanted was to have the entire bus system accessible. HandyRide would just be an extra.” Disabled people began demonstrating for accessibility on public buses – and in 1978 RTD agreed to develop mass transit accessibility. By June, 1982, it had met its commitment of having fifty percent of the buses accessible (two hundred twenty buses were retrofitted with lifts and one hundred twenty-seven new buses purchased in 1981 had lifts). In the meantime, however, Blank said the RTD reneged on its commitment of total accessibility because it announced in November, 1981, that eighty-nine buses to be delivered in late 1983 would not be lift equipped. These new buses are articulated buses, twice as long as regular buses. Wheelchair Ridership Graph - Shows ridership by month in 1981, 1982, and part of 1983 (up to April. ) Ridership pretty much rises except in fall and winter there is a downturn, and July of 1982 a sharp drop to a low point of about 300. Thur., March 15, 1990 Rocky Mountain News GREATER DENVER & THE WEST * 19 Denver disabled keep pressure on at U.S. Capitol By John Brinkley News Washington Bureau WASHINGTON — A Denver-based group of disabled people continued its pressure on the U.S. Capitol yesterday, converging on the office of a congressman whom the demonstrators said was opposed to their agenda. The congressman, Rep. Bud Shuster, R-Pa., was not in. An aide refused to tell them where he was and said he would not be back in his office yesterday or today. Some of the disabled people vowed to camp out there until he returned. Michael Auberger, a 35-year-old quadriplegic from Denver, who co-founded American Disabled for Accessible Transportation, said Shuster had introduced legislation to exempt cities with fewer than 200,000 residents from having to equip mass transit buses with wheelchair lifts. If the exemption were enacted, “you're really screwed if you live in a city of 199,999,” Auberger said. Shuster also sponsored legislation to exempt cities that have “inclement weather," such as Denver, he said. “The transportation system in Denver could say, ‘we're not going to provide any m'ore lift-equipped transportation. We don't have to,’ ” Auberger said. “That's a major issue, because not everybody lives in the Sun Belt." Shuster’s administrative assistant, Ann Eppard, said she could neither confirm nor deny that Shuster had sponsored such legislation, and said the aide who would know was not in, either. The “visit” to Shuster’s office continued a week of often-militant protest by hundreds of ADAPT members, most of them in wheelchairs, from across the country. Their main purpose has been to push for quick passage of the Americans with Disabilities Act, which would extend a broad range of civil rights protections to disabled people. The House Energy and Commerce Committee passed the bill, 40-3, on Tuesday as 104 of the disabled people were being arrested and jailed for unlawful entry and demonstrating in the capitol. The Senate passed its version of the bill last year. The arrestees, including Auberger, were released later with orders to appear in Court today. Auberger said his group was also concerned about the Bush administration's position that disabled people should not be entitled to punitive damages when filing discrimination suits against businesses that fail to accommodate them. Legislation is pending that would afford them that right, and Attorney General Dick Thornburgh has told Congress that the administration opposes it. “I think it's unfortunate that this administration doesn't want to see disabled rights equal with other minority rights,” Auberger said. U.S. to mandate bus service for disabled By The Associated Press WASHINGTON — The government announced plans yesterday to require that all federally aided bus systems buy only vehicles that are accessible to the disabled and provide special door-to-door transit for those who can’t make it to bus stops. Requiring both access and special services for all systems is expected to “increase significantly the amount and quality of service available to persons with disabilities,” said a Transportation Department announcement. In Denver, all buses owned by the Regional Transportation District are equipped with wheelchair lifts, and the district also provides a door-to-door service for handicapped riders. Groups representing the handicapped praised the Washington announcement and a transit industry spokesman said bus companies are prepared for it. The proposed rule, expected to become final in September after a period for public comment, would match some of the requirements of legislation pending in Congress and meet the key transportation demands of disabled-rights activists. More than 150 people were arrested in two incidents last week during demonstrations in Washington for the Americans With Disabilities Act. “The Bush administration is committed to policies that will ensure that people with disabilities have the opportunities available to other persons to use our mass transit system,” said Transportation Secretary Samuel Skinner. Announcement of the proposed rule met the requirements of a Philadelphia federal court order that required the department to examine and change existing regulations but did not mandate what the changes should be. Disabled Protesting Lack of Access to Buses Win Partial Victory from page B1 [we don't have part one of this story] ...it was the best they could hope for at present and agreed to stop blocking the building's doors and elevators. More than 100 people, most of them in wheelchairs, participated in the protests Monday and Tuesday. ADAPT members had planned to maintain a symbolic presence at the building after the agreement was reached, but no protesters were visible inside the facility Tuesday night. Authorities had attempted to eject protesters from the building Monday evening, but President Bush intervened and let them spend the night inside rather than send them out into the rain. During the lunch hour Tuesday, before the settlement was reached, tensions escalated between demonstrators and the building's employees. Protesters blocked elevators on the plaza level, forcing office workers and visitors to climb the stairs in the 26-story building. Security guards, who until then had stood by and watched, donned blue surgical gloves and forcibly removed some protesters from the elevators so people could pass. Having equal access to public transportation is a goal disabled people say they have fought years to attain. By denying able-bodied people access to the federal building was a way of underscoring the barriers they have in their daily lives, protesters said. But some people viewed the demonstration as an inconvenience and not as a tactic to gain rights for the disabled. "l wasn't their momma, and I didn't have them and l'm not God, so why do I have to put up with this?" argued one woman. Rhonda Lester of Denver, whose 5-year-old son was among the protesters, got into a face-to-face shouting match with her. After security officers stepped in, Ms. Lester said she understood the woman's point. "But she has to understand ours," she said. “Where would blacks be without protests?“ Although 35 percent of the nation's 50,000 buses have wheelchair lifts, handicapped persons say, they sometimes have to wait at a bus stop for an hour before one comes by with a lift or a bus driver who knows how to operate it. - ADAPT (502)

The sit-in was orderly, and the group left about three hours after entering the office. A 3rd U.S. Circuit Court of Appeals panel ruled 2-1 last month that lift-equipped buses are part of Congress‘ mandate to make public transportation more accessible to the disabled. The court also ordered the U.S. Department of Transportation to rewrite regulations that let cities offer the disabled alternative services, such as van rides. It said the 24-hour reservations required for such services hinder use of mass transit. Representatives of local disability-rights groups began demonstrating at ll:30 a.m. outside the Federal Building at Sixth and Chestnut streets. They formed a noon-hour caravan of wheelchairs for the trip to the U.S. attorney's office on the 10th floor of the Bank of Louisville building at Fifth Street and Broadway. Demonstrators asked that the U.S. attorney call John Sununu, the White House chief of staff, to tell President Bush to instruct federal officials not to appeal the decision. When told Whittle was ill, the demonstrators asked to meet with an assistant. Arthur Campbell Jr., a spokesman for the group, told Assistant U.S. Attorney Terry Cushing, “This ruling; gives us the freedom that the rest of society takes for granted." Cushing promised to pass their request on to Whittle. "Can’t you do that now?" a demonstrator asked. Cushing said he couldn't because someone was waiting in his office, but promised to do it later. “We’ll wait until Monday if necessary," another group member said. They left about three hours later, after Cashing called Whittle and several members of the group spoke to him. "He (Whittle) asked me to take some additional information from them about the case, and they left," Cushing said. The demonstration was part of a nationwide observance sponsored by American Disabled for Accessible Public Transportation, a plaintiff in the federal Court case, and other disability rights groups. - ADAPT (559)

News Local Briefs [Headline] Wheelchair-lift issue in court’s lap, lawyer says U.S. Attorney Michael Norton yesterday told a group of disabled activists that the federal government’s appeal of a court ruling on bus wheelchair lifts was out of his hands. Norton appeared before 40 wheelchair-bound members of ADAPT, American Disabled for Access to Public Transit, who had camped several hours outside his 12th floor offices in Denver’s federal building. ADAPT members are angry about an appeal by the U.S. Justice Department on behalf of the Department of Transportation. The appeal seeks to overturn a federal court ruling requiring all local transit buses to be equipped with wheelchair lifts. Thirty protesters were arrested Monday for blocking the doors of the Radisson Hotel, where their target, the Urban Mass Transportation Administration, was holding a conference. - ADAPT (368)

Chung The San Francisco protests by wheelchair demonstrators seeking better access to public transportation finally rolled to an end yesterday in a Hall of Justice courtroom. Since Sunday, a total of 134 of the demonstrators have been arrested during a series of protests that ranged from a rally at San Francisco's City Hall to a 2 1/2 hour shutdown of the city's historic Powell Street cable car line by a wheelchair army Tuesday. The protests were staged to oppose the policies of the American Public Transit Association, which ends four days of meetings today in San Francisco. Groups representing disabled persons contend that all transit vehicles, even the historic cable cars, should be accessible to wheelchairs. Although there were more demonstrations yesterday, there were no new arrests.' The 43 protesters who were held Tuesday night in a Hall of Justice gym on misdemeanor charges stemming from their arrests were all released yesterday. They had pleaded no contest to a charge of obstruction. Municipal Court Judge Phil Moscone waived $50 fines in light of the time they had spent in custody. Some 90 other protesters who had been cited but not booked also pleaded no contest and their fines also were waived. Outside the courtroom, the hallway echoed with cheers and applause from nearly 100 other persons in wheelchairs as the first group of 14 wheelchair defendants to appear before the judge were released. "They're our heroes," said Connie Arnold of San Rafael. "They're standing up for us and everybody." Inside the jammed courtroom, 6-year-old Jennifer Keelan — the youngest person to participate in the demonstrations — sat in her wheelchair and watched the proceedings with her mother, Cynthia. "I am her parent," her mother said. "But this is her disabled family and these are her brothers and sisters." Earlier in the day, during a bizarre demonstration of just how tough the access problems of the disabled really are, a band of people in wheelchairs were denied access to the federal Department of Transportation offices at 211 Main Street. The entire building is leased by the General Services Administration. When they rolled into the building's elevators to visit the 11th floor offices of the Urban Mass Transportation Administration and the secretary of transportation's regional representative, electrical power to the elevators was abruptly shut off. The visitors were informed by a man in a blue blazer that they were in a private building and not a public building, and that police would be asked to remove them if they did not leave. He identified himself as the building manager, but refused to give his name. Amid cries that they were experiencing George Orwell's "1984," the protesters began chanting: "We will ride. We will ride." However, the elevators did not move. Shortly after noon, San Francisco police warned the demonstrators that they were "on private property, and we ask you to disperse." If they failed to leave, the demonstrators would be arrested, officers said. Cook 202/467-5730 DISABILITY GROUPS DELIGHTED BY DOT RULING ON ACCESSIBLE BUSES United States Transportation Department Secretary Samuel Skinner, stating his strong "support of policies that would substantially improve access to mass transit services for handicapped persons," today proposed a new regulation "requiring all new buses to be accessible,“ and "requiring supplemental paratransit service . . comparable to the service for the general public for persons who could not use the fixed route transit service." The regulation was issued in response to a court suit brought by Americans Disabled for Accessible Public Transportation (ADAPT) and twelve other national disability organizations. Wade Blank, head of ADAPT, stated that he was "delighted that the Administration finally has followed through on its commitment to persons with disabilities." The regulation will require all buses that are newly purchased or remanufactured to include wheelchairs lifts in their design and manufacture. According to Timothy M. Cook, of the Washington—based National Disability Action Center, the attorney for the disability groups, "this new rule will immensely enhance the lives of persons with disabilities throughout the country.
