Title: WHEELCHAIR TRANSIT BUSTED English Cultural Tabloid, Oct 7, 1988, p. 8 by KRISTIAN GRAVENOR Montreal's handicapped community is hoping that getting arrested will succeed where letters and phone calls have failed to improve its transit service. About 50 activists were arrested after blocked traffic along Rene Levesque, disrupting the Queen Elizabeth Hotel conference, and demonstrating at the Sheraton hotel, where members of the American Public Transit Association (APTA) were staying for an annual convention from October 1-5. The local disabled population teamed up with the American Disabled for Accessible Public Transit (ADAPT) in protesting against APTA policy. ADAPT has organized civil disobedience at all APTA conferences for the last five years, with last year's convention in San Francisco resulting in over 70 arrests , while a regional conference in St. Louis led to the arrest of over 40 activists. Stephanie Thomas of ADAPT says that the enmity towards the transit group dates to the late '70s when the U.S. government passed a law which decreed that all new public transit vehicles must be accessible to the handicapped, but APTA lobbying had the law overturned. Thomas, who has been active in each of the protests against APTA, refuted the organization's claim that making transit accessible is expensive and impractical: "A lift on a bus only increases its cost by about 10 per cent, which would be made up as it eases the cost on the separate transportation system for the disabled." Montreal's transit authority (MUCTC) is a member of APTA and has failed to make new buses or subway stations accessible to the disabled: A separate service for the disabled has existed since 1980. This system, according to Francois Gagnon of the Quebec Movement of Handicapped Consumers, is deteriorating. "The Quebec government has ordered that the separate service maximize its use," he says, "and since then, one complaint I received was from a man who gets picked up for work at 7 AM and is delivered to his job at 9:45 AM." Gagnon, whose organization encouraged the disabled community to take part in the protests against APTA, argues that economics and demographics prove that now is the time to make the system accessible. "By the year 2000, 25 per cent of Quebecers will be senior citizens, many of whom will be handicapped, and the longer it is delayed, the more expensive the transition will become." For many disabled, the real issue is the right to enjoy transit facilities made for the rest of society. The protests are an attempt to end the separate transit systems. Stephanie Thomas stresses that ADAPT is not demanding that existing vehicles be modified, only that new equipment should be accessible to the disabled. Thomas is encouraged by the results of the protests. 'We have been active lobbying, and nothing was ever done. But since we started protesting, it has become a major issue. Slowly, cities such as Phoenix, Atlanta, Dallas, Syracuse, and Chicago are changing to accessible transit." Montreal may yet be able to join that list. The End - ADAPT (384)

Cleveland Plain Dealer p.8 Title: Cincy frees wheelchair access bus activists CINCINNATI (AP) -- A judge granted early release yesterday to three wheelchair-bound activists who were arrested last week for participating in protests to demand access for handicapped people to public transportation. Hamilton county Municipal Judge J. Howard Sundermann, Jr. granted a defense lawyers request for early release of Michael Auberger of Denver, George Cooper of Dallas and Bob Kafka of Austin, Texas, who had served six days for criminal trespassing. Sundermann had sentenced the three to jail terms of 10 days each for their part in last week’s demonstration at the headquarters of Queen City Metro, Cincinnati's public transit agency. Their lawyer, Joni Wiikens, had argued against a jail term, saying the men could have suffered health problems if they were jailed for an extended period. Before he granted the early release, Sundermann asked the men if they planned to go to another city and repeat the demonstration. Auberger and Kafka said they planned to return home. Cooper did not reply. “I think we made our point. The issue won’t go away,” Kafka told reporters after the hearing. Auberger, Cooper and Kafka are members of Americans’ Disabled for Accessible Public Transportation (ADAPT), a national organization that sponsored last week’s protests outside a downtown Cincinnati hotel where the American Public Transit Association was conducting a regional meeting of bus system executives. The activists were protesting Queen City Metro’s policy of requiring the handicapped ride on separate vans for the disabled rather than on regular buses. ADAPT members urged the system to fit the buses with wheelchair lifts, but Metro officials said they did not have money to do so because of the Reagan administration’s cuts in federal transit funding. The vans must be reserved 24 hours in advance. Handicapped people complain that the vans often are booked days in advance, leaving them isolated and unable to get to work or other destinations. - ADAPT (244)
The Cincinnati Enquirer Wednesday, May 21, 1, '86 p14—A Title: The handicapped Bus service that can meet special needs is the answer The handicapped demonstrators who are demanding greater access to transportation systems could find that, even if they succeed, they may not like what they get. About '75 members of American Disabled for Accessible Public Transit (ADAPT) have been in Cincinnati for the regional meeting of the American Public Transit Association (APTA). Their purpose has been to protest what they see as a violation of their civil rights. They want to be able to use all modes of public transportation as others do. ADAPT is focusing on bus systems, asking that all buses — on a progressive basis -- be provided with lifts for the handicapped. That might be a valid answer, if the money were available, but the experience of states such as California and Michigan shows that the handicapped prefer a more personalized service, such as the Access shuttles that Metro provides. Both California and Michigan have state laws requiring fully accessible systems, but the use of regular buses is negligible. Most of the handicapped prefer the “Dial-a-Ride” services that supplement the regular system. That service seems the best way. With Cincinnati's hilly terrain for example, how would the handicapped reach the bus stops? How far would they have to go to reach a "regular" bus stop? How far must they travel when they get off? What happens in chilly, stormy or snowy weather? From the bus service's standpoint, how do buses keep schedules? How many areas on a bus would have to be cleared for handicapped equipment? What would be the costs? How would those costs be met? APTA officials say their policy is to recommend that local services do what is best, considering their terrain, climate, resources and needs -— always in consultation with the community served. Metro’s Access has had its troubles meeting the needs of the handicapped. Last year, the demand was so great that the handicapped had to wait for as long as a week before they could schedule a ride. Although the problem has been helped somewhat, Metro’s officials frankly agree that it is not ideal. Improvement is needed. The handicapped must have freedom of movement. The question is, what is best for them and what is possible? The problem won't be easily solved. More bus service is needed in many areas of Greater Cincinnati, and with the cut in federal funds, money will be hard to come by. But Cincinnati's coalition of the handicapped has found negotiation preferable to confrontation. Although the coalition is upset about the limitations of Access, it still sees co-operative decisions as the wisest course. And it is. Together with Metro, they must find a practical answer to their needs. - ADAPT (124)

VERRENGIA Rocky Mountain News Staff Writer As handicapped demonstrators blocked Regional Transportation District buses with their wheelchairs for the second straight day Friday, Mayor Federico Pena's staff stepped in to referee a growing dispute over broken wheelchair lifts. “Perhaps part of the ultimate answer will be to allow the disabled community to be part of the decision-making process," Pena aide Dale Sadler said Friday. “What we're hoping for now is to get everyone to talk." But Sadler could only watch as Denver police quickly arrested George Roberts and Renate Rabe as the pair rolled their wheelchairs in front of an RTD bus at 17th and California Streets at 12:25 p.m. Roberts and Rabe were the second and third members of the militant disabled-rights group known as ADAPT to be booked into city jail in two days in connection with obstructing a government agency and blocking traffic. Mike Auberger of Denver was arrested Thursday at the intersection of East Colfax Avenue and Cherry Street when he rolled his wheelchair in front of a bus with a broken lift. Auberger, who was jailed for about three hours, is scheduled to appear in Denver District Court March 12. He faces $250 in fines. Roberts and Rabe were released Friday afternoon. Roberts is scheduled to appear in court Feb. 25. Rabe is scheduled to appear March 15. ADAPT protesters have vowed to block buses at busy intersections throughout the six-county transit district for 80 days — or until the RTD board of directors agrees to spend $753,059 budgeted to fix the balky electrical systems on 303 lift-equipped buses. RTD has one of the nation's most accessible public transit systems with lifts installed on about half of it's 750-bus fleet. However, disabled passengers complain that they frequently suffer frostbite in the winter as four or five buses with broken lifts pass them. They said they have a right as taxpayers to ride regular bus service, rather than plan their lives days in advance around the limited schedules of van services. “A wheelchair lift on a bus means a disabled person can live wherever he wants and shop wherever he wants," Auberger said. “The (RTD) board doesn't have the right to tell me where to live and shop. They might as well put me back in a nursing home." The demonstrators offered to cancel Friday's rally in exchange for a meeting with RTD General Manager Ed Colby. RTD officials said Colby had taken the day off Friday, but agreed to meet with the protesters minutes before their scheduled protest. That wasn't good enough, ADAPT leaders responded. “Colby had all last night and this morning to respond to us,” said Wade Blank, an able bodied demonstrator who organized the protests. “He was just a little late." Boxed Text: "You were talking about a separate and unequal system." -- Protester Wade Blank Threat of Sit-In Over RTD Lift Plans Dissolves By GEORGE LANE, Denver Post Urban Affairs Writer [This story continues on ADAPT 113, but the entire text has been included here for easier reading.] After tense negotiations, Regional Transportation District officials avoided use of police force Thursday night to break up a threatened all-night wheelchair sit-in at RTD headquarters. The protesters want RTD to reconsider a decision not to put wheelchair lifts on new buses — a decision they say broke an agency promise made to them last year. Three district board members promised about 25 disabled persons they would try to call a special meeting to reconsider the anti-lift action. The sit-in was staged in the fifth-floor executive offices of the RTD at 1325 S. Colorado Blvd. by members of the Atlantis Community for the disabled. The promise, contained in a policy statement adopted by the RTD board a year ago, was that 50 percent of the existing bus fleet of more than 600 vehicles would be retrofitted with wheelchair lifts, and all new buses would be ordered with lifts. When the statement was approved, there was a federal regulation demanding that all federally financed transit agencies make transportation modes accessible to the handicapped, and all new buses purchased had to have the lifts. RTD was one of the only transit agencies in the country to take steps toward complying with the regulation. But the regulation was repealed last July. Thursday afternoon, the RTD board voted to save more than $1 million by canceling the order to have the lifts installed on 89 high-capacity, articulated buses expected to be delivered in 1983. Wade Blank, co-administrator of Atlantis, pointed out to board members before the vote was taken that the day the regulation was rescinded, RTD officials said lifting the regulation would have no effect on the district's commitment to serving disabled persons. “A week ago I came to a meeting, and about 10 minutes to four, it was casually mentioned" there would be no lifts on articulated buses, Blank said. "I was dazed... it took a few days to realize that you were talking about a separate and unequal system." Robert Conrad, also an Atlantis administrator, told RTD board members he feels "betrayed" because he has worked closely with RTD on providing service to the handicapped “and all of a sudden you spring this on us." Board member Flodie Anderson explained to the approximately 75 angry persons attending the meeting that RTD intends to use the articulated buses on express routes and other heavy routes. Under that plan, Anderson said, other buses will be freed that will be lift-equipped and able to provide better service to disabled people than is provided now. Board member Edward Cassinis told the group that buses currently equipped with wheelchair lifts are carrying a maximum of 270 wheelchair passengers per week. RTD's “handiride,“ which provides front-door service to disabled passenger, is handling 831 riders per week. When the vote was taken on the action, the outcome was 12-4 against installation of the lifts. Members of the Atlantis Community and several other disabled organizations then gathered ln hallway outside the first-floor meeting room and decided to “resume civil disobedience." The group of about 25, all from Atlantis, then rode the elevators to the fifth floor of the building and began their sit-in shortly after 4 p.m. Motorized wheelchairs were parked in the doorways of the three elevators to make it impossible for them to be used. Shortly after the beginning of the demonstration, Bob West, RTD’s director called for police assistance and paramedics “because we don’t want anybody to get hurt.” The police, however, didn’t arrive for more than an hour and when they did arrive, the negotiating session that would end the sit-in already was in progress in a fifth-floor conference room. During that session, board members Mary Duty, Kathi Williams and Thomas Bastien agreed to try to get their fellow board members to meet again to possibly reconsider the issue. L.A. “Kim” Kimball, RTD’s executive director and general manager, also agreed not to execute the board action until an effort is made to set up the special board meeting. “But I can’t guarantee they will” Kimball added. “We can guarantee that if they don’t, we’ll file suit for breach of promise,” responded Mary Penland, an Atlantis employee. “And we’ll guarantee those articulated buses won’t roll unless they roll over our bodies.” - ADAPT (141)

Handicapped block buses 2 protesters are arrested; talks planned By Judith Brimberg 2/16/85 Denver Post Staff Writer For the second day in a row, wheelchair-bound protesters blocked an RTD bus in downtown Denver Friday. They were demonstrating against possible discontinuation of accessible bus service for the handicapped. Despite efforts by the Peña administration to mediate the dispute, the protest went off as scheduled, and two handicapped demonstrators were arrested. Denver police identified them as George Roberts, 36, and Renate Rabe, 30, who live in the same apartment complex at 1255 Galapago St. The pair, afflicted with cerebral palsy, were charged with impeding traffic and disobeying a lawful order. Rabe was released on her own recognizance, but Roberts, who participated in a similar demonstration several years ago, was held overnight in Denver County Jail. Thursday, another member of the disabled-rights group known as ADAPT, Mike Auberger, 30, was arrested at East Colfax Avenue and Cherry Street for impeding traffic. But efforts by Dale Saddler of the Mayor’s Commission on the Disabled ultimately paid off. Late Friday, both sides agreed to meet early next week to try to resolve the dispute. Demonstrations scheduled for this weekend were called off. The handicapped community contended that RTD failed to understand that separate, private transportation for the handicapped doesn’t meet everyone’s needs, said Wade Blank, an able-bodied demonstrator who organized the protests. On Tuesday, an RTD committee is to review policies affecting the elderly and the handicapped. Among the options to be considered are discontinuing accessible service on public buses and expanding handyride services or brokering services to private providers. In an interview, Blank said he organized the protests because “the handicapped aren’t going to be the stepping stones to a new budget.” More than two years ago, he and others obtained a commitment from RTD to install wheelchair lifts on 50 percent of the peak-hour buses. But RTD, like other transportation districts across the country, is facing severe cuts in federal aid and Blank fears the agency may try to balance its budget at the expense of the handicapped. Many wheelchair lifts have proved unreliable and costly to repair. Larry Perry, chairman pro tem of the RTD board, said Friday that Blank’s fears were groundless. “If they will sit down and talk with us, they will learn they won’t be hurt,” he declared. Earlier this week, however, General Manager Ed Colby told board members it costs $72 a year to maintain bus lifts because 12,000 disabled persons ride the buses each year. It’s cheaper to maintain lifts on the handy vans, Colby said. Blank countered that RTD is sabotaging its accessible program by refusing to perform inventive maintenance on the Colby’s handyride figures are distorted, he added, because they include the elderly as well as the disabled.
