That's why people support us. That's why they believe in what we are doing." Danny Saenz of ADAPT (American Disabled for Attendant Programs Today) was talking about the recent string of direct actions which has taken them from Baltimore to Washington to Dallas to Chicago and back to Washington again. ADAPT's primary issue: put Medicaid money into direct home attendant care of the disabled and get them out of nursing homes. ADAPT 's primary target: HHS Secretary Dr. Louis Sullivan, also known as “Lonesome Louie" and “Dr. No" because whatever ADAPT asks for, he refuses. “All we want is a meeting. . ." “All we want is a meeting," says Saenz, who is from the Austin, Texas ADAPT chapter. “But he always finds some excuse.” Tom Olin of Tennessee Adapt adds: "When we were in Washington recently, we thought that we had a meeting with Sullivan. But HHS went back on their word. So we closed down their building." Adapt members blocked the exits of the Health and Human Services building and forced guards to close it down for two hours on June ll. Police were reluctant to make arrests not only because it is bad publicity for them to be seen carrying off the disabled but also because most police stations do not have adequate care facilities. Tuesday, June 11, may go down as the biggest day in ADAPT's history for more reasons than the shutting down of HHS. Members began early at the American Health Care Association Convention where Sullivan was scheduled to speak. AHCA is a particularly galling organization to ADAPT because it is a lobbyist for the nursing home industry which receives billions in federal and state money for healthcare that ADAPT leaders describe as "inadequate," “wasteful” and “sometimes criminal." ADAPT estimates that over 1.5 million disabled could be moved from nursing homes to attendant home care if the Medicaid benefits were the same or comparable. Getting To Sullivan Although many ADAPTers got into the Hyatt Hotel where the AHCA convention was being held, security forces were able to head them off and lock the auditorium where Sullivan was scheduled to speak. All except for one person. She was able to sneak in and got down to the front of the room in her wheelchair. When Sullivan started his lecture, she also began speaking and gesturing to the audience, asking why Sullivan supported the agenda of nursing homes instead of the agenda of the disabled themselves. Several security police carted her off but ADAPT had, once again gotten Sullivan's attention. Eventually, Sullivan snuck out of the hotel, reputedly through the back kitchen entrance. But, even then, several ADAPT members caught up with him at his expensive limo and shouted their demands for a meeting at him as he drove away. Then ADAPT moved over to the HHS building where they blocked entrances and closed doum the building for a few hours. As National People's Action had done on their April visit, a few people got past the guards to some upper floor offices. But, of course, Sullivan was “not there." To cap off the day, ADAPT met with Senator Kennedy's staff to talk about the proposed health care bill. “We called for a meeting when we were here before in April," says Olin. “But they said they didn't know who we were. So we told them to just watch the news on TV and they’d see us.” What Kennedy’s staff and many other Washingtonians saw on TV then were another two direct actions which included blocking the HHS parking lot and the busy Baltimore intersection in front of the Social Security and Health Care Funding Administration building. ADAPT members said they wanted to illustrate what happens when they are locked in nursing homes. “It’s the same kind of feeling —— you can't leave when you want to. You need my permission," said Mike Auberger of Denver's Atlantis Community afterwards. “I’m sympathetic. . ." "I'm sympathetic to all these folks not able to get home, but this is a really minor inconvenience compared to the inconveniences suffered by those in nursing homes," said protester Nate Butler. A Washington Post photo showed ADAPT members lying down in front of police cars in a scene reminiscent of civil rights demonstrations of the 1960s. Some federal workers were irritated but many expressed sympathy for ADAPT’s views. Other ADAPT actions this spring included cornering Sullivan in Chicago on May 14 and, again in Dallas on May 22 at the President's Committee on Employment of People with Disabilities Conference. ln Dallas, according to the June issue of Incitement, ADAPT’s national newsletter: “(Sullivan) began his talk, and, slowly and silently, one by one, ADAPT members dropped to the floor and began crawling toward his podium, waving the proposed meeting dates in the air. Though he tried to ignore us, Sullivan stumbled over his words several times. in the end, a sea of bodies lay on the floor before him. . -" Sullivan's staff repeatedly says they won‘t meet with "radical" `groups`, but ADAPT leaders believe that this is just an excuse to avoid them. They note that Sullivan has plenty of time to meet with big money `groups` and lobbyists but that he ignores community-based `groups` whether they are "radical" or not. One of ADAPT's strongest arguments for reallocating Medicaid nursing home funds to a home attendant care system is financial. Leaders believe that, in the same way that health insurance administration costs eat up money that should go to the people who have the medical problems, nursing homes end up making large profits while the disabled suffer. Auberger says that nursing homes’ care costs are in the range of $30,000 to $60,000 a person a year but home care is in the $15,000-30,000 range. Auberger himself receives home care that averages about $2,000 a month. "Not only is it cost effective," he concludes, “it‘s the right to dignity and freedom of choice." The bottom line for ADAPT is the redirection of 25% of the $23 billion that Medicaid currently spends on nursing homes to community-based attendant services programs. While some states have adequate home care services, most do not. So ADAPT believes the primary change must come through the allotment of federal funds. “The nursing home industry is a billion-dollar industry — they give political contributions to politicians who protect their interests," says Lillibeth Navarro, an ADAPT member from California. “This is going to be a difficult struggle. TIME 3/26/90 American Notes CONGRESS A Crawl-In At the Capitol There had never been such a sight at the entrance to the U.S. Capitol. Dozens of disabled people abandoned their wheelchairs and crawled up the steep stone steps on knees, elbows and backs. The climb was not really necessary. The Capitol is equipped with ramps and elevators for wheelchairs. But the point was to rally support for the Americans with Disabilities Act, which would require public buildings and transportation systems to accommodate the disabled. One major obstacle to passage of the bill is the fear of small-business groups that it might be amended to allow disabled people to bring damage suits if they are discriminated against. To prevent an avalanche of court cases, the Justice Department has urged Congress to specify the circumstances under which the disabled could sue for damages. A compromise is expected. 3/13/90 Capitol Steps Climbed in Protest by Disabled WASHINGTON (AP) — Using her arms to drag her small body up the Capitol steps, 8-year old Jennifer Keelan joined some 60 disabled Americans Monday in lobbying for legislation to guarantee their civil rights“. “l‘ll take all night if I have to," Jennlfer said to others crawling along side her. She paused just past the halfway point for a sip of water on a bright and unseasonably hot March day, then resumed pulling herself up the rest of the 83 marble steps. Keelan, a ‘blond-haired second grader from Denver, was the youngest of about 60 people with disabilities who left their wheelchairs and crawled up the West Front of the Capitol. They were making a symbolic protest to demand passage of a key bill now pending in the House that would extend civil rights to disabled persons. She and the others climbed the Capitol steps after about 1,000 people walked or rode in wheelchairs down Pennsylvania Avenue from the White House to the Capitol and held a rally at the base of the Capitol steps. The were demanding passage of the Americans with Disabilities Act, which passed the Senate last year but has been bogged down in the House this year, despite widespread predictions of its ultimate passage. The measure would outlaw discrimination based on physical or mental disability in employment, access to buildings, use of the telephone system, use of public and private transportation systems, and in other areas. Although the hill has the support of the Bush administration and congressional leaders, some supporters have begun questioning the administration‘s commitment in recent weeks. At the White House, Bush press secretary Marlin Fitzwater denied that the support was slipping and said the administration was negotiating over the bill with key members of Congress. "We do support the legislation," Fitzwater said. "We're very supportive of their rights and their cause. President Bush has spoken out on that in the past." Rep. Pat Schroeder, D-Colo, a supporter of the bill, told the rally that pressure was building for the bill and that the House Energy and Commerce Committee had scheduled its vote on the measure for Tuesday as a result.

Foley and Minority Leader Robert H. Michel. Some 75 protesters were arrested, many of them in their wheelchairs. Removing them and loading them into vans took about two hours. Those arrested were charged with two misdemeanors, unlawful entry and demonstrating within the Capitol, police said. Both carry maximum sentences of six months in jail. In addition, those convicted could be fined $100 for unlawful entry and $500 for demonstrating in the Capitol. The arrests marked the second day of dramatic lobbying by people with disabilities, who are seeking passage of the Americans with Disabilities Act. On Monday, some 60 people crawled out of their wheelchairs and up the West steps of the Capitol. The bill would outlaw discrimination based on physical or mental disability in employment, access to buildings, use of the telephone system, use of public and private transportation and in other uses. It would require ramps or other means of access in all new buildings used by the general public, including private businesses and offices. The Senate passed the bill last year but the measure has bogged down in the House despite widespread predictions of ultimate approval. "It is a priority for passage in this session of the Congress." House Speaker Thomas S. Foley. D-Wash., told unpacified demonstrators Tuesday. The Energy and Commerce Committee, meantime, approved the Americans With Disabilities Act by a 40-3 vote after amending it to soften the impact on Amtrak and make other minor changes. Police arrested 104 people many of whom had chained their wheelchairs together, after deliberate acts of civil disobedience following a confrontation in the Capitol Rotunda with Foley and House Minority Leader Robert H. The Washington Times Wednesday, March 14, 1990 Handicapped protesters arrested The Associated Press Demonstrators in wheelchairs were arrested in the U.S. Capitol yesterday after confronting House leaders with demands for quick passage of legislation guaranteeing them civil rights protections. A crowd of more than 100 disabled demonstrators threatened civil disobedience and interrupted House Speaker Thomas Foley and House Minority Leader Robert Michel as the congressional leaders tried to speak over the din in the cavernous Capitol Rotunda. After the congressmen left, about 70 disabled people assembled in the center of the Rotunda and began chanting in an attempt to provoke arrest. Capitol Police, standing nearby, encircled the protesters and began taking them into custody. Outside the Capitol, police began placing the protesters - most in Wheelchairs - into several government owned vans. The demonstrators were being charged with unlawful entry and demonstrating within the Capitol, said Capitol Police Officer G.T. Nevitt. The first charge carries a maximum sentence of six months in jail and a $100 fine; the second, six months in jail and a $500 fine. “It is a priority for passage in this session of the Congress," Mr. Foley shouted over catcalls from the protesters. “l am absolutely satisfied it will reach the floor. we will have a conference with the Senate and it will become law." “Will it be on the floor in 24 hours? No," Mr Foley added in a statement greeted with a chorus of boos. “I am not going to set an artificial deadline that prevents the committees from sending a bill to the floor that they can defend," he said. Afflicted with cerebral palsy, Jennifer has trouble moving around. But Monday afternoon in Washington, she crawled hand-over-hand up the 83 steps leading to the U.S. Capitol, eventually reaching the top. No members of Congress threw obstacles in her path. None stood in her way. But in the eyes of Jennifer and about 60 others who abandoned their wheelchairs to make the Capitol climb, they might just as well have. By failing to protect the disabled from discrimination, they say, Congress is allowing others to throw obstacles in their path every day. They want Congress to stop yakking and start voting on the Americans with Disabilities Act, sweeping legislation that would do for the disabled what the civil rights legislation of the 1960s did for minorities and women. The legislation passed the Senate last year. It has the support of the president. But the House of Representatives, lobbied hard by business interests that fear the bill's costs, just can't seem to get its part of the job done. Justice demands that the stalling end. Today, people in wheelchairs lose job opportunities because they can’t get to work on public transportation. The deaf are often shut off from society because telephones aren't properly equipped. People with mental disabilities are denied jobs by employers who wrongly assume they can't do them. Too often, the only response is: What do they expect? Society can't make them well again. The disabilities act has a better, more sensitive response: * lt bans discrimination against both the mentally and physically disabled. * It requires employers to make “reasonable accommodations" for the handicapped. * It ensures access to bus and rail systems. * It mandates full telephone access for the deaf. * It demands that public accommodations, ranging from hotels to coffee shops to bowling alleys, try to provide equal access for the disabled. Those goals cannot be achieved easily or cheaply. As you can read across this page, they will mean new costs and inconveniences for businesses. New equipment may be needed. Structural alterations may be required. Plans for new building may be altered. Those concerns deserve consideration. But they are not adequate reasons to delay any longer. The legislation specifies that employers not be forced to endure undue hardship. It says the only changes that are required are those that are readily achievable. It affords time to make changes — as long as 30 years in some cases. Every day that Congress delays is another day that obstacles can be thrown in Jennifer Keelan's path. And she, just like the rest of us, deserves every opportunity to reach the top. Los Angeles Times Tuesday March 13, 1990 Disabled Persons Rally, Crawl Up Capitol Steps Congress: Scores protest delays in passage of rights legislation. The logjam in the House is expected to break soon. By WILLIAM J. EATON Times Staff Writer WASHINGTON—-Crawling up the Capitol steps to dramatize the barriers confronting them, scores of disabled persons rallied Monday to protest delays in congressional action on a Senate-passed bill to expand their access to jobs, transportation and public services. The legislation, endorsed by President Bush, has broad bipartisan backing but has been moving at glacial speed through four House committees since it was approved overwhelmingly by the Senate last September. “Two centuries is long enough for people with disabilities to wait before the constitutional promise of justice is kept," Justin W. Dart Jr., chairman of the President's Committee on Employment of People with Disabilities, told the rally. “If we have to come back, perhaps we'll simply stay until they pass [the bill]," said I. King Jordan, first deaf president of Gallaudet college for the deaf, hinting at a Capitol Hill camp-in for the disabled. Organizers of the rally said disabled persons from 30 states, including many in wheelchairs, came to demand immediate action on the bill without any weakening amendments. At the close of the rally, when dozens left their wheelchairs to crawl to the Capitol entrance, spectators’ attention focused on 8-year-old Jennifer Keelan of Denver, who propelled herself to the top of the steep stone steps using only her knees and elbows. Nearby, sprawled on her back and inching ahead slowly, was Paulette Patterson, 33, of Chicago. “I want my civil rights," Patterson said. "I want to be treated like a human being." Despite grumbling from rally-goers that the Bush Administration and Democratic leaders were relaxing their efforts on behalf of the measure, key advocates predicted the House log-jam will be broken in the next few weeks. The House Energy and Commerce Committee is expected to approve its part of the legislation today, followed by similar action by the Public Works and Judiciary committees. Final House passage appears likely to occur by May. Ralph Neas, executive director of the Leadership Conference on Civil Rights, said the unusual lobbying effort would provide a "final push" to the legislation, which he forecast would clear the House with no more than 100 votes against it. The demonstration at the West Front of the Capitol had some of the fervor of a civil rights rally of the 1960s as the demonstrators chanted slogans and sang songs to underscore their message to Congress. Rep. Patricia Schroeder (D-Colo.) made the comparison, telling the crowd; “What we did for civil rights in the l960s we forgot to do for people with disabilities." Another member of Congress, Rep. Major R. Owens (D-N.Y.), said there are still threats to passage of the bill from conservative lawmakers and powerful business interests who oppose the legislation's provisions on disabled access to transportation. “All the i’s have been dotted and all the t's have been crossed," Owens said. "There have been enough negotiations-delay is the real enemy." Speaking for the Bush Administration however, Chairman Evan J. Kemp Jr. of the Equal Employment Opportunity Commission denied any lack of enthusiasm by the White House. Kemp, who uses a wheelchair, said: "This Administration is more for the bill today than it was 14 months ago.... We have solidarity. Solidarity made Poland free; It can make us free, too." But James Brady, former press secretary to President Ronald Reagan, expressed impatience with Congress’ rate of progress. “l hope these politicians are awake and listening. If not. we'll be back." said Brady, who was disabled when he was shot in the head during an attempt on Reagan's life. Meantime, Atty. Gen. Dick Thornburgh notified key members of the House that the Administration would seek a change in the Senate passed bill to make clear that disabled persons who are willfully discriminated against would not be entitled to monetary damages. The "clarifying amendment" will be introduced during the House Judiciary Committee's consideration of the bill this month, Thornburgh said, adding; "We will . . . continue to support expeditious passage of the Americans with Disabilities Act with this clarification." The legislation, endorsed by President Bush, has broad bipartisan backing but has been moving at glacial speed through four House committees since it was approved overwhelmingly by the Senate last September. When dozens left their wheelchairs to crawl to the Capitol entrance, spectators’ attention focused on 8-year-old Jennifer Keelan of Denver, who propelled herself to the top of the steep stone steps using only her knees and elbows. The demonstration at the West Front of the Capitol had some of the fervor of a civil rights rally of the 1960s as the demonstrators chanted slogans and sang songs to underscore their message to Congress. Rep. Pat Schroeder, D-Colo., told the crowd: “What we did for civil rights in the 1960s we forgot to do for people with disabilities." Justin Dart, chairman of the President's Committee on Employment of People with Disabilities. told the rally, “Two centuries is long enough for people with disabilities to wait before the constitutional promise of justice is kept.” “If we have to come back, perhaps we’ll simply stay until they pass (the bill),” said I. King Jordan, first deaf president of Gallaudet College for the deaf located nearby, hinting at a disabled camp-in on Capitol Hill. Organizers of the rally said disabled persons from 30 states, including many in wheelchairs, came to demand immediate action on the bill without any weakening amendments. Despite grumbling from rally goers that the Bush Administration and Democratic leaders were relaxing their efforts on behalf of the measure, key advocates predicted the House logjam will be broken in the next few weeks. Chairman Evan Kemp of the Equal Employment Opportunity Commission denied any lack of enthusiasm by the White House.
