Title: Cincy arrests disabled in protest of bus access By BILL SLOAT STAFF writer CINCINNATI — Police arrested l7 disabled people yesterday after they blockaded the entrance to a downtown hotel or chained themselves to the doorway of an adjoining office building that houses Queen City Metro, this city’s public bus service. Eleven of them refused to post bond and were in Hamilton County Justice Center under cash bonds ranging from $1,500 to $3,000. Five were released late yesterday on personal bonds. One pleaded no contest to disorderly conduct and was found guilty. Sixteen were in wheelchairs from polio, paralyzing spinal accidents, multiple sclerosis, cerebral palsy and amputations. One was blind and walked carrying a white cane. The arrests were made during a non-violent, noon demonstration that challenged lack of access to city buses here and around the nation. Chants of “We will ride" and “Access now” came from about 52 demonstrators outside the Westin Hotel. Some removed footstands from their wheelchairs and banged on metal barricades. Police stood behind the barricades and refused to let the demonstrators into the hotel. All 17 taken to jail said they were members of a national handicapped rights organization called American Disabled for Accessible Public Transportation. “This is a civil disobedience action," said Wade Blank, 47, a Presbyterian minister who helped organize yesterday's protest. Blank, who now lives in Denver, was involved in anti-war demonstrations at Kent State University in the 1960s when he lived in Akron. Several of the people loaded onto vans and hauled away to the Hamilton County Justice Center on disorderly conduct charges compared Cincinnati to Selma and Montgomery, two Alabama cities where civil rights activists were jailed by authorities in the 1960s. “The message needs to be sent out that we can’t ride a bus because we're handicapped,” said Glenn Horton, 46, of El Paso, Texas. "It's discrimination it’s segregation and it’s appalling that it could still be happening in this country." Horton said he had been confined to a wheelchair since age 9, when he fell and broke his back. Bill Bolte, 54, of Los Angeles, said handicapped people needed mainline bus service to get to jobs, movies, dates, shopping, banks and anywhere else they might want to go. “We're already in prison," said Bolte, who had polio 51 years ago. “We're going to see that what few rights we have are not going to be taken away. Our rights to public transportation are being deprived, and we will not sit for it." Organizers of the protest said they took to the streets because about 600 executives of public and private transit companies in the eastern United States and Canada were attending a convention in the hotel that ends today. Protesters said the convention should adopt a resolution supporting the installation of wheelchair lifts on all public buses in the nation. Many came from Denver, which has such lifts in use on its bus fleet. The demonstration also came a day after the U.S. Department of Transportation announced in Washington, D.C., a new regulation that allows transit authorities to establish alternative services for the disabled instead of putting lifts on regularly scheduled buses. Demonstrators complained the rule meant that buses, subways and rail lines wouldn't be made accessible to people in wheelchairs. Police Chief Lawrence Whalen said the comparisons with Alabama in the 1960s were unfair when it came to the police. Police in the South during the civil rights era often brutalized protesters. Whalen yesterday said, “Our officers handled themselves very admirably. The group has had their chance to protest and get their point across." He said the police assigned to make arrests had attended special briefings on how to handle disabled people and were instructed to ask the people in custody the best way to lift them into vans. “We wanted to be sensitive to their special needs." Whalen said. Three of those arrested yesterday were out on $3,000 bond after incidents Monday when two climbed aboard city buses, paid fares and refused to leave when ordered off by Queen City Metro officials. The third interfered with a bus. The three, Robert A. Kafka, 40, of Austin, Texas; George Cooper, 58, of Irving, Texas; and Michael W. Auberger, 32, of Denver, were charged yesterday with Criminal trespassing when they chained themselves to the entranceway of Queen City Metro's offices. Police Capt. Dale Menkhaus told his men to use bolt cutters to get them out of the building. Kafka, Cooper and Auberger had been ordered Tuesday not to set foot in Cincinnati by a Municipal judge at the time they posted bond, but another Municipal judge lifted the banning order shortly before yesterday's protests started. Police Chief Lawrence Whalen said 14 others were charged with disorderly conduct for their activities outside the hotel. Bond was set at $3,000 each, a Hamilton County Municipal Court official said. Before the demonstration began, the group gathered in a Newport, Ky., motel for a strategy session on civil disobedience. They agreed not to carry anything but identification with them when they confronted police in downtown Cincinnati and they voted not to post bail. None of the people arrested were from Ohio. The 11 who refused to post bond and were in jail last night are: Bolte; Bob Conrad of Denver; Joe Carle of Denver; Auberger; Horton; Jim Parker of El Paso, Texas; Cooper; George Roberts of Denver; Earnest Taylor of Hartford, Conn.; Lonnie Smith of Denver; Kafka. Kelly Bates of Denver pleaded no contest to disorderly conduct, was found guilty and sentenced to 30 days in jail, which she is to start serving tomorrow. Those released on personal bond are Ken Heard of Denver; George Florman of Colorado Springs, Colo.; Frank Lozano of El Paso, Texas; Rick James of Salt Lake City, Utah; and Arthur Campbell of Louisville, Ky.

Title: Disabled People Block Buses, 37 Arrested By Mark Schlinkmann, Regional Political Correspondent Thirty-seven protesters, almost all of them in wheelchairs, were arrested Tuesday afternoon as they blocked buses from entering and leaving the Greyhound Lines terminal downtown. Police also arrested a man from Ohio after he became Involved in a scuffle with two protesters. Police said the man, who was later released without being charged, might have been irritated at the delay in a bus departure caused by the demonstration. The incident, which shut down traffic at the terminal on and off for almost three hours, took place on the third day in a row of protests by disabled people seeking the installation of wheelchair lifts on all buses in the United States. The group, called the American Disabled for Accessible Public Transit, or ADAPT, is in St. Louis because the American Public Transit Association is meeting at the Omni International Hotel. But after two days of protesting at the hotel, the target shifted Tuesday to the Greyhound terminal, at 801 North Broadway. "We demand that they serve all the public, including us," said Bill Bolte of Los Angeles as he and others blocked a bus on Sixth Street from entering the terminal. "We're going to stop their buses everywhere until they stop treating us as less than greyhounds." Boite and others complained that Greyhound allowed disabled people with wheelchairs to travel only if were accompanied by a companion. George Gravley, public relations director or the bus line, defended the company's policies in a telephone interview from his office, in Dallas. While the company lacks mechanical lifts, he said, it for years has had a program that provides a free ticket to a companion of any disabled traveler. The protesters began arriving at the terminal around noon. First, a few people began blocking two entrances to a parking lot on the east side of the terminal along Broadway. Then, when a bus without passengers drove toward the west-side entrance, on Sixth, several protesters wheeled up to block its path. Carrying placards and chanting slogans, the group grew in number to about 20. Police, meanwhile, blocked off Sixth between Convention Plaza and Cole Street to traffic. Other incoming buses were forced to bide their time elsewhere. About 1:30 p.m., Police Capt. Clarence Harmon informed the protesters that they were breaking the law and would be arrested if they refused to move. While that was being mulled over, police said, a man identified as Donald Keiper, 63, of Ridgeville, Ohio, walked from the terminal area and grabbed a wheelchair in which Barbara Guthrie, 48, of Colorado Springs, Colo., was sitting. Keiper started to move Guthrie's wheelchair, but another protester in a wheelchair, Ernest Taylor of Denver, intervened, and a brief scuffle ensued, Police then arrested Keiper. He was released later: warrants were :_aken under advisement. Police said no injuries had resulted. Police later arrested Guthrie, Taylor and the other protesters, some for blocking buses inside the terminal area. The process was slow because the wheelchairs had to be lifted mechanically onto Bi-State buses and vans, which hauled them to the City Workhouse. The episode was over about 3 p.m. The circuit attorney's office said Tuesday night that the protesters had been released on their promise to appear in court after being charged with general peace disturbance, a misdemeanor. Late Tuesday afternoon, Circuit Judge Robert H. Dierker Jr. denied a request from Jerome Schlichter, an attorney from St Louis who is representing ADAPT, for a court order regarding blood tests. Schlichter's request was denied after the city stated that it was not requiring the people arrested to undergo mandatory testing and that only those who agreed to the practice voluntarily were being tested. But Schlichter said ADAPT continued to allege that blood tests were taken without consent Sunday night at the Workhouse from a group of 41 protesters arrested that day in front of the Omni. [Headline] Wheelchair-bound demonstrators tie up mass transit meeting By Philipp Gollner Herald staff writer 10/7/85 Eight wheelchair-bound protesters were arrested yesterday while close to 200 others jammed the lobby of the Bonaventure Hotel downtown to demand greater access for the disabled to public transportation. The demonstrators, members of about 15 disabled-rights advocacy groups from around the country, are demanding a federal law that would order all public transit operators to install automatic wheelchair lifts in buses. Such a law existed as part of the Federal Rehabilitation Act of 1973, but was successfully challenged in court six years ago by the American Public Transit Association, a trade group representing more than 400 transit districts nationwide. The association began its four-day annual convention yesterday at the Bonaventure, and protesters picked the occasion to voice their demands. “We're going to show the American (Public) Transit Association that we don't take crap and we're going to let them know that we are not passive crips," protester Bill Bolte, who has been on crutches or confined to a wheelchair for 52 of his 54 years, told demonstrators at the start of yesterday's protest. The demonstrators rode their wheelchairs down Wilshire Boulevard from MacArthur Park to the Bonaventure, where they hoped to talk to association executive vice president Jack R. Gilstrap and visit convention exhibits. But police blocked elevators and escalators leading to the convention floor, and after about 40 minutes, officers began handcuffing protesters who refused to disperse from fire exits of the second-story lobby where they had assembled. As police carried a wheelchair-bound demonstrator from the lobby, a sympathizer shouted: “Why don't you handcuff his legs? He might run away.” Six wheelchair-bound protesters blocked the path of a departing Airport Express bus that they said was not equipped with a lift. The bus was able to leave after police lifted the protesters and their wheelchairs onto the sidewalk. Inside the hotel, startled guests looked on as protesters chanted “we will ride" and “Gilstrap, Gilstap, where are you?" Seven of the eight protesters who were arrested were driven by specially-equipped vans to the county‘s Central Jail, where they were booked for failure to disperse and interfering with police. One female protester was taken to Sybil Brand institute for Women. All eight were being held last night on $500 bail each. “We certainly aren't unsympathetic to the people involved, but we are responsible for enforcing the law,” Deputy Police Chief Clyde Cronkhite, commander of operations at Central Bureau, told reporters following the arrests. in addition to demanding wheelchair lifts in all public buses, demonstrators at yesterday's protest demanded that the association fire its president, Gilstrap, and pass a resolution pledging commitment to restoring wheelchair access legislation. Albert Engelken. the association's deputy executive director, told reporters yesterday that "Mr. Gilstrap has no intention of resigning" and that there are no plans to vote on any resolutions proposed by the protest groups. Engelken said the group opposes federal wheelchair access laws mainly for what he called "geographical and climatic reasons." The lifts are cumbersome in snow and on curved roads. he said. In addition, it would cost transit districts nearly $270 per disabled passenger boarding if such legislation were implemented, he said. Usha Viswanathan, spokeswoman for the Southern California Rapid Transit District, said the district spends between $15,000 and $20,000 for each automatic lift that it buys. Viswanathan said 1,891 of 2,445 active RTD buses are equipped with lifts. Engelken said the association prefers decisions over access legislation to be made at the local level. But demonstrators at yesterday's protest believe that federal legislation is needed to guarantee the civil rights of the disabled. They argue that current policies violate their constitutional right to equal protection of the laws. "The small things in life that non-disabled people take for granted we have to work harder for," Christina Keeffer. who suffers from cerebral palsy, said. "l'm 42 now and I don’t want to wait until I'm 75 to get the changes."

[Headline] 25 arrested on second day of demonstrations [Subheading] Protesters straining nerves, budgets By Faith Bremner Tribune Staff The handicapped protests in downtown Sparks are costing local residents time and money. Time in the sense that police officers who would otherwise be helping local citizens are spending their time keeping the peace on B Street. Money in the sense that the police and the court are working overtime just to keep up with the 100 or so demonstrators who are protesting the American Public Transportation Association's (APTA) convention at the Nugget this week. “ While (the Sparks Police) are out there handling these individuals and if you call 911, the response times change dramatically," Sparks Municipal Court Judge Andy Cray said. The demonstrators come from all over the country and are members of the Denver, Colo. based American Disabled for Accessible Public Transportation (ADAPT). They are demonstrating against APTA because that organization opposes the federal government forcing public transit authorities to install wheelchair lifts on all buses purchased with federal funds. APTA represents public transit authorities around the United States and Canada. In two days of protests, Sparks Police have arrested 72 demonstrators, mostly on charges of blocking fire access to the Nugget, obstructing police officers and assault and battery, Cray said. Most of those arrested Sunday, the first day of the protest, were given warnings and had their fines suspended, Cray said. Those who were rearrested Monday were given three day jail terms and fines ranging from $200 to $500, he said. The arrested were brought into court directly from B Street and checked out by two nurses, then arraigned and transported to jail via a special lift-equipped van, Cray said. The two judges worked until midnight both nights, Cray said, just to handle the crowd. Likewise the sheriff and the police department are working their crews overtime. The Sparks Police have canceled all days off and vacations and during the demonstrations called in all available officers Lt. Tony Zamboni said. "Everybody's tired and we've put in some long hours but morale is still relatively high," Zamboni said. Likewise, the Nugget is working its security guards overtime, spokesman Parley Johnson said. “I think it's hurting us a little bit but you have to feel sorry for these people,"Johnson said. “It's a tough situation. There but for the grace of God go I.” It has been business as usual at the Nugget, Johnson said, and few customers have been inconvenienced. “Most of our customers didn't realize what was going on," Johnson said. Meanwhile, ADAPT co-founder Mike Auberger complained that the Washoe County Consolidated Jail is unprepared to house the handicapped prisoners. As of this morning about 30 protesters were still in jail, Auberger said. Auberger, a quadriplegic, was arrested Sunday and posted bail and was released late Monday night. "There were only three people handling 30 people's medical needs and helping them to transfer from their chairs to the beds or the bathroom, the litany of what it takes for a disabled person to survive," Auberger said. “Most of the nurses and staff at the jail clearly had never dealt with disabled people. They had no idea what you were asking for." But Sheriff Vince Swinney denied that the jail is unprepared to handle the handicapped. “Somebody should realize this is what these people want to do," Swinney said of the group that has staged numerous similar demonstrations around the country. “If they were treated like royalty, they wouldn't be happy. And the media is playing it up 100 percent. I really think that we who have been here and will continue to be here deserve some credibility.“
