Chicago Tribune Tuesday, May 12, 1992 Title: State thwarts protest, so disabled switch site By Rob Karwath A threatened demonstration by wheelchair-bound protesters prompted an unprecedented show of force Monday at the 16-floor glass-and-steel State of Illinois Center. The demonstrators instead targeted federal offices several blocks south, leaving 3,000 state workers walking along barricaded corridors and past security checkpoints in the building at 100 W. Randolph St. Workers had to tell uniformed police where they were going. Security guards manned the elevators. A trip from an upper floor to a main-floor coffee shop became a half-hour journey. The preparations were made for a group that has become increasingly militant, with members at times chaining themselves to objects and forming chains of wheelchairs. After experiencing a day of the clampdown, most employees interviewed said they thought the state Department of Central Management Services, which runs the building, has overreacted. “It's ridiculous," said Peggy Craddieth, a secretary at the Illinois Pollution Control Board. “Even during Operation Desert Storm they weren’t this tight.” State officials said the tight security will continue all week, or at least until the protesters from Americans Disabled for Attendant Programs Today (ADAPT) leave town. The heavy security seemed out of place to those familiar with the idea behind the wide—open state building. Architect Helmut Jahn created the building to symbolize the openness of a properly run democracy. Jahn’s concept was former Gov. James Thompson's frequent retort to anyone who criticized the building as a poor use of space. “There’s a general discomfort all across the office about this,” said Rob Cushing, a lawyer in the lllinois attorney general‘s office. He said of the demonstrators, “We shouldn't have to go through all of this to deny them their right to protest.” Central Management Services officials said they never intended to create a problem with the extra security, which included calling all department police in on their days off and hiring l6 private security guards at a cost of about $2,000 a day. Instead, department spokeswoman Helen Adorjan said the state was simply trying to keep the building open after receiving a call from ADAPT warning that the group might try to block doors and elevators at the building this week. The group is protesting what it believes to be a lack of government funds for programs that allow disabled people to live at home and avoid nursing homes. ADAPT did block doorways and elevators Monday in at least one Loop building where federal offices are housed. Diane Coleman, an organizer in ADAPT, said Monday that the group went to 105 W. Adams, the Bankers Building, because it houses one of the regional offices of the Department of Health and Human Services. “There have been movements by `groups` like this before, but they were neglecting civil rights tactics—taking it to the streets,” she said. “And we'll do it until we win this issue. Six times the money goes to nursing homes and other institutions than to home and community-based services. We want 25 percent of that nursing home budget to go to home care." Many State of Illinois building workers said they were concerned that everyone entering the building was barred from the Easement and first-floor elevators, which were roped of and guarded by Central Management Services police officers. Yellow and black paper signs directed workers and patrons to an escalator that took them to the second floor where they were allowed to board the elevators. The escalator guaranteed that any wheechair-bound protesters wouldn‘t make it beyond the ground level. But some state workers said they were concerned that wheelchair-bound employees and disabled people with state business had to specially request that an elevator descend to the first floor and then convince building police that they were not protesters. “ls it fair for someone who shows up in a wheelchair to have to declare their business?" asked Alex Des Chenes, a contractor with the state Department of Public Health. “Have you seen the tapes of what the have done in other cities?” Anforjan said. “This group completely immobilizes activity. They need to be able to express themselves, but we need to keep the building operating." But, in an effort to prevent a disruption, workers said all of the extra security only ended up causing a disruption. The building's Lake Street entrance was open, but a large steel gate inside the revolving glass doors sealed it off to all but riders of the CTA subway trains below. A newsstand and a Chinese restaurant located inside the entrance were empty as most of their customers were forced to bypass them. Even some of the Central Management Services police running the elevators said they disagreed with the security plan and would have tried less-disruptive measures. “Everybody’s complaining about this," said one officer, shaking his head as he punched elevator buttons. “It‘s crazy." Title: Bus Stop By Joan Bray Of the Post-Dispatch Staff ACTIV1STS FROM local advocacy groups were absent from the scores of protesters who took to St. Louis streets last week asserting the rights of the disabled to accessible bus service. Leaders of the local groups say tactics, not goals, caused them and their members to opt out of the demonstrations. About 150 people blocked entrances at Union Station and surrounded buses at the Greyhound terminal. A majority of them were in wheelchairs, on crutches or otherwise disabled. And they were out-of-towners. They belong to a loosely woven group, American Disabled for Accessible Public Transit, called ADAPT for short. The group was protesting the policies of the American Public Transit Association, which was holding a regional meeting at the Omni International Hotel at Union Station. As a result of ADAPT's civil disobedience, 78 arrests were made, two group court appearances were held and a lawsuit was filed by the group over treatment at the City Workhouse. We support ADAPT's policies on access 1,000 percent," said Max J. Starkloff. He is executive director here of Paraquad Inc., which advocates rights for the handicapped. "But we have not participated in the demonstrations." "Our methods are negotiation, public testimony and organized public rallies," Starkloff said. "Our goals ore the same" as ADAPT's. Both the local activists and ADAPT want the transit association to push for installing a wheelchair lift on every bus in the country. They see 100 percent accessibility as a civil right. Rut the transit association notes in a written statement that no such accessibility is required by the Constitution, the Congress or the courts. It says the number of lifts on buses has increased to 30 percent now from 11 percent in 1981. In that same period, the administration of President Ronald Reagan has slashed the federal transit program's budget by 47 percent, the association says. The association says each local transportation agency should be allowed to determine how it will provide access for the disabled. Special services — like the Call-A-Ride service operated by the Bi-State Development Agency — may work better than lift-equipped buses in some areas, the association says. Local groups' methods for effecting change include working within the system. Starkloff serves on Bi-State's committee on transit for the elderly and disabled. The chairman of that committee, Fred Cowell, is executive director of the Gateway chapter of Paralyzed Veterans of America. Bi-State has made a commitment to install wheelchair lifts on all its buses, Cowell said. But the committee wants the agency's board of directors to adopt a policy stating it will do so. "We know that the buses are here to stay," Cowell said. "If or when budget cuts come, special services such as Call-A-Ride would be the first to go." Cowell and Starkloff said they feared that between the bureaucracy and the protests, the primary point — the need for equal transportation — was being missed. "A disabled person is not unlike any other person," Cowell said. Disabled people need to get to their jobs, to medical care and to social engagements, be said. "There is absolutely no difference in their need to get around," he said. Starkloff noted that the cost of a van equipped for a wheelchair — a minimum of about $20,000 — was prohibitive for most people. But the disabled should not have to wait at a bus stop on the chance that the next bus may be equipped with a lift, be said. Nor should they have to plan their trips 24 hours in advance, as Call-A-Ride requires, he said. Cowell said, "The main thing the (BI-State) committee has been trying to do is develop a deepening concern for services for the disabled and elderly." The fact that the committee has been successful in persuading Bi-State to buy only buses with lifts prevented the agency from bearing the brunt of ADAPT's effort here, one of the protest leaders said. The Rev. Wade Blank, a Presbyterian minister from Denver, is a co-director of ADAPT. He has a daughter who is disabled. Two months ago, representatives of ADAPT met with State officials in preparation for their trip here and learned of the agency's commitment to lifts, Blank said. As a result, ADAPT aimed its protests at the transit association's meeting and Greyhound Bus Lines. Greyhound is bidding on local routes in some metropolitan areas — Dallas, for one, Blank said. But it does not equip its buses with lifts, he said. A spokesman for Greyhound said last week that, instead, it provided a free ticket for a companion for a disabled traveler. Regarding the transit meeting, Blank said: "Our whole intent is to go after people who are so much wrapped up in the system that they insulate themselves from the issue. They have to live and breathe (ADAPT's protests) when they go to these conventions." Demonstrators here represented some of ADAPTs 33 chapters across the country, Blank said. He said his headquarters was with a group in Denver called the Atlantis Community, which moves disabled people out of nursing homes into independent living arrangements. Funding comes primarily from church donations and foundation grants, he said. From 1978 to 1981, ADAPT protested — and "caused a major disruption" — in Denver every month, Blank said. In 1982, the buses there became 100 percent equipped with lifts, he noted. ADAPT has since protested in all the cities where the transit association has met and where it has been invited by other activists, for a total of about 15 cities, Blank said. Another success that ADAPT points to is a ruling by a federal Judge in Philadelphia in January striking down a regulation of the US. Department of Transportation that allows transit authorities to spend only 3 percent of their budgets on the disabled. The Judge postponed the effect of the ruling while the Justice Department appeals it. Three percent of Bi-State's budget for the current fiscal year Is $2.6 million, said Rosemary Covington, an agency official who works with the advisory committee. But Bi-State will spend only $1 million because of delays in getting bids on new buses and in expanding the Call-A-Ride service. "We are having budget problems, but that wasn't the reason" the money wasn't spent, Covington said. The remaining $1.6 million does not roll over to the fiscal year that begins July 1, she said. She said that by early next year, Bi-State expected that 221 of its fleet of about 700 buses will be equipped with lifts, 12 of the more than 120 routes will be operated entirely with lift-equipped buses, the Call-A-Ride service will include all of St. Louis County and the city and a voucher system will be available for back-up cab service. Equipping all the agency's buses with lifts will take six to seven years, Covington said. Meanwhile the committee will help evaluate the services for the disabled, she said. "If ridership doesn't materialize" on the buses with lifts or "if it costs thousands or millions (of dollars) to maintain them, that will enter into the decision making," Covington said. Bi-State is training drivers how to use the lifts and plans to promote and advertise the service heavily, she said.

Title: WHEELCHAIR TRANSIT BUSTED English Cultural Tabloid, Oct 7, 1988, p. 8 by KRISTIAN GRAVENOR Montreal's handicapped community is hoping that getting arrested will succeed where letters and phone calls have failed to improve its transit service. About 50 activists were arrested after blocked traffic along Rene Levesque, disrupting the Queen Elizabeth Hotel conference, and demonstrating at the Sheraton hotel, where members of the American Public Transit Association (APTA) were staying for an annual convention from October 1-5. The local disabled population teamed up with the American Disabled for Accessible Public Transit (ADAPT) in protesting against APTA policy. ADAPT has organized civil disobedience at all APTA conferences for the last five years, with last year's convention in San Francisco resulting in over 70 arrests , while a regional conference in St. Louis led to the arrest of over 40 activists. Stephanie Thomas of ADAPT says that the enmity towards the transit group dates to the late '70s when the U.S. government passed a law which decreed that all new public transit vehicles must be accessible to the handicapped, but APTA lobbying had the law overturned. Thomas, who has been active in each of the protests against APTA, refuted the organization's claim that making transit accessible is expensive and impractical: "A lift on a bus only increases its cost by about 10 per cent, which would be made up as it eases the cost on the separate transportation system for the disabled." Montreal's transit authority (MUCTC) is a member of APTA and has failed to make new buses or subway stations accessible to the disabled: A separate service for the disabled has existed since 1980. This system, according to Francois Gagnon of the Quebec Movement of Handicapped Consumers, is deteriorating. "The Quebec government has ordered that the separate service maximize its use," he says, "and since then, one complaint I received was from a man who gets picked up for work at 7 AM and is delivered to his job at 9:45 AM." Gagnon, whose organization encouraged the disabled community to take part in the protests against APTA, argues that economics and demographics prove that now is the time to make the system accessible. "By the year 2000, 25 per cent of Quebecers will be senior citizens, many of whom will be handicapped, and the longer it is delayed, the more expensive the transition will become." For many disabled, the real issue is the right to enjoy transit facilities made for the rest of society. The protests are an attempt to end the separate transit systems. Stephanie Thomas stresses that ADAPT is not demanding that existing vehicles be modified, only that new equipment should be accessible to the disabled. Thomas is encouraged by the results of the protests. 'We have been active lobbying, and nothing was ever done. But since we started protesting, it has become a major issue. Slowly, cities such as Phoenix, Atlanta, Dallas, Syracuse, and Chicago are changing to accessible transit." Montreal may yet be able to join that list. The End

[This article continues in ADAPT 422 but the entire text of the article is included here for easier reading.] Title: MUC police arrest 20 on Day 2 of protests by wheelchair activists By: Susan Semenak, of The Gazette 10/4/88 Large contingents of Montreal Urban Community police were mobilized yesterday for the second day in a row to deal with wheelchair protesters who were demonstrating for better public transit facilities for handicapped people. Twenty protesters were arrested, 10 in a demonstration atop Mount Royal and 10 who chained themselves to the doors of the under-parking garage at Place Ville Marie, across the street from the Queen Elizabeth Hotel, where the American Public Transit Association — the protesters' target — is holding its convention. Most of the demonstrators were members of ADAPT — American Disabled for Accessible Public Transit. In the demonstration on the mountain, 35 protesters tied up 100 specially trained police for about four hours yesterday afternoon. [Subheading] Refusing to clear road Ten were arrested after refusing to clear the road leading to the Mount Royal chalet, where the transit association had organized a lunch. After pleading guilty in municipal court last night to charges of mischief and obstructing police, five demonstrators paid fines of $50 while five others refused, to pay and were sent to jail for three days. A mother and her 12-year-old daughter were released after the Place Ville Marie protest. The eight other activist pleaded guilty to charges of mischief and obstructing police. All eight chose to go to jail for three days rather than pay $50 fines. [Subheading] Placed on probation All those who pleaded guilty yesterday were placed on probation until the convention ends Thursday. Judge Louis Jacques Leger barred them from the island of Montreal and from demonstrating and banned them from the mountain and from a wide downtown area around the Queen Elizabeth Hotel. Police said last night that of the 48 activists arrested yesterday and Sunday, only one was a Quebecer. Protest organizer Rev. Wade Blank of Colorado told Leger. "I am personally grieved and saddened that this court has chosen to punish people who have already been greatly punished by society." Const. Normand Tremblay said the Montreal Urban Community police were out in full force yesterday to prevent the wheelchair protesters from repeating the disturbance they had caused Sunday, when they chained themselves to railings at the Sheraton Centre hotel and blocked traffic on Dorchester Blvd. for nearly two hours. Twenty-eight of the handicapped activists were arrested Sunday. After pleading guilty to mischief charges, five paid $25 fines and were released, while 23 others opted to serve three-day jail terms at Bordeaux and Tanguay jails. "We are joining our friends in jail and it's worth it," said Lillibeth Novaro, one of those arrested on the mountain yesterday, as a policeman wheeled her to a school bus hired to take the protesters to police headquarters and municipal court. "There are millions of people in wheelchairs who need to take the bus to go to work and be equal members of society," she said. Novaro ended up paying her $50 fine and didn't go to jail. 'We want equal access' "We pay taxes like everybody else and we want equal access to mass transit," said Molly Blank, who drove four days from Colorado with her husband and 18-year-old handicapped daughter to join the protest. Police blocked roads leading to the chalet and the lookout atop the mountain with barricades and patrol cars to prevent the protesters from confronting the luncheon guests. The police force's tactical squad had been tracking the demonstrators' movements since morning. Urgences Sante doctors were on hand to verify that none of the protesters had been injured during the arrests. "We know these people are here to cause problems and we are here to prevent that," Tremblay told reporters as a helicopter the MUC had rented for the day from provincial police hovered overhead. "We are allowing them to protest and express themselves, but we cannot allow them to make trouble. And we want to take all the necessary precautions to ensure that nobody is injured”. The special police team assembled to deal with the protesters took a day-long course last week to learn how to "handle" the handicapped — from identifying disabilities and deactivating wheelchairs to carrying the disabled without injuring them. Tremblay said police consulted their counterparts in six U.S. cities where the group has staged previous demonstrations. Phyllis Young, a transit official from Duluth, Minn., who attended the luncheon on Mount Royal, said the wheelchair protesters have been turning up at public transit conventions for the past five years. "This is nothing. In San Francisco they chained themselves to trolleys and ran over one policeman in their wheelchairs and gave him a concussion," Young said. "Another year they all laid down on the street and blocked traffic for a whole day." Tremblay said police could not stop the protesters from coming to Montreal because they have no criminal record — the only laws they had broken are municipal bylaws. Instead, MUC police smiled and chatted as they wheeled the protesters away. But some had donned kneepads under their uniforms in case the protesters became aggressive. Maria Barila, a Montrealer arrested on the mountain, said officials at the Office des personnes handicapes du Quebec — the government agency that oversees services to the disabled — discouraged local disabled people from turning out at the demonstrations. "Some people were told they could lose their welfare cheques," said Barila. "Others were told that things could get violent." Francois Gagnon, also of Montreal, said specialized buses for the handicapped provided by the Montreal Urban Community Transit Corp. are "a joke." He said the disabled would prefer to ride the same buses and Metros as everyone else. “They call It door-to-door service, but sometimes it takes two hours for a disabled person to get from home to work in those mini-vans they provide," said Gagnon, winding his way up the mountain in his wheelchair. Meanwhile, Murielle Lariviere-Lebret, president of the Adapted Transport Users Association, said her group morally supports ADAPT protesters demanding accessible transport for all. But her group, which speaks on transit for 18 associations of the handicapped here, would not join demonstrations or urge members to do so. Instead, it prefers to concentrate on getting more and better minibuses and taxis to serve handicapped commuters in the MUC. Over the longer term, it favors adapting the regular bus and Metro service so it is accessible to the handicapped. [Subheading] Position denounced This position was denounced by Jean-Francois Gagnon, a member of the Quebec Association of Handicapped Consumers, who said the handicapped had to become more radical to get what they want from the MUC and Quebec. But MUCTC managing director Louise Roy said the transit corporation has no intention of adapting buses or Metro stations to accommodate the handicapped. "Our intention was never to make the Metro system completely accessible she said. "We are working on improving our adapted door-to-door service, and I think that's much more realistic." Adding wheelchair-lift platforms on regular buses would cost $15,000 per bus, which Roy said is too expensive. Instead, the MUCTC will spend $16,000 on improving adapted transit services next year. "Each year our ridership on adapted transit increases by 30 per cent. Last year we served 500,000 people," she said. Service is offered through adapted mini-buses and taxis. Riders pay the same price they would to ride a bus and the rest of the cost is absorbed by the MUCTC, Roy said.

Transit activists wheel into action on South Shore By PEGGY CURRAN Of the Gazette In March, Bill Bolte took a sledge-hammer to Hollywood's star-studded Walk of Fame because it wasn't wheelchair-accessible. Bolte was arrested, although the vandalism charge was dropped, he says, "in the interests of justice." Six months later, Bolte says the city of Los Angeles has come up with $360,000 to cut access ramps along the 2.5-kilometre sidewalk. On Monday night, the wheelchair-bound American was arrested again - for the 14th time - when he chained himself to the doors of the underground parking garage at Place Ville Marie. Released from Bordeaux Jail yesterday but banned from demonstrating on the island of Montreal, he joined about 20 disabled people who took their crusade for better public transit across the bridge. There were no arrests during the brief, boisterous sit-in at the Brossard bus terminal. But Bolte said another arrest was a risk he was ready to take as a member of ADAPT - American Disabled for Accessible Public Transit. [Subheading] `Not willing to go last' "Our only ability is to embarrass and expose the position of the able-bodied power structure, which is basically 'You go last,' " Bolte said. "Well, we aren't willing to go last any more." For about half an hour during afternoon rush hour, members of ADAPT and their supporters staged a rowdy demonstration at the terminal on Taschereau Blvd. Chanting "we will ride," about five disabled people parked their wheelchairs in front of a Montreal-bound bus. That forced the South Shore transit authority to empty the bus and have passengers board other buses idling on Taschereau Blvd. One of the disabled protesters, Marthe Bail of Quebec City, succeeded in boarding the bus by pulling herself out of her wheelchair and clinging to the handrails. Bail, one of only four Quebecers who took part in yesterday's protest, said disabled Quebecers have a fundamental right to public transit. And she said they shouldn't have to rely on the woefully inadequate service now provided. [Subheading] Sympathetic response In Montreal, for instance, she said disabled passengers must make reservations 48 hours in advance whenever they want to use the service. And the buses don't cross bridges, ruling out trips to Laval and the South Shore. Pierre Beaudoin, whose bus was blocked by the protesters, said he respects their demands. Beaudoin said he believes it would be possible to redesign regular buses to provide access to the disabled by installing lifts and setting aside space for wheelchairs. For the most part, commuters who witnessed the demonstration were also sympathetic. "They feel they have to do this to achieve their goals," said Andre Plante. "Who are we to complain? What's a delay of a few minutes? These people are handicapped for life." Brossard resident Francine Labrosse said she doesn't think ADAPT's demands are very realistic. I don't think the inside of the bus is wide enough for wheelchairs even if the lifts they want were installed," Labrosse said. "Of course, if the government decides it wants something anything is possible." But at least one South Shore resident was outraged by the demonstration. "How am I supposed to' get to work?" a livid Joseph Pacheco screamed at bus driver Beaudoin. "Am I supposed to take a taxi? That will cost me $11. Who is going to pay' for that?"

[Headline] Wheelchair Protesters Unfazed by Metro stairs By PEGGY CURRAN of The Gazette It began when Ronnie Smith deliberately hurled his wheelchair down the stairs at the Longueuil Metro station. Horrified commuters stood by helplessly as the frail-looking Dallas, Tex., man tumbled in a heap at the foot of the stairs. Five Longueuil police officers rushed to pick Smith up and ease him back into his chair. "It wasn't bad," said Smith, 33. "I knew if I made it halfway down, I'd be OK. I knew I'd be shaken up a little bit." Minutes later, 10 more disabled activists had abandoned their wheelchairs, slithering or crawling down the steps to the subway level. Holding up bus tickets, they edged toward the wickets - only to be stopped by a police barricade. Another 30 disabled people remained in the rotunda upstairs, chanting "We will ride" and singing We shall overcome. Most of the protesters were Americans, members of ADAPT - American Disabled for Adapted Public Transit. For five years, the organization has taken radical action to press its demands for better public transit. Often it stages spectacular demonstrations and welcomes arrests. The group came to Montreal for four days to stage protests again at he annual convention of the American Public Transit Association. Since Sunday, some 48 protesters have been arrested during demonstrations at the Sheraton Centre, the chalet on Mount Royal and Place Ville Marie. There were no arrests during yesterday's demonstration. Longueuil police Sgt. Pierre Rheault said his officers would allow the disabled protesters to demonstrate, as long as they agreed to leave peacefully when they were done. And the 15 officers from the Longueuil and Metro police handled the situation with gentleness. Officers offered to carry many of the protesters upstairs at the end of the hour-long sit-in and news conference. And they were quick to intervene when a man, who claimed to be a trained paramedic, lunged at one of the protesters as he lay writhing on the ground. The man, who said he works as a night nurse at Maisonneuve-Rosemont Hospital, had been drinking in a tavern on the lower level of the Metro station when he heard activity in the corridor leading to the trains. He jumped on the disabled man's chest, ignoring pleas to leave the man alone. But police dragged him away, throwing him back into the brasserie and ordering him to stay there until the demonstration was over. Montrealer Francois Gagnon said disabled Quebecers may be afraid to speak out lest they lose the benefits they depend on, such as jobs, disability pensions or housing allowances. But Gagnon said he hopes this week's actions will encourage more handicapped people to step forward to fight for their right to better transit services, and wheelchair access to public washrooms, buildings and housing projects. Meanwhile, at the transit convention, Robert Zuzworsky, a New York Transit Authority driver, was awarded first prize of $1,000 U.S. in the International Bus Roadeo competition held here Tuesday.

The demonstrators were protesting the American Public Transit Association's (APTA) reluctance to endorse wheelchair lifts on new buses. They crashed their wheelchairs through a luggage-cart barrier hotel employees had built in an attempt to ward off the protesters. [Subheading] Came along When APTA, a Washington-based transit authority organization, brought its annual conference to Montreal this week, the protesters came along as part of the ticket. The demonstrators, from a group called American Disabled for Accessible Public Transit (ADAPT), have been protesting at APTA conferences for eight years. Only a few members of a local disabled rights group took part in the demonstrations — the rest were from the U.S. Police said all those arrested — who are expected to be charged with assault — were American citizens, many of them Vietnam veterans. About 50 MUC police officers showed up to clear the Sheraton's marble-covered lobby after the protesters, singing "we want to ride," blocked elevators and escalators. Police wheeled the demonstrators one by one to a waiting wheel-chair bus being used as a paddy wagon. Police snipped chains linking protesters Mike Auberger and Bob Kafka's wheelchairs to a handrail in the lobby. Although the APTA conference is taking place at the Queen Elizabeth Hotel, some of the 3,000 attendees are staying at the Sheraton. Earlier in the day, police turned the Queen Elizabeth into a fortress with metal street barriers as about 75 demonstrators wheeled toward the APTA conference headquarters. They blocked traffic in both directions on Dorchester for more than two hours as police tried to pen the group in with the barriers. Police took two protesters who had crashed the barriers out of their chairs in order to lift them and their chairs over the barriers. [Subheading] Took chair "The police took his chair away, separated him from his legs," said Lori Taylor as she watched from the side-walk when police lifted her husband, Lester, over the barrier. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Bill Bolte, who started ADAPT's Los Angeles chapter, said police overreacted to the demonstration. "This really confuses me because I know that after the Canadians (hockey team) won the Stanley Cup, all types of terrible activity went on," said Bolte. "People overturned cars while everyone, including the police, just looked the other way and went and had a cup of coffee." Several demonstrators who broke through the police perimeter smashed their chairs into barriers in front of the hotel entrance, but hotel security and police stood their ground. Police arrested some 25 wheelchair demonstrators after they forced their way into the lobby of the Sheraton Centre. They were protesting the American public transit association’s reluctance to endorse wheelchair lifts on new buses. Title: APTA still says no to lifts Wheelchair activists cross into Canada Wheelchair militants chased their arch enemy over the border into Canada in October, but unfortunately for advocates of accessible transit systems, the American Public Transit Association (APTA) not only came back but found time in between dodging wheelchair barricades and attending panel discussions to veto mandatory lifts on buses. APTA's board of directors voted unanimously at their national convention in Montreal to reaffirm its policy of local option while continuing to study proposals made by its Elderly and Disabled Services Task Force. APTA has been fighting mandatory lifts since the Carter administrations' Department of Transportation (DOT) first ordered transit companies to install lifts in 1979. APTA lost in U.S. District Court in 1980 but won in 1981 when the U.S. Court of Appeals ruIed that the DOT regulations were not required by Section 504 of the Rehabilitation Act of 1973. In 1983 wheelchair activists in Denver formed the American Disabled for Accessible Public Transit (ADAPT) and picketed APTA's national convention being held in Denver. ADAPT chapters rapidly sprang up in other cities, and APTA delegates soon grew used to having their annual conventions and regional meetings disrupted by hundreds of demonstrators in wheelchairs. This year's meeting in Montreal was no different. As usual, local police threw up barricades in front of the conventioneers' hotels, and as usual, wheelchair demonstrators hurled their chairs and bodies at police lines. And, as usual, they were arrested. "City police crush wheelchair protest," headlined the Montreal Daily News, next to a picture of police removing demonstrators from their chairs and passing them over the barricades. Protester Lori Taylor said the police had no right to take her husband's chair away from him. "They separated him from his legs," she said. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Police maintained that they had a right to remove Lester Taylor any way they could after he deliberately crashed his way through a metal barrier in front of the Queen Elizabeth Hotel. Taylor was taken into custody, along with 24 other demonstrators. Many of those arrested were from Colorado, including Mike Auberger, who chained his wheelchair to a handrail in the hotel lobby. Also among those "arrested" was a seven-year-old-girl from Scottsdale, Ariz. Jennifer Keelan, who has cerebral palsy, was taken into custody along with her mother Cynthia. Both mother and daughter were released later that day without charges being filed against them so that they would not be separated overnight. Cynthia Keelan said the police lifted Jennifer and her chair onto a police van using the kind of lift she and Jennifer would like to see put on every bus. She said she was very proud of her "very, very brave little girl," although a police spokesperson was quick to point out that it was the mother, not the daughter, who was actually being arrested. Most of those arrested were U.S. citizens, although a few Canadians did join the pickets. Maria Barila, a Montreal resident who was arrested, said potential Canadian demonstrators had been warned by one government agency that they could lose their welfare checks if they were arrested. Montreal police had received reports from the six U.S. cities in which ADAPT had previously picketed APTA conventions and had prepared accordingly, down to issuing officers kneepads in case wheelchair militants attempted to run their chairs into police. If you have it and can send a picture we would be very grateful. ] Second article: RTD firm in commitment to accessibility RTD has been named one of the nation's most accessible public transit systems by the American Disabled for Accessible public Transit (ADAPT), and it continues to show every sign of improving that system. On Nov. 1, RTD became one of the first transit systems in the country to offer accessible public transportation on intercity routes when 35 lift-equipped buses began rolling between Boulder and Denver. The Neoplan buses replace Yellow Cab service. Critics of lifts on intercity buses argued that they were too costly and took up to much space on already crowded buses, but when Neoplan submitted its bid to RTD, the cost was so low that the transit agency was able to buy additional buses. RTD says its new regional service shouldn't cause any delays, since its buses are already operating at a 95 per cent on-time rate. The lift-equipped buses operate between Boulder, Broomfield Park-n-Ride, Market Street Station, Stapleton Airport. and Longmont. Regular fares on the Regional AFB arc: Boulder to Broomfield, $1.25; Broomfield Park-n-Ride to Denver, $1.25; Boulder-Denver-Stapleton, $2.00. The fare for disabled individuals traveling during off-peak hours (9 a.m. to 4 p.m.) is 104. Regular monthly passes are $68; disabled riders pay $44 with their RTD Handicapped I.D. card. Ten-ride coupons are also available for this service at a cost of $18. For additional information regarding the new accessible regional service or for trip planning needs, call 777-3343 until 10 p.m. RTD also announced a get-tough policy on non-function lifts on buses being operated by private contractors. Some buses on accessible routes are now operated by private companies, even though the drivers still wear RTD uniforms and the buses carry the RTD logo. Every time one of those buses gets stopped and its lift isn't working, RTD will automatically levy a $100 fine against the private transit provider. It does not appear be the start of the article.] "They bill it as door to door service, but it does crazy things like, if you want to go from west county to the city, it will pick you up but leave you at the city-county line." Bi-State plans to expand the service in December by adding 11 lift-equipped vans and extending the service into the city. The system will also extend its hours of operation, to 6 a.m. to 7 p m. Its use in the city limits will be limited to disabled passengers, Plesko says, and, with the extended hours, disabled workers will be able to use the service to get to their jobs. While some other cities are making similar (or greater) progress — San Francisco, for one, has lifts on every one of its buses — things are still moving too slowly for the members of ADAPT. And they blame the slow pace on APTA. (ADAPT members who came to St. Louis this week stressed that they were here because of their quarrel with APTA and were not here to demonstrate against Bi-State. They said they approved of the plans Bi-State had made for the achievement of 100 percent accessibility, but nonetheless questioned the slow pace at which that was occurring.) The fight between ADAPT and APTA has its roots in the 1970s. During the Carter administration, the Department of Transportation (DOT) issued rules requiring transit systems to have at least half of their buses equipped with wheelchair lifts. Those regulatioms came out of the Rehabilitation Act of 1973, a landmark federal law that many in the disabled community point to as being equivalent to the Civil Rights Act of 1964. But APTA filed suit against DOT for its regulations and a federal court upheld APTA's argument for "local option," that is, allowing individual transit authorities to decide how they would comply with the spirit of the regulation requiring adequate accessible transportation for the disabled. Says APTA's Engelken, "These decisions are best made locally, because the local transit systems understand the needs of their passengers. For example, it would not be feasible to have a transit system for the disabled based on 100 percent lift-equipped buses in Fargo, North Dakota, because in the winter it would be almost impossible for someone in a wheel chair to get to a bus stop and wait for a bus. Able-bodied people have enough trouble (there)." Says Bob Kafka, another ADAPT leader, "(That) is one of the arguments people use for not providing transportation. They say, 'People in a motorized wheelchair can't get there, so why provide (accessible buses)?' But do you know what a person in a motorized wheelchair has to do to get to the bus stop? He has to hit a joystick. Little old ladies cleaning people's homes for years, with fallen arches, and having to carry shopping bags, no one has ever said we need special transit for them. But a disabled person who has to hit a joystick to operate his wheelchair, we need special transportation for them because it’s too cold, too snowy, too hilly, too wet, too this. "It's like were going to break, were going to fall apart." ADAPT sees APTA's insistence on local option as an attempt by the group to foster so-called "separate-but-equal” transportation systems. They say that APTA is attempting to segregate transit systems; keeping disabled passengers out of the mainstream system. ADAPT was formed in 1982 in Denver by Auberger and a handful of other members of that city's disabled community. It was put together because APTA had scheduled a convention for Denver and APTA's resistance to 100 percent accessible main-line public transportation for the disabled made the trade organization the moral equivalent of "the Ku Klux Klan and the Nazi party" for disabled Americans, Kafka says. Thirty demonstrators showed up at the first protest, and there have been eight subsequent protests, all at APTA regional or national conferences. The demonstrators model their actions after the non-violent civil rights activists of the 1960s. They block access to buses: they block access to the APTA convention sites. Some, including Auberger, chain themselves to buses or to doorways. The aim is arrest and the accompanying media attention. Auberger has been arrested at least 30 times by his own count, including this past Sunday at the Omni Hotel. ADAPT's militant tactics have drawn criticism from several corners, including others who work in the disabled community. "While we agree with the goals and-objectives of accessibility for disabled persons, we don't agree with the tactics of civil disobedience or confrontation as a means to achieve those objectives," says Ginny Weber, assistant to Deborah Phillips, the commissioner of the city's Office on the Disabled. "There are other ways to get things done," she says. "You can go through the legislative process. You can conduct public awareness campaigns. Over the last 10 years, some progress has been made. To change conditions that have been in existence for a long time takes a while. You have to just stay in there' and keep working towards it." Sheldon Caldwell, executive director of the St. Louis Society for Crippled Children, agrees. "I don't think it pleads our case well to have a group with a disruptive militant attitude. This is my personal opinion: I haven't polled my staff on this, but I don't think disruption is ever the way to go about it. But others are not as harsh in their judgment. "I take a different position (from those who criticize ADAPT)," says Paraquad's Tuscher. "I have the point of view that there are many ways to get from where we are to where we want to go. We're more likely to use negotiation, legislative action, legal action, public relations campaigns. Confrontation is not one of our methods, but I don't think it's my place to judge (ADAPT). Let history judge: let history prove whose method is the right one." About the criticism from within the disabled community, ADAPT's Kafka says, "Those who are in power are not going to give it up to you willingly. Without the push of civil disobedience, even the Civil Rights Act would never have come about." Says Auberger, "(Negotiation and public relations campaigns) delay the justice. It's not perceived as delaying justice, but it is. They are doing harm to their disabled brothers and sisters by saying, 'I don't support their tactics, but I do agree with their position.— Because other groups for the disabled receive so much financial support from corporations, they are less willing to be as direct in their demands as is ADAPT, he says. "They will eat a lot of garbage just to get half the loaf. "If you're going to change things, you have to get rid of the notion right away that you are going to be someone's friend," he says. "Be-cause someone is going to want something different than you do. The city of St. Louis and I will never be friends. The police and I will never be friends, but I won't lose any sleep over it. I know when I leave here, people will be talking about this issue in a way it hasn't been talked about before and something might change. "You look at demonstrators in history. Go back to the civil rights movement. The blacks who demonstrated weren't seen as 'nice.' If you go back further, to the women's suffrage movement, those women who wanted the right to vote weren't seen as mom and apple pie. But typically people who have been vocal about their rights are never perceived as being nice." When ADAPT members from all over the country began descending on Phoenix this spring to protest at the American Public Transit Association’s regional meeting, staff of the Arizona Bridge to Independent Living felt some anxiety over where our loyalties lay. The City of Phoenix had been receptive to the disability community. They'd purchased only accessible buses the last three years. Phoenix's Regional Public Transportation Association had spent hundreds of hours working with us. Yet we also knew from brief interaction with ADAPT that their strongly-worded opinions best expressed our frustration and anger at the system's unwillingness to commit to 100% accessibility. ABIL decided to work with both groups. Prior to their coming, we discussed with ADAPT the guidelines they’d follow in deciding what level of civil disobedience would be involved. We found ADAPT’s demand — that cities purchase only accessible buses in the normal course of replacing a fleet — a reasonable one. ADAPT wasn’t demanding bus systems retrofit their buses, or that they immediately replace all their buses with lift-equipped ones — just a long-term commitment to change. " A month before the APTA meeting, ABIL met with RPTA officials to discuss our and ADAPT's demands for accessibility. To our surprise, RPTA suggested their commitment be put in writing and adopted by their board! ADAPT was already having an effect — and they weren't even in town yet! The day before, ADAPT arrived. ABIL hosted a meeting for those disabled people from all over the community who were most likely to be contacted by media or others regarding the APTA/ADAPT confrontation. A consensus emerged that the disability community would maintain a united front; that the local community's interests were the same as ADAPT’s and that any public discussion beyond that — especially regarding ADAPT's "techniques" — would simply distract from the central issue: accessible mass transit. This single act of meeting and making these decisions was the thing most responsible for the success of our efforts. By spreading the word, we were able to keep from being forced into a public debate over the differences between persons with disabilities rather than focusing the debate on our common interest —- accessible public transit. Negative comments from a few individuals in the community were lost among the events of the next several days. ABIL found itself taking an increasingly larger role as protests and police reaction escalated, with some of us participating in the demonstrations, others calling politicians and media, putting pressure on local bureaucrats and helping to keep lines of communication open. The mayor of Phoenix, in the midst of the media barrage, made a public statement supporting the purchase of accessible buses. After APTA and ADAPT had left Phoenix, ABIL set up a meeting between the Mayor and local ADAPT members. It was the first time the Mayor had sat down with members of the disability community to discuss transportation. Although he and some transit system officials were still angry about the demonstrations, they were taking us more seriously. That's a tradeoff we’re willing to make. The ADAPT experience was a positive one for ABIL and the disability community in Phoenix. The events caused more public discussion about accessible public transit in those five days than there had been in Phoenix in the past five years. The longer the topic stayed in the news, the greater appreciation the public had for the need for accessible public transit. — Robert E. This is the second article: Title: End of September will see ADAPT in S.F. Denver. Then Washington, D.C. Then Los Angeles. Then Detroit. For the past four years, members of American Disabled for Accessible Public Transit have held demonstrations during the American Public Transit Association’s annual convention, trying to get the lobbying and trade association for the public transit industry to change its mind about lifts on buses. APTA refuses to back mandatory requirements that public bus systems be accessible — instead, they promote a concept called “local option." Under “local option,” something ADAPT organizer Wade Blank has compared to “states’ rights” back in slavery days, communities should decide whether equipping a bus system's fleet with lifts is “better" for disabled people than a separate, “paratransit” system of mini-buses (often called "dial-a-ride.”) Since APTA has refused to change its position, ADAPT has continued to harass the group. Each year ADAPT’s ranks have grown. The first year ADAPT picketed APTA’s convention, in Denver, ADAPT was a local, Denver-based group of wheelchair riders. Today, there are ADAPT chapters in most major American cities. Local disability `groups` in the San Francisco Bay area are organizing for this year's convention and expect hundreds of disabled people from across the country for events beginning September 28. Title: Disabled protesters spark Metro debate BY PAUL FURIGA The handicapped protesters who halted Queen City Metro buses have left jail and Hamilton County, but the controversy they created remains. Leaders in the disabled community shied away from the demonstrations and arrests, but quietly applauded members of American Disabled for Accessible Public Transportation's (ADAPT) actions. Almost two weeks ago Cincinnati police arrested 17 ADAPT members when they attempted to block the Vine Street entrance to the Westin Hotel and the Fourth Street entrance to Queen City Metro's offices. The demonstrators came from all over the United States to protest at the convention of the American Public Transit Association at the Westin. Their protests raised hopes in Cincinnati. A fire has started; and it's important to keep the flames fanned," said Basil Vlahopoulos, co-chairman of Metro‘s Specialized Transportation Advisory Committee (STAC). “if it dies, it will take another 10 years to get it started.” Metro officials who run Access, the local transit service for the disabled, also find themselves in the public eye for the first time in several years. “I think we" understand the need is there for more service,” said Judith Van Ginkel, spokeswoman for Metro. “The question is one of funding and do we have the funds available.” “Every dollar is precious, and the issue is to put each dollar to best possible use,” said Murray C. Bond, Metro's assistant general manager. Both camps agree that the ADAPT visit raised the public awareness of public transportation for the handicapped. Both also agree that a big debate on Access is in the future, the result of the ADAPT visit and recent changes in federal regulations. Metro officials and handicapped leaders do not agree on the extent of problems with the current situation, or on the solutions that might improve transportation for the handicapped. At Metro, Access manager Carl Palmer and Bond point out that each one-way Access trip costs taxpayers more than $10. The annual cost for Access, Palmer said, is more than $1 million. For that money, he said Metro makes an estimated 105,000 one-way trips for passengers each year, charging them 60 cents each. Palmer said Metro turns away only 4% to 5% of those who call to schedule Access service. But he acknowledges that Access meets only 6% of the estimated potential demand in Hamilton County. A new federal interpretation of regulation 504, which mandates handicapped service, will require Metro to add about $200,000 to its Access service in 1987. That may allow service with two to three new vans, Palmer said. But even that, he said, will not make much of a dent. Bond says he sees few alternatives. As expensive as the Access service is, he argues that it would cost $6 million to equip Metro's 379-bus fleet with lifts that would accommodate handicapped passengers in lieu of Access.
