A group of disabled persons in Denver, spurred to expectations of a better life by a new-found militancy, for some months now have been working to bring to to life a planned community in which handicapped persons could live a more normal life. This type of community, they hoped, would be free of confining nursing home atmospheres which so easily could make "vegetables" out of young patients without hope for anything more. Now, it has been announced, the first step toward that new independence has been successful. Within three months 14 disabled young persons will move from nursing homes into a cooperative apartment living situation in which they can receive the medical and supportive services they need in addition to the freedom they so desperately seek. The group will move into a renovated apartment complex called Las Casitas Homes at W. 11th Ave. and Federal Blvd. They will receive services and funding from a variety of sources. It is with a project such as this — perhaps unique in the nation — that disabled persons can find their level of dignity and productivity. For too long they have suffered through stereotyping which never realized their potential. However, the note of caution comes here: The participants in the program must be carefully screened so that those who take part can experience success in their new life styles; and those who are chosen must not reject the level of assistance that they still require in the headiness of their new freedom. If the commitment of all concerned is well established, the program should work and become a guiding light for other communities across the country. - ADAPT (35)

[Subheading] Bus-Blocking Plaque SE Corner, Broadway & Colfax The plaque on this corner celebrates the nineteen disabled activists who blocked inaccessible buses overnight on July 5, 1978. This began the campaign for lifts on Denver's public buses. The Regional Transportation District (RTD) made the commitment to full access in June, 1983. All buses in Denver are now lift-equipped and useable by everyone, including people with disabilities. This struggle for civil rights culminated in the passage of the Americans with Disabilities Act in July, 1990. Second panel: [Headline] Where it all began... [Subheading] the former Heritage House West 1st Ave. & Sheridan The nursing home at 5301 West First Avenue was the former residence of the founding members of the Atlantis Community and ADAPT. ln 1975, when they attempted an “exodus” to live independently in their own homes, they found that Colorado would not provide any personal attendant services outside an institutional setting. The people of Atlantis went to the state legislature to demand provision of in-home services, thus beginning the independent living movement in Colorado. Atlantis became the second independent living center in the country. The former nursing home inmates sued Heritage House for mistreatment and denial of civil rights (Smith vs. O’Halloran). After a 12 year court fight, a settlement was reached, awarding thirty disabled individuals a total of $3.2 million. With this victory, federal Medicaid officials were forced to design minimum standards of care and services for residents of nursing homes — the OBRA Act. The beginning of the Atlantis Community was dramatized in the 1990 ABC-TV movie, “When You Remember Me." ADAPT, a national grass-roots disability rights movement, was founded in 1983. ADAPT led and won the national fight for wheelchair accessible public transportation. Mike's Postcript: Poems in Print Michael Smith of Denver, a 21-year-old victim of muscular dystrophy, held firmly to the dream that one day a book of his poems would be published. That dream was realized this week — about 2.5 months after Mike died at the place he called home, the Atlantis Community for the handicapped in Denver. At that time, a manuscript of Mike’s poems was being circulated to publishers. The poems were written during Mike’s last seven years, when he was living in nursing homes and was unable to lift pen to paper but dictated the poems to friends. A copy of the manuscript of his poems was cradled in Mike’s arms at his funeral and later when he was cremated. Afterward, it was determined that the poems would be published privately, with all profits- after printing and selling costs- going to the Atlantis Community. Mike’s book, titled "Companions" was published Monday and is available at bookstores and in book sections at department stores in downtown Denver and outlying areas, as well as at the Colorado University Extension Center and Metropolitan State College Bookstores. Mike lived long enough to hear the tribute paid to his poems by Thomas Hornsby Ferril of Denver, who recently was named Colorado's Centennial poet. Some of the perceptions and imagery in the poems are "near genius," Ferril said after reading the manuscript. Mike's book contains 32 poems, many of which are dedicated to Mike's companions- the handicapped persons he had known in nursing homes and later at Atlantis. In his last months, Mike progressively weakened and was confined to bed, depending to a great extent on an oxygen tank to ease his breathing. Despite the ravages of his illness, Mike was able to write affirmatively: "Our there in the blackness is a porthole that reaches into the worlds of brilliant light. There are souls there whose beauty reaches beyond any mortal eye " And vowing to go beyond this, Mike wrote: "like an arrow shot from a mighty bow, I shall fly into the heart of the most holy of holies.. Home is where I'll be." - ADAPT (42)
The Denver Post? [Headline] Atlantis Residents Train for Hot Line Handicapped persons residing in the Atlantis Community in Denver are being trained to man a telephone hot line to respond to the emergency needs of all the disabled in Denver. Wade Blank, Atlantis co-director, said the hot line -- soon to be put into service -- is being funded by the Colorado Vocational Rehabilitation Division. [Subheading] FURNITURE GIVEN In other developments at Atlantis, the Denver Hilton Hotel ls donating furniture for the apartments in which the handicapped persons reside at the Las Casitas Public Housing Development here. The furniture is being made available by the hotel as the result of remodeling of some of the Hilton’s rooms, Blank noted. Atlantis ls a nonprofit organization which began operations last spring to offer the handicapped the opportunity to live in apartments so that they might attempt to realize their full potential. Blank also said the IBM Corp. in Denver, through its staff member Burt Lipell, donated a new washer and dryer to Atlantis. This equipment is operated by George Roberts, one of the Atlantis residents. The Denver City Council, Blank said, is being asked to appropriate $2,000 for installation of sidewalks among all the Atlantis apartments before winter comes. Atlantis has received three new electric wheel chairs and one manual chair through the efforts of Dr. James Syner of Medicaid’s special Medical Equipment division. [Subheading] COMMUNICATIONS A communications system also ls being planned among each of the apartments at Atlantis. And one of Atlantis’ most severely disabled residents is the coordinator of a wheel chair van which Atlantis leases from this resident, Blank said. This project also is funded by the rehabilitation division. Five Atlantis residents are attending local schools or colleges - one resident attending Metropolitan State College, one at Red Rocks School, two at Boettcher School and one at Opportunity School. Next article on right Disabled Helped by Wirth's Compassion To the Denver Post: IN A RECENT LETTER to the Forum (April 27), Rita Jackson complained that Representative's Wirth office is not accessible to the handicapped "via the front door." A partial truth can be a big lie, and the whole truth should be told. It is true that the front door is hard to negotiate in a wheelchair, but the office building is accessible from the rear, which is where the parking lot is located. Here, as in many office buildings, the "rear" is the normal, preferred building entrance, and as no "second class" connotations. What is more important, Tim Wirth is not the kind of ivory tower legislator who hides in his office and expects the world, disabled included, to bring its problems to him. Tim Wirth constantly leaves his office, goes out into the community, and talks to the people about their problems in their own environment. The disabled have often been helped by his blend of energy and compassion. Atlantis has found that Tim Wirth's heart and mind are always accessible, and that is what counts. Red Rock Journal, Community College of Denver, vol.1, number 2, April 12, 1977 HEW Occupied Disabled Demand Rights by Jim Walker Will the forgotten minority finally be heard? Last Tuesday about one hundred and fifty disabled people gathered in front of the Federal building to demand their rights by protesting the delay of the signing of a bill by Health, Education and Welfare Secretary Califano. Between bursts of chanting and sign waving, several disabled participants lodged verbal protest against the delay. Ingo Antonisch, the executive director of the Mayor's Commission on the Disabled along with Don Galloway, the executive director of the Governor's Advisory on the Handicapped were also there to voice their discontent. Lyle Peterson, master of ceremonies, lead the group in the chanting of "We Want our Rights," while converging onto a downtown street. Clad with wheelchairs and crutches and a stretcher they continued to hold up traffic for about fifteen minutes until Denver police came to break it up. During the detainment of downtown motorists, one parking lot manager, James Chidlaw, started to detour traffic through his lot. In doing this, he came in conflict with a demonstrator named Dennis Wilcox. Chidlaw allegedly assaulted Dennis, throwing him out of his wheelchair. The manager was later cited in county court for two charges of assault. The crowd then proceeded to block the halls of the HEW regional offices on the 10th floor of the Federal Building, where Wade Blank, director of the Atlantis Community, and the participants of the rally demanded that a call be placed to Washington and the conversation be put on the portable intercom system. Califano supposedly was unable to talk at that time and passed the buck on to one of his assistants, who in turn told the angry group that the secretary intended to sign the bill after he had read it carefully. Ingo Antonisch then got on the phone and said, "We hear the message but we want to see the action." Nearly four years has gone by since Section 504 of the Federal Rehabilitation Act was made into law in 1973 under the Nixon administration. The handicapped have fought secretary after secretary under Nixon and Ford and are tired of being shoved around. “It takes $25,000 minimum price to rehabilitate a person from a spinal cord injury, yet we are thrown out into society and left there to hang and dry with our guts in the wind," said one angry protestor. The law when it takes effect, will grant the same rights as racial minorities and women as it does for the disabled. There is another rally scheduled for the 29th of April at the State Capitol. Perhaps there will be more than one person in attendance from Red Rocks Campus. EN ROUTE TO CAPITOL Handicapped youths, most of them in wheel chairs, protested Wednesday morning what they said is inadequate treatment and housing provided by the state. They met at the State Social Services Building, 1575 Sherman St., then proceeded to the State Capitol. Their organization, called the Organization of Disabled Adults and Youth (TODAY), sent statements to Con Shea, social service director, and to Gov. John Vanderhoof. TODAY organizer Deon Yoder, who isn't handicapped but who works as a nursing home orderly during the winter, said the group plans to return to the Social Services building area each day during the working hours until either the governor or Shea decide to address themselves heartily to the problems and care of handicapped individuals. - ADAPT (96)
Rocky Mountain News 9/5/81 Denver, CO Handicapped buoyed by judge's ruling By JANE HULSE, News Staff A Denver judge Friday dismissed charges against 20 able-bodied protesters who invaded the Denver mayor's office last spring because 23 other protesters in wheelchairs had not been ticketed. That, said County Judge Edward A. Simons, is reverse discrimination. The unusual ruling by Simons was hailed by the handicapped community as a "significant” victory. The ruling stemmed from a protest May 15 in the office of Mayor William H. McNichols Jr. concerning budget cuts that would affect handicapped residents. The demonstrators were ordered to leave the building at 5 p.m. after McNichols refused to meet with the group about the cuts in the city’s health-care systems budgets. When the group refused to leave, those in wheelchairs were not ticketed, but the able-bodied protesters were charged with interference —- a misdemeanor carrying a maximum penalty of 90 days in jail or a $300 fine. None was taken to jail and booked. The attorney for the protesters, John Holland, argued that his clients were entitled to equal protection under the law and that the law shouldn’t be enforced selectively against one group. “It takes a message to the mayor that he can’t insult the disabled community by ignoring them," said Wade Blank, a spokesman for the disabled. “The disabled are telling me that next time (they meet with McNichols) he will have to treat them differently.” He said the ruling will cause the handicapped people to become even more outspoken and demonstrative about fighting for their rights. Knowing they would be subjected to jail at demonstrations doesn't frighten them, he said, noting that the jail has wheelchair access. Blank said the city’s decision to ticket only those demonstrators who were not in wheelchairs had the effect of making the handicapped feel as if they weren't being recognized as people. “It made them feel like second-class citizens he said. He said the handicapped demonstrators knew they were breaking the law by refusing to leave and “they were willing to pay the price.” According to the ruling, the city decided not to ticket the handicapped for fear that some weren't able to remove themselves from the office or didn’t understand the orders to leave. But Simons noted that “the time and resources were available to make those determinations." The judge also stated, “The fact that none of the disabled persons were charged in spite of their active resistance to leaving renders the city's evidence insufficient to overcome the inescapable conclusion that the defendants have been denied equal protection of the laws.” - ADAPT (109)
The Denver Post Friday, Dec. 18, 1981 [Headline] Handicapped Will Protest RTD Wheelchair-Lift Ban By George Lane Denver Urban Affairs Writer The board of directors of the Regional Transportation District Thursday made it official – there will be no wheelchair lifts on 89 high-capacity buses expected to be delivered in 1983. The board actually decided a month ago there would be no lifts on the new buses, but they have been hedging on finalizing that action because of objections voiced by the area’s disabled community. Following the vote on the lifts, Wade Blank, co-administrator for the Atlantis Community for the disabled and organizer of the protest against the RTD action, told the transit directors that members of the handicapped community view the action as a violation of their human rights and they will respond to that violation Jan. 4. Blank later said members of the disabled community will be in “training for civil disobedience” between now and Jan. 4. He said beginning Jan. 4, 10 disabled persons in wheelchairs will stage a sit-in in the office of L.A. “Kim” Kimball, RTD’s executive director and general manager. “Everyday during the month of January, 10 disabled people will be occupying Kimball’s office,” Blank said. They won’t have any able-bodied people with them – and if they’re arrested they will be replaced by 10 more. At the conclusion of the board meeting, Kimball told the directors that the RTD staff will take steps to try to prevent this action, but he doesn’t think it proper to discuss those steps at this time. The RTD board during its Nov. 19 meeting voted to save more than a million dollars by not ordering the lifts on the new buses. The RTD staff recommended this action because they said the lifts are expensive (more than $12,000 per bus) and difficult to maintain. The staff proposal was to use the articulated buses on high ridership bus routes, freeing regular buses with wheelchair lifts to provide better service for the handicapped. A delegation from the handicapped community objected to this proposal, with arguments that RTD officials had promised several years ago that 50 percent of the district’s bus fleet would be made accessible to wheelchair-bound riders and all new buses would be ordered with lifts. About 25 disabled persons from Atlantis staged a wheelchair-bound sit-in following the November meeting until Kimball and three board members promised to attempt to get the entire board to reconsider the action. Caption: An RTD bus with wheelchair lift provides mobility for Mel Conrardy Title: Leaders of handicapped rate RTD service best in country By Norm Udevitz, Denver Post Staff Writer Disabled Denverites just a few years ago had as much chance of riding a bus as they did of climbing Mount Everest. “It was brutal the way RTD treated us,” said Mike Auberger, an official in the Atlantis Community, for the disabled and a leader in the fight that has turned the Regional Transportation District’s handicapped service around. In the 1970s and early 1980s, RTD busses then rarely equipped with wheelchair lifts, often left wheelchair-bound riders stranded on streets. Drivers, lacking training in dealing with visually or language impaired people, panicked when blind or deaf riders tried to board buses. “It used to be that even in the dead of winter, when it was below zero, those of us in wheelchairs would wait 2 or 3 hours for a bus to finally stop," Auberger recalls. “And often the lift was broken and we couldn't get on the bus anyway. And usually the drivers were rude and angry. They would tell us that we were ruining their schedules." But conditions have changed, Auberger says: “Right now, Denver has the most accessible public transit system for the handicapped — and all the public - in the country." Debbie Ellis, a state social services worker who heads the agency's Handicapped Advisory Council, agrees, saying: “It took a lot of pressure, but RTD has responded and now the bus system is doing a good job of serving the handicapped." Leaders of national programs for the disabled also agree. In fact, the President's Committee on Employment of the Handicapped will bring 5,000 delegates, many of them handicapped, to its national conference in Denver in April. This will be the first time in four decades the group has held its national session outside of Washington DC. “One of the key reasons we're meeting in Denver this year is because it just might be the most comfortable city in the country for the handicapped,” says Sharon Milcrut, head of the Colorado Coalition for Persons with Disabilities, which is hosting the conference. “A very important aspect of that comfort," she notes, “is how accessible the transit system is for the handicapped.” It didn't get that way easily. In the decade between 1974 and 1984, handicapped activists had to pressure indifferent RTD administrators and directors. Each gain was hard won. “We used every tactic in the book, from lawsuits to bus blockades on the street and sit-ins at the RTD offices," says Wade Blank, an Atlantis group director. “The lawsuits didn't help much but when we took to the streets in the late 1970s, I think that's when we started getting their attention." Blank and others also say the 1984 hiring of Ed Colby as RTD general manager helped. Before he arrived, less than half of the 750 RTD buses had wheelchair lifts, which often were in disrepair. Training for drivers to learn how to deal with handicapped riders was minimal. Agency directors resisted change. RTD relied heavily on a costly special van operation called Handyride - a door-to-door pickup service for handicapped. It has cost $13[? glare makes number hard to read] million to run since it began in 1975. “Over the past couple of years the turnaround has been phenomenal," Auberger says. “All of RTD's new buses are being ordered with lifts and older buses are being retrofitted." By 1986's end, almost 80 percent of the bus fleet — 608 of 765 buses — had wheelchair lifts; 82 percent of the fleet's 6,242 daily trips are now accessible for the disabled. Plans call for the fleet to be 100 percent lift-equipped by 1987's end. “The lifts aren't breaking down all the time now, either," Auberger said, noting that agency officials found drivers had neglected to report broken lifts: “That way the lifts stayed broken and drivers had an excuse for not picking us up. A bunch of people were fired over that and others realized that Colby wasn't kidding about improving handicapped service." Driver training also has improved dramatically. “It isn't perfect yet,” Ellis of the advisory council says. "But everyone is working hard at it. What we are finding is that 20 percent of the drivers understand that they are moving people, all kinds of people, and they're really great with the handicapped. “Another 20 percent figure their job is to move buses and to heck with passengers, all kinds of passengers. That bottom 20 percent probably won't ever change. So we're working real hard on the 60 percent in between," Ellis says. Drivers, for example, learn to help blind riders. “That’s an improvement that helps the disabled, but it also helps regular passengers who are newcomers to the city,” Ellis says. All the improvements haven't come cheap. Since 1974, more than $5million has been spent on lifts and lift maintenance, most of the expense was incurred in the last three years. RTD plans to spend $9 million more in the next six years to keep the fleet up to its current standards and pay for more driver training. Another $4 million will be spent on HandyRide service. Ironically, Auberger and Ellis both say one of the biggest problems remaining is getting more handicapped people to use mass transit. “There are no reliable figures," Ellis says. “But we think there are about 20,000 handicapped people in the metro area and only about 200 or 300 are using buses on a regular basis." Auberger, confined to a wheelchair after breaking his neck in an accident ll years ago, complains: “The medical system builds a bubble around handicapped people and makes them think they have to be protected. "That's just not true in most cases. So one of the things we're doing now is educating the handicapped to overcome their fears. By Al Knight Denver Post Perspective Editor Now, while the Americans with Disabilities Act is awaiting President Bush’s signature, would be a good time to reflect on what has been learned by this city's experience in attempting to provide full wheelchair access to public transportation. Assuming the president signs the bill as he says he will, public transit systems all over America will have to begin purchasing new buses equipped with wheelchair lifts, as well instituting a variety of other steps designed to enlarge employment opportunities for the disabled, improve services in state and local government, enlarge public accommodations, and create a national telecommunication relay service to aid the blind and deaf. Critics of the bill have argued that the nation is embarking upon a program without the vaguest clue of what its ultimate cost will be. In many ways, the dispute is a duplication of what took place in Denver in the early 1980s as the Regional Transportation District developed its policy on how rapidly to expand wheelchair access. There were a number of protests in which disabled residents in wheelchairs disrupted RTD service and were arrested. The protests were particularly disturbing for all concerned — RTD, the drivers and the police. The sight of an abled-bodied police officer toting away a wheelchair-bound citizen is not the stuff for law enforcement scrapbooks, nor is it the kind of publicity designed to attract bus riders generally. In 1982, the RTD board, which then was an appointed body, voted against equipping 89 new buses with special lifts capable of handling wheelchair passengers. That vote set off the protests. An elected board took over in 1983 and one of its first acts was to reverse that vote and authorize the purchase of the lifts at a cost of well over $1 million. At the same time RTD struggled with the issue of whether to retrofit existing buses with lifts, and in 1985 resolved it with a resolution that it would buy lifts for all new buses, but not pursue a retrofitting program. There had been a history of mechanical problems with some of the lifts, and on more than one occasion a lift would fail, dumping the wheelchair passenger in the process. In 1982, then Gov. Dick Lamm refused to go along with a proposal by the American Disabled for Accessible Public Transportation, which was demanding wheelchair access to “all U.S. public buses." Lamm suggested in a speech to the American Public Transit Association that such a policy might result in rides costing $600 each: “If America can't say no to a system that costs $600 per ride, we don't deserve to continue as a great nation.“ But as they say, that was then, this is now. Just last fall, RTD was awarded a special citation for having "the finest accessible bus service in the nation." The award came from the President's Committee on Employment of People with Disabilities. Indeed. it is beyond dispute that RTD has in some respects led the nation. Its experience in developing its current fleet of buses was the prime example used by congressional supporters of the Americans with Disabilities Act. In addition, it is a fact that RTD was the first agency to order its over-the-road buses equipped with lifts. Until RTD's first order, these larger vehicles had been built without lifts. The RTD program hasn’t been accomplished without significant expense. It has cost about $8 million for the lift equipment and millions more for parts, maintenance and training. But the latest figures show per-ride costs are far below the $600 figure mentioned by Lamm. The lifts cost about $13,000 a copy. Because the life of a bus normally is calculated at 12 years, this works out to a little more than $1,000 a bus per year. To this must be added the maintenance cost, which has been dropping each year. As recently as 1985 the cost of maintaining an individual lift was $1,798. This year the average is just over $500. Even without the retrofitting program rejected by the board in 1985, RTD has managed to increase greatly its percentage of lift-equipped buses. In 1985, only 54 percent of buses were so equipped. This year 81 percent are. In recent years, disabled ridership has gone up sharply. In 1982 it was just over 9,000 wheelchair boardings, but last year it reached an estimated 45,000. According to RTD figures, the per-ride cost may have reached $80 in 1984, but with the increase in ridership and the drop in maintenance cost, the cost per ride now has dropped to about $19 a ride, according to the latest calculations. What is not known is how many of Denver’s disabled community actually are served by the lifts. In the mid-1980s, it was estimated that only a few hundred wheelchair-bound residents were regular bus riders. Even as RTD has fitted new buses with the lifts, demands for its HandyRide service have continued to increase. This door-to-door service is available to both the elderly and the handicapped. Some of its wheelchair passengers could be served by regular buses, but many others are unable to get to the bus stop and therefore require the HandyRide service. Precise calculations aren’t available, but it is estimated the cost per ride for using the van service is about $50. Lamm, contacted this week, said he basically hasn’t changed his position on the issue. He said the $600 figure he used in 1982 was based on the experience of the St. Louis bus company. “To govern is to choose," he said, "and I don't believe this nation should make every bus wheelchair-accessible. Should the handicapped be provided transportation? Of course, but it should be provided in the most cost-effective way possible.” Lamm mentioned the expensive elevator system that is a part of the Washington, D.C., subway system as an example of a method that isn't cost-effective. The Denver experience does indicate that the costs of accommodating the wheelchair-bound citizen may not be an endlessly upward spiral. But the key indicator that needs watching is the number of passengers using the service. The taxpayers, the RTD board and staff members clearly have done their part. The wheelchair service is now available on nearly every bus, yet ridership has flattened out. The estimate of 45,000 wheelchair passengers for 1989 is just a few hundred higher than the 1986 level. More persons must be encouraged to use the service. Now that maintenance costs are down, the only way to decrease the still-considerate per-ride cost is to increase the number of passengers using the lifts. The most compelling case the disabled community can make for greater access is to demonstrate an even higher usage of the existing facilities. Rocky Mountain News 10/16/84 Denver- Boulder rides offered to handicapped By JOSEPH B. VERRENGIA Rocky Mountain News Staff Writer The Regional Transportation District started offering special rides between Boulder and Denver for handicapped passengers Monday amid criticism from disabled activist that the new service is a form of illegal segregation. “We’re not looking for special, we’re looking for equal,” said Wade Blank, spokesman for the disabled protect group called Adapt. “Basically, we’re being segregated.” RTD contracted with Special Transit Systems Inc. of Boulder to provide the new service. It will operate on weekdays during rush hours between the Boulder Transit Center, 14th and Walnut streets, and down town Denver, outside the Market Street Station. Morning Trips leave Boulder at 6:30 a.m. and arrive in Denver at 7:15 a.m. The bus starts its return trip to Boulder at 8:30 a.m., arriving at 9:10 a.m. Afternoon trips leave Boulder at 4 p.m. and arrive in Denver at 4:40. The return trips leave Denver at 5:30 p.m., arriving in Boulder at 6:20. The rides require reservations at least three business days in advance. Special door-to-door service by STS is available the rest of the day. The fare is $1.75 each way, the same as a regular RTD express bus ride. RTD officials are offering the service as a compromise to handicapped riders who demand that wheelchair lifts be included on new over-the-road buses scheduled for purchase next month. Those buses would be used for express runs to Boulder, Evergreen and Conifer. Without the special service, RTD officials said, disabled people would have no public transit between Denver and Boulder. “Perhaps as an interim problem-solver, it (the special service) is done in good faith,” Blank said. “But I hope it wouldn’t be a permanent alternative. Most people don’t know their plans (for bus riding) three days in advance." - ADAPT (145)
The Handicapped Coloradan, October 1984 [Headline] McDonald’s Statement Called “Unacceptable” The response by McDonald’s to demands by wheelchair protestors that the fast food chain improve the accessibility of its restaurants was described as unacceptable by a spokesperson for the Access Institute. Wade Blank said that Access was contacting McDonald’s again and if the company’s response did not improve his organization might well return to the picket lines. Starting in June, Access picketed McDonald’s restaurants in Denver, Colorado Springs, Cheyenne, Wyo., El Paso, Tex., Syracuse, N.Y., and Kansas City, Mo. Demonstrators were arrested in Colorado Springs and at one of the Denver demonstrations. At an Aug. 17 meeting, McDonald’s representatives warned Access that if the protests continued, the fast food chain was prepared to take demonstrators to court. At that meeting, McDonald’s suggested that it would be willing to remodel restaurants owned by the company, but that it did not have the power to order individually owned franchises to follow suit. Company representatives estimated that the retrofitting operation would affect some 2,200 of the more that 7,700 McDonald’s across the country and would cost between $3 and $5 million. At a second meeting a week later, McDonald’s seemed ready to make further concessions and promised to issue a policy statement in September. Blank said he had expected that statement to satisfy many of Access’s demands. Instead, McDonald’s response took the form of a memo from its vice president for national operations to regional managers and vice presidents, outlining the company’s record on accessibility and listing the standards the company suggested its licensees follow. Blank said the memo shows that McDonald’s is “not really serious about what they’re doing.” In fact, he said, Access did not receive a copy of the memo and had to ask McDonald’s for one. Throughout the discussions, McDonald’s has argued that it would not bow to pressure and that the company’s record on accessibility was a good one. The memo, dated Sept. 12, 1984 and written by Tom Glasgow, reaffirmed that position. Glasgow said that since 1979 McDonald’s has been following accessibility guidelines set by the American National Standards Institute (ANSI) for its company-owned (McOpCo) restaurants as well as its licensed operations. “Currently with in excess of 2000 McDonald’s restaurants accessible to wheelchair users, we are the leaders in this area in the quick service restaurant industry and, indeed most probably, in any segment of the food service industry,” Glasgow wrote. Glasgow listed four minimum accessibility standards that were followed by McOpCo owned restaurants. “Parking Spaces-Special parking located as close to the building as possible (striping according to ANSI). In addition, vertical signage making these spaces even more obvious is being installed. “Ramps/Curb Buts—Convenient as possible to special parking (per ANSI specifications). “Table Access—Although table heights at McDonald’s restaurants meet or exceed ANSI standards we need tables which wheelchair users can easily use. Movable seating is preferred. “Rest Rooms- These will be made accessible as remodeling becomes necessary and affordable. Restaurants not currently planning to remodel should make modifications such as installing grab bars and widening stalls to make these facilities more functional for wheelchair users when possible.” However, Glasgow pointed out that since licenses own three out of every four stores system wide, area managers and vice presidents could only recommend that these standards be followed. Table access has been one of the Access Institute’s major goals in their dealings with McDonald’s. Currently, most if not all McDonald’s restaurants use seating that is physically attached to tables, making it impossible for a person in a wheelchair to use a table without blocking the aisle. The Access Institute had also asked that McDonald’s use people with disabilities in at least 10 percent of its ads. That issue was not addressed in the memo. The memo made no mention of the Access Institute or the pickets. Glasgow concluded by saying, “Accessibility has been something we as a corporation have been committed to for years. Our efforts are not new. Our commitment is not new. We expect this commitment will be continually reinforced through action.” However, so far that commitment seems not to have impressed wheelchair users. The executive board of the Colorado Coalition for Persons with Disabilities recently passed a resolution calling upon members of the 50 or so organizations it represents to boycott McDonald’s until the company makes a stronger commitment to accessibility. McDonald’s size and reputation were why the company was singled out by the Access Institute, according to Blank. He said if McDonald’s agreed to their requests then other national chains would follow suit. - ADAPT (146)

And the series of confrontations that ended with 27 arrests last month seemed to come down to a similar central issue— the right to sit on a bus, to have full access to public transportation. There was one striking difference, however. Unlike Rosa Parks and the black civil rights activist who battered down the Jim Crow barriers in the South, these protesters were in wheelchairs, and their goal was equal access for the physically handicapped. “It's a civil right to be able to ride public transportation," said Julia Haraksin, a wheelchair-bound Los Angeles resident who participated in the demonstrations. “In the ‘60s, the blacks had to ride in the back—and we can't even get on the buses." New, Radical Tactics Organizations representing handicapped persons long have urged Washington to require that new buses and rail systems built with funds from the Department of Transportation's Urban Mass Transportation Administration be equipped to accommodate handicapped riders. But Haraksin and other handicapped individuals like her now are beginning to press the old arguments with new, more radical tactics. Frustrated by years of negotiating, lobbying in Washington, going through the courts and staging non-confrontational protests, some members of the handicapped community now are resorting more actively to confrontations and civil disobedience. Thus, early in October, 100 members of a newly formed coalition called American Disabled for Accessible Public Transit confronted a national meeting of city transportation heads here, using the kind of civil disobedience tactics used 30 years earlier by Dr. Martin Luther King Jr. Protesters were arrested when they blocked entrances and buses of those attending the American Public Transit Assn. convention. The strategy was to physically be a barrier because handicapped people have to face barriers all their lives," Wade Blank, a founder of Denver-based ADAPT said. Calling the protests here " Selma," leaders of ADAPT claimed victory and promised that their struggle has only begun. They already are focusing their efforts on what they hope will be a larger demonstration at the next meeting of the American Public Transportation Assn. a year from now in Los Angeles. But they and their cause may be in for a tough battle. Their opposition comes from the Reagan Administration, from many city governments and even from within the handicapped community. And as public attention focuses on the underlying budget choices involved, the opposition may swell with the addition of taxpayers concerned about the possible costs of a national full-access program. ADAPT argues that a legal right to full access for the handicapped already exists. Federal law states that Urban Mass Transportation Administration funds — which account for about 80% of the costs of new and replacement equipment in most municipal transportation systems—cannot be spent on programs that discriminate against, or exclude, the handicapped. The law does not make clear, however, whether handicapped persons must be provided with access to regular bus lines or whether they can instead be provided with alternative transportation systems. Nor does it indicate who should make that decision. Cities Make Decisions Current Transportation Department policy, which is strongly supported by the American Public Transportation Assn., allows each city to make its own decision on what type of transportation it will provide for the handicapped. This is in sharp contrast with Carter Administration policy, which in 1979 interpreted federal regulation to mean full access. Members of ADAPT, opposing the separate-but-equal philosophy of paratransit argue that it does not meet the needs of the handicapped and that it is inherently discriminatory. "It segregates the disabled people from the able-bodied community," Mike Auberger, an organizer for ADAPT, said. Because paratrasit requires advanced scheduling [unreadable] a ride is needed, he said, “you have to schedule your life according to the system. No one else has to do that. That shows the inequality right there." He and other members of ADAPT contend that because of long waiting lists for paratransit, some cities refuse to offer the service to new users - thus cutting off thousands of handicapped persons from any public transportation. Transit authorities, on the other hand, argue that full access can be too expensive, given the low percentage of handicapped riders in many cities. Lift-fitted buses cost an estimated $8,000 to $10,000 more than regular buses. Furthermore, lift systems are often unreliable and time-consuming to operate and maintain, transit administrators say. In Denver, for example, the transportation district has spent $63 million to purchase or retrofit buses with lifts. 80% of which was paid for by the federal government, according to spokesman Gene Towne. Since it started mainline access in 1982, the district has spent close to $1 million in maintenance of the lifts and expects to spend an additional $900,000 this year. Yet of the district's total annual ridership of 38 million, only 12,000 use the lifts, according to Towne. ADAPT counters that the issue is not cost but civil liberties. “In America we have a way of hiding, our prejudices with pragmatism," said Blank, a Presbyterian minister and veteran of the civil rights and anti-war movements of the 1960s who now supports handicapped activists. Variety of Approaches Across the country, cities are using a variety of approaches to the problems of providing mass transit for the handicapped. In Los Angeles, mainline access is required by state law. Although 1,850 of the Southern California Rapid Transit District‘s 2,400 buses are fitted with wheelchair lifts some local advocates charge that the RTD gives only "lip service" to access, complaining of broken lifts, drivers who do not know how to use the equipment or refuse to do so and an overall lack of commitment to providing access. The system provides only about 1,400 rides a month according to the RTD. Handicapped activists charge that the low ridership is attributable to the system's poor management. There were and are people in the operation department (of the RTD) back there who were and are opposed to the idea of access from day one," Dennis Cannon, a Washington-based expert who helped to plan the RTD's access program in the 1970s said. But in the last six months, the RTD has made "a major effort" to overcome the problem, according to RTD General Manager John A. Dyer. The system boosted its fiscal year 1985 budget for handicapped service by $3 million, to $4.9 million, to provide for a program to educate drivers and upgrade the quality of equipment and service. In Oakland, half the city's 800 buses are lift-equipped and all of the Alameda — Contra Costa Transit District's new buses will be lift-equipped. Seattle’s Services In Seattle, 570 of 1,100 buses are accessible to the handicapped, providing about 5,900 rides a month. The Municipality of Metropolitan Seattle also contracts with private groups to supply paratransit bus and half-fare cab service, providing a total of 8,400 rides a month in Denver. 432 of the city's 744 buses are lift- or ramp-equipped, providing more than 1,000 rides per month. The city also uses 13 vans and small buses in a paratransit system that provides 3,200 rides a month. In New York City, where an estimated 35% of all the transit passengers in the country use Metropolitan Transportation Authority vehicles each day. half of the city's 4,333 buses are fitted with lifts. The city has no figures on how many handicapped riders use the system, but one official calls the number minuscule. A new state law calls for $40 million over the next eight years to retrofit “in the neighborhood of 30" subway stops for handicapped use, according to a transit authority official. In addition the law will increase the percentage of lift-equipped buses to 65% of the fleet, as well as provide a paratransit system in the city by 1988. Minneapolis-St. Paul uses 45 paratransit buses and contracts with private cab companies to carry handicapped persons in all, the city provides 40.000 trips a month. None of Chicago's 2.400 regular buses are fitted with lifts. Instead the city provides 42 paratransit buses, which offer 12,000 rides a month. Additionally, 14 of the city's subway stops have been retrofitted for handicapped access and 300 of Chicago's 1,100 subway cars are accessible. If there is a diversity of approaches to the problem, there is also a diversity of views on the militant new tactics used by ADAPT and its supporters. The views of the handicapped people are all over the lot on what type of transport they'd like," Bob Batchelder, counsel for the APTA, said. But transit specialist Cannon, himself a wheelchair user, counters: “I'm talking to disabled people who wouldn't do what ADAPT does ... but who support what they are doing and think it needs being done." Whether ADAPT's controversial style will work remains an open question. While no negotiations are scheduled, ADAPT leaders vow to continue to harass association meetings. But in Los Angeles, the RTD's Dyer indicated that he hopes demonstrations will be replaced at next year's convention with “serious dialogue and discussion of the issues." "It’s a new thing for the disabled to see themselves with power," ADAPT's Auberger said, "but it's also a new experience for the powers that be."
