SEPTEMBER 29, 1989 The Atlanta Journal and Constitution [Headline] ADAPT: ‘Militant Group' Takes on the Mainstream Disabled Protesters Tired of ‘Lousy Way to Live’ By Pat Burson, staff writer Sallie Bach said she used to look at people with disabilities “like they were nothing.“ “When you're able to walk, you see people like this and you stand up and laugh at them. l know. l did it," said the 50-year-old Chicago woman, a waitress for 21 years until she became physically disabled after jumping from a third-floor window to escape an apartment fire. “l know what it feels like now," she said. “Now I understand.“ Ms. Bach joined more than 100 other disabled and non-disabled people who are members of American Disabled for Accessible Transportation, or ADAPT, as they blockaded a federal office tower and the Greyhound bus station in Atlanta this week to call attention to their demands that wheelchair lifts be installed on all new buses purchased with federal dollars. ADAPT, based in Denver, promotes non discriminatory, mainline public transit system that are accessible to people who use wheelchairs. This week's protests were planned to coincide with the American Public Transit Association‘s (APTA) annual convention ADAPT has held similar protests in Denver, San Francisco, Cincinnati and Montreal, trying to persuade APTA members to support total accessibility of public transit systems. The transit group and ADAPT differ on the federal government's role in mandating access to public transportation. APTA agrees that transit systems should make their buses and trains accessible, but the group believes local government not Washington, should decide. Whether or not members of the disabled community agree with ADAPT's more radical tactics, they applaud its members unceasing demand for access. “They are a militant group, and l think their militancy had been imposed upon them," said Jay W. Brill, a longtime activist for disability rights and manager of the Initiative on Technology, Disability and Post-Secondary Education at the American Council on Education in Washington. "There's a point where the community [of disabled people] becomes so frustrated with transit authorities, and a door opens wide for ADAPT," said Mr.Brill. ADAPT founder Wade E. Blank, a 48-year-old minister with shoulder-length blond hair, said he got the idea to start the group when he worked as a nursing home orderly. "l said to myself, 'What a lousy way to live your life," he said Wednesday, standing behind a police barricade as 25 fellow protesters at the Greyhound station were loaded onto a lift-equipped bus by police. Co-founder Michael Auberger describes ADAPT as “a fringe group‘ that has become mainstream." “It attracts the person who has been within the system and tired of it and the person who is locked out of the system,... somebody who's really disabled, on a fixed income and needs to use public transportation." The organization, formed in 1983, has about 1,800 members and 33 local chapters. As protesters tried to close down the Richard B. Russell Federal Building this week, linking arms and wheelchairs at the tower's main doors and elevators, some compared the demonstration to those during the civil rights movement of a quarter-century ago. "The civil rights movement started because of busing" said Jerry Eubanks, a 31-year-old-dispatcher for the Chicago Sanitation Department, whose legs were amputated below the knee after a train accident. “We just want the right to ride the bus."

Hill, Staff Writer Twenty disabled protesters pleaded no contest Thursday in Atlanta Municipal Court to disorderly conduct charges growing out of a demonstration at the Greyhound bus station that blocked buses for almost five hours. Each of the protesters received a $75 fine that was suspended by Chief Judge Andrew Mickle in a plea bargain agreement. State criminal trespass charges filed against six other protesters were dismissed. A hearing on two aggravated assault charges against another demonstrator was rescheduled for early January, Judge Mickle said. The court session marked the end of three days of demonstrations by more than 100 ADAPT activists to protest the lack of wheelchair lifts on public buses and private intercity carriers. Although the group did not succeed in its initial demands to obtain an executive order from U.S. Transportation Secretary Samuel K. Skinner requiring all new buses purchased with federal dollars to have lifts, ADAPT leaders were claiming a victory. The demonstrators obtained promises from transit and federal transportation officials to meet with them. Also, they are counting on federal transit officials to discourage transit operators from making hurried purchases of buses without lifts before federal law mandates the devices.

Tues., September 26, 1989 [Headline] Disabled Try to Block Access To Elevators [Subheading] Protesters Continue Russell Building Sit-In By Alma E. Hill and Pat Burson, Staff Writers [This is the full text of the story that appears on ADAPT 496, 509 and 488.] Protesters in wheelchairs moved to block elevators in the Richard B. Russell Federal Building today in their second straight day inside the building, as federal officials increased security. Ed Driver, chief of law enforcement for the General Services Administration, said six security guards were brought in “so that we can maintain access to and from the building." “We're not going to do anything, we just want to be able to maintain an element of safety in the building," Mr. Driver said. At 11:50 a.m., leaders of American Disabled for Accessible Public Transportation (ADAPT) gave the signal and protesters began to chant and roll their wheelchairs in front of the doors on the plaza level of the federal building to restrict access to and from the building, as they had done Monday. Moments later, in an apparent shift in tactics, the group moved toward elevators to cut off access to upper floors in the high-rise. Protesters said they will continue to demonstrate until President George Bush or Transportation Secretary Samuel Skinner complies with their demands to issue a federal mandate requiring new buses purchased with federal dollars to be equipped with wheelchair lifts. Judges who work in the federal building avoided problems getting out of the building by leaving before the noon takeover. And the doors to the Peachtree Federal Employees Credit Union, located in the southwest corner of the building, closed as soon as protesters began to shout. Visitors are being directed out of the basement and second floor exits. The Rev. The protesters began their demonstration Monday to coincide with an appearance by Mr. Skinner at the American Public Transit Association (APTA) convention at a downtown hotel. After occupying the plaza floor of the federal building for eight hours Monday, more than 100 disabled activists were evicted at the close of the business day, only to be allowed back inside after President Bush personally intervened. “We're here until the order gets signed." Michael W. Auberger, of Denver, one of the co-founders and organizers of ADAPT, said Monday. Mr. Auberger and other demonstrators from throughout the country lined their wheelchairs two and three deep near the doorways to the federal building. located at the corner of Spring Street and Martin Luther King Jr. Drive, trying to stop anyone from leaving or entering. Mr. Auberger, who has been disabled since he suffered a spinal cord injury 17 years ago, and others blocked revolving doors by attaching chains and iron bicycle locks around their necks and locking them to door handles, a tactic used to prevent security from simply lifting protesters out of their wheelchairs to clear the doorways. At one point Monday afternoon Mr. Auberger, 35, said, “They'll have to carry everybody out or arrest them." At 6 p.m. Atlanta police and officers from the General Services Administration, who provide security for the building, ordered the protesters to leave and began carrying them outside. The guards used large bolt cutters to sever the chains holding some demonstrators to the doors. At about 8 p.m., as guards were removing the last of the demonstrators, Gary C. Cason, regional administrator of the General Services Administration, told police and maintenance workers to allow the protesters back into the building. “The decision is to let them stay in the building because of the president's deep commitment to the handicapped and their right to protest." Mr. Cason said. Mr. Cason said Mr. Bush also said he was concerned about the protesters sitting outside in the chilly overnight temperatures and rainy mist. Maintenance crews appeared a half-hour later with blankets. Mr. Cason said the protesters would be restricted to the lobby floor and would have access to the restrooms. Protest organizers credit White House counsel C. Boyden Gray for Mr. Bush's action. Mr. Auberger said they contacted Mr. Gray, who took their case to Mr. Bush. The president then called the head of the GSA, Richard G. Austin in Washington, telling him to allow the demonstrators back inside. The protest forced most visitors to the building Monday to use a basement entrance adjacent to an underground parking lot. Mr. Auberger said the group planned to stay in the building overnight and would block the entrances again at noon if the Transportation Department does not order changes in transit-access rules. “At noon the administration has to decide whether or not they are going to arrest us, or we’re closing the building down again,” he said shortly before 11 p.m., as the protesters ate Chinese food they had ordered and made themselves comfortable in the hallway on the Spring Street side of the building. The demonstration was the second in as many days held by ADAPT, a nationwide organization. The event was held in Atlanta to coincide with the annual conference of the American Public Transit Association (APTA), meeting this week in Atlanta, and to attract the attention of U.S. Transportation Secretary Samuel K. Skinner, who spoke to APTA Monday morning. APTA opposes legislation pending in Congress — that ADAPT supports — called the Americans With Disabilities Act. The proposal would remove barriers in public transportation by requiring public transit authorities to have wheelchair lifts on any new buses purchased 30 days after the measure was enacted. APTA officials say they oppose that portion of the measure because it would cut into limited federal funds. While Mr. Skinner has said he supports the bill, ADAPT wants him to issue an executive order so the stipulation can take effect immediately — prior to congressional action. Protesters demanded to talk with Mr. Skinner while he was in Atlanta, but Mr. Skinner departed for St. Croix without meeting with them. Robert Marx, a spokesman for Mr. Skinner, said the secretary does not have the authority to issue such an order, only the president. Spokesmen for ADAPT believe Mr. Skinner is not championing their cause because of a lawsuit the group won against the Chicago Transit Authority (CTA) two years ago, when Mr. Skinner was chairman of the city's Regional Transportation Authority. Those arrested were charged with two misdemeanors, unlawful entry and demonstrating within the Capitol, police said. Both carry maximum sentences of six months in jail. In addition, those convicted could be fined $100 for unlawful entry and $500 for demonstrating in the Capitol. The arrests marked the second day of dramatic lobbying by people with disabilities, who are seeking passage of the Americans with Disabilities Act. On Monday, some 60 people crawled out of their wheelchairs and up the West steps of the Capitol. The bill would outlaw discrimination based on physical or mental disability in employment, access to buildings, use of the telephone system, use of public and private transportation and in other uses. It would require ramps or other means of access in all new buildings used by the general public, including private businesses and offices. The Senate passed the bill last year but the measure has bogged down in the House despite widespread predictions of ultimate approval. While the demonstration was in progress. the House Energy and Commerce Committee approved the bill 40-3 at a meeting in another building. The measure still must go to two other committees before reaching the full House. Before the arrests, Foley assured demonstrators that he and other congressional leaders were pushing the bill. His words were met with skepticism. The Energy and Commerce Committee, meantime, approved the Americans With Disabilities Act by a 40-3 vote after amending it to soften the impact on Amtrak and make other minor changes. DISABILITY RIGHTS ADVOCATES TURN UP THE HEAT IN CAPITOL In more ways than one, the heat was turned up in Washington, D.C. during the week of March 11 to March 17, 1990. Weather records were shattered as the mercury climbed to 89 degrees on Monday and remained hot all week; the cherry blossoms at the Tidal Basin bloomed three weeks early. There was another heat wave going on as people with disabilities from all over the country converged on the Capitol to push for the Americans with Disabilities Act, which passed the Senate last September and is now stalled in the House. On Monday, March l2, we gathered in front of the White House at noon. Over 1000 strong, most in wheelchairs but including people who are deaf and blind, we marched down Pennsylvania Avenue, the 17 blocks to the U.S. Capitol. We carried signs and chanted “ADA Now!" At the Capitol, Justin Dart, chairman of the President's Committee, said that partial equality is not equality: “We want an end to discrimination against the disabled, the nation's most impoverished, isolated and segregated minority." King Jordan, president of Gallaudet University, warned “If we don’t get what we want, we will be back to stay." Mike Auberger, from ADAPT, closed with a stirring speech. “We are Americans," he said, “and we want the same rights as everyone else." After the speeches, many abandoned their wheelchairs and climbed the 83 steps on the west front of the Capitol, as a symbolic gesture dramatizing the barriers that the disabled still face. On Tuesday, many assembled in the huge rotunda inside the U.S. Capitol and heard speeches by Speaker Thomas Foley, Congressman Robert Michel and Congressman Stenny Hoyer of Maryland, who is coordinating the House legislative effort on ADA. Hearing that no promises could be given as to the date of a House vote, many started chanting “ADA Now!" Many were arrested for illegal entry, carried in police vans to a police facility and then to court for paper work. Many did not get back to the hotel until midnight. It was a matter of individual conscience whether anyone was arrested; many chose not to, believing that the legislative process has been working well so far. On Wednesday. about 60 were arrested at the Rayburn Building in and near the office of Congressman Bud Shuster of Pennsylvania, who had supported some weakening amendments to ADA. On Thursday, a small group (their numbers reduced because so many were in court) assembled at housing and urban development and asked to see secretary Jack Kemp; he was out of town but Undersecretary Alfred Dellabovi came down. There was a productive talk concerning the Fair Housing Amendment Act of 1988. Some weakening amendments to the Housing Act, relating to access standards, had been proposed; the disability groups strongly opposed. On Friday, some members of ADAPT protested at the Greyhound terminal. Some of the strongest opposition to ADA has come from Greyhound and other private bus companies, who fear that the cost of wheelchair lifts will be excessive. But the disability groups claim as much a right to be on a bus as anyone else. After a glorious week, the participants began the long journey home by train, bus, airplane or dust-covered van. Though many other disability groups were involved, much credit goes to Wade Blank, Mike Auberger, Bob Kafka, and Mark Johnson, all of ADAPT. It‘s too early to tell whether our goals have been reached, but there was a feeling of solidarity. and of a successful crusade on behalf of equal rights for disabled people in employment, in transportation, in housing, in places of public accommodation, in every aspect of American life. Afflicted with cerebral palsy, Jennifer has trouble moving around. But Monday afternoon in Washington, she crawled hand-over-hand up the 83 steps leading to the U.S. Capitol, eventually reaching the top. No members of Congress threw obstacles in her path. None stood in her way. But in the eyes of Jennifer and about 60 others who abandoned their wheelchairs to make the Capitol climb, they might just as well have. By failing to protect the disabled from discrimination, they say, Congress is allowing others to throw obstacles in their path every day. They want Congress to stop yakking and start voting on the Americans with Disabilities Act, sweeping legislation that would do for the disabled what the civil rights legislation of the 1960s did for minorities and women. The legislation passed the Senate last year. It has the support of the president. But the House of Representatives, lobbied hard by business interests that fear the bill's costs, just can't seem to get its part of the job done. Justice demands that the stalling end. Today, people in wheelchairs lose job opportunities because they can’t get to work on public transportation. The deaf are often shut off from society because telephones aren't properly equipped. People with mental disabilities are denied jobs by employers who wrongly assume they can't do them. Too often, the only response is: What do they expect? Society can't make them well again. The disabilities act has a better, more sensitive response: * lt bans discrimination against both the mentally and physically disabled. * It requires employers to make “reasonable accommodations" for the handicapped. * It ensures access to bus and rail systems. * It mandates full telephone access for the deaf. * It demands that public accommodations, ranging from hotels to coffee shops to bowling alleys, try to provide equal access for the disabled. Those goals cannot be achieved easily or cheaply. As you can read across this page, they will mean new costs and inconveniences for businesses. New equipment may be needed. Structural alterations may be required. Plans for new building may be altered. Those concerns deserve consideration. But they are not adequate reasons to delay any longer. The legislation specifies that employers not be forced to endure undue hardship. It says the only changes that are required are those that are readily achievable. It affords time to make changes — as long as 30 years in some cases. Every day that Congress delays is another day that obstacles can be thrown in Jennifer Keelan's path. And she, just like the rest of us, deserves every opportunity to reach the top. Caption reads: ALL THEY ASK is ALL ABOARD A contingent of eight protesters, some in wheelchairs, picketed the United Mass Transit Administration office, 841 Chestnut St., yesterday in support of a recent 3rd U.S. Circuit Court or Appeals ruling that all buses bought with federal funds must be accessible to disabled riders and that all who can't use buses must be afforded other mass transit. The protesters said they represented a variety of advocacy groups staging protests nationwide on behalf of 5 million disabled and elderly Americans.

Scores of demonstrators have been arrested hundreds of times as they blocked the entrances to APTA's various hotel headquarters in such cities, as Denver, Detroit, Montreal, Los Angeles, San Francisco, Washington, D.C., Cincinnati, San Antonio, and Reno. Only once, in Denver in 1983, was ADAPT allowed to make its plea for accessible public transit before an APTA meeting, and then only after the city's mayor, Federico Pena, intervened. APTA insisted throughout the demonstrations that they weren't opposed to lifts per se, only to making the lifts mandatory on all public transit systems. APTA argued that it was a matter best decided by local transit providers.

[Headline] New Law for Americans with Disabilities Can a deaf person use a public telephone? Can a person in a wheelchair work on the top floor of a tall building? Can a mentally retarded person work and earn money? The answer to all of these questions is yes—if they receive special help. A new law in the U.S. may provide that special help for millions of disabled Americans. The law is called the Americans with Disabilities Act. T I P S & TRENDS The President's Committee on Employment of People With Disabilities |Vol. 1 No.4 April 1989 [Headline] Administration Granted Rehearing of Transit Access Decision On April 10, 1989, the U.S. Department of Transportation (DOT) requested a rehearing of a court decision that would make many transit systems more accessible to people who use wheelchairs. DOT requested all eleven judges of the U.S Court of Appeals for the Third Circuit to rehear the February 13 ADAPT (American Disabled for Accessible Public Transit ) vs. DOT decision (see March Tips & Trends) which ordered DOT to cease subsidizing buses purchased by transit systems unless they are equipped with wheelchair lifts. On April 19, 1989, the Third Circuit Court of Appeals vacated the February 13 decision and granted a rehearing to DOT. The unusual decision to grant a rehearing may indicate that the February 13 decision will be reversed. [Subheading] Decision Angers Protesters Also on April 10, disability advocates and members of ADAPT were protesting for accessible public transportation during a regional meeting of the American Public Transit Association (APTA) at the Nugget Casino in Reno, NV. Protesters were disappointed by the announcement that the Federal government had asked for a rehearing of the ADAPT vs. DOT decision. Three people with severe disabilities were injured, 49 protesters were arrested and many were jailed. Untrained ranch hands from the surrounding area assisted the under-staffed Reno police department with the arrests, and threatened to take seeing eye dogs from blind protesters if they did not disperse. Wheelchair users were dragged from their seats by the local police and deputies, who broke a leg of one severely disabled protester. Wade Blank, spokesperson for ADAPT, commented from Reno: "This means the protests must continue, all the way to the White House if need be.” Article is accompanied by a picture of a handwritten letter from a very young child.
