Rocky Mountain News 8/5/83 RTD proposes bus changes for disabled By Tony Pugh, Rocky Mountain News Staff Writer The Regional Transportation District, in an open forum with handicapped citizens Thursday, introduced changes designed to make buses more accessible for disabled riders. Mike Smith, director of transit operations, outlined the proposed improvements, which include a new material to improve traction on bus wheelchair lifts and a metal “kickplate,” designed to minimize wear on lifts from hitting curbs. A new rotary control panel, said to be easier for drivers to operate, and a new lift wiring system also were introduced. Although many people in the attendance voiced displeasure with bus driver insensitivity and mechanical failure of the lifts, others expressed gratitude to RTD for its efforts in accommodating handicapped riders. Bill West, chairman of RTD’s handicapped advisory council, said he is reasonably pleased with RTD officials’ commitment to the disabled community. “I think they’re committed to making the best of what they’ve been mandated to do, but I believe they have a tendency to focus more on the lifts rather than better driver training,” West said. Larry Ruiz, 29, typified the problems encountered by handicapped riders. Earlier this week, he was passed up by four buses as he waited at a stop outside Colorado General Hospital, said Ruiz, who is confined to a wheelchair. The first bus had no lift, the next two buses had lifts, but the drivers did not know how to operate them. After waiting more than two hours, the driver of the fourth bus called a HandyRide disabled vehicle which took Ruiz home. But that lift malfunctioned, Ruiz said. He had to be removed manually. This gathering was a forerunner to a meeting in late October between the American Public Transit Association and the newly formed American Disabled for Accessible Public Transit. A spokesman for the access group, Wade Blank, said it will made three demands to the association: * “Wheelchair accessibility by all public transit systems in the nation.” * “To serve notice to all bus manufacturers that only wheelchair accessible buses will be purchased by its members.” * “For the federal government to stand behind this moral position and develop laws and regulations supporting total access for the wheelchair bound public on public transit.”

And the series of confrontations that ended with 27 arrests last month seemed to come down to a similar central issue— the right to sit on a bus, to have full access to public transportation. There was one striking difference, however. Unlike Rosa Parks and the black civil rights activist who battered down the Jim Crow barriers in the South, these protesters were in wheelchairs, and their goal was equal access for the physically handicapped. “It's a civil right to be able to ride public transportation," said Julia Haraksin, a wheelchair-bound Los Angeles resident who participated in the demonstrations. “In the ‘60s, the blacks had to ride in the back—and we can't even get on the buses." New, Radical Tactics Organizations representing handicapped persons long have urged Washington to require that new buses and rail systems built with funds from the Department of Transportation's Urban Mass Transportation Administration be equipped to accommodate handicapped riders. But Haraksin and other handicapped individuals like her now are beginning to press the old arguments with new, more radical tactics. Frustrated by years of negotiating, lobbying in Washington, going through the courts and staging non-confrontational protests, some members of the handicapped community now are resorting more actively to confrontations and civil disobedience. Thus, early in October, 100 members of a newly formed coalition called American Disabled for Accessible Public Transit confronted a national meeting of city transportation heads here, using the kind of civil disobedience tactics used 30 years earlier by Dr. Martin Luther King Jr. Protesters were arrested when they blocked entrances and buses of those attending the American Public Transit Assn. convention. The strategy was to physically be a barrier because handicapped people have to face barriers all their lives," Wade Blank, a founder of Denver-based ADAPT said. Calling the protests here " Selma," leaders of ADAPT claimed victory and promised that their struggle has only begun. They already are focusing their efforts on what they hope will be a larger demonstration at the next meeting of the American Public Transportation Assn. a year from now in Los Angeles. But they and their cause may be in for a tough battle. Their opposition comes from the Reagan Administration, from many city governments and even from within the handicapped community. And as public attention focuses on the underlying budget choices involved, the opposition may swell with the addition of taxpayers concerned about the possible costs of a national full-access program. ADAPT argues that a legal right to full access for the handicapped already exists. Federal law states that Urban Mass Transportation Administration funds — which account for about 80% of the costs of new and replacement equipment in most municipal transportation systems—cannot be spent on programs that discriminate against, or exclude, the handicapped. The law does not make clear, however, whether handicapped persons must be provided with access to regular bus lines or whether they can instead be provided with alternative transportation systems. Nor does it indicate who should make that decision. Cities Make Decisions Current Transportation Department policy, which is strongly supported by the American Public Transportation Assn., allows each city to make its own decision on what type of transportation it will provide for the handicapped. This is in sharp contrast with Carter Administration policy, which in 1979 interpreted federal regulation to mean full access. Members of ADAPT, opposing the separate-but-equal philosophy of paratransit argue that it does not meet the needs of the handicapped and that it is inherently discriminatory. "It segregates the disabled people from the able-bodied community," Mike Auberger, an organizer for ADAPT, said. Because paratrasit requires advanced scheduling [unreadable] a ride is needed, he said, “you have to schedule your life according to the system. No one else has to do that. That shows the inequality right there." He and other members of ADAPT contend that because of long waiting lists for paratransit, some cities refuse to offer the service to new users - thus cutting off thousands of handicapped persons from any public transportation. Transit authorities, on the other hand, argue that full access can be too expensive, given the low percentage of handicapped riders in many cities. Lift-fitted buses cost an estimated $8,000 to $10,000 more than regular buses. Furthermore, lift systems are often unreliable and time-consuming to operate and maintain, transit administrators say. In Denver, for example, the transportation district has spent $63 million to purchase or retrofit buses with lifts. 80% of which was paid for by the federal government, according to spokesman Gene Towne. Since it started mainline access in 1982, the district has spent close to $1 million in maintenance of the lifts and expects to spend an additional $900,000 this year. Yet of the district's total annual ridership of 38 million, only 12,000 use the lifts, according to Towne. ADAPT counters that the issue is not cost but civil liberties. “In America we have a way of hiding, our prejudices with pragmatism," said Blank, a Presbyterian minister and veteran of the civil rights and anti-war movements of the 1960s who now supports handicapped activists. Variety of Approaches Across the country, cities are using a variety of approaches to the problems of providing mass transit for the handicapped. In Los Angeles, mainline access is required by state law. Although 1,850 of the Southern California Rapid Transit District‘s 2,400 buses are fitted with wheelchair lifts some local advocates charge that the RTD gives only "lip service" to access, complaining of broken lifts, drivers who do not know how to use the equipment or refuse to do so and an overall lack of commitment to providing access. The system provides only about 1,400 rides a month according to the RTD. Handicapped activists charge that the low ridership is attributable to the system's poor management. There were and are people in the operation department (of the RTD) back there who were and are opposed to the idea of access from day one," Dennis Cannon, a Washington-based expert who helped to plan the RTD's access program in the 1970s said. But in the last six months, the RTD has made "a major effort" to overcome the problem, according to RTD General Manager John A. Dyer. The system boosted its fiscal year 1985 budget for handicapped service by $3 million, to $4.9 million, to provide for a program to educate drivers and upgrade the quality of equipment and service. In Oakland, half the city's 800 buses are lift-equipped and all of the Alameda — Contra Costa Transit District's new buses will be lift-equipped. Seattle’s Services In Seattle, 570 of 1,100 buses are accessible to the handicapped, providing about 5,900 rides a month. The Municipality of Metropolitan Seattle also contracts with private groups to supply paratransit bus and half-fare cab service, providing a total of 8,400 rides a month in Denver. 432 of the city's 744 buses are lift- or ramp-equipped, providing more than 1,000 rides per month. The city also uses 13 vans and small buses in a paratransit system that provides 3,200 rides a month. In New York City, where an estimated 35% of all the transit passengers in the country use Metropolitan Transportation Authority vehicles each day. half of the city's 4,333 buses are fitted with lifts. The city has no figures on how many handicapped riders use the system, but one official calls the number minuscule. A new state law calls for $40 million over the next eight years to retrofit “in the neighborhood of 30" subway stops for handicapped use, according to a transit authority official. In addition the law will increase the percentage of lift-equipped buses to 65% of the fleet, as well as provide a paratransit system in the city by 1988. Minneapolis-St. Paul uses 45 paratransit buses and contracts with private cab companies to carry handicapped persons in all, the city provides 40.000 trips a month. None of Chicago's 2.400 regular buses are fitted with lifts. Instead the city provides 42 paratransit buses, which offer 12,000 rides a month. Additionally, 14 of the city's subway stops have been retrofitted for handicapped access and 300 of Chicago's 1,100 subway cars are accessible. If there is a diversity of approaches to the problem, there is also a diversity of views on the militant new tactics used by ADAPT and its supporters. The views of the handicapped people are all over the lot on what type of transport they'd like," Bob Batchelder, counsel for the APTA, said. But transit specialist Cannon, himself a wheelchair user, counters: “I'm talking to disabled people who wouldn't do what ADAPT does ... but who support what they are doing and think it needs being done." Whether ADAPT's controversial style will work remains an open question. While no negotiations are scheduled, ADAPT leaders vow to continue to harass association meetings. But in Los Angeles, the RTD's Dyer indicated that he hopes demonstrations will be replaced at next year's convention with “serious dialogue and discussion of the issues." "It’s a new thing for the disabled to see themselves with power," ADAPT's Auberger said, "but it's also a new experience for the powers that be."

VERRENGIA Rocky Mountain News Staff Writer WASHINGTON — Fourteen wailing handicapped protesters, including some from Denver, were arrested here Monday when they used their wheelchairs, crutches and limp bodies to briefly blockade a national meeting of transit executives. Among those arrested were Mike Auberger, Bob Conrad, Mark Ball and Glen Damen, all of Denver. Richard Male of Denver, an able-bodied demonstrator, also was arrested, as were nine other protesters from New York, Texas, Illinois and Connecticut. The 14 were among more than 35 people who converged on the annual meeting of the American Public Transit Association at the Washington Convention Center. They were fined $50 apiece for blocking a public building. ADAPT, a Denver-based militant handicapped rights group, raised an estimated $30,000 this year to send the protesters to Washington and to train disabled groups nationwide in political demonstration and lobbying techniques. Two of the protesters who were arrested and fined were treated at a local hospital for minor injuries and released. "The police got pretty physical,“ said ADAPT spokesman Wade Blank of Denver. "We had been causing civil disobedience all week. We expected it (the arrests) to happen. It was just a matter of when." Monday's arrests capped a year of growing tension between handicapped activists and transit officials over the issue of accessibility to the handicapped. “This is not something that we are especially proud of,"said ADAPT member Mark Johnson, as he pounded on the plexiglass door of the convention center with a wooden crutch. "We are here because there has been a resistance to us," said Johnson, who ran unsuccessfully for the RTD Board of Directors in 1980. Johnson said ADAPT is demanding that the transit convention vote to make all public transit systems accessible to the handicapped, that those systems only purchase buses equipped with wheelchair lifts, and that the Federal Government reinstate a regulation mandating accessibility. Convention officials said the demonstrators delayed their program for a few minutes, but caused no damage. Last year, RTD hosted the annual transit convention. Although handicapped activists picketed the meeting, their protests were less forceful. In addition, the protesters last year were allowed to address the convention, a privilege refused them this year. "They requested a slot, but we already had everything filled," convention spokesman Albert Engelken said. "There have been some problems. They (protesters) have been pretty aggressive." The demonstrators suddenly appeared at 10 a.m, just as hundreds of transit executives arrived at the convention center on a convoy of shuttle buses from their hotels. Washington police tried to block the advancing wheelchairs. However, they quickly became entangled with the front line of handicapped men and women and were outflanked by the rest of the demonstrators. Chanting "we will ride. it's our right," the protesters wedged their wheelchairs between the doors of the convention center. Many of them threw themselves out of their chairs and sprawled on the sidewalk to block the doors. Monday's demonstration was the third in a series of protests organized by ADAPT. On Thursday, a dozen protesters blocked seven Washington Metro buses in front of the White House during the evening rush hour. On Sunday, another contingent blocked a chartered bus carrying the spouses of 50 transit executives who were touring the nation's capital. After being trapped for an hour, the spouses finally crawled over the crippled protesters to get to their hotel. The protest overshadowed the speeches to the packed convention by U.S. Secretary of Transportation Elizabeth Dole and New York City Mayor Ed Koch. Dole abandoned much of her highly partisan prepared speech, choosing instead to repeat the Reagan administration's compromise offer for accessible public transit. "Transit authorities receiving federal funds would be required to make at least half of their peak hour bus fleet accessible, provide para-transit for special services or offer some combination of these options," Dole said. Both sides are cool to the proposal. Transit executives complain it will cost too much considering that only 5 percent of the country's transit passengers are disabled. Many disabled groups, meanwhile, reject Dole's offer because they say it endorses separate but equal service.

[Headline] Disabled Advocates Are Rolling on Washington D.C. For the second year in a row wheelchair pickets will surround the national convention of the American Public Transit Association (APTA). Some 150 to 200 wheelchair demonstrators are expected to join the picket lines, although that number could increase dramatically by the time the four day long convention opens Sept. 30 in Washington, D.C., according to a spokesperson for the American Disabled for Accessible Public Transportation (ADAPT). But, unlike the convention held in Denver last year, ADAPT will not be allowed to argue the case for accessibility on the convention floor. “Gilstrap (APTA executive vice president Jack Gilstrap) told us there was no way we were going to speak this year,” Wade Blank said. Nor does Blank expect APTA to vote on a resolution introduced at the 1983 convention calling upon APTA members to purchase only lift-equipped buses. When the Carter administration mandated accessibility in the late 1970s, it was APTA that successfully fought those regulations in court, arguing that it was a judgment best left to the discretion of the local transit provider. Some cities, like Seattle and San Jose, California, and-to a lesser extent-Denver, chose to make their systems accessible, but the vast majority refused, claiming the lifts were impractical and too expensive. However, accessibility advocates say that the technology is available to design both economical and reliable lifts, but that bus manufacturers will not use it as long as there is little demand for lifts from transit providers. APTA argues that in many, if not most cases paratransit systems can offer better and more economical services to disabled riders. ADAPT maintains that isn't so, arguing that cities such as Seattle are experiencing a steady drop in the per ride cost for lift-assisted trips while paratransit costs are constant, regardless of the number of trips. At the Denver convention, APTA's position was championed by Colorado Governor Richard Lamm, who told the delegates that the country couldn't afford to equip all its buses with lifts and continue as a great nation. New York City Mayor Ed Koch is expected to take a similar tack at this year's convention. In 1983, Denver Mayor Federico Pena, who was instrumental in getting ADAPT a place on the convention agenda, supported accessibility, just as this year's host mayor, Marion Berry, is expected to do. Access/Denver will send 43 wheelchair demonstrators to Washington, although at press time they were short $4,400 of the $15,000 needed to provide them with transportation, food and lodging. Among the individuals contributing to the fund drive was Wellington Webb, an unsuccessful 1983 candidate for mayor of Denver. In addition, Denver's HAIL, Inc., will be sending five representatives. Several other cities, including Dallas, El Paso, Los Angeles, Cincinnati, Little Rock, Arkansas, Poughkeepsie, New York, and Chicago have confirmed that they will have representatives on the picket line. Boston's Disabled Liberation Front announced that it was sending eight pickets. ADAPT intends to provide a training session in confrontational politics in Washington on September 26. Ironically, one problem that demonstrators flying into Washington's Dulles International Airport will face is a lack of accessible buses between the airport and downtown Washington. "We were going to file a complaint," Blank said, "but it turns out that the Department of Transportation runs the bus system there and they say that they are the administrators, not the recipients, of federal funds, and therefor are not required to provide accessible service."

Kathy Archuleta, an aide to Pena, said she set up a meeting for Friday with Wade Blank, handicapped activist leader, after an official from the American Public Transit Association (APTA) called the mayor’s office expressing concern about Blank’s plans to picket the convention. “We’ll act as facilitators,” said Archuleta. “APTA has called us and now we’re going to talk to Wade.” Blank, one of the leaders of the newly formed American Disabled for Accessible Public Transit, said the group is protesting APTA’s refusal to endorse wheelchair lifts on all buses and subways. The group represents disabled associations across the country. Blank also is co-director of Atlantis, a self-help group for the disabled. Blank said the plans call for about 30 handicapped people to picket the convention each day and possibly conduct civil disobedience, such as disabled chaining themselves to the convention’s headquarters at the Denver Hilton. About 3,000 representatives from transit districts throughout the United States are expected to attend the convention, Oct. 23 to 27. Blank said the group wants the convention to support equal access for all transit riders on public transportation and inform bus manufacturers that transit districts will buy only buses equipped with wheel-chair lifts. Jack Gilstrap, executive vice president of APTA, said the organization called Pena’s office just to inform of the planned demonstrations and “expressing the hope that they would be orderly.” “We’re used to demonstrations,” said Gilstrap. He said the protests have not changed APTA’s plans to hold the convention in Denver.

Police Arrest Denver Disabled Protestor MIKE AUBERGER, a community organizer for the Atlantis Community in Denver and a member of the American Disabled for Accessible Transit (ADAPT) is arrested by Washington, D.C., police outside the Washington Convention Center where the national convention of the American Public Transit Association (APTA) was just getting under way. A spokesperson for APTA said that the demonstrations only delayed the start of the convention by a few minutes. Inside the convention hall Secretary of Transportation Elizabeth Dole abandoned her prepared text and said the administration was working to provide public transit for the disabled. Outside the hall, demonstrators branded the secretary's plan as another “separate but equal" scheme and demanded that the federal government require all public transit systems be made accessible to the handicapped. Demonstrators not only blocked the entrances to the convention but also surrounded chartered buses that took delegates from their hotel to the convention center. The disabled activists represented a number of cities, including Denver, Syracuse, N.Y., Boston, El Paso, Los Angeles and Chicago. Additional photo on page 4. 28 Busted in D.C. The 28 disabled activists who were arrested for civil disobedience during the national convention of the American Public Transit Association (APTA) in Washington, D.C., last month are trying to raise $1500 to make their bail money by a Dec. 3 deadline. At the same time, they're preparing to carry their demand that the APTA members buy only wheelchair-lift equipped buses to the transit organization's regional convention in San Antonio on April 20. The Texas contingent from the American Disabled for Accessible Public Transit (ADAPT) under the leadership of Jim Parker of El Paso has been especially militant in their demands. Taking their lead from an editorial in the September Handicapped Coloradan, a coalition of of Texas disabled groups met in San Antonio and voted to ask transit systems in Texas to withdraw from APTA unless it goes on record supporting accessibility. The Colorado chapter of ADAPT was planning to introduce a similar resolution to Denver’s Regional Transportation District (RTD). APTA's position is that accessibility should be left to the discretion of the local transit provider, Although the Carter administration mandated accessibility in public transit, APTA was successful in getting that ruling thrown out in a l98l court battle. ADAPT maintains that the disabled have a civil right to public transit. Jack Gilstrap, APTA's executive vice president, reiterated that position as wheelchair demonstrators seized buses in front of the White House and hurled their chairs at police lines outside the Washington Hilton and Washington Convention Center during APTA's late September meeting. Gilstrap said that the funds just weren't there to support a mandatory system, adding that the additional burden might jeopardize some transit systems. However, since the convention ADAPT has been approached by APTA's new president, Warren Franks, the director of the Syracuse, N.Y., transit system, who has requested a meeting in Denver with wheelchair activists. "The Syracuse ADAPT group has been pretty active," said ADAPT spokesperson Wade Blank. "Franks must be pretty worried about what might happen there if he wants to meet with us.“ ADAPT was organized in Denver one year ago by some of the same groups and individuals who had been involved in forcing RTD to adopt a pro-accessibility policy when purchasing new buses. That battle too was highlighted by militant demonstrations with wheelers chaining themselves to the doors of RTD headquarters. In contrast, demonstrators restricted themselves to orderly pickets when APTA held its national convention in Denver in 1983. But ADAPT only abandoned its plans for civil disobedience after APTA met its demands to address the entire convention on accessibility. APTA's national staff fought that request and allegedly threatened to pull the convention out of Denver at the last minute, but finally agreed to allow ADAPT to address the meeting after Denver Mayor Federico Pena intervened. There was no question that ADAPT would be offered the same treatment at the Washington convention. Although they didn't get a spot on the agenda Blank said his group made their point by capturing the attention of the capital's media. Even before the convention opened, ADAPT made its presence known by joining forces with local D.C. activists to seize seven Metrobuses and block the five blocks along Pennsylvania Avenue in front of the White House during the afternoon rush hour. Demonstrators released the buses an hour later when D.C.’s Metro General Manager Carmen E. Turner agreed to meet with Washington disabled leaders to discuss their demands for a fully accessible system. No date has yet been set for that meeting, which ADAPT said marked an historic first in the Washington area. No arrests were made during that demonstration, although Washington police moved several demonstrators out of the street. But on the following Monday and Tuesday 28 demonstrators were arrested as they tried to block buses leaving the Washington Hilton for the convention center and again at the convention center itself. The police threw up lines as picketers arrived but were unable to halt the advance of the demonstrators, who wedged their chairs in the hall's doors or hurled their bodies onto the ground. Mike Auberger, one of those arrested, said the police "were abusive -- there's no doubt of that," but he added that this was probably pretty typical. “Let's face it," he said, "these guys probably have to deal with demonstrators all the time." They don't mess around when they get started. Auberger said he was grabbed by the hair and pulled back so that his chair was resting on its back wheels. Two other demonstrators were thrown from their chairs and taken to local hospitals where they were released after being treated for minor injuries. Police had to bring in special vans with wheelchair lifts in order to cart demonstrators off to jail, where they were fingerprinted and rushed into court. "Only the doorway between the holding cells and the courtroom was too narrow to get our chairs through," Auberger said, "so they had to take us in the back way." Some of the disabled picketers were surprised that the police reacted with such force, according to Auberger. "l think it opened a few eyes," he said. ADAPT filmed the demonstration, and a 20-minute edited version is being shown as part of a fundraiser to pay the bails of those arrested, about half of whom were from Denver. Congresswoman Pat Schroeder (D-Denver) has agreed tn help raise money, but because of previous campaign commitments said she would be unable to participate until after the first of the year.

San Antonio Light, 4/25/85 [Headline] Disabled protesters claim win After three days of public protests, members of the American Disabled for Accessible Public Transit said they believe they have accomplished their goal of drawing the public’s attention to the transportation problems they encounter. The organization called off planned demonstrations yesterday after receiving a pledge from Mayor Henry Cisneros that he would seek improvements in local transit services. More than 50 members of ADAPT, who were staying at The Convent of the Holy Spirit, were expected to leave San Antonio and return to their homes in other states. “We have raised the issue substantially," said ADAPT spokesman Wade Blank. “Our issue is a mobility problem for more than 10,000 people in San Antonio," he added. “They are a ‘hidden minority." Sunday, ADAPT members blocked the lobby of the Hyatt Regency Hotel where the American Public Transit Association was holding a regional meeting. Monday, ADAPT members moved into the VIA Metropolitan Transit offices on Myrtle Street and remained for several hours until they met with association officials. And Tuesday, the organization's members blocked VIA buses at several downtown intersections. Two ADAPT members were given citations for obstructing traffic, but no arrests were made. No disabled San Antonians joined the protests during which ADAPT members demanded that VIA buses be equipped with wheelchair lifts. VIA operates a special van transportation service for the disabled. Blank, who charged there is a lack of leadership and organization within the San Antonio disabled community, said it would be up to the people here to take up the issue now. The ADAPT spokesman said San Antonio police officers who dealt with the three days of demonstrations were the “most friendly, and, level-headed police in any city” in which the group has demonstrated.

The group which represents American Disabled for Accessible Public Transportation (ADAPT), was in town to meet with members of the American Public Transit Assn. today. Representatives of ADAPT said they want a legislation requiring all new buses operated by private companies such as Greyhound and Trailways to be equipped with wider doors, lifts and ramps. Most public transportation operators, including San Diego Transit, provide wheelchair lifts on at least some buses. ADAPT member Claude Holcom bought a ticket to Los Angeles, but when Trailways' personnel told him they would have to fold his wheelchair and carry him to his seat, Holcom declined to board the bus. "We don't think a person should have to be carried aboard a bus," said Wade Blank, one of the protest's organizers. “It's very dehumanizing. They’re taking away their legs." Blank and fellow ADAPT member Mike Auberger said the group is trying to draw attention to the frustrations of traveling by bus and being in a wheelchair. Although both Trailways and Greyhound buses are not equipped to handle wheelchairs, Blank said ADAPT met with Greyhound officials last week to discuss the possibility of fitting new buses with lifts. “This is a symbolic protest, just like the civil rights protests of the '60s, but we have the right to travel the same as anybody else," Blank said. "The wheelchair is like somebody's legs." The Los Angeles bus, with its two passengers, was scheduled to leave the C Street station at 4:15 p.m., but by the time terminal manager Fred Kroner arrived and negotiated with the ADAPT members, it was nearly 7 o'clock before it departed. The two passengers appeared surprised and baffled by the protest and by queries from members of the news media. One man opted to go to the Greyhound terminal two blocks away and catch another bus rather than wait out the protest. The other passenger, Mich Galloway, 23, said he was sympathetic to the group wanting equal access to buses and waited patiently until the protesters dispersed. “I see where they are coming from." Galloway said. "I hope something is done about it." After several phone calls to the Trailways corporate offices in Dallas proved fruitless. the ADAPT members agreed to accept from Koner the name, address and phone number of the company‘s public relations officer. who they intend to call Monday. Dallas Times Herald, Saturday Nov. 24, 1984 [Headline] Wheelchair activist adopt radical tactics Los Angeles Times WASHINGTON — It was a scene reminiscent of the 1960s civii rights demonstrations as angry protesters chanted slogans, picketed the White House and stopped traffic before they were finally dragged away by police. And the series of confrontations that ended with 27 arrests last month all seemed to come down to a similar central issue —- the right to sit on a bus, to have full access to public transportation. There was one striking difference, however. Unlike Rosa Parks and the black civil rights activists who battered down the Jim Crow barriers in the South, these protesters were in wheelchairs, and their goal was equal access for the physically handicapped. "It's a civil right to be able to ride public transportation," says Julia Haraksin, a wheelchair-bound Los Angeles resident who participated in the demonstrations. Organizations representing handicapped persons long have urged Washington to require that all new buses and rail systems built with funds from the Department of Transportation's Urban Mass Transportation Administration be equipped to accommodate handicapped riders. But Haraksin and other handicapped individuals are beginning to press the old arguments with more radical tactics. Frustrated by years of negotiating, lobbying in Washington, going through the courts and staging non-confrontational protests, some handicapped activists now are resorting to confrontations and civil disobedience. Thus, early in October, 100 members of a newly formed coalition called American Disabled for Accessible Public Transit confronted a national meeting of city transportation heads here, using the kind of civil disobedience tactics used 20 years earlier by Dr. Martin Luther King Jr. Protesters were arrested when they blocked entrances and buses of those attending the American Public Transit Association convention. “The strategy was to physically be a barrier because handicapped people have to face barriers all their lives," Wade Blank, a founder of Denver-based ADAPT, said. Calling the protests here “our Selma," leaders of ADAPT claimed a public relations victory and promised their struggle has only begun. They already are focusing their efforts on what they hope will be a larger demonstration at the next meeting of the American Public Transportation Association a year from now in Los Angeles. But their cause may be in for a tough battle. Their opposition comes from the Reagan administration, from many city governments and even from within the handicapped community. And as public attention focuses on the underlying budget choices involved, the opposition may swell with the addition of taxpayers concerned about the possible costs of a national full-access program. ADAPT argues a legal right to full access for the handicapped already exists. Federal law states Urban Mass Transportation Administration funds — which account for about 80 percent of the costs of the equipment in most municipal transportation systems —- cannot be spent on programs that discriminate against, or exclude, the handicapped. The law does not make clear, however, whether handicapped persons must be provided with access to regular bus lines or whether they can instead be provided with alternative transportation systems. Nor does it indicate who should make that decision. Current Department of Transportation policy, which is strongly supported by the American Public Transportation Association, allows each city to make its own decision on what type of transportation it will provide for the handicapped. This is in sharp contrast with Carter administration policy, which in 1979 interpreted federal regulations to mean full access. Members of ADAPT, opposing the separate-but-equal philosophy, argue that paratransit does not meet the needs of the handlcapped and is inherently discriminatory. “lt segregates the disabled people trom the able-bodied community," Mike Auberger, an organizer for ADAPT, said. Because paratransit requires advanced scheduling, sometimes weeks before a ride is needed, he said, “you have to schedule your life according to the transit system." Transit authorities, on the other hand, argue full access can be too expensive, given the low percentage of handicapped riders in many cities. Lift-fitted buses cost an estimated $8,000 to $10,000 more than regular buses. Furthermore, lift systems are often unreliable and time-consuming to operate and maintain, authorities add. In Denver, for example, the transportation district has spent $6.3 million to purchase or retrofit buses with lifts, 80 percent of which was paid for by the federal government, according to spokesman Gene Towne. Since it started mainline access in 1982, the district has spent close to $1 million in maintenance of the lifts and expects to spend an additional $900,000 this year. Yet only 12,000 of the district's 38 million riders use the lifts, according to Towne. ADAPT counters the issue is not cost but civil liberties. "In America, we have a way of hiding our prejudices with pragmatism," said Blank, a Presbyterian minister and veteran of the civil rights and anti-war movements of the 1960s who now supports handicapped activists. Across the country, cities are using a variety of approaches to the problems of providing mass transit for the handicapped. ln Los Angeles, mainline access is required by state law. Although 1,850 of the Southern California Rapid Transit District's 2,400 buses are fitted with wheelchair lifts, some local advocates charge that broken lifts, drivers who do not know how to use the equipment or refuse to do so and an overall lack of commitment to providing access limits the system. [The] Municipality of Metropolitan Seattle also contracts with groups to supply paratransit [vans] and half-fare cab service, [providing] 8,400 rides a month. Trailways bus from the depot on State and C streets to Los Angeles yesterday, but he was not allowed to buy a ticket. There were only two passengers aboard, but Holcomb is confined to a wheelchair. Trailways buses are not accessible to people in wheelchairs. “I have a friend in L.A.,” Holcomb spelled out on a homemade message board he uses to communicate. “I have to fly from L.A. to Hartford, Conn., tomorrow.” Holcomb lives in Hartford. Shortly before the bus was due to depart, Holcomb, 24, along with 11 other members of American Disabled for Accessible Public Transportation (ADAPT), hemmed the bus in with their wheelchairs and refused to move. Police officers arrived at 4:35 p.m. and told the group that they were breaking the law by obstructing traffic and trespassing. The ADAPT members will appear at the American Public Transportation Association's (APTA) meeting this morning. They have been granted 30 minutes to air their plea for both wheelchair-accessible transit buses on both local and interstate lines. Twenty of 29 San Diego Transit bus routes have wheelchair access, but no such equipment is in use on intercity or interstate public buses. Joe Carle, an ADAPT community organizer in Denver, parked his wheelchair in front of the bus and tilted back his black felt cowboy hat. “This may seem like it’s drastic,” he said, “but it’s the only way to open people’s eyes. ... What good is it if a person has to stay in a one-block area?” Similar demonstrations were held recently in Denver and Washington, D.C., in conjunction with scheduled APTA meetings. Carle said the attitude toward the disabled seems to be “we'll do everything we can to keep you alive, but we don’t want you around.” He said ADAPT was specifically focusing on Trailways and Greyhound Bus Lines because they are owned by companies who manufacture their own buses, yet refuse to construct them to accommodate wheelchairs. The bus driver and two passengers, Michael Calloway, 23, and Claude Williams, 26, got off the bus and waited inside the depot. “I think they (the disabled) have the right to board the bus,” Calloway said. Williams nodded his head in agreement. “It throws us off schedule, but I’d like to see something done about it (bus access for the disabled). I don’t think it’s right for them to (delay the bus) but I understand. Sometimes it takes a little push and shove to get things done." Able-bodied Wade Blank organized the group's meeting at the bus station. Blank is one of the six founders of ADAPT. Two years ago, he adopted Heather, a 14-year-old girl confined to a wheelchair, and married her mother. He described the attitude toward the disabled as “just another ‘ism’ — paternalism. It's just like racism and sexism.” After police told the group they were breaking the law, Mike Auberger, spokesman for the wheelchair group, asked to speak with the manager of the terminal, Fred Kroner, who was summoned from his home in Chula Vista. Kroner spoke with Auberger and his group at the door of the bus. He was asked to set up a meeting in Denver with Trailways’ national representatives. “For what?” Kroner asked “To talk about making these buses accessible," said Auberger. Fifteen minutes later, Kroner said he could reach no one, and gave Auberger the phone number of Roger Rydell, vice president in charge of public relations at Trailways’ Dallas headquarters. The group let the bus leave. “I won't be satisfied until these buses are accessible,” Auberger said, “but this is the first step in the process.”

Handicapped Coloradan, vol 7 no 5, December 1984 [Headline] ADAPT HEADS FOR SAN DIEGO The executive board of the American Public Transit Association (APTA) has agreed to vote on a resolution calling upon the nation’s transit systems to provide accessible mainline bus service. That vote will take place when the executive board meets in San Diego Feb. 9 or 10. Wade Blank, a spokesperson for the group pressuring APTA to endorse the resolution, said he expects that the APTA board will summarily vote it down. Two years ago the American Disabled for Accessible Public Transit (ADAPT) put such a resolution before the national convention of APTA when it met in Denver. While APTA allowed the presentation, it refused to vote on the resolution. Twenty-eight ADAPT members were arrested for civil disobedience outside the convention hall when APTA met in Washington, D.C., in October 1984. Following that convention, ADAPT asked new APTA chairman Warren Frank, director of the Syracuse, N.Y., transit system, for a meeting to discuss accessibility. Frank responded by reiterating his opposition to mandatory accessibility. “The transit industry has thoroughly studied the matter and as a result strongly endorses current federal requirements which provide the flexibility for each local community to meet the needs of their handicapped citizens with specialized services or full accessibility or a combination of both," Frank said in a letter to Blank dated Nov. 2. Blank wired this response: “Your letter . . . is a sign of your bad faith and lack of moral resolve when it comes to the rights of disabled people. To offer us a statement of APTA's policy toward the disabled citizen and indicate your unwillingness to be flexible is no different than Governor Wallace standing in the doorway to prevent blacks from integrating." The telegram concluded with a warning that ADAPT would show up at the Western Regional Convention of APTA in San Antonio, Tex., April 20-24. Frank finally agreed to meet with representatives of ADAPT in Chicago Dec. 6. Frank was accompanied by APTA attorney Robert Batchelder and executive vice president Jack R. Gilstrap. Gilstrap, who runs the daily APTA operations, has been the target of a number of vocal attacks by ADAPT members. "For the first time Jack Gilstrap actually shook my hand and smiled at me," Blank said after returning from the Chicago meeting. APTA agreed to allow ADAPT to make a 20-minute presentation of the merits of accessibility at the San Diego board meeting. APTA further agreed to provide the names and addresses of board members so that ADAPT could lobby them in advance of the meeting. ADAPT has said it will cancel the demonstration in San Antonio in the unlikely event the APTA board supports mainline access in all cities. In the meantime, ADAPT has continued working on plans for the San Antonio convention. Organizers believe the smaller nature of that regional convention will make it easier for them to disrupt it. Blank said ADAPT intended to be at every APTA meeting until they agree to total accessibility. ADAPT is still working with Rep. Pat Schroeder's (D-Colo.) office on a fundraiser to help pay the bond money for the 28 demonstrators arrested in Washington during the October APTA convention. The Washington chapter of ADAPT has pressured the Washington Metropolitan Area Transit Authority (WMATA) board of directors to establish a policy that all newly purchased buses will be equipped with wheelchair lifts. WMATA was to vote on that resolution Jan. 10.

[Headline] Disabled riders hopeful after meeting transport officials San Diego Union By Ric Bucher, Staff Writer 2/11/85 Mike Auberger and Dana Jackson were not smiling when they wheeled out of the Hilton Hotel's Capri Room, but they were hopeful. Auberger and Jackson, along with 13 other wheelchaired members of American Disabled for Accessible Public Transportation, asked board members of the American Public Transportation Association to endorse full accessibility for the disabled to all public transit vehicles. And they aimed their plea at the board members’ hearts rather than their budget. “I think we really shook them up,” Jackson said. “They have come a long way,” Auberger said. “Two years ago, they didn't want us in the room. This time they asked questions.” One of those questions, posed by John Pingree, transit manager of Salt Lake City, Utah, personalized one of APTA’s primary disagreements with the ADAPT group. The transit manager said he has an autistic child whom handicap requires the use of specially equipped vans presently available to the handicapped in most cities. The cost of fitting public transportation system with wheelchair lifts, ramps and wider doorways would take away funds currently subsidizing these van services, APTA members claim. ADAPT members say, however, that the van service method is severely handicapped itself. Van service must be reserved 24 hours in advance for a specific time and destination, and ADAPT members say the vans segregate them from the rest of the public. “Imagine if you had to program your car 24 hours in advance every time you wanted to go anywhere, and that was the only way you could get there,” Jackson said. Jackson is the ADAPT transportation coordinator in Washington, D.C. Wade Blank, who helped found ADAPT 12 years ago, said the group's appeal focused on “the moral imperative” aspect of equal access, instead of “costs and everything else.” Blank, who is not disabled, feels the transit system discriminates against the disabled now as it once did against black people. Blank believes the presentation created a rift between transit managers who have superior handicap access – Seattle was cited as the best – and those with lesser facilities. San Diego is one of the worst, according to Auberger. APTA’s executive vice president, Jack Gilstrap, said the APTA board has appointed a committee to study the ADAPT and give a report, tomorrow. Gilstrap said the main purpose of the meeting here is to address the severe budget cuts planned for the Department of Transportation by the government.

Shs wrote a letter of complaint to the head of the chain and received an apology, along with a $50 gift certificate. Off she went to cash in the certificate, and guess what happened? That's right. A guard turned her away from the store. The woman sued; the store settled the case by giving her a check for $10,300. I had been about to write that a disabled lawyer had handled her case, but he — Kipp Elliott Watson—corrected me. “I am a lawyer with a disability," he said. In Jim Johnson's "Shop 'Talk" column in the February 22, 1986, Editor & Publisher, there is a guide for copy editors and reporters concerning accuracy of language in stories about those with disabilities. It was put together by more than 50 national disability organizations. One illustration: “Perhaps the most offensive term to disabled people is ‘wheelchair-bound' or ‘confined to a wheelchair.’ Disabled people don't sleep in their wheelchairs, they sleep in bed. Call them 'wheelchair users.'" Also, "labeling of groups should be avoided. Say ‘people who are deaf' or 'people with arthritis’ rather than ‘the deaf' or ‘the arthritic.’ . . . One of the problems with eliminating insensitive terms is the, lack of a clear policy that reporters and editors can follow. A reporter cannot change a paper's policy by himself. The first time a reporter writes 'person who is arthritic,’ a copy editor is sure to change it to ‘an arthritic’ to save words.” And I would particularly recommend the next correction to the vast majority of the reporters and editorial writers who have covered Baby Doe cases: “Afflicted [unintelligible] a negative term that suggests hopelessness. Use disabled. Also to be avoided are deformed and invalid." The guide is especially useful because more and more of those with disabilities are going to be making news-in–lawsuits, individual acts of resistance against discrimination, and in collective demonstrations. For instance, in Los Angeles last October, during a nonviolent direct-action protest against the American Public Transit Association (which is resisting making all its buses accessible to the handicapped), there was this report by George Stein in the October 7 Los Angeles-Times: “During the procession, 131 wheelchairs, stretching more than a block, carried people with disabilities ranging from spina bifida, cerebral palsy and muscular dystrophy to snapped spinal cords, congenital defects and post-polio paralysis. “Many had the withered limbs and lack of body control that the more fortunate usually try not to stare at. “But not Sunday. Motorists slowed to watch the sight. Some honked in support. One of the demonstrators was Bob Kafka, a spokesman for ADAPT (American Disabled for Accessible Public Transit) "This is beautiful,” Kafka said as he wheeled along “I am tired of being closed away." Carolyn Earl, who uses a wheelchair, tried to make a reservation at the Harrison Hotel in Oakland, California. The clerk wouldn't take an advance deposit. Suppose there's a fire, he said. The hotel would be liable. But call back, he said. She did. Ain't that a shame, there are no rooms with baths, and she'd asked for a room with a bath. Okay, the woman said, I’ll take a room without a bath. The clerk said that for her, there were no rooms, period. Just like it used to be with blacks and Jews. It happens, however, that according to Section 54.1 of California's Civil Code, it is as unlawful to discriminate in public accommodations against people with disabilities as it is to exclude racial and ethnic minorities. Carolyn Earl went to court. In December 1984, the hotel agreed to pay her damages and to sign an agreement pledging never again to refuse lodging to anyone who is disabled. In Louisville last fall, Steve and Nadine Jacobson, who are blind, were on trial. The charge: disorderly conduct. On July 7, they had been sitting in exit-row seats on United Airlines Flight 869 to Minneapolis, where they live. Airline personnel and security employees from Standford airport ordered the Jacobsons to get out of those seats. In the event of an emergency, the Jacobsons were told, they, being blind, could jeopardize their own safety and that of others. The rationale for the policy, it came out at the trial, was a “test” some time back during which – now get this – sighted people were blindfolded two hours before a mock evacuation and it turned out that these “blind” people had trouble opening emergency exit doors as well as dealing with other evacuation procedures. On the basis of a test that used fake blind people to find out how real blind people might act, the Federal Aviation Administration—long known for its stunning brilliance—issued an advisory circular suggesting to airlines that they keep blind folks out of those emergency exit rows. As they were trying to get the Jacobsons to move, United Airlines personnel kept insisting that a "Federal regulation" said they had to get out of those seats. The Jacobsons, however, had just come from a convention at which that very advisory circular had been discussed. They knew there was no rule. And so they sat. And sat. Irritated passengers offered to trade seats with them. Another yelled that the Jacobsons were holding everybody else up. "How can you be so selfish?" And another, speaking from the heart, pointed to Nadine Jacobson, and said to a neighbor: “No wonder God punished her by making her blind!" Eventually, the Jacobsons were removed from the plane and charged with disorderly conduct—not with violating the alleged “Federal regulation." At the trial, Steve Jacobson told the jury: “All through my life, there were things I was told I couldn't do because I was blind. In college, they said I couldn't take math." (Mr. Jacobson is a computer analyst for 3M.) He went on to say that he kept ignoring all the advice about all the things he couldn't do because he was blind. “I just had to go on," he said. Where he works, he was told not to use the escalator. He could get hurt. He uses the escalator. That day at the airport, “To move from my seat would reinforce all that I've worked not to have happen. To move would say to the other people on the plane that I am less capable than any sighted person to open that emergency door. And that isn't. the case. It just isn't.” As for Nadine Jacobson: “I was scared. I had never been arrested before. I felt really bad that people were angry and upset, and that the plane was being delayed." But still she wouldn't move. “Many times people make assumptions about what we [blind people] can do and can't do. I knew that if I moved from that seat, everyone would think that anyone else was more competent than me. It's an issue of self-respect. I'm a citizen of this country, and a blind person, and I feel I have a right to travel in this country, and if I get assigned a seat, I have a right to sit there." Would the jury have been convinced solely by what the Jacobsons said? I don't know. But I expect they listened with much interest to testimony by Mark D. Warriner of Frontier Airlines, who said his company had stopped discriminating against blind people as a result of a March 1985 evacuation drill by World Airways, which showed that blind people—real blind people—got out during an emergency faster than sighted passengers. The Jacobsons were acquitted. The verdict, said Nadine Jacobson, was “a step forward for blind people all over the country." Footnote: None of the police officers or the security personnel involved in arresting the Jacobsons would give them their names. Without the names, the Jacobsons could never identify them, ho-ho. But an attorney sitting in front of the Jacobsons on the plane handed them a piece of paper with one of the names, and that led to others being revealed. The stories about the Jacobsona and the woman trying to get a hotel room originally appeared in The Disability Rag in somewhat different form. There is nothing like that paper in the whole country. It covers the whole disability rights spectrum—from what‘s happening in the courts to the directions being taken by groups of nonviolent resisters. It publishes memoirs, jeremiads, parodies, and material for which there is no category. It is the liveliest publication I know. It has grace and beauty and fury. The importance of access to buses and other forms of transit has been distilled by Wade Blank of ADAPT: “Jobs and education don't mean much if you can't get a bus to take you there. Accessibility to public transportation—moving from one place to another—should be a right, not just a consumer service." Recently, Wade Blank was telling me how, because of ADAPT and the pressure it keeps putting on, 78 per cent of the buses in Denver, where ADAPT is based, are now accessible. Soon, with 200 new buses on order, all of them with lifts, people with disabilities will be able to ride 90 per cent of the Denver buses. Already, Blank said, this access means a lot. “I know a man with cerebral palsy," Blank continued. “He has no use of his legs or arms. He can't speak. But now, with the buses accessible, he can ride around and see the sights and come to our offices. He can move where and when he wants to in the Denver community." He's no longer closed away. In Dallas, Kataryn Thomas, 57, was arrested last month during an ADAPT demonstration against the recalcitrant Dallas Area Rapid Transit Authority. She was born with spina bifida, uses a wheelchair, has worked as a receptionist, and when she was busted, a bright orange flag connected to the back of her chair fluttered in the breeze. The words on it were: “Free Spirit." “l don't have to climb any mountains," Kataryn Thomas told the Dallas Times Herald. “I just want to ride the public transit.”

[Headline] Protest by disabled clogs downtown L.B. PRESS-TELEGRAM (AM/PM)/THURSDAY, Oct. 10, 1985, p. A10 FROM/A1 batch of arrests in the 200 block of Pine. At that point, protest leader Rev. Wade Blank, of Denver, told police there would be no further disruptions. Blank thanked the police for the way the department had handled the demonstration and said the remaining protesters were tired and hungry. During the afternoon, police Lt. Norm Benson conferred at length with protest leaders, pointing out that, despite whatever police sympathies there might be for the cause, the event took patrolmen off their rounds and posed an impediment to emergency vehicles. Benson even made a call to the Bonaventure Hotel in downtown Los Angeles, where the American Public Transit Association is holding a convention, in an attempt to reach Laurence Jackson, general manager and president of Long Beach Transit and new president of the APTA, to urge him to speak by phone with an ADAPT spokesperson. Guy Heston, the bus company’s director of marketing, interviewed at the scene of the bus tie-ups, said the request to talk with Jackson was untenable because "they came unannounced, and, as you know, he has commitments at the convention." An ADAPT spokesman, Jim Parker of El Paso, told a reporter as he was being steered toward a Dial-a-Lift van for the trip to the Long Beach jail, "This is probably going to be the largest mass arrest of disabled people in the history of this country." He stressed that the targets of Wednesday's demonstration and one Monday in the office of Rep. Glenn Anderson, D-Long Beach, were the APTA, which closes its four-day convention today in Los Angeles, and Anderson, as chairman of the House subcommittee on surface transportation. "One very important thing for the people of Long Beach, Los Angeles County and California to understand," Parker said, "is that this is not aimed at them, because California and cities like Long Beach and Los Angeles are really models for the country to look at. "Most of the buses have lifts on them, and all new buses purchased will have lifts. "I guess, for the first time, disabled people have come to the city where the president of APTA resides . . . to help pull the federal government back into the issue again, along with APTA." ADAPT asserts that it was a legal action by APTA, followed by an administrative order in early months of the first Reagan administration, that killed a law mandating phased in accessibility for the disabled to public transit across the country. The order left the decision up to local option. Jackson could not be reached for comment Wednesday, but Long Beach Transit Assistant General Manager Patrick Butters said that nine of 18 fixed routes in Long Beach are wheelchair accessible, while 85 percent of all the company's public buses in the city are equipped with wheelchair lifts. "On an ongoing basis we’ve been increasing that" percentage, said Butters. A committee on the handicapped advises Long Beach Transit on which bus routes to offer lift service on, said Butters. "We’ve tried to hit the routes that are most heavily traveled," he said. An average of 12 to 14 persons a day who are confined to wheelchairs ride on fixed Long Beach Transit routes, said Butters. In addition to regular bus service, Dial-a-Lift service is available in Long Beach, Lakewood and Signal Hill, he added. At the height of the protest, Frank Lozano and Martin Walton took a stand in front of an RTD bus that had eight Long Beach Transit buses backed up behind it at Pine and Broadway. The passengers of those idled buses, workers and schoolchildren heading for home, were not happy with the delay. "Hey, I just want to go home; take a shower, eat some supper and watch the ball game," said one man. But Lozano, who is blind, and Walton, confined to a wheelchair, held their ground. "No, it doesn't surprise me,” Lozano said of the anger from the riders. "I realize that there are many people who are unaware of the issues." California is one of two states – Michigan is the other — that mandate that all new public transit buses be equipped with wheelchair lifts. The demonstrators said they were aware of this but believe that Jackson and APTA can pressure the other 48 states into enacting similar legislation. Denver Post, Issues, 10/6/85, no page number [Headline] Transit leaders to face protests from disabled By Jack Farrar Special to the Denver Post The American Public Transit Association will run into some political street theater when it rolls into Los Angeles today for its annual meeting. Waiting for the group will be a militant cast of handicapped individuals, including members of a Denver organization called Atlantis, who want full accessibility to the nation's public transportation system. As APTA delegates convene at the Westin Bonaventure Hotel, more than 100 people in wheelchairs – members of the American Disabled for Accessible Public Transit – will be “marching” single-file from MacArthur Park, more than a mile away, to begin a week-long series of demonstrations. They won't have a parade permit. They haven't asked for one. Through such acts of civil disobedience, the demonstrators hope to force the APTA, public officials and the news media to think about what they consider to be the most pressing issue facing the handicapped: access to public transportation. One contingent of protesters will be led by Wade Blank, a 44-year-old Denverite who cut his activist teeth in the 1960s, marching with blacks in Alabama and peaceniks in Ohio. Access 'a right'[boldface] Blank is the founder and executive director of Atlantis, one of ADAPT's most militant member organizations. “Jobs and education don't mean much,” Blank argues, “if you can't take a bus to get there. Accessibility to public transportation – moving from one place to the other – should be a right, not just a consumer service.” For the past three years, ADAPT, largely under Blank's leadership, has demanded that APTA adopt total accessibility for the handicapped as an official policy rather than as an objective. Transit association officials have responded by citing numerous improvements made in service for the handicapped – improvements that the handicapped have applauded – and contends that total accessibility is financially impractical. “We have not ignored the handicapped,” says APTA Deputy Executive Director Albert Engelken. “Accessibility is a compelling issue. But total accessibility is an enormous undertaking, and with federal dollars shrinking, our resources are limited. In any case, it is not the role of an association like ours to establish policy.” Disabled activists, however, believe the costs of accessibility are distorted by the transportation industry. Moreover, they argue, the issue is civil rights, not economics. “Public transportation is a tax-supported system,” Blank says. “The handicapped pay taxes. It's as simple as that. How would the average taxpayer feel if he was denied access to a facility he paid for?” Long regarded as a quiet minority, disabled individual recently have added a more confrontational approach to their struggle for equality, and the man frequently in the front lines of that movement is Blank, whose long blond hair and granny glasses evoke the image of the 1960s activist. He encourages the handicapped to take to the streets when they feel their demands are being taken less than seriously. Members of Atlantis have made headlines locally and nationally with their tactics in Denver – chaining themselves to seats of fast food restaurants, occupying intersections that don't accommodate wheelchairs, and blocking the entrances to buildings with architectural barriers. Rules watered down [boldface] Progress in making public transportation available to the handicapped can be traced to the Urban Mass Transit Administration's adoption of Section 504 of the Rehabilitation Act in 1979. [sic] Section 504 generally made it illegal to exclude any individual, by reason of handicap, from any program receiving federal dollars. UMTA's regulations stated that all new buses purchased with federal money must include wheelchair lifts and aimed for 50 percent of peak-hour accessibility on regular bus routes. RTD standards strict [boldface] The Regional Transportation District in metropolitan Denver has adopted accessibility standards that are more stringent than required. Even after Section 504 regulations were softened in 1981, RTD's board chose to maintain its commitment to provide 50 percent peak-hour accessibility on all routes, and 100 percent off-peak accessibility. And RTD will soon become the first public transit system in the United States to introduce wheelchair lifts on its larger, regional commuter buses. Despite such advances, Blank will not be satisfied until disabled individuals throughout the United States can board and ride a bus whenever and wherever the able-bodied do the same. “We simply want APTA, as the association which speaks for the public transportation industry, to declare its intention to make the system accessible. We know it will take time. But isn't this the country that put a man on the moon?”
