June 12, 1990 - Guardian. 5 Disabled 'ecstatic' as rights act clears House By DIANE COLEMAN The Americans with Disabilities Act, considered by many to be the most sweeping civil rights legislation since the 1964 Civil Rights Act, easily cleared the House of Representatives May 22. It is expected to reach the president‘s desk by July 4. The act prohibits discrimination based on disability in public accommodations, employment, transportation and telecommunications. It is intended to address "rampant, daily discrimination in every sphere of American life,“ Rep. Pat Schroeder, D-Colo., told her colleagues on the House floor. “Mentally retarded persons are kept out of restaurants. Persons with cerebral palsy are turned away from theaters. . . . Employers cite fears of hiring disabled persons because their customers will feel uncomfortable or even repulsed,” Schroeder added. Despite strong opposition from private business and transportation lobbies, chief among them the National Federation of Independent Businesses and Greyhound Lines, Inc. , the Americans With Disabilities Act achieved bipartisan support in both houses of Congress. The House vote was 403-29. Under pressure from the NFIB and the National Restaurant Association, the House version of the bill was amended at the last minute to allow employers to remove people with HIV infection from food handling positions. Sponsored by Rep. Jim Chapman, the amendment passed narrowly, although the Texas Democrat conceded there is no “evidence that‘AIDS can be transferred in the process of handling food.” Tom Sheridan of AIDS Action, representing 500 community-based service organizations, predicted that the Chapman amendment would go down to defeat in the House-Senate conference committee. “It’s a horrible amendment for all people with disabilities because . . . it begins to codify the fact that irrational fear is protected by the law,” he said. Nonetheless at press time Senate conferees had agreed to include the restrictions. “Cheers and tears” filled the House gallery at the moment of the ADA's long-awaited passage, according to Tennessee disabled activist Michael Gibson, “but we all know that the bill is only a first step. Several agencies will be writing key regulations which offer innumerable opportunities to weaken the effect of this legislation,” Gibson said. SOME DELAYS, FEW LOSSES While many activists feared the House would water down the Senate version of the bill, Marilyn Golden of the Disability Rights Education and Defense Fund said that the ADA “has not been weakened anywhere near the extent that much legislation is. " According to Golden, who has worked intensively for the bill's passage over the last two years, various timetables and phase-in provisions were adopted to avoid other forms of compromise. The ADA’s protections against employment discrimination, which parallel those applied to federally funded entities since 1973, do not go into effect for two years. Prohibitions against discrimination in public accommodations, such as theaters and restaurants, will require accessibility in facilities “construct[ed] . . . for first occupancy no later than 30 months after the date of enactment." Telephone companies will have three years to put in place a relay service for deaf people and others who depend on non-voice telecommunication. A requirement that all new public buses be lift-equipped will take effect in only 30 days. Many attribute this to seven years of non-violent civil disobedience by the American Disabled for Accessible Public Transit. Greyhound, a private carrier, was given six years to begin replacing its retired buses with accessible ones. Activists also waged a last-minute battle over employment discrimination remedies. Recently proposed legislation would add damages to the relief available to discrimination victims under Title VII of the Civil Rights Act of 1964. In the face of this, Golden said. the Bush administration tried “to renege on its agreement for parallelism” between the ADA and the 1964 act. It backed an amendment that would have kept remedies for disability-based discrimination at current levels if and when discrimination remedies are increased for other minority groups and women. The amendment was narrowly defeated just prior to the final vote on the bill itself. Overall, Golden said. “We're ecstatic." The ADA “will hopefully begin to convey to the American public. left, center and right (because in some ways I don't think the consciousness of the left is any better), that disability is not a personal issue, that there’s a systematic oppression of people with disabilities. . . . Breaking Down the Barriers Civil Rights for People with Disabilities by Yaél Hana Bethiem In 1983 I considered killing myself. l considered this out of a deep despair, an agony over my life. In 1983 I had been diagnosed with a progressive disease. I could no longer work, could no longer sit in chairs and could stand for shorter and shorter periods of time. In other words, I was becoming disabled. I was panicked. How could I live without my physical life, my strength, my independence? What I didn't see at the time was that I was buying into our culture's attitudes about disability. I could not value myself or value my life because the system I had to fight to get my basic needs met, did not value me; l live in a culture that believes that "out of sight, out of mind" is acceptable policy for dealing with people with disabilities. In a culture that values productivity above all else, those who cannot produce, or who need assistance to be able to produce, are considered a burden. Our culture also has a myth called the “American way," which says that if anyone "tries hard enough" he or she can “make it." When applied to people with disabilities this means that if only we “try harder" we can "overcome." We can rise above the barriers, showing superhuman strength, and then we will be more acceptable. This attitude makes people believe the barriers do not need tn be removed. Instead, they think we, the disabled, need to overcome them. In other words, the closer we cart be to “normal," the more we are accepted. Those who cannot become more normal are locked away, out of sight, out of mind. Those of us living within this oppression, for it is oppression, often internalize the culture's attitudes. We believe there is something wrong with us. Millions of people share this fate with me; we are locked away by a society that would prefer to pretend we do not exist. We are imprisoned by attitudes that do not see people with disabilities as fully human; attitudes that expect us to "overcome" (or heal ourselves); attitudes that create barriers, or do not see the barriers that do exist. There are 43 million people with disabilities in the United States. We are one of the most repressed minorities in this country. We are denied access to basic rights, transportation, jobs, and respect. For people with disabilities there are thousands of ways the oppression affects us, thousands of forms of prejudice and visible and invisible barriers. An example of the effects of this oppression is the story of David Rivlin. David was a quadriplegic who, last summer, chose to have his respirator turned off. He went to court to ask for the right to die. His story was aired on TV. I heard people around me say, “l would do that too. I wouldn't want to live like that." David lived in a nursing home. He lay in bed twenty-four hours a day tied to a stable respirator. David didn't have to live this way. He could have had a portable respirator and thus been able to use a wheelchair. He didn't know about a portable respirator and no one ever told him. The government was paying $2300 day to keep David in a nursing home, but would pay only $207 a month for an attendant so David could live independently. The day before David died, a reporter covering David's story discovered that money could have been gotten for David to live independently if someone had known how lo “work the system." David's struggle reflects the struggle of people with disabilities in this country. If David, and other people with disabilities were given their right to make choices in their lives all along, there would be no necessity of fighting for the right to die. The Americans With Disabilities Act There is a growing awareness of the need for change in policy and attitude toward people with disabilities. Last year a bill was introduced in Congress called the Americans With Disabilities Act (ADA). The ADA would begin to guarantee civil rights for people with disabilities. Although it has already been modified since its inception, the ADA, as it now stands, would be a beginning to removing barriers that prevent people with disabilities from participating in society. Unfortunately, the ADA is facing serious compromise due to powerful lobbies against it. It is also facing changes that would remove its power as a civil rights act. Last summer, the ADA was passed almost unanimously by the Senate. It was endorsed by President Bush. It then moved into the House of Representatives, where it is now stalled. The most powerful lobbies against the bill are Greyhound and the National Federation of Independent Businesses along with the Chambers of Commerce. Greyhound is against the ADA because they will have to equip new buses with wheelchair lifts. They claim it will cost them millions of dollars, yet they are adding in costs that have nothing to do with the Americans With Disabilities Act. While using erroneous concepts for the cost figures, Greyhound is pouring money into Washington to fight the bill. The National Federation of Independent Businesses also base their antagonism to the ADA on erroneous concepts. The NFIB is saying the ADA will cause hardship for businesses. The ADA requires that public facilities constructed after the ADA becomes law be accessible. Existing facilities have to be accessible within two years of enactment if the access is "readily achievable without much difficulty or expense." In other words. businesses can decide for themselves whether they can afford to provide access. On March 10, American Disabled for Accessible Public Transportation (ADAPT) held a march on Washington to promote awareness of the Americans With Disabilities Act. Over 1,000 people with disabilities came from all over the country. They marched from the White House to the steps of the Capitol. The rest of the week was filled with talks with key figures and demonstrations. Many people participated in planned civil disobedience aimed at calling attention to the current injustice. Because the ADA is civil rights legislation, it ties in with the Civil Rights Act of 1964. New legislation has just been introduced that would create real remedies for violations of the Civil Rights Act. Because the ADA is tied to the Civil Rights Act these remedies would also apply to violations of the ADA. Opponents of ADA want to separate the ADA from the Civil Rights Act. For people with disabilities this would be a compromise that essentially negates the purpose of the ADA. People with disabilities deserve to be treated fairly and humanely, which at this point we are not. It is time to remove the barriers, especially the barriers of mind. It is time to break down the walls that have kept people with disabilities imprisoned. The Americans With Disabilities Act is a very important step. Please write to Hon. Fort Worth Star Telegram / Sunday March 26, 1989 [Headline] Disabled evicted by guards [Subheading] Fort Worth protest at courthouse ends BY Whitt Canning, Fort Worth Star Telegram Bob, Joe, Frank, Tim and Frazier spent a quiet evening Friday on the ninth floor of the Federal Building nodding off occasionally between friendly chats with the guards. Having arrived earlier in the day to take part in a protest by a group of disabled people against the Urban Mass Transit Administration, they hadn't really planned on staying the night. Things just sort of worked out that way. Their strange vigil ended abruptly about 1:15 p.m. yesterday when they were evicted by Federal Protection Service officers, who explained that it was being done for their own good. “They physically picked us up and carried us out," said Bob Kafka, admiring a skinned place on his right forearm that was bleeding slighty. “At least," said Joe Carle, “it was reassuring being in the hands of the kinder, gentler Bush administration." Kafka, 43, Carle, 50, Frank Lozano, 38, and Tim Baker, 26, are members of a group called American Disabled for Accessible Public Transportation that staged a nationwide protest Friday in an effort to dissuade the administration from appealing a recent decision in the 3rd Circuit Court of Appeals (ADAPT vs. Burnley). The decision requires wheelchair lifts on buses purchased with federal money. The Fort Worth protest involved 20 to 30 people, but Kafka, Carle, Lozano and Baker managed to reach the ninth-floor office of the administration's regional manager, Wilbur Hare. There, they requested he telephone White House chief of staff John Sununu and voice his support for the court decision. Joining the small group in its audience with Hare was Frazier, an amiable pooch who serves the visually impaired Lozano as a guide dog. Hare refused the request, and went home at 4:45 p.m., leaving the intrepid little band stuck on the ninth floor, vowing to stay through Easter weekend. “We were in the outer office, and he (Hare) came out once about 3:30 and told us he was leaving at his normal time," Carle said. "Then at 4:45, he came out, shook our hands, wished us happy Easter, and left. "We wished him happy Easter too." So the group was left occupying the building, along with several guards. At 6 p.m., Casey Bowen, director of building operations with the General Services Administration, told them they would not be forcibly removed, but he would not allow food to be brought in. As an added precaution, Kafka said, all the phones were removed. “I don't mean just in Hare‘s office," Kafka said. "lt looked to me like they removed every phone on the ninth floor. They didn‘t just disconnect them. They TOOK the phones off.“ The group settled in for the night. "Mostly, we tried to sleep as best we could, sitting in our chairs (Kafka, Carle and Baker use wheelchairs)" Kafka said. "I got the couch, since l'm the oldest," Carle said. “Frank slept on the floor because he doesn't have a wheelchair.“ "There are some vending machines up there," Kafka said, "and we ate some candy bars and drank some cokes that was about it. "The guards were very nice to us -- until today, when they evicted us." [Subheading] PROTEST About 6:30 a.m. yesterday, Kafka said, they asked the guards if they could send out for food and were refused. About 11 a.m. the group's attorney, Paul Alexander, arrived with the same request and also was refused. Then about l p.m., the group made another request — that Hare appear at a 6 p.m. news conference and agree to make the call to Washington tomorrow. ln return, they would end their occupation of the building. "That's when they evicted us," Kafka said. “They said they were acting on Bowen's orders and it was for our own good because we hadn't had anything to eat. “They picked me up out of my chair, because l wasn't going to leave, and carried me. That's how I got skinned up." “They had a little trouble getting Frank into a wheelchair," Carle said. “But Frazier went quietly when ordered to leave." Baker, who is severely disabled, did not fare so well, group members said. “When they were pushing him out in his chair, they didn't know how to operate it, and they tore up the motor and the clutch,“ Kafka said. “They did about $1,000 worth of damage to it." Guards at the building refused to comment. Hare did not show up at the news conference. And the I3 activists held up the starting time of 6 p.m. to wait for additional supporters who did not arrive. “We came here to fight for transportation, but we couldn't get the troops over to fight for them," Carle said, adding that none of the disabled could ride the bus downtown so only those who could afford a car could come. Kafka said that the group will examine legal recourse for injuries and damages incurred while being evicted. However, the group's lawyer, Paul Alexander, had advised the four that they might not have legal grounds because they were on federal property, Carle said. As to whether the demonstrators felt they had accomplished anything by the protest, Carle said, “We hope that somewhere along the line this wakes up the able-bodied community" and shows members of the disabled community that “they don't have to knuckle under." He said the group's impromptu occupation of Hare's office had probably amazed them as much as anyone else. “When we got here (with the other protesters), I was telling Bob that Mr. Hare was a pretty nice guy and would probably make the phone call fairly quickly," Carle said. “We were trying to figure out what we were going to do with the rest of the afternoon.“ Carle said other protests are planned soon, including one against Greyhound Corp. on Monday in Dallas. Greyhound, he said, has indicated it does not wish to adapt its buses to the handicapped. “I think this was an abomination," Kafka said. “As a Vietnam veteran, l am embarrassed for my country. But it's just another example of how the govrnment views the disabled. They don't want us to be people — they want us to sit down and shut up, or be put away in institutions. “I think a lot of people have a fear of the disabled." “They're trying to put us back where we've been for ... eternity," Carle said. "Instead of doing this, they should help us with job training so we can carry our own weight. “It's the only way we will ever become . . . people." The occupying force at least had a clear view of its immediate objective once it was back out on the street: friends who arrived to help were immediately dispatched to find food (“double burgers, chicken, and big milkshakes"). When the food gathering force hurried off, Carle offered one last observation on the situation. "Frazier," he confided. “is extremely upset about all this. “He says they treated him like a dog." [Headline] Disabled demand better access BY Bob GWIZDZ Fort Worth StarTelegram Four people lobbying for better access to public transportation for disabled people refused to leave the Federal Building in downtown Fort Worth last night, promising to stay until Monday. Members of the American Disabled for Accessible Public Transportation earlier in the day had demanded that a local Department of Transportation official call the White House in support of their cause. Similar actions were planned in other cities today. “We plan to stay through Easter and welcome Wilbur Hare Monday morning.“ said Bob Kafka, a community organizer with the group. “On Monday we'll decide where we go from there.“ Hare, regional manager of the Urban Mass Transportation Administration, refused the group's request that he call White House chief of staff John Sununu in support of a recent federal appeals court decision requiring wheelchair lifts on all new public buses purchased with federal money. Group members say they think the Department of Transportation will appeal the decision. ln Philadelphia, eight people were escorted from a federal building that contains the regional transportation administration office when the building closed at 5 p.m. Sieglinde Shapiro, who headed the delegation of disabled people, said she read a statement to the official in charge. The statement noted that similar meeting had been scheduled with regional directors in New York, Boston, Atlanta, Chicago, Dallas, Denver, Seattle, Washington, San Francisco, Los Angeles, Phoenix, Ariz., and Salt Lake City, she said. The Associated Press office in Dallas said it had no reports of meetings with federal officials there. The Fort Worth office of the transportation department serves the Metroplex. Shapiro said “our sources in Washington tell us that the U.S. Department of Transportation is poised to appeal” the Feb. 13 decision by the 3rd U.S. Circuit Court of Appeals. The ruling requires that every bus newly purchased with federal assistance be wheelchair accessible, and that those unable use buses be provided with adequate transportation. The Fort Worth protest began when between 20 and 30 demonstrators, many in wheelchairs, arrived at the Federal Building around 1 p.m. after assembling at nearby Burnett Park. Hare, who said he received word Wednesday that a protest was planned, asked the protesters to meet with him downstairs at the Federal Building. The demonstrators refused. “That’s how you treat the disabled separate,” Kafka said to Hare. “We want to see you on the ninth floor, in your office, like everybody else. It’s the same thing as transportation — we want access like everybody else.” After a few protesters entered the building, Federal Protective Service officers locked the doors, forcing more than half of the demonstrators to remain outside. Hare said his office would not accommodate all the protesters. He declined to say who ordered the officers to lock the doors. About 10 protesters met with Hare in his office. “I’m not calling Mr. Sununu, but if you have a message for him, I’ll do my best to get it delivered,” Hare said. “lf you’d like to make a call, then go where you conduct your business and make the call. I’m sure you’ve made your views known to (President) Bush and if you haven’t, there are better ways to do it than tying up this office all afternoon.” Hare did call the Washington headquarters of the transportation administration and said he relayed the protesters’ message to officials there. When Hare left at 4:45 p.m., his normal quitting time, four protesters decided to remain. “We weren’t anticipating Mr. Hare being so obstinate,” Kafka said. “We expected a quick reaction and a phone call. It just shows their real arrogance toward disabled people.” At 6 p.m., Casey Bowen, director of building operations with the General Services Administration, told the protesters that he would prefer they leave, but that he had no intention of forcibly removing them. But Bowen said he would not allow them to have food sent in, and he had the telephones removed from the office. “Quite frankly, our intent is not to encourage this sort of protest,” Bowen said. Reporters could not contact the protesters later in the evening and building guards declined to comment. The protesters, who had no provisions other than a couple of granola bars and soft drinks, have access to the building's snack and soft drink machines. Besides Kafka, 43, of Austin, the protesters who remained in the building last night were Joe Carle, 50, and Frank Lozano, 39, both of Dallas, and Tim Baker, 26, of Austin. Kafka has used a wheelchair since he suffered a broken neck in an auto accident 10 years ago. Carle suffers from a circulation disorder, has had part of one leg amputated and has used a wheelchair for nine years. Lozano is blind, the result of an auto accident five years ago. Baker suffers from severe cerebral palsy. Paul Alexander, a Fort Worth lawyer who uses a wheelchair, arrived late in the afternoon to try to negotiate a settlement. When it became apparent that the protesters were determined to stay, Alexander tried to arrange for permission for food delivery. Alexander said arrangements could not be made. “Us being locked up all weekend symbolizes the thousands of disabled people who are locked up in their homes," Carle said. “Will it do any good? [Headline] Protest by disabled clogs downtown L.B. PRESS-TELEGRAM (AM/PM)/THURSDAY, Oct. 10, 1985, p. A10 FROM/A1 batch of arrests in the 200 block of Pine. At that point, protest leader Rev. Wade Blank, of Denver, told police there would be no further disruptions. Blank thanked the police for the way the department had handled the demonstration and said the remaining protesters were tired and hungry. During the afternoon, police Lt. Norm Benson conferred at length with protest leaders, pointing out that, despite whatever police sympathies there might be for the cause, the event took patrolmen off their rounds and posed an impediment to emergency vehicles. Benson even made a call to the Bonaventure Hotel in downtown Los Angeles, where the American Public Transit Association is holding a convention, in an attempt to reach Laurence Jackson, general manager and president of Long Beach Transit and new president of the APTA, to urge him to speak by phone with an ADAPT spokesperson. Guy Heston, the bus company’s director of marketing, interviewed at the scene of the bus tie-ups, said the request to talk with Jackson was untenable because "they came unannounced, and, as you know, he has commitments at the convention." An ADAPT spokesman, Jim Parker of El Paso, told a reporter as he was being steered toward a Dial-a-Lift van for the trip to the Long Beach jail, "This is probably going to be the largest mass arrest of disabled people in the history of this country." He stressed that the targets of Wednesday's demonstration and one Monday in the office of Rep. Glenn Anderson, D-Long Beach, were the APTA, which closes its four-day convention today in Los Angeles, and Anderson, as chairman of the House subcommittee on surface transportation. "One very important thing for the people of Long Beach, Los Angeles County and California to understand," Parker said, "is that this is not aimed at them, because California and cities like Long Beach and Los Angeles are really models for the country to look at. "Most of the buses have lifts on them, and all new buses purchased will have lifts. "I guess, for the first time, disabled people have come to the city where the president of APTA resides . . . to help pull the federal government back into the issue again, along with APTA." ADAPT asserts that it was a legal action by APTA, followed by an administrative order in early months of the first Reagan administration, that killed a law mandating phased in accessibility for the disabled to public transit across the country. The order left the decision up to local option. Jackson could not be reached for comment Wednesday, but Long Beach Transit Assistant General Manager Patrick Butters said that nine of 18 fixed routes in Long Beach are wheelchair accessible, while 85 percent of all the company's public buses in the city are equipped with wheelchair lifts. "On an ongoing basis we’ve been increasing that" percentage, said Butters. A committee on the handicapped advises Long Beach Transit on which bus routes to offer lift service on, said Butters. "We’ve tried to hit the routes that are most heavily traveled," he said. An average of 12 to 14 persons a day who are confined to wheelchairs ride on fixed Long Beach Transit routes, said Butters. In addition to regular bus service, Dial-a-Lift service is available in Long Beach, Lakewood and Signal Hill, he added. At the height of the protest, Frank Lozano and Martin Walton took a stand in front of an RTD bus that had eight Long Beach Transit buses backed up behind it at Pine and Broadway. The passengers of those idled buses, workers and schoolchildren heading for home, were not happy with the delay. "Hey, I just want to go home; take a shower, eat some supper and watch the ball game," said one man. But Lozano, who is blind, and Walton, confined to a wheelchair, held their ground. "No, it doesn't surprise me,” Lozano said of the anger from the riders. "I realize that there are many people who are unaware of the issues." California is one of two states – Michigan is the other — that mandate that all new public transit buses be equipped with wheelchair lifts. The demonstrators said they were aware of this but believe that Jackson and APTA can pressure the other 48 states into enacting similar legislation. Kelli Bates, 21, of Denver, the only woman arrested, was the only ADAPT member to plead no contest to a disorderly conduct charge against her. Albanese found her guilty and sentenced her to 30 days in jail if she has not left the city by Friday or enters the city before Friday. Lonnie Smith, 30, of Denver, charged with resisting arrest and disorderly conduct, pleaded not guilty. Albanese set a $2500 10-percent bond for the resisting charge and a $1500 10-percent bond for the disorderly conduct charge. Those pleading not guilty to charges of disorderly conduct and placed on a $1500 10 percent cash bond were Ernest Taylor, 31, of Hartford, Conn.; William Bolte, 54, of Los Angeles; Glenn Horton, 46, of El Paso, Texas; Joseph Carl, 47, of Denver, and James Parker, 40, of El Paso. Those pleading not guilty to charges of disorderly conduct and given higher bonds because of prior records were Robert Conard, 32, of Denver, on a $2000 10-percent cash bond and George Roberts, 37, of Denver on a $3000 10-percent cash bond. Those pleading not guilty to charges of disorderly conduct and released on a $1500 unsecured bond because of medical problems were Arthur Campbell, 39, of Louisville; Kenneth Heart, 36, of Denver; Efrain Lozano, 35, of El Paso; George Florom, 43, of Colorado Springs, Col; and Rick James, 36, of Salt Lake City. In all cases where bond could be posted, Albanese warned the people not to return to Cincinnati except for court appearances or meetings with their attorneys. The Cincinnati Human Relations Commission is investigating complaints that some handicapped people may have been denied access to the Westin Hotel. Robert Harris, the commission’s community representative for the disabled, said today at least four handicapped persons not connected with ADAPT were at least temporarily denied entrance to the hotel. “The process was geared against people in wheelchairs,” Harris said.

Title: Activists ordered to leave 3 protesters awaiting trial By Edwin: Blackwell, Post staff reporter Three wheelchair-bound activists were ordered by a judge today to get out of town until their trials or face being jailed on disorderly conduct charges. “This is ludicrous and unconstitutional," said Robert Kafka of Austin, Texas, one of the three. "We got on a public bus and so he is throwing us out of town." The order came after a night when 15 other members or American Disabled for Accessible Public Transportation pitted their wheelchairs against the steel frames of buses in a protest over the rights of the handicapped to public transportation. The protesters rolled their wheelchairs into the paths of buses traveling 40 mph on Kings Island Drive in Warren County and carrying conferees of the American Public Transit Association to a reception. No one was injured in the protest, and no one was arrested. Kafka and two other activists, George Cooper of Dallas and Michael Auberger of Denver, were arrested earlier Monday during a demonstration in front of the Westin Hotel, where the transit association conferees are meeting this week, and the U.S. Courthouse. Kafka and Cooper were arrested on trespassing charges after they boarded a Queen City Metro bus that stopped at the boarding plaza in front of the Courthouse. Auberger was arrested for grabbing a wheel of the same bus. They appeared in Hamilton County Municipal Court today and were told by Judge David Albanese to leave Cincinnati today or forfeit their $3000 bonds. A pre-trial hearing was set for June 26. The three contended the order violated their constitutional rights to free speech but said they will abide by it. They are staying in a motel in Newport, Ky. They said they will discuss possible federal civil rights court action with their attorney, Joni Veddern Wilkens of Reading. "I can’t believe it; this is America," Cooper said. “When you invoke law like it was west of the Pecos, before Texas even became a state . .. get out of town by sundown ... it's scary, it's frightening. I feel it's a basic infringement of my freedom to travel as an American citizen." Cooper, a U.S. Air Force Korean Wax veteran, said it was the first time in ADAPT protests in half a dozen cities that any of its members had been ordered out of town. He said it was the first time they had ever faced actual barricades, as they did in front at the Westin Hotel Monday. “I thought I came from the most conservative city in the country, Dallas," Cooper said. "We just can't believe this." During Monday night's protest near the College Football Hall of Fame, Warren County police moved the ADAPT members from in front of the buses but made no arrests. Police had set up barricades by the hall earlier, but that didn't keep the protesters from roiling their wheelchairs onto the roadway. “I remember flashing in my mind that these might be the first deaths of the civil rights movement of the handicapped," said the Rev. Wade Blank of Denver, Colo., co-founder of ADAPT. “Although I trained them, it just told me how serious it is to these people." Members of the Denver based group say their action shows how far they are willing to go. The protesters want the transit officials to change their national policy on accessibility and Queen City Metro to have wheelchair lifts on all new buses. Today ADAPT members continued to demonstrate in front of the Westin Hotel by hanging a wheelchair from a 10-foot-tall wooden cross to signify “the way APTA is crucifying disabled people." Eleven Cincinnati police officers, including Chief Lawrence Whalen, watched but made no arrests as they guarded the hotel atrium and entrance from some protesters chanting “We will ride. Title: Protesters ready for long jail stay Post staff report Comparing Cincinnati to Selma, Ala., in the 1960s, 11 members of a handicapped activist group are vowing to stay in jail to end alleged discrimination against the handicapped. Of 17 disabled protesters arrested Wednesday, 14 were charged with disorderly conduct for blocking the Westin Hotel entrance. Three were charged with criminal trespassing after chaining themselves to the front doors of Queen City Metro’s offices at 6 E. Fourth St., downtown. Scheduled court dates ranged from May 28 through June 2, so some of the protesters could be in jail for as long as 12 days. Demonstrating against lack of access to Queen City Metro buses, members of Americans Disabled tor Accessible Public Transportation have timed protests this week to coincide with an American Public Transit Association conference at the Westin. The five-day conference ended Wednesday night. “This (Cincinnati) is the Selma, Ala., of the disabled civil rights movement,” said the Rev. Wade Blank of Denver, a founder of ADAPT. “People from all over the country have been calling to say they are willing to get arrested. This has not happened in many cities.” Access Service, Queen City's alternative transit system for the elderly and handicapped, is inadequate and overloaded, ADAPT members say. “We are committed and the people who got involved in this knew it would be more than an overnight stay in jail," said Stephanie Thomas, an ADAPT organizer. “We will not post bond for them." The 11 jailed ADAPT members have been separated from the rest of the prison population and have a full-time employee watching over them at the Hamilton County Justice Center, said Victor Carrelli, Hamilton County chief deputy sheriff. Hamilton County Municipal Judge David Albanese held a special two-hour hearing Wednesday for the 17 under judicial orders covering mass arrests or civil disobedience cases. Those charged with crimi nal trespassing were Michael W. Auberger, 32, of Denver, Colo.; George Cooper Jr., 58, of Irving, Texas, and Robert Kafka, 40, of Austin, Texas. Albanese set bond for the three, who pleaded not guilty, at $3000 cash and "banned them from the city if they chose to post bond. They did not. Kelli Bates, 21, of Denver, the only woman arrested, was the only ADAPT member to plead no contest to a disorderly conduct charge against her. Albanese found her guilty and sentenced her to 30 days in jail if she has not left the city by Friday or enters the city before Friday. Lonnie Smith, 30, of Denver, charged with resisting arrest and disorderly conduct, pleaded not guilty. Albanese set a $2500 10-percent bond for the resisting charge and a $1500 10-percent bond for the disorderly conduct charge. Those pleading not guilty to charges of disorderly conduct and placed on a $1500 10 percent cash bond were Ernest Taylor, 31, of Hartford, Conn.; William Bolte, 54, of’ Los Angeles; Glenn Horton, 46, of El Paso, Texas; Joseph Carl, 47, of Denver, and James Parker, 40, of E1 Paso. Those pleading not guilty to charges of disorderly conduct and given higher bonds because of prior records were Robert Conrad, 32, of Denver, on a $2000 10-percent cash bond and George Roberts, 37, of Denver on a $3000 10-percent cash bond. Those pleading not guilty to charges of disorderly conduct and released on a $1500 unsecured bond because of medical problems were Arthur Campbell, 39," of Louisville; Kenneth Heart, 36, of Denver; Efrain Lozazno, 35, of El Paso; George Florom, 43, of Colorado Springs, Col; and Rick James, 36, of Salt Lake City. In all cases where bond could be posted, Albanese warned the people not to return to Cincinnati except for court appearances or meetings with their attorneys. Prosecutor Charles A. Rubenstein in many of the cases protested Albanese’s decision to allow the prisoners to be released on bonds. “There is a great likelihood if they are released on bond they would create "further problems and turn this court into a revolving door,” he said. However, James Nicholas of the public defenders office, who was appointed to aid the group's privately hired legal counsel, said "the group would cause no further problems. “The reason that they came, here is finished. They have no reason to remain." After the hearings were finished, Nicholas said most members of the group had vowed to remain in jail.

Gazette-Telegraph 5/21/86 Wheelchair-bound protesters arrested CINCINNATI (AP) — Police arrested at least 17 chanting, wheelchair-bound protesters who blocked a hotel entrance or chained themselves together in a doorway at the Cincinnati transit agency’s building Wednesday. Police said those arrested included George Florom of Colorado Springs; Joe Corle of Denver, Ernest Taylor and George Roberts of Hartford, Conn.; Rick James of Salt Lake City; and Glenn Horton, Jim Parker and Frank Lazano, all from El Paso, Texas. It was the third consecutive day of protests by a nationwide group called American Disabled for Accessible Public Transportation (ADAPT), which has staged similar protests elsewhere to demand equal access to public transit. Police said the 17 protesters who had been arrested were charged with disorderly conduct. They were taken in vans to the Hamilton County Justice Center, where they refused to post bonds.
