Title: Protesters ready for long jail stay Post staff report Comparing Cincinnati to Selma, Ala., in the 1960s, 11 members of a handicapped activist group are vowing to stay in jail to end alleged discrimination against the handicapped. Of 17 disabled protesters arrested Wednesday, 14 were charged with disorderly conduct for blocking the Westin Hotel entrance. Three were charged with criminal trespassing after chaining themselves to the front doors of Queen City Metro’s offices at 6 E. Fourth St., downtown. Scheduled court dates ranged from May 28 through June 2, so some of the protesters could be in jail for as long as 12 days. Demonstrating against lack of access to Queen City Metro buses, members of Americans Disabled tor Accessible Public Transportation have timed protests this week to coincide with an American Public Transit Association conference at the Westin. The five-day conference ended Wednesday night. “This (Cincinnati) is the Selma, Ala., of the disabled civil rights movement,” said the Rev. Wade Blank of Denver, a founder of ADAPT. “People from all over the country have been calling to say they are willing to get arrested. This has not happened in many cities.” Access Service, Queen City's alternative transit system for the elderly and handicapped, is inadequate and overloaded, ADAPT members say. “We are committed and the people who got involved in this knew it would be more than an overnight stay in jail," said Stephanie Thomas, an ADAPT organizer. “We will not post bond for them." The 11 jailed ADAPT members have been separated from the rest of the prison population and have a full-time employee watching over them at the Hamilton County Justice Center, said Victor Carrelli, Hamilton County chief deputy sheriff. Hamilton County Municipal Judge David Albanese held a special two-hour hearing Wednesday for the 17 under judicial orders covering mass arrests or civil disobedience cases. Those charged with crimi nal trespassing were Michael W. Auberger, 32, of Denver, Colo.; George Cooper Jr., 58, of Irving, Texas, and Robert Kafka, 40, of Austin, Texas. Albanese set bond for the three, who pleaded not guilty, at $3000 cash and "banned them from the city if they chose to post bond. They did not. Kelli Bates, 21, of Denver, the only woman arrested, was the only ADAPT member to plead no contest to a disorderly conduct charge against her. Albanese found her guilty and sentenced her to 30 days in jail if she has not left the city by Friday or enters the city before Friday. Lonnie Smith, 30, of Denver, charged with resisting arrest and disorderly conduct, pleaded not guilty. Albanese set a $2500 10-percent bond for the resisting charge and a $1500 10-percent bond for the disorderly conduct charge. Those pleading not guilty to charges of disorderly conduct and placed on a $1500 10 percent cash bond were Ernest Taylor, 31, of Hartford, Conn.; William Bolte, 54, of’ Los Angeles; Glenn Horton, 46, of El Paso, Texas; Joseph Carl, 47, of Denver, and James Parker, 40, of E1 Paso. Those pleading not guilty to charges of disorderly conduct and given higher bonds because of prior records were Robert Conrad, 32, of Denver, on a $2000 10-percent cash bond and George Roberts, 37, of Denver on a $3000 10-percent cash bond. Those pleading not guilty to charges of disorderly conduct and released on a $1500 unsecured bond because of medical problems were Arthur Campbell, 39," of Louisville; Kenneth Heart, 36, of Denver; Efrain Lozazno, 35, of El Paso; George Florom, 43, of Colorado Springs, Col; and Rick James, 36, of Salt Lake City. In all cases where bond could be posted, Albanese warned the people not to return to Cincinnati except for court appearances or meetings with their attorneys. Prosecutor Charles A. Rubenstein in many of the cases protested Albanese’s decision to allow the prisoners to be released on bonds. “There is a great likelihood if they are released on bond they would create "further problems and turn this court into a revolving door,” he said. However, James Nicholas of the public defenders office, who was appointed to aid the group's privately hired legal counsel, said "the group would cause no further problems. “The reason that they came, here is finished. They have no reason to remain." After the hearings were finished, Nicholas said most members of the group had vowed to remain in jail.

O'Connor OF THE EXAMINER STAFF The Hall of Justice resounded with victory whoops and the whirl of motorized wheelchairs as 43 'handicapped activists arrested for blockading the Powell Street cable car line got their day in court. Protesters used their arraignment Wednesday before Municipal Court Judge Philip Moscone as a platform for a new attack against the American Public Transit Association, which they say has not done enough to provide the handicapped with access to public transit. Moscone allowed designated speakers to address the court after each group of blockaders entered no contest pleas to charges of obstructing a public thoroughfare. The $50 fine the charge carried was dropped as Moscone credited the night the 43 demonstrator spent in jail as "time served." A second charge of failing to disperse was dropped "in the interest of justice," according to Deputy District Attorney Randall Knox. Jane Jackson, who spoke on behalf the first group of 14 wheelchair-bound demonstrators arraigned Wednesday, seized the opportunity to charge APTA with denying handicapped citizens of their civil rights. "It is for this reason that we believe Jack Gilstrap (APTA executive Ace president) should be asked to resign or should be forced to resign," Jackson said. "APTA is not acting in good faith." More than 15,000 public transit officials from around North America attended the four-day convention. Officials of the transit group have said they feel the access question should be handled on a local level. Jackson also said the coalition of handicapped-rights groups, which captured national media attention with four days of protests and blockades across the city, was pulling out of a scheduled meeting with APTA officials Thursday. "It's the only move left open to us," Jackson said later while members of the September Alliance for Accessible Transit and American Disabled for Accessible Public Transportation cheered her and the other blockaders as they exited the courtroom. About 75 wheelchair-bound protesters lined the hallway outside the courtroom, chanting and clapping in approval and support as each group of blockaders were arraigned and allowed to leave. "They're our heroes," said Connie Arnold of San Rafael. "They're standing up for us." During the arraignments, police, sheriff's and emergency medical personnel stood by as defendants were wheeled in or entered the courtroom under their own power. Jennifer Keelan, a 6-year-old girl from Tempe, Ariz., whose bouncy enthusiasm and apparent unconcern over her handicap captivated the press and boosted the resolve of protesters, was wheeled in by a sheriff's deputy and sat writing her name over and over again in a small notebook. Unlike the group's earlier demonstrations, Wednesday's action was peaceful and there were no arrests. Protesters had staged noisy and sometimes violent demonstrations outside the APIA convention at Moscone Center Monday and on the steps of City Hall Sunday night. Handicapped-rights group organizers said Wednesday was their last day in The City as the APTA convention at Moscone Center ended a four-day conference and transit officials left town. Twenty protesters were arrested, 10 in a demonstration atop Mount Royal and 10 who chained themselves to the doors of the under-parking garage at Place Ville Marie, across the street from the Queen Elizabeth Hotel, where the American Public Transit Association — the protesters' target — is holding its convention. Most of the demonstrators were members of ADAPT — American Disabled for Accessible Public Transit. In the demonstration on the mountain, 35 protesters tied up 100 specially trained police for about four hours yesterday afternoon. [Subheading] Refusing to clear road Ten were arrested after refusing to clear the road leading to the Mount Royal chalet, where the transit association had organized a lunch. After pleading guilty in municipal court last night to charges of mischief and obstructing police, five demonstrators paid fines of $50 while five others refused, to pay and were sent to jail for three days. A mother and her 12-year-old daughter were released after the Place Ville Marie protest. The eight other activist pleaded guilty to charges of mischief and obstructing police. All eight chose to go to jail for three days rather than pay $50 fines. [Subheading] Placed on probation All those who pleaded guilty yesterday were placed on probation until the convention ends Thursday. Judge Louis Jacques Leger barred them from the island of Montreal and from demonstrating and banned them from the mountain and from a wide downtown area around the Queen Elizabeth Hotel. Police said last night that of the 48 activists arrested yesterday and Sunday, only one was a Quebecer. Protest organizer Rev. Wade Blank of Colorado told Leger. "I am personally grieved and saddened that this court has chosen to punish people who have already been greatly punished by society." Const. Normand Tremblay said the Montreal Urban Community police were out in full force yesterday to prevent the wheelchair protesters from repeating the disturbance they had caused Sunday, when they chained themselves to railings at the Sheraton Centre hotel and blocked traffic on Dorchester Blvd. for nearly two hours. Twenty-eight of the handicapped activists were arrested Sunday. After pleading guilty to mischief charges, five paid $25 fines and were released, while 23 others opted to serve three-day jail terms at Bordeaux and Tanguay jails. "We are joining our friends in jail and it's worth it," said Lillibeth Novaro, one of those arrested on the mountain yesterday, as a policeman wheeled her to a school bus hired to take the protesters to police headquarters and municipal court. "There are millions of people in wheelchairs who need to take the bus to go to work and be equal members of society," she said. Novaro ended up paying her $50 fine and didn't go to jail. 'We want equal access' "We pay taxes like everybody else and we want equal access to mass transit," said Molly Blank, who drove four days from Colorado with her husband and 18-year-old handicapped daughter to join the protest. Police blocked roads leading to the chalet and the lookout atop the mountain with barricades and patrol cars to prevent the protesters from confronting the luncheon guests. The police force's tactical squad had been tracking the demonstrators' movements since morning. Urgences Sante doctors were on hand to verify that none of the protesters had been injured during the arrests. "We know these people are here to cause problems and we are here to prevent that," Tremblay told reporters as a helicopter the MUC had rented for the day from provincial police hovered overhead. "We are allowing them to protest and express themselves, but we cannot allow them to make trouble. And we want to take all the necessary precautions to ensure that nobody is injured”. The special police team assembled to deal with the protesters took a day-long course last week to learn how to "handle" the handicapped — from identifying disabilities and deactivating wheelchairs to carrying the disabled without injuring them. Tremblay said police consulted their counterparts in six U.S. cities where the group has staged previous demonstrations. Phyllis Young, a transit official from Duluth, Minn., who attended the luncheon on Mount Royal, said the wheelchair protesters have been turning up at public transit conventions for the past five years. "This is nothing. In San Francisco they chained themselves to trolleys and ran over one policeman in their wheelchairs and gave him a concussion," Young said. "Another year they all laid down on the street and blocked traffic for a whole day." Tremblay said police could not stop the protesters from coming to Montreal because they have no criminal record — the only laws they had broken are municipal bylaws. Instead, MUC police smiled and chatted as they wheeled the protesters away. But some had donned kneepads under their uniforms in case the protesters became aggressive. Maria Barila, a Montrealer arrested on the mountain, said officials at the Office des personnes handicapes du Quebec — the government agency that oversees services to the disabled — discouraged local disabled people from turning out at the demonstrations. "Some people were told they could lose their welfare cheques," said Barila. "Others were told that things could get violent." Francois Gagnon, also of Montreal, said specialized buses for the handicapped provided by the Montreal Urban Community Transit Corp. are "a joke." He said the disabled would prefer to ride the same buses and Metros as everyone else. “They call It door-to-door service, but sometimes it takes two hours for a disabled person to get from home to work in those mini-vans they provide," said Gagnon, winding his way up the mountain in his wheelchair. Meanwhile, Murielle Lariviere-Lebret, president of the Adapted Transport Users Association, said her group morally supports ADAPT protesters demanding accessible transport for all. But her group, which speaks on transit for 18 associations of the handicapped here, would not join demonstrations or urge members to do so. Instead, it prefers to concentrate on getting more and better minibuses and taxis to serve handicapped commuters in the MUC. Over the longer term, it favors adapting the regular bus and Metro service so it is accessible to the handicapped. [Subheading] Position denounced This position was denounced by Jean-Francois Gagnon, a member of the Quebec Association of Handicapped Consumers, who said the handicapped had to become more radical to get what they want from the MUC and Quebec. But MUCTC managing director Louise Roy said the transit corporation has no intention of adapting buses or Metro stations to accommodate the handicapped. "Our intention was never to make the Metro system completely accessible she said. "We are working on improving our adapted door-to-door service, and I think that's much more realistic." Adding wheelchair-lift platforms on regular buses would cost $15,000 per bus, which Roy said is too expensive. Instead, the MUCTC will spend $16,000 on improving adapted transit services next year. "Each year our ridership on adapted transit increases by 30 per cent. Last year we served 500,000 people," she said. Service is offered through adapted mini-buses and taxis. Riders pay the same price they would to ride a bus and the rest of the cost is absorbed by the MUCTC, Roy said.

St. Louis Post Dispatch, 5/13/88 Activists Derail Transit Group’s Welcoming Plans By Mark Schlinkmann, Regional Political Correspondent Officials have moved the site of a convention's welcoming ceremony Sunday night away from the Gateway Arch visitors' center because of fears of a protest by disabled-rights activists. Organizers of a transit officials' convention have moved the reception site to the Omni Hotel, the site of the convention. Better security can be provided at the hotel, a spokesman for the Bi-State Development Agency, Thomas Sturgess, said Thursday. Because most other activities connected with the five-day convention will be at the hotel, Sturgess said, "The participants already will be there." More than 600 people from across the country are expected to attend the convention, a regional conference of the American Public Transit Association. As many as 150 others affiliated with Americans Disabled for Accessible Public Transportation — known as ADAPT — are expected to be here to protest the organization's stand on wheelchair lifts for buses. Police say the protest group, including many in wheelchairs themselves, has a reputation for seeking arrest to dramatize their cause. Tactics in other cities have included blocking roadways and chaining themselves to buses, Bi-State officials have said. ADAPT wants the Transit Association to endorse 100 percent accessibility to buses and other public transportation for the disabled through the installation of wheelchair lifts by all its member systems. Disabled people should have the right to as much access to taxpayer-financed transportation as able-bodied people enjoy, ADAPT officials argue. "Our demand is that the association change its policy," said the Rev. Wade Blank of Denver, an ADAPT founder. The association "will not have their parties anywhere in the United States without people in wheelchairs making them inaccessible." Transit association officials respond by saying that although they support access for the disabled, wheelchair lifts are not the only way to provide it. Jack R. Gilstrap, executive vice-president of the Transit Association, said Thursday that about a third of the nation's transit systems use lifts on buses; a third have begun using vans to provide door-to-door service for disabled persons; and a third use a combination. The vans have a higher rate of use than wheelchair lifts on standard buses and so are less costly, he said. "We believe the local community ought to be deciding how this will be provided," Gilstrap said. "There really are some serious business and tax-payer considerations." ADAPT complains that "paratransit vans, which usually must be reserved in advance, segregate the disabled from the general public. "It's very similar to apartheid," Blank said. In St Louis, the Bi-State transit system is using a combination — developed in conjunction with a local committee of disabled persons. Almost 120 new standard buses equipped with wheelchair lifts are being purchased between now and early 1989. In addition, the system's "Call-A-Ride" van service for disabled people — now limited to parts of St. Louis County — will be expanded to cover all of St. Louis and St. Louis County in November. At that time, Bi-State also will begin issuing scrip that can be used by disabled persons to take taxis in certain circumstances. ADAPT officials have said the organization is satisfied with Bi-State's plans. But they have complained that Bi-State is allowing two of its buses to be used as paddy-wagons on call in the case of any arrests at the demonstrations.

SMITH BY JEFF SMITH Title: ROLL MODELS Civil disobedience tends to be a cyclical form of political expression. It only comes into flower every few years, even decades, and during the intermissions of its popularity, the great masses in the political middle tend to forget what an important tool it is. Indeed, civil disobedience is the only legitimate means of effecting change on behalf of minority needs. Mull it over: • A minority with a valid and pressing need to see some public policy created or changed has the option of going to the polls along with everyone else . . . and losing. because it is, after all, a minority. Or: • Its members could arm themselves and turn their minority cause into a guerilla war, which the majority would agree is hardly a legitimate solution. Or: • They could employ the classic, nonviolent, Gandhian stratagem of civil disobedience. Bingo. Which is why I endorse the protest staged recently by American Disabled for Accessible Public Transportation (ADAPT). About 200 members of the Denver-based group, most of them in their primary means of transportation — wheelchairs— came here and raised hell a couple of weeks ago with the national convention of the American Public Transportation Association. It was a classic sit-in. Gimps are good at that. But it's been quite a while—a peaceful, soporific, almost brain-dead while—since the civil-rights movement and the Vietnam War era, when sit-ins, protest marches and similar styles of civil disobedience were at all common. And six years of Reagan, four of Carter and three of Ford have turned many of us into conservatives like Phoenix City Councilman Howard Adams, who sympathize the problems of certain minorities, but object to the only tactic they really can use to solve those problems. Adams doesn't think cripples ought to be blocking restaurant and hotel entrances, impeding the comings and goings of conventioneers and blockading buses in order to make their point that most public transit is inaccessible to people in wheelchairs and those rendered nearly immobile by the need for canes and crutches. Adams is not an unsympathetic man: He has both sympathy and empathy for the disabled. In case you didn't know it, Howard Adams is a gimp himself. He was crippled in a swimming accident twenty years ago. And in case you think my characterizations mark me as a churl, know that I'm a gimp, too, coming on six years in a wheelchair after a motorcycle crash. (I got to be churlish independent of paralysis.) So both Howard and I know something of the subject. I simply know more than he does on account of I'm smarter. So listen up: Neither Howard Adams nor Yr. Obdt. Svt. is a decent role model for anyone with ambitions of becoming disabled. I am far too pretty and talented; Howard Adams is too powerful and prosperous. It is way too easy for someone like Adams or me to say, Hey, why don't the rest of you gimps just get your own car or van, like me? Adams is a quadriplegic with a specially equipped van. It is his own rig, but he must get someone else to drive it for him. When he's on city business, or going to and from his Phoenix City Council office, the city provides the driver. I am a paraplegic, somewhat less handicapped than Adams, so I drive myself in a station wagon with hand controls. Now you might think owning a car is virtually within the reach of anyone. Even the poorest hovel might have a Caddy parked outside. And you might say that since Smith and Adams manage so commendably, anybody can work and support a family, and get around to do [missing text here] unaffordable. Sensible people of limited means may own one old beater which one spouse takes to work, while the other rides the bus. Consider that even for Homo erectus, hoofing to the bus stop on hind feet in Hush Puppies and making the necessary connections to get from home in Phoenix to work in Tempe can be a major pain in the ass and add several hours to the workday. Now try it from a wheelchair. Listen: I am about as adapted, chipper and successful a gimp as you're likely to meet, and I don't go to Circle K's anymore. How familiar the ritual: You're driving home and you get a lech for a cold one. You hang a quick right, don't even shut off the engine, you're in and out in a flash, and buzzing nicely on your second beer before you've hit the next stoplight. When you're in a wheelchair you don't do stuff like this anymore. It is simply too much bother. Even for a gimp like me, with great strong arms, catlike grace and his own automobile. I run wheelchair marathons, lift weights three times a week, have the cardiovascular system of a twelve-year-old, but I do not visit Circle K's. It takes too long, requires too much exertion, inflicts too much pain, and maybe there's no ramp. Screw it. If I had to call two days, or as much as a week in advance to arrange to have a special van pick me up—just to make a doctor's appointment or go buy - groceries—I don't know if I could cope. If Howard Adams had to plan his daily schedule around Phoenix bus schedules, which provide wheelchair service on only six of 54 bus routes, I wonder if he would be able to discharge his duties as a councilman. I suppose he would, being the Type A he is. "I haven't showcased my activities," Adams told me, "but I am interested in this issue." Indeed, Adams has just been appointed to President Reagan's Architecture and Transportation . Compliance Board, which oversees enforcement of federal access regulation. Adams said he thinks Phoenix is doing well on handicap access, but if he lived in, say, New York, he might be frustrated and angry. Then would he resort to civil disobedience? "Probably not," he said. "I'd work the [missing text here] That might work for Howard Adams, - but not for all of Jerry's kids. I've learned a lot of stuff about gimps since becoming one — stuff that contradicts most of what I thought I knew before. No two of us are alike. Being paralyzed doesn't mean blessed forgetfulness of the concerns of your formerly functional physiology. You can experience constant pain from the paralyzed parts. You can have involuntary muscles spasms that make it impossible to sit still, and even more difficult to haul around those parts that would be tough enough to move if they just lay there like deadwood. You can run out of popcorn and have to get rest before the day is half done. You can spend two hours getting bathed and dressed to go out in public, only to get just out the door and find you've pissed your pants and have to go back and start all over. Think about these things the next time you scoff at the demands of the disabled for better access to public transportation, for ramps at street corners, for rest rooms with doors wide enough for a wheelchair, for wider aisles in airplanes, elevators in two-story buildings. Think what it means when a six-inch curb is as impassable a barrier as a prison wall. Not figuratively. In fact. Think about these things and think about one thing further: Disability is a very Eighties fashion of affliction, tres chic you could say. With speed sports like sail-boarding, off-roading and even sidewalk surfing being so trendy, lots more of you hip, yuppie dudes and dudettes will be joining me on wheels in the very near future. Think of handicapped access as an investment in your own future. Think of all this the next time you find yourself staring at the convenience market — the one with the cold can of beer— from across a lane of oncoming traffic, and you decide it's just too inconvenient to make a left-hand turn. Believe thee me: You don't have a clue as to what inconvenience is.

Most visitors to the Bay Area relish the opportunity to hop a cable car and "climb halfway to the stars," as Tony Bennett croons in his signature song, I Left My Heart in San Francisco. Stephanie Thomas, organizer for Americans Disabled for Accessible Public Transportation, had other ideas. "To mobility-impaired people, keeping those historic symbols of public transit alive memorializes inaccessibility and makes it seem like a positive thing," she said. ADAPT, a national civil-rights group, strives to make it easier for disabled people to ride city buses. They differ from mainstream disability-rights groups in that members sometimes commit acts of civil disobedience when the usual political channels clog or hit a dead end. Thomas, her husband Bob Kafka, and eight other Austinites went to San Francisco in late September to conduct a protest during the national convention of the American Public Transit Association, a lobbying organization. Kafka and 15 others were arrested when they climbed out of their wheelchairs and staged a sit-in at the cable car turnaround at Powell and Market streets. Thomas was arrested twice, once for blocking a shuttle bus and once for blocking a cable car. "I've been arrested eight times or so," she said. "I've lost count. Bob has been arrested 14 times. The police are usually aware it's a demonstration about civil rights, and that we're not out to hurt their city. But it's scary. We're not automatons. Some members break down and cry when they go to prison." As far as Thomas is concerned, the suffering has been worth it. "The demonstrations got national exposure. More important, we got the transit association's attention. They are beginning to listen." Thomas, who is also executive director of the Coalition of Texans With Disabilities, could sit for a poster portrait of the committed political activist. Her shock of amber hair shifts of its own accord like the wind ruffling a field of grain. Wide, blue eyes fix visitors with the riveting gaze of a woman who believes she fights for what is right. She was born 30 years ago in New York to parents who fought for justice in their way. Her father organized political campaigns and worked for arms control. Her mother, a writer, was involved in the women's movement. "Mom taught me to question people's perceptions," Thomas said. "The women's and disabled movements have something in common: We're defined by our bodies. You have to fight that all the time." Her first protest occurred when she was in elementary school. Mothers in the apartment building where her family lived wanted to establish a day-care center. The owners didn't want to provide the space. "Women and children took over the building," Thomas said. "We weren't angry college protestors. We were non-threatening moms and kids. But our presence made a difference." Despite her progressive upbringing, she was a shy girl who hid from the world behind the covers of books. When she was 17, her legs were paralyzed when she fell off a farm tractor while doing chores. What could have been a tragedy turned her life around. "I realized that life doesn't go on forever, and that you need to make the most of every moment," Thomas said. Thomas attended Harvard, where she and other disabled students organized a group to help make campus more accessible. "When I look back, I see we were very tame,” she said. “We were polite but usually got what we asked for.” Over the years, Thomas became increasingly active in disability rights. She got involved in independent living centers, communities of disabled people supporting one another so they can live with dignity outside institutions. In the early 1980s, she joined the Austin Resources Center for Independent Living. She went to work for the Coalition of Texans With Disabilities in 1985. The 9-year-old coalition lobbies for, represents and coordinates 90 organizations (including ADAPT) concerned with disabilities, as well as the more than 2 million disabled Texans. “It is the collective voice for the disabled in Texas,” said Kaye Beneke, spokeswoman for the Texas Rehabilitation Commission. "They’re committed - the members live every day with the problems they try to solve. “Stephanie understands there’s a spectrum of political views in the coalition, which tend to be more middle-of-the-road than ADAPT. She takes responsibility for the representing of all those views. But don’t call the coalition passive. They’ve had their way in the legislature and on the local level.” As a leader in two of Texas major disability-rights organizations, Thomas has her hands full. It helps having Bob Kafka, who broke his back in a car accident in 1973, at her side. The experienced trouble maker -- albeit trouble for a good cause -- has made a name for himself. He won the Governor’s Citation for Meritorious Service in 1986. Appropriately, Kafka met Thomas at a disability-rights conference. “Stephanie was real involved, real committed and real attractive,” he said. Sharing home and office has increased their commitment to the cause they serve- and to each other. “Bob and I are an activist couple,” Thomas said. “It’s intense because we work so closely. But it’s rewarding. It has made us an incredibly tight couple.” Thomas has to rework her concept of activism when she joined ADAPT. “Demonstrations force the public to look at disabled people in a different light,” she said. “The cripple is the epitome of powerlessness. We say we’re sorry if it scares you to look at me, but we have to live our lives.” Confrontation, however can cost allies as well as foes. This year, the Paralyzed Veterans of America severed ties with ADAPT and any organization "advocating illegal civil disobedience.” “Our charter states that we must act in accordance with the laws of the land,” said Phil Rabin, director of education. “To act otherwise would be to violate our charter. “The veterans and ADAPT members share first-hand the frustration of living in a society that is not accessible to the disabled. We don’t want to fight ADAPT. It’s a waste of precious resources to divert our energies.” Though Thomas’ group is controversial, it has achieved many of its goals. Albert Engleken, deputy executive director for the American Public Transit Association in Washington, D.C., acknowledged that ADAPT’s street theater has had some effect. In September his organization created a task force to study the issue of providing service for disabled, he said. Engelken, however is not a convert to their cause. “ADAPT wants a lift on every transit bus in the country,” Engelken said. “We believe it should be left to local transit authorities to decide how to handle transportation for disabled people. Transit officials are not robber barons. We’re paid by the public to provide the most mobility for the most people.” Thomas knows how to work within the system. Ben Gomez, director of development for Capital Metro, said ADAPT members have been effective on the Mobility Impaired Service Advisory Committee, which makes recommendations on service to the transit authority board of directors. “They’re well-organized,” Gomez said. “We don’t always agree on the approach and issues. We’ve made many of the adjustments they’ve asked for, but not always within their time frame.” The concessions have been gratifying, but Thomas has only begun to fight. “ADAPT took a dead issue änd made it hot again,” she said. After a request from Detroit Police Chief William Hart, who cited illegal actions of the protesters in other cities, Detroit's City Council last week withdrew a permit that would have allowed the demonstrators to parade through the streets. Members of the group have been arrested at demonstrations at other transit association meetings after chaining themselves to buses and stopping traffic. "In the ’50s, a lot of blacks were on the back of the bus." said Michael Parker of Peoria, ILL. “We still can't get on the bus." Several members of the group told reporters there would be other protests against transit association members. Wheelchair lifts were required on buses briefly in the late l970s. But a transit association lawsuit led to a 1981 U.S. Supreme Court ruling that a federal requirement for lifts on all buses overstepped the intent of equal access legislation. said Jack Gilstrap, executive vice-president of the association. Most local transit agencies provide transportation to handicapped persons using mini-buses in services such as Dial-A-Ride. Gilstrap said. "The vast majority of people in wheelchairs prefer Dial-A-Ride or demand service," he said. “it runs 10-, 15-, 20-1 over lifts on every bus." Gilstrap said it is cheaper to offer special transportation service for wheelchair users than to adapt all public systems to wheelchairs. The subway authority in Washington D.C. spent between $50 million and $60 million to build elevators to allow wheelchair access tor "35 to 40 people a day," he said. MEMBERS OF the handicapper group complain of disparate quality of Dial-A-Ride systems among various cities. and they cite a requirement that rides must be arranged 24 hours in advance. Bill Bolte, 55, of Los Angeles, said: "l was a law-abiding citizen before l realized how oppressive society was getting toward handicapped people. Long-time civil rights activist Rosa Parks canceled her plans to join the ADAPT members, citing tactics that would "embarrass the city‘s guests and cripple the city's present transportation system." said to her assistant, Elaine Steele. By Richard Chin, NEWS Staff Writer Using a back entrance to Greenfield Village, a convoy of SEMTA buses filled with delegates to a national transportation convention avoided a confrontation Sunday with about 100 members of a militant disabled-rights group. The buses, under police escort, slipped into Greenfield Village along a service road from a nearby Ford Motor Co. facility. The protesters were waiting in front of the main entrance to Greenfield Village. THE BUSES were en route to a dinner reception for members of the American Public Transit Association (APTA), which met in Detroit over the weekend. The protesters are members of American Disabled for Accessible Public Transportation, which has been trying to disrupt APTA meetings for three years. They demand improved access for the disabled to buses and other public transportation. Sunday‘s protest began with a wheelchair march from Rosa Park Boulevard down Michigan Avenue to the Westin Hotel in the Renaissance Center, where the APTA delegates are staying. The group had planned a wheelchair parade on the street but Detroit City Council rescinded the group's parade permit Sept. 29, fearing the protest would disrupt city transportation. AS THE GROUP wheeled along the sidewalk, up to 15 city police cars worked to keep them from spilling onto the street. Once they arrived at the hotel, the protesters were quickly herded into a barricaded area that kept them from entering the hotel. Group leaders said once they realized they couldn't enter the building or keep the buses carrying the delegates from leaving, they left themselves for Greenfield Village to try to block entrances. However, the SEMTA buses slipped through the back entrance. THE GROUP did manage to turn away several cars carrying late arrivers at the dinner, and after Greenfield Village was closed to the public at 6 p.rn., restricted all but guests at a private wedding from entering. APTA raised the ire of the protesters through what the protesters said were policies discriminatory against the disabled. They said APTA opposes making all buses wheelchair accessible. “l think they're afraid some of the riders don't want tn ride with diaabled people because some diaabled people are not attractive," aaid Jack Warren, 43. of Cincinnati. He said the stance reflects that of many public transportation users. APTA officials could not be reached immediately for comment. Harry A. Cassidy, a bus driver from Capital Area Transit Authority in Lansing, said he understands the protesters' complaints, but said making all buses accessible to the disabled makes it difficult to keep buses on schedule. Michnel Niemann, communications manager for SEMTA, said all that company’s small buses and 70 percent of its large buses are wheelchair accessible. Thirteen protesters spent the night in a gym at Detroit Police Headquarters after the Wayne County sheriff's department refused to admit them to the county jail. A spokeswoman for the sheriff's department said the protesters weren’t accepted at the jail because over-crowding forced the county on Friday to stop incarcerating people accused of misdemeanors. MEANWHILE, UP to 60 people -- most in wheelchairs — descended on the area around Police Headquarters to protest the jailings. They wheeled slowly along the sidewalks around the building, chanting, “Let our people go" and vowed to spend the night. About 20 police officers stood near the protesters but did not intervene. The 13 protesters were among 37 people arrested Tuesday, after they blocked one of two entrances to the McNamara federal office building in downtown Detroit. Of the 37 people arrested, 31 were in wheelchairs. Police said the 13 jailed protesters were being held in lieu of $1,000 cash bail each. The rest of the protesters were released on $100 [personal bond]. BAIL WAS set at $1,000 for the 13, a police spokesman said, because their arrests Tuesday violated the conditions of their release Monday on $100 personal bond after a similar protest. They had been ordered to avoid further arrest until a court appearance set for Oct. 24, police said. Their incarceration posed special problems for police. The protesters were being held in a gym at Police Headquarters, which has barred windows and doors and is occasionally used to hold prisoners temporarily when processing of prisoners is backed up at the jail, police said. The bathrooms in the gym are not equipped for the handicapped and guards were carrying the protesters in the toilets, police said. The protesters were arrested early in the afternoon. By the time they had been processed and carried into the gym by police, the cafeteria at the Wayne County Jail had closed, police said. Officers at Police Headquarters, who declined to be named and who wouldn't provide details, said they secured from the county jail meals of roast beef and pot roast with lettuce, salads, ice cream, milk and juice. The protesters ate about 8:30 p.m. Title of second article: Costly bus lifts are key to dispute By Louis Mieczko, News Staff Writer It costs an estimated $20,000 to install wheelchair lifts on a typical city bus, and sometimes they don't work. That's the crux of a dispute between transit agencies across the country handicapped groups protesting the lack of access to public buses and rail cars. Americans [sic] Disabled for Accessible Public Transportation (ADAPT) wants every bus and rail car in the county available to wheelchair-bound people, a move which transit officials say would bankrupt most agencies. HANDICAPPED ADAPT demonstrators clashed this week with the American Public Transit Association (APTA), which is holding its annual convention in Detroit. It was the fourth such confrontation in as many years tied to the APTA conventions. Dozens of protesters have been arrested since Sunday for interfering with bus traffic and blocking entry to the McNamara Building as they sought to meet with staff members of U.S. Senators Carl Levin and Donald Riegle Jr. ADAPT has strongly criticized Detroit's Department of Transportation (D-DOT), which serves the city, and praised the suburban Southeastern Michigan Transportation Authority (SEMTA). “We fought for five years in Denver to get wheelchair lifts on all city buses there, and when we won in Denver, we went national," said Wade Blank, a Presbyterian minister whose 15-year-old daughter is confined to a wheelchair. THE PROTEST group, which Blank helped start, is upset with APTA for opposing its goal of wheelchair lifts on all buses. Five years ago, APTA won a lawsuit knocking down a requirement that the devices be installed on buses purchased with federal funds. Jack R. Gilstrap, APTA executive vice-president, called that too costly. “In Washington, D.C., $60 million was spent to provide elevators for the ‘subway stations, but only 36 handicapped people use those elevators on a given day," said Gilstrap. “We would much rather let each transit authority develop dial-a-ride and other more cost-effective services.” Gilstrap said it costs an average of $20,000 a bus to add wheelchair lifts, which often are unreliable. "THEY’VE NEVER given the wheelchair lift system a chance to work," said Frank A. Clark, chairman of the Detroit-based Coalition for the Human Rights of the Handicapped. “How much does it cost to keep these people at home or in a nursing facility." A 10 year old Michigan law, one of the most stringent in the United States, requires that all new buses bought with state funds have wheelchair lifts. California is the only other state with such a requirement. According to the Michigan Department of Transportation, 1,186 of the 2,127 publicly owned buses in the state have wheelchair lifts. Detroit recently bought 100 buses, but equipped only 20 with wheelchair lifts. The city did not have to follow the state law because it used city funds. ONLY 196 of the city's 606 buses — about 32 percent —— have the wheelchair equipment. By comparison, 140 of SEMTA’s 202 buses — more than 69 percent — are equipped with the lifts. And 440 of Denver's 760 buses — 58 percent — have the lifts. Denver's policy is to equip all new buses with the lifts: and the handicapped groups say they consider Denver's system a model that should be adopted by others. Clark complained that the Detroit lifts often don't work. “They don't maintain them at all," Clark said. “We'll be going into federal court soon to complain about the situation." CLARK’S GROUP has a five-year-old lawsuit pending before Federal District Judge Richard Suhrheinrich, charging Detroit with violating U.S. handicap access laws for mass transit, public buildings and walkways. The law requires that public property be accessible to the handicapped. Clark said members of his group monitor Detroit buses for operating lifts by attempting to board them while in wheelchairs. He said the group annually checks five routes Gratiot, Woodward, Grand River, Crosstown and East Warren — designated by D-DOT for handicapped access. "But even on those routes," Clark said, "we can't find any that work." By contrast," he said, "SEMTA maintains its lift equipment. D-DOT officials could not be reached for comment. Mayor Coleman A. Young’s press secretary, Robert Berg, referred questions on Detroit's recent bus purchase in state officials. NEIL LINCOLN, a spokesman for the Denver system, said it has come a long way quickly. “The lifts still break down," he added, “but not nearly as often." However, some cities like Chicago and Cleveland have not bought any wheelchair lifts because of the cost and maintenance problems. Spokesmen for those cities said they prefer to develop dial-a-ride and van service for the handicapped. Detroit has no dial-a-ride or van service. January / February 1987 METRO Magazine [Headline] Handicapped Rights and APTA Highlighted text: A seeming fixture at APTA conventions is a demonstration by the handicapped. In this exclusive interview with METRO Magazine,Rev. Wade Blank describes the movement’s goals and objectives. Shortly before the APTA Annual Meeting in Detroit last October, the General Assembly of the Denver Presbytery of the Presbyterian Church unanimously passed a resolution favoring 100% accessibility to all publicly funded transit buses. The resolution calls upon the" U.S. DOT “to mandate that all public buses bought with federal monies be accessible to all people, specifically including those persons who use wheelchairs for mobility." The resolution declares that equal access to public transportation is a basic human right. It urges the American Public Transit Association to support total accessibility, and calls on all public transit systems to work toward the goal as well. According to sponsors of the resolution, 14% of U.S. citizens are disabled and thus denied full access. The resolution also recommends to all churches and church agencies to consider adding equal access facilities to all their church buses and vans. Wade Blank, a Presbyterian minister and leader in the disability rights movement for 11 years, said the resolution is the latest effort in the struggle to enable disabled Americans to integrate into their communities. According to Blank, disability rights is a civil rights movement similar to the black political movement of the 1950's and 60's. Blank is a leader of ADAPT, the Denver-based American Disabled for Accessible Public Transportation, an organization which has demonstrated on behalf of disability rights at several APTA conventions in recent years. Blank said his organization has about 800 people who actively support it, though he believes many thousands more wheelchair-bound people would do so if they could. What follows is an interview with Rev. Blank conducted in Detroit during the APTA Annual Meeting there during which 18 disabled individuals were arrested for demonstrating at the city hall. METRO: Mr. Blank, what is your organization trying to accomplish at this APTA meeting? Blank: First of all, in 1983 we introduced a resolution before APTA in Denver, Colorado, in which we said that we wanted APTA to vote in favor of having public transportation accessible to people in wheelchairs. That resolution said three things. First, that APTA should inform all its members that it will now endorse accessibility; second, that they should take a public vote member by member (about the issue); and third, that they should inform the transportation industry that accessibility is their position. They have refused since 1983 to act on the resolution, so we assume that that means they don't favor accessible public transit. Now as to what we are doing here. Whenever APTA goes into a community (to hold a convention) we do two things: we demonstrate against APTA, and we use the occasion to illustrate to the public that their local transit system is not wheelchair accessible, in other words, every bus being wheelchair accessible. METRO: Over the years your organization has demonstrated at a number of APTA meetings and very often the demonstrations have been very disruptive. Do you think that your activities have paid off? Blank: They've paid off in the sense that first they are directed to other people with disabilities in order to raise their consciousness about their rights. Our group has grown three times over the last few years. Secondly, it tells the able-bodied public that people in wheelchairs cannot board transit, which most people never even think about. And thirdly, it teaches the community at large that our political movement is in fact a civil rights movement. METRO: Your organization demonstrates against APTA. But isn't it true that you're also hoping for action on the local level wherever you mount a demonstration? Blank: Yes. In effect, APTA does our organizing for us by picking the cities it goes into. We follow and go in and raise consciousness for our cause. I don’t think anyone can understand how alienating it is (to be disabled). My daughter is in a wheelchair. If she goes to a bus stop and the doors open and shut and the bus drives off without her, there's no way of expressing to people how alienated, how shut out that makes her feel. Of course, the transit people want to make it an economic argument...but that didn't cut it with the black movement and it's not going to cut it with the disabled movement either. METRO: How is ADAPT funded? And what is your annual budget? Blank: Mainly from the Roman Catholic Campaign for Human Development, the Presbyterians, the Lutherans and the United Church of Christ. ADAPT itself doesn't have a budget per se. A trip like this (to Detroit) will run us approximately $15,000 for all the logistics involved, hotels, food, attendant care, just the logistics of moving that large number of disabled. METRO: How big is your staff? Blank: We don't have a staff, we don't have bylaws, we don't even have officers. It's just a consensus group. For example, in Denver, the disabled groups each do their own thing, and there's a lot of individuals who have joined ADAPT by simply saying, I want to be part of it. That's all it takes. We have a list of names of who those people are. METRO: You mentioned the logistics of moving the disabled. Do you bring people along with you to do the demonstrating, or do you seek to have local disabled join in? How does this work? Blank: In July we flew here with some disabled and met with the local disabled. They basically said they'd recently filed suit and were trying to get access to the buses, but that they didn't believe they could support any demonstrations because they'd be afraid to lose what they have now. That's almost to the letter the situation in every community we go into. The disabled are very afraid to lose what little they have. Plus, a disabled person in a wheelchair is by definition passive about the way they see themselves. But before we leave Detroit we will have a few people who will dare. By seeing the press, they'll see it's pretty amazing and they want to be a part of this. It changes the way they view themselves. That's how we recruit members. METRO: Tell me how the organization started? Blank: It started in Denver in 1975 when we announced we were going to make the transit system there accessible. Everybody laughed at us. We had about 20 members. We filed suit and lost. On July 5, 1978, the day after the suit was lost, we went down and blocked the first two buses in the whole movement. We held those buses for two days, sleeping on the streets. The battle in Denver went on in spurts. We started in 1978. In 1979 (Denver RTD) announced they'd make their transit buses accessible, but in 1980 when Reagan took office they went to a posture of inaccessibility. We hit the streets again and they reverted back to accessibility. In 1982, they finally signed an agreement with us that they would be totally accessible. So then other groups asked us: how did you do that? we'd like you to teach us how. Rather than just sit in Denver and enjoy our system, we decided to export what we'd won there using the same tactics on a national basis. METRO: You said earlier that the economic argument against accessibility doesn't fly. Yet to APTA and the transit industry the economic argument is very real. After all, the funds to pay for accessibility come out of their budgets. They can cite some very dramatic statistics of how much subsidy each handicapped ride costs. So how can you say the economic argument doesn't carry weight? Blank: Because those figures are not true. Denver, for example, bought 160 buses. The lowest bidders (for that contract) bid accessible buses. Neoplan undercut everybody else’s bid and they bid accessible. So you can't go just by the lifts themselves, you go by the total cost of the bus. METRO: But you also have to consider the maintenance costs and personnel costs too. In San Francisco. for example, one of the agencies there has two maintenance workers who do nothing but service the lifts, that's all those individuals do. Blank: That's true. But they have people who work on the motors, and people who work on the brakes, and people who work on every aspect of the buses that service the able bodied. The figures out of Seattle and Denver on maintenance per lift is under $400 a year, if they do preventive maintenance. Now that's a lot lower than APTA's figures of $2,500 per lift (per year). That figure is correct if you don't ever fix the lifts. In other words if you drive around and they break down and they're all gummed up, then you have to put new hydraulics in because you haven’t changed the oil. Then you're going to top out at $2,500 the same way if you don't keep your car up. METRO: During his remarks to APTA, CBS correspondent Ed Bradley charged your organization had mounted a mailgram campaign against his coming. He went on to give a presentation about apartheid in South Africa Your comments? Blank: The disabled community in the United States is suffering from a form of apartheid. The disabled live in section 8 housing, high-rise housing which is for disabled and elderly, They live in nursing homes. They go to workshops like Goodwill where they're segregated, and they are paid under 10 cents an hour in the average workshop in the United States. That's what the salary is. The disabled can't ride public transportation, so you have a form of apartheid. METRO: Thank you.

OH 45202 (513)352-2000 Editorials Title: Buses and the disabled Shades of the civil rights movement returned to Cincinnati yesterday when members of ADAPT, which stands for American Disabled for Accessible Public Transportation, interfered with the operation of Queen City Metro buses. One latched onto a wheel well, and two others boarded and refused to leave. The protesters say members of the American Public Transit Association, who are meeting here this week, are moving slowly or not at all toward making all buses and trains fully accessible for the handicapped. They point to Metro, which has many buses without wheelchair lifts and 87 with lifts that it refuses to operate, as a microcosm of the problem nationwide. Some may condemn the protesters’ tactics of interrupting normal transit service, albeit by relatively non-violent means. The larger question, however, is whether the transit systems are going out of their way to leave the handicapped at curbside. That's certainly not the case with Metro. Metro has contracted with a private company to provide door-to-door (more accurately, curb-to-curb) service for the handicapped within Cincinnati. The system isn't perfect, but it is growing. Complaints abounds that scheduling the Access vans is difficult, and Metro has failed to meet a five-year goal of providing van service to all of Hamilton County, says general manager Tony Kouneski. The problem, here and elsewhere, is one of money. ADAPT wants the lifts as well as the door-to-door service. It’s tough to have it both ways, especially since federal dollars for mass transit have been cut almost 25 percent by the Reagan administration. States have been hard-pressed to fill that gap, and a sales tax increase for Metro failed miserably in 1980. Kouneski says if Metro did, indeed, have an extra $350,000 for operating and maintaining the 87 wheelchair lifts, the money would be better spent on door-to-door service. That's a decision that groups such as the Greater Cincinnati Coalition of People With Disabilities and Metro's own advisory council for the handicapped should help make and implement. Members of national groups such as ADAPT, meanwhile, have made their point. They should now turn their efforts to such things as legal parades and peaceful picketing. Instead of continuing their Cincinnati protest, they should devote their energies to lobbying Washington and the legislatures to fund their full-access plan before someone is seriously injured.
