Title: Disabled arrested in SF protest By Donna Hemmila Staff writer SAN FRANCISCO — Protesters in wheelchairs, chanting "If you can take us to jail, take us to work," were arrested Sunday at City Hall where they disrupted the opening of a national public transit convention. More than 35 disabled people were hauled into special wheelchair-lift equipped vans on charges of disturbing the peace. Groups of demonstrators blocked the entrance to the City Hall rotunda where delegates from the American Public Transit Association kicked off a five-day convention Sunday. As San Francisco police officers pushed the wheelchairs into the waiting vans, other wheelchair riders parked in front of the vans to keep them from driving away. Captain Michael Pera said the demonstrators would be given citations at the Hall of Justice and released. "The situation was getting out of hand," Pera said. "My understanding was by the demeanor of the crowd, they wanted to be arrested." More than 150 disabled protesters and their families had marched from an afternoon rally at Union Square. The parade of wheelchairs had stopped traffic on downtown streets and demonstrated in front of the Hilton Hotel on Powell Street, where convention delegates are staying. The five-day transit convention is expected to bring nearly 15,000 representatives from transit agencies across the United States to the Bay Area. Disabled organizers have vowed to disrupt the convention, being held at the Moscone Center, to call attention to the transit organization's policy on access for disabled people. Disabled organizers say the APTA is responsible for weakening federal laws that require public transit agencies to equip their buses and subways to carry disabled passengers. A successful lawsuit brought by APTA changed federal law to give local transit agencies the right to decide what type of accessible transit to provide. Many transit districts have chosen to carry wheelchair passengers in dial-a-ride-type vans rather than equip their regular buses with wheelchair lifts. Members of the American Disabled for Public Transit and the September Alliance for Accessibility are demanding to ride the same public transit system that able-bodied passengers use. At the rally in Union Square, the protesters heard pledges of support from Lt. Gov. Leo McCarthy, feminist Eleanor Smeal, the Rev. Cecil Williams from Glide Memorial Church in San Francisco and labor leader Jack Henning. During the rally the protesters chanted curses against APTA and waved signs with slogans such as "No Taxation without Transportation." The songs and chants were punctuated with the clanging bells of passing cable cars, a San Francisco attraction none of the wheelchair riders can board because the cars lack lifts. McCarthy said he backed the disabled community in its fight for independence. Many disabled rely on public transit to go to work and are being denied opportunities because they don't have transportation, he said. "There is no footnote to the Constitution that says everybody gets these civil rights except the disabled," McCarthy said. Disabled speakers fanned the crowd's anger with accounts of their morning meetings with APTA representatives at the Hilton Hotel. Disabled representatives said the wheelchair-accessible door to the hotel was barricaded and they were told to exit through the garage. "The backdoor entrance went out in the '60s with the civil rights movement," said Judy Heumann, of the September Alliance. "We're not going to go through the back door anymore." Albert Engelken, deputy executive director of APTA, denied his organization had ordered the hotel barricaded. "This is not a happy situation," Engelken said as he watched wheelchair users demonstrating on the streets below from the fourth floor window of the Hilton. "Obviously it's a sore spot. Nobody likes this." APTA's executive board has agreed to set up a task force to study their policy, but Engelken said the organization is not ashamed of its stand on disabled access. Only California and Michigan have laws that mandate full accessibility on public buses and rail systems. "You folks in California chose Artie you want and APIA thinks that's great," Englenken said. "We just wonder if the people in California should be telling the rest of us what to do." APTA has estimated it would cost $13 billion to make every public transit system in the United States accessible to the disabled. [This article continues in ADAPT 422 but the entire text of the article is included here for easier reading.] Title: MUC police arrest 20 on Day 2 of protests by wheelchair activists By: Susan Semenak, of The Gazette 10/4/88 Large contingents of Montreal Urban Community police were mobilized yesterday for the second day in a row to deal with wheelchair protesters who were demonstrating for better public transit facilities for handicapped people. Twenty protesters were arrested, 10 in a demonstration atop Mount Royal and 10 who chained themselves to the doors of the under-parking garage at Place Ville Marie, across the street from the Queen Elizabeth Hotel, where the American Public Transit Association — the protesters' target — is holding its convention. Most of the demonstrators were members of ADAPT — American Disabled for Accessible Public Transit. In the demonstration on the mountain, 35 protesters tied up 100 specially trained police for about four hours yesterday afternoon. [Subheading] Refusing to clear road Ten were arrested after refusing to clear the road leading to the Mount Royal chalet, where the transit association had organized a lunch. After pleading guilty in municipal court last night to charges of mischief and obstructing police, five demonstrators paid fines of $50 while five others refused, to pay and were sent to jail for three days. A mother and her 12-year-old daughter were released after the Place Ville Marie protest. The eight other activist pleaded guilty to charges of mischief and obstructing police. All eight chose to go to jail for three days rather than pay $50 fines. [Subheading] Placed on probation All those who pleaded guilty yesterday were placed on probation until the convention ends Thursday. Judge Louis Jacques Leger barred them from the island of Montreal and from demonstrating and banned them from the mountain and from a wide downtown area around the Queen Elizabeth Hotel. Police said last night that of the 48 activists arrested yesterday and Sunday, only one was a Quebecer. Protest organizer Rev. Wade Blank of Colorado told Leger. "I am personally grieved and saddened that this court has chosen to punish people who have already been greatly punished by society." Const. Normand Tremblay said the Montreal Urban Community police were out in full force yesterday to prevent the wheelchair protesters from repeating the disturbance they had caused Sunday, when they chained themselves to railings at the Sheraton Centre hotel and blocked traffic on Dorchester Blvd. for nearly two hours. Twenty-eight of the handicapped activists were arrested Sunday. After pleading guilty to mischief charges, five paid $25 fines and were released, while 23 others opted to serve three-day jail terms at Bordeaux and Tanguay jails. "We are joining our friends in jail and it's worth it," said Lillibeth Novaro, one of those arrested on the mountain yesterday, as a policeman wheeled her to a school bus hired to take the protesters to police headquarters and municipal court. "There are millions of people in wheelchairs who need to take the bus to go to work and be equal members of society," she said. Novaro ended up paying her $50 fine and didn't go to jail. 'We want equal access' "We pay taxes like everybody else and we want equal access to mass transit," said Molly Blank, who drove four days from Colorado with her husband and 18-year-old handicapped daughter to join the protest. Police blocked roads leading to the chalet and the lookout atop the mountain with barricades and patrol cars to prevent the protesters from confronting the luncheon guests. The police force's tactical squad had been tracking the demonstrators' movements since morning. Urgences Sante doctors were on hand to verify that none of the protesters had been injured during the arrests. "We know these people are here to cause problems and we are here to prevent that," Tremblay told reporters as a helicopter the MUC had rented for the day from provincial police hovered overhead. "We are allowing them to protest and express themselves, but we cannot allow them to make trouble. And we want to take all the necessary precautions to ensure that nobody is injured”. The special police team assembled to deal with the protesters took a day-long course last week to learn how to "handle" the handicapped — from identifying disabilities and deactivating wheelchairs to carrying the disabled without injuring them. Tremblay said police consulted their counterparts in six U.S. cities where the group has staged previous demonstrations. Phyllis Young, a transit official from Duluth, Minn., who attended the luncheon on Mount Royal, said the wheelchair protesters have been turning up at public transit conventions for the past five years. "This is nothing. In San Francisco they chained themselves to trolleys and ran over one policeman in their wheelchairs and gave him a concussion," Young said. "Another year they all laid down on the street and blocked traffic for a whole day." Tremblay said police could not stop the protesters from coming to Montreal because they have no criminal record — the only laws they had broken are municipal bylaws. Instead, MUC police smiled and chatted as they wheeled the protesters away. But some had donned kneepads under their uniforms in case the protesters became aggressive. Maria Barila, a Montrealer arrested on the mountain, said officials at the Office des personnes handicapes du Quebec — the government agency that oversees services to the disabled — discouraged local disabled people from turning out at the demonstrations. "Some people were told they could lose their welfare cheques," said Barila. "Others were told that things could get violent." Francois Gagnon, also of Montreal, said specialized buses for the handicapped provided by the Montreal Urban Community Transit Corp. are "a joke." He said the disabled would prefer to ride the same buses and Metros as everyone else. “They call It door-to-door service, but sometimes it takes two hours for a disabled person to get from home to work in those mini-vans they provide," said Gagnon, winding his way up the mountain in his wheelchair. Meanwhile, Murielle Lariviere-Lebret, president of the Adapted Transport Users Association, said her group morally supports ADAPT protesters demanding accessible transport for all. But her group, which speaks on transit for 18 associations of the handicapped here, would not join demonstrations or urge members to do so. Instead, it prefers to concentrate on getting more and better minibuses and taxis to serve handicapped commuters in the MUC. Over the longer term, it favors adapting the regular bus and Metro service so it is accessible to the handicapped. [Subheading] Position denounced This position was denounced by Jean-Francois Gagnon, a member of the Quebec Association of Handicapped Consumers, who said the handicapped had to become more radical to get what they want from the MUC and Quebec. But MUCTC managing director Louise Roy said the transit corporation has no intention of adapting buses or Metro stations to accommodate the handicapped. "Our intention was never to make the Metro system completely accessible she said. "We are working on improving our adapted door-to-door service, and I think that's much more realistic." Adding wheelchair-lift platforms on regular buses would cost $15,000 per bus, which Roy said is too expensive. Instead, the MUCTC will spend $16,000 on improving adapted transit services next year. "Each year our ridership on adapted transit increases by 30 per cent. Last year we served 500,000 people," she said. Service is offered through adapted mini-buses and taxis. Riders pay the same price they would to ride a bus and the rest of the cost is absorbed by the MUCTC, Roy said.

Police officials said nine of 10 would be arraigned in municipal court sometime last night or early this morning. Cynthia Keelan and her seven-year-old daughter Jennifer were released soon after the wheelchair bus carrying the arrested demonstrators arrived at police headquarters. Police began processing the 10 protesters last night just as the arraignments of 10 others arrested earlier in the day were being completed. The 10 arraigned at 7:30 last night were arrested for blocking the Camillien-Houde parkway atop Mount Royal —to impede the return of APTA conference-goers from a luncheon at Chalet Mont Royal. All 10 pleaded guilty to charges of mischief and obstruction of justice. Municipal court Judge Louis-Jacques Leger sentenced five of the 10 — all of whom refused to pay $50 in fines — to three days in jail. The judge also slapped probation orders on the protesters, forbidding them from taking part in demonstrations on the Island of Montreal for six months. Léger also forbade them from being within 100 metres of an ADAPT demonstration and from being in areas where the arrests were made until the APTA conference ends to-morrow. [Subheading] Waived conditions The judge waived the last two conditions for Marie Barile, the sole Montrealer arrested atop the mountain. Barile protested conditions which said she should not be within the boundaries of Cote des Neiges Boulevard, Pine Avenue, Mount Royal Avenue and Parc Avenue. "But I work on Cote des Neiges near Victoria," she said, leaning forward in her wheel-chair so Léger could hear her. Rev. Wade Blank, one of the five who refused to pay his fine, told the judge that he would go to jail to protest the incarceration of the wheelchair-bound demonstrators. "I'm protesting the punishment of people, who are already punished enough by society," said Blank, who isn't disabled. MUC police moved in after the group of 50 blocked access to the chalet for an hour. "All the APTA people got up to their fancy luncheon, but they couldn't get down," said Molly Blank, Wade's wife. Meanwhile, 20 ADAPT members are expected to be released from prison this morning after serving half of their three-day sentences for invading and refusing to leave the Sheraton Centre, where some APTA members are staying. While 28 were arrested in the Sheraton protest, eight paid their $50 fines after pleading guilty to mischief and obstructing justice in a 2:30 a.m. municipal court session yesterday. The rest refused to pay fines or could not. The 20 — 16 men who were sent to Bordeaux jail and four women sent to Tanguay — went on hunger strikes to protest the probation orders Léger imposed. "Basically, the judge told them not to go into a demilitarized zone encompassing the major hotels where APTA members are staying," said Stewart Russell, the group's Montreal lawyer. [Subheading] Don't have right Russell called the restrictions on their movements unconstitutional because, he said, they didn't allow those convicted freedom of assembly and freedom of speech. Again at last night's session, he told Léger the orders were unconstitutional. "These people have not the right to demonstrate anywhere in the city of Montreal for six months, and they can't go see the mountain like other tourists visiting the city," Russell told the court at the arraignment of the mountain demonstrators. Léger said the probation order didn't hinder their rights enough to be considered unconstitutional, and he said, "I think they had an opportunity to see the mountain today." Title: 25 arrested in downtown demonstration by Ron Charles Montreal Daily News MUC police arrested 25 wheelchair-bound demonstrators last night after they forced their way into the lobby of the Sheraton Centre in downtown Montreal. The demonstrators were protesting the American Public Transit Association's (APTA) reluctance to endorse wheelchair lifts on new buses. They crashed their wheelchairs through a luggage-cart barrier hotel employees had built in an attempt to ward off the protesters. [Subheading] Came along When APTA, a Washington-based transit authority organization, brought its annual conference to Montreal this week, the protesters came along as part of the ticket. The demonstrators, from a group called American Disabled for Accessible Public Transit (ADAPT), have been protesting at APTA conferences for eight years. Only a few members of a local disabled rights group took part in the demonstrations — the rest were from the U.S. Police said all those arrested — who are expected to be charged with assault — were American citizens, many of them Vietnam veterans. About 50 MUC police officers showed up to clear the Sheraton's marble-covered lobby after the protesters, singing "we want to ride," blocked elevators and escalators. Police wheeled the demonstrators one by one to a waiting wheel-chair bus being used as a paddy wagon. Police snipped chains linking protesters Mike Auberger and Bob Kafka's wheelchairs to a handrail in the lobby. Although the APTA conference is taking place at the Queen Elizabeth Hotel, some of the 3,000 attendees are staying at the Sheraton. Earlier in the day, police turned the Queen Elizabeth into a fortress with metal street barriers as about 75 demonstrators wheeled toward the APTA conference headquarters. They blocked traffic in both directions on Dorchester for more than two hours as police tried to pen the group in with the barriers. Police took two protesters who had crashed the barriers out of their chairs in order to lift them and their chairs over the barriers. [Subheading] Took chair "The police took his chair away, separated him from his legs," said Lori Taylor as she watched from the side-walk when police lifted her husband, Lester, over the barrier. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Bill Bolte, who started ADAPT's Los Angeles chapter, said police overreacted to the demonstration. "This really confuses me because I know that after the Canadians (hockey team) won the Stanley Cup, all types of terrible activity went on," said Bolte. "People overturned cars while everyone, including the police, just looked the other way and went and had a cup of coffee." Several demonstrators who broke through the police perimeter smashed their chairs into barriers in front of the hotel entrance, but hotel security and police stood their ground. Police arrested some 25 wheelchair demonstrators after they forced their way into the lobby of the Sheraton Centre. They were protesting the American public transit association’s reluctance to endorse wheelchair lifts on new buses. It was showdown time yesterday, as wheelchair-bound protesters took on city cops outside the Sheraton hotel on Dorchester Boulevard Some demonstrators where roughly carried and wheeled away as the melee grew ugly. The protesters were making their case for better accessibility to buses at the American Public Transit Association convention.

Title: Police on guard as disabled plan protest at transit meet By LYNN MOORE of The Gazette Montreal Urban Community police are bracing for trouble from a militant group of disabled Americans with a beef against the American Public Transit Association. The association is holding its convention in Montreal, and about 150 members of the American Disabled for Accessible Public Transit (ADAPT) and 20 handicapped Canadians will engage in "confrontational" lobbying at the convention site and elsewhere in the city. The group wants mechanical lifts on all buses in the U.S. It claims between 300 and 500 members. [Subheading] Meet starts tomorrow The Montreal Urban Community Transit Corp., a founding member of the transit association, is host of the four-day meet. It starts tomorrow at the Queen Elizabeth Hotel and is expected to draw about 3,000 people. MUC police are taking the protesters seriously, after speaking with U.S. police and watching videos of demonstrations in the U.S. The MUC department says the protesters — many of whom will be in wheelchairs — are capable of creating traffic chaos, halting buses and closing bridges. While the disabled group won't reveal its targets, a spokesman told The Gazette that its members will chain themselves and their wheelchairs to buses and buildings. "We are not violent. We are confrontational and aggressive," Stephanie Thomas said. She and her husband have come from Austin, Tex., to protest. ADAPT has hounded transit association conventions for five years. Thomas says she has been arrested at least 10 times but has never spent more than two days in jail. "I personally would rather not go around making enemies in every town," she said. "I would just like to ride the public transit." Some Montrealers who had planned to protest with ADAPT have backed out after a newspaper reported that many of its members were Vietnam veterans and violence was expected, said Francois Gagnon, vice-president of the Movement of Handicapped Consumers of Quebec. But Thomas said her husband will be the only Vietnam vet involved in the Montreal protests. To deal with the anticipated protests, about 100 MUC police officers have been put through a day-long training session, division director Marcel Auger told a news conference yesterday. Part of the session was conducted by two handicapped Montrealers: Restraining straps instead of handcuffs will be used on demonstrators who are arrested. Medical staff will examine protesters, Auger said. Municipal court and Quebec Court judges will be available around the clock to avoid keeping the protesters in custody. ADAPT members usually plead guilty to charges, however, and opt for jail terms rather than pay fines. Space in the two city jails has been set aside for the protesters. [Subheading] Service inadequate Local disabled groups aren't happy with MUCTC services; Gagnon called the MUCTC's door-to-door minibus operation, coupled with a small taxi service, simply inadequate. He was particularly incensed over the MUCTC's refusal to provide the elderly and handicapped with easy access to the new Metro stations that opened last winter. The Regroupement des Usagers du Transport Adapte is "not at all pleased" with the level of service provided to the disabled by the MUCTC but will not protest with ADAPT, spokesman Yvon Desgro-seilliers said. The demonstration was non-violent, and there were no reports of injuries or of anyone resisting arrest. The protesters were booked by police on charges of trespassing and were taken to the City Workhouse in vans and buses equipped with lifts to accommodate wheelchairs. Members of a group called the American Disabled for Accessible Public Transit, ADAPT for short, demonstrated against the American Public Transit Association, which is holding a convention at the Omni Hotel in Union Station. The association, which represents bus operators, op-poses efforts to require that buses be equipped with wheelchair lifts. ADAPT has repeatedly carried out civil disobedience at meetings of the association, and police were prepared. Scores of officers in uniform and plainclothes officers were waiting as about 150 people in wheelchairs and their able-bodied supporters marched from The Arch, up Market Street and into Union Station shortly after 1 p.m. They blocked some entrances and hallways but were unable to close the hotel. Many chanted and called on the public for support. St. Louis police Capt. Clarence Harmon spoke over a bullhorn and tried to order the demonstrators to disperse. But as he tried to speak, the demonstrators sounded portable air horns, drowning him out. "I'll tell each one individually," Harmon said to an aide. He walked from wheelchair to wheelchair telling each person, "I am Capt. Harmon from the police department. You are subject to arrest if you don't leave. Many did leave, but others remained in place, their wheelchairs side by side. Among them was Barbara Toomer, who sat blocking the main entrance to the hotel. San Francisco Hundreds of disabled activists, demanding accessible transit, dramatically confronted “the world’s largest transit exposition” here September 27-30 as they blockaded streets, chained themselves to cable cars, and generally besieged the 15,000 mass transit officials and manufacturers’ representatives at the American Public Transit Association (APTA) Expo ’87. Over 100 protesters were arrested as they pressed APTA to approve a resolution by the September Alliance for Affordable Transit (SAAT) calling for the right of the disabled and elderly to access public transit. SAAT organizer Marilyn Golden called the APTA protests “the largest in disability rights history.” The disabled community has fought against APTA since 1979 when APTA brought a lawsuit that succeeded in overturning a federal regulation requiring that all transit vehicles be accessible to the disabled. Since 1983 the American Disabled for Accessible Public Transit (ADAPT) has organized demonstrations at APTA conventions in Cincinnati, Detroit, Phoenix, New York, and Washington, D. C. to urge a policy change. Until this year when they scheduled two workshops on the issue, APTA has been unwilling to even meet with protestors. Mark Johnson, a demonstrator from Georgia, drew the parallel between these protests and the civil rights movement saying, “There was something wrong when Black people weren’t allowed to sit in the front of the bus, and there’s something wrong when we can’t even go on the bus.” APTA claims that accessibility would cost $15 billion and would bankrupt the nation’s transit districts; they propose instead a system of “paratransit” which would theoretically provide disabled people with flexible door-to-door service but in fact translates into long waiting lists and call-ahead requirements, weekday-only buses and restricted ride purposes. SAAT counters that APTA’s $15 billion figure includes completely rebuilding subways in New York, Chicago and other cities, while the disabled community’s actual demand does not include rebuilding rail systems or even retrofitting existing vehicles, but only that new buses include wheelchair lifts. Also, while arguing that paratransit may be a useful supplement to public transit, Susan Schapiro of SAAT criticized existing paratransit systems as designed with a view of the disabled as “pathetic people in nursing homes going to see the doctor twice a month . . . . It all boils down to discrimination and the belief that these aren’t really people. The APTA delegates could not miss the powerful statement made by the tenacious lines of wheelchair bound demonstrators who spanned several generations in age, were multi-racial in composition, and came from every corner of the U.S. – including eight from Alaska. As demonstrators were being arrested they drove home the irony of being taken away in a lift-equipped paddy wagons chanting, “They can take us to jail but not to work.”

O'Connor OF THE EXAMINER STAFF The Hall of Justice resounded with victory whoops and the whirl of motorized wheelchairs as 43 'handicapped activists arrested for blockading the Powell Street cable car line got their day in court. Protesters used their arraignment Wednesday before Municipal Court Judge Philip Moscone as a platform for a new attack against the American Public Transit Association, which they say has not done enough to provide the handicapped with access to public transit. Moscone allowed designated speakers to address the court after each group of blockaders entered no contest pleas to charges of obstructing a public thoroughfare. The $50 fine the charge carried was dropped as Moscone credited the night the 43 demonstrator spent in jail as "time served." A second charge of failing to disperse was dropped "in the interest of justice," according to Deputy District Attorney Randall Knox. Jane Jackson, who spoke on behalf the first group of 14 wheelchair-bound demonstrators arraigned Wednesday, seized the opportunity to charge APTA with denying handicapped citizens of their civil rights. "It is for this reason that we believe Jack Gilstrap (APTA executive vice president) should be asked to resign or should be forced to resign," Jackson said. "APTA is not acting in good faith." More than 15,000 public transit officials from around North America attended the four-day convention. Officials of the transit group have said they feel the access question should be handled on a local level. Jackson also said the coalition of handicapped-rights `groups`, which captured national media attention with four days of protests and blockades across the city, was pulling out of a scheduled meeting with APTA officials Thursday. "It's the only move left open to us," Jackson said later while members of the September Alliance for Accessible Transit and American Disabled for Accessible Public Transportation cheered her and the other blockaders as they exited the courtroom. About 75 wheelchair-bound protesters lined the hallway outside the courtroom, chanting and clapping in approval and support as each group of blockaders were arraigned and allowed to leave. "They're our heroes," said Connie Arnold of San Rafael. "They're standing up for us." During the arraignments, police, sheriff's and emergency medical personnel stood by as defendants were wheeled in or entered the courtroom under their own power. Jennifer Keelan, a 6-year-old girl from Tempe, Ariz., whose bouncy enthusiasm and apparent unconcern over her handicap captivated the press and boosted the resolve of protesters, was wheeled in by a sheriff's deputy and sat writing her name over and over again in a small notebook. Unlike the group's earlier demonstrations, Wednesday's action was peaceful and there were no arrests. Protesters had staged noisy and sometimes violent demonstrations outside the APTA convention at Moscone Center Monday and on the steps of City Hall Sunday night. Handicapped-rights group organizers said Wednesday was their last day in The City as the APTA convention at Moscone Center ended a four-day conference and transit officials left town. But protesters declared the string of rallies and blockades a success. "We made our point," said Marilyn Golden of Oakland. "Now maybe they will listen."

Chung Thirty-four disabled people, deliberately blocking streets in a bitter demand for better access to public transit, were arrested yesterday by San Francisco police officers. Twenty-five protesters, many in wheelchairs, blocked Howard Street yesterday morning outside the Moscone Center where the American Public Transit Association is meeting through tomorrow. Then. in the afternoon, nine more disabled people blocked the street outside the downtown Hilton Hotel, where the transit officials are staying. On Sunday 22 protesters were arrested making a total of 56 cited in two days. Calling themselves the September Alliance tor Accessible Transit, the disabled wheeled themselves a mile to Moscone Center, under police escort, to protest, chanting, "Up with Access! Down with APTA!" For more than 10 years disabled people nationwide have pressed for wheelchair access to local buses and trains. However, APTA, in 1981, managed to overturn a federal mandate requiring wheelchair lifts on all new buses. APTA, instead, got a “local option" allowing each transit organization to determine the best way to serve the disabled. At yesterday morning's protest, Judy Heumann of the Berkeley-based World institute on Disability, said, “It‘s a very emotional issue for disabled people to have to come out here and do this." She was not arrested. Police gave the protesters outside Moscone Center three warnings to disperse, then started arresting them. They were taken to the Hall of Justice in a specially equipped Municipal Railway bus that had a wheelchair lift. A special police van with a lift handled the protesters outside the Hilton Hotel. All those arrested for blocking a street and falling to disperse were cited and then released. The protesters said they will be back demonstrating until the convention ends tomorrow. More than 11,000 public transit officials from across the United States and about 50 countries are attending the convention.

San Francisco Chronicle 9/28/87 S.F Protest For Disabled Turns Violent By Evelynn C. White A peaceful demonstration for the rights of the disabled to use public transit turned violent last night when 23 people were arrested, one of them on charges of assaulting a police officer. Following a rally at Union Square, 500 demonstrators converged on City Hall, where members of the American Public Transportation Association were holding a dinner meeting. Police said the melee broke out when demonstrators tried to block members from entering in the meeting. San Francisco police officer Michael Travis, 40, who was thrown down the City Halls steps in the scuffle, was treated for a possible concussion and released. Arrested in the assaulted was Alan Shipley, 40, of San Francisco, who police said is not disabled. Shipley was booked at city jail on charges of assaulted and battery on an officer and resisting arrest. The other 22 demonstrators, 19 of them wheelchair-bound were cited for failure to disperse, blocking a sidewalk and resisting arrest. They were released. Earlier in the day, 250 demonstrators at Union Square, 80 percent in wheelchairs, made a plea for better access to public transit. “In most cities, a person who is disabled can’t go to work, can’t go to school, can’t function,” said Laverne Chase, a wheelchair-bound resident of Washington, D.C. “I am here because I believe that disabled people should have equal access to everything that the mind can imagine, starting with public transportation.” The protest, sponsored by the September Alliance for Accessible Transit, was held in opposition to the APTA, which is convening in the city through the week. In the early 1980s, APTA fought to rescind federal regulations that would have required wheelchair lifts in all newly purchased transit buses and handicapped accessibility to all new rail systems. The organization instead lobbied for a “local option” alternative that allows individual transit systems to determine the best way to serve the handicapped. On Wednesday, the association plans to hold a session concerning the needs of the disabled. “I’m one of the lucky ones because I have a van,” said French. “But other wheelchair-bound people have to impose on friends and family plan weeks in advance to get where they need to go. They should be able to go down to a corner and get on a bus, to live their lives spontaneously.”

Hundreds of disabled people who are demanding access to public transit systems in every U.S. city have threatened to block city streets, hotel lobbies and entrances to the Moscone Convention Center through Wednesday during a national public transit conference. “If it were women or blacks who couldn’t get on the bus it would clearly be a civil rights issue,” said Kitty Cone of Berkeley, a member of September Alliance for Accessible Transit. An unidentified man was arrested for investigation of assault on a police officer when he got into an altercation with officers arresting protestors in wheelchairs who blocked the main entrance to the stately city building. A reception was being held for members of the American Public Transit Association inside. “The officer fell backward and received a slight concussion when he hit his head on the steps,” police spokesman Richard Galliani said. The other 19 people – all of whom were in the wheelchairs – were arrested for investigation of blocking a sidewalk, resisting arrest and failure to disperse, all misdemeanor charges, said Galliani. They were transported to San Francisco jail in several vans equipped to accommodate wheelchairs.

Title: Wheelchair activists block restaurants Compiled by The Gazette About 100 members of a militant group of wheelchair-bound activists blocked the roads and entrances to a restaurant Sunday night in an attempt to keep people from attending a steak fry put on by the American Public Transit Association. Phoenix police arrested 27 protesters. They were taken away in handicapped-accessible vans, cited for trespassing and released, police said. Police were continuing to monitor the American Disabled for Accessible Public Transit groups today, with a command post at the Civic Plaza. Adams Street, next to the Hyatt, remained blocked and about 20 officers were stationed there. Chanting and carrying placards Sunday, members of ADAPT lined up across two roads, a stairway and the doors, including the handicapped entrance to the restaurant at The Pointe at South Mountain resort. The 450 people attending the APTA convention arrived in six Phoenix buses. Some were forced to scramble up a steep gravel incline and enter through the kitchen. Others walked up the back driveway. “We plan to be here all week and to inconvenience you as much as we can,” called out one protester, who was blocking the stairs. Earlier in the day, protesters had picketed at the Hyatt Regency, where the conventioneers are staying. The protesting group, known for demonstrations on behalf of the handicapped, wants all public transit to be accessible to the wheelchair-bound. “I think they have a just cause, but I think they are carrying it to an extreme,” said Bob Hocken, general manager of the Phoenix Transit System, who walked up the hill from the lower parking lot because the stairway was blocked. After speaking to the restaurant’s manager, the group agreed to let staff, supplies, and the restaurant’s shuttle buses pass. The restaurant sent a waitress out to serve ice water. Richard Worth, a spokesman for the Regional Public Transportation Authority in Phoenix, said all of the buses currently on order “will offer wheelchair accessibility.” Of the 54 bus routes in metropolitan Phoenix, eight offer wheelchair accessibility, Worth said, and 49 of the city’s 350 buses, or 14 percent, are wheelchair accessible. Handicapped ridership on Phoenix’s routes is estimated at 509,000 per year, or 3 percent of total ridership, he said.

April 8, 1987 B-5 37 more arrested in protests by handicapped By Scott Craven The Phoenix Gazette Police arrested 37 members of the American Disabled for Accessible Public Transit, most of them for trespassing after they refused to leave the Phoenix bus depot until they were able to board a bus. That brings to 69 the number of arrests police have made since the group arrived in Phoenix Saturday to protest the policies of the American Public Transit Association. Most of those arrested Tuesday were booked into the Towers facility of the Maricopa County Jail, where they were expected to stay the night because they could not raise bail, according to police spokesman Sgt. Ken Johnson. He said the typical bond for trespassing is $206. Although some ADAPT members were arrested at the state Capitol and the downtown Hyatt Regency, site of the convention, most were taken into custody at the bus terminal at Washington Street and Central Avenue. The ADAPT members were attempting to board buses, none of which were equipped with lifts for the disabled. The group is protesting because it wants all buses nationwide to be equipped to handle wheelchair-bound people. ADAPT organizer Mike Auberger said it was a frustrating battle. “Here we are, tourists in the middle of Phoenix, and we can't get a bus to see the rest of the city,” he said at the terminal. “No one else has that problem. We should have the same rights as everybody else." Police arrested 27 ADAPT members Sunday after they blocked the driveway to Rustler's Rooste at the Pointe South Mountain. Austin American-Statesman Sunday, October 25, 1987 Lifestyle section Title: Streetcars and Desire Activist couple dedicate lives to tearing down walls between city buses and the disabled By Carlos Vidal Greth, American-Statesman Staff (This is a compilation of the article that is on ADAPT 354 and ADAPT 353. The content is all included here for easier reading.) Most visitors to the Bay Area relish the opportunity to hop a cable car and "climb halfway to the stars," as Tony Bennett croons in his signature song, I Left My Heart in San Francisco. Stephanie Thomas, organizer for Americans Disabled for Accessible Public Transportation, had other ideas. "To mobility-impaired people, keeping those historic symbols of public transit alive memorializes inaccessibility and makes it seem like a positive thing," she said. ADAPT, a national civil-rights group, strives to make it easier for disabled people to ride city buses. They differ from mainstream disability-rights groups in that members sometimes commit acts of civil disobedience when the usual political channels clog or hit a dead end. Thomas, her husband Bob Kafka, and eight other Austinites went to San Francisco in late September to conduct a protest during the national convention of the American Public Transit Association, a lobbying organization. Kafka and 15 others were arrested when they climbed out of their wheelchairs and staged a sit-in at the cable car turnaround at Powell and Market streets. Thomas was arrested twice, once for blocking a shuttle bus and once for blocking a cable car. "I've been arrested eight times or so," she said. "I've lost count. Bob has been arrested 14 times. The police are usually aware it's a demonstration about civil rights, and that we're not out to hurt their city. But it's scary. We're not automatons. Some members break down and cry when they go to prison." As far as Thomas is concerned, the suffering has been worth it. "The demonstrations got national exposure. More important, we got the transit association's attention. They are beginning to listen." Thomas, who is also executive director of the Coalition of Texans With Disabilities, could sit for a poster portrait of the committed political activist. Her shock of amber hair shifts of its own accord like the wind ruffling a field of grain. Wide, blue eyes fix visitors with the riveting gaze of a woman who believes she fights for what is right. She was born 30 years ago in New York to parents who fought for justice in their way. Her father organized political campaigns and worked for arms control. Her mother, a writer, was involved in the women's movement. "Mom taught me to question people's perceptions," Thomas said. "The women's and disabled movements have something in common: We're defined by our bodies. You have to fight that all the time." Her first protest occurred when she was in elementary school. Mothers in the apartment building where her family lived wanted to establish a day-care center. The owners didn't want to provide the space. "Women and children took over the building," Thomas said. "We weren't angry college protestors. We were non-threatening moms and kids. But our presence made a difference." Despite her progressive upbringing, she was a shy girl who hid from the world behind the covers of books. When she was 17, her legs were paralyzed when she fell off a farm tractor while doing chores. What could have been a tragedy turned her life around. "I realized that life doesn't go on forever, and that you need to make the most of every moment," Thomas said. Thomas attended Harvard, where she and other disabled students organized a group to help make campus more accessible. "When I look back, I see we were very tame,” she said. “We were polite but usually got what we asked for.” Over the years, Thomas became increasingly active in disability rights. She got involved in independent living centers, communities of disabled people supporting one another so they can live with dignity outside institutions. In the early 1980s, she joined the Austin Resources Center for Independent Living. She went to work for the Coalition of Texans With Disabilities in 1985. The 9-year-old coalition lobbies for, represents and coordinates 90 organizations (including ADAPT) concerned with disabilities, as well as the more than 2 million disabled Texans. “It is the collective voice for the disabled in Texas,” said Kaye Beneke, spokeswoman for the Texas Rehabilitation Commission. "They’re committed - the members live every day with the problems they try to solve. “Stephanie understands there’s a spectrum of political views in the coalition, which tend to be more middle-of-the-road than ADAPT. She takes responsibility for the representing of all those views. But don’t call the coalition passive. They’ve had their way in the legislature and on the local level.” As a leader in two of Texas major disability-rights organizations, Thomas has her hands full. It helps having Bob Kafka, who broke his back in a car accident in 1973, at her side. The experienced trouble maker -- albeit trouble for a good cause -- has made a name for himself. He won the Governor’s Citation for Meritorious Service in 1986. Appropriately, Kafka met Thomas at a disability-rights conference. “Stephanie was real involved, real committed and real attractive,” he said. Sharing home and office has increased their commitment to the cause they serve- and to each other. “Bob and I are an activist couple,” Thomas said. “It’s intense because we work so closely. But it’s rewarding. It has made us an incredibly tight couple.” Thomas has to rework her concept of activism when she joined ADAPT. “Demonstrations force the public to look at disabled people in a different light,” she said. “The cripple is the epitome of powerlessness. We say we’re sorry if it scares you to look at me, but we have to live our lives.” Confrontation, however can cost allies as well as foes. This year, the Paralyzed Veterans of America severed ties with ADAPT and any organization "advocating illegal civil disobedience.” “Our charter states that we must act in accordance with the laws of the land,” said Phil Rabin, director of education. “To act otherwise would be to violate our charter. “The veterans and ADAPT members share first-hand the frustration of living in a society that is not accessible to the disabled. We don’t want to fight ADAPT. It’s a waste of precious resources to divert our energies.” Though Thomas’ group is controversial, it has achieved many of its goals. Albert Engleken, deputy executive director for the American Public Transit Association in Washington, D.C., acknowledged that ADAPT’s street theater has had some effect. In September his organization created a task force to study the issue of providing service for disabled, he said. Engelken, however is not a convert to their cause. “ADAPT wants a lift on every transit bus in the country,” Engelken said. “We believe it should be left to local transit authorities to decide how to handle transportation for disabled people. Transit officials are not robber barons. We’re paid by the public to provide the most mobility for the most people.” Thomas knows how to work within the system. Ben Gomez, director of development for Capital Metro, said ADAPT members have been effective on the Mobility Impaired Service Advisory Committee, which makes recommendations on service to the transit authority board of directors. “They’re well-organized,” Gomez said. “We don’t always agree on the approach and issues. We’ve made many of the adjustments they’ve asked for, but not always within their time frame.” The concessions have been gratifying, but Thomas has only begun to fight. “ADAPT took a dead issue änd made it hot again,” she said.
