4B / Las Vegas Review-Journal Monday, April 10, 1989 [Headline] Disabled protesters arrested in Sparks Associated Press SPARKS — About 75 wheelchair-bound people blocked the entrances to a casino Sunday to protest what they called their lack of accessibility to public bus systems. Police said about 40 protesters were arrested by late Sunday evening and more arrests were expected. Members of a national group calling itself The American Disabled for Accessible Public Transit staged the protest by chanting slogans and blocking entrances to the Sparks Nugget. The target of the protest was the American Public Transit Association, which is holding its western regional meeting at the Nugget through Wednesday. The association represents the nation’s bus and rapid transit systems. The transit association opposes a move to install wheelchair lifts on new public buses and the disabled group sought a meeting with its leaders inside the casino to discuss the issue. “We try to make their conventions as inaccessible to them as they have made transportation to disabled people,” said protest organizer Mike Auberger of Denver. “They can't just come and have fun.” However, Nugget security personnel blocked outside entrances to the protesters and denied them access, saying they posed a threat to the safety of casino patrons. Police said four protesters were arrested on a charge of blocking a roadway on the group’s march to the Nugget, while 36 others were arrested at the casino on a variety of charges, including obstructing justice and blocking a fire exit. Protesters started out by blocking two entrances and later blocked all but one entrance for a brief time. Police said they were forced to drag several protesters away from the doors after they resisted arrest. In February, the 3rd U.S. Circuit Court of Appeals in Philadelphia ruled in favor of the disabled group, saying all new public buses purchased with federal funds must be equipped with wheelchair lifts. Auberger, who uses a wheelchair because of a neck injury suffered in a bobsledding accident, said only about a dozen U.S. cities now have buses with the lifts. “We want to be able to wait in the rain and hot sun and ride a bus like everyone else," he said. “The lifts would force integration and change the way most people view disabled people.” However, Jack Gilstrap, executive vice president of the transit association, said his group opposes the court ruling because of the cost involved. “Every lift costs $15,000 and they’re very expensive to maintain,” he said. - ADAPT (532)
3/14/90 100 Disabled Arrested on Hill by Stephen Buckley, Washington Post Staff Writer About 100 persons with disabilities were arrested in the Capitol Rotunda yesterday during a demonstration calling for greater rights for the handicapped, U.S. Capitol Police said. Most of those arrested were members of American Disabled for Accessible Public Transportation, a Denver-based organization that plans protests in Washington throughout the week to bring attention to the Americans with Disabilities Act. The measure was passed by the Senate last September and is being considered by the House. Yesterday's arrests occurred after about 150 members of ADAPT listened to House Speaker Thomas S. Foley (D-Wash.), House Minority Leader Robert H." Michel (R-Ill.) and Rep. Steny H. Hoyer (D-Md.) discuss the disabilities act. After the lawmakers spoke to them, the demonstrators began chanting. They were asked to leave the rotunda, but refused, said Greg Nevitt, a U.S. Capitol Police spokesman. Those who did not leave were arrested, he said. Hoyer is the chief sponsor of the Americans With Disabilities Act, which seeks to bar discrimination against those with disabilities in several areas: private sector employment, public accommodations, services provided by state and local governments, telecommunications and transportation. By Pat Burson, Staff Writer More than two dozen disabled activists were arrested Wednesday after they halted bus service at the Greyhound bus station in downtown Atlanta for nearly five hours by blocking driveways with their wheelchairs and, in some cases, chaining themselves to the buses. The demonstrators, who were in town this week to protest the lack of accessible transportation, were driven to jail in a lift-equipped transit bus. Those arrested were charged with criminal trespass, disorderly conduct and failing to clear streets and sidewalks, said Atlanta police Maj. J.L. Mullins. They were released later on their own recognizance. More than 100 disabled protesters wearing headbands and carrying placards began encircling the bus terminal at 3:30 pm. with the majority lined up against the front of the building along International Boulevard. chanting, “We will ride" and “Access is our civil right." Others moved to the back of the terminal and blocked five buses by parking their wheelchairs in front and behind to prevent the drivers from leaving the station. During the protest, police also closed International Boulevard between Spring and Williams streets and rerouted rush-hour traffic. Greyhound officials declined to comment on the protest, which effectively closed the station until 8 p.m. One demonstrator, Clayton Jones, 41, of Houston, pulled himself into the driver‘s seat of an unoccupied bus and chained himself to the steering column. Earlier in the afternoon, he chained himself to the rear wheel of a bus. “I am trying to hold up Greyhound because they are holding up my life," said Mr. Jones, who lost the use of his legs in a 1985 accident. Mr. Jones said he has tried to ride Greyhound alone, but could not because of its “Helping Hands" policy, which requires a passenger in a wheelchair to be carried on and off the buses but allows a companion to travel with the disabled passenger free of charge. The policy also prohibits battery-powered wheelchairs inside the buses. “Is this a free America?" Lillibeth Navarro of Los Angeles shouted at police, draping a full-sized American flag around her body as other protesters were being loaded into the lift-equipped bus. “You are abetting Greyhound’s discriminatory policies!" The bus station was a new target for members of American Disabled for Accessible Public Transportation, or ADAPT, who spent Monday and Tuesday occupying the main floor of the Richard B. Russell Federal Building several blocks to the south. They protested outside the Atlanta Hilton Hotel on Courtland Street on Sunday, where the American Public Transit Association (APTA) is holding its annual convention. Atlanta was chosen as the target for the protests, even though MARTA only buys handicapped-accessible buses, because of the APTA convention here. The Denver-based ADAPT is demanding that all public buses purchased with federal dollars be made handicapped-accessible through installation of wheelchair lifts. The demonstrators targeted Greyhound, one of their major foes in the transportation industry because it does not have lift-equipped buses, will not transport people using electric-powered wheelchairs and requires disabled passengers to travel with their own attendants when they ride on its buses. Tom Street, regional general manager for the bus line, said only four buses carrying a total of 80 passengers left Atlanta during the protest. On a normal evening, 20 buses carrying up to 600 passengers would pass through the terminal. The protest came as a surprise to some who thought victories won by the protesters with federal officials Tuesday would have sent them packing. The protesters met with Steven A Diaz, chief counsel for the Urban Mass Transportation Administration, who told them he would ask Transportation Department officials to meet with them to establish a process to identify public transit authorities that are deliberately speeding up purchase of new buses to circumvent a bill pending in Congress mandating that such buses have wheelchair lifts. Protesters swarmed on the first Greyhound bus that pulled up to the International Boulevard entrance about 4:30 p.m. Three people in wheelchairs and one man who is blind sat in front of the bus, arms linked, while several other protesters went to the side of the bus. One man maneuvered himself out of his wheelchair and onto the steps of the bus while bewildered passengers looked on. One angry passenger screamed obscenities at the protesters as she stepped over the man lying in the doorway. “I just got out of Hardwick prison camp," said the 32 year-old woman, referring to the Georgia Women's Correctional Institution. “We left Hardwick at 8:30 and changed buses three times before we got to Atlanta. I want to go home. “I haven't been home in eight months. I have people waiting at the bus station for me. I said this morning, ‘I‘m free at last,‘ and I come to Atlanta and see this!" Greyhound officials called in police while protest leaders talked by phone to representatives of the bus company at its Dallas headquarters. Most protesters allowed officers to maneuver their wheelchairs over to a lift-equipped bus the police called to the site for the arrests, while others chose to evade police. 3/14/90 Disabled demonstrators arrested at U.S. Capitol WASHINGTON (AP) — Police arrested disabled demonstrators who chanted slogans and chained their wheelchairs together in the Capitol on Tuesday in a protest demanding quick passage of a bill guaranteeing their civil rights. The arrests came after deliberate arts of civil disobedience by the demonstrators and a confrontation in the Capitol's cavernous Rotunda with House Speaker Thomas S. Foley and Minority Leader Robert H. Michel. Some 75 protesters were arrested, many of them in their wheelchairs. Removing the demonstrators and loading them into vans look police about two hours. Those who could walk were handcuffed, and some in wheelchairs were strapped into their seats by police. Those arrested were charged with two misdemeanors, unlawful entry and demonstrating within the Capitol, said police spokesman GT Nevitt. Both carry maximum sentences of six months in jail. In addition, those convicted could be fined $100 for unlawful entry and $500 for demonstrating in the Capitol. The arrests marked the second day of dramatic lobbying by people with disabilities, who are seeking passage of the Americans with Disabilities Act. On Monday, some 60 people crawled out of their wheelchairs and up the West steps of the Capitol to underline their demands. Rocky Mountain News [ Headline] 30 disabled activists arrested Protest at Radisson aimed at transit group gathering By LEROY WILLIAMS JR. Rocky Mountain News Staff Writer Police yesterday arrested about 30 disabled activists who disrupted a national transportation conference at the Radisson Hotel in downtown Denver by blocking the hotel's front doors with wheelchairs. The midmorning protest by members of ADAPT, American Disabled tor Access to Public Transit, came on the opening day of a symposium sponsored by the U.S. Urban Mass Transportation Administration. Protesters chanted, sang and cheered as a half-dozen Denver police officers carried off the protesters, about 27 of them in wheelchairs, in specially equipped vans. The job was made more difficult for police by protesters who wheeled in front of the vans to block them. And officers used wire cutters to free three protesters who chained themselves to railings. Police Capt. Roger Kaspers said the arrested were cited for obstruction of access to a business and a public sidewalk. He said they were not jailed. ADAPT’s national strategy of blocking bus companies and public transit operations that lack equipment for the handicapped is not new. But members said it was the first time they had protested against UMTA. At issue is an appeal by the U.S. Department of Transportation, of which UMTA is a part, of a federal court ruling requiring all public transit agencies to equip their buses with wheelchair lifts. The order was theresult of a lawsuit brought by ADAPT. "We view that (appeal) as a hostile action" said ADAPT activist Maureen O'Rourke, who said the process would be delayed by four or five years. "We are tired of winning lawsuits and never getting them implemented." In an interview later yesterday, outgoing UMTA administrator Alfred A. DelliBovi defended the appeal, saying the agency prefers to leave transit agencies’ decisions on equipment for the handicapped to local agencies. DelliBovi lauded Denver's Regional Transportation‘ District, which has so far awarded $40 million in bus operations contracts, as a pace-setter in that area. He also said one of his last acts — or his successor's first -- will be to sign over about $65 million to help pay for construction of a busway along Interstate 25 north of Denver. DeliiBovi, who is soon to become undersecretary of the Department of Housing and Urban Development, repeated the theme of his keynote address and of the symposium: Dwindling federal resources means local transit agencies must figure out ways to save money by involving the private sector. Disabled occupy House offices; 59 are arrested By Frank Wolfe and Sonsyrea Tate The Washington Times 3/15/90 About 300 disabled demonstrators from 40 states occupied two congressional offices and the House Judiciary Committee room in the Rayburn House Office Building for about five hours yesterday before Capitol Police began making arrests. The participants at times discarded wheelchairs and dropped to the floor in one representative's office as part of their demonstration for passage — without weakening amendments — of the Americans with Disabilities Act. Last night, 59 persons were arrested for unlawful entry when they refused to leave the building after the House ended its session about 8 p.m., Capitol Police said. The rest of the demonstrators left peacefully. Police, some wearing optional rubber gloves, carried the demonstrators out. The protest began about 3:15 p.m. when the activists, including 101 arrested Monday in the Capitol Rotunda, occupied the offices of Reps. Hamilton Fish Jr., New York Republican, and Bud Shuster, Pennsylvania Republican. Members of the group also occupied the meeting room of the Judiciary Committee, which is slated to consider the bill. It has passed the Energy and Commerce Committee by a 40-3 vote. But one of the amendments would make flexible the requirement that mass-transit authorities provide lift-equipped transportation for disabled people. Authorities could choose instead to provide “paratransit" services such as minivans. Protest leaders are concerned that such flexibility would lead to “segregated busing" in many states, said Mike Auberger, co-founder of American Disabled for Accessible Public Transportation and one of the protest organizers. Mr. Shuster was in a meeting of the House Select Committee on Intelligence yesterday afternoon and belatedly learned of the protest. Mr. Fish, ranking minority member of the House Committee on the Judiciary, offered his support for the bill with no weakening amendments and said he would use all measures available to him to defeat any such amendments, according to Ed Tessier, a quadriplegic who helped to organize the protest. Those assembled in Mr. Fish’s office then left. Later in the afternoon, demonstrators occupied Mr. Shuster‘s office, demanding to see the congressman and hoping to make it difficult for staff employees to leave. Mr. Shuster, a member of the House Public Works and Transportation Committee, acknowledged the demonstrators’ grievances and said the proposed transportation budget is severely lacking in money allotted for mass transit. “My heart goes out to them," the congressman told The Washington Times in a telephone interview. “I'm in a unique position. My mother was a double amputee in a wheelchair. I have more intimate experiences with the plight and problems of the disabled than perhaps any other member of Congress." The bill is slated for two other House committees, the House Committee on the Judiciary and the House Committee on Public Works and Transportation — committees the two congressmen sit on - before reaching the floor of the House. Mr. Shuster said that 100 percent federal mandate" wheelchairs would add 10 percent to the cost of buses and would provide “zero accessibility" for the thousands of disabled who need more comprehensive para-transit services, such as the minivan to transport them to bus stops. "This is a feel-good bill," he said. “There is no money accompanying the bill to pay for the costs it is proposing." He cited New York City, where he said there is, on average, one wheelchair rider per 19 buses, as an example of the need for a mix of lift—equipped buses and paratransit services. I was one of 200 people with disabilities who converged on Atlanta three months after the historic ADA was signed, to raise the banner of ADAPT’s new demand: a clear-cut national policy on attendant service programs. The lack of basic attendant services keeps one million disabled Americans imprisoned in nursing homes when they could be full-fledged, contributing members of society. While it costs $30,000 a year to keep one of us in a nursing home, the cost of providing attendant care services for the same person is $4,000 to $6,000 a year. In an ever-deepening federal budget crisis, ADAPT’s simple proposal will cost not a single penny, but simply redirect 25% of the funds currently spent on nursing home care. Attendant services in fact save money and cut the deficit by allowing all Americans — not just the able-bodied — to be productive workers, taxpayers. October’s action for disability rights at Morehouse College in Atlanta was the national kickoff for this vital issue. Morehouse College’s most famous graduate is Martin Luther King, Jr. Our protest there followed in King's grand tradition of non-violent passive civil disobedience. Morehouse College is also the alma mater of U.S. Secretary of Health and Human Services, Louis Sullivan — the man with the power to push for a new national policy on attendant services. ADAPT had written to Secretary Sullivan months in advance, asking for a meeting. Sullivan was scheduled to be in Atlanta the week before. ADAPT asked for an hour of his time. Sullivan did not respond. More than fifty of ADAPT’s demonstrators took over the President's office at Morehouse College for the night of October 1st. A young boy saw news of our protests on TV that evening. He stayed up late into the night to make a sandwich for each demonstrator, pack each sandwich into a bag, and write on every bag: "You are my Hero." The boy and his mother delivered those hero sandwiches to the demonstrators the next morning. When we returned from the college, street vendors along the route stood up and applauded our wheelchair parade. At another protest in Decatur, Georgia, traffic stopped several times on a four-lane highway while the drivers honked their horns in support of the issues we raised. On October 3, we forced the issue further, blockading the doors of the Federal Building. [See photos...] During the four hours it took for the police to arrest 64 people with disabilities who were blocking the entrance, one police officer took a break to speak with a woman in a wheelchair who waited to be loaded onto the arrest bus. The cop said that his wife had just suffered a stroke. Because there is no attendant services program in Georgia, he expected to see his wife go into a nursing home — against both their wishes — within the next six months. The woman he had arrested told him that's why she was demonstrating: to speak for people like his wife who couldn’t speak out themselves. After the woman was loaded onto the arrest bus, the policeman asked to hold her hand. She reached out the window. He took her hand. Then he cried. Please, let us all put our anger into action and speak out for attendant services. Whatever happens — jail or heroism or both — we're going all the way. The protest is being staged by a national group called The American Disabled for Accessible Public Transit, and its target is the western regional meeting of the American Public Transit Association. As many as 700 people representing public bus systems, including many that don’t have buses with lifts to handle wheelchairs, are expected to attend. In protests at 16 other cities in recent years, disabled protesters have held marches, crawled onto or chained themselves to buses, and barricaded hotels where the public transit association held its meetings. “We try to make their conventions as inaccessible to them as they have made transportation to disabled people ” said protest organizer Mike Auberger of Denver. “They can’t just come and have fun." Auberger, 34, said he met earlier this week with representatives of Sparks police, the Washoe County Sheriff’s Department and Nugget security. He was handed a 32-page list of possible violations, including felonious assault, that his group could be charged with. “From what I heard, the police department’s tactic is going to be to intimidate,” Auberger said. “I wouldn’t be surprised to see the police on Sunday in riot gear.” Auberger, who arrived in town Monday to prepare for the protests, said he expects about 150 handicapped people from around the country to show up. Auberger said he met with members of the Sparks and Reno police, the Washoe County Sheriff’s Department and court marshals Tuesday. “It’s definitely threatening but I think the people coming in here are well aware of what could happen to them,” Auberger said. Already Auberger has had a confrontation, albeit a friendly one, with Nugget security and Sparks police. Monday when Auberger was casing the outside of the Nugget, with video camera in hand, a security guard and a police officer approached him and knew him by name, he said. “It gave me a real feeling for how the police are going to respond and how the casino security will respond," Auberger said. “It was like the casino burped and the police said ‘Excuse me,’ and that’s not normal." Auberger said his group has yet to begin drawing up strategy on how it will carry out its demonstration. However, Auberger predicted his group won’t be happy with being confined to B Street. “(The location) is very visible to traffic on B Street but it won’t be visible to APTA members,” Auberger said. “The spot is perfect if your issue is with the public or if it's directed at the Nugget." Auberger said his group is not violent although it is confrontational. Zamboni showed the press a 10-minute video tape of an ADAPT demonstration held in San Francisco Sept. 28, 1987. The video tape showed demonstrators blocking a SAMTRANS bus and tying their wheelchairs to the vehicle's wheelspokes and sitting on the Powell Street cable-car tum-around. The arrests marked the second day of dramatic lobbying by people with disabilities, who are seeking passage of the Americans with Disabilities Act. On Monday, some 60 people crawled out of their wheelchairs and up the West steps of the Capitol. The bill would outlaw discrimination based on physical or mental disability in employment, access to buildings, use of the telephone system, use of public and private transportation and in other uses. It would require ramps or other means of access in all new buildings used by the general public, including private businesses and offices. The Senate passed the bill last year but the measure has bogged down in the House despite widespread predictions of ultimate approval. While the demonstration was in progress. the House Energy and Commerce Committee approved the bill 40-3 at a meeting in another building. The measure still must go to two other committees before reaching the full House. Before the arrests, Foley assured demonstrators that he and other congressional leaders were pushing the bill. The Washington Times Wednesday, March 14, 1990 Handicapped protesters arrested The Associated Press Demonstrators in wheelchairs were arrested in the U.S. Capitol yesterday after confronting House leaders with demands for quick passage of legislation guaranteeing them civil rights protections. A crowd of more than 100 disabled demonstrators threatened civil disobedience and interrupted House Speaker Thomas Foley and House Minority Leader Robert Michel as the congressional leaders tried to speak over the din in the cavernous Capitol Rotunda. After the congressmen left, about 70 disabled people assembled in the center of the Rotunda and began chanting in an attempt to provoke arrest. Capitol Police, standing nearby, encircled the protesters and began taking them into custody. Outside the Capitol, police began placing the protesters - most in Wheelchairs - into several government owned vans. The demonstrators were being charged with unlawful entry and demonstrating within the Capitol, said Capitol Police Officer G.T. Nevitt. The first charge carries a maximum sentence of six months in jail and a $100 fine; the second, six months in jail and a $500 fine. “It is a priority for passage in this session of the Congress," Mr. Foley shouted over catcalls from the protesters. “l am absolutely satisfied it will reach the floor. we will have a conference with the Senate and it will become law." “Will it be on the floor in 24 hours? No," Mr Foley added in a statement greeted with a chorus of boos. “I am not going to set an artificial deadline that prevents the committees from sending a bill to the floor that they can defend," he said. The Gazette, Montreal, Monday, October 3, 1988 Final [edition] 50 cents Title: Police arrest 28 wheelchair activists after protest in hotel lobby By Michael Doyle and Catherine Buckie of the Gazette Twenty-eight wheelchair protesters were arrested and charged with mischief last night after 50 of them staged a noisy demonstration in the lobby of the Sheraton Center on Dorchester Blvd. The protesters were demonstrating against the lack of mass transit facilities for the handicapped. They sang We Shall Overcome and chanted “Access is a Civil Right!” as they blocked off elevators and escalators at the downtown hotel. Police took the wheelchair activists to the Bonsecours St. station. They were to be arraigned before a judge at 1 a.m. today. “We don’t want to hold them for nothing,” said Const. Bernard Perrier. “We want to put them before a judge as soon as possible. It will be up to the judge to decide what happens to them after that.” The demonstrators were mostly members of a U.S. group, American Disabled for Accessible Public Transit (ADAPT). They are here to badger transit-authority representatives from across the continent – including officials of the Montreal Urban Community Transit Corp. – who are attending the convention of the American Public Transit Association. “We’re just trying to make their convention as inaccessible to them as public transit is for us,” group organizer Rev. Wade Blank of Denver, Colo., said earlier that day. A squad of about 80 police officers was called in to clear the hotel lobby. One protester, Bob Kafka, a 42-year-old Vietnam veteran from Austin, Texas whose neck was broken in a car accident, had chained himself to a railing in the lobby. Police cut the chain with shears. The activists decided to demonstrate at the Sheraton because a large number of delegates to the transit convention are staying there, Kafka said. “We’re sorry for the inconvenience, but we’ve been inconvenienced all our lives,” he said. Hotel general manager Alfred Heim, who used a bullhorn to read a portion of the Eviction Act to the protesters before the police moved in, said he expected some trouble because the protesters attend each transit convention. The demonstration closed the westbound lanes on Dorchester Blvd. outside the hotel for about two hours. It was the second time yesterday that the demonstrators had disrupted traffic on Dorchester Blvd. Earlier, more than 75 of the wheelchair activists blocked traffic outside the Queen Elizabeth Hotel, site of the convention. Police there put up barricades to contain the activists, who were eventually allowed to line up single-file on the north side of the street, away from the hotel entrance. [Headline] Demonstrators ride paddy wagon, not buses By Yvonne Duffy When Mike Gambatto retired from the Detroit Police Department after an on-the-job injury, he probably never thought that one day he would be arrested for obstructing traffic on a public street. He felt so strongly about the importance of Detroit buses being accessible to persons with disabilities, however, that on the morning of November 23 he drove from Lansing to downtown Detroit to join other demonstrators, most of whom were users of wheelchairs or three-wheelers. In 1987, Gambatto was one of the plaintiffs in a class action suit in which the Wayne County Circuit Court ordered the Detroit Department of Transportation (DDOT) to purchase and maintain lifts on their buses and awarded $2.5 million in damages to the more than 1,110 people eventually included in the suit. This protest occurred because this October the MI Court of Appeals overturned the earlier decision, ruling in favor of DDOT and eliminating the monetary damages. The group of about twenty-five huddled at the intersection of Woodward and East Jefferson in hooded jackets, mufflers, mitts, and occasional afghans under a sullen grey sky punctuated by freezing rain and snow flurries. As the traffic light turned red, Gambatto and nine other chair and cart users rolled onto the road to arrange themselves so that when the light changed, traffic was completely blocked on the busy downtown street. Horns honked, and a few drivers got out of their vehicles. One driver, upon learning that the protestors were demonstrating for their right to use the city buses like everyone else, exclaimed, “I’m with you!” raising his hand in the victory sign as he returned to his car. The police were ready. Within minutes, the sergeant in charge approached Frank Clark, a post-polio retiree with a long history of activism to make Detroit more accessible, and informed him that if the group did not return to the curb they would be arrested. When they refused, the paddy wagon, which had no lift, was brought in, and officers began hoisting up the chair users. The chair of one tipped perilously to one side as he was loaded into the van. Gambatto asked to be lifted in separately from his three-wheeler, which sometimes comes apart when lifted. An assisting officer asked if Gambatto had been injured in the line of duty. The fourteen-year veteran of the force explained that a nerve in his neck had been injured when he had attempted to break through a chained door to apprehend a man who had just stabbed a little girl, resulting in a multiple sclerosis-like condition. The officer, visibly moved, replied, “I never actually met a policeman that was hurt on the job before. This hurts- it hits home.” Gambatto was elated about his participation on the demonstration. “I felt like we were doing something worthwhile out there,” he said. “We weren’t breaking a law just to break a law. We were making a point that really needed to be made- that the buses are inaccessible in the City of Detroit.” As mobility Coordinator at Michigan State University’s Program for Handicapper Students, he has become even more keenly aware of the financial and social costs of failing to make public transportation to accessible. “Instead of buying [unreadable], we, as a society, are paying for people to stay home- often for their whole lives. We waste human minds because we’re too cheap to buy wheelchair lifts.” The demonstrators were driven a few blocks to police headquarters where they were given the option of receiving tickets. During the two hours it took for processing, they were held in an unheated storeroom off the garage. There were no accessible restrooms. Nevertheless, there was general agreement among the demonstrators that the Detroit police displayed exemplary sensitivity and courtesy during the arrest and booking. “They were nice to the point of graciousness,” said Verna Spayth of Ann Arbor, an organizer of the action. According to Spayth, the police sergeant, whose late brother had been a polio quad, seemed aware that by his decision to arrest, he rescued them from the freezing rain and, at the same time, attracted attention to their protest by making it a newsworthy event. Ironically, George Harrison, a Detroit resident for 25 years and a wheelchair user for the last six, almost never made it to the protest because the bus driver did not know how to operate the lift. He was fortunate that a more knowledgeable bus driver riding to work came to his rescue. When Roger McCarville of Ortonville, whose both legs were amputated, heard about Harrison’s experience, he “knew he was in the right place.” Citing accessible public transportation as essential for a quality life, McCarville, who owns a company, Handicap Transportation, which carries people with disabilities to non-emergency medical appointments, says, “Lives go beyond medical. There’s a whole social aspect out there, and there’s no service available.” Many who live outside the metropolitan area put themselves on the line to demonstrate unity with their brothers and sisters with disabilities even though they personally did not need the service. For Spayth, Advocacy Coordinator at the Ann Arbor Center for Independent Living, who, last fall, chained herself with several other to buses in downtown Detroit but was not arrested, every opportunity to forge a sense of community is precious. She says, “Whether you get arrested or not, once you’ve chained yourself together with other people with disabilities, it’s totally impossible to look at those people again as separate individuals. Even without words, a bond is created there.” Scott Heinzman of Livonia, adds, “Even though I’m not expecting anything, there could be a time when I might need the help of people in other communities to bring attention to an issue.” For Heinzman, participating in the protest was important for other reasons. Sharing the view that Detroit has been hurt by the mass exodus to the suburbs, he feels that, as a suburban resident, he wants to give something back to the city. “People are people everywhere,” he says, “and if there are problems, problems can be solved.” Heinzman serves on the Advisory Council of the Great Lakes Center for Independent Living, whose offices are in Detroit. A 28-year-old quad, he is also bringing much-needed exposure of children to people with disabilities, through his activity with the Boy Scouts and his local Parent Teacher Organization. Ray Creech, a Canton resident, wanted to “show support for the people in Detroit who really need it [accessible transportation].” Occasionally, when he visits Trapper’s Alley or Greektown, he has tried to use the buses with mixed success. Spayth vocalizes a feeling shared by many in the disability movement: “The easy answer is that when we fight for disability rights anywhere, we fight for them everywhere, but, for me, it goes deeper than that. Every once in awhile, I feel the need to express my anger against my oppressors. What happens next in the fight to make DDOT buses reliably accessible and restore the monetary damages awarded by the lower court three years ago? The next step in the judicial process, according to Justin Ravitz, attorney for the plaintiffs, is an appeal to the Michigan Supreme Court. If the justices “have any sensitivity or allegiance to the law, they will surely hear our case,” he says. This process could take months or even years, however. Meanwhile, Detroiters with disabilities want to ride. She was one of more than 20 ejected after refusing to [unreadable.] Handicapped Protesters Forcibly Ejected From RTD Offices By BRAD MARTISILS, Denver Post Staff Writer One man was arrested and more than 20 handicapped protesters, some wailing and yelling and others kicking and resisting, were ejected forcibly from RTD headquarters Wednesday afternoon after they refused to leave voluntarily. The single arrest was made after Jeff Franek, 24, or 1123 Adams St. [unreadable] struck and knocked down an RTD employee. Franek, who isn't handicapped, was booked on suspicion of assault and released on a $50 cash bond. The demonstrators were removed from the building by about eight Denver policemen assisted by ambulance crews from Denver General Hospital. The ambulance [unreadable] there to assist demonstrators confined to wheelchairs included paramedics trained to handle disabled persons. Police also arranged for [unreadable] ambulance cabs to provide transportation for the demonstrators desiring it. THE PROTESTERS had occupied the fifth floor of RTD offices at 1225 S. Colorado Blvd earlier Wednesday. lt was one of a number of demonstrations over the past few months aimed at pressing RTD officials to provide more service for handicapped persons on regular bus routes. Protesters said they had planned to stay in the offices for three days. But when RTD's Executive Director John Simpson met with them shortly after 5 pm he explained that the building was closing and that they couldn't stay. The protesters refused to meet with him in a downstairs conference room. SIMPSON WAS interrupted by catcalls several times as he tried lo speak to the protesters. "You're not leaving me many choices," he told them when they refused to leave. Bob Conrad, 29, of 750 Knox Court, acted as spokesman for the protesters. When Simpson tried to explain RTD's policies, Conrad said he had been hearing the same explanations for years. "John, you've been telling us the same crap for three years," Conrad said. "We are being denied our rights because we can't ride the buses." Conrad said his group wants to take advantage of regular bus service. But Simpson said such service simply doesn't work for the handicapped. He pointed to a program in St. Louis, in which lifts were installed on 157 buses. In a year's time, he said, only 1,000 rides were given to persons in wheelchairs, at a cost of $200 per ride. THE IMPEDIMENTS to travel for the handicapped aren't primarily with buses," Simpson said. "Studies have shown that inability to get over curbs, to get to the bus stop, and to travel from the bus are much more important factors." Simpson said RTD's service -- which is due to be expanded -- is a better alternative than putting lifts on all buses. He said RTD's service accommodated more than 45,000 trips for handicapped persons in 1977, at a cost of about $10 per trip. He said service to the homes of handicapped persons is being provided by 12 special HandyRide buses. He said 18 more lift-equipped buses soon will begin running on fixed, circular routes, once their lift mechanisms meet the standards of the Denver Commission on the Disabled. Finally, he said 10 more specially equipped buses will soon begin running between RTD Park and Ride areas and various college campuses and shopping centers, where many handicapped persons need transportation. THE HANDYRIDE service operates by subscription, meaning the potential riders must arrange with RTD for the buses to stop at their homes. The fares are the same as for regular bus service. Simpson said the subscription service is filled to capacity, serving 55 wheelchair users and 78 persons with other disabilities. He said there is a waiting list of persons wishing to take advantage of the service. Simpson said equipping RTD buses with lifts to accommodate persons in wheelchairs would cost $4 million. Annual operating costs would be more than $6.5 million, he said. However, the protesters didn't hear his facts and figures because they refused to meet Simpson in the conference room and then were ejected. SEVERAL OF the protesters struggled violently when they were ejected from the building. At least one, Patsy Castor, 18, was slightly injured. She was hauled from the building struggling violently with ambulance crews call to assist police officers. A few onlookers said attendants purposely dropped her outside the door. Others said she struggled so violently that they dropped her accidentally. Wade Blank, director of the Atlantis Community for the handicapped in Denver, said the group was prepared for everything but forceful ejection. "We've asked to be arrested," he said, "But the way things look, I don't think we even have the right to expect that." - ADAPT (415)
St. Louis Post Dispatch, 5/13/88 Activists Derail Transit Group’s Welcoming Plans By Mark Schlinkmann, Regional Political Correspondent Officials have moved the site of a convention's welcoming ceremony Sunday night away from the Gateway Arch visitors' center because of fears of a protest by disabled-rights activists. Organizers of a transit officials' convention have moved the reception site to the Omni Hotel, the site of the convention. Better security can be provided at the hotel, a spokesman for the Bi-State Development Agency, Thomas Sturgess, said Thursday. Because most other activities connected with the five-day convention will be at the hotel, Sturgess said, "The participants already will be there." More than 600 people from across the country are expected to attend the convention, a regional conference of the American Public Transit Association. As many as 150 others affiliated with Americans Disabled for Accessible Public Transportation — known as ADAPT — are expected to be here to protest the organization's stand on wheelchair lifts for buses. Police say the protest group, including many in wheelchairs themselves, has a reputation for seeking arrest to dramatize their cause. Tactics in other cities have included blocking roadways and chaining themselves to buses, Bi-State officials have said. ADAPT wants the Transit Association to endorse 100 percent accessibility to buses and other public transportation for the disabled through the installation of wheelchair lifts by all its member systems. Disabled people should have the right to as much access to taxpayer-financed transportation as able-bodied people enjoy, ADAPT officials argue. "Our demand is that the association change its policy," said the Rev. Wade Blank of Denver, an ADAPT founder. The association "will not have their parties anywhere in the United States without people in wheelchairs making them inaccessible." Transit association officials respond by saying that although they support access for the disabled, wheelchair lifts are not the only way to provide it. Jack R. Gilstrap, executive vice-president of the Transit Association, said Thursday that about a third of the nation's transit systems use lifts on buses; a third have begun using vans to provide door-to-door service for disabled persons; and a third use a combination. The vans have a higher rate of use than wheelchair lifts on standard buses and so are less costly, he said. "We believe the local community ought to be deciding how this will be provided," Gilstrap said. "There really are some serious business and tax-payer considerations." ADAPT complains that "paratransit vans, which usually must be reserved in advance, segregate the disabled from the general public. "It's very similar to apartheid," Blank said. In St Louis, the Bi-State transit system is using a combination — developed in conjunction with a local committee of disabled persons. Almost 120 new standard buses equipped with wheelchair lifts are being purchased between now and early 1989. In addition, the system's "Call-A-Ride" van service for disabled people — now limited to parts of St. Louis County — will be expanded to cover all of St. Louis and St. Louis County in November. At that time, Bi-State also will begin issuing scrip that can be used by disabled persons to take taxis in certain circumstances. ADAPT officials have said the organization is satisfied with Bi-State's plans. But they have complained that Bi-State is allowing two of its buses to be used as paddy-wagons on call in the case of any arrests at the demonstrations. - ADAPT (543)

DISABILITY RIGHTS ADVOCATES TURN UP THE HEAT IN CAPITOL In more ways than one, the heat was turned up in Washington, D.C. during the week of March 11 to March 17, 1990. Weather records were shattered as the mercury climbed to 89 degrees on Monday and remained hot all week; the cherry blossoms at the Tidal Basin bloomed three weeks early. There was another heat wave going on as people with disabilities from all over the country converged on the Capitol to push for the Americans with Disabilities Act, which passed the Senate last September and is now stalled in the House. On Monday, March l2, we gathered in front of the White House at noon. Over 1000 strong, most in wheelchairs but including people who are deaf and blind, we marched down Pennsylvania Avenue, the 17 blocks to the U.S. Capitol. We carried signs and chanted “ADA Now!" At the Capitol, Justin Dart, chairman of the President's Committee, said that partial equality is not equality: “We want an end to discrimination against the disabled, the nation's most impoverished, isolated and segregated minority." King Jordan, president of Gallaudet University, warned “If we don’t get what we want, we will be back to stay." Mike Auberger, from ADAPT, closed with a stirring speech. “We are Americans," he said, “and we want the same rights as everyone else." After the speeches, many abandoned their wheelchairs and climbed the 83 steps on the west front of the Capitol, as a symbolic gesture dramatizing the barriers that the disabled still face. On Tuesday, many assembled in the huge rotunda inside the U.S. Capitol and heard speeches by Speaker Thomas Foley, Congressman Robert Michel and Congressman Stenny Hoyer of Maryland, who is coordinating the House legislative effort on ADA. Hearing that no promises could be given as to the date of a House vote, many started chanting “ADA Now!" Many were arrested for illegal entry, carried in police vans to a police facility and then to court for paper work. Many did not get back to the hotel until midnight. It was a matter of individual conscience whether anyone was arrested; many chose not to, believing that the legislative process has been working well so far. On Wednesday. about 60 were arrested at the Rayburn Building in and near the office of Congressman Bud Shuster of Pennsylvania, who had supported some weakening amendments to ADA. On Thursday, a small group (their numbers reduced because so many were in court) assembled at housing and urban development and asked to see secretary Jack Kemp; he was out of town but Undersecretary Alfred Dellabovi came down. There was a productive talk concerning the Fair Housing Amendment Act of 1988. Some weakening amendments to the Housing Act, relating to access standards, had been proposed; the disability groups strongly opposed. On Friday, some members of ADAPT protested at the Greyhound terminal. Some of the strongest opposition to ADA has come from Greyhound and other private bus companies, who fear that the cost of wheelchair lifts will be excessive. But the disability groups claim as much a right to be on a bus as anyone else. After a glorious week, the participants began the long journey home by train, bus, airplane or dust-covered van. Though many other disability groups were involved, much credit goes to Wade Blank, Mike Auberger, Bob Kafka, and Mark Johnson, all of ADAPT. It‘s too early to tell whether our goals have been reached, but there was a feeling of solidarity. and of a successful crusade on behalf of equal rights for disabled people in employment, in transportation, in housing, in places of public accommodation, in every aspect of American life.
