Fourth Wave Magazine (Washington University) [This article continues in ADAPT 729, 721 and 739, but it is included here in it's entirety for easier reading.] Wheelchair Warriors Story and Photographs by Jan Neely Editor's note: Last May, Fourth Wave editorial intern Jan Neely and I flew to Chicago for our first ADAPT demonstration. ADAPT (or American Disabled for Attendant Programs Today, as it is more formally known), first took to the streets 12 years ago in Denver, Colorado, to fight for wheelchairaccessible public transportation. Today, with the passage of the ADA securing transportation access, ADAPT has taken on the nursing home industry, institutions and the United States government in an attempt to provide community based personal attendant care and housing to all persons with disabilities in all 50 states. People are basically lined up waiting to move out. Article begins: DAY ONE: ADAPT arrives in Chicago. Its my first demonstration and my first job as a photojournalist. "Click, click" goes my camera. Everybody else may look cool. but I'm shakin' in my shoes. Try to picture 300 people (most in wheelchairs) on the same mission. No pro-nursing home advocate is safe here! I feel as if I've just entered THE ADAPT ZONE! Actually, the first day was mellow and taken up with pre-action planning. ADAPT doesn't have any membership rules or requirements. You just have to believe that people with disabilities have the right to live without putting up with abuse of any kind. I'm real excited because this is the first group I've ever been involved with that has people with all kinds of disabilities, not just developmental disabilities. DAY 2 Here's ADAPT (photo 1) blocking the doors of the auditorium in hope of catching Dr. Sullivan when he leaves. The Chicago police and the Secret Service put up barricades and pushed back the activists. Victoria Medgyesi, editor of Fourth Wave and my traveling buddy, used her press pass to get into where Dr. Sullivan was to ask him some questions. He refused to talk to her about Medicaid, ADAPT or nursing home abuse. Usually ADAPT doesn’t go around the country crashing graduations, but this one was different (photo 2) Here we are at the University of Chicago where Dr. Louis Sullivan, Secretary of Human and Health Services, is speaking to students who are going to be medical professionals. For the past two years, ADAPT has been trying to talk to Dr. Sullivan about redirecting 25 percent of the Medicaid budget for personal attendant care into a home-based program. But he has refused to talk to ADAPT or to change the rules. As the graduation crowd went in, ADAPT passed out flyers. As l told one person, “What if you become disabled someday? What if your family couldn't take care of you?" As for the police, at this time they just stood back and watched. One of the reasons ADAPT has public demonstrations is to make the public aware of what's important to people with disabilities. Actions like this keep us going to meetings back home even though what we say is usually ignored. DAY 3 The next day we went to one of ADAPT's all time favorite places to "act up": the state office of Health and Human Services. It was only a few blocks away from our downtown hotel. so all 300 of us got in a single line and went for a little walk. Did I say little? Wait a minute. a line of 300 people in wheelchairs plus their supporters? Little? I will admit it was the most incredible thing I have ever seen. ADAPT does not stop when it goes on one of its “little walks." It does not stop for lights, trucks, cars, cops, or anything else. It also goes right down the middle of the street. But that's not to say ADAPT isn't nice, oh no! All along the way ADAPT gave the people of Chicago (who lined up on the curbs to watch as we wheeled and walked by) little gifts of knowledge: flyers with the real scoop on nursing homes. It was a thrill to watch ADAPT in action. When the whole group got to the Federal building, it was a big mess. We blocked off streets and almost shut the building down. As ADAPT told the police, the media and all the people who gathered; “We declare this building a Federal nursing home... only this time, no one goes in or out without our permission! " The reason many activists do this is because they once lived in nursing homes and other institutions and know how bad those places are. Boy, can I relate. I have mild cerebral palsy and I’m lucky to have always lived at home. But will I always be lucky? I feel that as long as there are institutions, they will be a threat to the kind of life my friends and I want to live. This laid-back looking guy is Mike Auberger. He is one of the original ADAPT activists. ADAPT may look like a bunch of disorganized hippies who lost the map to Woodstock 20 years ago, but the opposite is true. In Mike's backpack is one of ADAPT's three cellular phones and the base walkie-talkie! Bill Scarborough, an activist from Texas, keeps the computer nerds in the know by sending the word out from his laptop computer to computer bulletin boards across the country. ADAPT also has a media person who goes to whatever city ADAPT is demonstrating in several days ahead to let people know whats going to happen. After nine long hours of blocking the building's doors, representatives from HHS finally agreed to meet in the street with ADAPT. It turned into a regular media pow-wow. Activists told the administrators and the media what was needed by people with disabilities. We talked and they listened, but I have a feeling the concern I saw on those experts' faces was just the same old B.S. All of ADAPT's demonstrations are non-violent, but they are important battles in a war fought by people who are fighting to lead decent lives. The possibility of being arrested did make me nervous. It made me feel a little better when ADAPT told the new people that, if you got arrested, the group would never leave you alone. They said ADAPT would tell the cops your needs, get you a good lawyer, and stay on the outside of the jail chanting so you would know ADAPT was with you. DAY 4 As l was getting dressed I thought to myself “Today ADAPT is taking on the AMA." Oh God. what have l gotten myself into? l mean the AMA! The Big Brother of the medical world; the people who are not only in charge of admissions to nursing homes, but who are also in charge of giving prescriptions to people like me. I thought: What if my doctor saw me and did not like what I was doing with ADAPT? Would he stop giving me my blood pressure pills that I can't afford to buy? What would happen then? What about the others? Aren't they in the same boat? I got a lot more out of my trip to Chicago than just a story and a few good pictures. I met some people who are important to the disability rights movement. I felt accepted and I came home with the feeling that together we can really change things. People with disabilities need to keep talking. We need to demonstrate. We need to tell the so-called "experts" the real truth and try not to be too afraid while were doing it. Morehouse president’s office blocked By Ben Smith III, Staff writer Saying Dr. Martin Luther King Jr. would smile on their protest, nearly 200 disabled activists on Monday seized the administration building on the campus where he was educated. The demonstrators, members of Americans Disabled for Attendant Programs Today (ADAPT), a national advocacy group for the disabled, took over Gloster Hall at Morehouse College in southwest Atlanta and barricaded the school president’s office. “This is a college that has always valued human rights,” said Michael Auberger, a co-founder of the group. “This is another minority that is trying to gain its human rights.” The protest was intended to force Morehouse President Leroy Keith to arrange a meeting with Louis Sullivan, secretary of Health and Human Services and an alumnus and former dean of the Morehouse School of Medicine. Group members were angry at Dr. Sullivan for not responding to their invitation to meet with them although he spoke at an AIDS symposium in Atlanta last week. “Morehouse Medical College invited him to speak. He came. This group invited him to speak on an issue as serious as AIDS. He chose to ignore the issue," said Mr. Auberger. More than a dozen wheelchair-bound activists rolled into Dr. Keith's office before noon Monday and barricaded the door. Scores of additional protesters followed, chanting, “We want Sullivan" and "We shall overcome,” and blocked the front door and hallways. Late in the afternoon, Dr. Keith exited through a rear door, and many other employees left the building. College officials said they were puzzled that the demonstrators took their protest to the Morehouse College administration building instead of the Morehouse School of Medicine, which is a separate institution. Richard Ammons, a school spokesman, said Dr. Keith had contacted Dr. Sullivan, who said he would not meet with the protesters. But the regional director of Department of Health and Human Services agreed to meet with demonstrators in his office today, Mr. Ammons added. “We as an institution are powerless to do anything other than [contact Dr. Sullivan],” Mr. Ammons told the protesters. “And we are asking you to leave at this time." Lee Jackson, a demonstrator, replied, “We’re going to wait right here for Sullivan.” At least 50 demonstrators said they planned to remain in the building until Dr. Sullivan meets with them or they are arrested. School officials said the college was reluctant to have the protesters arrested. The protesters said they chose to come to Georgia, in part, because the state is one of the worst at caring for the disabled. Mark Johnson of Alpharetta a spokesman for the Georgia branch of ADAPT, said the state offers no state-funded care for disabled people outside of nursing homes and no matching supplements for federal disability benefits. Most states offer such assistance, Mr. Johnson added. Protesters also complained that residential care facilities can be opened in Georgia with nothing more than a a business license. Some students who were locked out of Gloster Hall complained about the protesters, but others called their objections “hypocritical” because of the school's civil rights tradition. "Anytime you're dealing with basic human rights, protests may inconvenience some people," said Otis Moss, 20, a Morehouse philosophy and religion major. “But you have to understand that ultimately it's going to benefit all." Atlanta Journal 10/4/1990 Disabled protesters arrested downtown Charged in blocking of building’s doors By Bill Montgomery and Ben Smith staff writers As supporters cheered and chanted, more than 30 activists for the handicapped in wheelchairs were arrested for sealing off the Richard B. Russell Federal Building in Atlanta Wednesday. They were lifted by police aboard MARTA buses and taken to hastily arranged hearings in a parking lot at Atlanta-Fulton County Stadium. U.S. Magistrate John Strother released the activists — who are protesting U.S. government funding of nursing home care for the disabled — on personal appearance bond for arraignment in Magistrate's court on Nov. 16. The defendants face a maximum $50 fine or 30 days in jail for a class B misdemeanor, hindering access to and from a federal building. Wednesday's blockade at the Russell building by American Disabled for Attendant Programs Today (ADAPT), continued the strategy that the group used to seize the Morehouse College administration building and a nursing home association headquarters in Decatur on Monday and Tuesday. About half of the 100 protestors who appeared at 11 a.m. to blockade all street level doors refused orders by Russell Building security chief Thomas W. Woodall to move away from the entrances by 2:30 p.m. or face arrest. Several chained themselves and their wheelchairs to the revolving doors. Employees and people attempting to enter the Russell Building used a tunnel from the federal annex across the street to enter the building. Atlanta police, federal marshals and Russell Building security officers began arrests at 2:45, less than 90 minutes before some offices in the building close for the day. Protesters who moved away from the doors chanted “Free our people now!” as their arrested comrades, some grinning and flashing raised thumbs and “victory” signals, were lifted by their wheelchairs onto four MARTA buses. By 5 p.m., 31 men and women had been delivered to a parking lot across from the stadium for the hearings. The protesters are demanding that the federal government redirect 25 percent of funding for the disabled from nursing homes to home care. They argue that 250,000 disabled people are being held in nursing homes against their will, and that this shift in funding is more humane and cost-efficient.

Handicapped Coloradan [Headline] These are the people who chased APTA George Florum, 47, of Colorado Springs, is a T3 para who fell out of a cherrypicker. He went to work for Atlantis and became involved with ADAPT in April of 1985. Florum has been arrested between 15 and 20 times on charges ranging from instigating a riot, blocking entrances, and chaining himself to doors and buses. "I think the disability movement has really grown," Florum said, "In April of '85 in San Antonio 15 people were willing to be arrested. Now people are standing up for their rights, and I think it's great." Joe Carle, 51, of Dallas, is a single amputee with artery problems. "I was the first to go through the training seminar," Carle said. "The second big seminar was to take on McDonald’s. Now, transportation is fairly won, but access will be a continuing battle. The disability movement can go anywhere." Rick James, 39, had encephalitis when he was two years old. Five years ago he was one of 20 people who did a "crawl on" on a bus, and three weeks later he was part of a group that got together and blocked a bus. “We will get ADA passed," James said, "and then take on any issues we feel necessary, such as health care, attendant care, the Greyhound company, housing - any of a number of issues." Cathy Thomas, 60, of Irving, Tex., has spina bifida and became involved with ADAPT - when a disability group she belonged to that was trying to get accessible transportation in Dallas asked ADAPT for help. She says, “At this point rights for disabled people are inevitable, We want to get as many buses accessible as possible. If President Bush is sincere in wanting to mainstream people with disabilities, then it's time he took the first step in getting us accessible transportation so we, too, can pursue the American dream." Rhonda Lester of Denver is the mother of Kenny Perkins, 5, who was refused access to an RTD bus in October 1987. “They viewed Kenny as a baby because of his chair," Lester said. “They wanted to board him separately from his chair-in other words, he was to be carried on. So I called Wade Blank on a Thursday and on Friday help came. Larry, George, Ken, ET and Julie blocked a bus. They let us on, we changed the policy, and I was allowed to attend a training meeting." When asked if there has been a lot of resistance to Kenny, Lester said, "Oh, yeah. People see one of ‘Jerry's Kids,' not the wheelchair I hope our actions and civil disobedience help to get full integration for my son." As to the controversial issue of children in the disability rights movement, Lester said, "As the mother of a disabled son, I feel that no one has a bigger right than myself to fight for my son's rights, although there are some who would disagree very strongly with this view. Kaspersen carts away Greg Buchanan, one of 26 wheelchair-bound protesters arrested Monday outside the entrance of the Radisson Hotel. by Terry Kilewer, Denver Post Staff Writer 4/25/89 Denver’s Regional Transportation District, which is contracting 20 percent of its service to private operators, may be a step ahead of other public transit systems with dwindling public money, delegates to a transit symposium were told Monday. Alfred DelliBovi, outgoing head of the Urban Mass Transportation Administration, praised Denver‘s move to the forefront of privatization — a trend toward government disengagement from transit that is catching on nationwide. RTD expects to save millions in future operating costs by farming out some bus routes to private companies, state Sen. Terry Considine, R - Cherry Hills Village, told an audience of 800 at the opening session of the two-day conference. Considine sponsored a bill last year to privatize a fifth of RTD’s service. Now he wants to go even further by redirecting RTD tax revenues toward other transportation needs, notably a Denver-encircling beltway. He said it's time to re-evaluate public transit, which is "21 times the tax cost per passenger-trip taken by private automobile." And he charged Gov. Roy Romer with failing to “tackle the tough decisions that need to be made" in state transportation legislation. A transit-and-highways bill Romer favored and Considine opposed died in the legislature last week. Romer disputed the senator's claims in his remarks to the conference. Later, in an interview, he said Considine is “off in left field" and out of step with his own political leadership on transportation issues. "I agree you've got to take advantage of all the savings you can. You've got to innovate with RTD; I signed (Considine’s) privatization bill last year. But more privatization won't take care of our highway problems.” Considine and DelliBovi seemed in-step on privatization, though. The UMTA boss said the key to emerging federal policy in the public transit area is "dwindling resources.” During DelliBovi’s two-year tenure at UMTA, the agency maintained the Reagan administration's bent toward frugal funding for transit construction and operations.

T I P S & TRENDS The President's Committee on Employment of People With Disabilities |Vol. 1 No.4 April 1989 [Headline] Administration Granted Rehearing of Transit Access Decision On April 10, 1989, the U.S. Department of Transportation (DOT) requested a rehearing of a court decision that would make many transit systems more accessible to people who use wheelchairs. DOT requested all eleven judges of the U.S Court of Appeals for the Third Circuit to rehear the February 13 ADAPT (American Disabled for Accessible Public Transit ) vs. DOT decision (see March Tips & Trends) which ordered DOT to cease subsidizing buses purchased by transit systems unless they are equipped with wheelchair lifts. On April 19, 1989, the Third Circuit Court of Appeals vacated the February 13 decision and granted a rehearing to DOT. The unusual decision to grant a rehearing may indicate that the February 13 decision will be reversed. [Subheading] Decision Angers Protesters Also on April 10, disability advocates and members of ADAPT were protesting for accessible public transportation during a regional meeting of the American Public Transit Association (APTA) at the Nugget Casino in Reno, NV. Protesters were disappointed by the announcement that the Federal government had asked for a rehearing of the ADAPT vs. DOT decision. Three people with severe disabilities were injured, 49 protesters were arrested and many were jailed. Untrained ranch hands from the surrounding area assisted the under-staffed Reno police department with the arrests, and threatened to take seeing eye dogs from blind protesters if they did not disperse. Wheelchair users were dragged from their seats by the local police and deputies, who broke a leg of one severely disabled protester. About 75 wheelchair-bound members of Denver-based American Disabled for Accessible Public Transportation (ADAPT) rushed two entrances of the hotel—casino about 3:15 p.m., but Nugget security officers and police inside blocked the doorways. No injuries were reported, police said. Sparks police Lt. Tony Zamboni said that as of late Sunday night, five of the 49 demonstrators arrested had been transferred to the Washoe County jail, after their arraignment in Sparks Municipal Court. They were being held in lieu of $1,025 bond for investigation of obstructing traffic, obstructing a police officer an blocking a fire exit, Zamboni said. Arraignments continued Sunday night for the remaining protesters. Disabled residents from Reno and 30 other cities throughout the country joined in the protest of an expected appeal of a federal court order that requires all public bus systems to be equipped for wheelchairs. ADAPT filed a lawsuit asking for the decision last year. The 3rd U.S. Circuit Court of Appeals in Philadelphia ruled in favor of the group in February. Demonstrators Sunday hoped to persuade the transit officials to work against the appeal, expected to be made by the U.S. Department of Transportation today. APTA spokesman Albert Engelken said the group's protests are “compelling and heart-rending." But he said APTA cannot afford a national mandate for the lifts, which cost $15,000 to install and even more to maintain. Engelken also cited low usage of the buses and suggested the lift requirement be a local option instead of a state mandate. “We're for accessible transportation for the disabled, and we do have it, but the local transit systems and the local disabled communities should decide what is needed because they know what's best." Reno’s Citifare would not be affected by the decision because transit officials already have made a commitment toward a 100 percent wheelchair-equipped bus system, said Bill Derrick, planning manager for the Regional Transportation Commission. All Citifare buses bought since 1984 are wheelchair-equipped, he said, and all non-equipped buses will be replaced by 1996. Mike Auberger, ADAPT founder and protest organizer, said the group has staged at least 14 demonstrations at APTA conferences during the last seven years throughout the United States and Canada. Auberger, 33, of Denver, who has been confined to a wheelchair since a bobsled accident 17 years ago, said demonstrators will follow APTA convention-goers for as long as it takes. “We’re not fighting Reno or any other city. We're fighting APTA,” he said. “We will go to jail, we'll get arrested, but so what — it's a misdemeanor. We'll do it again." Citifare accommodates the disabled more than some other cities, said Reno resident Dottie Spinnetta, 51, who suffers from muscular dystrophy and rides the buses five days a week. But RTC could improve the system by offering additional wheelchair space on the buses and bus pickups every 30 minutes instead of every hour. “I should be able to get around as everyone else can and not have to ask,” she said. “That’s what everybody wants — to be independent." The only drawbacks of using Citifare for John Civitello, 21, is that he has to get up at 4 a.m. to catch a 6 a.m. bus that takes him to his job with American Handicapped Workers. [Headline] Disabled protesters maintain hunger strike [Subheading] Jailed demonstrators getting care, sheriff says By Susan Voyles/Gazzette-Journal A hunger strike in the Washoe County jail by 22 handicapped prisoners — arrested for obstructing sidewalks while protesting a public Transit meeting in Sparks -— continued Tuesday night, although nine demonstrators broke their fast. Leaders of the American Disabled for Accessible Public Transit (ADAPT) group encouraged jailed protesters to break their fast after Washoe County Sheriff Vince Swinney early Tuesday afternoon promised the inmates more nurses, if needed, and more medical supplies. But Lt. Rod Williams said the hunger strike wasn't over medical treatment. "They're protesting the fact they're here,“ he said, “not the conditions in the jail." The hunger strike began Monday night after 25 people were arrested and jailed in a demonstration against public transit officials meeting at John Ascuaga's Nugget. The meeting concludes today. Five others have been in jail since Sunday night, when ADAPT began a planned four-day protest. They're here to protest the western regional meeting of the American Public Transit Association, which is fighting ADAPT's legal efforts to require all federally funded transit systems to buy buses equipped with wheelchair lifts. Swinney said one female prisoner vowed to continue her fast even though she was warned by a doctor that she'll ultimately go into seizures. Another woman, Diane Coleman of Los Angeles, was released from Washoe Medical Center Tuesday morning after being given liquids intravenously for dehydration. She was taken to the hospital about 3 a.m. Tuesday when she began vomiting. Mike Auberger, organizer of the Denver based group, and Pat Gilbert, his Reno attorney, met with Swinney early Tuesday afternoon to discuss jailed ADAPT members complaints. "People in charge are now in the process of trying to respond to the situation, which they've never been in before," Auberger said at a news conference outside the jail. “It's a lot more positive than it was two hours ago." Swinney said the jail has put 11 nurses to work, nine more than usual. And more nurses and a doctor will be brought in if needed, he said. But he admitted the jail did not have enough medical supplies, such as catheter drainage bags, on hand and had to order more. Normally, the jail sees only about six handicapped prisoners a year. Sparks Municipal Judge Don Gladstone defended the sentences handed down to the protesters. Of the 30 in jail, the majority were sentenced to three days for obstructing sidewalks, fire entrances or a police officer, and given an average fine of $580. On Sunday, only five of 49 people arrested went to jail. Those five pleaded innocent and will have their trials Monday. Gladstone said he warned ADAPT members he'd get tougher on them. "Clearly, everyone was put on notice," he said. "We're not following their rules" Auberger, who was also arrested but paid a fine to get out of jail Monday night, was outraged so many of his people were arrested. "I have been in many cities where I have done civil disobedience and I wasn't arrested," he said. "Maybe it's the politics of Sparks that the city has to respond to what the Nugget wants. it's real clear (Gladstone) was being forced to do what he did." “They don't toss people in jail for blocking sidewalks in most cities," complained Pete Mendoza of Marin County, Calif. "They were researching ordinances to arrest us.“ Gladstone who said he supports the rights the handicapped are seeking, said he is simply doing his job and the demonstrators were amply warned. Among the 50 or so protesters outside the jail Tuesday was Beverly Furnice of Denver, with a thick, fresh bandage around one of her twisted legs. She claims her leg was broken Sunday night when a security guard tried to move her out of a doorway. She was treated at Sparks Family Hospital, but officials would not confirm that her leg was broken. She was arrested after the incident, and said she sat in Sparks Municipal Court for five hours before she was released with a verbal warning. Nugget spokesman Parley Johnson said he's not sure what happened to Furnice. "There was a lot of shoving and pushing going on," he said "If it did happen, I'm very sorry about it." Gladstone said he doubted she broke her leg. He said he and his staff held arraignments until midnight Sunday and were far more inconvenienced than Furnice or anyone else arrested.

From a series of demonstrations to a controversial court case, this relentless group keeps fighting for accessible transit around the country. Among its victories are a July, 1989 federal court ruling that transportation agencies no longer have a 3 percent cap in providing wheelchair lifts or paratransit. For the members of ADAPT, accessible transit is a basic civil right — and is always worth fighting for. We reported in Disclosure #l08 on ADAPT’s actions in Montreal at the annual convention of the American Public Transit Authority (APTA). APTA and other transit authorities continue to make it extremely difficult for people with disabilities to use public transit. Nevertheless, ADAPT has shown that it will confront APTA wherever it shows up. Last April, at the Western Regional Conference of APTA in Sparks, Nevada (just outside of Reno), over 125 ADAPT members staged actions at the conference, calling for public transportation that can be used by everyone — including people with disabilities. Members started off with a march from their hotel to the conference hotel. When they were about halfway there, ADAPT was met by a police blockade. Obviously, authorities already knew about ADAPT: here is a group that won’t stops until it forces permanent changes. In Sparks. the marchers were able to get around the police barriers. But when they got to APTA’s hotel, they were met by private security forces. The hotel security outnumbered the city’s police three-to-one -— and were able to chain the door shut before ADAPT entered. Forty-seven ADAPT members were arrested, and seven were sent to jail. “The Sparks police had obviously decided that we weren't going to march in the streets,” said Stephanie Thomas, an ADAPT member who lives in Austin, Texas. “But we were able to go around the car barricades. it was like water going around the rocks." The following afternoon, ADAPT staged another demonstration with many crawling across the street and around police barricades, blocking traffic until they reached the front door of the hotel. It was locked from the inside. This time, 25 were arrested. The charge: blocking a fire door which was locked. Many of the ADAPT members who were arrested went on a hunger strike. Meanwhile, ADAPT members on the outside held a press conference calling attention to the problems jail staff were having providing for several of the disabled people’s needs. A final protest was held the next day. One day later, the Sparks judge who sent the hunger strikers to prison made a deal with the protesters: he let out two protesters for the price of a $100 fine. The judge had imposed a much stiffer sentence a couple of days earlier, but changed his mind in the face of a group of arrested ADAPT members who made it clear that they would rather starve and stay in jail than pay a huge fine. Meanwhile, disability groups on the east and west coasts were raising money to help support ADAPT. On the fourth day of the hunger strike, the judge relented and the fine was reduced. By the end of the day, all arrested ADAPT members had been released — and many in the group headed to Denver, for more demonstrations. In Denver — which is the home of ADAPT — the group protested at the annual conference of the Urban Mass Transit Administration (UMTA). This time, demonstrations focused on the federal government's request for a re-hearing of the ADAPT vs. Burnley case. In February, ADAPT won a major victory from the Department of Transportation (DOT) - only to have it undercut by the government. The first of ADAPT’s arguments stated that the rule saying transportation agencies should not have to spend more than 3 percent of their budget on wheelchair lifts or paratransit was unconstitutional. Second, ADAPT held that the option allowing agencies to decide whether or not to provide new buses with wheelchair lifts was unconstitutional. DOT kept flip-flopping on the issue: first it said yes, and then it backed off, asking for a rehearing to vacate the decisions. In Denver, ADAPT confronted Michael Norton, U.S. Attorney for the Tenth District in Denver. “Why is the government working against disabled rights?” asked ADAPT. Norton eventually read a 20-page statement from Attorney General Thornburgh stressing “the need for concern, compassion, and commitment” — but also saying that the law never mandated integration. “It was a really offensive statement, ” said Stephanie Thomas. “On one hand, he was affirming the government's commitment, and on the other he’s fighting tooth and nail to stop rights for the disabled.” When the case was reheard in Philadelphia on May 15, ADAPT was ready. With help from the local chapter of Disabled in Action and the Cape Organization for Rights of the Disabled (CORD), protesters gathered at the federal court building. Four ADAPT members met with the U.S. Attorney, who listened to their concerns. Two days later, a protest was staged at Independence Hall. Dressed in revolutionary garb complete with wigs, three-cornered hats and fife and drum, the “Disability Rights Patriots” marched around the Liberty Bell. Court Decision On July 24, ADAPT won a significant victory as the original ruling striking down the 3 percent cap on wheelchair and paratransit lifts was upheld. On the local option issue, judges decided that the stipulation was legal. Now, it's back in the hands of DOT, for "clarification." Meanwhile, ADAPT will be working with lawyers to plan its next strategy in the legal arena, even though the courts have dodged the issue of equal rights for the disabled. Nevertheless, ADAPT is still ready for action. “We are not going to sit around and wait for the government to put a piece of legislation through,” said Wade Blank. What's next for ADAPT? The next APTA Conference will be held in Atlanta, Georgia, September 23-28, 1989. “The court’s decision on local option will make our demonstrations in Atlanta bigger,” says Mike Auberger, a co-director of ADAPT. A victim of congenital cerebral palsy, Jennifer will have to fight for everything in a society that still doesn't respect the rights of the disabled, says her mother, Cynthia. And that will probably mean more demonstrations like the one that led to her "arrest" by police last night. "She's a very, very brave little girl and I'm proud of her," Cynthia Keelan said, as Jennifer looked up at burly policemen surrounding her small group. There had been a lot of excitement as the beefy cops first moved in. But the drama waned as everyone awaited special transportation to police headquarters, and Jennifer's little blonde head kept sinking to her chest. Station 25 director Edouard Sarrazin was quick to point out that the little girl hadn't been arrested. [Subheading] Paddy wagon ride "It's her mother who has been arrested." Still, Jennifer had to watch about 40 policemen surround her and her mother and other members of the group. American Disabled for Accessible Public Transit. And it meant a ride to police head-quarters in a converted wheelchair bus being used as a paddy wagon. The Keelans, of Scottsdale, Ariz., are in Montreal to protest with other ADAPT members at the annual meeting of the American Public Transit Association (APTA), which is meeting at the Queen Elizabeth Hotel. Later, at police headquarters, police decided to release the mother and daughter without pressing charges, saving Jennifer and her mother the trauma of being separated overnight. [Subheading] Make things better "I hope they don't separate us," Cynthia Keelan had told the Daily News just a few minutes before. "You don't think they will, do you?" Though in perfect health herself, she decided to get involved in ADAPT "so that things will be better for the disabled when my daughter grows up than they are now." ADAPT's specific beef with APTA concerns the 3,000-member group's refusal to endorse a policy requiring all urban transit buses to be equipped with wheelchair lifts. Cynthia Keelan didn't miss the irony of her daughter, wheelchair-bound since infancy, being lifted aboard the police bus with the kind of lift ADAPT would like to see as standard equipment on all buses. "Access to transportation is essential if people in wheelchairs, people like Jennifer, are to have a fair chance," said the young mother. "It's too bad the authorities don't always make these kinds of buses available."

About 50 activists were arrested after blocked traffic along Rene Levesque, disrupting the Queen Elizabeth Hotel conference, and demonstrating at the Sheraton hotel, where members of the American Public Transit Association (APTA) were staying for an annual convention from October 1-5. The local disabled population teamed up with the American Disabled for Accessible Public Transit (ADAPT) in protesting against APTA policy. ADAPT has organized civil disobedience at all APTA conferences for the last five years, with last year's convention in San Francisco resulting in over 70 arrests , while a regional conference in St. Louis led to the arrest of over 40 activists. Stephanie Thomas of ADAPT says that the enmity towards the transit group dates to the late '70s when the U.S. government passed a law which decreed that all new public transit vehicles must be accessible to the handicapped, but APTA lobbying had the law overturned. Thomas, who has been active in each of the protests against APTA, refuted the organization's claim that making transit accessible is expensive and impractical: "A lift on a bus only increases its cost by about 10 per cent, which would be made up as it eases the cost on the separate transportation system for the disabled." Montreal's transit authority (MUCTC) is a member of APTA and has failed to make new buses or subway stations accessible to the disabled: A separate service for the disabled has existed since 1980. This system, according to Francois Gagnon of the Quebec Movement of Handicapped Consumers, is deteriorating. "The Quebec government has ordered that the separate service maximize its use," he says, "and since then, one complaint I received was from a man who gets picked up for work at 7 AM and is delivered to his job at 9:45 AM." Gagnon, whose organization encouraged the disabled community to take part in the protests against APTA, argues that economics and demographics prove that now is the time to make the system accessible. "By the year 2000, 25 per cent of Quebecers will be senior citizens, many of whom will be handicapped, and the longer it is delayed, the more expensive the transition will become." For many disabled, the real issue is the right to enjoy transit facilities made for the rest of society. The protests are an attempt to end the separate transit systems. Stephanie Thomas stresses that ADAPT is not demanding that existing vehicles be modified, only that new equipment should be accessible to the disabled. Thomas is encouraged by the results of the protests. 'We have been active lobbying, and nothing was ever done. But since we started protesting, it has become a major issue. Slowly, cities such as Phoenix, Atlanta, Dallas, Syracuse, and Chicago are changing to accessible transit." Montreal may yet be able to join that list. The End

Title: Disabled People Block Buses, 37 Arrested By Mark Schlinkmann, Regional Political Correspondent Thirty-seven protesters, almost all of them in wheelchairs, were arrested Tuesday afternoon as they blocked buses from entering and leaving the Greyhound Lines terminal downtown. Police also arrested a man from Ohio after he became Involved in a scuffle with two protesters. Police said the man, who was later released without being charged, might have been irritated at the delay in a bus departure caused by the demonstration. The incident, which shut down traffic at the terminal on and off for almost three hours, took place on the third day in a row of protests by disabled people seeking the installation of wheelchair lifts on all buses in the United States. The group, called the American Disabled for Accessible Public Transit, or ADAPT, is in St. Louis because the American Public Transit Association is meeting at the Omni International Hotel. But after two days of protesting at the hotel, the target shifted Tuesday to the Greyhound terminal, at 801 North Broadway. "We demand that they serve all the public, including us," said Bill Bolte of Los Angeles as he and others blocked a bus on Sixth Street from entering the terminal. "We're going to stop their buses everywhere until they stop treating us as less than greyhounds." Boite and others complained that Greyhound allowed disabled people with wheelchairs to travel only if were accompanied by a companion. George Gravley, public relations director or the bus line, defended the company's policies in a telephone interview from his office, in Dallas. While the company lacks mechanical lifts, he said, it for years has had a program that provides a free ticket to a companion of any disabled traveler. The protesters began arriving at the terminal around noon. First, a few people began blocking two entrances to a parking lot on the east side of the terminal along Broadway. Then, when a bus without passengers drove toward the west-side entrance, on Sixth, several protesters wheeled up to block its path. Carrying placards and chanting slogans, the group grew in number to about 20. Police, meanwhile, blocked off Sixth between Convention Plaza and Cole Street to traffic. Other incoming buses were forced to bide their time elsewhere. About 1:30 p.m., Police Capt. Clarence Harmon informed the protesters that they were breaking the law and would be arrested if they refused to move. While that was being mulled over, police said, a man identified as Donald Keiper, 63, of Ridgeville, Ohio, walked from the terminal area and grabbed a wheelchair in which Barbara Guthrie, 48, of Colorado Springs, Colo., was sitting. Keiper started to move Guthrie's wheelchair, but another protester in a wheelchair, Ernest Taylor of Denver, intervened, and a brief scuffle ensued, Police then arrested Keiper. He was released later: warrants were :_aken under advisement. Police said no injuries had resulted. Police later arrested Guthrie, Taylor and the other protesters, some for blocking buses inside the terminal area. Late Tuesday afternoon, Circuit Judge Robert H. Dierker Jr. denied a request from Jerome Schlichter, an attorney from St Louis who is representing ADAPT, for a court order regarding blood tests. Schlichter's request was denied after the city stated that it was not requiring the people arrested to undergo mandatory testing and that only those who agreed to the practice voluntarily were being tested. But Schlichter said ADAPT continued to allege that blood tests were taken without consent Sunday night at the Workhouse from a group of 41 protesters arrested that day in front of the Omni. St Louis Post Dispatch May 19, 1988 Title: Protesters Plead Guilty, Are Released By William C. Lhotka and Mark Schlinkman Of the Post-Dispatch Staff Thirty-seven disabled people arrested at wheelchair protests here this week entered guilty pleas Wednesday afternoon to charges of peace disturbance and then were released under an agreement worked out by lawyers. The court action came after members of the American Disabled for Accessible Public Transit (ADAPT) held a final protest rally outside Union Station, where an association of transit systems completed its five-day regional convention Wednesday. No new arrests were made at the 45-minute gathering, which involved about 90 people, most of them in wheelchairs. But about 2:15 a.m. Wednesday, two able-bodied men who police said were associated with ADAPT were arrested on assault charges after fighting with police on the parking lot of the Holiday Inn, 2211 Market Street. Police were called to the scene by hotel security guards who reported a disturbance. The incident had no connection with any protest or demonstration. Police said one of the officers had suffered a potentially serious eye injury. In an interview Wednesday afternoon, an ADAPT leader, the Rev. Wade Blank of Denver, denied that the two men were members of The organization. He said they were with a disabled woman from Lawrence, Kan., who had arrived in St. Louis early Wednesday. Blank said she apparently had come here to take part in the rally later in the day; he said he was unsure whether she had done so. Most of the members of ADAPT here have been staying at the Holiday Inn on Market. The protesters want the transit group, the American Public Transit Association, to push for the installation of mechanical wheelchair lifts on all buses in the United States. Association officials say that they support access for the disabled but that each local system should have the right to decide for itself how to provide such access. Protesters were arrested Sunday for blocking entrances and hallways at the Omni International Hotel at Union Station and on Tuesday for blocking buses entering and leaving the Greyhound Lines depot at 801 North Broadway. Under the agreement worked out by prosecutors and defense attorneys, Associate Circuit Judge Thomas C. Grady accepted the time the defendants served in jail after their arrests in lieu of any further sentence or fines. The judge also waived court costs. The agreement meant that the demonstrators were free to leave St. Louis. On the other hand, they have misdemeanor convictions on their records. Three of the 37 faced charges from both the Sunday and Tuesday protests. Arrested in the separate incident early Wednesday were Mike Knowlen, 22, of Lawrence, Kan.., and Dana Dower, 22, of Viburnum Mo. Police said Dower faced a felony charge of second-degree assault and misdemeanor charges of peace disturbance, resisting arrest and destruction of city property. Police said Knowlen faced misdemeanor charges of third-degree assault, peace disturbance, cruelty to an animal and interfering with an arrest. Police said the fight had erupted as police officers attempted to arrest Knowlen. Police said Knowlen had been slapping and swinging a dog by its tail on the lot and had been shouting profanities. In the scuffle, police said, Dower fell face forward onto the trunk lid of a police car. Police said Officer Barry Hinchey had been treated at Bethesda Eye Institute for an injured retina after he was struck on the face Hinchey also was treated, at St. Louis University Hospital, for a human bite wound.
