Article reads: Washington -- It was a scene reminiscent of the 1960s civil rights demonstrations as angry protesters chanted slogans, picketed the White House and stopped traffic before they were finally dragged away by police. And the series of confrontations that ended with 27 arrests last month seemed to come down to a similar central issue— the right to sit on a bus, to have full access to public transportation. There was one striking difference, however. Unlike Rosa Parks and the black civil rights activist who battered down the Jim Crow barriers in the South, these protesters were in wheelchairs, and their goal was equal access for the physically handicapped. “It's a civil right to be able to ride public transportation," said Julia Haraksin, a wheelchair-bound Los Angeles resident who participated in the demonstrations. “In the ‘60s, the blacks had to ride in the back—and we can't even get on the buses." New, Radical Tactics Organizations representing handicapped persons long have urged Washington to require that new buses and rail systems built with funds from the Department of Transportation's Urban Mass Transportation Administration be equipped to accommodate handicapped riders. But Haraksin and other handicapped individuals like her now are beginning to press the old arguments with new, more radical tactics. Frustrated by years of negotiating, lobbying in Washington, going through the courts and staging non-confrontational protests, some members of the handicapped community now are resorting more actively to confrontations and civil disobedience. Thus, early in October, 100 members of a newly formed coalition called American Disabled for Accessible Public Transit confronted a national meeting of city transportation heads here, using the kind of civil disobedience tactics used 30 years earlier by Dr. Martin Luther King Jr. Protesters were arrested when they blocked entrances and buses of those attending the American Public Transit Assn. convention. The strategy was to physically be a barrier because handicapped people have to face barriers all their lives," Wade Blank, a founder of Denver-based ADAPT said. Calling the protests here " Selma," leaders of ADAPT claimed victory and promised that their struggle has only begun. They already are focusing their efforts on what they hope will be a larger demonstration at the next meeting of the American Public Transportation Assn. a year from now in Los Angeles. But they and their cause may be in for a tough battle. Their opposition comes from the Reagan Administration, from many city governments and even from within the handicapped community. And as public attention focuses on the underlying budget choices involved, the opposition may swell with the addition of taxpayers concerned about the possible costs of a national full-access program. ADAPT argues that a legal right to full access for the handicapped already exists. Federal law states that Urban Mass Transportation Administration funds — which account for about 80% of the costs of new and replacement equipment in most municipal transportation systems—cannot be spent on programs that discriminate against, or exclude, the handicapped. The law does not make clear, however, whether handicapped persons must be provided with access to regular bus lines or whether they can instead be provided with alternative transportation systems. Nor does it indicate who should make that decision. Cities Make Decisions Current Transportation Department policy, which is strongly supported by the American Public Transportation Assn., allows each city to make its own decision on what type of transportation it will provide for the handicapped. This is in sharp contrast with Carter Administration policy, which in 1979 interpreted federal regulation to mean full access. Members of ADAPT, opposing the separate-but-equal philosophy of paratransit argue that it does not meet the needs of the handicapped and that it is inherently discriminatory. "It segregates the disabled people from the able-bodied community," Mike Auberger, an organizer for ADAPT, said. Because paratrasit requires advanced scheduling [unreadable] a ride is needed, he said, “you have to schedule your life according to the system. No one else has to do that. That shows the inequality right there." He and other members of ADAPT contend that because of long waiting lists for paratransit, some cities refuse to offer the service to new users - thus cutting off thousands of handicapped persons from any public transportation. Transit authorities, on the other hand, argue that full access can be too expensive, given the low percentage of handicapped riders in many cities. Lift-fitted buses cost an estimated $8,000 to $10,000 more than regular buses. Furthermore, lift systems are often unreliable and time-consuming to operate and maintain, transit administrators say. In Denver, for example, the transportation district has spent $63 million to purchase or retrofit buses with lifts. 80% of which was paid for by the federal government, according to spokesman Gene Towne. Since it started mainline access in 1982, the district has spent close to $1 million in maintenance of the lifts and expects to spend an additional $900,000 this year. Yet of the district's total annual ridership of 38 million, only 12,000 use the lifts, according to Towne. ADAPT counters that the issue is not cost but civil liberties. “In America we have a way of hiding, our prejudices with pragmatism," said Blank, a Presbyterian minister and veteran of the civil rights and anti-war movements of the 1960s who now supports handicapped activists. Variety of Approaches Across the country, cities are using a variety of approaches to the problems of providing mass transit for the handicapped. In Los Angeles, mainline access is required by state law. Although 1,850 of the Southern California Rapid Transit District‘s 2,400 buses are fitted with wheelchair lifts some local advocates charge that the RTD gives only "lip service" to access, complaining of broken lifts, drivers who do not know how to use the equipment or refuse to do so and an overall lack of commitment to providing access. The system provides only about 1,400 rides a month according to the RTD. Handicapped activists charge that the low ridership is attributable to the system's poor management. There were and are people in the operation department (of the RTD) back there who were and are opposed to the idea of access from day one," Dennis Cannon, a Washington-based expert who helped to plan the RTD's access program in the 1970s said. But in the last six months, the RTD has made "a major effort" to overcome the problem, according to RTD General Manager John A. Dyer. The system boosted its fiscal year 1985 budget for handicapped service by $3 million, to $4.9 million, to provide for a program to educate drivers and upgrade the quality of equipment and service. In Oakland, half the city's 800 buses are lift-equipped and all of the Alameda — Contra Costa Transit District's new buses will be lift-equipped. Seattle’s Services In Seattle, 570 of 1,100 buses are accessible to the handicapped, providing about 5,900 rides a month. The Municipality of Metropolitan Seattle also contracts with private groups to supply paratransit bus and half-fare cab service, providing a total of 8,400 rides a month in Denver. 432 of the city's 744 buses are lift- or ramp-equipped, providing more than 1,000 rides per month. The city also uses 13 vans and small buses in a paratransit system that provides 3,200 rides a month. In New York City, where an estimated 35% of all the transit passengers in the country use Metropolitan Transportation Authority vehicles each day. half of the city's 4,333 buses are fitted with lifts. The city has no figures on how many handicapped riders use the system, but one official calls the number minuscule. A new state law calls for $40 million over the next eight years to retrofit “in the neighborhood of 30" subway stops for handicapped use, according to a transit authority official. In addition the law will increase the percentage of lift-equipped buses to 65% of the fleet, as well as provide a paratransit system in the city by 1988. Minneapolis-St. Paul uses 45 paratransit buses and contracts with private cab companies to carry handicapped persons in all, the city provides 40.000 trips a month. None of Chicago's 2.400 regular buses are fitted with lifts. Instead the city provides 42 paratransit buses, which offer 12,000 rides a month. Additionally, 14 of the city's subway stops have been retrofitted for handicapped access and 300 of Chicago's 1,100 subway cars are accessible. If there is a diversity of approaches to the problem, there is also a diversity of views on the militant new tactics used by ADAPT and its supporters. The views of the handicapped people are all over the lot on what type of transport they'd like," Bob Batchelder, counsel for the APTA, said. But transit specialist Cannon, himself a wheelchair user, counters: “I'm talking to disabled people who wouldn't do what ADAPT does ... but who support what they are doing and think it needs being done." Whether ADAPT's controversial style will work remains an open question. While no negotiations are scheduled, ADAPT leaders vow to continue to harass association meetings. But in Los Angeles, the RTD's Dyer indicated that he hopes demonstrations will be replaced at next year's convention with “serious dialogue and discussion of the issues." "It’s a new thing for the disabled to see themselves with power," ADAPT's Auberger said, "but it's also a new experience for the powers that be." - ADAPT (160)

[Headline] Handicapped Seek Change in Public Transit By George Lane, Denver Post Staff Writer Several dozen wheelchairs jammed the sidewalk of the Denver Hilton Hotel on Sunday afternoon as disabled activists from throughout the country urged public transportation be made more accessible to the handicapped. The rolling demonstration took place in front of the Hilton because the hotel is the headquarters for about 3,000 U.S and Canadian transportation officials attending the national meeting of the American Public Transit Association. Representatives of the group, the American Disabled for Accessible Public Transit, are scheduled to speak to the transit officials Wednesday, but a spokesman said they were on the sidewalks Sunday “to let them know they were serious.” Bob Conrad, an executive of Denver Atlantis Community Inc. and one of the wheelchair-bound demonstrators, said the purpose of attending the transit convention was to call the need for accessible public transportation to the attention of transit officials and bus manufacturers. “California has had a law for about 12 years saying all buses purchased must be accessible to all person, including riders in wheelchairs,” said Lew Nau of Los Angeles. “Michigan is the only other state I know of with a similar law.” Nau and his wife, Yvonne, both in wheelchairs, said they have devoted all their efforts since retirement to the issue. The couple said that during the Carter administration all public transit agencies were subject to a regulation that said 50 percent of all buses purchased had to be accessible to handicapped people. “The (regulation) was our civil rights act,” Mrs. Nau said. “Now Reagan has in effect rolled it back.” - ADAPT (165)
[Headline] Disabled Advocates Are Rolling on Washington D.C. For the second year in a row wheelchair pickets will surround the national convention of the American Public Transit Association (APTA). Some 150 to 200 wheelchair demonstrators are expected to join the picket lines, although that number could increase dramatically by the time the four day long convention opens Sept. 30 in Washington, D.C., according to a spokesperson for the American Disabled for Accessible Public Transportation (ADAPT). But, unlike the convention held in Denver last year, ADAPT will not be allowed to argue the case for accessibility on the convention floor. “Gilstrap (APTA executive vice president Jack Gilstrap) told us there was no way we were going to speak this year,” Wade Blank said. Nor does Blank expect APTA to vote on a resolution introduced at the 1983 convention calling upon APTA members to purchase only lift-equipped buses. When the Carter administration mandated accessibility in the late 1970s, it was APTA that successfully fought those regulations in court, arguing that it was a judgment best left to the discretion of the local transit provider. Some cities, like Seattle and San Jose, California, and-to a lesser extent-Denver, chose to make their systems accessible, but the vast majority refused, claiming the lifts were impractical and too expensive. However, accessibility advocates say that the technology is available to design both economical and reliable lifts, but that bus manufacturers will not use it as long as there is little demand for lifts from transit providers. APTA argues that in many, if not most cases paratransit systems can offer better and more economical services to disabled riders. ADAPT maintains that isn't so, arguing that cities such as Seattle are experiencing a steady drop in the per ride cost for lift-assisted trips while paratransit costs are constant, regardless of the number of trips. At the Denver convention, APTA's position was championed by Colorado Governor Richard Lamm, who told the delegates that the country couldn't afford to equip all its buses with lifts and continue as a great nation. New York City Mayor Ed Koch is expected to take a similar tack at this year's convention. In 1983, Denver Mayor Federico Pena, who was instrumental in getting ADAPT a place on the convention agenda, supported accessibility, just as this year's host mayor, Marion Berry, is expected to do. Access/Denver will send 43 wheelchair demonstrators to Washington, although at press time they were short $4,400 of the $15,000 needed to provide them with transportation, food and lodging. Among the individuals contributing to the fund drive was Wellington Webb, an unsuccessful 1983 candidate for mayor of Denver. In addition, Denver's HAIL, Inc., will be sending five representatives. Several other cities, including Dallas, El Paso, Los Angeles, Cincinnati, Little Rock, Arkansas, Poughkeepsie, New York, and Chicago have confirmed that they will have representatives on the picket line. Boston's Disabled Liberation Front announced that it was sending eight pickets. ADAPT intends to provide a training session in confrontational politics in Washington on September 26. Ironically, one problem that demonstrators flying into Washington's Dulles International Airport will face is a lack of accessible buses between the airport and downtown Washington. "We were going to file a complaint," Blank said, "but it turns out that the Department of Transportation runs the bus system there and they say that they are the administrators, not the recipients, of federal funds, and therefor are not required to provide accessible service." - ADAPT (200)

[Headline] The eyes of Texas are on outside agitators -- and a lot of folks from down the street There's never been much love lost between Coloradans and Texans, at least not since those folks from the Lone Star State first wandered into the Rocky Mountains and discovered deep powder in the winter and cool valleys in the summer. As Winnebago after Cadillac after pickup poured across Raton Pass, Coloradans greeted Texans with open cash registers and - increasingly -- ridicule. Our scorn for Texans even reached into the highest office in the state when Governor Dick Lamm greeted his Texan counterpart with this joke: A Texan died here recently and we couldn't find a coffin large enough, so we gave him an enema and buried him in a shoebox. Texans were not amused, though by now they should have come to expect such treatment. We've been squabbling ever since a detachment of Colorado militia turned back a Texas Confederate army at Glorietta Pass during the Civil War. Each summer now we give Texas a chance to even the score down near Alamosa in a rotten tomato battle. OF course we always make sure our army's bigger. That animosity, however, doesn't carry over to the disabled population of the two states. In fact, a dozen or more militant wheelchair activists from Colorado have been rolling onto the streets of several Texas cities during the past couple of years to aid their counterparts in the battle to force Texas transit systems to make their buses wheelchair-accessible. "After Colorado, Texas is out best organized state," Wade Blank, the long haired ex-preacher who helped found American Disabled for Accessible Public Transit (ADAPT) in Denver two years ago. ADAPT chapters have sprung up in several other states, notably Illinois, Maine, and Connecticut, but none have garnered as many active members as Texas. Scores of Texans have blocked buses in San Antonio, Houston, Dallas and El Paso in recent months to focus the attention of the state's media on the lack of accessible buses. Part of ADAPT's success in Texas lies in the fact that there are so few lift-equipped buses in this huge state. Some Texas cities did order accessible buses when the Carter administration's Department of Transportation ordered mandatory accessibility in the 1970s. However, most of these lifts were never used as the American Public Transit Association (APTA), a national lobbying and policy making organization for transit systems, successfully fought the regulation in federal appeals court. APTA maintains that the local transit provider is the best judge of whether or not accessibility is feasible. Adverse climatic and geographical conditions are generally cited as the chief obstacles to lifts. Texas ADAPT leaders point out that few areas in Texas experience severe winter storms and that the state's larger cities are generally laid out on flat plains. That was one of the points wheelchair activist tried to make when they picketed in April 1985 regional APTA convention in San Antonio. A sizable contingent of Coloradans joined those picket lines, leading to a charge by the local newspaper, the San Antonio Light, that the demonstration was the work of outside agitators and that most of the city's disabled population was quite happy with using paratransit. Spot demonstrations and bus seizures soon followed in other Texas cities, while some Texas ADAPT members turned outside agitators themselves by participating in demonstrations at the APTA national convention in Los Angeles in October 1985. Several Texans including Jim Parker of El Paso and Bob Kafka of Austin, were among The dozens arrested. Supporters of lifts point to cities like Seattle and Denver where most of the buses are accessible -- and increasingly free of breakdowns. Denver's Regional Transportation District (RTD) maintenance crew made a few simple changes in some of their lift systems and managed to operate experimental buses without a single breakdown. ADAPT argues that some transit providers have deliberately sabotaged their lift systems to justify removing them. Opponents of lifts argue that paratransit--usually vans that pick riders up at their residences -- is more cost effective. Supporters point to Seattle where the cost per ride on mainline buses is less than $15 a trip, which compares very favorably with the best deals offered by paratransit systems. Convenience is a major factor too, according to Mike Auberger of ADAPT-Denver, who points out that most paratransit systems require two days' advance notice and users might have to travel all day just to keep a 15 minute dental appointment. "Me, I like being able to roll down to the corner bus stop," Auberger said. ADAPT grew out of coalition of Denver disabled groups who were successful in battling RTD over wheelchair lifts. Protestors seized buses and chained themselves to railings at RTD headquarters before the battle was won. Two years ago they went national when their arch foe, APTA, held its national convention in Denver, APTA refused to allow ADAPT to present a resolution to the convention calling for mandatory accessibility until pressure was brought to bear by Denver Mayor Federico Pena, a pro-lift advocate. APTA declined, however, to vote on the issue, and ADAPT picketed the group's 1984 national convention in Washington, DC, in October. Twenty-four protestors were arrested during the demonstration, including Parker. Parker, who was joined in Washington by four other Texans, isn't through with APTA yet. When that group holds its Western Regional Convention in San Antonio April 20, Parker said they can expect almost as many demonstrators as went to Washington. "I can't think of any place in Texas where it (public transportation for the disabled) is as good as it is here in Denver -- in fact it's poor everywhere here. Dallas just decided to buy 200 or 300 new buses without lifts." The situation isn't any better in his home city of El Paso, according to Parker. "It's very poor here," he said. "There are 30 city cruisers here with lifts but the city has shown no desire to use them." Parker thinks too many people in wheelchairs are too passive. "They're not used to pushing people, but we're starting to see some changes." However, Parker points out that Texas is a very conservative state and people -- including the disabled -- are slow to change. Handicapped American, 12/84 Two articles: Article #1: [Headline] Anti-APTA Protest Grows as Disabled Demand Bus Lifts Disabled activists in several states are pressing the attack against the American Public Transit Association (APTA) in an attempt to persuade that organization to support wheelchair accessibility. At its seventh annual delegate assembly in November, the Coalition of Texans with Disabilities [CTD] urged all transit providers in that state to withdraw from APTA. “It is the urgent desire of CTD and its 77 organizational members across the state that Texas become a model of full, equal access to all transportation systems," according to the CTD resolution. CTD President Marshall Mitchell said that APTA'S transportation philosophy “is a powerful tool for discrimination and denies the vast majority of disabled persons equal access to the community." CTD is also opposed to paratransit as an alternative to wheelchair lift equipped buses because this "provides disabled people only limited use of the locally operated transit systems in all Texas cities." Mitchell said that not only does paratransit violate the equal protection clause of the l4th Amendment but operating two separate systems "is infinitely more expensive than would be totally accessible systems with only limited door-to-door service to meet the needs of those who could not use mainline service." APTA is holding a Western Regional Conference in San Antonio in April (see related stories). Meanwhile in November a spokesperson for disabled groups in neighboring Louisiana has requested that APTA's board of directors reverse its position on accessibility. Susan M. Daniels, in a letter to APTA chairman Warren Franks, said that "disabled people will no longer sit quiet while their rights are abridged." Daniels points out that the Regional Transit Authority which serves the Greater New Orleans area is not accessible, making it impossible for disabled people in that city to participate on an equal basis in community activities with nondisabled persons. In California, disabled activists are seeking to cut off the flow of public money to APTA. At its December meeting, the California Association of the Physically Handicapped (CAPH) passed a resolution calling upon various branches of the federal government to withhold funds earmarked for APTA because such payments represent "a misappropriation of public funds." More than 60 percent of APTA's operating money comes from public funds, according to the CAPH resolution. CAPH charges that this money is being used in part “to deny handicapped individuals the benefits of transportation services requiring federal financial assistance." In addition to blocking the flow of federal dollars to APTA, CAPH urges "that all public transit agencies be prohibited from paying APTA dues" while any investigations of APTA are in progress. Article #2: [Headline] Texans Plan San Antonio Showdown Chances are if you board a public bus anywhere in Texas you won't find any riders in wheelchairs. That's all going to change if Jim Parker of El Paso has anything to do about it. Parker and several other people in wheelchairs from across Texas have organized the state chapter of the American Disabled for Accessible Public Transit (ADAPT), a new national group that is trying to force bus companies and manufacturers to equip all buses with wheelchair lifts. In 1979, the Carter administration's Department of Transportation mandated such a policy, but the American Public Transit Association (APTA) successfully fought those regulations in court, arguing that it was a judgment best left to the discretion of the local transit provider. Disabled activists argued that such "local option” policies are no different from the old states’ rights arguments used in the South to block integration and lead to policies similar to "separate but equal" laws. Reagan's Department of Transportation has generally sided with APTA in this dispute and has suggested that paratransit services could provide similar service to the disabled at less cost. Opponents of lifts argue that they're unreliable. In Houston, Metro's Grumman Flexible buses’ wheelchair lifts were removed because the company said they caused too many maintenance problems. [no source or date included] ADAPT has been targeting APTA because of a lawsuit which APTA filed and ultimately won. Under the Carter Administration, the Department of Transportation (DOT) issued regulations in response to 504, which required all new buses to have wheelchair lifts. APTA filed suit saying that congress didn't intend 504 to put undue financial demands on the local transit authorities. The requirement for every bus to be lift-equipped was costly and cumbersome. APTA lost in the lower court, but appealed. The appeals court agreed with APTA that 504 didn?t mandate that all buses be lift-equipped. At present, every transit authority must make an effort to provide service to the elderly and disabled populations. There is an upper limit on the amount of money which must be spent on this service. Since para-transit is an expensive way to provide transportation services, the demand often exceeds the service available. California and Michigan have state laws requiring fully accessible transportation. In other states, transit authorities have started removing lifts from buses saying it is their "local option" to provide a fixed amount of para-transit instead of providing fixed route service. Leads to massive arrests In a scene reminiscent of the black civil rights marches of the 1960s, some 215 people in wheelchairs rolled down Wilshire Boulevard in Los Angeles on Sunday, Oct. 7, to protest the lack of accessible mainline public transit in the United States. ' Chanting "We will ride!" and carrying inflammatory placards, the single-file column snaked its way 1.7 miles from the MacArthur Park staging area to the Bonaventure Hotel where the American Public Transit Association (APTA) was holding its national convention. Although the demonstrators had been denied a parade permit, police made no attempt to halt the march and routed traffic around the procession. However, the hands-off attitude disappeared once the column of wheelchair militants reached the hotel. As hotel security personnel blocked the only wheelchair-accessible elevator that gave access to the main lobby, several of the demonstrators pulled themselves from their wheelchairs and threw their bodies in front of the escalators, vowing to prevent anyone else from entering or leaving the hotel. The disabled demonstrators shouted "Access now! Access now!" while police deliberated their next move. Finally, after an hour, the police moved in. Eight demonstrators, including one woman, were arrested for “refusing to leave the scene of a riot," according to a police spokesperson. But they didn't go without a fight. George Florom of Colorado Springs thrashed about so hard that it took three officers to subdue him. One of the officers claimed that Florom kicked and bit him, During the scuffle, police said one of the demonstrators grabbed an officer's gun. Florom was removed to a specially equipped police van. He was soon joined by Edith Harris of Hartford, Conn, a veteran of other APTA demonstrations, who had been arrested during the San Antonio APTA protest. Harris had tried several times during the day to get the police to arrest her, even to the point of throwing shredded ADAPT literature in the street and demanding that police arrest her. Police merely removed her motorized chair from the street and picked up the paper, But when Harris threw herself on an escalator, the police moved in and escorted her to a waiting police van. Police and demonstrators differed as to how well the department handled the arrests. "We look bad no matter what we do," Sgt. Bill Tiffany said. A police spokesperson said the department had medical personnel on hand and tried to provide for the special needs of those arrested. That wasn't the case, according to Wade Blank of Denver, one of the founders of the American Disabled for Accessible Public Transit (ADAPT), which helped organize the Los Angeles demonstration as it has similar protests in Denver (1983), Washington, D.C. (1984), and San Antonio, Texas (1985). "The police were real nice until we got to the Bonaventure," Blank said. “But it was a real bad situation at the hotel. The cops turned into real pigs. They wouldn't let us use the hotel restroom. Some of them laughed at a lot of disabilities of the demonstrators, and a few of them pulled their clubs and threatened us with them." Blank said he learned that the officers who pulled their clubs were later given reprimands. Lou Nau, chairman of the Disability Rights Committee of the American Civil Liberties Union (ACLU), was also critical of how the police handled the arrests. Nau said that Mike Auberger, a quadriplegic community organizer for the Atlantis Community in Denver, was not allowed to use a bathroom for eight hours, causing hyperreflexia, while others who were arrested were not allowed to take necessary medications although they repeatedly explained the danger this might cause. Four men were handcuffed behind their backs and then left for up to five hours in their chairs in police vans, according to Nau. Of the eight arrested, Harris was released that same night and five of the men by the following afternoon. The other two men were not released until Tuesday morning. Some 53 disabled protestors maintained a night-long vigil outside the county jail. The police later issued this statement: “It must be stressed that the Los Angeles Police Department has repeatedly tried to meet with demonstration leaders in the attempt to provide legal alternatives to accomplish their objectives and avoid the distasteful necessity of arresting handicapped citizens." To that end, Jack Day, a board member of the Southern California Rapid Transit District (RTD flew to Denver earlier in the year to [print completely faded] in an attempt to talk the organization out of civil disobedience. Blank was one of those who met with Day. "We told him we wouldn't use civil disobedience if the (Southern California RTD) agreed to introduce and support a resolution at the APTA convention calling upon APTA to reverse its stand and back mandatory wheelchair lifts on buses," he said. Day said that was not possible. Meanwhile back in Los Angeles Day's other board members continued to discuss ways and means of handling the demonstrators. Ironically, Los Angeles — the city where demonstrators chose to make their point - is one of the most accessible in the country. California and Michigan are the only states that require all new public transit vehicles to be equipped with lifts. Usha Viswanathan, a spokesperson for the Southern California RTD, said that 1,891 of the district‘s 2,445 active buses were equipped with lifts and another 200 were being retrofitted. The lifts cost between $15,000 and $20,000 each. Within the next five years, the district intends to operate only lift-equipped buses, making it the first 100 percent accessible system in the country. In other parts of the country it's Up to the local transit provider to decide whether or not to offer accessible service. And that's the way it should bee, according Albert Engelken, APTA's deputy executive director. Geographical and climatic conditions have to be taken into consideration because lifts are difficult to operate in snow and on curved roads, Engelken said. In the late 1970s, the Carter administration's Department of Transportation mandated that all new buses be outfitted with wheelchair lifts. APTA, which acts as a lobbying and policy-making group for some 300 separate transit districts across the country, filed a lawsuit that eventually reversed that decision. Since then disabled groups have dogged APTA wherever it meets, insisting that the organization vote on a resolution calling for mandatory accessibility. That‘s why the demonstrators were in Southern California, Jim Parker of El Paso explained. Parker said ADAPT was very appreciative of the steps California was taking toward complete accessibility.” "This is a model city," he said. The demonstrators were in Los Angeles to embarrass APTA, not the local transit district, he said. That didn't stop the demonstrators from stopping buses, however. On Wednesday, Oct. 10, wheelchair demonstrators poured onto the streets of Long Beach, where they held several buses hostage. Protestors said they would release the buses if Laurance Jackson, general manager and president of Long Beach Transit and the newly elected president of APTA, would meet with them. A spokesperson for Jackson said that would be impossible, as Jackson had other commitments at the convention and the protestors had come unannounced. Before the day was done, police issued 33 misdemeanor citations for failure to disperse and arrested l6 protestors, all of whom were later released on their own recognizance. Blank said that the Long Beach police acted appropriately under the circumstances. Long Beach had been the scene of another confrontation earlier that same week. On Monday, 26 wheelchair demonstrators staged a roll-in at the office of U.S Rep.Glen Anderson (D-Long Beach), who is chairman of the House Transportation Committee. Anderson, who had been expected in his office that day, had been detained in Washington due to a heavy work load. The congressman later issued a statement pointing out that he had consistently voted to support accessible systems. Anderson blamed the Reagan administration, not Congress, for overturning a "requirement that the handicapped be given full accessibility to public transit." Most of the demonstrators agreed with that assessment. Blank and Parker compared APTA to the Klu Klux Klan and called upon its individual members either to fire its executive board, including executive vice president Jack Gilstrap, a longtime foe of mandatory accessibility, or to pull out and form a new national transit organization. A Gilstrap aide said he had no intention of resigning. Blank said Gilstrap and the rest of the APTA membership could expect to see them again when the organization holds its next national convention in Detroit in 1986. ADAPT plans similar tactics, since Michigan, like California, has already opted for total accessibility. "It's a question of civil rights," Blank said." And it's a national issue. Rocky Mountain News Sunday March 27, 1977 Disabled are limited by society's attitudes By Alan Cunningham PHOTO by John Gordon, News: A young man (Larry Ruiz) sits in a wheelchair in front of a building. Caption reads: Larry Ruiz is one of those leading better lives of the Atlantis community. Nobody seems to know exactly how many disabled Americans there are - or even how one should define them. In Colorado, the figures are even more sketchy than they are nationally. But one estimate, based on federal statistics, suggests there may be as many as 350,000 disabled citizens in this state. If true, that would mean that 14 percent of the population suffers from some disability. The same projection indicates that as many as 83,000 of these persons as unable to work, keep house or go to school. Gov. Dick Lamm sometimes uses a more conservative figure of 10 percent. But even if that is closer to the truth, it shows that the plight of the disabled is a major problem. It also offers a clue as to why the disabled seem sure to emerge soon as the country's newest civil rights lobby. The have the numbers to make themselves heard - and seen - if they can begin to speak out with a unified voice, demanding their fair share of the American Pie. Until now, they've suffered the fate of most minority groups: invisibility. This is ironic, since most are highly visible if anyone chooses to see them. But for many reasons - not the least a sense of guilt - the able-bodied tend to turn away from those with crutches, wheelchairs and seeing eye dogs. And those who plan public facilities and services often reflect this attitude. It is politically safe for them to ignore the needs of the disabled pretending such persons make up a tiny fraction of the population and thus don't deserve a major share of attention. A myth to be sure. But it is only one of several myths which the Atlantis community, a group home for handicapped persons, in a minority report to the upcoming White House Conference on Handicapped individuals, hopes to destroy. For instance, there is the idea that nursing homes are primarily heavens for the aged and the infirm. The opposite side of that assumption is set forth in the opening chapter of the Atlantis report. Few realize that our nation's institutions also house a great many disabled young persons, some in their early teens. THESE ARE THE victims of our society's response to children and young adults who have muscular dystrophy, cerebral palsy, birth defects, blindness, and neurological disorders, or have survived accidents of varying kinds. But they are there by the thousands, many simply because they were labeled by physicians and psychologists as "retarded" and unable to function normally. It is difficult to imagine a more stifling or inappropriate atmosphere for a young person. It is inhumane to shackle and imprison youthful energy and curiosity into the nursing home routine. Such repressive living leads to anger, hostility and finally to the withdrawal and waste of a battered ego. As the report goes on to explain, the Atlantis group has fought to get more than 30 young men and women out of nursing homes and institutions so as to demonstrate that they can reverse this pattern if given a chance. But, even as it begins to reverse, new problems emerge. Most have to do with obstacles which the world has placed in the way of the disabled person. Again, it has a lot do with society's tendency to act as if he doesn't exist. Funds for rehabilitation programs, both public and private, are so scarce that only a small fraction of the disabled ever benefit from them. A prime example of this comes from State Rehabilitation Director Glenn Crawford, who says his division has determined that 135,000 persons in Colorado are potentially eligible for its services. Yet, in 1976, the division served about 14,300 persons. The figure will inch its way up to 16,000 this year. Such private facilities as the widely acclaimed Craig Hospital also have finite resources. They apply guidelines to decide which applicants will be accepted and which won't. Needless to say, a lawyer whose only disability is the loss of his legs has a better chance than a 19-year-old with no schooling who has lain on his back for most of his life. Funds and facilities for handicapped scarce Those who don't get the help often wind up in the category that Wade Blank of Atlantis refers to as "the losers." He contends that those who work with the disabled have too quickly given up on this group of people consigning them to lives of hopelessness. And he further argues that the implications of this have narrowed opportunities not only for the severely disabled, but for many others with less serious problems. For even those who have escaped the awful label of the "loser" run into obstacles every day. The Atlantis report focuses on many of these obstacles. These are some of the observations: EDUCATION. Many disabled youngsters in the past have failed to get adequate schooling either because they were in institutions or because their families assumed they would never be able to lead normal lives as adults and consequently didn't need to be trained for careers. Even those who went to school often were sidelined into special programs for the handicapped. While academic standards were high in such programs, the students were poorly prepared either intellectually or emotionally, to get along in a world of able-bodied persons. The recommended solution, "mainstreaming"- that is, letting disabled youngsters and adults go to school in the same classroom with everyone else. MONEY. The complexities of the various welfare programs on the county, state and federal level often conspire to keep disabled persons in nursing homes. Counties often find they have to pay more money if a man or woman is living in his own apartments, or in a facility, such as Atlantis, than they do if he or she is in a nursing home. That's because the federal government pays the bulk of the nursing home fee. Likewise, assistance payments are cut off if a disabled person earns more than a pittance in a month's time. The cutoff can be as low as $65. The "maximum level of income"from federal state and county assistance payments is $185. This means many disabled persons are living below the poverty level as it has been defined for other underprivileged groups. The solution as viewed by those who put together the Atlantis report, is to simplify and integrate the complicated payments system. But even more important, to increase payments so that everyone gets the same amount of money whether he is in an institution or out. TRANSPORTATION. The report talks about a number of things here including electric wheelchairs and curb cuts, but is main statement under this heading is that bus systems such as the Regional Transportation District (RTD) should become fully accessible to the disabled. RTD, it contends, has been unresponsive to the needs of disabled would be riders for transportation to work, school and for pleasure trips. Even the special HandiRide service - which RTD often boasts is a frontrunner in the nation - is given poor marks. LAWS. [not legible...] Colorado concerning the disabled in general and the severely physically disabled in particular, the report states. Furthermore, it is not realistic to think that the disabled will get effective legislation passed without having government officials sensitized to the disabled's problems. This may already be changing. Largely due to lobbying by Atlantis, hearings were underway in the General Assembly this week on two bills aimed at helping the disabled. One, a Senate bill now in committee, would allow more Coloradans to receive payments so they could hire home attendants. The other, a House bill, is a "civil rights bill for the handicapped." It would bar discrimination against the disabled. Backers of the latter bill point out that it's needed because the federal civil rights laws, while dealing with the rights of racial minorities and women, have never guaranteed these same rights to disabled citizens. Idealy, says the Atlantis report, Congress and the state legislatures need to weed out laws which are confusing and contradictory, often creating "disincentives"for the disabled to pursue more normal lives. A wholistic approach is needed. JOBS. Virtually every problem mentioned above, plus all the others catalogued in the report, tend to stand in the way of the disabled person who seriously wants to go to work in spite of the lip service paid to the slogan, "Hire the handicapped," many find the doors still closed. The reasons are many and the problems complex. Lack of schooling is a factor. Some disabled persons have languished in sheltered workshops, counting fish hooks and getting paid $10 a month for it, the report says. Others have an education but find that architectural barriers, or the lack of adequate bus service, keep them from getting to jobs they could perform. And attitudes often stand in the way when physical barriers are moved aside. "Perhaps the greatest barrier of all is in the minds of men," the report notes. It advocates more and better training programs, plus affirmative action plans to assure that larger numbers of disabled workers are hired by public and private employers. In an elaborate ceremony several weeks ago, the Atlantis report was presented to Mayor Bill McNichols. But privately some of those connected with the report conceded they didn't expect to see much action on the local level until public policies in Washington and throughout the nation begin to change significantly. That's why the Atlantis group is placing much emphasis on its efforts to make an impression on the Carter administration during its formative period. The time seems ripe for a coalition of disabled groups around the country to launch a concerted civil rights drive on behalf of their "invisible" constituents. And the first test may come April 5, when many groups have threatened to stage a sit-in at offices of the Department of Health Education and Welfare, including the regional office in Denver, if new HEW Secretary Joseph Califano hasn't issued new regulations to implement laws for the disabled. "The disabled have been ignored far too long in this society," declares the Atlantis report. "We are demanding that our rights be addressed. We are giving you, the policy makers, our findings and recommendations on how to solve the inequities in the system. "The next is yours." Such words, when voiced by other groups, have inevitably been followed by major social changes. It seems likely the same pattern will apply here. It does not appear be the start of the article.] "They bill it as door to door service, but it does crazy things like, if you want to go from west county to the city, it will pick you up but leave you at the city-county line." Bi-State plans to expand the service in December by adding 11 lift-equipped vans and extending the service into the city. The system will also extend its hours of operation, to 6 a.m. to 7 p m. Its use in the city limits will be limited to disabled passengers, Plesko says, and, with the extended hours, disabled workers will be able to use the service to get to their jobs. While some other cities are making similar (or greater) progress — San Francisco, for one, has lifts on every one of its buses — things are still moving too slowly for the members of ADAPT. And they blame the slow pace on APTA. (ADAPT members who came to St. Louis this week stressed that they were here because of their quarrel with APTA and were not here to demonstrate against Bi-State. They said they approved of the plans Bi-State had made for the achievement of 100 percent accessibility, but nonetheless questioned the slow pace at which that was occurring.) The fight between ADAPT and APTA has its roots in the 1970s. During the Carter administration, the Department of Transportation (DOT) issued rules requiring transit systems to have at least half of their buses equipped with wheelchair lifts. Those regulatioms came out of the Rehabilitation Act of 1973, a landmark federal law that many in the disabled community point to as being equivalent to the Civil Rights Act of 1964. But APTA filed suit against DOT for its regulations and a federal court upheld APTA's argument for "local option," that is, allowing individual transit authorities to decide how they would comply with the spirit of the regulation requiring adequate accessible transportation for the disabled. Says APTA's Engelken, "These decisions are best made locally, because the local transit systems understand the needs of their passengers. For example, it would not be feasible to have a transit system for the disabled based on 100 percent lift-equipped buses in Fargo, North Dakota, because in the winter it would be almost impossible for someone in a wheel chair to get to a bus stop and wait for a bus. Able-bodied people have enough trouble (there)." Says Bob Kafka, another ADAPT leader, "(That) is one of the arguments people use for not providing transportation. They say, 'People in a motorized wheelchair can't get there, so why provide (accessible buses)?' But do you know what a person in a motorized wheelchair has to do to get to the bus stop? He has to hit a joystick. Little old ladies cleaning people's homes for years, with fallen arches, and having to carry shopping bags, no one has ever said we need special transit for them. But a disabled person who has to hit a joystick to operate his wheelchair, we need special transportation for them because it’s too cold, too snowy, too hilly, too wet, too this. "It's like were going to break, were going to fall apart." ADAPT sees APTA's insistence on local option as an attempt by the group to foster so-called "separate-but-equal” transportation systems. They say that APTA is attempting to segregate transit systems; keeping disabled passengers out of the mainstream system. ADAPT was formed in 1982 in Denver by Auberger and a handful of other members of that city's disabled community. It was put together because APTA had scheduled a convention for Denver and APTA's resistance to 100 percent accessible main-line public transportation for the disabled made the trade organization the moral equivalent of "the Ku Klux Klan and the Nazi party" for disabled Americans, Kafka says. Thirty demonstrators showed up at the first protest, and there have been eight subsequent protests, all at APTA regional or national conferences. The demonstrators model their actions after the non-violent civil rights activists of the 1960s. They block access to buses: they block access to the APTA convention sites. Some, including Auberger, chain themselves to buses or to doorways. The aim is arrest and the accompanying media attention. Auberger has been arrested at least 30 times by his own count, including this past Sunday at the Omni Hotel. ADAPT's militant tactics have drawn criticism from several corners, including others who work in the disabled community. "While we agree with the goals and-objectives of accessibility for disabled persons, we don't agree with the tactics of civil disobedience or confrontation as a means to achieve those objectives," says Ginny Weber, assistant to Deborah Phillips, the commissioner of the city's Office on the Disabled. "There are other ways to get things done," she says. "You can go through the legislative process. You can conduct public awareness campaigns. Over the last 10 years, some progress has been made. To change conditions that have been in existence for a long time takes a while. You have to just stay in there' and keep working towards it." Sheldon Caldwell, executive director of the St. Louis Society for Crippled Children, agrees. "I don't think it pleads our case well to have a group with a disruptive militant attitude. This is my personal opinion: I haven't polled my staff on this, but I don't think disruption is ever the way to go about it. But others are not as harsh in their judgment. "I take a different position (from those who criticize ADAPT)," says Paraquad's Tuscher. "I have the point of view that there are many ways to get from where we are to where we want to go. We're more likely to use negotiation, legislative action, legal action, public relations campaigns. Confrontation is not one of our methods, but I don't think it's my place to judge (ADAPT). Let history judge: let history prove whose method is the right one." About the criticism from within the disabled community, ADAPT's Kafka says, "Those who are in power are not going to give it up to you willingly. Without the push of civil disobedience, even the Civil Rights Act would never have come about." Says Auberger, "(Negotiation and public relations campaigns) delay the justice. It's not perceived as delaying justice, but it is. They are doing harm to their disabled brothers and sisters by saying, 'I don't support their tactics, but I do agree with their position.— Because other groups for the disabled receive so much financial support from corporations, they are less willing to be as direct in their demands as is ADAPT, he says. "They will eat a lot of garbage just to get half the loaf. "If you're going to change things, you have to get rid of the notion right away that you are going to be someone's friend," he says. "Be-cause someone is going to want something different than you do. The city of St. Louis and I will never be friends. The police and I will never be friends, but I won't lose any sleep over it. I know when I leave here, people will be talking about this issue in a way it hasn't been talked about before and something might change. "You look at demonstrators in history. Go back to the civil rights movement. The blacks who demonstrated weren't seen as 'nice.' If you go back further, to the women's suffrage movement, those women who wanted the right to vote weren't seen as mom and apple pie. But typically people who have been vocal about their rights are never perceived as being nice." Mrs. Sue Sutherland, 23, is one of two women who tutor the Atlantis residents, using a special teaching machine developed by a University of Colorado professor. A staff of 27 persons, including some who were themselves rescued from institutional settings, provides attendant care. Their pay comes from the state and county attendant allowances of up to $217 per month to which many in Atlantis are entitled by law. A HOTLINE CONNECTS the housing units and the apartments of those no longer at Las Casitas, so residents can seek help quickly in emergencies. The job of manning the line is one of many tasks performed by the residents. Each is paid $50 a month, a figure arrived at because anything higher would oblige the recipients to involve themselves in red tape - and, in many cases, to lose the welfare payments they now receive. Most residents draw $184 a month in public assistance, most of it coming in the form of federal "SSI" payments. The rest comes from the state. From this, they pay $101 for room and board. Blank is the highest paid staff member. He gets about $8,000 a year from a combination of state and private grants. This leaves him eligible for food stamps. Administrator Mary Penland "gets paid when we can scrounge it up," and Kopp - who lives in Blank's house and has bought a third of it - hasn't been paid a dime of salary during his two years as co-director. Needless to say, Atlantis has made waves. lt has clashed with doctors who insist that the place for severely disabled persons is in an institution. And it has fought with those label people as "mentally retarded," saying the phrase is largely meaningless. "WE TOTALLY REFUSE to use that label here." says Blank. “We don't think the term is applicable to most young people. If they're retarded, it's socially retarded." Blank bubbles with excitement at the success stories of the people around him - those he proudly describes as “my circle of friends. “ And their affection for him is equally visible. There is Gary Van Lake. a 24-year-old Wyoming native who broke his neck in a 1973 car crash. Wyoming rehabilitation officials insisted he had no hope of returning to a normal life. "They told me I had reached my potential," he recalls. Coming to Denver to attend college, he wound up in a nursing home. Atlantis got him out and helped him get into Craig Hospital where he learned anew how to do things like go to the bathroom and drive a car. Now he has a specially equipped van, complete with an elevator for his electric wheelchair, and is engaged to marry in May. An outsider, viewing the rundown setting and the severity of the residents' physical problems, has to rely on their words and smiles to know how much their lives have improved. ONE TESTIMONIAL came from John Folks, 21, who has been paralyzed from the neck down since he was shot in June 1972. He breathes through a tube in his throat and uses a specially equipped telephone with a loudspeaker and a switch that he can trigger by moving his head to one side. Soon after Blank told how Folks had joined other Atlantis residents on a camping trip last summer. Folks explained how he felt about leaving the nursing home in which he lived for nine months before he came to Atlantis: “It's just like getting out of prison. lt is like starting over again. " Acknowledging that he and others at Atlantis “are somewhat egotistical" in their boasts of success, he adds: "We have to be to survive." But he also contends that the boasts are well-founded. For one thing, he notes, Atlantis has caught President Carter's fancy and could play a role in Carter's upcoming plans to revamp the welfare system. Last summer, when candidate Carter passed through Denver on the campaign trail, he met briefly with Atlantis officials. This week, two HEW aides from Washington came to Denver for a briefing on what Atlantis is doing. And a thick report, put together by Atlantis with an $82,500 federal grant, will go to Washington as Colorado's minority report at the White House Conference on Handicapped Individuals. The May event, planned when Gerald Ford was still president, is the first of its kind. lt is expected to set the stage for significant action by Congress to aid the nation's disabled citizens. The money for the Atlantis reports which was unveiled in February, came as a belated response to the original efforts of Blank and Kopp to get enough money so they could build Atlantis from the ground up. When the money came through in 1976, they knew it wouldn't be enough to get them out of Las Casitas. But they saw the value of a comprehensive report about the need of the disabled. ITS CONCLUSIONS are clear and blunt. Blunt as Wade Blanks words when he describes why Atlantis has the potential to be seen us model for the nation. “Our critics say all we have to offer is the slums," he noted a couple of days ago. "Yet 55 people are on our waiting list." The Handicapped Coloradan ADAPT wins transit access VlCTORY! Federal court orders all new buses to be equipped w|th wheelchair lifts APTA pressures DOT to appeal decision Feb. 13,1989. Call it V-D Day. Victory over the Department of Transportation (DOT). Or call it V-A Day. Victory over the American Public Transit Association (APTA). Because on that day in Philadelphia, within earshot of the Liberty Bell and walking distance of the hall in which the Declaration of Independence was forged, disabled Americans won not only the right but the means to ride mainline public transportation. On a 2-l vote, the U.S. Court of Appeals for the Third Circuit ruled that in the future every transit system in the nation that buys buses with assistance from the DOT must purchase only buses equipped with wheelchair lifts. That decision reverses a 1988 ruling by U.S. District Judge Harold Katz who upheld DOT’s policy of allowing transit systems the “local option" of providing public transit to people with disabilities through a paratransit system. APTA, which reaffirmed its support of local option at its last national convention, has urged DOT to appeal the decision to the U.S. Supreme Court. Such an appeal must be filed within 90 days, or by May 13, 1989. DOT already has filed for a rehearing, and the court is expected to announce by March 29 if they would be willing to reconsider the decision. Justices Carol Los Mansmann and A. Leon Higginbotham wrote the maiority opinion with Judge Morton Greenber dissenting. The case was brought to the Court of Appeals by a dozen disability rights organizations, led by the militant American Disabled for Accessible Public Transit (ADAPT) and the Eastern Paralyzed Veterans of America. Timothy M. Cook, director of the newly formed National Disability Action Center, argued the case. It wasn't the first time wheelchair lifts have been in the courts. in 1979, the DOT, at the direction of President Jimmy Carter, ordered all transit systems to install lifts on new buses, but that mandate was struck down in federal court after an appeal by APTA. APTA’s insistence on local option led to the creation of ADAPT by a handful of militant wheelchair users in Denver, who set up pickets outside the Hilton Hotel headquarters of APTA's I983 national convention. At the insistence of Mayor Federico Pena, ADAPT was allowed to speak before the convention and no arrests were made. That was the last time either situation would exist. At every subsequent national convention or regional APTA meeting, wheelchair militants have shown up in force, blocking buses and hotel entrances until local police forces were forced to cart them away to jail. “Who would have thought a bunch of ragbag crips from Denver could have started something that would have grown this big?" asked ADAPT founder Wade Blank, co-director of the Atlantis Community, a local independent living agency. Both Blank and Cook cautioned that the war was not over yet, although both said they were pleased that the 73-page court opinion was filled with the language of the civil rights movement and would go a long way toward convincing those on the fence that their cause was just. The Court of Appeals opinion reads, in part: “We find the goal of eradicating the ‘invisibility of the handicapped‘ led Congress to enact measures to facilitate, if not immediate and complete mainstreaming of the handicapped, then affirmative and aggressive steps in that direction." The decision involves only new buses, as the justices argued that requiring systems to retrofit old buses would subject them to "undue burdens." Cook said after the decision was handed down that the "opinion is completely consistent with President Bush's call last week, in his speech before Congress, for Americans with disabilities to be ‘in the economic mainstream.‘ Nothing is more essential to meeting that goal than the provision of accessible public transportation." Mike Auberger of the Denver ADAPT chapter, who's been arrested in several cities while engaging in civil disobedience, agreed that accessible public transit is the key to enabling disabled people assume full citizenship. "People are dying out there," Auberger said. "Disabled people go into nursing homes because they don't have any options. I personally know people who have committed suicide because they don‘t have any options. Wheelchair lifts will give them that option." Auberger said that ADAPT doesn't plan to rest on its laurels. They'll be Reno April 7-ll for a regional APTA convention and back in Denver April 23-26 for the national meeting of the Urban Mass Transit Association (UMTA). “Our demand is simple," Auberger said. “We just want them to drop the appeal process and accept the decision." If they don't, Auberger promised that protesters would try to fill the jails one more time. To that end, ADAPT members intend to picket DOT offices in 12 cities on Good Friday, March 24, and ask staff members there to call the Presidiential assistant in charge of transportation matters and ask that the court decision not be appealed. "If they don't make the call, then we don't go," Auberger said. "I'm sure we'll take some heat because we're doing it on Good Friday," he said, explaining that he expects many offices to be shorthanded because of workers leaving early for the Easter weekend. [Headline] Disabled protest lack of HEW action By Alan Cunningham Chanting slogans and carrying picket signs attached to crutches, more than 100 disabled persons staged a protest march and sit-in Tuesday at the federal office building in downtown Denver. Their sit-in was expected to last all night outside the regional office of the U.S. Department of Health, Education and Welfare (HEW) It was part of a nationwide protest aimed at forcing HEW Secretary Joseph Califano to sign regulations implementing a "handicapped bill of rights" passed by Congress nearly four years ago. The demonstration was peaceful, for the most part, but was marred by one incident in which a parking lot manager across the street from the federal complex allegedly assaulted demonstrator Dennis Wilcox, a quadraplegic, causing him to fall out of his wheelchair. Wilcox apparently was unhurt. The manager, James C. Chidlaw, insisted the encounter occurred accidentally as he attempted to guide stalled motorists through his lot. But, on complaints by Wilcox and another demonstrator, Chidlaw was cited into county court to face two charges of assault. Simultaneous demonstrations too part at HEW headquarters in Washington and at regional offices in Denver and eight other cities. They brought forth an assurance from Califano that he would sign the regulations “early in May," but Denver demonstrators — part of a nationwide coalition which had demanded he sign by Monday - were unimpressed. In speeches outside the federal courthouse at noon Tuesday, they declared they wanted to see immediate action by HEW, followed by an aggressive program to carry out various facets of the four-year-old law. At issue is Section 504 of the Federal Rehabilitation Act of 1973, which had never been put into effect. Handicapped groups have fought with HEW secretaries under Presidents Nixon, Ford and now Carter to force them to sign regulations which would implement the act. A federal judge ordered last year that such regulations be signed, but the matter still went unresolved. The law when it takes effect, will guarantee many of the same rights to handicapped Americans which were extended to racial minorities and to women under prior legislation of the last two decades. Its provisions are expected to force public school districts to open many more of their classrooms to wheelchair-bound students, to force employers to grant equal pay to handicapped employees and to provide more stringent civil rights guarantees to those in nursing homes and institutions. The protests brought assurances from several elected officials that they were trying to persuade President Carter to speed up action on the matter. Messages to this effect came from Gov.Lamm and U.S. Sen. Floyd Haskell, D-Colo. In addition, a Washington aide to Rep. Pat Schroeder, D-Colo., told the News late Tuesday that she was drafting a telegram asking that Carter order Califano to act. Other protests took place at HEW regional offices in Boston, New York, Philadelphia, Atlanta, Chicago, Dallas, Seattle and San Francisco. Among the leaders of the Denver gathering were Ingo Antonisch, executive director of the Mayor's Commission on the Disabled, and Don Galloway, the new executive director of the Governor's Advisory Council on the Handicapped. Even Antonisch, an Austrian-born man with a stiff German accent and a generally conservative approach, was drawn into the militancy of the event. After acting HEW regional director Ed Lapidas read Califano's "early in May" statement, Antonisch stepped to the microphone and said, "Thank you very much," which inspired a woman in the crowd to yell, "We don't thank him very much, Ingo!" Antonisch got in the spirit by declaring, "I would like to say we hear the message but we want to see the action." Galloway, a black man who has been blind since he was 16, stirred up the crowd with a brief speech reminiscent of earlier civil rights campaigns. Taking his cues, they responded with lusty cries of “Right on" Even many who had difficulty speaking loudly and clearly joined in as best they could. At one point, Lyle Peterson, master of ceremonies at the noon rally, tried to lead the crowd in a chorus of "We Shall Overcome," traditional anthem of the black civil rights movement. The song proceeded weakly for a few seconds, but died when one protestor interrupted, shouting: "We want our rights!" Immediately, the crowd picked up his line and began to chant "We want our rights!" with an enthusiasm that had been lacking in the aborted attempt to sing.
