San Antonio Light, 4/25/85 [Headline] Disabled protesters claim win After three days of public protests, members of the American Disabled for Accessible Public Transit said they believe they have accomplished their goal of drawing the public’s attention to the transportation problems they encounter. The organization called off planned demonstrations yesterday after receiving a pledge from Mayor Henry Cisneros that he would seek improvements in local transit services. More than 50 members of ADAPT, who were staying at The Convent of the Holy Spirit, were expected to leave San Antonio and return to their homes in other states. “We have raised the issue substantially," said ADAPT spokesman Wade Blank. “Our issue is a mobility problem for more than 10,000 people in San Antonio," he added. “They are a ‘hidden minority." Sunday, ADAPT members blocked the lobby of the Hyatt Regency Hotel where the American Public Transit Association was holding a regional meeting. Monday, ADAPT members moved into the VIA Metropolitan Transit offices on Myrtle Street and remained for several hours until they met with association officials. And Tuesday, the organization's members blocked VIA buses at several downtown intersections. Two ADAPT members were given citations for obstructing traffic, but no arrests were made. No disabled San Antonians joined the protests during which ADAPT members demanded that VIA buses be equipped with wheelchair lifts. VIA operates a special van transportation service for the disabled. Blank, who charged there is a lack of leadership and organization within the San Antonio disabled community, said it would be up to the people here to take up the issue now. The ADAPT spokesman said San Antonio police officers who dealt with the three days of demonstrations were the “most friendly, and, level-headed police in any city” in which the group has demonstrated.

Los Angles Times Part 1/Saturday, October 5, 1985 page 22 [Headline] Disabled Vow to Parade Despite Denial of Permit By John Kendall, Times Staff Writer Despite denial of a city permit, wheelchair-bound members of organizations for the disabled say they are resolved to parade along Wilshire Boulevard on Sunday to demonstrate at a downtown meeting of the American Public Transit Assn. Barry Atwood, chairman of Access Now, told reporters Friday that he expects 300 to 500 gravely disabled people to gather at MacArthur Park at noon and illegally parade to the Westin Bonaventure Hotel to protest what he charged is the association's refusal to support accessible public transportation for the disabled. In anticipation, the Los Angeles Police Department issued a three-page background statement pledging that those who “persist in violating the law will be arrested." Specially equipped vans and trained medical personnel will be used if arrests are made, the statement said. Atwood appeared before the Police Commission on Tuesday to request a parade permit. According to police, the verbal request was denied because of the lateness of the bid and because of the lack of police and other city personnel “to protect marchers or traveling public due to prior commitments of resources." During the hearing, Atwood was questioned about tactics employed by the American Disabled for Accessible Public Transit (ADAPT) in other anti-transit association demonstrations in San Antonio, Denver, Chicago and Washington. The tactics included blocking intersections and buses, chaining wheelchairs together and handicapped protesters throwing themselves from their wheelchairs to the ground. Atwood, who said he is not a member of ADAPT, told reporters that he was asked by police commissioners to promise that similar demonstrations would not occur in Los Angeles. He said he told the panel he could make no such promise. Atwood charged that Police Chief Daryl F. Gates threatened to arrest demonstrators Sunday “to intimidate disabled citizens and to ensure that they remain silent, impassive non-participants in society." Sgt. Ralph Hubbard, who heads the Police Department's special events planning unit, said Atwood’s charge is “absolute nonsense. . . . It’s simply untrue. No. 224 @ 1989 Sparks Tribune Co [Headline] Protesters plan to disrupt convention By Faith Bremner Tribune Staff A national handicapped rights group says it will take over downtown Sparks next month and commit acts of civil disobedience to draw public attention to handicapped accessible public transportation. But American Disabled for Accessible Public Transportation's (ADAPT) specific target will be the American Public Transportation Association (APTA) convention at John Ascuaga's Nugget April 9-13. In 1980, APTA successfully lobbied the federal government to drop a requirement that all public transportation systems that receive federal funds must purchase buses with wheelchair lifts, ADAPT co-founder Mike Auberger said. APTA represents about 450 transit authorities in the United States and Canada, including Citifare which is hosting the convention. "Everything we do will be centered around transportation,” Auberger said in a telephone interview this morning from ADAPT's Denver, Colo. headquarters. “That's the only reason “we're coming to Sparks; We‘re not coming to the city just to inconvenience Sparks.” Auberger said he expected about 150 ADAPT members from all over the country to show up during the convention and do things like chain themselves to city buses and block the entrances to the Nugget. Sparks Police Department spokesman Tony Zamboni said the department is aware of the convention and of ADAPT's plans to protest. He said Sparks Police are in contact with other police agencies around the country that have dealt with the group. "We are here to provide a service and we will protect these person's first amendment rights as well as anyone else‘s," Zamboni said. "We are prepared for the outcome of any situation such as this.“ Sue Hyde, marketing manager for the Regional Transportation Commission which oversees the Citifare operations, said her agency does not plan to change its operations during the convention. Seventy percent of Citifare‘s buses are already equipped with wheelchair lifts and plans to purchase more, she said. Most of the buses that come into downtown Sparks have the lifts, but some of them don’t, she said. “I don't think Citifare should have any problems," Hyde said. "If they block our buses they would be hurting their constituency." Since it was founded six years ago, ADAPT members have experienced 1,000 arrests — all at APTA conventions, Auberger said. "It‘s a varied group, we're all very experienced." Auberger said. "The majority of the people have gone to jail a number of times and stayed in jail for a week at a time. "This is not a group that's afraid of the police. These people are willing to go to jail to make a point." The point to all the demonstrations, Auberger said, is to make life difficult and inaccessible to the APTA conventioneers, just like it is for people in wheelchairs who can't get onto buses. The organization also uses its demonstrations to make the public think about handicapped access to public transportation, Auberger said, even if the public reacts negatively to ADAPT's methods. "(The public) doesn't have to like what we do or support what we do but it‘s important for them to think about the issue,“ Auberger said. It‘s not easy to arrest someone in a wheelchair, Auberger admits. "We've had cases where people were taken out of their wheelchairs and their chairs were left behind" Auberger said. “If the police don't have a van with a lift, they sometimes lift the chairs right into the paddy wagons. "The motorized wheelchairs can weight up to 300 pounds. It's not an easy process."

Six of 26 sit-ins seeking public transit access for disabled people were arrested for trespassing Monday in the office of Rep. Glenn Anderson, D-Long Beach. The protesters, many disabled and in wheelchairs, were removed from Anderson's sixth-floor office office in the Post Office building at Third Street and Long Beach Boulevard when they told Long Beach police officers they were going to stay until they could talk to Anderson. Boyd Kifer, Anderson’s district representative, explained that Anderson was on the House floor in Washington, D.C., and unable to talk to them. They said they would wait. Responding to a citizen's arrest request by the post office’s station manager, Lyle Van Dorne, police issued misdemeanor citations to six persons on the sidewalk in front of the post office. Ten of the group avoided citations by leaving the office. Names of the other 10 were recorded in field interviews that involved no arrests. Police Sgt. Dave Buchanan said the demonstrators were out-of-state people representing a national organization, American Disabled for Accessible Public Transit (ADAPT). Buchanan told the sit-ins that they would be given the citations rather than being booked at the station if they confined their demonstration to the public sidewalk. He also pointed out that a couple of the sit-ins, who had early evening flight reservations, would miss them if they insisted on going through the longer booking process. Jim Parker, of El Paso, Tex., spokesman for ADAPT, said his group comes to national conventions of the American Public Transit Association, now in session in Los Angeles, every year "to continue to press our demand for a policy of full, 100 percent accessibility to public transit for disabled people.” Parker said Anderson was targeted for the demonstration because he is chairman of the House Transportation Committee. Parker agreed with a statement from Anderson’s office that the congressman has voted in line with their wishes. He deplored Congress’ failure to overturn a Reagan administration order that killed a federal mandate for nationwide transit accessibility for the handicapped. About a dozen Long Beach police officers assisted in removing the protesters. The police group included a woman officer, K.M. Daeley, who communicated with some of the disabled in sign language. In a statement Monday evening, Anderson noted also that "it was this administration, not Congress, which overturned a requirement that the handicapped be given full accessibility to public transit.” That move, by administrative order, nullified the full access provision of the Rehabilitation Act of 1973, Parker said, leaving that issue to the option of each state. Ironically, California opted, by state law, for full accessibility in new purchases of public transit vehicles, a fact that Parker saluted. In fact, Parker said Los Angeles is one of the better cities in the nation for lift-equipped buses. Nevertheless, the ADAPT group registered its protest in Long Beach and in a second day of demonstrations in downtown Los Angeles. Eight were arrested in Los Angeles Sunday for failure to disperse and interfering with police during a demonstration by about 130 activists. Anderson appealed to ADAPT to help block the Reagan administration’s intended cuts in public transit operating funds. "I would be pleased,” he said, "to try and make sure that administration officials sit down and discuss this important issue with the elderly and handicapped community.” Sgt. Buchanan said the Long Beach demonstrators, left the post office at about 1:30 p.m. Monday, but returned several hours later. "Three of them blocked traffic on Long Beach Boulevard with their wheelchairs,” he said, "but we just rolled them back to the sidewalk and they dispersed again.”

Lynton Washington Post Staff Writer Secretary of Transportation Elizabeth Hanford Dole yesterday praised Metro's new plan for completing 89.5 miles of the proposed rail system, calling it a “highly positive step." Nevertheless, in her first comment on the transit agency's proposal, Dole stopped short of saying whether the Reagan administration would approve the plan. The administration has limited federal construction funds to 76.4 miles of the proposed 101-mile Metro system. The new Metro plan calls for using federal funds previously authorized by Congress to complete 89.5 miles, including a long-delayed Green Line branch connecting Fort Totten with Greenbelt in Prince George's County and a Yellow Line spur to a proposed Van Dorn Street station in Alexandria. Metro officials have said they will eventually seek an additional congressional authorization of more than $1 billion to complete the rest of the planned 101-mile system. Dole cited the new Metro plan in a speech to the American Public Transit Association, which opened its annual meeting at the Convention Center here yesterday. The association, which represents the nation's transit systems, is holding its three-day conference in Washington for the first time in recent years. About 8,000 officials are expected to attend the sessions. Shortly after Dole spoke, 14 handicapped demonstrators, including several in wheelchairs, were arrested outside the Convention Center, according to D.C. police. The protesters were charged with blocking entrances to a public building and disorderly conduct. Since last week, members of a Denver-based group called ADAPT, an acronym for American Disabled for Accessible Public Transit, have staged demonstrations here to demand improved access to buses and trains for handicapped patrons in transit systems throughout the nation. The group contends that all buses should be equipped with special lifts for wheelchairs. ln her speech, Dole expressed "deep concern for the plight of the handicapped" and argued that proposed regulations now under review by federal officials would provide "adequate access" to transit services for disabled riders. The federal proposals are less stringent than those sought by ADAPT, but they appear largely acceptable to the transit association. Several years ago, the association sued federal officials to block stricter requirements. Jack R. Gilstrap, the association's executive vice president, said the new proposals would provide flexibility for local governments. "We support the local option concept," Gilstrap said. Dole described the 89.5-mile Metro plan as evidence that "there can be progress" in state and local efforts to devise new methods to finance transit projects. The Metro plan still must be ratified by county and city governments, in the Washington area. and Dole indicated the administration would withhold a decision on the plan until local governments act. Federal financing of the nation's transit systems is expected to be a focus of debate at the convention. Dole indicated no shift in policies, and she reiterated the administration's reluctance to subsidize operating costs, a controversial issue. "The most crucial issue facing public transit today is funding." Metro General Manager Carmen E. Turner told the conference. Twelve of the handicapped demonstrators were arraigned before a U.S. commissioner and released pending further hearings. Two protesters forfeited collateral of $l0 each. Title: Police prepare for wheelchair demonstration By Scott Luck and Scott Craven Phoenix police have set up a command post at the downtown Hyatt Regency to monitor actions of a group of wheelchair activists that plans to protest a convention this weekend. Although the American Public Transit Association convention is not scheduled to begin until Sunday, 20 officers Friday blockaded Monroe Street by the Hyatt. In addition to the officers, two police buses were at the scene, which police spokesman Ken Johnson said would be used, if needed, to take protesters to jail. The protesting group, American Disabled for Accessible Public Transit, plans to picket the convention to demand installation of wheelchair lifts in every bus and transit system that receives federal transportation funds. The group says efforts by the APTA to install equipment for the disabled have been unacceptable. The group has held similar protests in other cities across the country. Members have chained themselves to buses, obstructed bus routes, thrown themselves on to the steps of buses without lifts and generally raised havoc. The conference is scheduled to run until Wednesday. ADAPT organizer Michael Auberger said he is trying to draw 150 people together to participate in demonstrations throughout the week. “I can’t imagine why the police would be there today (Friday), especially in that location,” Auberger said. “I met with the police chief, and I didn’t tell him anything that would lead him to believe we were going to demonstrate today.” Johnson said police chief Ruben Ortega met with Auberger to help minimize any problems that might arise but said Auberger did not outline any plans for his groups protest. “We understand they (ADAPT) have a right to demonstrate just as anybody else would, but were going to make sure the demonstration is done lawfully and peacefully Johnson said.” Past ADAPT demonstrations have led to numerous arrests. “We would rather not make any arrests, but we will if we're forced to,” Johnson said. “This is something between them (ADAPT) and the transit people and we don’t want to be caught in the middle. The hour-long protest was aimed at demonstrating the lack of access to buses that handicapped persons endure both locally and nationwide. The demonstrators agreed to release the buses—by abandoning their position in front of the vehicles—only after Metro General Manager Carmen E. Turner agreed to meet with them. The demonstrators. representing a national group called American Disabled for Accessible Public Transit, said they wanted all new Metrobuses to be equipped with power equipment that lifts wheelchairs into buses. AIso, they said, they want the Department of Transportation to allocate more funds for equipping buses nationwide with the lifts. "We say it's a civil right, just as they denied black people the right to get on a bus and now allow them access." said Mike Auberger of Denver, a spokesman for the group. “It's a right like being able to go to school." Presently, Metro schedules a limited number of runs with buses equipped with lifts, or dispatches the buses if a handicapped person requests on the day before. The protesters said a lift costs $8,000 on a $180,000 new bus. an amount they said is far below the cost of an air conditioner. "I’ve called for buses, and they break down said Ronald L. Smith, who sat in a wheelchair in front of the Old Executive Office Building. "We want all the buses to be for the handicapped." Beverly Silverburg, director of public affairs for Metro, said last night that the group will meet with Assistant General Manager Theodore Weigle and Turner "will probably meet with the group." The protest began at 1:15 p.m., when the demonstrators announced to reporters that they were going to surround the next bus that stopped in front of the White House. It happened to be one marked "Brookland." Several demonstrators lay down on the street or leaned against the front of the bus while supporting themselves on crutches. A second contingent blocked another bus that had just pulled up behind the first. "What's going on?" Theodore R. Wright, the driver of the Brookland bus, said to no one in particular. The protesters told him they wanted to meet with Turner to present their grievances. As riders disembarked, Wright called his dispatcher. "I'm looking at two buses that are blocked," he said "They want Carmen Turner." Wright said he once drove a bus equipped with a power lift for six months and never had a handicapped rider. But he added, "l sympathize with these people. Probably they have some legitimate beefs." As the impasse dragged on, the protesters took over a third bus as it was trying to pass the first two. Police persuaded the protesters to let it go, but they became more agitated and began blocking buses across the street in front of Lafayette Square. By 5 p.m., police had cordoned off the section of Pennsylvania Avenue NW in front of the White House, disrupting rush-hour traffic in all directions. Metro supervisors came and went, and one protester was taken to George Washington Hospital after he fell off his wheelchair. By 5:30 p.m., the protesters had corralled seven buses, would-be passengers were complaining that they could not find a bus, and bus drivers were lining the streets. At 5:35 pm., D.C. Police Lt. W.R. Sarvis passed the word that Turner had agreed to the meeting. The demonstrators uttered whoops of joy and hugged each other. “No confrontations, no problems," said Sarvis. The protesters said they also plan to present their demands to the American Public Transit Association, which meets here Sunday.

TITLE: Disabled group plans protest at transit meeting in Sparks By Susan Voyles/Gazette-Journal Up to 150 wheelchair-bound people are expected to protest outside John Ascuaga’s Nugget beginning Sunday, and Sparks police say they are ready. The protest is being staged by a national group called The American Disabled for Accessible Public Transit, and its target is the western regional meeting of the American Public Transit Association. As many as 700 people representing public bus systems, including many that don’t have buses with lifts to handle wheelchairs, are expected to attend. In protests at 16 other cities in recent years, disabled protesters have held marches, crawled onto or chained themselves to buses, and barricaded hotels where the public transit association held its meetings. “We try to make their conventions as inaccessible to them as they have made transportation to disabled people ” said protest organizer Mike Auberger of Denver. “They can’t just come and have fun." Auberger, 34, said he met earlier this week with representatives of Sparks police, the Washoe County Sheriff’s Department and Nugget security. He was handed a 32-page list of possible violations, including felonious assault, that his group could be charged with. “From what I heard, the police department’s tactic is going to be to intimidate,” Auberger said. “I wouldn’t be surprised to see the police on Sunday in riot gear.” Auberger, who arrived in town Monday to prepare for the protests, said he expects about 150 handicapped people from around the country to show up. Auberger said he met with members of the Sparks and Reno police, the Washoe County Sheriff’s Department and court marshals Tuesday. “It’s definitely threatening but I think the people coming in here are well aware of what could happen to them,” Auberger said. Already Auberger has had a confrontation, albeit a friendly one, with Nugget security and Sparks police. Monday when Auberger was casing the outside of the Nugget, with video camera in hand, a security guard and a police officer approached him and knew him by name, he said. “It gave me a real feeling for how the police are going to respond and how the casino security will respond," Auberger said. “It was like the casino burped and the police said ‘Excuse me,’ and that’s not normal." Auberger said his group has yet to begin drawing up strategy on how it will carry out its demonstration. However, Auberger predicted his group won’t be happy with being confined to B Street. “(The location) is very visible to traffic on B Street but it won’t be visible to APTA members,” Auberger said. “The spot is perfect if your issue is with the public or if it's directed at the Nugget." Auberger said his group is not violent although it is confrontational. Zamboni showed the press a 10-minute video tape of an ADAPT demonstration held in San Francisco Sept. 28, 1987. The video tape showed demonstrators blocking a SAMTRANS bus and tying their wheelchairs to the vehicle's wheelspokes and sitting on the Powell Street cable-car tum-around. It also showed police handcuffing protestors to their wheelchairs and the protestors chanting "We want to ride,” and "We want access."

St Louis Post Dispatch May 19, 1988 Title: Protesters Plead Guilty, Are Released By William C. Lhotka and Mark Schlinkman Of the Post-Dispatch Staff Thirty-seven disabled people arrested at wheelchair protests here this week entered guilty pleas Wednesday afternoon to charges of peace disturbance and then were released under an agreement worked out by lawyers. The court action came after members of the American Disabled for Accessible Public Transit (ADAPT) held a final protest rally outside Union Station, where an association of transit systems completed its five-day regional convention Wednesday. No new arrests were made at the 45-minute gathering, which involved about 90 people, most of them in wheelchairs. But about 2:15 a.m. Wednesday, two able-bodied men who police said were associated with ADAPT were arrested on assault charges after fighting with police on the parking lot of the Holiday Inn, 2211 Market Street. Police were called to the scene by hotel security guards who reported a disturbance. The incident had no connection with any protest or demonstration. Police said one of the officers had suffered a potentially serious eye injury. In an interview Wednesday afternoon, an ADAPT leader, the Rev. Wade Blank of Denver, denied that the two men were members of The organization. He said they were with a disabled woman from Lawrence, Kan., who had arrived in St. Louis early Wednesday. Blank said she apparently had come here to take part in the rally later in the day; he said he was unsure whether she had done so. Most of the members of ADAPT here have been staying at the Holiday Inn on Market. The protesters want the transit group, the American Public Transit Association, to push for the installation of mechanical wheelchair lifts on all buses in the United States. Association officials say that they support access for the disabled but that each local system should have the right to decide for itself how to provide such access. Protesters were arrested Sunday for blocking entrances and hallways at the Omni International Hotel at Union Station and on Tuesday for blocking buses entering and leaving the Greyhound Lines depot at 801 North Broadway. Under the agreement worked out by prosecutors and defense attorneys, Associate Circuit Judge Thomas C. Grady accepted the time the defendants served in jail after their arrests in lieu of any further sentence or fines. The judge also waived court costs. The agreement meant that the demonstrators were free to leave St. Louis. On the other hand, they have misdemeanor convictions on their records. Three of the 37 faced charges from both the Sunday and Tuesday protests. Arrested in the separate incident early Wednesday were Mike Knowlen, 22, of Lawrence, Kan.., and Dana Dower, 22, of Viburnum Mo. Police said Dower faced a felony charge of second-degree assault and misdemeanor charges of peace disturbance, resisting arrest and destruction of city property. Police said Knowlen faced misdemeanor charges of third-degree assault, peace disturbance, cruelty to an animal and interfering with an arrest. Police said the fight had erupted as police officers attempted to arrest Knowlen. Police said Knowlen had been slapping and swinging a dog by its tail on the lot and had been shouting profanities. In the scuffle, police said, Dower fell face forward onto the trunk lid of a police car. Police said Officer Barry Hinchey had been treated at Bethesda Eye Institute for an injured retina after he was struck on the face Hinchey also was treated, at St. Louis University Hospital, for a human bite wound. A victim of congenital cerebral palsy, Jennifer will have to fight for everything in a society that still doesn't respect the rights of the disabled, says her mother, Cynthia. And that will probably mean more demonstrations like the one that led to her "arrest" by police last night. "She's a very, very brave little girl and I'm proud of her," Cynthia Keelan said, as Jennifer looked up at burly policemen surrounding her small group. There had been a lot of excitement as the beefy cops first moved in. But the drama waned as everyone awaited special transportation to police headquarters, and Jennifer's little blonde head kept sinking to her chest. Station 25 director Edouard Sarrazin was quick to point out that the little girl hadn't been arrested. [Subheading] Paddy wagon ride "It's her mother who has been arrested." Still, Jennifer had to watch about 40 policemen surround her and her mother and other members of the group. American Disabled for Accessible Public Transit. And it meant a ride to police head-quarters in a converted wheelchair bus being used as a paddy wagon. The Keelans, of Scottsdale, Ariz., are in Montreal to protest with other ADAPT members at the annual meeting of the American Public Transit Association (APTA), which is meeting at the Queen Elizabeth Hotel. Later, at police headquarters, police decided to release the mother and daughter without pressing charges, saving Jennifer and her mother the trauma of being separated overnight. [Subheading] Make things better "I hope they don't separate us," Cynthia Keelan had told the Daily News just a few minutes before. "You don't think they will, do you?" Though in perfect health herself, she decided to get involved in ADAPT "so that things will be better for the disabled when my daughter grows up than they are now." ADAPT's specific beef with APTA concerns the 3,000-member group's refusal to endorse a policy requiring all urban transit buses to be equipped with wheelchair lifts. Cynthia Keelan didn't miss the irony of her daughter, wheelchair-bound since infancy, being lifted aboard the police bus with the kind of lift ADAPT would like to see as standard equipment on all buses. "Access to transportation is essential if people in wheelchairs, people like Jennifer, are to have a fair chance," said the young mother. "It's too bad the authorities don't always make these kinds of buses available."

The American Public Transit Association was coming to Detrolt and so were American Disabled for Accessible Puplic Transit. APTA versus ADAPT. There was insensitivity to handicappers on the part of city officials; apathy and collaboration by local handicappers nervous about ADAPT's presence, and a general lack of commitment by anyone other than ADAPT to the principle of public transit for all, accessible buses for all. I wrote a column in mid-September outlining the approaching confrontation. lt had happened in other cities. ADAPT, an outgrowth of an independent living organization in Denver called Atlantis, had fought for and won a commitment from the City of Denver for total accessibility on its main buses. ADAPT wanted the American Public Transit Association, at its 1983 Denver national convention, to take a similar public stand. lt did not, and ADAPT promised to appear each time APTA convened and protest that decision. Then I turned the story over to others, since I knew I could not be impartial. They covered the story with words and pictures, but let me tell you about some of the strange, ironic, disappointing and disturbing things that took place beginning Oct. 3 in Detroit. SAD BUT perhaps not unexpected was the reaction of city officials. In many ways, the city acted like any other city would react. It had wooed and won the APTA and promised APTA officials a safe and peaceful convention in the face of expected ADAPT protests. APTA had faced challenges from ADAPT in Denver, Los Angeles, Washington, San Antonio and Cincinnati before the Detroit convention. City officials were pretty sure they knew what to expect. What would ADAPT do? They would "do" civil disobedience. They would block buses that were not lift-equipped for wheelchair users. Wheelchair users would try to crawl onto some of these inaccessible buses. But while putting the best face possible on a woefully inadequate mass transit system, the city put the worse possible face on its position toward a mass translt system that is accessible to all. Just before the APTA delegates arrived, Mayor Young announced that the City of Detroit was buying 100 new buses. He emphasized that the service-poor city would use its own money. Thls point was notable, since Young made no mention of the new buses' accessibility. Federal regulations require non-discrimination toward handicapped riders and require communities to develop a plan to make their systems accessible. Michigan law requires that each bus bought with the aid of state money must be lift-equipped. ln response to questions, city officlals said that perhaps as many as 20 - one of five — of the new buses would be lift-equipped. NOT COINCIDENTALLY, the City of Detroit had entered into an out-of-court settlement 14 months earlier in a federal lawsuit brought by four handicappers against the city on a variety of complaints of non-compliance with federal law regarding non-discriminatlon and accommodation of handicappers. in that settlement, the city had agreed to maintain the lifts on buses and to train drivers in their proper use. But little has been accomplished. Young's announcement that the city had bought at least 80 percent inaccessible buses underlined the city's position regarding access. it also reminded handicappers that the settlement had not committed the city to providing future accessible, well maintained buses. In the meantime. efforts were under way to neutralize ADAPT. The Detroit City Council denied the group a parade permit. ADAPT had contacted Rosa Parks, the Detroit woman whose refused to move to the back of a Montgomery, Ala., bus in 1955 gained national attention and sparked protests during a different civil rights struggle. Her representatives said she would not lead a parade, but would hold a news conference. She later said she might attend a press conference, but did not. CBS reporter Ed Bradley from "60 Minutes" delivered a keynote speech at the APTA convention Oct. 6. Bradley said he had investigated ADAPT found their complaints "didn't hold water." FORD MOTOR CO. allowed a [bus] full of APTA delegates to use its private property to gain access to a coctail party site that ADAPT members planned to barricade. The Southeastern Michigan Transportatlon Authorities (SEMTA), which has committed itself to total access of its bus systems by the end of decade, loaned the Detroit police an accessible van so they could [take] ADAPT protesters to jail. Frank Cl[-]one of the plaintiffs in the federal lawsuit against Detroit, provided sensitivity training to Detroit police officers who were expected to be arresting ADAPT wheelchair users. But the training only extended [so] far. Although there was no "arm twisting or head-beating," as a [police] representative described it, police were unable to appropriately house protesters and provide medical necessities, food and bedding to some who were arrested. On Oct. 7, Detroit Recorder's [County?] Judge George Crockett felt compelled to issue a writ of habeas corpus, freeing them because of these conditions.J As ADAPT members went home Oct. 8-9, I was still teed off. This will not be the end of the debate on transportation access in Detroit and across the country.

[Headline] Disabled Stage Protest Parade; 8 Arrested Oppose Transit Group Policy Against Mandating Bus Chair Lifts By GEORGE STEIN Times Staff Writer The halt and the blind converged on a public transit conference in downtown Los Angeles Sunday, parading through streets without a city permit and blocking entrances and stairways at the conference hotel in an effort to make the point that the disabled are denied the access to transportation available to the general public. Eight activists for the disabled were arrested on charges of failing to disperse an unlawful gathering and intefering with a police officer. The arrests —“a distasteful necessity," police said -- took place in and around the Bonaventure. They came after Los Angeles police had relented to an earlier stand to make arrests if any tried to parade along Wilshire Boulevard from MacArthur Park to the conference. “Listen, how could we arrest all these people?" Capt. Bill Wedgeworth said. During the procession, 131 wheelchairs, stretching more than a block, carried people with disabilities ranging from spina bifidia, cerebral palsy and muscular dystrophy to snapped spinal cords, congenital defects and postpolio paralysis. Many had the withered limbs and lack of body control that the more fortunate usually try not to stare at. But not Sunday. Motorists slowed to watch the sight. Some honked in support. “This is beautiful. I am proud to be a disabled person. I am tired of being closed away," said Bob Kafka, as he wheeled along. Kafka, from Austin, Tex., a spokesman for the American Disabled for Accessible Public Transit, has a broken spinal cord. He was among those arrested later. Once inside the hotel, the group headed for the reception area in an attempt to reach delegates to the annual conference of the American Public Transit Assn. However, police kept the demonstrators bottled up near the entrance, one floor above the main reception area. "Access now! Access now!" the demonstrators shouted. The crowd, which came from a spectrum of disabled activist groups in and out of California, targeted the transit convention because the organization opposes a national policy mandating wheelchair lifts on buses. The American Public Transit Assn.'s position is to let each transit agency deal with access for the disabled as a local decision. In Los Angeles, the Southern California Rapid Transit District, with 2,445 buses, has wheelchair lifts on 1,691 and is retrofitting another 200. The RTD hopes to have lifts on all buses in five years, which, according to a spokesman, would probably make it the first major urban bus system to be so equipped. After the demonstrators blocked hotel escalator wells for almost an hour, Wedgeworth told them their gathering was illegal. The actual arrests were an odd orchestration of defiance and cooperation. Escalator Well George Florom, a member of the disabled group from Colorado Springs, Colo., began thrashing as police tried to remove him from an escalator well. It took three officers to subdue him. “He began kicking and trying to bite me, so he had to go," Lt Ken Colby explained. One of the demonstrators grabbed an officer's gun, police said. Florom, lay quietly once handcuffed, and police gently placed him in his wheelchair and wheeled him to a lift-equipped van that had been arranged for the occasion. Trained medical personnel also were on hand. Edith Harris of Hartford, Conn., had earlier failed in an attempt to get arrested, tearing up American Disabled for Accessible Public Transit literature and throwing it on Figueroa Street. "Arrest me,“ she screamed to ‘no avail from her motorized wheelchair. The police only moved her to the sidewalk, and an officer went back to [unreadable] trash. Her wish was granted later, after she tried to herself down one of the blocked escalators. Then she calmed down, gratefully accepting a drink of water from a police officer, while waiting for a stretcher to arrive. Unhandcuffed, sitting upright, she was placed in the van. Her wheelchair was carefully handed in after her. Taken to Station The arrestees were taken to the Central Division station for processing. The seven men were later booked at County Jail, where bail was set at $500. Harris was booked at Sybil Brand Institute. Some police worried that the department's image would suffer from Sunday's action. “We look bad, no matter what we do," Sgt. Bill Tiffany said. After the arrests, a spokesman said, “It must be stressed that the Los Angeles Police Department has repeatedly tried to meet with demonstration leaders in the attempt to provide legal alternatives to accomplish their objectives and avoid the distasteful necessity of arresting handicapped citizens.” The police were not alone in their concern. Five months before the convention, according to Mark Johnson, 34, of Westminster, Colo., an organizer for the disabled group, RTD board member Jack Day flew to Denver to try to talk the organization out of civil disobedience. Negotiations foundered on an demand by the disabled group that the RTD introduce and support a proposal that the American Public Transit Assn. reverse its stand and back mandatory wheelchair lifts on buses, Johnson said. He said the disabled activists will be in town through Wednesday. The American Public Transit Assn. is a lobbying and policy organization. The five-day convention began Sunday.

Title: Police on guard as disabled plan protest at transit meet By LYNN MOORE of The Gazette Montreal Urban Community police are bracing for trouble from a militant group of disabled Americans with a beef against the American Public Transit Association. The association is holding its convention in Montreal, and about 150 members of the American Disabled for Accessible Public Transit (ADAPT) and 20 handicapped Canadians will engage in "confrontational" lobbying at the convention site and elsewhere in the city. The group wants mechanical lifts on all buses in the U.S. It claims between 300 and 500 members. [Subheading] Meet starts tomorrow The Montreal Urban Community Transit Corp., a founding member of the transit association, is host of the four-day meet. It starts tomorrow at the Queen Elizabeth Hotel and is expected to draw about 3,000 people. MUC police are taking the protesters seriously, after speaking with U.S. police and watching videos of demonstrations in the U.S. The MUC department says the protesters — many of whom will be in wheelchairs — are capable of creating traffic chaos, halting buses and closing bridges. While the disabled group won't reveal its targets, a spokesman told The Gazette that its members will chain themselves and their wheelchairs to buses and buildings. "We are not violent. We are confrontational and aggressive," Stephanie Thomas said. She and her husband have come from Austin, Tex., to protest. ADAPT has hounded transit association conventions for five years. Thomas says she has been arrested at least 10 times but has never spent more than two days in jail. "I personally would rather not go around making enemies in every town," she said. "I would just like to ride the public transit." Some Montrealers who had planned to protest with ADAPT have backed out after a newspaper reported that many of its members were Vietnam veterans and violence was expected, said Francois Gagnon, vice-president of the Movement of Handicapped Consumers of Quebec. But Thomas said her husband will be the only Vietnam vet involved in the Montreal protests. To deal with the anticipated protests, about 100 MUC police officers have been put through a day-long training session, division director Marcel Auger told a news conference yesterday. Part of the session was conducted by two handicapped Montrealers: Restraining straps instead of handcuffs will be used on demonstrators who are arrested. Medical staff will examine protesters, Auger said. Municipal court and Quebec Court judges will be available around the clock to avoid keeping the protesters in custody. ADAPT members usually plead guilty to charges, however, and opt for jail terms rather than pay fines. Space in the two city jails has been set aside for the protesters. [Subheading] Service inadequate Local disabled groups aren't happy with MUCTC services; Gagnon called the MUCTC's door-to-door minibus operation, coupled with a small taxi service, simply inadequate. He was particularly incensed over the MUCTC's refusal to provide the elderly and handicapped with easy access to the new Metro stations that opened last winter. The Regroupement des Usagers du Transport Adapte is "not at all pleased" with the level of service provided to the disabled by the MUCTC but will not protest with ADAPT, spokesman Yvon Desgro-seilliers said. But for disabled persons dependent on wheelchairs, the fare box is more a slot machine: Their chance of getting on a bus is frequently as unlikely as hitting the jackpot. The problem is an acute shortage of buses equipped with wheelchair lifts to get disabled passengers into the bus. In St. Louis, less than one-fourth of the 690 buses operated by Bi-State Development Agency are equipped with lifts; only half of those available lifts function. The story is the same in almost every city across the United States, and now disabled rights activists are pointing to the lack of accessible transportation as the most significant problem facing the disabled today. "In the past (disabled groups) placed education and employment programs high as a priority," says Mike Auberger, a leader and founder of American Disabled for Accessible Public Transit (ADAPT). "But we've always seen that as the biggest joke: 'Hire the handicapped.' You can give me a job, one that pays a good salary, but if I can't drive (because of a disability) and can't take a bus, there's no way in heaven you can hire me. It's been, 'Here, let's put this piece of the pie out here for you but not give you a way to reach it. The unemployment rate among disabled Americans is appallingly high. The most recent figures available for St. Louis are from the 1980 census, says Russ Signorino spokesman for the Missouri Division of Employment Security. [at this point in the article the first column is cut off on the left, slightly] According to that census, there were 119.000 [disa]bled St. Louisans. but only 48,000 were in [the] work force. says Signorino. Of the 71,000 of the labor force. 59.000 did not work [bec]ause their disability prevented them from [emp]loyment. The balance of 12,000 disabled [unclear]ons were so-called "discouraged workers." [Indi]viduals who had stopped looking for work [beca]use of various factors. ‘You're going to find a higher percentage of [disc]ouraged workers among the disabled (than [amo]ng the general population)." Signorino [said]. Nationally, less than one-third of the country's 13 million disabled are in the labor force, according to the Statistical Abstract of the United States 1986, the most recent edition to {unclear] information on the employment status of disabled Americans. Of those who are in the work force, almost {unclear]-fifth are unemployed. ("Discouraged" workers are not included in the work force; those who are unemployed. but looking for work. are.) This is compared, in the same year, with the able-bodied population of the country, which nearly 70 percent of 133 million persons were in the workforce and 9.6 percent of those were unemployed. The problem of lack of access to public transit brought Auberger and more than 100 other members of ADAPT to St. Louis this week to demonstrate at the annual meeting of Eastern region of the American Public Transit Authority [sic] (APTA), the industry's [principal] trade organization. ADAPT wants the transit industry to move toward what ADAPT calls "100 percent accessibility." That is every bus in the country would have wheelchair lifts. But APTA opposes that saying it is impractical and too expensive. It favors, instead, what is known as "local option." Each transit authority would decide how it would make public transportation accessible for the disabled, using either buses equipped with lifts, paratransit vans with lifts (the so-called dial-a-ride services, or a combination of the two. Right now, 18 percent of the nation's systems use lift-equipped buses exclusively, 44 percent use paratransit vans and the remainder — including St. Louis — use a combination. Nationally, according to APTA Deputy Executive Director Albert Engelken, one in three buses is lift-equipped. That is progress, Engelken says. In 1980, only about 11 percent of the nation's buses were lift-equipped. But for ADAPT and others in the disabled community, the progress is too slow. “I'm damned impatient," says Jim Tuscher, vice-president of programs for Paraquad, a St. Louis non-profit agency that serves disabled people. "I personally have been involved with Bi-State for well over 10 years, negotiating, trying to get an accessible transit system and today we still do not have an adequate system. Sure, their attitude is better now than it was 10 years ago, in that they are willing to cooperate with the disabled community. They had to be dragged, kicking and screaming into this. But I‘m a results person and so far I haven't seen any. I still can't go out to the corner and take a bus." Currently, 171 (24.8 percent) of Bi-State's 690 buses are equipped with wheelchair lifts. Tom Sturgess, the company's director of communication, says the system has a goal of 100 percent wheelchair accessibility, but getting there is a slow process. Later this summer, the number of lift-equipped buses will be increased to 238, but that will still mean that only one in three Bi-State buses can be used by a disabled person. Sturgess says Bi-State has notified its manufacturer that it will be buying another 60 lift-equipped buses sometime in the near future. Of the company's present 171 wheelchair lifts, only 85 (or just less than half) function. “We've had a lot of problems with them." says Sturgess. “The new buses we're getting will have a different kind of lift in them, one we think will work. Of those we have, we're in the process of repairing as many as we can, but some will never operate again. We're convinced it wouldn't be economically feasible to do so. The biggest problem is the salt they spread on the streets and highways. It sprays up into the lift mechanism, corrodes the wires and rusts the lifts.“ Because there are so few lift-equipped buses at present, only 16 to 18 of Bi-State's 129 routes have accessible buses, says Todd Plesko, Bi-State's director of service planning and scheduling. [Italicized ends] – Julie Haraskin, during a nonviolent direct-action demonstration in Los Angeles by ADAPT (American Disabled for Accessible Public Transit) Barry Giddings is a citizen of the United States who lives in Philadelphia. In 1981, he was shot in the neck and became a quadriplegic. The only way he can get around is in a wheelchair. Until December 10, 1985, he and his brother lived in his mother's home. On that day, Mrs. Giddings and her family were evicted. She went to Philadelphia's Division of Adult Services to get shelter for herself and her sons. Mrs. Giddings was told that she and her nondisabled son would be provided shelter, but Barry Giddings would have to provide for himself. Why? Because he was disabled. The apparatchiks tried to make Mrs. Giddings understand that they had no choice in this matter. Taking care of her disabled son's needs, they explained, would cost more money than was being spent on the average homeless soul in the city's shelters. Then there were the costs of additional insurance premiums to cover the city if this quadriplegic were taken in. Then where should he go? Was this man to be thrown out into the street to lie there until he died? Not our problem, said Philadelphia's Division of Adult Services. Lest you think that the decision to wholly abandon this disabled man was made by some low-level employee devoted to the increasingly popular notion that inconvenient people should be terminated, the person who sent Barry Giddings into the night was following the policy of Philadelphia's Division of Adult Services. A relative arranged to have Giddings taken into Jefferson Hospital for the night because the staff there, unlike the folks at Adult Services, could not bear leaving him without shelter. They put him in the emergency room. The next day, he was removed to Magee Rehabilitation Hospital, although he did not require hospitalization. What he required, was a place to stay, and Magee Rehabilitation Hospital couldn’t keep him because providing shelter wasn't its' function. Barry Giddings, with the help of Stefan Presser, an American Civil Liberties Union attorney, took the city of Philadelphia to court. The class action suit charged that the city policy discriminates against homeless people who are disabled, and thereby violates their Constitutional right to equal protection under the law as well as their rights under Section 504 of the Federal Rehabilitation Act of 1973. That statute forbids discrimination against the handicapped in any program receiving Federal funds, and Philadelphia's Division of Adult Services, as part of the Department of Human Services, does receive Federal money. The city of Philadelphia quickly caved in, placed Giddings in a temporary shelter and said it would find permanent housing for him and his mother. As Stefan Presser points out, a particularly shocking thing about the case was that although the city had been engaged in a vigorous campaign to get the homeless into shelters, it had this firm policy of shutting out the disabled among the homeless. "There's no telling," Presser told me, “how many disabled people have been turned away until we got the policy changed, and who knows what happened to them? Some of the organizations for the disabled inform me that from time to time they've had phone calls from people who have been refused shelter because they're not able-bodied, but when they got to the phone booth from which the call was made, there was no one there." Ralph Ellison's Invisible Man could have a counterpart in the experiences of the nation's disabled for many, many years. As Robert Funk, Director of the Disability Rights, Education and Defense Fund, wrote in 1981: “American society, under the guise of humanitarian efforts, has developed a record, with respect to treatment of disabled persons, that is a history of isolation and discrimination inflicted upon them because of their ‘handicaps.’ This history, manifested in the attitude of ‘out of sight, out of mind,' carried out through policies of custodialism, has resulted in an ostracized, invisible minority denied access to organized society." This year, in his part of a forthcoming book, Images of the Disabled/Disabling Images, Funk makes the corollary point—— and see if any of this applies to you ---- that "the general public does not associate the word 'discrimination' with the segregation and exclusion of disabled people. Most people assume that disabled people are excluded from school or segregated because they cannot learn or because they need special protection. So too, the absence of disabled coworkers is simply considered a confirmation of the obvious fact that disabled people can't work. These assumptions are deeply rooted in history. Historically, the inferior economic and social status of disabled people has been viewed as the inevitable consequence of tho physical and mental differences imposed by disability." I know a young woman whose disability is athetosis, a form of cerebral palsy, which affects her speech and the way she walks. She is a first-class writer --- a published writer --- and a graduate of Harvard Law School. Currently in Hartford, she specializes in state regulation of automobile and homeowners’ insurance. Her name is Lisa Blumberg and she wrote me recently: "If nondisabled adults spent more time talking to disabled adults, they would learn that anatomy is not destiny and never has been." But because many disabled adults are segregated from the rest of the population, misconceptions about them, along with ignorance of who they actually are, continue to create more discrimination. For instance. Michael Landwehr of the Council for Disability Rights in Chicago, born with spina bifida, was disabled during surgery when he was 12. He is a graduate of the University of Illinois. Landwehr watched with great interest when in 1973 Congress enacted Section 504 of the Rehabilitation Act forbidding discrimination against the disabled in any programs or activities that receive Federal funding. So what has Michael Landwehr's life been like since 1973? “I have been denied an apartment based on my disability," he says. “Last year I was uprooted from home when the commuter train I took to work refused to let me continue riding without an attendant. I was told I could not buy a ticket in the first-class section of an airliner unless I also purchased a ticket for an attendant. I have been denied jobs and promotions on the basis of my disability. Every day I am denied access to public transportation. [He is in A wheelchair.] “Hundreds of thousands of disabled persons remain incarcerated in nursing homes and institutions, isolated from every aspect of community life, denied their right to vote, denied the right to education and employment. Disabled people remain the most unemployed and underpaid group in the country. For every dollar earned by a nondisabled white male, a disabled white male earns 52 cents, a disabled minority male earns 25 cents, and a disabled minority woman earns 12 cents." But the disability rights movement is gathering momentum and has already brought about some changes. Accordingly, by the end of this decade, there is likely to be a stretching of public consciousness concerning this form of American apartheid that has largely been ignored during the rise of all the other movements for equal protection under the law-—blacks, women, Native Americans, homosexuals and lesbians, Hispanics, et al. Future columns will include an exploration of the nonviolent direct-action arm of the disability rights movement, which is currently the most vigorous continuation of the Martin Luther King-Saul Alinsky legacy. The series will also go into the history of legislation and court action concerning the disabled; the seemingly infinite ways in which the disabled are distorted, sentimentalized, and underestimated by the press, television, and films; a battery of very specific legislative recommendations by the disabled; and a good deal more. One of the underlying themes is a comment by Vassar Miller, who has published eight volumes of poetry, one of which was nominated for the Pulitzer Prize. In her early sixties now, she was born with cerebral palsy. “What handicaps me far more than my physical condition," she says, “is the reaction society has to it. And, no less important, my reaction to society's reaction." Vassar Miller has edited a new book, Despite This Flesh (University of Texas Press), an extraordinarily illuminating collection of short stories and poems about the disabled. If public television had any imagination, a striking series could be made from Despite This Flesh. It ranges from pungent, poignant, and sharply funny evocations of childhood to a resoundingly erotic poem about a paralyzed man, "Seated Nude" by Richard Ronan. In her introduction, Vassar Miller tells of how, when she was a child, before there was ever such a thing as special education or mainstreaming, her stepmother “had tried to enroll me in a private school. ‘They just looked at me and started talking about God!‘" her stepmother said in dismayed tones when she came home. By the time the 1980s are over, a picket line of the disabled might elbow God aside and change the admissions policies of a school like that. The pressure is rising inside the disabled to break out of their caste, to be visible, to be part of whatever the hell's going on that they want to be part of. Consider ADAPT (American Disabled for Accessible Public Transit). In a number of cities around the country, its members have been demonstrating and getting arrested in protests against the lack of lifts on buses and the absence of ways of enabling the disabled to use other forms of public transportation. On October 6 in Los Angeles, a march of some 280 disabled ended at the Westin Bonaventure Hotel, where the American Public Transit Association was holding a convention. This was the scene, as described in The Disability Rag (Box 145, Louisville, Kentucky): "Attempts by ADAPT members to descend to the main lobby of the Bonaventure on the one elevator connecting the lobby with the street level were met with police resistance. Security forces turned off the elevator and escalators. Police blocked doors to prevent other disabled people from entering the hotel. Chants of ‘We Will Ride!‘ filled the Bonaventure from protesters inside and out. A number of ADAPT marchers, determined that conventioneers would not be able to use the escalators either, tried to block the escalator entrances or to throw themselves down the steps....By Monday, the Bonaventure had become a police-held fortress.“ I bet you never thought disabled people could do anything like that. It's just the beginning. As an ADAPT organizer yelled at a crowd of the disabled in Los Angeles, “We've got to get over our slave mentality!"
