Title: Police prepare for wheelchair demonstration By Scott Luck and Scott Craven Phoenix police have set up a command post at the downtown Hyatt Regency to monitor actions of a group of wheelchair activists that plans to protest a convention this weekend. Although the American Public Transit Association convention is not scheduled to begin until Sunday, 20 officers Friday blockaded Monroe Street by the Hyatt. In addition to the officers, two police buses were at the scene, which police spokesman Ken Johnson said would be used, if needed, to take protesters to jail. The protesting group, American Disabled for Accessible Public Transit, plans to picket the convention to demand installation of wheelchair lifts in every bus and transit system that receives federal transportation funds. The group says efforts by the APTA to install equipment for the disabled have been unacceptable. The group has held similar protests in other cities across the country. Members have chained themselves to buses, obstructed bus routes, thrown themselves on to the steps of buses without lifts and generally raised havoc. The conference is scheduled to run until Wednesday. ADAPT organizer Michael Auberger said he is trying to draw 150 people together to participate in demonstrations throughout the week. “I can’t imagine why the police would be there today (Friday), especially in that location,” Auberger said. “I met with the police chief, and I didn’t tell him anything that would lead him to believe we were going to demonstrate today.” Johnson said police chief Ruben Ortega met with Auberger to help minimize any problems that might arise but said Auberger did not outline any plans for his groups protest. “We understand they (ADAPT) have a right to demonstrate just as anybody else would, but were going to make sure the demonstration is done lawfully and peacefully Johnson said.” Past ADAPT demonstrations have led to numerous arrests. “We would rather not make any arrests, but we will if we're forced to,” Johnson said. “This is something between them (ADAPT) and the transit people and we don’t want to be caught in the middle. O'Connor OF THE EXAMINER STAFF The Hall of Justice resounded with victory whoops and the whirl of motorized wheelchairs as 43 'handicapped activists arrested for blockading the Powell Street cable car line got their day in court. Protesters used their arraignment Wednesday before Municipal Court Judge Philip Moscone as a platform for a new attack against the American Public Transit Association, which they say has not done enough to provide the handicapped with access to public transit. Moscone allowed designated speakers to address the court after each group of blockaders entered no contest pleas to charges of obstructing a public thoroughfare. The $50 fine the charge carried was dropped as Moscone credited the night the 43 demonstrator spent in jail as "time served." A second charge of failing to disperse was dropped "in the interest of justice," according to Deputy District Attorney Randall Knox. Jane Jackson, who spoke on behalf the first group of 14 wheelchair-bound demonstrators arraigned Wednesday, seized the opportunity to charge APTA with denying handicapped citizens of their civil rights. "It is for this reason that we believe Jack Gilstrap (APTA executive vice president) should be asked to resign or should be forced to resign," Jackson said. "APTA is not acting in good faith." More than 15,000 public transit officials from around North America attended the four-day convention. Officials of the transit group have said they feel the access question should be handled on a local level. Jackson also said the coalition of handicapped-rights `groups`, which captured national media attention with four days of protests and blockades across the city, was pulling out of a scheduled meeting with APTA officials Thursday. "It's the only move left open to us," Jackson said later while members of the September Alliance for Accessible Transit and American Disabled for Accessible Public Transportation cheered her and the other blockaders as they exited the courtroom. About 75 wheelchair-bound protesters lined the hallway outside the courtroom, chanting and clapping in approval and support as each group of blockaders were arraigned and allowed to leave. "They're our heroes," said Connie Arnold of San Rafael. "They're standing up for us." During the arraignments, police, sheriff's and emergency medical personnel stood by as defendants were wheeled in or entered the courtroom under their own power. Jennifer Keelan, a 6-year-old girl from Tempe, Ariz., whose bouncy enthusiasm and apparent unconcern over her handicap captivated the press and boosted the resolve of protesters, was wheeled in by a sheriff's deputy and sat writing her name over and over again in a small notebook. Unlike the group's earlier demonstrations, Wednesday's action was peaceful and there were no arrests. Protesters had staged noisy and sometimes violent demonstrations outside the APTA convention at Moscone Center Monday and on the steps of City Hall Sunday night. Handicapped-rights group organizers said Wednesday was their last day in The City as the APTA convention at Moscone Center ended a four-day conference and transit officials left town. But protesters declared the string of rallies and blockades a success. "We made our point," said Marilyn Golden of Oakland. "Now maybe they will listen."

And one member of American Disabled for Accessible Public Transit (ADAPT) that protested at John Ascuaga's Nugget Sunday said her knee was broken when a Nugget security officer accidentally hit her leg with a door. Approximately 75 ADAPT members paraded down B Street and converged on the Nugget to protest the American Public Transit Association (APTA) meeting that is continuing through Sunday. The transit association opposes installation of wheelchair lifts on new public buses and the disabled group sought a meeting with its leaders inside the casino to discuss the issue. Nugget employees stood inside the casino doors, refusing to allow access to the ADAPT members. In response, the ADAPT members, most of them in wheelchairs, blocked the entrances to the hotel casino. Meeting organizers said they would meet at 1 p.m. today at Western Village Casino to consider what form of protest, if any, the group should stage today. "We‘ll definitely be taking an action, but we'll be discussing what we're going to do," organizer Stephanie Thomas said. Forty-nine people were arrested Sunday and seven were sent to jail. ADAPT leaders said this morning at the Washoe County jail that the seven being held were staging a hunger strike. Five of the seven pleaded not guilty to misdemeanor charges during their arraignment Sunday night in Sparks Municipal Court for refusing to give information that would allow them to be released on their own recognizance. They have trials set for next Monday. One was cited for contempt of court by Gladstone and sentenced to two days in jail and another was sent to jail until he pays his fine. ADAPT member Beverly Furnice, a cerebral palsy victim, said this morning she is finished protesting after her knee was broken Sunday. Furnice was in her wheelchair near the southeast door on the 11th Street side of the building when a security officer hit her leg, she said. She knew immediately it was broken, Furnice said. “It hurt. I hollered, ‘It hurt my leg. It hurt my leg,'" Furnice said. She went to Sparks Family Hospital where they bandaged her leg, she said. "l'm sorry to hear that," Nugget spokesman Parley Johnson said. “We made every possible effort to ensure the safety of all involved," Johnson said. “However, if we have someone trying to get in, ...and we're trying to get the doors closed, what can I say? The person (trying to get in) is contributing to the problem. "We could not allow the group to come in and disrupt our business and cause problems with our customers," the Nugget spokesman said. “And we have every right to do this." ADAPT protesters are staying at Western Village and took their protest down B Street to the Nugget about 3 p.m. Sparks police made some preliminary arrests and by 5 p.m. all of the ADAPT protesters had moved away from the casino doors. But then at 5:07 p.m.,a phalanx of about a dozen in wheelchairs charged down Nugget Avenue between interstate 80 and the Nugget parking lot and the doors were again barricaded. Just about every Nugget entrance seemed to be blocked at one point or another. ADAPT protester Harlan Hahn of Santa Monica,Calif., was talking to a reporter when Pam Fyock of San Luis Obispo, Calif., who is also confined to a wheelchair, scolded him and other protestors as she left the Nugget. “Just arrest them and haul their ass off," Fyock said of protesters. “They're inconveniencing all of us." After Fyock's comments, however, a transportation association member from Denver said he supported the protestors in their efforts to require more handicapped access to public transportation. “Based on my experience. we don't have problems providing access to the handicapped," said Kevin Sampson of the Denver Regional Transportation Department. “In Chicago, they have hardly any (handicapped access). In Denver, we have almost 600. What the hell is wrong with Chicago?" Sampson said. Hahn, a political science professor at the University of Southern California, compared the handicapped protests to the civil rights protests by the blacks in the 1950s and 1960s against being forced to sit in the back of the bus. "Sparks is the site of a civil rights struggle that began with the Montgomery Boycott," Hahn said. ADAPT protest organizer Stephanie Adams said the Sparks protest has been a little rougher than protests in other cities, citing Furnice's broken knee as one example. "They don't usually handcuff us" when they are arrested, Adams said. Protesters were also pushed and kicked as they tried to enter doors, she said. “Having people serve time for a first offense is not typical," she added. This was the seventh straight year the disabled group had staged a protest at a meeting of the transit group. Protest by disabled ends Demands not met, group plans new try today By Ben Smith Ill Staff writer Handicapped protesters who blockaded an Atlanta college administration building and a health-care facility in Decatur ended their siege of both buildings Tuesday without having their demands met. But group leaders of American Disabled for Attendant Programs Today (ADAPT) called their protests successful and planned to carry their demonstrations for increased funding for home care for the disabled to the Richard B. Russell Federal Building today. The protesters are demanding that the federal government redirect 25 percent of funding for the disabled from nursing homes to home care. They argue that 250,000 disabled people are being held in nursing homes against their will, and that this shift in funding is more humane and cost-efficient. “The ghetto in Soweto is no different than a nursing home,” said Michael Auberger, an ADAPT co-founder. “You're locked in there. You don't have the freedom to leave. You don't have a choice of what you eat, what time you go to bed or what time you get up.” The activists ended their occupation of a Morehouse College administration building Tuesday, leaving with what they said was a statement from the college saying it sympathized with the group's concerns. The disabled activists, who occupied the building for a day and a half, had demanded that Morehouse President Leroy Keith arrange a meeting between the demonstrators and Secretary of Health and Human Services Louis Sullivan. Dr. Keith refused. The group on Tuesday tried to enlist the support of the Georgia Health Care Association (GHCA). Nearly 100 protesters blocked the entrances and driveway of the GHCA office, demanding that officials agree to support their cause. While GHCA executive vice president Fred Watson agreed to send a copy of the group’s demands to the American Health Association, with which the Georgia organization is affiliated, he refused to sign an ADAPT letter supporting the redirection of federal funds. “Allocating 25 percent from nursing homes to their cause would only hurt the people who are in nursing homes now,” Mr. Watson said. The protest lasted nearly five hours, but the group's blockade was broken by police. The protesters contend that Georgia is one of the worst states in caring for disabled people and offers no state-funded home care or matching supplements for federal disability benefits.

Morehouse president’s office blocked By Ben Smith III, Staff writer Saying Dr. Martin Luther King Jr. would smile on their protest, nearly 200 disabled activists on Monday seized the administration building on the campus where he was educated. The demonstrators, members of Americans Disabled for Attendant Programs Today (ADAPT), a national advocacy group for the disabled, took over Gloster Hall at Morehouse College in southwest Atlanta and barricaded the school president’s office. “This is a college that has always valued human rights,” said Michael Auberger, a co-founder of the group. “This is another minority that is trying to gain its human rights.” The protest was intended to force Morehouse President Leroy Keith to arrange a meeting with Louis Sullivan, secretary of Health and Human Services and an alumnus and former dean of the Morehouse School of Medicine. Group members were angry at Dr. Sullivan for not responding to their invitation to meet with them although he spoke at an AIDS symposium in Atlanta last week. “Morehouse Medical College invited him to speak. He came. This group invited him to speak on an issue as serious as AIDS. He chose to ignore the issue," said Mr. Auberger. More than a dozen wheelchair-bound activists rolled into Dr. Keith's office before noon Monday and barricaded the door. Scores of additional protesters followed, chanting, “We want Sullivan" and "We shall overcome,” and blocked the front door and hallways. Late in the afternoon, Dr. Keith exited through a rear door, and many other employees left the building. College officials said they were puzzled that the demonstrators took their protest to the Morehouse College administration building instead of the Morehouse School of Medicine, which is a separate institution. Richard Ammons, a school spokesman, said Dr. Keith had contacted Dr. Sullivan, who said he would not meet with the protesters. But the regional director of Department of Health and Human Services agreed to meet with demonstrators in his office today, Mr. Ammons added. “We as an institution are powerless to do anything other than [contact Dr. Sullivan],” Mr. Ammons told the protesters. “And we are asking you to leave at this time." Lee Jackson, a demonstrator, replied, “We’re going to wait right here for Sullivan.” At least 50 demonstrators said they planned to remain in the building until Dr. Sullivan meets with them or they are arrested. School officials said the college was reluctant to have the protesters arrested. The protesters said they chose to come to Georgia, in part, because the state is one of the worst at caring for the disabled. Mark Johnson of Alpharetta a spokesman for the Georgia branch of ADAPT, said the state offers no state-funded care for disabled people outside of nursing homes and no matching supplements for federal disability benefits. Most states offer such assistance, Mr. Johnson added. Protesters also complained that residential care facilities can be opened in Georgia with nothing more than a a business license. Some students who were locked out of Gloster Hall complained about the protesters, but others called their objections “hypocritical” because of the school's civil rights tradition. "Anytime you're dealing with basic human rights, protests may inconvenience some people," said Otis Moss, 20, a Morehouse philosophy and religion major. “But you have to understand that ultimately it's going to benefit all." LXXXVII- No.6 35 cents, 40 cents outside Chicago and suburbs Title: Disabled group blockades street by Dobie Holland Likening the plight of the disabled to that of the Civil Rights movement, Americans Disabled for Attendant Programs Today (ADAPT) staged a blockade of downtown streets Monday in an effort to gain an audience with Health and Human Services Director Dr. Louis W. Sullivan. Sullivan, however, refused to meet with the group and 10 ADAPT members were arrested on criminal trespassing charges according to HHS and police officials. “Our ghettos are the nursing homes and facilities for the mentally retarded. Society doesn't want to recognize us. They want to put us in these ghettos," said ADAPT coordinator Bob Kafka of Austin, Texas. Hundreds of ADAPT members rolled their wheelchairs and formed a human chain in the middle of Clark and Adams streets and swamed HHS’ regional offices to demand a meeting with Sullivan. The group wants 25 percent of Medicaid funds channeled to community-based nursing centers, which would permit many disabled citizens to live at home, ADAPT representatives said. "The American Disabilities Act is very similar to the Civil Rights Act of 1964," Kafka said. “Very few people want to talk about the discrimination against the disabled. "They don't want to consider us as people and they just want to put us all in nursing homes,” Kafka continued. “Most people think a nursing home is a nice place for little old ladies...well, it's not.” Kafka, who is wheelchair-bound, said he has never been in an institution but recent political policies of the Bush Administration are making it possible. Title: ADAPT blocks street The American Health Care Association, a formidable nursing lobby, and the American Medical Association are also responsible, Kafka noted. Kafka said nursing homes have become big businesses and doctors have become owners of nursing homes, which motivated both `groups` to, support the institutionalization of the disabled. The group has been attempting to meet with Sullivan for more than two years, Kafka said. with all of their requests being rejected. A spokesperson for HHS told the group that Sullivan was contacted but said his schedule would not permit him to meet with them. On Sunday, a small band of disabled activists disrupted Sullivan's commencement address at the Univelsity of Illinois at Chicago, although the secretary did not acknowledge the ADAPT members. Guests to the gaduation day ceremonis filed past police barricades, while the activists, many in wheelchairs, circled outside the doors of the UIC Pavillion, chanting “We want Sullivan.” The demonstrators made same demands. urging the Bush Administration to redirect 25 percent of Medicaid funds currently budgeted for nursing homes and other institutions to set up community-based programs to allow the disabled to live on their own. An estimated 1.6 million disabled people now live in nursing homes. which Kafka said is a more expensive and less humane option than helping the disabled live independently.

He has barricaded hotel entrances in San Francisco, and he has thrown himself in front of federal buildings, government officials, even oncoming traffic, all to draw attention to the rights of the disabled. This weekend, Auberger and hundreds of other activists from across the country plan to converge on Washington for a three-day blitz of demonstrations and marches in what promises to be the largest protest in history for people with disabilities. “We've written the letters, made the phone calls, had the meetings, and the bottom line is we're still being treated like second-class citizens." said Auberger, co-founder of ADAPT, an activist group that is spearheading the activities. “lf those channels don't work, you take to the streets." Organizers say the immediate purpose of the demonstrations is to demand that the federal government commit more money to helping disabled people live at home, instead of in institutions. At the same time, they want to continue the larger campaign for equal rights that produced the Americans With Disabilities Act, landmark legislation that went into effect last year. A march to the White House and a memorial service for Wade Blank, who was a leader in the movement, are expected to draw the largest crowds, both on Sunday. What may draw the most attention, however, are demonstrations on Monday and Tuesday, when protesters are expected to disrupt Washington with human blockades of buildings and streets. The exact places and times for those actions aren't being disclosed, but the targets could include public buildings, such as the Capitol and the White House, and some federal agencies. “We like to preserve the element of surprise," Auberger said. ADAPT — an acronym for American Disabled for Attendant Programs Today — has been staging protests every six months for more than a decade to fight what it says is the inhumane treatment of the disabled at nursing homes and other institutions. The group said it hopes to redirect 25 percent of the $23 billion in Medicaid funds currently budgeted for nursing homes into programs that would enable those with disabilities to have attendants in their homes. Currently, each state sets policy for how much Medicaid money will go toward attendant care programs, but there is no national policy. [Subheading] Disabled Activists Plan 3-Day Protest The strike on Washington is timed to pressure the Clinton administration into focusing on people with disabilities as part of its package of health care revisions, due out soon, activists said. "Clinton has talked about change and says he wants people to be able to live at home, but what we're looking for is more than just words," said Bob Kafka, an ADAPT organizer in Texas who plans to bring a caravan of about 50 people to Washington. In the past, ADAPT activists have drawn attention to their cause by employing sometimes sensational tactics. They have done belly crawls across hotel lobbies in San Francisco, clawing at passersby. They have taken sledgehammers to street curbs in Denver to protest sidewalks that were inaccessible to wheelchair users. And they have swarmed and blockaded buildings in virtually every major U.S. city; a demonstration in Chicago last spring forced the evacuation of more than 1,000 American Medical Association workers and created disruptions in a half-dozen other downtown facilities. Though such events have attracted media attention, some individuals and `groups` sympathetic to ADAPT’s cause question how effective they are in achieving the larger goal of attaining more money for in-home care. “We're sympathetic to their concerns, but we think the tactics they use bring attention to ADAPT and not the problem," said Claudia Askew, a spokeswoman for the American Health Care Association, which represents 11,000 nursing homes and is a frequent target of ADAPT protests. Disabled people also are somewhat splintered over whether ADAPT's approach helps or hurts their cause. “There are people with disabilities that think ADAPT is a little extreme," said Patrick McCurdy, vice president of Marylanders for Adequate Attendant Care, a group that generally relies on peaceful protests and negotiations to lobby for in-home care. McCurdy did defend ADAPT's technique as a necessary part of an overall approach to force change in a society that he said has long ignored the rights of disabled people. Few spoke up for those rights until recently, but the Americans With Disabilities Act provided new protections to disabled people and helped forge a civil rights movement among the 43 million people with physical or mental impairments. “A great byproduct of the [disabilities act] is the new sense of confidence and empowerment it has instilled within the disability community," said Justin Dart, chairman of the President's Committee on Employment of People with Disabilities, a small federal agency. “It's generated an enormous infusion of dignity and pride." Gregory Dougan, a District resident, said the renewed sense of hope is one reason he will take part in Sunday's march. Dougan, who was born with cerebral palsy and uses crutches, said he is fortunate to be able to live at home. But several of his friends live in institutions because they can't get the in-home care they need. And on Sunday, Dougan said, he will be thinking of them. "I'll be tired at the end of the day," he said, "but my crutches and me are going to that march."
