[Headline] ADAPT PUBLIC TRANSIT OR ELSE by Mike Ervin One of the largest civil rights marches in history by people with disabilities was held Sunday, October 7, 1985 in downtown Los Angeles to protest the American Public Transit Association (APTA)'s policy of local option transit for disabled. In response to an “invitation” by American Disabled for Accessible Public Transit (ADAPT) to join in picketing the annual APTA convention, national leaders of the Disability Rights Movement converged at MacArthur Park to roll the 1.7 miles to the convention site at the Bonaventure Hotel. Bill Bolte of the California Association of the Physically Handicapped (CAPH) took a head count of the line of people in wheelchairs rolling single file down the middle of Wilshire Boulevard and announced that there was 215 present. The L.A. Police Department had refused to issue a parade permit to the group and had said it would not allow the long planned parade to be held on the street, but when 200 plus wheelchair users took to the pavement (no curb cuts) all the police could do was route traffic around the procession. It was an impressive sight; more than twice the number of people ADAPT had turned out for previous demonstrations at the annual conventions of APTA. As the line of people stretched more than a block in front of the posh Bonaventure Hotel where APTA was staying, the L.A. Police waited; there wasn’t much they could do except establish their presence. The protesters marched into the hotel lobby taking up most of the available space. Chants of “We will ride!" Filled the atrium below as bewildered hotel guests wondered what all this could possibly be about. The Hotel Security immediately blocked the one wheelchair accessible elevator to the main lobby. This escalated (so to speak) the confrontation, as demonstrators got out of their wheelchairs to block the escalators, saying “if you block our access, then we will block the escalators. No one will be able to use them." Meanwhile the police discussed the strategy of arresting certain people first whom they had identified as leaders. The police told the media that the charge was “refusing to leave the scene of a riot.” The woman arrestee was released Sunday night, five of the men were released the following afternoon, and the last two men were released Tuesday morning after 53 disabled individuals held an all night vigil outside the county jail. On Tuesday morning, the American Civil Liberties Union (ACLU), represented by Lou Nau, the chairman of the Disability Rights Committee of the ACLU, outlined the treatment that the arrestees faced. Four of the men were handcuffed behind their backs and left to sit in the police vehicles for up to five hours. Mike Auburger, a quadriplegic, was not allowed to use the bathroom for eight hours, causing hyperreflexia. Individuals on sustaining medication repeatedly asked for their medication, but never received it. Nau said to permit no bail for misdemeanor offenses is clearly against the law. Although APTA tried to discredit the protestors as a “small militant group of outsiders," they represented a wide spectrum of the Disability Rights Movement including Robert Funk, Executive Director of the Disability Rights and Education Defense Fund; Michael Winter, Director of the Center for Independent Living, Berkeley, CA; Judy Heumann, of the World Institute on Disability; Joe Zenzola, President, California Association of the Physically Handicapped; Peg Nosek, of Independent Living Research Utilization Project, Houston, TX; Catherine Johns, President of The Association on Handicapped Student Service Programs in Post-Secondary Education; John Chapples, Department of Rehabilitation, Boston, MA; Mark Johnson, Department of Rehabilitation, Denver, CO; Marco Bristo, Director, Access Living, Chicago, IL; Harlan Hahn, Professor, University of Southern California; and Don Galloway, D.C. Center for Independent Living. The following days saw many more protests in the Los Angeles area. On Wednesday, about 50 individuals arrived at the office of Larry Jackson, Director of the Long Beach Transit Authority, who is the incoming President of APTA. After being denied a meeting with him, they went out into the streets. The police gave them l0 minutes to disburse or be arrested. When no one moved, the police proceeded to arrest the protestors and take them to jail in 6 dial-a-ride vans. These individuals were booked and then released, as it was not possible for the Long Beach Police Department to accommodate so many disabled people. The passers-by had many different reactions to what they were experiencing; some were mad at being detained, some joined in. One man gave protestors a banner which read “help” and proceeded to distribute little American.... [rest of the article is not available.] Three photos. [Headline] Disabled Stage Protest Parade; 8 Arrested Oppose Transit Group Policy Against Mandating Bus Chair Lifts By GEORGE STEIN Times Staff Writer The halt and the blind converged on a public transit conference in downtown Los Angeles Sunday, parading through streets without a city permit and blocking entrances and stairways at the conference hotel in an effort to make the point that the disabled are denied the access to transportation available to the general public. Eight activists for the disabled were arrested on charges of failing to disperse an unlawful gathering and intefering with a police officer. The arrests —“a distasteful necessity," police said -- took place in and around the Bonaventure. They came after Los Angeles police had relented to an earlier stand to make arrests if any tried to parade along Wilshire Boulevard from MacArthur Park to the conference. “Listen, how could we arrest all these people?" Capt. Bill Wedgeworth said. During the procession, 131 wheelchairs, stretching more than a block, carried people with disabilities ranging from spina bifidia, cerebral palsy and muscular dystrophy to snapped spinal cords, congenital defects and postpolio paralysis. Many had the withered limbs and lack of body control that the more fortunate usually try not to stare at. But not Sunday. Motorists slowed to watch the sight. Some honked in support. “This is beautiful. I am proud to be a disabled person. I am tired of being closed away," said Bob Kafka, as he wheeled along. Kafka, from Austin, Tex., a spokesman for the American Disabled for Accessible Public Transit, has a broken spinal cord. He was among those arrested later. Once inside the hotel, the group headed for the reception area in an attempt to reach delegates to the annual conference of the American Public Transit Assn. However, police kept the demonstrators bottled up near the entrance, one floor above the main reception area. "Access now! Access now!" the demonstrators shouted. The crowd, which came from a spectrum of disabled activist groups in and out of California, targeted the transit convention because the organization opposes a national policy mandating wheelchair lifts on buses. The American Public Transit Assn.'s position is to let each transit agency deal with access for the disabled as a local decision. In Los Angeles, the Southern California Rapid Transit District, with 2,445 buses, has wheelchair lifts on 1,691 and is retrofitting another 200. The RTD hopes to have lifts on all buses in five years, which, according to a spokesman, would probably make it the first major urban bus system to be so equipped. After the demonstrators blocked hotel escalator wells for almost an hour, Wedgeworth told them their gathering was illegal. The actual arrests were an odd orchestration of defiance and cooperation. Escalator Well George Florom, a member of the disabled group from Colorado Springs, Colo., began thrashing as police tried to remove him from an escalator well. It took three officers to subdue him. “He began kicking and trying to bite me, so he had to go," Lt Ken Colby explained. One of the demonstrators grabbed an officer's gun, police said. Florom, lay quietly once handcuffed, and police gently placed him in his wheelchair and wheeled him to a lift-equipped van that had been arranged for the occasion. Trained medical personnel also were on hand. Edith Harris of Hartford, Conn., had earlier failed in an attempt to get arrested, tearing up American Disabled for Accessible Public Transit literature and throwing it on Figueroa Street. "Arrest me,“ she screamed to ‘no avail from her motorized wheelchair. The police only moved her to the sidewalk, and an officer went back to [unreadable] trash. Her wish was granted later, after she tried to herself down one of the blocked escalators. Then she calmed down, gratefully accepting a drink of water from a police officer, while waiting for a stretcher to arrive. Unhandcuffed, sitting upright, she was placed in the van. Her wheelchair was carefully handed in after her. Taken to Station The arrestees were taken to the Central Division station for processing. The seven men were later booked at County Jail, where bail was set at $500. Harris was booked at Sybil Brand Institute. Some police worried that the department's image would suffer from Sunday's action. “We look bad, no matter what we do," Sgt. Bill Tiffany said. After the arrests, a spokesman said, “It must be stressed that the Los Angeles Police Department has repeatedly tried to meet with demonstration leaders in the attempt to provide legal alternatives to accomplish their objectives and avoid the distasteful necessity of arresting handicapped citizens.” The police were not alone in their concern. Five months before the convention, according to Mark Johnson, 34, of Westminster, Colo., an organizer for the disabled group, RTD board member Jack Day flew to Denver to try to talk the organization out of civil disobedience. Negotiations foundered on an demand by the disabled group that the RTD introduce and support a proposal that the American Public Transit Assn. reverse its stand and back mandatory wheelchair lifts on buses, Johnson said. He said the disabled activists will be in town through Wednesday. The American Public Transit Assn. is a lobbying and policy organization. The five-day convention began Sunday.

Cincy orders protesters out A May bus protest in Cincinnati has been described “as the most effective, courageous and fun action ever accomplished in the movement for disabled rights," according to literature mailed out by the American Disabled for Accessible Public Transit (ADAPT). Some 85 members of ADAPT were in Cincinnati in mid-May to picket a regional convention of its arch-enemy, the American Public Transit Association (APTA) and to dramatize what a lack of accessible buses means to the disabled population of that Ohio city. The action began with the customary march on the convention hotel on Sunday, May 18. No arrests were made but marchers were greeted at the Westin Hotel by police and double barricades. None of the protestors was allowed into the hotel. Pointing out that other people were passed through the barricades, Bob Kafka of Austin, Texas, said the wheelchair protestors were being discriminated against. However, Cincinnati police captain Dale Menkhaus said that such actions, were proper when taken to protect private property from any group seeking to disrupt other lawful gatherings. The following day Kafka and fellow Texan George Cooper of Dallas dragged themselves onto a City Metro bus, paid their fares, and were arrested. They were reportedly told that “it’s not safe for disabled people to be on the regular bus.” The two were later released on $3,000 bond and ordered out of town, an action that ADAPT leaders described as blatantly unconstitutional. A third protestor, Mike Auberger of Denver, who is a former resident of Cincinnati, was arrested when he attempted to block the bus on which Cooper and Kafka were riding. Auberger said he originally left Cincinnati because of that city's “nineteenth century” attitude toward persons with disabilities. None of the Queen City Metro buses are accessible to the disabled, although 87 of the buses do have lifts which have been bolted down. Metro officials estimate it would cost them $350,000 to return those lifts to operational status. A local Cincinnati disabled activist said that's why she agrees with ADAPT’s goals, even if she can't go along with their methods. Dixie Harmon, co-chairperson of the Specialized Transportation Advisory Committee to Queen City Metro and a member of the Greater Cincinnati Coalition of Persons with Disabilities, said that the city’s service for disabled riders was inadequate. A disabled person must request space 24 hours in advance from Access, the paratransit system, but even then there's not always a space. “They dictate our lives to us because we have to go and come as there's space available.” ADAPT members said that's why they were willing to go to jail to publicize their cause. Police, however, made no arrests when 15 wheelchair protestors rolled onto a highway where vehicles were traveling at 40 miles per hour and blocked seven buses that were carrying APTA delegates and their spouses to a dinner at the Pro Football Hall of Fame in nearby Canton. Police were caught by surprise, as they had barricades to turn back protestors at the entrance to the Hall of Fame. Two local disabled leaders who were accompanying the APTA delegation to the dinner were taunted as “Uncle Toms” in front of TV cameras. Early the next day ADAPT members were back in front of the Weston Hotel where they erected a huge cross and hung a wheelchair from it in a mock crucifixion. On the final day of the convention, 17 protestors were arrested when they blocked the hotel driveway and refused police orders to move. Many of those arrested were ordered to jail unless they agreed to leave town. Three protestors, Auberger, Cooper and Kafka, decided the time had come for disabled protestors to do “hard time” and ended up serving 10 days. Five other protestors were turned out of jail because they had special medical problems or speech impairments. Others were released after pleading “no contest” to the charges in hastily organized trials. “Even the story we had left town and the protest was over made TV news," an ADAPT spokesperson said.

Austin American-Statesman Sunday, October 25, 1987 Lifestyle section Title: Streetcars and Desire Activist couple dedicate lives to tearing down walls between city buses and the disabled By Carlos Vidal Greth, American-Statesman Staff (This is a compilation of the article that is on ADAPT 354 and ADAPT 353. The content is all included here for easier reading.) Most visitors to the Bay Area relish the opportunity to hop a cable car and "climb halfway to the stars," as Tony Bennett croons in his signature song, I Left My Heart in San Francisco. Stephanie Thomas, organizer for Americans Disabled for Accessible Public Transportation, had other ideas. "To mobility-impaired people, keeping those historic symbols of public transit alive memorializes inaccessibility and makes it seem like a positive thing," she said. ADAPT, a national civil-rights group, strives to make it easier for disabled people to ride city buses. They differ from mainstream disability-rights groups in that members sometimes commit acts of civil disobedience when the usual political channels clog or hit a dead end. Thomas, her husband Bob Kafka, and eight other Austinites went to San Francisco in late September to conduct a protest during the national convention of the American Public Transit Association, a lobbying organization. Kafka and 15 others were arrested when they climbed out of their wheelchairs and staged a sit-in at the cable car turnaround at Powell and Market streets. Thomas was arrested twice, once for blocking a shuttle bus and once for blocking a cable car. "I've been arrested eight times or so," she said. "I've lost count. Bob has been arrested 14 times. The police are usually aware it's a demonstration about civil rights, and that we're not out to hurt their city. But it's scary. We're not automatons. Some members break down and cry when they go to prison." As far as Thomas is concerned, the suffering has been worth it. "The demonstrations got national exposure. More important, we got the transit association's attention. They are beginning to listen." Thomas, who is also executive director of the Coalition of Texans With Disabilities, could sit for a poster portrait of the committed political activist. Her shock of amber hair shifts of its own accord like the wind ruffling a field of grain. Wide, blue eyes fix visitors with the riveting gaze of a woman who believes she fights for what is right. She was born 30 years ago in New York to parents who fought for justice in their way. Her father organized political campaigns and worked for arms control. Her mother, a writer, was involved in the women's movement. "Mom taught me to question people's perceptions," Thomas said. "The women's and disabled movements have something in common: We're defined by our bodies. You have to fight that all the time." Her first protest occurred when she was in elementary school. Mothers in the apartment building where her family lived wanted to establish a day-care center. The owners didn't want to provide the space. "Women and children took over the building," Thomas said. "We weren't angry college protestors. We were non-threatening moms and kids. But our presence made a difference." Despite her progressive upbringing, she was a shy girl who hid from the world behind the covers of books. When she was 17, her legs were paralyzed when she fell off a farm tractor while doing chores. What could have been a tragedy turned her life around. "I realized that life doesn't go on forever, and that you need to make the most of every moment," Thomas said. Thomas attended Harvard, where she and other disabled students organized a group to help make campus more accessible. "When I look back, I see we were very tame,” she said. “We were polite but usually got what we asked for.” Over the years, Thomas became increasingly active in disability rights. She got involved in independent living centers, communities of disabled people supporting one another so they can live with dignity outside institutions. In the early 1980s, she joined the Austin Resources Center for Independent Living. She went to work for the Coalition of Texans With Disabilities in 1985. The 9-year-old coalition lobbies for, represents and coordinates 90 organizations (including ADAPT) concerned with disabilities, as well as the more than 2 million disabled Texans. “It is the collective voice for the disabled in Texas,” said Kaye Beneke, spokeswoman for the Texas Rehabilitation Commission. "They’re committed - the members live every day with the problems they try to solve. “Stephanie understands there’s a spectrum of political views in the coalition, which tend to be more middle-of-the-road than ADAPT. She takes responsibility for the representing of all those views. But don’t call the coalition passive. They’ve had their way in the legislature and on the local level.” As a leader in two of Texas major disability-rights organizations, Thomas has her hands full. It helps having Bob Kafka, who broke his back in a car accident in 1973, at her side. The experienced trouble maker -- albeit trouble for a good cause -- has made a name for himself. He won the Governor’s Citation for Meritorious Service in 1986. Appropriately, Kafka met Thomas at a disability-rights conference. “Stephanie was real involved, real committed and real attractive,” he said. Sharing home and office has increased their commitment to the cause they serve- and to each other. “Bob and I are an activist couple,” Thomas said. “It’s intense because we work so closely. But it’s rewarding. It has made us an incredibly tight couple.” Thomas has to rework her concept of activism when she joined ADAPT. “Demonstrations force the public to look at disabled people in a different light,” she said. “The cripple is the epitome of powerlessness. We say we’re sorry if it scares you to look at me, but we have to live our lives.” Confrontation, however can cost allies as well as foes. This year, the Paralyzed Veterans of America severed ties with ADAPT and any organization "advocating illegal civil disobedience.” “Our charter states that we must act in accordance with the laws of the land,” said Phil Rabin, director of education. “To act otherwise would be to violate our charter. “The veterans and ADAPT members share first-hand the frustration of living in a society that is not accessible to the disabled. We don’t want to fight ADAPT. It’s a waste of precious resources to divert our energies.” Though Thomas’ group is controversial, it has achieved many of its goals. Albert Engleken, deputy executive director for the American Public Transit Association in Washington, D.C., acknowledged that ADAPT’s street theater has had some effect. In September his organization created a task force to study the issue of providing service for disabled, he said. Engelken, however is not a convert to their cause. “ADAPT wants a lift on every transit bus in the country,” Engelken said. “We believe it should be left to local transit authorities to decide how to handle transportation for disabled people. Transit officials are not robber barons. We’re paid by the public to provide the most mobility for the most people.” Thomas knows how to work within the system. Ben Gomez, director of development for Capital Metro, said ADAPT members have been effective on the Mobility Impaired Service Advisory Committee, which makes recommendations on service to the transit authority board of directors. “They’re well-organized,” Gomez said. “We don’t always agree on the approach and issues. We’ve made many of the adjustments they’ve asked for, but not always within their time frame.” The concessions have been gratifying, but Thomas has only begun to fight. “ADAPT took a dead issue änd made it hot again,” she said. San Francisco Hundreds of disabled activists, demanding accessible transit, dramatically confronted “the world’s largest transit exposition” here September 27-30 as they blockaded streets, chained themselves to cable cars, and generally besieged the 15,000 mass transit officials and manufacturers’ representatives at the American Public Transit Association (APTA) Expo ’87. Over 100 protesters were arrested as they pressed APTA to approve a resolution by the September Alliance for Affordable Transit (SAAT) calling for the right of the disabled and elderly to access public transit. SAAT organizer Marilyn Golden called the APTA protests “the largest in disability rights history.” The disabled community has fought against APTA since 1979 when APTA brought a lawsuit that succeeded in overturning a federal regulation requiring that all transit vehicles be accessible to the disabled. Since 1983 the American Disabled for Accessible Public Transit (ADAPT) has organized demonstrations at APTA conventions in Cincinnati, Detroit, Phoenix, New York, and Washington, D. C. to urge a policy change. Until this year when they scheduled two workshops on the issue, APTA has been unwilling to even meet with protestors. Mark Johnson, a demonstrator from Georgia, drew the parallel between these protests and the civil rights movement saying, “There was something wrong when Black people weren’t allowed to sit in the front of the bus, and there’s something wrong when we can’t even go on the bus.” APTA claims that accessibility would cost $15 billion and would bankrupt the nation’s transit districts; they propose instead a system of “paratransit” which would theoretically provide disabled people with flexible door-to-door service but in fact translates into long waiting lists and call-ahead requirements, weekday-only buses and restricted ride purposes. SAAT counters that APTA’s $15 billion figure includes completely rebuilding subways in New York, Chicago and other cities, while the disabled community’s actual demand does not include rebuilding rail systems or even retrofitting existing vehicles, but only that new buses include wheelchair lifts. Also, while arguing that paratransit may be a useful supplement to public transit, Susan Schapiro of SAAT criticized existing paratransit systems as designed with a view of the disabled as “pathetic people in nursing homes going to see the doctor twice a month . . . . It all boils down to discrimination and the belief that these aren’t really people. The APTA delegates could not miss the powerful statement made by the tenacious lines of wheelchair bound demonstrators who spanned several generations in age, were multi-racial in composition, and came from every corner of the U.S. – including eight from Alaska. As demonstrators were being arrested they drove home the irony of being taken away in a lift-equipped paddy wagons chanting, “They can take us to jail but not to work.”

Title: 25 arrested in downtown demonstration by Ron Charles Montreal Daily News MUC police arrested 25 wheelchair-bound demonstrators last night after they forced their way into the lobby of the Sheraton Centre in downtown Montreal. The demonstrators were protesting the American Public Transit Association's (APTA) reluctance to endorse wheelchair lifts on new buses. They crashed their wheelchairs through a luggage-cart barrier hotel employees had built in an attempt to ward off the protesters. [Subheading] Came along When APTA, a Washington-based transit authority organization, brought its annual conference to Montreal this week, the protesters came along as part of the ticket. The demonstrators, from a group called American Disabled for Accessible Public Transit (ADAPT), have been protesting at APTA conferences for eight years. Only a few members of a local disabled rights group took part in the demonstrations — the rest were from the U.S. Police said all those arrested — who are expected to be charged with assault — were American citizens, many of them Vietnam veterans. About 50 MUC police officers showed up to clear the Sheraton's marble-covered lobby after the protesters, singing "we want to ride," blocked elevators and escalators. Police wheeled the demonstrators one by one to a waiting wheel-chair bus being used as a paddy wagon. Police snipped chains linking protesters Mike Auberger and Bob Kafka's wheelchairs to a handrail in the lobby. Although the APTA conference is taking place at the Queen Elizabeth Hotel, some of the 3,000 attendees are staying at the Sheraton. Earlier in the day, police turned the Queen Elizabeth into a fortress with metal street barriers as about 75 demonstrators wheeled toward the APTA conference headquarters. They blocked traffic in both directions on Dorchester for more than two hours as police tried to pen the group in with the barriers. Police took two protesters who had crashed the barriers out of their chairs in order to lift them and their chairs over the barriers. [Subheading] Took chair "The police took his chair away, separated him from his legs," said Lori Taylor as she watched from the side-walk when police lifted her husband, Lester, over the barrier. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Bill Bolte, who started ADAPT's Los Angeles chapter, said police overreacted to the demonstration. "This really confuses me because I know that after the Canadians (hockey team) won the Stanley Cup, all types of terrible activity went on," said Bolte. "People overturned cars while everyone, including the police, just looked the other way and went and had a cup of coffee." Several demonstrators who broke through the police perimeter smashed their chairs into barriers in front of the hotel entrance, but hotel security and police stood their ground. Let our people go. You operators want to pretend it’s complicated. You raise a-lot of pseudo-issues to disguise the fact that it’s all about your money and your power. You want to pretend you’re trapped in this business, that union contracts prevent such and such... that legal liability prevents so on and so forth... We don’t want to hear any of that. It’s not complicated. It’s very simple. You will let our people go. >> We were arrested the first day, lots of us. They never expected us to come close to their hotel, the place where members of the American Health Care Association were staying while they held their convention across the street. Yes, they knew we were coming to Orlando. They briefed the locals, had the police waiting. So it was all set up in advance, cops on the rooftops, a police booking operation in the basement of the convention center. They were all set to cage us up for daring to interfere. They thought they had it covered. They were smugly going about their business, expecting only a minimum of trouble for a couple of hours. The intensity there — anyone driving by could feel it. The tons of security, the A.C.H.A. people retreating inside the hotel, aghast. It was like: “How dare they spoil our party!” The first wave of arrests was meant to stop us at all costs, keep us out of the convention. That first day, they thought they’d arrested all the “leaders.” But with ADAPT, when folks get arrested, other folks fill in and we just keep going. We will not be moved. It was our intent to send the message that nursing homes have one and a half million Americans locked up. We want the nursing home operators to be publicly accountable for that. Here we are, people who look like the folks the operators lock up at their home facilities. They’re on vacation, but they can’t escape. We are people with disabilities. We are everywhere. The operators were inside having seminars on how to manage the disruptive patient. We were outside holding a seminar with the press on the economics of managing people in nursing homes. Every place the A.C.H.A. people went they had to confront ADAPT people who had been in nursing homes. They can talk all they want about how homelike it is. We know better, firsthand. We are focusing the attention of the Bush administration through U.S. Health & Human Services Secretary Louis Sullivan and the whole Health Care Financing Administration. We are focusing public attention on the nursing home operators, the nurses, the families, everybody who had anything to do with our people being locked up. This will be a long struggle; we’re prepared for that. Five or ten years, a long struggle. Unless people like ADAPT are willing to stay focused and targeted, people in nursing homes and state schools are going to be forgotten all over again. We may not win at every action, but we will win the cumulative victory. We make people think about nursing homes. They don’t want to think about that. Put them away, put it out of mind, put it somewhere else. I want to say to people who say they don’t like ADAPT tactics: Do you really want our people out? Or are you sitting home saying, “Oh, those nursing homes shouldn’t do that!” How many people are going to get free because you hold that opinion? What are you doing about it? People are turned off by the arrests, by our confrontational style. “I’m not going to do ADAPT-style confrontations” — we hear that a lot. If you don't want to be on the front lines but you do want to help, there’s plenty to do: raising dollars so we can get to our actions, working with people in your community to make these issues known, forming your own group, bringing some attention to the issues in your own home town. We sure would welcome your help. ADAPT puts the edge on it, sets the margin. This is as far as we go, this is all we will take. We will not be moved. For Wade Blank and the 210 or so members of ADAPT, or American Disabled for Attendant Programs Today, the plan was simple. “We're going to block the entrance to the hotel because those people block our lives," he said of the American Health Care Association, which represents nursing home operators and has attracted 3,500 people to a convention this week at the Peabody Hotel. On the other side, hotel security and about 130 Orange County deputies and Florida Highway Patrol troopers were standing by to stop any protesters who blocked the doors with their bodies or their wheelchairs. “The main goal is to assist and help these people in a professional and sensitive manner," said sheriffs spokesman Cpl. Doug Sarubbi. “But when they break the law. we’ve got to enforce it." When the battle ended, one person had been hurt. one had suffered a heart attack and at least 73 had been arrested as ADAPT launched its four-day protest demanding fewer people be kept in nursing homes and more money be devoted to caring for the disabled at home. It was a battle authorities had mapped out extensively, making sure officials and facilities could accommodate the 'protesters' disabilities, said Sarubbi and Ed Royal, the Orange County Jail's assistant corrections director of programming. The costs of the special provisions had not been added up late Sunday, Sarubbi said. “This wasn't supposed to be the big day" of the protest, Sarubbi said. “We expect it every day and are prepared for whatever happens." More arrests were expected late Sunday, Sanibbi said. Each protester was charged with trespassing, taken to the Orange County Jail and held on $1,000 bail. A woman apparently was cut on the head when a table or bicycle lock fell on her while she tried to break through a barricade at the north entrance of the hotel. Pat Hasley, a top Peabody security specialist, suffered a heart attack outside the hotel and was taken to SandLake Hospital. His condition was unknown late Sunday. In demonstrations across the country, ADAPT has blocked meetings, disrupted speeches and shut down offices. “We chose to shut down the able-bodied system that suppresses us," ADAPT co-founder Blank said. "If they choose to arrest us, so be it." Denver-based ADAPT wants Medicaid to redirect 25 percent of its $23 billion nursing home budget to home care for the disabled. The group also wants 45 minutes on the convention agenda to make its position known. “We‘re not trying to change the world," said Toni Funderburk, who calls herself a nursing home survivor. “We're just trying to live in it." Linda Keegan, a vice president for the nursing home association, said the group could better spend its time at the bargaining table rather than barricading buildings. “I think it would make a bigger difference if they sit down with us and come to a compromise. "It's not our money to give," she said. “The real issue is an issue of choice. There needs to be choice on both sides. The only approach that makes sense is to sit down and form a compromise that makes sense for all." Sunday's showdown began at 12:35 p.m. as protesters filed out of the Clarion Plaza Hotel, across the street from the Peabody, with a phone number to a group lawyer scrawled on their arms, shouting "Hey! Hey! Ho! Ho! Nursing homes have got to go!" Others carried signs with such slogans as "End apartheid Destroy nursing homes" as others waved a modified U.S. flag with the stars forming the universal handicapped symbol. As the first protesters reached the Peabody parking lot, deputies confronted them. The protesters climbed out of their wheelchairs, crawled on the ground and tried to scoot past and through the legs of deputies in a race for the hotel doors. “Get to that damn door," barked Bob Kafka, a Texas ADAPT organizer. “Go! Go! Go!" Security scrambled to block the protesters, but ADAPT members managed to create a logjam at the entrance with their bodies or wheelchairs. “It's inconvenient," Peabody general manager Michael French said of the protest. “We respect their right to protest, but they must respect our right to operate a business." After the protesters refused security workers' request to leave, several school buses arrived, specially equipped for the disabled. Authorities brought in a moving van for non-disabled protesters. “We tried civil means and they just give us a cookie, pat us on the back and say, ‘Go away,'" Funderburk said. Deputies carried crawling protesters and ushered wheelchair users into the vehicles. The display drew looks of disbelief from some hotel guests and empathy from others. “It's awful," said Elma Oeters, visiting from Europe. Jacqueline Krygsman of Holland called the situation ridiculous, saying her country has a national health care policy. “They should have things at home." Police shuttled prisoners across the street to a makeshift booking office at the Orange County Convention and Civic Center before taking them to jail. Royal said open bay cells normally reserved for juveniles, psychotic inmates and those with other special needs were used for the protesters in wheelchairs. Guards were on duty in the bays. The open bays, which normally hold about 60 people, contained between six and 10 handicapped people, depending on their needs. Four nurses were added to the normal staff of five, he said. "The corrections staff underwent special training to understand the needs of handicapped individuals," Royal said. Other special provisions made by the jail included obtaining hand-held commodes and arrangements for the care of any guide dogs accompanying blind protesters. Those arrested will have to go through the normal process to be released. “Those who are able to bond will be allowed to bond," Royal said. “Those who are not able to bond will have to go to first appearance before a judge in the morning." Most protesters, after being informed of the $1,000 bond, said they could not afford to pay and would remain in jail, Blank said. "I guess Orlando wants to prove a point," he said. “We didn't travel 1,900 miles to haul it in after one day. It's not like it‘s anything new. Nursing homes or jail. LXXXVII- No.6 35 cents, 40 cents outside Chicago and suburbs Title: Disabled group blockades street by Dobie Holland Likening the plight of the disabled to that of the Civil Rights movement, Americans Disabled for Attendant Programs Today (ADAPT) staged a blockade of downtown streets Monday in an effort to gain an audience with Health and Human Services Director Dr. Louis W. Sullivan. Sullivan, however, refused to meet with the group and 10 ADAPT members were arrested on criminal trespassing charges according to HHS and police officials. “Our ghettos are the nursing homes and facilities for the mentally retarded. Society doesn't want to recognize us. They want to put us in these ghettos," said ADAPT coordinator Bob Kafka of Austin, Texas. Hundreds of ADAPT members rolled their wheelchairs and formed a human chain in the middle of Clark and Adams streets and swamed HHS’ regional offices to demand a meeting with Sullivan. The group wants 25 percent of Medicaid funds channeled to community-based nursing centers, which would permit many disabled citizens to live at home, ADAPT representatives said. "The American Disabilities Act is very similar to the Civil Rights Act of 1964," Kafka said. “Very few people want to talk about the discrimination against the disabled. "They don't want to consider us as people and they just want to put us all in nursing homes,” Kafka continued. “Most people think a nursing home is a nice place for little old ladies...well, it's not.” Kafka, who is wheelchair-bound, said he has never been in an institution but recent political policies of the Bush Administration are making it possible. Title: ADAPT blocks street The American Health Care Association, a formidable nursing lobby, and the American Medical Association are also responsible, Kafka noted. Kafka said nursing homes have become big businesses and doctors have become owners of nursing homes, which motivated both `groups` to, support the institutionalization of the disabled. The group has been attempting to meet with Sullivan for more than two years, Kafka said. with all of their requests being rejected. A spokesperson for HHS told the group that Sullivan was contacted but said his schedule would not permit him to meet with them. On Sunday, a small band of disabled activists disrupted Sullivan's commencement address at the Univelsity of Illinois at Chicago, although the secretary did not acknowledge the ADAPT members. Guests to the gaduation day ceremonis filed past police barricades, while the activists, many in wheelchairs, circled outside the doors of the UIC Pavillion, chanting “We want Sullivan.” The demonstrators made same demands. urging the Bush Administration to redirect 25 percent of Medicaid funds currently budgeted for nursing homes and other institutions to set up community-based programs to allow the disabled to live on their own. An estimated 1.6 million disabled people now live in nursing homes. which Kafka said is a more expensive and less humane option than helping the disabled live independently.

Clinton after this article.] On Monday, October 19, the Clinton/Gore campaign released a policy statement that forcefully supports attendant services for persons with disabilities instead of institutionalization The agreement worked out was the culmination of more than a month's negotiation between the Clinton/Gore campaign and the disability rights group ADAPT. In September, ADAPT contacted both the Bush/Quayle and the Clinton/Gore campaigns about the issue of attendant services. Both campaigns were asked to issue policy statements supporting independence for persons with disabilities through attendant services. A mid-October deadline for the statement was given because ADAPT was going to be In San Francisco for a national action at the site of the annual convention for the nursing home lobby, American Health Care Association (AHCA). While the Bush/Quayle campaign ignored the request, Clinton/Gore worked on a statement that was faxed to ADAPT as they were arriving in San Francisco on October 17. The Clinton/Gore statement went a long way to addressing the needs of attendant services, but was still missing the fact that a major crux of the problem had to with the bias in how federal regulations favor more expensive nursing home care instead of less expensive, more efficient attendant services Without the additional language, ADAPT went ahead with its planned non-violent protest march on Monday, October 19. Over 400 persons with disabilities marched in two `groups`, targeting the headquarters of Bush/Quayle and Clinton/Gore simultaneously. In response, the Bush/Quayle headquarters not only blocked off all wheelchair access to their headquarters, they also installed barricades blockading the entrances outside manned by platoons of police, Over at the Clinton/Gore headquarters no barricades were erected as more than 100 persons in wheelchairs from twenty states occupied every nook and cranny of the headquarters, leaving several dozen protesters lined up outside as police looked on without barricades After several hours of the occupation, an updated version of the earlier statement was faxed directly to ADAPT at the protest, from the Clinton/Gore national headquarters. The new revised statement was read to the assembled crowd of wheelchair warriors by Clinton’s director on national disability policy, Bobby Simpson. The final proposal is a far-ranging progressive document that: (1) persons with disabilities must be given the right to choose consumer-driven, community-based attendant services versus institutionalization, (2) employment as attendants by young women and men will be encouraged as an option under the National Service Trust Fund service to their community, (3) appointing a task force that will submit a reform package within the first 100 days of the Clinton Administration to overhaul federal regulations to remove their overwhelming institutionalization bias and instead propose regulations to make attendant services more available, and (4) the task force will include members with disabilities from prominent disability rights `groups` such as ADAPT. With this victory, the occupation was called a success by both the peaceful protesters in their wheelchairs and the workers of the Clinton/Gore campaign. That was in sharp contrast to the mood at the Bush/Quayle headquarters where the republican campaign refused to negotiate and instead issued a statement that the efforts by ADAPT were 'counter-productive' and 'a disservice to the disabled'. The next day, the mood changed again when California’s budget cuts in the state SSI/SSP of 16 1/2percent and attendant services of 12 percent were the subject of the action. The two sites targeted were the federal building and the state building in San Francisco. The police were caught off guard being stationed only at the state building. The federal protective service in charge of the federal building wasn't ready either. What followed was a declaration by ADAPT that the federal building was being turned into a nursing home for the day with all access in and out shut down. Police responded with mass arrests of 49 protesters in the plaza in front of the federal building as the protesters linked arms and wheelchairs together. The remainder of the group then continued on to the state building. Police had removed troops from the state building to go to the federal building. No arrests occurred at the state building as the group chanted and passed out fliers to passers-by. The 49 arrested were held for the day, ticketed, and released down at pier 38, which the police turned into a huge booking and holding facility. On the final planned day of protests, Wednesday, the AMCA convention hotel was the site of the dally protest. Police arrested 114 persons that day when the driveways and streets in front of the Marriott hotel were blocked by people using wheelchairs. It took hours to transport those arrested back down the pier. This prompted Mike Auberger of ADAPT to comment, "If I knew I would be spending so much time here I would have brought my fishing pole.” When released, the group marched in formation backto their own hotel for a night of celebration. It was a long week of work done getting the message out to the general public about the issue of attendant services as a basic civil rights issue. Among the celebrations held Wednesday night was a special wedding ceremony of two ADAPT protesters from Philadelphia and a musical concert put on by performers with disabilities that lasted into the wee hours. By all accounts, the week was a success. Even the police mentioned several times they were totally unprepared for the dedication and training of ADAPT members during the action to the point of admiration that the protesters never lost sight of why they were there - to expose the inhumanity of locking up persons with disabilities into nursing homes, when attendant services are less expensive, more humane, and let individuals retain their civil rights. the end TITLE: Statement of Governor Clinton on Personal Assistance Services I support efforts to make affordable personal assistance services available to Americans with disabilities. We must ensure that all people have the opportunity to live independent lives. People who have disabilities and have a need for personal assistance services should have maximum control over the care they receive. Personal assistance serves must be consumer driven- they must be met by the needs and desires of the user, not the dictates of the supplier. I believe that personal assistance services are of the utmost importance. I understand that every person has different needs. For this reason, I believe that every person has the right to personal assistance services. I believe that personal assistance services should be provided by a wide range of qualified individuals. In my proposal for a National Service Trust Fund, I have suggested that young men and women who go to college can pay for their education by spending two years working in jobs which serve our community - teaching our children, policing our streets, rebuilding our infrastructure. Employment in personal assistance services should be an option in this program, and I hope thousands of men and women choose it. This is only one of many ways in which we can expand the scope of available services. Personal assistance services should be a part of any comprehensive health care reform plan. For this reason, I intend to appoint a task force, including individuals with disabilities, on the role of personal assistance services and long term care in health care reform. Among other things, this task force should examine the role of federal regulations and funding which creates a presumption in favor of institutionalized care over home and community-based services. I have promised to submit a reform package to Congress in the first 100 days of my Administration. The task force will submit recommendations on reform in that time period. It is time for America to realize that silence on issues of concern to people with disabilities is as damaging as prejudice. As President, I will work with individuals with disabilities to empower people to live independently, I will bring people together and make this plan a reality.
