[Headline] Disabled may get aboard some buses VIA Cisneros By David Hawkings, Staff writer After wheelchair-bound protesters clogged downtown streets by placing themselves in front of city buses, Mayor Henry Cisneros vowed yesterday to press for improvements in local transit service for the disabled. The mayor made the pledge after meeting with protesters, who called off demonstrations scheduled last night. But a spokeswoman for the demonstrators refused to completely rule out further action. Before the mayor agreed to meet with the group, about 50 members of the American Disabled for Accessible Public Transit had slowed traffic by creeping across intersection crosswalks and placing themselves in front of VIA metropolitan Transit buses. There were no arrests, though two misdemeanor citations for obstructing traffic were issued. The action by ADAPT marked the third day of protests, which included a demonstration at the VIA headquarters Monday afternoon that prompted 90 buses authority employees to lock themselves in their office. It began Sunday with a demonstration at the Hyatt Hotel, where the American Public Transit Association is holding a regional conference. In a statement, ADAPT said the transit association’s policies are “perpetuating discriminatory transportation systems in cities throughout the U.S.” At yesterday’s session with ADAPT, the mayor agreed to lobby the Reagan administration to reinstate a federal rule -- struck down as a result of a suit brought by APTA -- mandating all public transit be accessible to the disabled. He also said he would urge those in Congress representing South Texas to support funding to help cities pay for making all buses available to those in wheelchairs. The mayor would not, however, endorse an ADAPT position paper “as it is now written” calling for all new municipal buses to be equipped with wheelchair lifts. The devices cost about $10,000. Instead, Cisneros said he would work to get “some buses fully equipped on some routes” and would lobby to get a handicapped person appointed to the VIA board. “Cisneros is obviously someone who’s sensitive to minorities, but the problem is he needs a good deal of education that we are a minority,” Jean Stewart, a spokeswoman for ADAPT, said in an interview after the meeting. Stewart, also one of the two protesters cited, was ticketed near the Hilton Hotel. The other protester cited by police yesterday was Robert A. Kafka of Austin, who allegedly was blocking traffic near the Marriott Hotel. By January 1986 ADAPT Texas felt sure enough of itself to directly challenge transit providers in Houston and Dallas to reverse their policy on accessibility. Ironically, at one time Houston boasted more accessible mainline buses than any other city in the country. After intense lobbying by the Coalition for Barrier Free Living, the Houston Metropolitan Transit Authority (MTA) purchased 326 Grumman Flxible 870 buses equipped with EEC lifts in 1977. That represents 50 percent of the city's total bus fleet. The decision to purchase those buses came only after members of the Coalition staged a sit-in at the office of then MTA executive director Barry Goodman, who had earlier refused to meet with representatives of the group to discuss accessibility. Goodman declined to make a commitment to accessibility at the subsequent meeting. Coalition members joined forces with the American Civil Liberties Union (ACLU) in a lawsuit that would have prevented MTA from purchasing any other buses until it had agreed to provide mainline service to wheelchair users. Coalition members took to the streets and blocked buses. MTA finally gave in to their demands but, according to coalition members, once the buses were on the streets MTA did nothing to publicize the routes. As a result few disabled passengers used the lifts. The death blow to accessibility in Houston came when cracks developed in the front frames of the new buses. MTA attributed the cracks to the EEC lifts, though the same cracks appeared in other buses in other parts of the country that had not installed lifts. MTA later admitted that the lifts did not cause the cracks, but when the Grumman buses were pulled out of service, Houston chose not to replace them with lift-equipped buses. The coalition's transportation committee had by this time disbanded, and accessibility ceased to be a front-page issue in Houston until some 20 Houston ADAPT members issued a Jan. 22, 1986, press release demanding that MTA proclaim its intention to purchase only lift-equipped buses. ADAPT gave MTA until July 4 to alter its position. ADAPT charged that MTA's Advisory Committee of the Disabled and Elderly was powerless and had done nothing to promote accessibility since it was formed. "The right to move freely in Houston usurps the recommendations of any committee," the ADAPT release said. A symbolic rally was held outside MTA's headquarters on Feb. l2 — Lincoln's birthday — to protest what ADAPT called a segregated transit system that makes slaves of the city's disabled population. Symbolism was also behind ADAPT's choice of Jan. l5, l986 Martin Luther King, ]r.'s, birthday — for its showdown with the Dallas Area Rapid Transit (DART). Several of those same "outside agitators” who had irked the San Antonio Light made the 800-mile trip from Denver to participate in the demonstration. Among them was Mike Auberger, a quadriplegic community organizer for the Atlantis Community, who just may have been arrested more times than any other wheelchair activist in the movement. Auberger was not alone. Seventeen demonstrators, including several first-timers, were arrested. Denver's Kathy Vincent was among that group. Altogether the demonstrators managed to block l7 buses for more than six hours before the police stepped in and forcibly removed them from the streets. Not all the fireworks took place on the streets, however. The night before, at a regular monthly meeting of DART's executive board, ADAPT made known its intention to bring traffic to a standstill in Dallas the next day. "They laughed at us," Blank said. "They didn't think a handful of us could stop the buses." But Blank said DART's new executive director, Ted Tedesco, until recently a University of Colorado vice chancellor, knew different. “He knows what we can do. His face went white when we entered the room." At first, DART refused to hear from ADAPT. However, several ADAPT members began chanting "We will ride!", making it impossible for the DART meeting to continue. After making their presentation, several protestors showered the board with play money to symbolize the wasted tax dollars DART has put into non-accessible systems. Not all the news from Texas is bleak, however. ADAPT Austin has succeeded in winning 100 percent of off-peak hour accessibility from Capital Metro as of July 1, 1986. More than 50 percent of that city's peak hour routes will be accessible once l00 lift-equipped buses arrive this summer. Jim Parker reports that El Paso ADAPT is pushing the city to activate the 30 lift-quipped buses the system owns but has never operated. That would mean 50 percent accessible service during off-peak hours, according to Parker, who was among the first Texans to receive training from the Denver parent group. Auberger and other Coloradans had helped Parker block buses and stage a demonstration at a non-wheelchair-accessible McDonald's restaurant two years before.

[Headline] Protesters hold workers hostage by Arthur Moczygemba, Express News Staff Writer Members of a group wanting improved access for the handicapped invaded the VIA office at 800 W Myrtle on Monday and used their wheelchairs to block all access to the building for about 90 minutes. Some 34 VIA employees held hostage inside their offices were released after police negotiated for a meeting with local and national transportation officials. The later session led to an airing of demands by about 60 members of the American Disabled tor Accessible Public Transportation. Police rented vans, in case the protesters were arrested. Bernie Ford of Chicago, president of the American Public Transit Association, and Wayne Cook, general manager of VIA, met with the ADAPT members Monday afternoon, but both sides stuck to their respective positions on public bus access for the handicapped. Ford was in San Antonio to attend the western conference of APTA, meeting at the Hyatt Regency Hotel through Wednesday. About 15 police officers were on duty there, Toscano reported. Ford refused to grant the ADAPT members 20 minutes of speaking time before the general transit membership, saying that a scheduled Wednesday work session on handicapped access was sufficient for consideration of the problem. Laura Hershey of Denver and Jean Stewart of Poughkeepsie, N.Y. listed the ADAPT demands, which included a policy change by the mass transit system that all new buses purchased be equipped with lifts that allow wheelchair-bound persons to use buses. ADAPT claims that it costs $8,000 to $10,000 to equip a new bus with lifts for the handicapped, while air conditioning a bus costs more “and doesn't always work." “It's a question of priorities," said Mike Auberger of Denver, where ADAPT is headquartered. After a 30-minute session, the only agreement between the ADAPT members and Ford was allow the group to publish an article in the September issue of the association's monthly newspaper. Cook was grilled about the San Antonio situation by Bob Kafka of Austin, a Texas ADAPT official. Cook said the VIA Para-Transit system used in San Antonio, which uses specially equipped vans to transport the handicapped was implemented upon recommendation by a 26-member task force, which included handicapped persons. “This is why you don‘t see San Antonians join your cause,” Cook said. Kafka retorted that numerous San Antonio handicapped members have contacted ADAPT, and refuted Cook's contention that the majority of the local handicapped persons support the VIA Para-Transit program because it is segregationist. “This is not to say you're lying,” Kafka told Cook, “but you are distorting the truth." The ADAPT members then read a statement submitted by Willis Williams on behalf of the San Antonio Citizens Concerned about Handicapism. The SACCH statement said the group declined to participate in the ADAPT demonstration but added: “It is our long-standing position to support the concept of a multimodal system with both lift-equipped mainline buses and door-to door service vans as the best and most economically sound approach for San Antonio." The statement was issued on behalf of Larry Johnson, chairman of San Antonio Independent Living Services, and Joyce Jenks, president of SACCH. "Twenty (VlA) vans cannot possibly serve 50,000 mobility impaired citizens," according to Jenks. The 60-member ADAPT group was composed mainly of Texans, with - others from Colorado, Illinois, and New York. Three people attending the protest identified themselves as San Antonians who came as individuals because their organizations are tax-exempt and do not participate in demonstrations. Tommy Leifester, 1100 Callaghan, said the VIA task force did not represent the majority of San Antonio handicapped. Leifester assisted Toscano in the negotiated settlement. Leifester stated that although local handicapped persons were not very visible at the protest, "This will help get our story out in public. VIA has been putting out only one side of the story." During the shuttle diplomacy segment the protesters chanted: “We will ride! Access now!" and demands for Cook to meet with them. Cook was not in his office since he was attending the mass transit convention at the hotel. He arrived at 12:10pm. Although the VIA employees were released about 12:30 p.m. and given the rest of the afternoon off, ADAPT members stayed until Ford showed for the meeting about 2:30 pm.

[Headline] The eyes of Texas are on outside agitators -- and a lot of folks from down the street There's never been much love lost between Coloradans and Texans, at least not since those folks from the Lone Star State first wandered into the Rocky Mountains and discovered deep powder in the winter and cool valleys in the summer. As Winnebago after Cadillac after pickup poured across Raton Pass, Coloradans greeted Texans with open cash registers and - increasingly -- ridicule. Our scorn for Texans even reached into the highest office in the state when Governor Dick Lamm greeted his Texan counterpart with this joke: A Texan died here recently and we couldn't find a coffin large enough, so we gave him an enema and buried him in a shoebox. Texans were not amused, though by now they should have come to expect such treatment. We've been squabbling ever since a detachment of Colorado militia turned back a Texas Confederate army at Glorietta Pass during the Civil War. Each summer now we give Texas a chance to even the score down near Alamosa in a rotten tomato battle. OF course we always make sure our army's bigger. That animosity, however, doesn't carry over to the disabled population of the two states. In fact, a dozen or more militant wheelchair activists from Colorado have been rolling onto the streets of several Texas cities during the past couple of years to aid their counterparts in the battle to force Texas transit systems to make their buses wheelchair-accessible. "After Colorado, Texas is out best organized state," Wade Blank, the long haired ex-preacher who helped found American Disabled for Accessible Public Transit (ADAPT) in Denver two years ago. ADAPT chapters have sprung up in several other states, notably Illinois, Maine, and Connecticut, but none have garnered as many active members as Texas. Scores of Texans have blocked buses in San Antonio, Houston, Dallas and El Paso in recent months to focus the attention of the state's media on the lack of accessible buses. Part of ADAPT's success in Texas lies in the fact that there are so few lift-equipped buses in this huge state. Some Texas cities did order accessible buses when the Carter administration's Department of Transportation ordered mandatory accessibility in the 1970s. However, most of these lifts were never used as the American Public Transit Association (APTA), a national lobbying and policy making organization for transit systems, successfully fought the regulation in federal appeals court. APTA maintains that the local transit provider is the best judge of whether or not accessibility is feasible. Adverse climatic and geographical conditions are generally cited as the chief obstacles to lifts. Texas ADAPT leaders point out that few areas in Texas experience severe winter storms and that the state's larger cities are generally laid out on flat plains. That was one of the points wheelchair activist tried to make when they picketed in April 1985 regional APTA convention in San Antonio. A sizable contingent of Coloradans joined those picket lines, leading to a charge by the local newspaper, the San Antonio Light, that the demonstration was the work of outside agitators and that most of the city's disabled population was quite happy with using paratransit. Spot demonstrations and bus seizures soon followed in other Texas cities, while some Texas ADAPT members turned outside agitators themselves by participating in demonstrations at the APTA national convention in Los Angeles in October 1985. Several Texans including Jim Parker of El Paso and Bob Kafka of Austin, were among The dozens arrested. Supporters of lifts point to cities like Seattle and Denver where most of the buses are accessible -- and increasingly free of breakdowns. Denver's Regional Transportation District (RTD) maintenance crew made a few simple changes in some of their lift systems and managed to operate experimental buses without a single breakdown. ADAPT argues that some transit providers have deliberately sabotaged their lift systems to justify removing them. Opponents of lifts argue that paratransit--usually vans that pick riders up at their residences -- is more cost effective. Supporters point to Seattle where the cost per ride on mainline buses is less than $15 a trip, which compares very favorably with the best deals offered by paratransit systems. Convenience is a major factor too, according to Mike Auberger of ADAPT-Denver, who points out that most paratransit systems require two days' advance notice and users might have to travel all day just to keep a 15 minute dental appointment. "Me, I like being able to roll down to the corner bus stop," Auberger said. ADAPT grew out of coalition of Denver disabled groups who were successful in battling RTD over wheelchair lifts. Protestors seized buses and chained themselves to railings at RTD headquarters before the battle was won. Two years ago they went national when their arch foe, APTA, held its national convention in Denver, APTA refused to allow ADAPT to present a resolution to the convention calling for mandatory accessibility until pressure was brought to bear by Denver Mayor Federico Pena, a pro-lift advocate. APTA declined, however, to vote on the issue, and ADAPT picketed the group's 1984 national convention in Washington, DC, in October. Twenty-four protestors were arrested during the demonstration, including Parker. Parker, who was joined in Washington by four other Texans, isn't through with APTA yet. When that group holds its Western Regional Convention in San Antonio April 20, Parker said they can expect almost as many demonstrators as went to Washington. "I can't think of any place in Texas where it (public transportation for the disabled) is as good as it is here in Denver -- in fact it's poor everywhere here. Dallas just decided to buy 200 or 300 new buses without lifts." The situation isn't any better in his home city of El Paso, according to Parker. "It's very poor here," he said. "There are 30 city cruisers here with lifts but the city has shown no desire to use them." Parker thinks too many people in wheelchairs are too passive. "They're not used to pushing people, but we're starting to see some changes." However, Parker points out that Texas is a very conservative state and people -- including the disabled -- are slow to change. [End italicized] – Wade Blank, a founder of and organizer for ADAPT (American Disabled for Accessible Public Transportation), Denver Post, October 6, 1985 In the spring of 1982, a woman in a wheelchair went into a clothing store in the Bronx and was told by the guard that he was required by store policy to turn away people with wheelchairs. Shs wrote a letter of complaint to the head of the chain and received an apology, along with a $50 gift certificate. Off she went to cash in the certificate, and guess what happened? That's right. A guard turned her away from the store. The woman sued; the store settled the case by giving her a check for $10,300. I had been about to write that a disabled lawyer had handled her case, but he — Kipp Elliott Watson—corrected me. “I am a lawyer with a disability," he said. In Jim Johnson's "Shop 'Talk" column in the February 22, 1986, Editor & Publisher, there is a guide for copy editors and reporters concerning accuracy of language in stories about those with disabilities. It was put together by more than 50 national disability organizations. One illustration: “Perhaps the most offensive term to disabled people is ‘wheelchair-bound' or ‘confined to a wheelchair.’ Disabled people don't sleep in their wheelchairs, they sleep in bed. Call them 'wheelchair users.'" Also, "labeling of groups should be avoided. Say ‘people who are deaf' or 'people with arthritis’ rather than ‘the deaf' or ‘the arthritic.’ . . . One of the problems with eliminating insensitive terms is the, lack of a clear policy that reporters and editors can follow. A reporter cannot change a paper's policy by himself. The first time a reporter writes 'person who is arthritic,’ a copy editor is sure to change it to ‘an arthritic’ to save words.” And I would particularly recommend the next correction to the vast majority of the reporters and editorial writers who have covered Baby Doe cases: “Afflicted [unintelligible] a negative term that suggests hopelessness. Use disabled. Also to be avoided are deformed and invalid." The guide is especially useful because more and more of those with disabilities are going to be making news-in–lawsuits, individual acts of resistance against discrimination, and in collective demonstrations. For instance, in Los Angeles last October, during a nonviolent direct-action protest against the American Public Transit Association (which is resisting making all its buses accessible to the handicapped), there was this report by George Stein in the October 7 Los Angeles-Times: “During the procession, 131 wheelchairs, stretching more than a block, carried people with disabilities ranging from spina bifida, cerebral palsy and muscular dystrophy to snapped spinal cords, congenital defects and post-polio paralysis. “Many had the withered limbs and lack of body control that the more fortunate usually try not to stare at. “But not Sunday. Motorists slowed to watch the sight. Some honked in support. One of the demonstrators was Bob Kafka, a spokesman for ADAPT (American Disabled for Accessible Public Transit) "This is beautiful,” Kafka said as he wheeled along “I am tired of being closed away." Carolyn Earl, who uses a wheelchair, tried to make a reservation at the Harrison Hotel in Oakland, California. The clerk wouldn't take an advance deposit. Suppose there's a fire, he said. The hotel would be liable. But call back, he said. She did. Ain't that a shame, there are no rooms with baths, and she'd asked for a room with a bath. Okay, the woman said, I’ll take a room without a bath. The clerk said that for her, there were no rooms, period. Just like it used to be with blacks and Jews. It happens, however, that according to Section 54.1 of California's Civil Code, it is as unlawful to discriminate in public accommodations against people with disabilities as it is to exclude racial and ethnic minorities. Carolyn Earl went to court. In December 1984, the hotel agreed to pay her damages and to sign an agreement pledging never again to refuse lodging to anyone who is disabled. In Louisville last fall, Steve and Nadine Jacobson, who are blind, were on trial. The charge: disorderly conduct. On July 7, they had been sitting in exit-row seats on United Airlines Flight 869 to Minneapolis, where they live. Airline personnel and security employees from Standford airport ordered the Jacobsons to get out of those seats. In the event of an emergency, the Jacobsons were told, they, being blind, could jeopardize their own safety and that of others. The rationale for the policy, it came out at the trial, was a “test” some time back during which – now get this – sighted people were blindfolded two hours before a mock evacuation and it turned out that these “blind” people had trouble opening emergency exit doors as well as dealing with other evacuation procedures. On the basis of a test that used fake blind people to find out how real blind people might act, the Federal Aviation Administration—long known for its stunning brilliance—issued an advisory circular suggesting to airlines that they keep blind folks out of those emergency exit rows. As they were trying to get the Jacobsons to move, United Airlines personnel kept insisting that a "Federal regulation" said they had to get out of those seats. The Jacobsons, however, had just come from a convention at which that very advisory circular had been discussed. They knew there was no rule. And so they sat. And sat. Irritated passengers offered to trade seats with them. Another yelled that the Jacobsons were holding everybody else up. "How can you be so selfish?" And another, speaking from the heart, pointed to Nadine Jacobson, and said to a neighbor: “No wonder God punished her by making her blind!" Eventually, the Jacobsons were removed from the plane and charged with disorderly conduct—not with violating the alleged “Federal regulation." At the trial, Steve Jacobson told the jury: “All through my life, there were things I was told I couldn't do because I was blind. In college, they said I couldn't take math." (Mr. Jacobson is a computer analyst for 3M.) He went on to say that he kept ignoring all the advice about all the things he couldn't do because he was blind. “I just had to go on," he said. Where he works, he was told not to use the escalator. He could get hurt. He uses the escalator. That day at the airport, “To move from my seat would reinforce all that I've worked not to have happen. To move would say to the other people on the plane that I am less capable than any sighted person to open that emergency door. And that isn't. the case. It just isn't.” As for Nadine Jacobson: “I was scared. I had never been arrested before. I felt really bad that people were angry and upset, and that the plane was being delayed." But still she wouldn't move. “Many times people make assumptions about what we [blind people] can do and can't do. I knew that if I moved from that seat, everyone would think that anyone else was more competent than me. It's an issue of self-respect. I'm a citizen of this country, and a blind person, and I feel I have a right to travel in this country, and if I get assigned a seat, I have a right to sit there." Would the jury have been convinced solely by what the Jacobsons said? I don't know. But I expect they listened with much interest to testimony by Mark D. Warriner of Frontier Airlines, who said his company had stopped discriminating against blind people as a result of a March 1985 evacuation drill by World Airways, which showed that blind people—real blind people—got out during an emergency faster than sighted passengers. The Jacobsons were acquitted. The verdict, said Nadine Jacobson, was “a step forward for blind people all over the country." Footnote: None of the police officers or the security personnel involved in arresting the Jacobsons would give them their names. Without the names, the Jacobsons could never identify them, ho-ho. But an attorney sitting in front of the Jacobsons on the plane handed them a piece of paper with one of the names, and that led to others being revealed. The stories about the Jacobsona and the woman trying to get a hotel room originally appeared in The Disability Rag in somewhat different form. There is nothing like that paper in the whole country. It covers the whole disability rights spectrum—from what‘s happening in the courts to the directions being taken by groups of nonviolent resisters. It publishes memoirs, jeremiads, parodies, and material for which there is no category. It is the liveliest publication I know. It has grace and beauty and fury. We shall be getting back to public transit, along with education, jobs, and stereotypes of people with disabilities in movies and television as well as in print. The importance of access to buses and other forms of transit has been distilled by Wade Blank of ADAPT: “Jobs and education don't mean much if you can't get a bus to take you there. Accessibility to public transportation—moving from one place to another—should be a right, not just a consumer service." Recently, Wade Blank was telling me how, because of ADAPT and the pressure it keeps putting on, 78 per cent of the buses in Denver, where ADAPT is based, are now accessible. Soon, with 200 new buses on order, all of them with lifts, people with disabilities will be able to ride 90 per cent of the Denver buses. Already, Blank said, this access means a lot. “I know a man with cerebral palsy," Blank continued. “He has no use of his legs or arms. He can't speak. But now, with the buses accessible, he can ride around and see the sights and come to our offices. He can move where and when he wants to in the Denver community." He's no longer closed away. In Dallas, Kataryn Thomas, 57, was arrested last month during an ADAPT demonstration against the recalcitrant Dallas Area Rapid Transit Authority. She was born with spina bifida, uses a wheelchair, has worked as a receptionist, and when she was busted, a bright orange flag connected to the back of her chair fluttered in the breeze. The words on it were: “Free Spirit." “l don't have to climb any mountains," Kataryn Thomas told the Dallas Times Herald. “I just want to ride the public transit.”

[Headline] ADAPT PUBLIC TRANSIT OR ELSE by Mike Ervin One of the largest civil rights marches in history by people with disabilities was held Sunday, October 7, 1985 in downtown Los Angeles to protest the American Public Transit Association (APTA)'s policy of local option transit for disabled. In response to an “invitation” by American Disabled for Accessible Public Transit (ADAPT) to join in picketing the annual APTA convention, national leaders of the Disability Rights Movement converged at MacArthur Park to roll the 1.7 miles to the convention site at the Bonaventure Hotel. Bill Bolte of the California Association of the Physically Handicapped (CAPH) took a head count of the line of people in wheelchairs rolling single file down the middle of Wilshire Boulevard and announced that there was 215 present. The L.A. Police Department had refused to issue a parade permit to the group and had said it would not allow the long planned parade to be held on the street, but when 200 plus wheelchair users took to the pavement (no curb cuts) all the police could do was route traffic around the procession. It was an impressive sight; more than twice the number of people ADAPT had turned out for previous demonstrations at the annual conventions of APTA. As the line of people stretched more than a block in front of the posh Bonaventure Hotel where APTA was staying, the L.A. Police waited; there wasn’t much they could do except establish their presence. The protesters marched into the hotel lobby taking up most of the available space. Chants of “We will ride!" Filled the atrium below as bewildered hotel guests wondered what all this could possibly be about. The Hotel Security immediately blocked the one wheelchair accessible elevator to the main lobby. This escalated (so to speak) the confrontation, as demonstrators got out of their wheelchairs to block the escalators, saying “if you block our access, then we will block the escalators. No one will be able to use them." Meanwhile the police discussed the strategy of arresting certain people first whom they had identified as leaders. The police told the media that the charge was “refusing to leave the scene of a riot.” The woman arrestee was released Sunday night, five of the men were released the following afternoon, and the last two men were released Tuesday morning after 53 disabled individuals held an all night vigil outside the county jail. On Tuesday morning, the American Civil Liberties Union (ACLU), represented by Lou Nau, the chairman of the Disability Rights Committee of the ACLU, outlined the treatment that the arrestees faced. Four of the men were handcuffed behind their backs and left to sit in the police vehicles for up to five hours. Mike Auburger, a quadriplegic, was not allowed to use the bathroom for eight hours, causing hyperreflexia. Individuals on sustaining medication repeatedly asked for their medication, but never received it. Nau said to permit no bail for misdemeanor offenses is clearly against the law. Although APTA tried to discredit the protestors as a “small militant group of outsiders," they represented a wide spectrum of the Disability Rights Movement including Robert Funk, Executive Director of the Disability Rights and Education Defense Fund; Michael Winter, Director of the Center for Independent Living, Berkeley, CA; Judy Heumann, of the World Institute on Disability; Joe Zenzola, President, California Association of the Physically Handicapped; Peg Nosek, of Independent Living Research Utilization Project, Houston, TX; Catherine Johns, President of The Association on Handicapped Student Service Programs in Post-Secondary Education; John Chapples, Department of Rehabilitation, Boston, MA; Mark Johnson, Department of Rehabilitation, Denver, CO; Marco Bristo, Director, Access Living, Chicago, IL; Harlan Hahn, Professor, University of Southern California; and Don Galloway, D.C. Center for Independent Living. The following days saw many more protests in the Los Angeles area. On Wednesday, about 50 individuals arrived at the office of Larry Jackson, Director of the Long Beach Transit Authority, who is the incoming President of APTA. After being denied a meeting with him, they went out into the streets. The police gave them l0 minutes to disburse or be arrested. When no one moved, the police proceeded to arrest the protestors and take them to jail in 6 dial-a-ride vans. These individuals were booked and then released, as it was not possible for the Long Beach Police Department to accommodate so many disabled people. The passers-by had many different reactions to what they were experiencing; some were mad at being detained, some joined in. [Headline] Disabled Stage Protest Parade; 8 Arrested Oppose Transit Group Policy Against Mandating Bus Chair Lifts By GEORGE STEIN Times Staff Writer The halt and the blind converged on a public transit conference in downtown Los Angeles Sunday, parading through streets without a city permit and blocking entrances and stairways at the conference hotel in an effort to make the point that the disabled are denied the access to transportation available to the general public. Eight activists for the disabled were arrested on charges of failing to disperse an unlawful gathering and intefering with a police officer. The arrests —“a distasteful necessity," police said -- took place in and around the Bonaventure. They came after Los Angeles police had relented to an earlier stand to make arrests if any tried to parade along Wilshire Boulevard from MacArthur Park to the conference. “Listen, how could we arrest all these people?" Capt. Bill Wedgeworth said. During the procession, 131 wheelchairs, stretching more than a block, carried people with disabilities ranging from spina bifidia, cerebral palsy and muscular dystrophy to snapped spinal cords, congenital defects and postpolio paralysis. Many had the withered limbs and lack of body control that the more fortunate usually try not to stare at. But not Sunday. Motorists slowed to watch the sight. Some honked in support. “This is beautiful. I am proud to be a disabled person. I am tired of being closed away," said Bob Kafka, as he wheeled along. Kafka, from Austin, Tex., a spokesman for the American Disabled for Accessible Public Transit, has a broken spinal cord. He was among those arrested later. Once inside the hotel, the group headed for the reception area in an attempt to reach delegates to the annual conference of the American Public Transit Assn. However, police kept the demonstrators bottled up near the entrance, one floor above the main reception area. "Access now! Access now!" the demonstrators shouted. The crowd, which came from a spectrum of disabled activist groups in and out of California, targeted the transit convention because the organization opposes a national policy mandating wheelchair lifts on buses. The American Public Transit Assn.'s position is to let each transit agency deal with access for the disabled as a local decision. In Los Angeles, the Southern California Rapid Transit District, with 2,445 buses, has wheelchair lifts on 1,691 and is retrofitting another 200. The RTD hopes to have lifts on all buses in five years, which, according to a spokesman, would probably make it the first major urban bus system to be so equipped. After the demonstrators blocked hotel escalator wells for almost an hour, Wedgeworth told them their gathering was illegal. The actual arrests were an odd orchestration of defiance and cooperation. Escalator Well George Florom, a member of the disabled group from Colorado Springs, Colo., began thrashing as police tried to remove him from an escalator well. It took three officers to subdue him. “He began kicking and trying to bite me, so he had to go," Lt Ken Colby explained. One of the demonstrators grabbed an officer's gun, police said. Florom, lay quietly once handcuffed, and police gently placed him in his wheelchair and wheeled him to a lift-equipped van that had been arranged for the occasion. Trained medical personnel also were on hand. Edith Harris of Hartford, Conn., had earlier failed in an attempt to get arrested, tearing up American Disabled for Accessible Public Transit literature and throwing it on Figueroa Street. "Arrest me,“ she screamed to ‘no avail from her motorized wheelchair. The police only moved her to the sidewalk, and an officer went back to [unreadable] trash. Her wish was granted later, after she tried to herself down one of the blocked escalators. Then she calmed down, gratefully accepting a drink of water from a police officer, while waiting for a stretcher to arrive. Unhandcuffed, sitting upright, she was placed in the van. Her wheelchair was carefully handed in after her. Taken to Station The arrestees were taken to the Central Division station for processing. The seven men were later booked at County Jail, where bail was set at $500. Harris was booked at Sybil Brand Institute. Some police worried that the department's image would suffer from Sunday's action. “We look bad, no matter what we do," Sgt. Bill Tiffany said. After the arrests, a spokesman said, “It must be stressed that the Los Angeles Police Department has repeatedly tried to meet with demonstration leaders in the attempt to provide legal alternatives to accomplish their objectives and avoid the distasteful necessity of arresting handicapped citizens.” The police were not alone in their concern. Five months before the convention, according to Mark Johnson, 34, of Westminster, Colo., an organizer for the disabled group, RTD board member Jack Day flew to Denver to try to talk the organization out of civil disobedience. Negotiations foundered on an demand by the disabled group that the RTD introduce and support a proposal that the American Public Transit Assn. reverse its stand and back mandatory wheelchair lifts on buses, Johnson said. He said the disabled activists will be in town through Wednesday. The American Public Transit Assn. is a lobbying and policy organization. The five-day convention began Sunday.

[Headline] Group seeks access for wheelchairs By David Wells George Cooper and Bob Kafka climbed aboard a City Metro bus at Government Square Monday, paid their fares and were arrested. Cooper and Kafka were among several dozen members of the American Disabled for Accessible Public Transit (ADAPT) demonstrating this week against Metro and the American Public Transit Association gathered at the Westin Hotel. ADAPT disrupted operations at Metro’s main downtown stop on Government Square for about two hours Monday. Following arrests of Cooper and Kafka, Metro rerouted its buses and avoided further confrontation with the wheelchair-bound demonstrators. ADAPT wants full accessibility for the handicapped on all public transportation facilities. Regular Metro coaches do not have wheelchair lifts. The company does provide transportation for the handicapped with special, lift-equipped Access vans. ADAPT claims that Access vans are unreliable in poor weather and even in good weather require a 24-hour advance reservation. The group also wants the national transit association to adopt a resolution at its Cincinnati convention requiring full access for the handicapped. Wheelchair-confined demonstrators picketed Westin entrances throughout the day but were denied admission to the hotel or adjoining public atrium. Cooper of Dallas, and Kafka of Austin, Texas, were charged with criminal trespass after they refused requests from Metro and the Cincinnati Police to get off the bus. “There are no lifts in these buses. It is not safe (for the handicapped), “said Murray Bond, assistant general manager for the company. Yet, after Cooper and Kafka were arrested, they were transported to the Hamilton County Justice Center on the bus rather than being transferred to a lift van. “That was a judgement call on my part,” said Capt. Dale Menkhaus, who headed the police detail. “It was decided it would be much easier and safer to transport them on the bus than to try to carry them off of it.” Four officers rode with the prisoners to ensure they were not jostled on the five-block trip to jail. Also arrested at the demonstration was Mike Auberger from Denver, who Menkhaus said attempted to block the bus carrying Cooper and Kafka. Auberger was charged with disorderly conduct and taken to the Justice Center in a lift van. Menkhaus said it was “a no win situation” for the police. No matter how sensitively the officers acted, they still had to confront and arrest people in wheelchairs. Officers in that detail were briefed on handling the demonstrators. Menkhaus said. “Our officers were told to ask each individual what the best way to lift him was, even to the point of which limb they would prefer to have moved first.” Still, to the members ADAPT, they were being dragged off the buses. “People were being dragged off the buses because they just wanted to ride,” said Bill Bolte of Los Angeles. When ADAPT member Rick James, a cerebral palsy victim repeatedly tried to roll his motorized chair into the street and in front of buses, police officers unplugged the chair’s battery. It left James immobile on the sidewalk. Other ADAPT members reconnected the battery and James pulled up in front of another bus. Metro eventually took the bus out of service and left it parked at the stop during the demonstration. At the Justice Center, all three prisoners co-operated fully with deputies, said Sheriff Lincoln Stokes. About five other demonstrators boarded buses that pulled in the stops at Government Square but they got off the bus when asked to do so, Menkhaus said.

Adams Crosscurrents Title: Pretenders to the Civil Rights movement The attempts of minorities of all stripes to identify with the black experience in America to gain even legitimate goals strike me as being a deception and a fraud. It also trivializes the dehumanization the blacks suffered at the hands of the white majority for 350 years. Only one group was brought to this country in chains, treated like animals, sold on the block like livestock, forced to live in shanties and valued only for the labor they could produce. And even after being freed from the shackles of slavery, blacks were denied their civil rights for another 100 years. No other group in this country has had to suffer those indignities. Yet minorities as diverse as militant feminists, homosexuals and the handicapped hoist the banner of oppression and try to do a black face routine as farcical as the old showboat acts on the Mississippi of the last century. The wheelchair protests staged by the Denver-based American Disabled for Accessible Public Transit (ADAPT) here last month are only the latest examples of groups with gripes trying to piggyback on the black civil rights struggle. Let us all agree that more needs to be done to make sure the disabled among us can get where they want to go. And there obviously are cities doing more than Cincinnati to make public transportation accessible. Denver is one. But that is begging the question. Cincinnati is not Denver. Queen City Metro is strapped for funds. It cannot provide all the service it would like for the handicapped—or even the able-bodied. But the issue is money, not civil rights. Determined to get arrested, the wheelchair protesters blocked the Westin hotel entrances, grabbed onto the wheel well of buses to keep them from moving, and one wacko with a death wish even rolled into the path of a bus going 40 mph. Bob Kafka, one of the 14 arrested—and given special treatment at the Hamilton County Justice Center—wrote a letter to The Post that began: “I am writing this letter from the Hamilton County Jail, in which I am spending Memorial Day, for the crime of trying to ride public transportation." Kafka's emotional appeal falls flat. (He obviously was trying to imitate Dr. Martin Luther King Jr., whose famous “Letter from the Birmingham Jail" stirred the conscience of a nation.) Kafka's crime was not that of trying to ride public transportation. He was charged with disorderly conduct for crawling aboard a bus, dragging his wheelchair, dropping 50 cents in the fare box and then demanding to ride - knowing full well the bus could not move with him on it. But Kafka, in his letter, attempts to equate the problems of the handicapped with those of blacks who were forced to ride in the back of the bus: “Those in power have decided to oppress us and make sure disabled people do not ‘step out of line’ and assert their rights," Kafka wrote. “Queen City Metro decided they were going to keep disabled people in their place.” By couching his complaint in vintage 1960s language, Kafka confuses the issue. The disabled should be heard. But they should give rational reasons for their demands for equal access to public transportation and not try posing as an oppressed minority that dares not “step out of line." I didn't see any cattle prods or police dogs used to quell the demonstrations. After the protesters had left town, Council Member David Mann had pangs of conscience that caused him to make some of the silliest statements in the annals of Mann. “It seems to me that every human being in Cincinnati — visitors, handicapped or otherwise — had the absolute right to enter the Fountain Square South complex on equal terms," Mann wrote, as if he had been living in a cave during the four-day wheelchair protests. “If you and I were free to move unfettered into the public areas of the Westin, then those who happen to move by wheelchair should have been treated precisely the same." I know philosophers have struggled for centuries to define reality. After reading Mann’s views on what took place in front of the Westin, I can understand why. His perceptions are unreal. Those who happened to “move by wheelchair” were not treated precisely the same as others because they were intentionally trying to block the entrances and disrupt bus service. That's called breaking the law. It seems to me that even a council member from Clifton, who happens to be a lawyer, should be able to make that distinction. The restrictions were not based on class discrimination. Rather, they were triggered by those misguided handicapped persons who believe they can gain greater access to public places by denying that right to others. The wheelchair protesters would have scored more points with the public by shunning crazy antics and making their appeal in a sane manner. I think it revealing that the Greater Cincinnati Coalition of People With Disabilities refused to participate in the public demonstrations. The coalition leaders believe they can accomplish more by talking with local city and bus officials than by trying to disrupt traffic. They certainly will gain more public sympathy. May 22, 1986 - Cheyenne Wyoming State Tribune—27 [Headline] Handicapped Protesters Arrested CINCINNATI (UPI) — A group of handicapped protesters charged with disorderly conduct and criminal trespass refused to post bond and spent the night in the Hamilton County Justice Center. The demonstrators, protesting the lack of access to public transportation for the disabled, were arrested Wednesday for blocking entrances to the Westin Hotel and the building housing offices of the city's bus system. The Westin was singled out because the American Public Transportation Association was holding a regional conference there this week. Barricades had been erected to keep the protesters from entering the hotel. Several of those arrested were released on unsecured appearance bonds for medical reasons. The first defendant's trial was scheduled for next Wednesday. “If the Cincinnati transit system, police and judicial system deny access to disabled people, why can't the disabled block the access to the system,” said Michael Auberger of Denver before his arrest. “We just want to be treated like everyone else.” Auberger was among those who spent the night in jail. About 40 wheelchair-bound members of American Disabled for Accessible Public Transportation, based in Denver, participated in the demonstration. Fourteen were arrested and charged with disorderly conduct. Robert Kafka of Austin, Texas, George Cooper of Dallas and Auberger, all of whom had been arrested earlier in the week, were charged with criminal trespassing for blocking the entrance to the building where Queen City Metro's offices are located. The three men, confined to wheelchairs, had been arrested Monday for refusing to get off a bus they had paid to board. A Hamilton County Judge had ordered them to leave Cincinnati until their trial, but another judge rescinded the order Wednesday morning. Auberger, Cooper and Kafka attempted to speak to Queen City officials but were not permitted to enter their offices. When they returned to the ground floor, they chained their wheelchairs together to block the entrance. One worker was forced to use an alternative route to return to her office. "We asked one lady to wait a few minutes," Auberger said. “The disabled are told to wait a lifetime.” The Rev. Wade Blank, director of ADAPT, said some staff members would remain in Cincinnati and that local clergy would be asked to monitor and support those arrested.

McCARTY The Cincinnati Enquirer and ENQUIRER WIRE SERVICES The issue of handicapped people and their accessibility to mass transit reached a peak Tuesday locally and nationally, sparking protests that were expected to go on today. In Cincinnati, a judge ordered three handicapped protesters who had been arrested to leave the city or go to jail. One of the men, a native Cincinnatian, chose to ignore the edict, and his bail of $3,000 was revoked late Tuesday. In Washington, D.C., the Department of Transportation issued long-awaited criteria for making the nation's public transportation systems more accessible to 20 million handicapped people. Neither decision was well received by the handicapped community. The Rev. Wade Blank of ADAPT (American Disabled for Accessible Public Transportation) said late Tuesday that a dozen or more of its members were planning an act of civil disobedience in Cincinnati today that he expected would get them all arrested. “We decided that to leave Cincinnati under the present atmosphere of basic human rights violations, would be to ignore our moral obligations," Blank said. George Cooper, who was arrested Monday said, “I thought my hometown of Dallas was conservative, but Cincinnati is more conservative." Cooper arrested Monday with two other members of ADAPT on charges of disorderly conduct during a demonstration at Government Square. Hamilton County Municipal Judge David Albanese imposed the sentence on the the ADAPT protesters. Late Tuesday, police spotted ADAPT member Mike Auburger, a former Cincinnatian who lives in Denver, driving a car through the -- city—an apparent violation of Albanese's order to leave the city. Cooper and Robert Kafka, Austin, Texas, were arrested after they crawled up the steps of a Queen City Metro bus, paid their fares and demanded the right to ride. Auburger was arrested when he tried to grab a wheel of the same bus as it pulled away from the stop. Metro's Assistant General Manager Murray Bond said disabled persons were not permitted on regular coaches because the company does not think it is safe. Metro provides wheelchair lifts on Special Access buses. but Bond said the cost of installing wheelchair lifts on regular buses would be prohibitive. Defense attorney Joanie Wilkens said after Tuesday’s hearing that she considered Albanese's order unusual but that ADAPT did not have the time or resources to fight it in court. ADAPT members were in Cincinnati to protest policies of Queen City Metro and the American Public Transit Association, which is having a convention at the Westin Hotel. In Washington, DOT's issuance of a final regulation requiring transit systems to provide reasonable alternative transportation for the handicapped contained no surprises. Many transit systems have been moving for several years toward providing alternatives such as van service or a taxi voucher system for handicapped passengers. But ADAPT and other national disability rights groups, dismayed by the new rule, almost immediately filed federal lawsuits against DOT to block the move. Handicapped representatives said the new rule fell far short of carrying out the law. A federal court in 1981 ruled that a federal requirement that all transit systems be accessible to the handicapped was too much of a financial burden. It told the Urban Mass Transportation Administration to develop new requirements that would assure that the handicapped are provided service. Under the final rule announced Tuesday, a transit authority must establish some alternative services for the handicapped if the regular bus or rail service can not be made accessible. Other members of ADAPT continued to picket in their wheelchairs in front of the Westin Hotel on Tuesday. The group suspended a wheelchair from a wooden cross. Cincinnati Enquirer 5/28/86 Disabled protesters released on promise to leave city by David Wells, The Cincinnati Enquirer Leaders of last week's disabled rights protests of Cincinnati left jail four days early Tuesday after Municipal Judge J. Howard Sundermann agreed to reduce their sentences. Last Friday, Sundermann sentenced Robert Kafka of Austin, Texas, George Cooper of Dallas and Michael Auberger of Denver to spend 10 days in jail for disorderly conduct. The judge gave each man credit for two days already served, but said they would have to remain incarcerated until this Friday. He modified those sentences Tuesday, saying the medical condition of at least one man seemed to be deteriorating and all three promised to leave Cincinnati if released. The men are members of American Disabled for Accessible Public Transportation (ADAPT). They came to Cincinnati last week to demonstrate against the American Public Transit Association, which was holding a convention at the Westin Hotel. The group also demonstrated against Queen City Metro in an effort to get the company to include wheelchair lifts on all new buses. The rest of 17 protesters arrested last Wednesday with Auberger, Kafka and Cooper were released by Friday, but Sundermann said the three leaders deserved more severe sentences than the others because they disobeyed an earlier court order. The three first were arrested for disorderly conduct May 18 during a demonstration against Queen City Metro at Government Square. They were released on bond and told to stay out of Cincinnati until their trials. Sundermann modified that order last Wednesday morning, saying the men could rejoin the ongoing protests as long as they did not break any laws. Within three hours, Kafka, Auberger and Cooper were rearrested, accused of blocking the Fourth Street entrance to Metro headquarters by chaining their wheelchairs together. “They apologized for that this morning," Sundermann said. “They said they just got caught up in the spirit of the protest.” Sundermann agreed to reduce the sentences on a motion from defense attorney Joni Wilkens, who noted that Auberger had been taken to University Hospital Sunday because of a recurrent medical problem related to his disability. Assistant City Prosecutor Charles Rubenstein did not object to the reduction of the sentences. All three men are confined to wheelchairs, and Wilkens said she was afraid continued time in jail might impair their health. After leaving jail Tuesday, Kafka said the three “felt we had made our point and raised awareness (of) the problems of the disabled."

Cincy orders protesters out A May bus protest in Cincinnati has been described “as the most effective, courageous and fun action ever accomplished in the movement for disabled rights," according to literature mailed out by the American Disabled for Accessible Public Transit (ADAPT). Some 85 members of ADAPT were in Cincinnati in mid-May to picket a regional convention of its arch-enemy, the American Public Transit Association (APTA) and to dramatize what a lack of accessible buses means to the disabled population of that Ohio city. The action began with the customary march on the convention hotel on Sunday, May 18. No arrests were made but marchers were greeted at the Westin Hotel by police and double barricades. None of the protestors was allowed into the hotel. Pointing out that other people were passed through the barricades, Bob Kafka of Austin, Texas, said the wheelchair protestors were being discriminated against. However, Cincinnati police captain Dale Menkhaus said that such actions, were proper when taken to protect private property from any group seeking to disrupt other lawful gatherings. The following day Kafka and fellow Texan George Cooper of Dallas dragged themselves onto a City Metro bus, paid their fares, and were arrested. They were reportedly told that “it’s not safe for disabled people to be on the regular bus.” The two were later released on $3,000 bond and ordered out of town, an action that ADAPT leaders described as blatantly unconstitutional. A third protestor, Mike Auberger of Denver, who is a former resident of Cincinnati, was arrested when he attempted to block the bus on which Cooper and Kafka were riding. Auberger said he originally left Cincinnati because of that city's “nineteenth century” attitude toward persons with disabilities. None of the Queen City Metro buses are accessible to the disabled, although 87 of the buses do have lifts which have been bolted down. Metro officials estimate it would cost them $350,000 to return those lifts to operational status. A local Cincinnati disabled activist said that's why she agrees with ADAPT’s goals, even if she can't go along with their methods. Dixie Harmon, co-chairperson of the Specialized Transportation Advisory Committee to Queen City Metro and a member of the Greater Cincinnati Coalition of Persons with Disabilities, said that the city’s service for disabled riders was inadequate. A disabled person must request space 24 hours in advance from Access, the paratransit system, but even then there's not always a space. “They dictate our lives to us because we have to go and come as there's space available.” ADAPT members said that's why they were willing to go to jail to publicize their cause. Police, however, made no arrests when 15 wheelchair protestors rolled onto a highway where vehicles were traveling at 40 miles per hour and blocked seven buses that were carrying APTA delegates and their spouses to a dinner at the Pro Football Hall of Fame in nearby Canton. Police were caught by surprise, as they had barricades to turn back protestors at the entrance to the Hall of Fame. Two local disabled leaders who were accompanying the APTA delegation to the dinner were taunted as “Uncle Toms” in front of TV cameras. Early the next day ADAPT members were back in front of the Weston Hotel where they erected a huge cross and hung a wheelchair from it in a mock crucifixion. On the final day of the convention, 17 protestors were arrested when they blocked the hotel driveway and refused police orders to move. Many of those arrested were ordered to jail unless they agreed to leave town. Three protestors, Auberger, Cooper and Kafka, decided the time had come for disabled protestors to do “hard time” and ended up serving 10 days. Five other protestors were turned out of jail because they had special medical problems or speech impairments. Others were released after pleading “no contest” to the charges in hastily organized trials. “Even the story we had left town and the protest was over made TV news," an ADAPT spokesperson said.
