Title: Disabled Arrested At Omni By Robert Manor (Post Dispatch Staff) Forty-one protesters in wheel-chairs were arrested at Union Station on Sunday as they demonstrated for equal access to public transportation. The demonstration was non-violent, and there were no reports of injuries or of anyone resisting arrest. The protesters were booked by police on charges of trespassing and were taken to the City Workhouse in vans and buses equipped with lifts to accommodate wheelchairs. Members of a group called the American Disabled for Accessible Public Transit, ADAPT for short, demonstrated against the American Public Transit Association, which is holding a convention at the Omni Hotel in Union Station. The association, which represents bus operators, op-poses efforts to require that buses be equipped with wheelchair lifts. ADAPT has repeatedly carried out civil disobedience at meetings of the association, and police were prepared. Scores of officers in uniform and plainclothes officers were waiting as about 150 people in wheelchairs and their able-bodied supporters marched from The Arch, up Market Street and into Union Station shortly after 1 p.m. They blocked some entrances and hallways but were unable to close the hotel. Many chanted and called on the public for support. St. Louis police Capt. Clarence Harmon spoke over a bullhorn and tried to order the demonstrators to disperse. But as he tried to speak, the demonstrators sounded portable air horns, drowning him out. "I'll tell each one individually," Harmon said to an aide. He walked from wheelchair to wheelchair telling each person, "I am Capt. Harmon from the police department. You are subject to arrest if you don't leave. Many did leave, but others remained in place, their wheelchairs side by side. Among them was Barbara Toomer, who sat blocking the main entrance to the hotel. [Headline] Wheelchair-bound rider discovers RTD'5 Catch-22 By PHILIP REED, News Staff It was a little like the old song about Charlie on the MTA - a Denver woman got on a Regional Transportation District bus Thursday afternoon, but she couldn't get off for 2 1/2 hours. Unlike the song, where the rider didn't have enough money, Beverly Furnice, 43, of 1135 Josephine St., couldn't get off because the driver wouldn't help in unloading her wheelchair. Furnice, who has arthritic legs that jut straight out in front of her, boarded the bus at East Colfax Avenue and Cherry Street after leaving her job at Atlantis at 4 p.m. Thursday. She had help boarding the bus, but the driver warned her he couldn’t help her with her wheelchair when she came to her stop. Wade Blank, head of Atlantis, said her plight shows that RTD should not put "an inaccessible bus on an accessible route." Normally, Furnice rides a more modern bus that allows her to get on and off by herself. But when short of buses, RTD reverts to the use of older buses, which can't handle all types of wheelchairs. The standoff came to an end at 6:30 pm when an RTD supervisor met the bus at Furnice’s East Colfax Avenue and Josephine Street stop and helped the driver with the heavy electric wheelchair. Blank said the mess was caused by indecision over whether drivers should help the handicapped. He said there should be a policy more clearly defining if RTD is going to serve the public. When the bus neared Furnlce’s stop, two Atlantis in wheelchairs were prepared to board the bus to “ride in sympathy.” But the driver parked the bus and, with the help of the RTD supervisor, helped Furnice to get her wheelchair onto the lift at the front entrance of the bus. The bus driver, who seemed more shaken by the experience than Furnice, refused to say why he didn't offer assistance earlier. He also refused to give his name, but politely asked reporters to step back from the folding doors before the hissed shut. Larry Narey, head of the Amalgamated Transit Union, which represents RTD drivers, said, “It was definitely a setup. s They (Atlantis) are trying to impress on the public that the drivers are insensitive." “But for every war story they can tell, I could tell hundreds of touching stories about how the drivers help and how they feel about handicapped riders," he added. Narey said drivers are required not to leave their driver's seat. But that rule commonly is ignored at the discretion of individual drivers. "Lord, we have even had drivers helping blind people across the street. We want to move people, but there are restrictions. There comes a point where you have to draw the line. The driver in this case is really a very conscientious young man," Narey said. "He feels deeply about helping the handicapped." - ADAPT (84)

By BRAD MARTISIUS Denver Post Staff Writer In the 1960s, the Kingston Trio recorded a song about a man trapped on the MTA, doomed to ride forever in the Boston subway. That song seemed prophetic Thursday when a handicapped woman found herself unable to get off an Regional Transportation District bus and ended up seeing much of Denver before finally being assisted off by RTD officials, anxious to avoid a scene. The incident, however, raised the hackles of RTD officials, who felt they were the victims of a ploy by members of the Atlantis Community, 4536 E. Colfax Ave., an organization that aids the handicapped. And Wade Blank, co-director of the Atlantis Community, said he wasn't too happy with RTD substituting one type of RTD lift-bus for another type, leading to a very long ride for the handicapped woman. THE WOMAN, Beverly Furnice, 43, of 1135 Josephine St., has legs which are rigid perpendicular to her body and don't bend because of her condition. This makes it impossible for her to ride in an automobile or taxi, a problem exacerbated by the fact that her wheelchair weighs 400 pounds and doesn't fold. Blank said she rides the bus to work daily, and usually has no problems. However, he said RTD put a different bus on the route Thursday. Asked why Miss Furnice didn't just wait for the next bus, Blank said the special buses on that route run only every two hours. Miss Furnice’s wheelchair is elevated and is longer than many wheelchairs, and was unable to negotiate the bus‘ interior without help, even though the bus was equipped with a ramp to aid handicapped persons in boarding. When she got on the bus, she was aided by Atlantis Community members. But when the time came for her to get off, there was no one to help, and the busdriver, who wouldn't identify himself, refused to leave his driver’s seat, so she had no choice but to continue riding the bus, taking the circuit out to Red Rocks and back. ACCORDING TO Dick Thomas, executive director for RTD‘s department of program management, the driver was assured that help would be available for Miss Furnice when she got off the bus. He said the driver made it clear when she boarded that he wouldn't help her get off. “The drivers have the right to do that," Thomas explained. “It’s in their union contract, and it's there to protect the other passengers. It’s up to the driver's discretion. He can help, but he doesn't have to if he feels it would be hazardous to leave the driver's seat." Thomas said Blank boarded the bus at Miss Furnice's stop and argued with the bus driver, but refused to help her get off the bus. About two hours later, several wheelchair-bound persons from the community were waiting at Miss Furnice’s stop, with the intention of boarding the bus also and riding in sympathy with her. Blank said Friday that the bus incident wasn't a planned protest, but that the wrong bus had arrived at least three times before and that this time Atlantis community decided to make a point about the type of bus used “which was bought without our permission." Blank said RTD frequently replaces one type of lift-bus with other, less accessible types, creating potential problems. “We've asked RTD not to use the less-accessible buses, for just this reason," Blank said. “It's not a problem if the driver is sensitive to the needs of the handicapped." Thomas said the lift-buses, while designed to meet some of the needs of the handicapped, never will be able to meet all the needs of everyone. [Headline] Wheelchair-bound stop Trailways bus By Ric Bucher, Staff Writer Claude Holcomb tried to take a 4:15 pm. Trailways bus from the depot on State and C streets to Los Angeles yesterday, but he was not allowed to buy a ticket. There were only two passengers aboard, but Holcomb is confined to a wheelchair. Trailways buses are not accessible to people in wheelchairs. “I have a friend in L.A.,” Holcomb spelled out on a homemade message board he uses to communicate. “I have to fly from L.A. to Hartford, Conn., tomorrow.” Holcomb lives in Hartford. Shortly before the bus was due to depart, Holcomb, 24, along with 11 other members of American Disabled for Accessible Public Transportation (ADAPT), hemmed the bus in with their wheelchairs and refused to move. Police officers arrived at 4:35 p.m. and told the group that they were breaking the law by obstructing traffic and trespassing. The ADAPT members will appear at the American Public Transportation Association's (APTA) meeting this morning. They have been granted 30 minutes to air their plea for both wheelchair-accessible transit buses on both local and interstate lines. Twenty of 29 San Diego Transit bus routes have wheelchair access, but no such equipment is in use on intercity or interstate public buses. Joe Carle, an ADAPT community organizer in Denver, parked his wheelchair in front of the bus and tilted back his black felt cowboy hat. “This may seem like it’s drastic,” he said, “but it’s the only way to open people’s eyes. ... What good is it if a person has to stay in a one-block area?” Similar demonstrations were held recently in Denver and Washington, D.C., in conjunction with scheduled APTA meetings. Carle said the attitude toward the disabled seems to be “we'll do everything we can to keep you alive, but we don’t want you around.” He said ADAPT was specifically focusing on Trailways and Greyhound Bus Lines because they are owned by companies who manufacture their own buses, yet refuse to construct them to accommodate wheelchairs. The bus driver and two passengers, Michael Calloway, 23, and Claude Williams, 26, got off the bus and waited inside the depot. “I think they (the disabled) have the right to board the bus,” Calloway said. Williams nodded his head in agreement. “It throws us off schedule, but I’d like to see something done about it (bus access for the disabled). I don’t think it’s right for them to (delay the bus) but I understand. Sometimes it takes a little push and shove to get things done." Able-bodied Wade Blank organized the group's meeting at the bus station. Blank is one of the six founders of ADAPT. Two years ago, he adopted Heather, a 14-year-old girl confined to a wheelchair, and married her mother. He described the attitude toward the disabled as “just another ‘ism’ — paternalism. It's just like racism and sexism.” After police told the group they were breaking the law, Mike Auberger, spokesman for the wheelchair group, asked to speak with the manager of the terminal, Fred Kroner, who was summoned from his home in Chula Vista. Kroner spoke with Auberger and his group at the door of the bus. He was asked to set up a meeting in Denver with Trailways’ national representatives. “For what?” Kroner asked “To talk about making these buses accessible," said Auberger. Fifteen minutes later, Kroner said he could reach no one, and gave Auberger the phone number of Roger Rydell, vice president in charge of public relations at Trailways’ Dallas headquarters. The group let the bus leave. “I won't be satisfied until these buses are accessible,” Auberger said, “but this is the first step in the process.” - ADAPT (159)

Robert L Keyser Ill. national director of media relations, rejected as “false" and “inappropriate" charges made by a group of wheelchair bound protesters that McDonald's discriminates against the handicapped. “We think we're the leader in the industry in barrier-free accessibility”, but there are always things we can learn, " Keyser said, watching protesters picket the McDonald's Restaurant at 207 N. Wahsatch Ave. As discussed, six weeks ago, he said, McDonald's plans to meet next week with representatives of the Denver-based Access Institute to discuss their concerns. “We want to listen. We also want them to learn a little more about McDonald's because we're committed to the community." Asked about the potential impact of the second protest against McDonald's in as many days on upcoming talks, Keyser said, "It's certainly not a sign of the good faith" in which we’ve been trying to deal with them in Denver." "He suggested "that the group had targeted McDonald's because of its size and visibility. “We clearly think it's not appropriate, but "they've done it, and we're going to speak proudly about our record." Keyser said ‘McDonald's had been striving since the 1960s to meet the needs of the disabled with ramps, drive-through lanes and other special accommodations. Robert Conrad, a protester confined to a wheelchair because of cerebral palsy criticized McDonald's for failing to do more to make their 6,400 restaurants accessible to the disabled. “We've tried to negotiate with McDonald's, but all they want to do is dialogue," he said. - ADAPT (638)

The Dally Sparks Tribune Monday, April 10, 1989 - Vol. 77, No. 236 © 1989 Sparks Tribune Co. 25 cents [Headline] Protesters, police clash at Nugget One demonstrator hurt; 7 in jail begin a hunger strike By Steve Timko - Tribune Staff Seven handicapped-rights advocates sent to the Washoe County jail Sunday night by Sparks Municipal Court Judge Don Gladstone are staging a hunger strike until they are free from jail. And one member of American Disabled for Accessible Public Transit (ADAPT) that protested at John Ascuaga's Nugget Sunday said her knee was broken when a Nugget security officer accidentally hit her leg with a door. Approximately 75 ADAPT members paraded down B Street and converged on the Nugget to protest the American Public Transit Association (APTA) meeting that is continuing through Sunday. The transit association opposes installation of wheelchair lifts on new public buses and the disabled group sought a meeting with its leaders inside the casino to discuss the issue. Nugget employees stood inside the casino doors, refusing to allow access to the ADAPT members. In response, the ADAPT members, most of them in wheelchairs, blocked the entrances to the hotel casino. Meeting organizers said they would meet at 1 p.m. today at Western Village Casino to consider what form of protest, if any, the group should stage today. "We‘ll definitely be taking an action, but we'll be discussing what we're going to do," organizer Stephanie Thomas said. Forty-nine people were arrested Sunday and seven were sent to jail. ADAPT leaders said this morning at the Washoe County jail that the seven being held were staging a hunger strike. Five of the seven pleaded not guilty to misdemeanor charges during their arraignment Sunday night in Sparks Municipal Court for refusing to give information that would allow them to be released on their own recognizance. They have trials set for next Monday. One was cited for contempt of court by Gladstone and sentenced to two days in jail and another was sent to jail until he pays his fine. ADAPT member Beverly Furnice, a cerebral palsy victim, said this morning she is finished protesting after her knee was broken Sunday. Furnice was in her wheelchair near the southeast door on the 11th Street side of the building when a security officer hit her leg, she said. She knew immediately it was broken, Furnice said. “It hurt. I hollered, ‘It hurt my leg. It hurt my leg,'" Furnice said. She went to Sparks Family Hospital where they bandaged her leg, she said. "l'm sorry to hear that," Nugget spokesman Parley Johnson said. “We made every possible effort to ensure the safety of all involved," Johnson said. “However, if we have someone trying to get in, ...and we're trying to get the doors closed, what can I say? The person (trying to get in) is contributing to the problem. "We could not allow the group to come in and disrupt our business and cause problems with our customers," the Nugget spokesman said. “And we have every right to do this." ADAPT protesters are staying at Western Village and took their protest down B Street to the Nugget about 3 p.m. Sparks police made some preliminary arrests and by 5 p.m. all of the ADAPT protesters had moved away from the casino doors. But then at 5:07 p.m.,a phalanx of about a dozen in wheelchairs charged down Nugget Avenue between interstate 80 and the Nugget parking lot and the doors were again barricaded. Just about every Nugget entrance seemed to be blocked at one point or another. ADAPT protester Harlan Hahn of Santa Monica,Calif., was talking to a reporter when Pam Fyock of San Luis Obispo, Calif., who is also confined to a wheelchair, scolded him and other protestors as she left the Nugget. “Just arrest them and haul their ass off," Fyock said of protesters. “They're inconveniencing all of us." After Fyock's comments, however, a transportation association member from Denver said he supported the protestors in their efforts to require more handicapped access to public transportation. “Based on my experience. we don't have problems providing access to the handicapped," said Kevin Sampson of the Denver Regional Transportation Department. “In Chicago, they have hardly any (handicapped access). In Denver, we have almost 600. What the hell is wrong with Chicago?" Sampson said. Hahn, a political science professor at the University of Southern California, compared the handicapped protests to the civil rights protests by the blacks in the 1950s and 1960s against being forced to sit in the back of the bus. "Sparks is the site of a civil rights struggle that began with the Montgomery Boycott," Hahn said. ADAPT protest organizer Stephanie Adams said the Sparks protest has been a little rougher than protests in other cities, citing Furnice's broken knee as one example. "They don't usually handcuff us" when they are arrested, Adams said. Protesters were also pushed and kicked as they tried to enter doors, she said. “Having people serve time for a first offense is not typical," she added. This was the seventh straight year the disabled group had staged a protest at a meeting of the transit group. [Headline] Disabled protesters maintain hunger strike [Subheading] Jailed demonstrators getting care, sheriff says By Susan Voyles/Gazzette-Journal A hunger strike in the Washoe County jail by 22 handicapped prisoners — arrested for obstructing sidewalks while protesting a public Transit meeting in Sparks -— continued Tuesday night, although nine demonstrators broke their fast. Leaders of the American Disabled for Accessible Public Transit (ADAPT) group encouraged jailed protesters to break their fast after Washoe County Sheriff Vince Swinney early Tuesday afternoon promised the inmates more nurses, if needed, and more medical supplies. But Lt. Rod Williams said the hunger strike wasn't over medical treatment. "They're protesting the fact they're here,“ he said, “not the conditions in the jail." The hunger strike began Monday night after 25 people were arrested and jailed in a demonstration against public transit officials meeting at John Ascuaga's Nugget. The meeting concludes today. Five others have been in jail since Sunday night, when ADAPT began a planned four-day protest. They're here to protest the western regional meeting of the American Public Transit Association, which is fighting ADAPT's legal efforts to require all federally funded transit systems to buy buses equipped with wheelchair lifts. Swinney said one female prisoner vowed to continue her fast even though she was warned by a doctor that she'll ultimately go into seizures. Another woman, Diane Coleman of Los Angeles, was released from Washoe Medical Center Tuesday morning after being given liquids intravenously for dehydration. She was taken to the hospital about 3 a.m. Tuesday when she began vomiting. Mike Auberger, organizer of the Denver based group, and Pat Gilbert, his Reno attorney, met with Swinney early Tuesday afternoon to discuss jailed ADAPT members complaints. "People in charge are now in the process of trying to respond to the situation, which they've never been in before," Auberger said at a news conference outside the jail. “It's a lot more positive than it was two hours ago." Swinney said the jail has put 11 nurses to work, nine more than usual. And more nurses and a doctor will be brought in if needed, he said. But he admitted the jail did not have enough medical supplies, such as catheter drainage bags, on hand and had to order more. Normally, the jail sees only about six handicapped prisoners a year. Sparks Municipal Judge Don Gladstone defended the sentences handed down to the protesters. Of the 30 in jail, the majority were sentenced to three days for obstructing sidewalks, fire entrances or a police officer, and given an average fine of $580. On Sunday, only five of 49 people arrested went to jail. Those five pleaded innocent and will have their trials Monday. Gladstone said he warned ADAPT members he'd get tougher on them. "Clearly, everyone was put on notice," he said. "We're not following their rules" Auberger, who was also arrested but paid a fine to get out of jail Monday night, was outraged so many of his people were arrested. "I have been in many cities where I have done civil disobedience and I wasn't arrested," he said. "Maybe it's the politics of Sparks that the city has to respond to what the Nugget wants. it's real clear (Gladstone) was being forced to do what he did." “They don't toss people in jail for blocking sidewalks in most cities," complained Pete Mendoza of Marin County, Calif. "They were researching ordinances to arrest us.“ Gladstone who said he supports the rights the handicapped are seeking, said he is simply doing his job and the demonstrators were amply warned. Among the 50 or so protesters outside the jail Tuesday was Beverly Furnice of Denver, with a thick, fresh bandage around one of her twisted legs. She claims her leg was broken Sunday night when a security guard tried to move her out of a doorway. She was treated at Sparks Family Hospital, but officials would not confirm that her leg was broken. She was arrested after the incident, and said she sat in Sparks Municipal Court for five hours before she was released with a verbal warning. Nugget spokesman Parley Johnson said he's not sure what happened to Furnice. "There was a lot of shoving and pushing going on," he said "If it did happen, I'm very sorry about it." Gladstone said he doubted she broke her leg. He said he and his staff held arraignments until midnight Sunday and were far more inconvenienced than Furnice or anyone else arrested. - ADAPT (458)

[Headline] Court grants transit rehearing In the wake of an often ugly battle with police, hotel security guards and the courts in Reno, wheelchair activists are heading for Philadelphia where the U.S. Court of Appeals has agreed to vacate its Feb. 13 decision to require all new buses purchased with federal funds to be equipped with wheelchair lifts. The case will now be heard by the entire 13-member court rather than the three judges who originally handed down the decision on a 2-l vote. The rehearing was requested by the Department of Transportation and the Department of Justice. Six disabled leaders had met with President Bush in an attempt to persuade him to call off the appeal. Bush didn't give them an answer at the time, said Wade Blank, one of the founders of the radical American Disabled for Accessible Public Transit (ADAPT), "but it's obvious the President has no intention of taking our side." So when the court convenes at 10 a.m. May 15, scores of wheelchair demonstrators will be outside chanting, "We will ride," the battle-cry of the six-year old movement. At press time, demonstrators were planning on arriving in Philadelphia on May 12 and demonstrating in front of the Justice Department there, up to but not including being arrested. "That will come later," Blank said. On Saturday, demonstrators are expected to attempt to board city buses, crawling onto them if necessary, and to otherwise disrupt service until Philadelphia transit officials sign an agreement promising to provide accessible service. Then on Sunday, the day before court opens, demonstrators will don Revolutionary War uniforms and march from Independence Hall to the federal courthouse, led by fife and drum. The movement is at a crossroads, Blank said, pointing out that many of his fellow activists are afraid that the court will reverse its pro-accessibility vote when its decision is made known, 30 to 90 days from now. Many of those activists are reluctant to appeal the decision to the U.S. Supreme Court if they lose in the Court of Appeals, arguing that the high court has a conservative majority, “We might have to wait 20 years before we get a liberal court," Blank said. "Better we find out where we stand with the court right now and then decide on a course of action." ADAPT has had plenty of experience with conservative judges in recent weeks, according to Blank, who said he broke down and cried at the treatment wheelchair defendants received in the Sparks courtroom of judge Don Gladstone. Gladstone told demonstrators that their mass arrests had "tarnished" their cause and suggested that the group needed "new leadership." Blank said Gladstone's courtroom was a zoo. "He locked the doors and screamed at us." Gladstone wasn't the only person in Reno and Sparks who was upset with ADAPT, which was there to protest at a regional meeting of the American Public Transit Association (APTA) as they have done in 16 other cities over the latter group's refusal to endorse mandatory accessibility for all transit systems in the country. The police weren’t very happy, either. Some 72 demonstrators were arrested during the 5-day-long protest, with about half of that number going to jail. City officials estimated that the protest cost local taxpayers at least $116,000. Police estimated their costs of controlling the group at $79,275, while the sheriff's department, which runs the Washoe County jail, placed its costs at about $34,164. Gladstone said municipal court costs will run about $3,000. But it wasn't just the money that bothered city and county officials. "While (the police) are out there handling these individuals and you cal 911, the response times change dramatically,” said Sparks Municipal Court judge Andy Cray. Police Lt. Tony Zamboni said, "We understand these people have certain rights, but they also don't have the right to obstruct other citizens." Sheriff Vince Swinney agreed with Zamboni and also seemed a bit miffed that the media were playing up the plight of the demonstrators. "Somebody should realize this is what these people want to do," he said. "if they were treated like royalty, they wouldn't be happy. And the media is playing it up 100 percent. I really think that we who have been here and will continue to be here deserve some credibility." ADAPT organizer Mike Auberger, 34, of Denver, said that the Washoe County jail was not prepared to deal with housing 30 disabled prisoners, although sheriffs department officials disagreed, saying that extra doctors and nurses were on duty. Twenty-two of the jailed demonstrators staged a hunger strike, including one woman who was warned by a doctor that she would ultimately go into seizures if she participated in the fast. Another demonstrator, Diane Coleman, an attorney from Los Angeles, was taken from the jail at 3 a.m. Tuesday morning when she started vomiting. Coleman was taken to the Washoe Medical Center where she was given liquids intravenously for dehydration. Headline for part 2 of article: Reno protest turns ugly as judge lectures ADAPT ”Get new leaders. ” Blank said that three or four demonstrators had to be hospitalized when they returned home because of inadequate care received at the jail. For example, Auberger was not allowed to empty his leg bag and he went into hyper reflex, according to Blank. “His blood pressure shot up to 300 and nearly blew his head off," Blank said. Unable to place a call to fellow ADAPT members in Sparks, Auberger was forced to call his parents in Indiana to see about getting help. Ultimately, Auberger had to bail himself out of jail in order to get medical treatment. “That's when the police began telling other jailed demonstrators that their leaders were bailing out on them," Blank said. Demonstrators also complained that the police in Reno and Sparks were rougher than the ones they had dealt with in other cities, pointing out that more of them were actually handcuffed than was usually the case. Most of the demonstrations took place outside the Nugget Casino and Hotel, which was serving as APTA's convention headquarters. Some 700 delegates were staying there. Demonstrators attempted to block all the entrances to the hotel to show APTA delegates what it is like not to have access to public institutions, buildings and buses. One demonstrator, Beverly Furnice, said her knee was broken when a Nugget security guard hit her leg as she was wheeling up to the door on the southeast side of the hotel. Nugget spokesperson Parley Johnson said he was sorry to hear about Furnice. “We made every possible effort to ensure the safety of all involved," he said. "However, if we have someone trying to get in, and we're trying to get the doors closed, what can I say? The person (trying to get in) is contributing to the problem. "We could not allow the group to come in and disrupt our business and cause problems with our customers. And we have every right to do this." Judge Gladstone several times commented on how well the hotel staff and police handled the situation. “He's just a front man for the casinos," Blank commented. On the other hand, demonstrators had nothing but praise for Reno's Citifare public transit system, which has already made a commitment toward a 100 percent lift-equipped bus system. All Citifare buses bought since 1984 have lifts, and the system expects its nonaccessible buses to be phased out by 1996. "We're not fighting Reno or any other city," Auberger said. “We're fighting APTA." Less than three weeks later, demonstrators were doing just that again, this time in Denver, where ADAPT was founded in 1983, Some 30 demonstrators were arrested as they protested outside the Radisson Hotel, where the Urban Mass Transit Association (UMTA) was holding a national transportation conference. The next day, April 25, 40 demonstrators, 30 of them in wheelchairs, were forcibly removed from the Federal Building at 9th and Stout by federal officers. Demonstrators were protesting word that the Department of Transportation, of which UMTA is part, had decided to appeal the Court of Appeals decision. "We are tried of winning lawsuits and never getting them implemented," said protester Maureen O'Rourke. UMTA‘s Alfred A. DelliBovi disagreed with the original court decision, saying his agency supports letting each transit provider decide how to handle disabled riders. Earlier Mayor Federico Pena met with ADAPT and reiterated his strong support for their goals, a statement he repeated when he met later with UMTA officials. Pena was responsible for forcing APTA officials to allow ADAPT to address its national convention in Denver in 1983. That is the only time ADAPT members have been allowed inside an APTA convention.
