Tues., April. 7, 1987, The Phoenix Gazette Title: Vice mayor derides disabled group's tactics By Pat Flannery, The Phoenix Gazette Vice Mayor Howard Adams denounced the tactics of a group of wheelchair activists protesting in Phoenix, saying their actions cloud the “tremendous job” the city has done to make public transit accessible to the disabled. The American Disabled for Accessible Public Transit has staged several protests in the city to dramatize its demand that all public transit buses in the nation be equipped with wheelchair lifts. On Monday, about 30 wheelchair-bound protesters blocked two entrances to the Mansion Club in an effort to prevent 40 American Public Transit Association conventioneers’ spouses from attending a luncheon there. The delegation had arrived via a taxpayer-supported Phoenix Transit charter bus. In a later incident at the Hyatt Regency Hotel in downtown Phoenix, police said five protesters were arrested and charged with disorderly conduct. The were: Marilyn Golden, 33, of Oakland, Calif.; Arthur Campbell Jr., 43, of Louisville, Ky.; Kenneth Heard, 36, of Denver; Chris Hronis, 47, of Haywood, Calif.; and Robert Conrad, 38, of Dallas. ADAPT has staged protests in every city in which the APTA - an industry lobbying group — has held a major convention. The APTA is holding its Western regional conference this week at the downtown Hyatt Regency. “Arizona and Phoenix have absolutely nothin to be ashamed of,” Adams, who himself uses a wheelchair, told the editorial board of The Phoenix Gazette and The Arizona Republic Monday. “At this point, disruption doesn't serve the cause," Adams said. The Phoenix Mayor's Committee on Employment of the Handicapped has taken the same position, saying in a position paper that it endorsed the protesters’ goal but not their methods. “The type of demonstration usually conducted by ADAPT serves only to shed a very negative light on a very worthy cause," committee chairwoman Michelle Goldthwaite wrote. APTA has been ADAPT’s primary target since 1982, when APTA successfully fought a federal regulation requiring all city transit systems to equip at least half their buses with lifts to qualify for federal funds. But Adams said the local protests could unfairly malign the city's efforts to meet the needs of the Valley's disabled. "l would hate for the public to think overall that this is aimed at Phoenix," he said. City transit director Richard Thomas said Phoenix is doing “reasonably well" to accommodate the needs of the disabled through a mix of lift-equipped buses, “dial-a-ride” vehicles and an experimental program in which private transportation for the disabled is subsidized by the city. - ADAPT (149)
The Washington Post: AROUND THE REGION, November 1st, 1984 [Headline] Disabled Protesters Block Bus at Transit Meeting Site About 15 handicapped protesters, most of them in wheelchairs, blocked a chartered bus in front of the Washington Hilton Hotel yesterday, the site of an American Public Transit Association convention, to protest the lack of access for handicapped persons to buses nationwide. The hour-long demonstration was the second staged here in the past four days by a group called the American Disabled for the Accessible Public Transit. On Thursday, a dozen protesters stopped rush-hour traffic in front of the White House by blocking seven Metrobuses. Yesterday, the protesters encircled a charter bus that was to take about 50 spouses of conventioneers on a tour of the city, according to convention speaker Albert Engelken. He said that the bus remained in front of the hotel's T Street NW entrance for about an hour while police negotiated with demonstrators. About 2 p.m., the riders disembarked and went back into the hotel. Engelken said. He said the demonstrators dispersed soon afterward. - ADAPT (344)
Cheyenne Tribune 9/27/87 Title: Disabled to Protest for Public Transit Access SAN FRANCISCO (UPI) - Hundreds of disabled activists say they will demonstrate for more access to public transportation during the American Public Transit Association's four-day meeting, which starts Sunday. Organizers of the protests, aimed at making a point to 4,000 delegates from 400 public transit systems, expected more than 600 handicapped and disabled people from all over the country to participate. Groups including the September Alliance for Accessible Transit have been trying for years to get the APTA, the nation’s public transit lobbying arm, to declare a national policy giving disabled people the same access to buses and trains as able commuters. “If it were women or blacks who couldn't get on the bus, it would clearly be a civil rights issue," said Kitty Cone of the Berkeley, Calif., group. Her organization and Denver-based American Disabled for Accessible Public Transit threaten to block city streets, hotel lobbies and entrances to the Moscone Convention Center to show delegates how it feels to be denied access. Some demonstrators also promised to invade banquets and cocktail parties attended by delegates. “We are not going to allow these people to have a good meal,” said Bill Bolte of the Denver organization. He was arrested earlier this year for a demonstration at a transit meeting in Phoenix. The transit group's policy is that questions of access should be left to local transit districts. “Mainstream access may work well in the Bay Area but don't tell systems in Akron, Ohio, or Buffalo, N.Y., that they have to do the same thing,” said Jack Gilstrap, executive vice president of the association. He said many systems in smaller areas cannot afford to renovate buses and trains or to purchase new vehicles, so have chosen to provide door-to-door van service for the disabled. He also said that protests or no protests, no major policy changes were expected to be adopted during the meeting. Federal regulations approved in 1986 give local agencies the option of using mainstream or so-called paratransit services, such as the door-to-door vans. - ADAPT (356)
Handicapped Coloradan October 1987 Title: 123 arrested in San Francisco ADAPT blocks cable cars For years San Francisco area disabled rights activists chose to look the other way as that city's historic cable cars transported tourists and locals up and down the steep hills in cars inaccessible to persons in wheelchairs. And then ADAPT (the American Disabled for Accessible Public Transit) hit town. On Tuesday, Sept. 29, scores of wheelchair militants dodged police barricades and, hauled their wheelchairs onto the cable car turntable at Market Street. Protesters managed to prevent the cable cars from moving for more than two hours until police cut the chains they were using to attach their wheelchairs to the turntable. Of the 75 protesters arrested on the spot, 43 were booked and spent the night on cots in the county prison gymnasium on the seventh floor of the Hall of Justice. Outside the hall, 80 persons in wheelchairs maintained a candlelight vigil throughout the night. Many tourists were upset with the protesters, yelling at them that they were ruining their vacation. Protesters replied that the tourists' inconvenience would last only a few hours, while they faced a lifetime of inaccessible public transportation. ADAPT was in San Francisco to make just that point to the several thousand delegates attending the national convention of the American Public Transit Association (APTA), a trade group which represents most of the country's transit providers. Some 123 demonstrators were arrested during the San Francisco protest. "Every year it's a new record for the Guinness book," said Wade Blank, one of ADAPT's founders. Many of the other arrests took place as wheelchair activists blocked buses and streets to prevent APTA delegates from attending social functions outside the convention hall. A highlight of the week-long action was a Sunday parade when more than 500 demonstrators formed an eight-block-long river of wheelchairs. "It's got to be one of the most moving and impressive sights I've ever witnessed," Blank said. San Francisco police complimented the demonstrators on their organizational abilities, according to Blank. "We couldn't have done this a few years ago," he said. Blank said one of the highlights of the week for him was when police stopped APTA's executive director Jack Gilstrap from climbing over a fence to avoid a confrontation with the demonstrators. - ADAPT (225)

Scores of wheelchair-bound disabled persons, dramatizing their cry for nationwide accessibility to all public transit, clogged downtown Long Beach traffic for more than five hours Wednesday. The protesters parked their wheelchairs in front of and behind buses in the downtown area, in some cases holding the buses hostage for several hours, until police removed them. Police issued 33 misdemeanor citations for failure to disperse, made three arrests for failure to disperse and 13 arrests for trespassing and issued two traffic citations. All those arrested were later released on their own recognizance. Of those arrested and cited, all except 12 were wheelchair-bound. As many as six buses were out of business at one point in the episode. Bus driver Teresa Estrada said she had been sitting in her bus for more than three hours. Some protesters, members of ADAPT, American Disabled for Accessible Public Transit, were arrested when they blocked the entrance and some offices of Long Beach Transit at Anaheim Street and Gardenia Avenue. The stalled hostage buses, along with police vehicles, slowed traffic to a crawl on Long Beach Boulevard and Pine Avenue, generally south of Fifth Street. Cross traffic filled intersections in the same area, creating a gridlock that required officers to set out flares and hand-direct vehicles. Some of the ambulatory handicapped people kept scouting new locations for intercepting buses. At a signal, several in wheelchairs would follow the point crew and stake out the new site. Title: 25 arrested in downtown demonstration by Ron Charles Montreal Daily News MUC police arrested 25 wheelchair-bound demonstrators last night after they forced their way into the lobby of the Sheraton Centre in downtown Montreal. The demonstrators were protesting the American Public Transit Association's (APTA) reluctance to endorse wheelchair lifts on new buses. They crashed their wheelchairs through a luggage-cart barrier hotel employees had built in an attempt to ward off the protesters. [Subheading] Came along When APTA, a Washington-based transit authority organization, brought its annual conference to Montreal this week, the protesters came along as part of the ticket. The demonstrators, from a group called American Disabled for Accessible Public Transit (ADAPT), have been protesting at APTA conferences for eight years. Only a few members of a local disabled rights group took part in the demonstrations — the rest were from the U.S. Police said all those arrested — who are expected to be charged with assault — were American citizens, many of them Vietnam veterans. About 50 MUC police officers showed up to clear the Sheraton's marble-covered lobby after the protesters, singing "we want to ride," blocked elevators and escalators. Police wheeled the demonstrators one by one to a waiting wheel-chair bus being used as a paddy wagon. Police snipped chains linking protesters Mike Auberger and Bob Kafka's wheelchairs to a handrail in the lobby. Although the APTA conference is taking place at the Queen Elizabeth Hotel, some of the 3,000 attendees are staying at the Sheraton. Earlier in the day, police turned the Queen Elizabeth into a fortress with metal street barriers as about 75 demonstrators wheeled toward the APTA conference headquarters. They blocked traffic in both directions on Dorchester for more than two hours as police tried to pen the group in with the barriers. Police took two protesters who had crashed the barriers out of their chairs in order to lift them and their chairs over the barriers. [Subheading] Took chair "The police took his chair away, separated him from his legs," said Lori Taylor as she watched from the side-walk when police lifted her husband, Lester, over the barrier. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Bill Bolte, who started ADAPT's Los Angeles chapter, said police overreacted to the demonstration. "This really confuses me because I know that after the Canadians (hockey team) won the Stanley Cup, all types of terrible activity went on," said Bolte. "People overturned cars while everyone, including the police, just looked the other way and went and had a cup of coffee." Several demonstrators who broke through the police perimeter smashed their chairs into barriers in front of the hotel entrance, but hotel security and police stood their ground. Police arrested some 25 wheelchair demonstrators after they forced their way into the lobby of the Sheraton Centre. They were protesting the American public transit association’s reluctance to endorse wheelchair lifts on new buses. Adams Crosscurrents Title: Pretenders to the Civil Rights movement The attempts of minorities of all stripes to identify with the black experience in America to gain even legitimate goals strike me as being a deception and a fraud. It also trivializes the dehumanization the blacks suffered at the hands of the white majority for 350 years. Only one group was brought to this country in chains, treated like animals, sold on the block like livestock, forced to live in shanties and valued only for the labor they could produce. And even after being freed from the shackles of slavery, blacks were denied their civil rights for another 100 years. No other group in this country has had to suffer those indignities. Yet minorities as diverse as militant feminists, homosexuals and the handicapped hoist the banner of oppression and try to do a black face routine as farcical as the old showboat acts on the Mississippi of the last century. The wheelchair protests staged by the Denver-based American Disabled for Accessible Public Transit (ADAPT) here last month are only the latest examples of groups with gripes trying to piggyback on the black civil rights struggle. Let us all agree that more needs to be done to make sure the disabled among us can get where they want to go. And there obviously are cities doing more than Cincinnati to make public transportation accessible. Denver is one. But that is begging the question. Cincinnati is not Denver. Queen City Metro is strapped for funds. It cannot provide all the service it would like for the handicapped—or even the able-bodied. But the issue is money, not civil rights. Determined to get arrested, the wheelchair protesters blocked the Westin hotel entrances, grabbed onto the wheel well of buses to keep them from moving, and one wacko with a death wish even rolled into the path of a bus going 40 mph. Bob Kafka, one of the 14 arrested—and given special treatment at the Hamilton County Justice Center—wrote a letter to The Post that began: “I am writing this letter from the Hamilton County Jail, in which I am spending Memorial Day, for the crime of trying to ride public transportation." Kafka's emotional appeal falls flat. (He obviously was trying to imitate Dr. Martin Luther King Jr., whose famous “Letter from the Birmingham Jail" stirred the conscience of a nation.) Kafka's crime was not that of trying to ride public transportation. He was charged with disorderly conduct for crawling aboard a bus, dragging his wheelchair, dropping 50 cents in the fare box and then demanding to ride - knowing full well the bus could not move with him on it. But Kafka, in his letter, attempts to equate the problems of the handicapped with those of blacks who were forced to ride in the back of the bus: “Those in power have decided to oppress us and make sure disabled people do not ‘step out of line’ and assert their rights," Kafka wrote. “Queen City Metro decided they were going to keep disabled people in their place.” By couching his complaint in vintage 1960s language, Kafka confuses the issue. The disabled should be heard. But they should give rational reasons for their demands for equal access to public transportation and not try posing as an oppressed minority that dares not “step out of line." I didn't see any cattle prods or police dogs used to quell the demonstrations. After the protesters had left town, Council Member David Mann had pangs of conscience that caused him to make some of the silliest statements in the annals of Mann. “It seems to me that every human being in Cincinnati — visitors, handicapped or otherwise — had the absolute right to enter the Fountain Square South complex on equal terms," Mann wrote, as if he had been living in a cave during the four-day wheelchair protests. “If you and I were free to move unfettered into the public areas of the Westin, then those who happen to move by wheelchair should have been treated precisely the same." I know philosophers have struggled for centuries to define reality. After reading Mann’s views on what took place in front of the Westin, I can understand why. His perceptions are unreal. Those who happened to “move by wheelchair” were not treated precisely the same as others because they were intentionally trying to block the entrances and disrupt bus service. That's called breaking the law. It seems to me that even a council member from Clifton, who happens to be a lawyer, should be able to make that distinction. The restrictions were not based on class discrimination. Rather, they were triggered by those misguided handicapped persons who believe they can gain greater access to public places by denying that right to others. The wheelchair protesters would have scored more points with the public by shunning crazy antics and making their appeal in a sane manner. I think it revealing that the Greater Cincinnati Coalition of People With Disabilities refused to participate in the public demonstrations. The coalition leaders believe they can accomplish more by talking with local city and bus officials than by trying to disrupt traffic. They certainly will gain more public sympathy. [Headline] "We Will Ride" [Subheading] Disabled Protesters Clash with Transit Authorities National Group Fights for Accessible Transit Disclosure Jan-Feb, 1989 [This article continues on ADAPT 420 but the entire text is included here for easier reading.] "These protests are the continuation of an ongoing assault," says Stephanie Thomas of American Disabled for Accessible Public Transit (ADAPT). In October, ADAPT disrupted the annual convention of the American Public Transit Authority (APTA) in Montreal with a series of protests. "We want all buses to be made accessible to disabled people," says Stephanie Thomas, who lives in Austin, Texas. "And we will continue these confrontations until that happens!" ADAPT is getting closer and closer to that goal. Last year, a task force created by APTA proposed lifts on all new buses. Nevertheless, at the Board of Directors' meeting in Montreal in October, APTA reaffirmed its current policy on transportation for disabled persons. In many cities, transportation for disabled persons means some kind of a pickup service. "It's a segregated system," says Stephanie Thomas, "and it never works out as well as it sounds. Riding public transportation is a civil right." For this civil right, ADAPT turns to civil disobedience. ADAPT has become such a force at APTA conventions that local police now prepare in advance for the group's demonstrations. In Montreal, police watched videos of ADAPT demonstrations in the U.S. and 100 police were put through a day-long training session on how to deal with the anticipated protests. But that didn't stop the ADAPT protesters, who continue to fight tenaciously for accessible transit. The four day series of actions in Montreal began on Sunday, October 1st. Despite a torrential downpour and near freezing temperatures, 120 members of ADAPT marched down Boulevard Rene Levesque to the Hotel Queen Elizabeth, APTA's 1988 convention site. ADAPT protesters were joined by representatives of their local counterpart — Le Mouvement des Consommateurs Handicapes de Quebec (MCHQ) or the Movement of Disabled Consumers of Quebec. ADAPT members swarmed across the road to enter the hotel, despite at least a one-to-one ratio of police to protesters. Even as a wall of police barricades was hastily erected, protesters climbed down from their chairs and crawled under the barriers. They were carried back by the police, but no arrests were made. That evening ADAPT took a more undercover approach. "No small feat for over 100 wheelchairs," commented Stephanie Thomas. Sneaking through back alleys and a back door, 15 people in wheelchairs were carried down a flight of stairs into one of the satellite hotels in which APTA members were staying. Meanwhile, two other `groups` converged on the front door using their wheelchairs to push aside makeshift barriers of luggage carts. Singing and chanting, ADAPT took over the lobby — blocking elevators, escalators, and stairs as APTA members looked on in shock, Finally, the police selectively arrested 28 of the demonstrators, including two who had chained themselves to the stairway. That night, a judge sentenced members of the group to a $50 fine, to be paid on the spot, or they would be faced with three days in jail, with a probation banning those arrested from entering downtown Montreal for six months. Twenty of the group refused to pay the fine and went to prison. Nevertheless, this put no damper on ADAPT's actions. Next hit: the APTA Spouses' Luncheon and Fashion Show, a favorite ADAPT target. The luncheon was held at a chalet atop Mount Royal on Mon-day, October 3. Ten more ADAPT members were arrested, as the APTA buses were stopped and the spouses were forced to walk past chanting demonstrators. On Monday night, October 3, 20 wheelchair users penetrated the Queen Elizabeth Hotel through an underground shopping area. 7 year old Jennifer Keelan, who uses a wheelchair, and her mother, were taken into custody and threatened with arrest, but were later let go. Meanwhile, in two Montreal prisons, the system was showing its inability to deal with severely disabled inmates. The ADAPT inmates were on a hunger strike. Officials decided that, due to good behavior, everyone would be out by Tuesday morning. ADAPT swung into the final phase of operation Tuesday morning. As requested by MCHQ, it was time to hit the local transit system — which is completely inaccessible to people with mobility impairments. Buses were stopped for an hour at a local bus transfer site, while a local woman crawled from her wheelchair aboard a bus and tried unsuccessfully to ride. "We are sorry for the inconvenience, but we are inconvenienced all our lives," said Wade Blank of ADAPT to the crowd. Blank is the founder of ADAPT. On Wednesday, October 5, ADAPT entered the Longueuil METRO subway station and once again tried to ride. The station had no ramps or elevators, and narrow turnstyles. 50 ADAPT members sang and chanted in the cavernous station — and cheered as 15 others crawled out of their wheelchairs, down the steps, and across the floor to the turnstyles where police blocked their passage. From the dirty platform floor, ADAPT held a press conference. We explained our simple desire to use the public transit that our taxes pay for," says Stephanie Thomas. "Lack of access is degrading for people with disabilities." The pressure on APTA is clearly mounting. APTA is now considering a resolution which strongly supports mainline transit access — ADAPT's demand from the start. In addition, Le Mouvement des Consommateurs Handicapes de Quebec has learned first hand the effectiveness of direct action techniques and has vowed to continue the pressure locally in Montreal. Rocky Mountain News 8/5/83 RTD proposes bus changes for disabled By Tony Pugh, Rocky Mountain News Staff Writer The Regional Transportation District, in an open forum with handicapped citizens Thursday, introduced changes designed to make buses more accessible for disabled riders. Mike Smith, director of transit operations, outlined the proposed improvements, which include a new material to improve traction on bus wheelchair lifts and a metal “kickplate,” designed to minimize wear on lifts from hitting curbs. A new rotary control panel, said to be easier for drivers to operate, and a new lift wiring system also were introduced. Although many people in the attendance voiced displeasure with bus driver insensitivity and mechanical failure of the lifts, others expressed gratitude to RTD for its efforts in accommodating handicapped riders. Bill West, chairman of RTD’s handicapped advisory council, said he is reasonably pleased with RTD officials’ commitment to the disabled community. “I think they’re committed to making the best of what they’ve been mandated to do, but I believe they have a tendency to focus more on the lifts rather than better driver training,” West said. Larry Ruiz, 29, typified the problems encountered by handicapped riders. Earlier this week, he was passed up by four buses as he waited at a stop outside Colorado General Hospital, said Ruiz, who is confined to a wheelchair. The first bus had no lift, the next two buses had lifts, but the drivers did not know how to operate them. After waiting more than two hours, the driver of the fourth bus called a HandyRide disabled vehicle which took Ruiz home. But that lift malfunctioned, Ruiz said. He had to be removed manually. This gathering was a forerunner to a meeting in late October between the American Public Transit Association and the newly formed American Disabled for Accessible Public Transit. Los Angles Times Part 1/Saturday, October 5, 1985 page 22 [Headline] Disabled Vow to Parade Despite Denial of Permit By John Kendall, Times Staff Writer Despite denial of a city permit, wheelchair-bound members of organizations for the disabled say they are resolved to parade along Wilshire Boulevard on Sunday to demonstrate at a downtown meeting of the American Public Transit Assn. Barry Atwood, chairman of Access Now, told reporters Friday that he expects 300 to 500 gravely disabled people to gather at MacArthur Park at noon and illegally parade to the Westin Bonaventure Hotel to protest what he charged is the association's refusal to support accessible public transportation for the disabled. In anticipation, the Los Angeles Police Department issued a three-page background statement pledging that those who “persist in violating the law will be arrested." Specially equipped vans and trained medical personnel will be used if arrests are made, the statement said. Atwood appeared before the Police Commission on Tuesday to request a parade permit. According to police, the verbal request was denied because of the lateness of the bid and because of the lack of police and other city personnel “to protect marchers or traveling public due to prior commitments of resources." During the hearing, Atwood was questioned about tactics employed by the American Disabled for Accessible Public Transit (ADAPT) in other anti-transit association demonstrations in San Antonio, Denver, Chicago and Washington. The tactics included blocking intersections and buses, chaining wheelchairs together and handicapped protesters throwing themselves from their wheelchairs to the ground. Atwood, who said he is not a member of ADAPT, told reporters that he was asked by police commissioners to promise that similar demonstrations would not occur in Los Angeles. He said he told the panel he could make no such promise. Atwood charged that Police Chief Daryl F. Gates threatened to arrest demonstrators Sunday “to intimidate disabled citizens and to ensure that they remain silent, impassive non-participants in society." Sgt. Ralph Hubbard, who heads the Police Department's special events planning unit, said Atwood’s charge is “absolute nonsense. . . . It’s simply untrue. Title: Disabled arrested in SF protest By Donna Hemmila Staff writer SAN FRANCISCO — Protesters in wheelchairs, chanting "If you can take us to jail, take us to work," were arrested Sunday at City Hall where they disrupted the opening of a national public transit convention. More than 35 disabled people were hauled into special wheelchair-lift equipped vans on charges of disturbing the peace. Groups of demonstrators blocked the entrance to the City Hall rotunda where delegates from the American Public Transit Association kicked off a five-day convention Sunday. As San Francisco police officers pushed the wheelchairs into the waiting vans, other wheelchair riders parked in front of the vans to keep them from driving away. Captain Michael Pera said the demonstrators would be given citations at the Hall of Justice and released. "The situation was getting out of hand," Pera said. "My understanding was by the demeanor of the crowd, they wanted to be arrested." More than 150 disabled protesters and their families had marched from an afternoon rally at Union Square. The parade of wheelchairs had stopped traffic on downtown streets and demonstrated in front of the Hilton Hotel on Powell Street, where convention delegates are staying. The five-day transit convention is expected to bring nearly 15,000 representatives from transit agencies across the United States to the Bay Area. Disabled organizers have vowed to disrupt the convention, being held at the Moscone Center, to call attention to the transit organization's policy on access for disabled people. Disabled organizers say the APTA is responsible for weakening federal laws that require public transit agencies to equip their buses and subways to carry disabled passengers. A successful lawsuit brought by APTA changed federal law to give local transit agencies the right to decide what type of accessible transit to provide. Many transit districts have chosen to carry wheelchair passengers in dial-a-ride-type vans rather than equip their regular buses with wheelchair lifts. Members of the American Disabled for Public Transit and the September Alliance for Accessibility are demanding to ride the same public transit system that able-bodied passengers use. At the rally in Union Square, the protesters heard pledges of support from Lt. Gov. Leo McCarthy, feminist Eleanor Smeal, the Rev. Cecil Williams from Glide Memorial Church in San Francisco and labor leader Jack Henning. During the rally the protesters chanted curses against APTA and waved signs with slogans such as "No Taxation without Transportation." The songs and chants were punctuated with the clanging bells of passing cable cars, a San Francisco attraction none of the wheelchair riders can board because the cars lack lifts. McCarthy said he backed the disabled community in its fight for independence. Many disabled rely on public transit to go to work and are being denied opportunities because they don't have transportation, he said. "There is no footnote to the Constitution that says everybody gets these civil rights except the disabled," McCarthy said. Disabled speakers fanned the crowd's anger with accounts of their morning meetings with APTA representatives at the Hilton Hotel. Disabled representatives said the wheelchair-accessible door to the hotel was barricaded and they were told to exit through the garage. "The backdoor entrance went out in the '60s with the civil rights movement," said Judy Heumann, of the September Alliance. "We're not going to go through the back door anymore." Albert Engelken, deputy executive director of APTA, denied his organization had ordered the hotel barricaded. "This is not a happy situation," Engelken said as he watched wheelchair users demonstrating on the streets below from the fourth floor window of the Hilton. "Obviously it's a sore spot. Nobody likes this." APTA's executive board has agreed to set up a task force to study their policy, but Engelken said the organization is not ashamed of its stand on disabled access. Only California and Michigan have laws that mandate full accessibility on public buses and rail systems. "You folks in California chose Artie you want and APIA thinks that's great," Englenken said. "We just wonder if the people in California should be telling the rest of us what to do." APTA has estimated it would cost $13 billion to make every public transit system in the United States accessible to the disabled. No. 224 @ 1989 Sparks Tribune Co [Headline] Protesters plan to disrupt convention By Faith Bremner Tribune Staff A national handicapped rights group says it will take over downtown Sparks next month and commit acts of civil disobedience to draw public attention to handicapped accessible public transportation. But American Disabled for Accessible Public Transportation's (ADAPT) specific target will be the American Public Transportation Association (APTA) convention at John Ascuaga's Nugget April 9-13. In 1980, APTA successfully lobbied the federal government to drop a requirement that all public transportation systems that receive federal funds must purchase buses with wheelchair lifts, ADAPT co-founder Mike Auberger said. APTA represents about 450 transit authorities in the United States and Canada, including Citifare which is hosting the convention. "Everything we do will be centered around transportation,” Auberger said in a telephone interview this morning from ADAPT's Denver, Colo. headquarters. “That's the only reason “we're coming to Sparks; We‘re not coming to the city just to inconvenience Sparks.” Auberger said he expected about 150 ADAPT members from all over the country to show up during the convention and do things like chain themselves to city buses and block the entrances to the Nugget. Sparks Police Department spokesman Tony Zamboni said the department is aware of the convention and of ADAPT's plans to protest. He said Sparks Police are in contact with other police agencies around the country that have dealt with the group. "We are here to provide a service and we will protect these person's first amendment rights as well as anyone else‘s," Zamboni said. "We are prepared for the outcome of any situation such as this.“ Sue Hyde, marketing manager for the Regional Transportation Commission which oversees the Citifare operations, said her agency does not plan to change its operations during the convention. Seventy percent of Citifare‘s buses are already equipped with wheelchair lifts and plans to purchase more, she said. Most of the buses that come into downtown Sparks have the lifts, but some of them don’t, she said. “I don't think Citifare should have any problems," Hyde said. "If they block our buses they would be hurting their constituency." Since it was founded six years ago, ADAPT members have experienced 1,000 arrests — all at APTA conventions, Auberger said. "It‘s a varied group, we're all very experienced." Auberger said. "The majority of the people have gone to jail a number of times and stayed in jail for a week at a time. "This is not a group that's afraid of the police. These people are willing to go to jail to make a point." The point to all the demonstrations, Auberger said, is to make life difficult and inaccessible to the APTA conventioneers, just like it is for people in wheelchairs who can't get onto buses. The organization also uses its demonstrations to make the public think about handicapped access to public transportation, Auberger said, even if the public reacts negatively to ADAPT's methods. "(The public) doesn't have to like what we do or support what we do but it‘s important for them to think about the issue,“ Auberger said. It‘s not easy to arrest someone in a wheelchair, Auberger admits. "We've had cases where people were taken out of their wheelchairs and their chairs were left behind" Auberger said. “If the police don't have a van with a lift, they sometimes lift the chairs right into the paddy wagons. Swinney said 30 people serving three-day sentences are only drinking water but won't take any meals. About 75 members of a national group calling itself The American Disabled for Accessible Public Transit have been demonstrating outside the Sparks Nugget, where the American Public Transit Association is holding its regional meeting. The protesters contend the transit association is not doing enough to make it easier for people in wheelchairs to gain access to public transportation. Swinney said he realizes the handicapped face a number of barriers, but called the demands the demonstrators are putting on the sheriffs office, on police and on the courts an “inappropriate use of the criminal justice system to educate the public to what is a public problem." He said he doesn't know how much the overtime and extra staffing is going to cost Sparks and the county. Swinney and the jail were to have been the target of a Tuesday news conference called by protest organizer Mike Auberger of Denver, who earlier said the jailed demonstrators had not received proper medical treatment. But Auberger said most of the problems at the jail were worked out in a two-hour conference with officials. Swinney said the jail has brought in an extra doctor with expertise in helping handicapped patients and has called for additional nurses who can work with the handicapped. Meanwhile, Swinney said the inmates' hunger strike is causing him concern over one of the prisoners, a woman with a history of seizures brought on by a chemical imbalance when she doesn't eat. The sheriff said most of the protesters are serving their three days in regular cells or the infirmary because the jail has only two cells for the handicapped. Forty-nine people were arrested Sunday and while most were not fined or jailed, they were told not to get arrested again. Those who were among the 25 arrested on Monday received sentences and fines of $265 to $315 in exchange for their guilty pleas. end of article 1 Reno Gazette-Journal Thursday, April 13, 1989 [Headline] Most handicapped protesters decide to remain in jail By Susan Voyles/Gazette-Journal Sparks Municipal Judge Don Gladstone late Wednesday offered to release 30 jailed handicapped protesters if they pay $100 of their fins and promise to pay the rest later. Two accepted the offer, but Mike Auberger, leader of the American Disabled for Accessible Public Transit (ADAPT), said he doubts many other members of his group will. The prisoners are entering their third day of a hunger strike in the Washoe County jail today in protest of sentences by Gladstone they claim are too harsh. The 30 protesters were arrested in demonstrations held on Sunday and Monday against the American Public Transit Association, which ended its western regional meeting at John Ascuaga‘s Nugget on Wednesday. ADAPT is picketing the transit group because many of its members operate public bus systems that do not have lifts for wheelchairs. Of the 30, 27 pleaded guilty or no contest to charges of obstructing sidewalks and fire entrances. Most of them were sentenced to three days in jail, which would end today or tomorrow, and given $580 in fines. Gladstone said he will allow them to pay $100 in fines each if they promise to pay the rest later in installments or do community service work in their home towns. Auberger said his group has only $500 to pay the $3,200 in fines needed to release the group. Those arrested would have to sit in jail for another 23 days in order to pay off their fines, which are reduced at a rate of $25 a day. "But I wouldn't be surprised if they say they'll serve the days rather than give them any money," Auberger said. Auberger and others said Sparks is the only city where the handicapped demonstrators have been jailed for such offenses as obstructing sidewalks. Pat Gilbert, a Reno attorney, was to meet with the 30 protesters Wednesday night to see what they want to do. Gladstone was prepared to hold hearings in the jail to begin releasing them. Two people already have been released for medical reasons after receiving treatment at local hospitals, and one woman, still in jail, is having up to 80 seizures a day, Auberger said. Washoe County Sheriff Vince Swinney declined to comment on the condition of the prisoners Wednesday, saying it only provides more fuel for the media to publicize their plight. However, several officers said the jail now has two doctors and ll nurses on duty, two more than were on Tuesday and nine more than the number of nurses usually assigned to the jail. In an initial court hearing, Gladstone lectured the demonstrators, saying their mass arrests have “tarnished” their cause. “I think you need new leadership" he said. After the hearing Wednesday, Auberger and a band of about 20 demonstrators peacefully protested in front of the Nugget, making a final stand against the transit association. Auberger said most of those who aren't in jail will be leaving town today, although a few will stay to help those in jail. Sparks police say it will take at least a week and half to determine the overtime and other expenses incurred because of the demonstrators. Jerry Peltier, a transit association board member from Richland, Wash., said the protest had no impact on the 500 member group. Parley Johnson, spokesman for the Nugget, said the demonstration cost the Nugget extra money for security guards. He also said business at the Nugget slowed the last few days.
