History and Mission Independent Living for People with Disabilities [This brochure continues in ADAPT 33, but the entire text is included here for easier reading.] PHOTO by Tom Olin (bottom right): A man (George Roberts) in wheelchair raises the power fist with his right hand. Atlantis was founded in 1975, the second “Independent Living Center” in the country after Berkeley. A group of young disabled adults and six concerned staff from a Denver nursing home concluded that no amount of outings to concerts or bingo games could normalize life for these young people. The real solution was to move into the community, in apartments within the city’s neighborhoods, to create self-determined lifestyles where the disabled clients choose their own food, direct their own care, and determine their own priorities. This was a revolutionary concept in 1975, but the people of Atlantis were able to convince the State Legislature to fund personal care assistance outside an institutional setting for the very first time. In the more than fifteen years since its founding, the agency has been able to assist over 400 disabled adults in moving from sheltered settings and maintaining independent lives. The Atlantis Community staff specializes in assistance for very severely, multiply-disabled people, carrying out our belief that any disabled person can live outside an institution, if s/he is willing to accept the risks and inconveniences in order to enjoy self-determination and liberty. To that end, the staff and clients are experts in helping with everything from finding an apartment to applying for benefits, from grocery shopping to weddings, from cooking training to camping trips. The assistance with daily living activities and the basic skills training and reinforcement offered are complemented by the trained and state-certified staff of home health aides and their supervisors who visit the clients at home as often as needed — usually several times a day. The people of Atlantis also offer other independent living services to people throughout the nation — ranging from information and referral services to assertiveness training and technical assistance. The city of Denver and the Atlantis Community have become a mecca for disabled people seeking an accessible environment and comprehensive services. [Headline] Wheelchair-bound stop Trailways bus By Ric Bucher, Staff Writer Claude Holcomb tried to take a 4:15 pm. Trailways bus from the depot on State and C streets to Los Angeles yesterday, but he was not allowed to buy a ticket. There were only two passengers aboard, but Holcomb is confined to a wheelchair. Trailways buses are not accessible to people in wheelchairs. “I have a friend in L.A.,” Holcomb spelled out on a homemade message board he uses to communicate. “I have to fly from L.A. to Hartford, Conn., tomorrow.” Holcomb lives in Hartford. Shortly before the bus was due to depart, Holcomb, 24, along with 11 other members of American Disabled for Accessible Public Transportation (ADAPT), hemmed the bus in with their wheelchairs and refused to move. Police officers arrived at 4:35 p.m. and told the group that they were breaking the law by obstructing traffic and trespassing. The ADAPT members will appear at the American Public Transportation Association's (APTA) meeting this morning. They have been granted 30 minutes to air their plea for both wheelchair-accessible transit buses on both local and interstate lines. Twenty of 29 San Diego Transit bus routes have wheelchair access, but no such equipment is in use on intercity or interstate public buses. Joe Carle, an ADAPT community organizer in Denver, parked his wheelchair in front of the bus and tilted back his black felt cowboy hat. “This may seem like it’s drastic,” he said, “but it’s the only way to open people’s eyes. ... What good is it if a person has to stay in a one-block area?” Similar demonstrations were held recently in Denver and Washington, D.C., in conjunction with scheduled APTA meetings. Carle said the attitude toward the disabled seems to be “we'll do everything we can to keep you alive, but we don’t want you around.” He said ADAPT was specifically focusing on Trailways and Greyhound Bus Lines because they are owned by companies who manufacture their own buses, yet refuse to construct them to accommodate wheelchairs. The bus driver and two passengers, Michael Calloway, 23, and Claude Williams, 26, got off the bus and waited inside the depot. “I think they (the disabled) have the right to board the bus,” Calloway said. Williams nodded his head in agreement. “It throws us off schedule, but I’d like to see something done about it (bus access for the disabled). I don’t think it’s right for them to (delay the bus) but I understand. Sometimes it takes a little push and shove to get things done." Able-bodied Wade Blank organized the group's meeting at the bus station. Blank is one of the six founders of ADAPT. Two years ago, he adopted Heather, a 14-year-old girl confined to a wheelchair, and married her mother. He described the attitude toward the disabled as “just another ‘ism’ — paternalism. It's just like racism and sexism.” After police told the group they were breaking the law, Mike Auberger, spokesman for the wheelchair group, asked to speak with the manager of the terminal, Fred Kroner, who was summoned from his home in Chula Vista. Kroner spoke with Auberger and his group at the door of the bus. He was asked to set up a meeting in Denver with Trailways’ national representatives. “For what?” Kroner asked “To talk about making these buses accessible," said Auberger. Fifteen minutes later, Kroner said he could reach no one, and gave Auberger the phone number of Roger Rydell, vice president in charge of public relations at Trailways’ Dallas headquarters. The group let the bus leave. “I won't be satisfied until these buses are accessible,” Auberger said, “but this is the first step in the process.” - ADAPT (192)

[Headline] 7 Arrested as Handicapped Protest at Fast-Food Outlet By Jim Kirksey Denver Post Staff Writer Denver police arrested seven persons – six of them handicapped – during a demonstration at a near-downtown Denver McDonald’s Restaurant Thursday. Wheelchair-bound demonstrators from Denver’s Atlantis Community Inc., which represents disabled people in the area, blocked entrances to the parking lot at the McDonald’s at East Colfax Avenue and Pennsylvania Street beginning about 11:0 a.m. to protest the lack of access to the restaurant for the handicapped. All of the arrests were based on traffic-obstruction charges. Police estimated there were about 20 demonstrators, but leaders of the demonstration estimated the number at 30 to 50. Richard Male, an organizer with the Community Resource Center, said the protesters want three things: access for the disabled to McDonald’s current restaurants, such access to be constructed at all new McDonald’s restaurants, and for the fast-food company to advertise its welcome and accessibility to the disabled. Joe Carle, 45, a community organizer at the Atlantis Community and one of the leaders of Thursday’s demonstration, said the point at issue is what he termed McDonald’s failure to live up to agreements made by the company in negotiations last month. He said McDonald’s officials met in Denver with members of the Access Institute, a national organization for the handicapped with which Atlantis is affiliated, following similar demonstrations at two McDonald’s restaurants in Denver in May. Organizers said McDonald’s agreed at that time to a June 19 meeting in Denver with a negotiating team from the institute. Carle said McDonald’s agreed to pay the costs of the Access Institute negotiators to return to Denver and to send a restaurant official with the authority to make an agreement. Now, according to the leaders of the local disabled group, McDonald’s says it won’t pay the transportation costs of the group’s members and won’t confirm that a representative with the authority to make an access agreement with the group will attend the meeting. The manager at the restaurant refused comment and a corporate spokesman for McDonald’s in Chicago didn’t return a telephone call to comment on the demonstration and the allegations. Sgt. Roy Clem of the Denver police said those demonstrators who were arrested had refused to get out of East Colfax Avenue, and they were arrested for obstruction of traffic. The one non-disabled person was arrested when she jumped in front of a car to block its path in support of the demonstration, Clem said. Detective George Masciotro identified those arrested as: Lori Eastwood, 26, of 1222 Pennsylvania St., who isn’t disabled; Donna Smith, 32, of 236 S. Elliot St.; Robert W. Conrad Jr., 35, of 750 Know Court; George Roberts, 36, of 1255 Galapago St.; Lawrence Ruiz, 30, also of 1255 Galapago St.; Terri Fowler, 28, of 3202 W. Gill Place; and Michael William Auberger, 29, of 1140 Colorado Blvd. Masciotro said they were booked into jail, then released on personal recognizance bonds. - ADAPT (453)

From a series of demonstrations to a controversial court case, this relentless group keeps fighting for accessible transit around the country. Among its victories are a July, 1989 federal court ruling that transportation agencies no longer have a 3 percent cap in providing wheelchair lifts or paratransit. For the members of ADAPT, accessible transit is a basic civil right — and is always worth fighting for. We reported in Disclosure #l08 on ADAPT’s actions in Montreal at the annual convention of the American Public Transit Authority (APTA). APTA and other transit authorities continue to make it extremely difficult for people with disabilities to use public transit. Nevertheless, ADAPT has shown that it will confront APTA wherever it shows up. Last April, at the Western Regional Conference of APTA in Sparks, Nevada (just outside of Reno), over 125 ADAPT members staged actions at the conference, calling for public transportation that can be used by everyone — including people with disabilities. Members started off with a march from their hotel to the conference hotel. When they were about halfway there, ADAPT was met by a police blockade. Obviously, authorities already knew about ADAPT: here is a group that won’t stops until it forces permanent changes. In Sparks. the marchers were able to get around the police barriers. But when they got to APTA’s hotel, they were met by private security forces. The hotel security outnumbered the city’s police three-to-one -— and were able to chain the door shut before ADAPT entered. Forty-seven ADAPT members were arrested, and seven were sent to jail. “The Sparks police had obviously decided that we weren't going to march in the streets,” said Stephanie Thomas, an ADAPT member who lives in Austin, Texas. “But we were able to go around the car barricades. it was like water going around the rocks." The following afternoon, ADAPT staged another demonstration with many crawling across the street and around police barricades, blocking traffic until they reached the front door of the hotel. It was locked from the inside. This time, 25 were arrested. The charge: blocking a fire door which was locked. Many of the ADAPT members who were arrested went on a hunger strike. Meanwhile, ADAPT members on the outside held a press conference calling attention to the problems jail staff were having providing for several of the disabled people’s needs. A final protest was held the next day. One day later, the Sparks judge who sent the hunger strikers to prison made a deal with the protesters: he let out two protesters for the price of a $100 fine. The judge had imposed a much stiffer sentence a couple of days earlier, but changed his mind in the face of a group of arrested ADAPT members who made it clear that they would rather starve and stay in jail than pay a huge fine. Meanwhile, disability groups on the east and west coasts were raising money to help support ADAPT. On the fourth day of the hunger strike, the judge relented and the fine was reduced. By the end of the day, all arrested ADAPT members had been released — and many in the group headed to Denver, for more demonstrations. In Denver — which is the home of ADAPT — the group protested at the annual conference of the Urban Mass Transit Administration (UMTA). This time, demonstrations focused on the federal government's request for a re-hearing of the ADAPT vs. Burnley case. In February, ADAPT won a major victory from the Department of Transportation (DOT) - only to have it undercut by the government. The first of ADAPT’s arguments stated that the rule saying transportation agencies should not have to spend more than 3 percent of their budget on wheelchair lifts or paratransit was unconstitutional. Second, ADAPT held that the option allowing agencies to decide whether or not to provide new buses with wheelchair lifts was unconstitutional. DOT kept flip-flopping on the issue: first it said yes, and then it backed off, asking for a rehearing to vacate the decisions. In Denver, ADAPT confronted Michael Norton, U.S. Attorney for the Tenth District in Denver. “Why is the government working against disabled rights?” asked ADAPT. Norton eventually read a 20-page statement from Attorney General Thornburgh stressing “the need for concern, compassion, and commitment” — but also saying that the law never mandated integration. “It was a really offensive statement, ” said Stephanie Thomas. “On one hand, he was affirming the government's commitment, and on the other he’s fighting tooth and nail to stop rights for the disabled.” When the case was reheard in Philadelphia on May 15, ADAPT was ready. With help from the local chapter of Disabled in Action and the Cape Organization for Rights of the Disabled (CORD), protesters gathered at the federal court building. Four ADAPT members met with the U.S. Attorney, who listened to their concerns. Two days later, a protest was staged at Independence Hall. Dressed in revolutionary garb complete with wigs, three-cornered hats and fife and drum, the “Disability Rights Patriots” marched around the Liberty Bell. Court Decision On July 24, ADAPT won a significant victory as the original ruling striking down the 3 percent cap on wheelchair and paratransit lifts was upheld. On the local option issue, judges decided that the stipulation was legal. Now, it's back in the hands of DOT, for "clarification." Meanwhile, ADAPT will be working with lawyers to plan its next strategy in the legal arena, even though the courts have dodged the issue of equal rights for the disabled. Nevertheless, ADAPT is still ready for action. “We are not going to sit around and wait for the government to put a piece of legislation through,” said Wade Blank. What's next for ADAPT? The next APTA Conference will be held in Atlanta, Georgia, September 23-28, 1989. “The court’s decision on local option will make our demonstrations in Atlanta bigger,” says Mike Auberger, a co-director of ADAPT. [Headline] Disabled demand better access BY Bob GWIZDZ Fort Worth StarTelegram Four people lobbying for better access to public transportation for disabled people refused to leave the Federal Building in downtown Fort Worth last night, promising to stay until Monday. Members of the American Disabled for Accessible Public Transportation earlier in the day had demanded that a local Department of Transportation official call the White House in support of their cause. Similar actions were planned in other cities today. “We plan to stay through Easter and welcome Wilbur Hare Monday morning.“ said Bob Kafka, a community organizer with the group. “On Monday we'll decide where we go from there.“ Hare, regional manager of the Urban Mass Transportation Administration, refused the group's request that he call White House chief of staff John Sununu in support of a recent federal appeals court decision requiring wheelchair lifts on all new public buses purchased with federal money. Group members say they think the Department of Transportation will appeal the decision. ln Philadelphia, eight people were escorted from a federal building that contains the regional transportation administration office when the building closed at 5 p.m. Sieglinde Shapiro, who headed the delegation of disabled people, said she read a statement to the official in charge. The statement noted that similar meeting had been scheduled with regional directors in New York, Boston, Atlanta, Chicago, Dallas, Denver, Seattle, Washington, San Francisco, Los Angeles, Phoenix, Ariz., and Salt Lake City, she said. The Associated Press office in Dallas said it had no reports of meetings with federal officials there. The Fort Worth office of the transportation department serves the Metroplex. Shapiro said “our sources in Washington tell us that the U.S. Department of Transportation is poised to appeal” the Feb. 13 decision by the 3rd U.S. Circuit Court of Appeals. The ruling requires that every bus newly purchased with federal assistance be wheelchair accessible, and that those unable use buses be provided with adequate transportation. The Fort Worth protest began when between 20 and 30 demonstrators, many in wheelchairs, arrived at the Federal Building around 1 p.m. after assembling at nearby Burnett Park. Hare, who said he received word Wednesday that a protest was planned, asked the protesters to meet with him downstairs at the Federal Building. The demonstrators refused. “That’s how you treat the disabled separate,” Kafka said to Hare. “We want to see you on the ninth floor, in your office, like everybody else. It’s the same thing as transportation — we want access like everybody else.” After a few protesters entered the building, Federal Protective Service officers locked the doors, forcing more than half of the demonstrators to remain outside. Hare said his office would not accommodate all the protesters. He declined to say who ordered the officers to lock the doors. About 10 protesters met with Hare in his office. “I’m not calling Mr. Sununu, but if you have a message for him, I’ll do my best to get it delivered,” Hare said. “lf you’d like to make a call, then go where you conduct your business and make the call. I’m sure you’ve made your views known to (President) Bush and if you haven’t, there are better ways to do it than tying up this office all afternoon.” Hare did call the Washington headquarters of the transportation administration and said he relayed the protesters’ message to officials there. When Hare left at 4:45 p.m., his normal quitting time, four protesters decided to remain. “We weren’t anticipating Mr. Hare being so obstinate,” Kafka said. “We expected a quick reaction and a phone call. It just shows their real arrogance toward disabled people.” At 6 p.m., Casey Bowen, director of building operations with the General Services Administration, told the protesters that he would prefer they leave, but that he had no intention of forcibly removing them. But Bowen said he would not allow them to have food sent in, and he had the telephones removed from the office. “Quite frankly, our intent is not to encourage this sort of protest,” Bowen said. Reporters could not contact the protesters later in the evening and building guards declined to comment. The protesters, who had no provisions other than a couple of granola bars and soft drinks, have access to the building's snack and soft drink machines. Besides Kafka, 43, of Austin, the protesters who remained in the building last night were Joe Carle, 50, and Frank Lozano, 39, both of Dallas, and Tim Baker, 26, of Austin. Kafka has used a wheelchair since he suffered a broken neck in an auto accident 10 years ago. Carle suffers from a circulation disorder, has had part of one leg amputated and has used a wheelchair for nine years. Lozano is blind, the result of an auto accident five years ago. Baker suffers from severe cerebral palsy. Paul Alexander, a Fort Worth lawyer who uses a wheelchair, arrived late in the afternoon to try to negotiate a settlement. When it became apparent that the protesters were determined to stay, Alexander tried to arrange for permission for food delivery. Alexander said arrangements could not be made. “Us being locked up all weekend symbolizes the thousands of disabled people who are locked up in their homes," Carle said. “Will it do any good? Handicapped Coloradan [Headline] These are the people who chased APTA George Florum, 47, of Colorado Springs, is a T3 para who fell out of a cherrypicker. He went to work for Atlantis and became involved with ADAPT in April of 1985. Florum has been arrested between 15 and 20 times on charges ranging from instigating a riot, blocking entrances, and chaining himself to doors and buses. "I think the disability movement has really grown," Florum said, "In April of '85 in San Antonio 15 people were willing to be arrested. Now people are standing up for their rights, and I think it's great." Joe Carle, 51, of Dallas, is a single amputee with artery problems. "I was the first to go through the training seminar," Carle said. "The second big seminar was to take on McDonald’s. Now, transportation is fairly won, but access will be a continuing battle. The disability movement can go anywhere." Rick James, 39, had encephalitis when he was two years old. Five years ago he was one of 20 people who did a "crawl on" on a bus, and three weeks later he was part of a group that got together and blocked a bus. “We will get ADA passed," James said, "and then take on any issues we feel necessary, such as health care, attendant care, the Greyhound company, housing - any of a number of issues." Cathy Thomas, 60, of Irving, Tex., has spina bifida and became involved with ADAPT - when a disability group she belonged to that was trying to get accessible transportation in Dallas asked ADAPT for help. She says, “At this point rights for disabled people are inevitable, We want to get as many buses accessible as possible. If President Bush is sincere in wanting to mainstream people with disabilities, then it's time he took the first step in getting us accessible transportation so we, too, can pursue the American dream." Rhonda Lester of Denver is the mother of Kenny Perkins, 5, who was refused access to an RTD bus in October 1987. “They viewed Kenny as a baby because of his chair," Lester said. “They wanted to board him separately from his chair-in other words, he was to be carried on. So I called Wade Blank on a Thursday and on Friday help came. Larry, George, Ken, ET and Julie blocked a bus. They let us on, we changed the policy, and I was allowed to attend a training meeting." When asked if there has been a lot of resistance to Kenny, Lester said, "Oh, yeah. People see one of ‘Jerry's Kids,' not the wheelchair I hope our actions and civil disobedience help to get full integration for my son." As to the controversial issue of children in the disability rights movement, Lester said, "As the mother of a disabled son, I feel that no one has a bigger right than myself to fight for my son's rights, although there are some who would disagree very strongly with this view. Fort Worth Star Telegram / Sunday March 26, 1989 [Headline] Disabled evicted by guards [Subheading] Fort Worth protest at courthouse ends BY Whitt Canning, Fort Worth Star Telegram Bob, Joe, Frank, Tim and Frazier spent a quiet evening Friday on the ninth floor of the Federal Building nodding off occasionally between friendly chats with the guards. Having arrived earlier in the day to take part in a protest by a group of disabled people against the Urban Mass Transit Administration, they hadn't really planned on staying the night. Things just sort of worked out that way. Their strange vigil ended abruptly about 1:15 p.m. yesterday when they were evicted by Federal Protection Service officers, who explained that it was being done for their own good. “They physically picked us up and carried us out," said Bob Kafka, admiring a skinned place on his right forearm that was bleeding slighty. “At least," said Joe Carle, “it was reassuring being in the hands of the kinder, gentler Bush administration." Kafka, 43, Carle, 50, Frank Lozano, 38, and Tim Baker, 26, are members of a group called American Disabled for Accessible Public Transportation that staged a nationwide protest Friday in an effort to dissuade the administration from appealing a recent decision in the 3rd Circuit Court of Appeals (ADAPT vs. Burnley). The decision requires wheelchair lifts on buses purchased with federal money. The Fort Worth protest involved 20 to 30 people, but Kafka, Carle, Lozano and Baker managed to reach the ninth-floor office of the administration's regional manager, Wilbur Hare. There, they requested he telephone White House chief of staff John Sununu and voice his support for the court decision. Joining the small group in its audience with Hare was Frazier, an amiable pooch who serves the visually impaired Lozano as a guide dog. Hare refused the request, and went home at 4:45 p.m., leaving the intrepid little band stuck on the ninth floor, vowing to stay through Easter weekend. “We were in the outer office, and he (Hare) came out once about 3:30 and told us he was leaving at his normal time," Carle said. "Then at 4:45, he came out, shook our hands, wished us happy Easter, and left. "We wished him happy Easter too." So the group was left occupying the building, along with several guards. At 6 p.m., Casey Bowen, director of building operations with the General Services Administration, told them they would not be forcibly removed, but he would not allow food to be brought in. As an added precaution, Kafka said, all the phones were removed. “I don't mean just in Hare‘s office," Kafka said. "lt looked to me like they removed every phone on the ninth floor. They didn‘t just disconnect them. They TOOK the phones off.“ The group settled in for the night. "Mostly, we tried to sleep as best we could, sitting in our chairs (Kafka, Carle and Baker use wheelchairs)" Kafka said. "I got the couch, since l'm the oldest," Carle said. “Frank slept on the floor because he doesn't have a wheelchair.“ "There are some vending machines up there," Kafka said, "and we ate some candy bars and drank some cokes that was about it. "The guards were very nice to us -- until today, when they evicted us." [Subheading] PROTEST About 6:30 a.m. yesterday, Kafka said, they asked the guards if they could send out for food and were refused. About 11 a.m. the group's attorney, Paul Alexander, arrived with the same request and also was refused. Then about l p.m., the group made another request — that Hare appear at a 6 p.m. news conference and agree to make the call to Washington tomorrow. ln return, they would end their occupation of the building. "That's when they evicted us," Kafka said. “They said they were acting on Bowen's orders and it was for our own good because we hadn't had anything to eat. “They picked me up out of my chair, because l wasn't going to leave, and carried me. That's how I got skinned up." “They had a little trouble getting Frank into a wheelchair," Carle said. “But Frazier went quietly when ordered to leave." Baker, who is severely disabled, did not fare so well, group members said. “When they were pushing him out in his chair, they didn't know how to operate it, and they tore up the motor and the clutch,“ Kafka said. “They did about $1,000 worth of damage to it." Guards at the building refused to comment. Hare did not show up at the news conference. And the I3 activists held up the starting time of 6 p.m. to wait for additional supporters who did not arrive. “We came here to fight for transportation, but we couldn't get the troops over to fight for them," Carle said, adding that none of the disabled could ride the bus downtown so only those who could afford a car could come. Kafka said that the group will examine legal recourse for injuries and damages incurred while being evicted. However, the group's lawyer, Paul Alexander, had advised the four that they might not have legal grounds because they were on federal property, Carle said. As to whether the demonstrators felt they had accomplished anything by the protest, Carle said, “We hope that somewhere along the line this wakes up the able-bodied community" and shows members of the disabled community that “they don't have to knuckle under." He said the group's impromptu occupation of Hare's office had probably amazed them as much as anyone else. “When we got here (with the other protesters), I was telling Bob that Mr. Hare was a pretty nice guy and would probably make the phone call fairly quickly," Carle said. “We were trying to figure out what we were going to do with the rest of the afternoon.“ Carle said other protests are planned soon, including one against Greyhound Corp. on Monday in Dallas. Greyhound, he said, has indicated it does not wish to adapt its buses to the handicapped. “I think this was an abomination," Kafka said. “As a Vietnam veteran, l am embarrassed for my country. But it's just another example of how the govrnment views the disabled. They don't want us to be people — they want us to sit down and shut up, or be put away in institutions. “I think a lot of people have a fear of the disabled." “They're trying to put us back where we've been for ... eternity," Carle said. "Instead of doing this, they should help us with job training so we can carry our own weight. “It's the only way we will ever become . . . people." The occupying force at least had a clear view of its immediate objective once it was back out on the street: friends who arrived to help were immediately dispatched to find food (“double burgers, chicken, and big milkshakes"). When the food gathering force hurried off, Carle offered one last observation on the situation. "Frazier," he confided. “is extremely upset about all this. “He says they treated him like a dog." Many of these same activists are heading for Washington, D.C. on Mar. 10, in an attempt to get Congress to pass the Americans with Disabilities Act of 1989. Protesters intend to leave their wheelchairs and crawl up the steps of the Capitol Building while Congress is in session. Article begins: ADAPT sets roll on D.C. To prod ADA passage Still a mile high following their victory in Atlanta last fall, disabled activists from across the country are planning on rolling on the Capitol Building in Washington, D.C., to demand that lawmakers pass the Americans with Disabilities Act of 1989. The act, which grants sweeping civil rights to disabled people (much as the 1965 Civil Rights Act aided blacks), has passed the Senate but is currently bogged down in four House committees, and no one expects a vote earlier than Feb. 28 by the full House membership. Disabled militants, mostly members of the Denver-based American Disabled for Accessible Public Transit (ADAPT), are planning on arriving in Washington on March 10. "If the bill is still in committee at that time, we're going to treat it as if the bill is in trouble," said ADAPT founder Wade Blank, co-director of the Atlantis Community, a Denver independent living health care provider. Blank said that disabled lobbyists in Washington have warned ADAPT to avoid the confrontational politics that it has used in other cities while battling its arch-nemesis, the American Public Transit Association (APTA). The professional lobbyists said it is not advisable to upset Congress, according to Blank. That's too bad, Blank said, because "we're telling them right here and now that we're going in and kicking ass.” Blank expects several hundred will participate in the march on the capitol, with about 125 of the protesters prepared to leave their chairs and crawl upon the capitol steps while other militants sneak in and seize the rotunda itself. If all that works out, it could be ADAPT’s biggest action so far in its seven-year struggle to force transit companies to put a lift on every bus in the country. The federal government unofficially agreed to support that goal in a deal hammered out between representatives of ADAPT and President Bush in Atlanta last October. Part of that deal called upon the President to push for disabled rights in his State of the Union address, which he did, much to the satisfaction of ADAPT, which Blank described as being “very pleased” with Bush. “Now we're going to smoke out a few Democrats," he said. When the agreement was reached in Atlanta, two cities had already started the process of purchasing non-lift equipped buses. Since then Pittsburgh has reversed its position and agreed to buy only accessible buses, while Albuquerque refused to consider altering its plans. “They’ll go down in history as the last city in America to buy lift-less buses," Blank said. In the months since Atlanta, ADAPT has switched its attention to pushing for lifts on intercity coaches. To that end some 45 wheelchair demonstrators were in Dallas Jan. 21-24 to picket a joint meeting of the American Bus Association (ABA) and the United Bus Owners of America (UBOA). Greyhound, the largest intercity bus company, is headquartered in Dallas. Most of those demonstrators were participating in their first action, which Blank said proves that ADAPT is continuing to grow in strength and power. On the first day, pickets blocked the entrance to the conference hotel with relatively little fireworks. But on Monday, Jan. 22, the protesters hit the Greyhound depot where some 29 demonstrators were arrested for blocking buses. Twenty of those were first-time arrestees. Trial has been set for Feb. 12. On the third day, protesters stormed in the exposition hall and interrupted a trade show demonstrating the latest advances in bus design. Most of that design had nothing to do with helping wheelchair riders get on board, Blank said. UBOA president Wayne Smith, who has published articles in the New York Times arguing against the transit provisions of the ADA, decided not to call in the police, and for three hours militant wheelchair protesters engaged in debate with professional transit providers. “It was a very successful happening,” Blank said. He said he hoped that spirit would hold true for the Washington, D.C., action, where he expects to see more first-time protesters. A seminar on ADAPT’S history and tactics is set for Mar. 10 at the Comfort Inn on H Street in northwestern Washington, where neophyte activists are urged to go even if they are planning to stay elsewhere during the action. Although the ADA covers all disabilities, this action, called the “Wheels of Justice," will center on the rights of the mobility-impaired. Blank said he tried to coordinate his action with other groups, including the National Federation of the Blind (NFB), but was rebuffed. “They don't think of themselves as disabled,” he said. “And that’s fine.” (For more on this topic see Homer Page’s column on page 2, “The ADA and the Blind.”) Some blind advocacy groups, including the NFB, have argued that they don't want adaptive devices, such as special buttons on street corners, written into the bill. “We don't need them," said Page, who is vice president of the Colorado NFB chapter. About 1500 people from all over the country with many different disabilities took part, he said. At the White House, a spokesperson "reaffirmed President Bush's position that he wanted to see the Senate version of the Americans with Disabilities Act (ADA) passed intact," Auberger said. The ADA is a civil rights act for persons of disability which prohibits discrimination in employment, transportation, public services, public accommodations, and telecommunications. It has passed the Senate and is now in the House of Representatives, where some business interests are lobbying heavily against it. ADAPT was demonstrating to work for passage of the ADA, according to Auberger. After the march to the capitol, several speakers talked to the crowd. They included Rep. Patricia Schroeder (D-Colo.); Rep. Major Owens (D-N.Y.), one of the sponsors of the ADA; Justin Dart, of the Congressional Task Force on Rights and Empowerment of Americans with Disabilities; Jim Brady, former President Reagan's press secretary; Auberger, and others. Then there was a crawl up the steps of the capitol. "The reason for the crawl was to let everybody in the House know that we're not going to let any obstacle stop us from having the ADA passed," Auberger said. “It wasn't to gain sympathy or to gain votes." ADAPT protesters marched to the rotunda the following day, March 13, and took over the rotunda. 104 of them were arrested. March l4, ADAPT demonstrators went to the Sam Rayburn Building. “We took over [Rep.] Bud Schuster's (R-Pa.) office who's the minority chairman of the Transportation Committee," Auberger said. “He's been the one within the Transportation Committee who's tried to add amendments like ‘Cities under 200,000 would not have to lift-equip their vehicles." “Also he was going after inclement weather—if you had too much snow, like we have here in Denver, you wouldn't have to have lift-equipped vehicles even though we already do. We have an average of 60 inches of snow a year," Auberger related. “Most of those amendments were defeated," Auberger added. “At the same time, we met with Hamilton Fish, (R-NY) who is the minority chairman of the Judiciary Committee," Auberger said. The ADA is undergoing constant attempts to weaken the remedy section; however, Fish didn't seem aware of this, according to Auberger. But Fish sat down in his office with about 30 disabled people and "talked with us probably for about a half hour and made a commitment that he would do everything within his position as minority leader of that Committee to see that there isn't any weakening and we were also at the Judiciary Committee Offices and we were working on setting up a meeting with Attorney General Thornburgh because he was the one who had been raising the issue of weakening the remedies section," Auberger said. “They were working on that and they tried to stall so at about seven o'clock, they were closing the capitol, we all refused to leave from Bud Schuster's office and from the Judiciary Committee and there were 60 people arrested in those offices and we got out about one o'clock that night," Auberger related. He said the demonstrations seemed to work. “lt clearly had this real effect on the hill when you went up there." These are new regs that have 90-day comment periods—the transit industry is not going" to oppose them,” he explained. Also, ADA should come to the House for a vote soon. It will be brought the the floor within 60 days and there is a lot of support for the bill, said Charles Siegal, from Speaker Foley’s press secretary’s office. ADA went through the Energy Committee without any amendments and no changes from the Senate version, Auberger indicated. “That happened while we were there and I'm sure that's why it happened that way," he said. STORY 2: by Vonne Worth A protest in Washington, D.C. by a disability group has resulted in the filing of a half-million-dollarlawsuit against the District of Columbia Court System. Americans with Disabilities for Accessible Public Transportation (ADAPT), many in wheelchairs, crawled up the stairs to the nation ’s capitol and took over the rotunda on March 13. They demanded to talk to Speaker of the House Tom Foley (D-Wash.) and Minority Leader of the House Robert Michel (R-Ill.) about passage of the Americans with Disabilities Act (ADA). “He [Foley] was not happy to come to meet with us" said Mike Auberger, organizer with ADAPT. "He didn't seem to have met with a lot of disability groups, he didn't quite know how to respond to that many disabled people and he talked about him pushing and speeding up the process and he tried to explain ‘we don’t understand the legislative process,’ and we said, ‘of course, we do, we're not totally stupid, just disabled.” “And Michel pretty much came out with the same sentiment and we let him know that he and other Republicans could be targets of the demonstration later in the week simply because they put more and more and more weakening amendments into the ADA,” Auberger added. The talk seemed to break down and the Capitol Police were called. “They were continuing to speak, we heard enough and so we were pretty much just chanting at that point ‘ADA now, now less,"' Auberger said. “At the point where we decided people could get arrested, all went to the center of the rotunda and circled there and several of us chained ourselves together with kryptonite locks," Auberger related. Within 15 minutes, 104 people, most of them in wheelchairs, were arrested, Auberger indicated. Then the police couldn’t cut through the locks. “They tried bolt cutters, they tried two different types of bolt cutters, they didn't work, so they had to bring in a hydraulic bolt cutter and it finally did work on the first one, but it broke on the second one, so they finally tried the bolt cutters again and they went through this whole process of getting these 104 people who were chanting in the middle of the rotunda ‘ADA now’ out," Auberger said. “It took about two and a half hours to get everybody out of the building since they only used one elevator which could take only one person at a time," Auberger explained. “At 1:28 Eastern time, they had to close the capitol to the public so that they could ‘get rid of all those rowdy disabled people." “They didn't have lift-equipped vehicles, so they had to lift everybody into vans and it took four or five officers to lift each chair into a van and they drive off with two chairs to a van to the police station, and then it took four or five more officers" to get them off, Auberger said. “They took everybody to police headquarters where they booked everybody and released them the next moming about one o'clock," Auberger related. It took 12 hours for the police to book 104 people. “This was a major process, them getting everybody out there," Auberger said, “lt was just a nightmare for them." The next afternoon, they went to the Sam Rayburn Building and took over offices of the congressmen on the Transportation and Judiciary Committees. About 60 people were arrested that day. The next two days were spent in court, Auberger said. “The majority of people ended up paying $10 in court costs and suspended sentences and that was pretty much it,” Auberger said. “There were five people who were given probation in their own cities from six months to a year just for being, I would suspect, ringleaders," he said. The judge in the case was disabled. “He had an arm that he couldn’t use at all,” Auberger said. Auberger said he felt the judge wasn’t sympathetic to the case. “His position was ‘You write your congressman if you want to change things,”’ Auberger said. “We all did that, clearly. It didn’t do a damn bit of good, but he wasn’t going to hear that. He pretty much gave out fines, four of them were for $100 and ten day suspended sentences and mine was $500 and a 20 day suspended sentence plus I have the longest, a year probation in-my city.” Auberger said it was rare for courts to send probation orders back to one’s home city. “Ironically, what was so incredible was the next day, when we went to file our probation papers, the building we were supposed to file our probation papers in was inaccessible,” Auberger said. “We come back to the courthouse, we talked to our attomey; unfortunately, the judge wasn’t around.” “They [had] put us all on probation and then we couldn’t get into the building to do the probation. Well, then, they told us, ‘Do it out in the hall by the courtroom.’.No. That's unacceptable. If everybody else goes into the building, we should be able to as well.” “So we’ve now filed a half a million dollar lawsuit against the District of Columbia Court System for denying us our civil rights.” About 250 people took part in the action.
