Police Arrest Denver Disabled Protestor MIKE AUBERGER, a community organizer for the Atlantis Community in Denver and a member of the American Disabled for Accessible Transit (ADAPT) is arrested by Washington, D.C., police outside the Washington Convention Center where the national convention of the American Public Transit Association (APTA) was just getting under way. A spokesperson for APTA said that the demonstrations only delayed the start of the convention by a few minutes. Inside the convention hall Secretary of Transportation Elizabeth Dole abandoned her prepared text and said the administration was working to provide public transit for the disabled. Outside the hall, demonstrators branded the secretary's plan as another “separate but equal" scheme and demanded that the federal government require all public transit systems be made accessible to the handicapped. Demonstrators not only blocked the entrances to the convention but also surrounded chartered buses that took delegates from their hotel to the convention center. The disabled activists represented a number of cities, including Denver, Syracuse, N.Y., Boston, El Paso, Los Angeles and Chicago. Additional photo on page 4. 28 Busted in D.C. The 28 disabled activists who were arrested for civil disobedience during the national convention of the American Public Transit Association (APTA) in Washington, D.C., last month are trying to raise $1500 to make their bail money by a Dec. 3 deadline. At the same time, they're preparing to carry their demand that the APTA members buy only wheelchair-lift equipped buses to the transit organization's regional convention in San Antonio on April 20. The Texas contingent from the American Disabled for Accessible Public Transit (ADAPT) under the leadership of Jim Parker of El Paso has been especially militant in their demands. Taking their lead from an editorial in the September Handicapped Coloradan, a coalition of of Texas disabled groups met in San Antonio and voted to ask transit systems in Texas to withdraw from APTA unless it goes on record supporting accessibility. The Colorado chapter of ADAPT was planning to introduce a similar resolution to Denver’s Regional Transportation District (RTD). APTA's position is that accessibility should be left to the discretion of the local transit provider, Although the Carter administration mandated accessibility in public transit, APTA was successful in getting that ruling thrown out in a l98l court battle. ADAPT maintains that the disabled have a civil right to public transit. Jack Gilstrap, APTA's executive vice president, reiterated that position as wheelchair demonstrators seized buses in front of the White House and hurled their chairs at police lines outside the Washington Hilton and Washington Convention Center during APTA's late September meeting. Gilstrap said that the funds just weren't there to support a mandatory system, adding that the additional burden might jeopardize some transit systems. However, since the convention ADAPT has been approached by APTA's new president, Warren Franks, the director of the Syracuse, N.Y., transit system, who has requested a meeting in Denver with wheelchair activists. "The Syracuse ADAPT group has been pretty active," said ADAPT spokesperson Wade Blank. "Franks must be pretty worried about what might happen there if he wants to meet with us.“ ADAPT was organized in Denver one year ago by some of the same groups and individuals who had been involved in forcing RTD to adopt a pro-accessibility policy when purchasing new buses. That battle too was highlighted by militant demonstrations with wheelers chaining themselves to the doors of RTD headquarters. In contrast, demonstrators restricted themselves to orderly pickets when APTA held its national convention in Denver in 1983. But ADAPT only abandoned its plans for civil disobedience after APTA met its demands to address the entire convention on accessibility. APTA's national staff fought that request and allegedly threatened to pull the convention out of Denver at the last minute, but finally agreed to allow ADAPT to address the meeting after Denver Mayor Federico Pena intervened. There was no question that ADAPT would be offered the same treatment at the Washington convention. Although they didn't get a spot on the agenda Blank said his group made their point by capturing the attention of the capital's media. Even before the convention opened, ADAPT made its presence known by joining forces with local D.C. activists to seize seven Metrobuses and block the five blocks along Pennsylvania Avenue in front of the White House during the afternoon rush hour. Demonstrators released the buses an hour later when D.C.’s Metro General Manager Carmen E. Turner agreed to meet with Washington disabled leaders to discuss their demands for a fully accessible system. No date has yet been set for that meeting, which ADAPT said marked an historic first in the Washington area. No arrests were made during that demonstration, although Washington police moved several demonstrators out of the street. But on the following Monday and Tuesday 28 demonstrators were arrested as they tried to block buses leaving the Washington Hilton for the convention center and again at the convention center itself. The police threw up lines as picketers arrived but were unable to halt the advance of the demonstrators, who wedged their chairs in the hall's doors or hurled their bodies onto the ground. Mike Auberger, one of those arrested, said the police "were abusive -- there's no doubt of that," but he added that this was probably pretty typical. “Let's face it," he said, "these guys probably have to deal with demonstrators all the time." They don't mess around when they get started. Auberger said he was grabbed by the hair and pulled back so that his chair was resting on its back wheels. Two other demonstrators were thrown from their chairs and taken to local hospitals where they were released after being treated for minor injuries. Police had to bring in special vans with wheelchair lifts in order to cart demonstrators off to jail, where they were fingerprinted and rushed into court. "Only the doorway between the holding cells and the courtroom was too narrow to get our chairs through," Auberger said, "so they had to take us in the back way." Some of the disabled picketers were surprised that the police reacted with such force, according to Auberger. "l think it opened a few eyes," he said. ADAPT filmed the demonstration, and a 20-minute edited version is being shown as part of a fundraiser to pay the bails of those arrested, about half of whom were from Denver. Congresswoman Pat Schroeder (D-Denver) has agreed tn help raise money, but because of previous campaign commitments said she would be unable to participate until after the first of the year.

[Headline] "We Will Ride" [Subheading] Disabled Protesters Clash with Transit Authorities National Group Fights for Accessible Transit Disclosure Jan-Feb, 1989 [This article continues on ADAPT 420 but the entire text is included here for easier reading.] "These protests are the continuation of an ongoing assault," says Stephanie Thomas of American Disabled for Accessible Public Transit (ADAPT). In October, ADAPT disrupted the annual convention of the American Public Transit Authority (APTA) in Montreal with a series of protests. "We want all buses to be made accessible to disabled people," says Stephanie Thomas, who lives in Austin, Texas. "And we will continue these confrontations until that happens!" ADAPT is getting closer and closer to that goal. Last year, a task force created by APTA proposed lifts on all new buses. Nevertheless, at the Board of Directors' meeting in Montreal in October, APTA reaffirmed its current policy on transportation for disabled persons. In many cities, transportation for disabled persons means some kind of a pickup service. "It's a segregated system," says Stephanie Thomas, "and it never works out as well as it sounds. Riding public transportation is a civil right." For this civil right, ADAPT turns to civil disobedience. ADAPT has become such a force at APTA conventions that local police now prepare in advance for the group's demonstrations. In Montreal, police watched videos of ADAPT demonstrations in the U.S. and 100 police were put through a day-long training session on how to deal with the anticipated protests. But that didn't stop the ADAPT protesters, who continue to fight tenaciously for accessible transit. The four day series of actions in Montreal began on Sunday, October 1st. Despite a torrential downpour and near freezing temperatures, 120 members of ADAPT marched down Boulevard Rene Levesque to the Hotel Queen Elizabeth, APTA's 1988 convention site. ADAPT protesters were joined by representatives of their local counterpart — Le Mouvement des Consommateurs Handicapes de Quebec (MCHQ) or the Movement of Disabled Consumers of Quebec. ADAPT members swarmed across the road to enter the hotel, despite at least a one-to-one ratio of police to protesters. Even as a wall of police barricades was hastily erected, protesters climbed down from their chairs and crawled under the barriers. They were carried back by the police, but no arrests were made. That evening ADAPT took a more undercover approach. "No small feat for over 100 wheelchairs," commented Stephanie Thomas. Sneaking through back alleys and a back door, 15 people in wheelchairs were carried down a flight of stairs into one of the satellite hotels in which APTA members were staying. Meanwhile, two other `groups` converged on the front door using their wheelchairs to push aside makeshift barriers of luggage carts. Singing and chanting, ADAPT took over the lobby — blocking elevators, escalators, and stairs as APTA members looked on in shock, Finally, the police selectively arrested 28 of the demonstrators, including two who had chained themselves to the stairway. That night, a judge sentenced members of the group to a $50 fine, to be paid on the spot, or they would be faced with three days in jail, with a probation banning those arrested from entering downtown Montreal for six months. Twenty of the group refused to pay the fine and went to prison. Nevertheless, this put no damper on ADAPT's actions. Next hit: the APTA Spouses' Luncheon and Fashion Show, a favorite ADAPT target. The luncheon was held at a chalet atop Mount Royal on Mon-day, October 3. Ten more ADAPT members were arrested, as the APTA buses were stopped and the spouses were forced to walk past chanting demonstrators. On Monday night, October 3, 20 wheelchair users penetrated the Queen Elizabeth Hotel through an underground shopping area. 7 year old Jennifer Keelan, who uses a wheelchair, and her mother, were taken into custody and threatened with arrest, but were later let go. Meanwhile, in two Montreal prisons, the system was showing its inability to deal with severely disabled inmates. The ADAPT inmates were on a hunger strike. Officials decided that, due to good behavior, everyone would be out by Tuesday morning. ADAPT swung into the final phase of operation Tuesday morning. As requested by MCHQ, it was time to hit the local transit system — which is completely inaccessible to people with mobility impairments. Buses were stopped for an hour at a local bus transfer site, while a local woman crawled from her wheelchair aboard a bus and tried unsuccessfully to ride. "We are sorry for the inconvenience, but we are inconvenienced all our lives," said Wade Blank of ADAPT to the crowd. Blank is the founder of ADAPT. On Wednesday, October 5, ADAPT entered the Longueuil METRO subway station and once again tried to ride. The station had no ramps or elevators, and narrow turnstyles. 50 ADAPT members sang and chanted in the cavernous station — and cheered as 15 others crawled out of their wheelchairs, down the steps, and across the floor to the turnstyles where police blocked their passage. From the dirty platform floor, ADAPT held a press conference. We explained our simple desire to use the public transit that our taxes pay for," says Stephanie Thomas. "Lack of access is degrading for people with disabilities." The pressure on APTA is clearly mounting. APTA is now considering a resolution which strongly supports mainline transit access — ADAPT's demand from the start. In addition, Le Mouvement des Consommateurs Handicapes de Quebec has learned first hand the effectiveness of direct action techniques and has vowed to continue the pressure locally in Montreal. "In Quebec, now they are saying 'Nous serons transporte!', says Stephanie Thomas. "That means what we have been saying all along, and will continue to say: 'We will ride!" That's why people support us. That's why they believe in what we are doing." Danny Saenz of ADAPT (American Disabled for Attendant Programs Today) was talking about the recent string of direct actions which has taken them from Baltimore to Washington to Dallas to Chicago and back to Washington again. ADAPT's primary issue: put Medicaid money into direct home attendant care of the disabled and get them out of nursing homes. ADAPT 's primary target: HHS Secretary Dr. Louis Sullivan, also known as “Lonesome Louie" and “Dr. No" because whatever ADAPT asks for, he refuses. “All we want is a meeting. . ." “All we want is a meeting," says Saenz, who is from the Austin, Texas ADAPT chapter. “But he always finds some excuse.” Tom Olin of Tennessee Adapt adds: "When we were in Washington recently, we thought that we had a meeting with Sullivan. But HHS went back on their word. So we closed down their building." Adapt members blocked the exits of the Health and Human Services building and forced guards to close it down for two hours on June ll. Police were reluctant to make arrests not only because it is bad publicity for them to be seen carrying off the disabled but also because most police stations do not have adequate care facilities. Tuesday, June 11, may go down as the biggest day in ADAPT's history for more reasons than the shutting down of HHS. Members began early at the American Health Care Association Convention where Sullivan was scheduled to speak. AHCA is a particularly galling organization to ADAPT because it is a lobbyist for the nursing home industry which receives billions in federal and state money for healthcare that ADAPT leaders describe as "inadequate," “wasteful” and “sometimes criminal." ADAPT estimates that over 1.5 million disabled could be moved from nursing homes to attendant home care if the Medicaid benefits were the same or comparable. Getting To Sullivan Although many ADAPTers got into the Hyatt Hotel where the AHCA convention was being held, security forces were able to head them off and lock the auditorium where Sullivan was scheduled to speak. All except for one person. She was able to sneak in and got down to the front of the room in her wheelchair. When Sullivan started his lecture, she also began speaking and gesturing to the audience, asking why Sullivan supported the agenda of nursing homes instead of the agenda of the disabled themselves. Several security police carted her off but ADAPT had, once again gotten Sullivan's attention. Eventually, Sullivan snuck out of the hotel, reputedly through the back kitchen entrance. But, even then, several ADAPT members caught up with him at his expensive limo and shouted their demands for a meeting at him as he drove away. Then ADAPT moved over to the HHS building where they blocked entrances and closed doum the building for a few hours. As National People's Action had done on their April visit, a few people got past the guards to some upper floor offices. But, of course, Sullivan was “not there." To cap off the day, ADAPT met with Senator Kennedy's staff to talk about the proposed health care bill. “We called for a meeting when we were here before in April," says Olin. “But they said they didn't know who we were. So we told them to just watch the news on TV and they’d see us.” What Kennedy’s staff and many other Washingtonians saw on TV then were another two direct actions which included blocking the HHS parking lot and the busy Baltimore intersection in front of the Social Security and Health Care Funding Administration building. ADAPT members said they wanted to illustrate what happens when they are locked in nursing homes. “It’s the same kind of feeling —— you can't leave when you want to. You need my permission," said Mike Auberger of Denver's Atlantis Community afterwards. “I’m sympathetic. . ." "I'm sympathetic to all these folks not able to get home, but this is a really minor inconvenience compared to the inconveniences suffered by those in nursing homes," said protester Nate Butler. A Washington Post photo showed ADAPT members lying down in front of police cars in a scene reminiscent of civil rights demonstrations of the 1960s. Some federal workers were irritated but many expressed sympathy for ADAPT’s views. Other ADAPT actions this spring included cornering Sullivan in Chicago on May 14 and, again in Dallas on May 22 at the President's Committee on Employment of People with Disabilities Conference. ln Dallas, according to the June issue of Incitement, ADAPT’s national newsletter: “(Sullivan) began his talk, and, slowly and silently, one by one, ADAPT members dropped to the floor and began crawling toward his podium, waving the proposed meeting dates in the air. Though he tried to ignore us, Sullivan stumbled over his words several times. in the end, a sea of bodies lay on the floor before him. . -" Sullivan's staff repeatedly says they won‘t meet with "radical" `groups`, but ADAPT leaders believe that this is just an excuse to avoid them. They note that Sullivan has plenty of time to meet with big money `groups` and lobbyists but that he ignores community-based `groups` whether they are "radical" or not. One of ADAPT's strongest arguments for reallocating Medicaid nursing home funds to a home attendant care system is financial. Leaders believe that, in the same way that health insurance administration costs eat up money that should go to the people who have the medical problems, nursing homes end up making large profits while the disabled suffer. Auberger says that nursing homes’ care costs are in the range of $30,000 to $60,000 a person a year but home care is in the $15,000-30,000 range. Auberger himself receives home care that averages about $2,000 a month. "Not only is it cost effective," he concludes, “it‘s the right to dignity and freedom of choice." The bottom line for ADAPT is the redirection of 25% of the $23 billion that Medicaid currently spends on nursing homes to community-based attendant services programs. While some states have adequate home care services, most do not. So ADAPT believes the primary change must come through the allotment of federal funds. “The nursing home industry is a billion-dollar industry — they give political contributions to politicians who protect their interests," says Lillibeth Navarro, an ADAPT member from California. “This is going to be a difficult struggle.
