Disabled take home-care protest to AMA's doorstep By Larry Weintraub, Staff Writer ln a third day of protests in support of home care instead of nursing home admissions, disabled rights activists Tuesday disrupted traffic and activities at the American Medical Association headquarters at Grand and State. Four demonstrators were arrested and one was injured. Two police officers were hurt and streets around the AMA building were blocked—first by protesters in wheelchairs and later by police. The demonstrators arrived at about 11:30 a.m. and surrounded the building at 515 N. State, said police Area 6 Chief of Patrol John Walsh. About six hours later, police officers escorted a caravan of wheelchairs south on State toward the Bismarck Hotel, where the group, American Disabled for Attendant Programs Today (ADAPT), has been staying. In the interim, the activists pounded on windows, shouted slogans, blocked entrances and generally tried to shut down the building. When the AMA began sending workers home at 3:30 p.m., about 20 demonstrators dropped out of their wheelchairs and crawled to confrontational positions. One man, Michael Auberger, 38, of Denver, was charged with battering a police officer. Officials said he rammed his mechanized wheelchair into East Chicago District Patrol Officer Robert Weston, injuring Weston's leg. The injured protester, a 38-year-old man who asked that his name be withheld, was treated for bruises at Northwestern Memorial Hospital and released. The other disabled persons arrested, a man and two women, were charged with disorderly conduct. ADAPT members, about 300 from 40 cities in 25 states, are holding a national convention here. They have been protesting the amount of federal and state funds spent on housing disabled people in nursing homes, rather than on attendants whose assistance would permit them to live at home, according to one spokesman, Mark Johnson of Atlanta. Johnson said his group targeted the AMA Tuesday “because nobody can go into a nursing home without a physician's referral, so they can play a pivotal role in reforming the system." Johnson said the lack of money for in-home care forces disabled people who could get along on their own with minimal assistance “to go on public aid and to live where they don't want to live." In-home care is far cheaper than nursing home residence, he said, and 80 percent of disabled people who live in nursing homes would rather live at home. Joanne Schwartzberg, director of the AMA‘s department of geriatric health, said the association agrees that “home care is the first choice for long-term care" and the AMA has a long history of support for it. However, the organization can only suggest guidelines to its members, she said. “Most disabled persons obviously don't belong in nursing homes." said Schwartzberg, “and we offered at a meeting last Thursday to work with them toward mutual goals—increasing the amount of home care and possibly drawing model home-care legislation for states that have no such provisions." The group demonstrated Sunday at the University of Illinois at Chicago, where Health and Human Services Secretary Louis Sullivan was speaking, and Monday at 105 W. Adams. where the department has offices. ADAPT plans to move its protest to the State of Illinois Center today. Meanwhile Tuesday, two women who use wheelchairs filed a class-action federal lawsuit charging that "oppressive" security measures Monday at the State of Illinois Center denied them equal access to facilities there. For Wade Blank and the 210 or so members of ADAPT, or American Disabled for Attendant Programs Today, the plan was simple. “We're going to block the entrance to the hotel because those people block our lives," he said of the American Health Care Association, which represents nursing home operators and has attracted 3,500 people to a convention this week at the Peabody Hotel. On the other side, hotel security and about 130 Orange County deputies and Florida Highway Patrol troopers were standing by to stop any protesters who blocked the doors with their bodies or their wheelchairs. “The main goal is to assist and help these people in a professional and sensitive manner," said sheriffs spokesman Cpl. Doug Sarubbi. “But when they break the law. we’ve got to enforce it." When the battle ended, one person had been hurt. one had suffered a heart attack and at least 73 had been arrested as ADAPT launched its four-day protest demanding fewer people be kept in nursing homes and more money be devoted to caring for the disabled at home. It was a battle authorities had mapped out extensively, making sure officials and facilities could accommodate the 'protesters' disabilities, said Sarubbi and Ed Royal, the Orange County Jail's assistant corrections director of programming. The costs of the special provisions had not been added up late Sunday, Sarubbi said. “This wasn't supposed to be the big day" of the protest, Sarubbi said. “We expect it every day and are prepared for whatever happens." More arrests were expected late Sunday, Sanibbi said. Each protester was charged with trespassing, taken to the Orange County Jail and held on $1,000 bail. A woman apparently was cut on the head when a table or bicycle lock fell on her while she tried to break through a barricade at the north entrance of the hotel. Pat Hasley, a top Peabody security specialist, suffered a heart attack outside the hotel and was taken to SandLake Hospital. His condition was unknown late Sunday. In demonstrations across the country, ADAPT has blocked meetings, disrupted speeches and shut down offices. “We chose to shut down the able-bodied system that suppresses us," ADAPT co-founder Blank said. "If they choose to arrest us, so be it." Denver-based ADAPT wants Medicaid to redirect 25 percent of its $23 billion nursing home budget to home care for the disabled. The group also wants 45 minutes on the convention agenda to make its position known. “We‘re not trying to change the world," said Toni Funderburk, who calls herself a nursing home survivor. “We're just trying to live in it." Linda Keegan, a vice president for the nursing home association, said the group could better spend its time at the bargaining table rather than barricading buildings. “I think it would make a bigger difference if they sit down with us and come to a compromise. "It's not our money to give," she said. “The real issue is an issue of choice. There needs to be choice on both sides. The only approach that makes sense is to sit down and form a compromise that makes sense for all." Sunday's showdown began at 12:35 p.m. as protesters filed out of the Clarion Plaza Hotel, across the street from the Peabody, with a phone number to a group lawyer scrawled on their arms, shouting "Hey! Hey! Ho! Ho! Nursing homes have got to go!" Others carried signs with such slogans as "End apartheid Destroy nursing homes" as others waved a modified U.S. flag with the stars forming the universal handicapped symbol. As the first protesters reached the Peabody parking lot, deputies confronted them. The protesters climbed out of their wheelchairs, crawled on the ground and tried to scoot past and through the legs of deputies in a race for the hotel doors. “Get to that damn door," barked Bob Kafka, a Texas ADAPT organizer. “Go! Go! Go!" Security scrambled to block the protesters, but ADAPT members managed to create a logjam at the entrance with their bodies or wheelchairs. “It's inconvenient," Peabody general manager Michael French said of the protest. “We respect their right to protest, but they must respect our right to operate a business." After the protesters refused security workers' request to leave, several school buses arrived, specially equipped for the disabled. Authorities brought in a moving van for non-disabled protesters. “We tried civil means and they just give us a cookie, pat us on the back and say, ‘Go away,'" Funderburk said. Deputies carried crawling protesters and ushered wheelchair users into the vehicles. The display drew looks of disbelief from some hotel guests and empathy from others. “It's awful," said Elma Oeters, visiting from Europe. Jacqueline Krygsman of Holland called the situation ridiculous, saying her country has a national health care policy. “They should have things at home." Police shuttled prisoners across the street to a makeshift booking office at the Orange County Convention and Civic Center before taking them to jail. Royal said open bay cells normally reserved for juveniles, psychotic inmates and those with other special needs were used for the protesters in wheelchairs. Guards were on duty in the bays. The open bays, which normally hold about 60 people, contained between six and 10 handicapped people, depending on their needs. Four nurses were added to the normal staff of five, he said. "The corrections staff underwent special training to understand the needs of handicapped individuals," Royal said. Other special provisions made by the jail included obtaining hand-held commodes and arrangements for the care of any guide dogs accompanying blind protesters. Those arrested will have to go through the normal process to be released. “Those who are able to bond will be allowed to bond," Royal said. “Those who are not able to bond will have to go to first appearance before a judge in the morning." Most protesters, after being informed of the $1,000 bond, said they could not afford to pay and would remain in jail, Blank said. "I guess Orlando wants to prove a point," he said. “We didn't travel 1,900 miles to haul it in after one day. It's not like it‘s anything new. Nursing homes or jail. [Headline] "We Will Ride" [Subheading] Disabled Protesters Clash with Transit Authorities National Group Fights for Accessible Transit Disclosure Jan-Feb, 1989 [This article continues on ADAPT 420 but the entire text is included here for easier reading.] "These protests are the continuation of an ongoing assault," says Stephanie Thomas of American Disabled for Accessible Public Transit (ADAPT). In October, ADAPT disrupted the annual convention of the American Public Transit Authority (APTA) in Montreal with a series of protests. "We want all buses to be made accessible to disabled people," says Stephanie Thomas, who lives in Austin, Texas. "And we will continue these confrontations until that happens!" ADAPT is getting closer and closer to that goal. Last year, a task force created by APTA proposed lifts on all new buses. Nevertheless, at the Board of Directors' meeting in Montreal in October, APTA reaffirmed its current policy on transportation for disabled persons. In many cities, transportation for disabled persons means some kind of a pickup service. "It's a segregated system," says Stephanie Thomas, "and it never works out as well as it sounds. Riding public transportation is a civil right." For this civil right, ADAPT turns to civil disobedience. ADAPT has become such a force at APTA conventions that local police now prepare in advance for the group's demonstrations. In Montreal, police watched videos of ADAPT demonstrations in the U.S. and 100 police were put through a day-long training session on how to deal with the anticipated protests. But that didn't stop the ADAPT protesters, who continue to fight tenaciously for accessible transit. The four day series of actions in Montreal began on Sunday, October 1st. Despite a torrential downpour and near freezing temperatures, 120 members of ADAPT marched down Boulevard Rene Levesque to the Hotel Queen Elizabeth, APTA's 1988 convention site. ADAPT protesters were joined by representatives of their local counterpart — Le Mouvement des Consommateurs Handicapes de Quebec (MCHQ) or the Movement of Disabled Consumers of Quebec. ADAPT members swarmed across the road to enter the hotel, despite at least a one-to-one ratio of police to protesters. Even as a wall of police barricades was hastily erected, protesters climbed down from their chairs and crawled under the barriers. They were carried back by the police, but no arrests were made. That evening ADAPT took a more undercover approach. "No small feat for over 100 wheelchairs," commented Stephanie Thomas. Sneaking through back alleys and a back door, 15 people in wheelchairs were carried down a flight of stairs into one of the satellite hotels in which APTA members were staying. Meanwhile, two other `groups` converged on the front door using their wheelchairs to push aside makeshift barriers of luggage carts. Singing and chanting, ADAPT took over the lobby — blocking elevators, escalators, and stairs as APTA members looked on in shock, Finally, the police selectively arrested 28 of the demonstrators, including two who had chained themselves to the stairway. That night, a judge sentenced members of the group to a $50 fine, to be paid on the spot, or they would be faced with three days in jail, with a probation banning those arrested from entering downtown Montreal for six months. Twenty of the group refused to pay the fine and went to prison. Nevertheless, this put no damper on ADAPT's actions. Next hit: the APTA Spouses' Luncheon and Fashion Show, a favorite ADAPT target. The luncheon was held at a chalet atop Mount Royal on Mon-day, October 3. Ten more ADAPT members were arrested, as the APTA buses were stopped and the spouses were forced to walk past chanting demonstrators. On Monday night, October 3, 20 wheelchair users penetrated the Queen Elizabeth Hotel through an underground shopping area. 7 year old Jennifer Keelan, who uses a wheelchair, and her mother, were taken into custody and threatened with arrest, but were later let go. Meanwhile, in two Montreal prisons, the system was showing its inability to deal with severely disabled inmates. The ADAPT inmates were on a hunger strike. Officials decided that, due to good behavior, everyone would be out by Tuesday morning. ADAPT swung into the final phase of operation Tuesday morning. As requested by MCHQ, it was time to hit the local transit system — which is completely inaccessible to people with mobility impairments. Buses were stopped for an hour at a local bus transfer site, while a local woman crawled from her wheelchair aboard a bus and tried unsuccessfully to ride. "We are sorry for the inconvenience, but we are inconvenienced all our lives," said Wade Blank of ADAPT to the crowd. Blank is the founder of ADAPT. On Wednesday, October 5, ADAPT entered the Longueuil METRO subway station and once again tried to ride. The station had no ramps or elevators, and narrow turnstyles. 50 ADAPT members sang and chanted in the cavernous station — and cheered as 15 others crawled out of their wheelchairs, down the steps, and across the floor to the turnstyles where police blocked their passage. From the dirty platform floor, ADAPT held a press conference. We explained our simple desire to use the public transit that our taxes pay for," says Stephanie Thomas. "Lack of access is degrading for people with disabilities." The pressure on APTA is clearly mounting. APTA is now considering a resolution which strongly supports mainline transit access — ADAPT's demand from the start. In addition, Le Mouvement des Consommateurs Handicapes de Quebec has learned first hand the effectiveness of direct action techniques and has vowed to continue the pressure locally in Montreal. "In Quebec, now they are saying 'Nous serons transporte!', says Stephanie Thomas. "That means what we have been saying all along, and will continue to say: 'We will ride!" [Headline] Wheelchair Protesters Unfazed by Metro stairs By PEGGY CURRAN of The Gazette It began when Ronnie Smith deliberately hurled his wheelchair down the stairs at the Longueuil Metro station. Horrified commuters stood by helplessly as the frail-looking Dallas, Tex., man tumbled in a heap at the foot of the stairs. Five Longueuil police officers rushed to pick Smith up and ease him back into his chair. "It wasn't bad," said Smith, 33. "I knew if I made it halfway down, I'd be OK. I knew I'd be shaken up a little bit." Minutes later, 10 more disabled activists had abandoned their wheelchairs, slithering or crawling down the steps to the subway level. Holding up bus tickets, they edged toward the wickets - only to be stopped by a police barricade. Another 30 disabled people remained in the rotunda upstairs, chanting "We will ride" and singing We shall overcome. Most of the protesters were Americans, members of ADAPT - American Disabled for Adapted Public Transit. For five years, the organization has taken radical action to press its demands for better public transit. Often it stages spectacular demonstrations and welcomes arrests. The group came to Montreal for four days to stage protests again at he annual convention of the American Public Transit Association. Since Sunday, some 48 protesters have been arrested during demonstrations at the Sheraton Centre, the chalet on Mount Royal and Place Ville Marie. There were no arrests during yesterday's demonstration. Longueuil police Sgt. Pierre Rheault said his officers would allow the disabled protesters to demonstrate, as long as they agreed to leave peacefully when they were done. And the 15 officers from the Longueuil and Metro police handled the situation with gentleness. Officers offered to carry many of the protesters upstairs at the end of the hour-long sit-in and news conference. And they were quick to intervene when a man, who claimed to be a trained paramedic, lunged at one of the protesters as he lay writhing on the ground. The man, who said he works as a night nurse at Maisonneuve-Rosemont Hospital, had been drinking in a tavern on the lower level of the Metro station when he heard activity in the corridor leading to the trains. He jumped on the disabled man's chest, ignoring pleas to leave the man alone. But police dragged him away, throwing him back into the brasserie and ordering him to stay there until the demonstration was over. Montrealer Francois Gagnon said disabled Quebecers may be afraid to speak out lest they lose the benefits they depend on, such as jobs, disability pensions or housing allowances. But Gagnon said he hopes this week's actions will encourage more handicapped people to step forward to fight for their right to better transit services, and wheelchair access to public washrooms, buildings and housing projects. Meanwhile, at the transit convention, Robert Zuzworsky, a New York Transit Authority driver, was awarded first prize of $1,000 U.S. in the International Bus Roadeo competition held here Tuesday.

From a series of demonstrations to a controversial court case, this relentless group keeps fighting for accessible transit around the country. Among its victories are a July, 1989 federal court ruling that transportation agencies no longer have a 3 percent cap in providing wheelchair lifts or paratransit. For the members of ADAPT, accessible transit is a basic civil right — and is always worth fighting for. We reported in Disclosure #l08 on ADAPT’s actions in Montreal at the annual convention of the American Public Transit Authority (APTA). APTA and other transit authorities continue to make it extremely difficult for people with disabilities to use public transit. Nevertheless, ADAPT has shown that it will confront APTA wherever it shows up. Last April, at the Western Regional Conference of APTA in Sparks, Nevada (just outside of Reno), over 125 ADAPT members staged actions at the conference, calling for public transportation that can be used by everyone — including people with disabilities. Members started off with a march from their hotel to the conference hotel. When they were about halfway there, ADAPT was met by a police blockade. Obviously, authorities already knew about ADAPT: here is a group that won’t stops until it forces permanent changes. In Sparks. the marchers were able to get around the police barriers. But when they got to APTA’s hotel, they were met by private security forces. The hotel security outnumbered the city’s police three-to-one -— and were able to chain the door shut before ADAPT entered. Forty-seven ADAPT members were arrested, and seven were sent to jail. “The Sparks police had obviously decided that we weren't going to march in the streets,” said Stephanie Thomas, an ADAPT member who lives in Austin, Texas. “But we were able to go around the car barricades. it was like water going around the rocks." The following afternoon, ADAPT staged another demonstration with many crawling across the street and around police barricades, blocking traffic until they reached the front door of the hotel. It was locked from the inside. This time, 25 were arrested. The charge: blocking a fire door which was locked. Many of the ADAPT members who were arrested went on a hunger strike. Meanwhile, ADAPT members on the outside held a press conference calling attention to the problems jail staff were having providing for several of the disabled people’s needs. A final protest was held the next day. One day later, the Sparks judge who sent the hunger strikers to prison made a deal with the protesters: he let out two protesters for the price of a $100 fine. The judge had imposed a much stiffer sentence a couple of days earlier, but changed his mind in the face of a group of arrested ADAPT members who made it clear that they would rather starve and stay in jail than pay a huge fine. Meanwhile, disability groups on the east and west coasts were raising money to help support ADAPT. On the fourth day of the hunger strike, the judge relented and the fine was reduced. By the end of the day, all arrested ADAPT members had been released — and many in the group headed to Denver, for more demonstrations. In Denver — which is the home of ADAPT — the group protested at the annual conference of the Urban Mass Transit Administration (UMTA). This time, demonstrations focused on the federal government's request for a re-hearing of the ADAPT vs. Burnley case. In February, ADAPT won a major victory from the Department of Transportation (DOT) - only to have it undercut by the government. The first of ADAPT’s arguments stated that the rule saying transportation agencies should not have to spend more than 3 percent of their budget on wheelchair lifts or paratransit was unconstitutional. Second, ADAPT held that the option allowing agencies to decide whether or not to provide new buses with wheelchair lifts was unconstitutional. DOT kept flip-flopping on the issue: first it said yes, and then it backed off, asking for a rehearing to vacate the decisions. In Denver, ADAPT confronted Michael Norton, U.S. Attorney for the Tenth District in Denver. “Why is the government working against disabled rights?” asked ADAPT. Norton eventually read a 20-page statement from Attorney General Thornburgh stressing “the need for concern, compassion, and commitment” — but also saying that the law never mandated integration. “It was a really offensive statement, ” said Stephanie Thomas. “On one hand, he was affirming the government's commitment, and on the other he’s fighting tooth and nail to stop rights for the disabled.” When the case was reheard in Philadelphia on May 15, ADAPT was ready. With help from the local chapter of Disabled in Action and the Cape Organization for Rights of the Disabled (CORD), protesters gathered at the federal court building. Four ADAPT members met with the U.S. Attorney, who listened to their concerns. Two days later, a protest was staged at Independence Hall. Dressed in revolutionary garb complete with wigs, three-cornered hats and fife and drum, the “Disability Rights Patriots” marched around the Liberty Bell. Court Decision On July 24, ADAPT won a significant victory as the original ruling striking down the 3 percent cap on wheelchair and paratransit lifts was upheld. On the local option issue, judges decided that the stipulation was legal. Now, it's back in the hands of DOT, for "clarification." Meanwhile, ADAPT will be working with lawyers to plan its next strategy in the legal arena, even though the courts have dodged the issue of equal rights for the disabled. Nevertheless, ADAPT is still ready for action. “We are not going to sit around and wait for the government to put a piece of legislation through,” said Wade Blank. What's next for ADAPT? The next APTA Conference will be held in Atlanta, Georgia, September 23-28, 1989. “The court’s decision on local option will make our demonstrations in Atlanta bigger,” says Mike Auberger, a co-director of ADAPT.
