Fla. — The melee at a meeting of nursing home representatives here was in many ways a typical demonstration by members of Adapt. After smashing their wheelchairs into police barricades and blocking a hotel entrance, 73 members were arrested, creating front page headlines and a successful day’s work for the militant advocacy group for the disabled. The aim of the action last Sunday at the Peabody Hotel in this resort city was to locus attention on the organization's call to divert federal funds from nursing homes in a form of in-home care. But the means the group uses, like Sunday’s chaotic demonstration, has exasperated its allies often as much its adversaries. But even those who criticize Adapt acknowledge that the searing image of people with physical limitations engaging in civil disobedience often succeed in shattering stereo-types of how meek and pliant "cripples" are supposed to act - stereotypes often held by many disabled people themselves. “Adapt is about the issue," said Mary Johnson, editor of the Disability Rag, a weekly magazine that is devoted to disability issues. "But it is also about showing you that though you are disabled you have power already. For people who feel they don't have any power, who are often dependent, that is such a liberation." [Subheading] Antagonizing allies The Denver-based group’s style has drawn its share of criticism from other advocates for the disabled. These critics note that the group played little part in the negotiations thai led to the passage of the Americans with Disabilities Act and that their methods have often antagonized allies in the struggle. “l think they do get attention," said a Washington-based disabled advocate who asked not to be identified. "But that‘s true when they are playing to an audience that is not politically savy. For people out in Middle America, sitting in front of the TV, seeing people in wheelchairs demonstrating is something new. But to folks in Washington who are used to sit-ins, it's passe." Leaders of Adapt, which originally stood for Americans Disabled for Accessible Public Transportation, say it is `groups` like theirs that push others to press forcefully for expanded rights for the disabled. “I think that even for the people with disabilities who don't participate directly in Adapt, we give them heart," said Diane Coleman, an Adapt organizer from Tennessee. And even those who sometimes criticize Adapt acknowledge that it is an effective weapon. It is a role Adapt readily takes on. “We make all the other `groups` seem real rational," said Mike Auberger, one of Adapt's founders and advocate who helped persuade the city to make all local buses accessible to people in wheelchairs. [Subheading] Drastic means to a questionable end Over the next few years they held protests over the issue of accessible public transportation in Cincinnati, ST Louis, Phoenix, Detroit and Atlanta. In addition to picketing, the protesters often would lock their wheelchairs together in front of city buses or chain themselves to a bus's bumper. Early on, Adapt made a prime target the American Public Transit Association, a group representing mass transit systems. The disabled advocates disrupted meetings and harassed officials of the group. "You have to have a bad guy in political organizing, somebody you can go after," said Auberger. These days that role is filled by the nursing home industry and Louis W. Sullivan, secretary of Health and Human Services. After Congress passed the Americans with Disabilities Act last year, requiring that all new buses be equipped with hydraulic lifts for people in wheelchairs, Adapt began protesting for federal subsidies for personal attendants, individuals hired by those with physical impairments to help them with basic everyday needs. Adapt wants 25 percent of the more than $20 billion paid to nursing home operators under the Medicaid program to he diverted from nursing homes to help the disabled pay for personal attendants. Though many mainstream advocates for the disabled have endorsed the goal of government subsidies for attendants, the diversion of funds sought by Adapt is opposed by the American Health Care Association, the trade group for nursing homes, and by the Bush administration. As a result, Adapt has spent the last few months harassing the nursing home association and Sullivan. This spring they blocked his car during a visit to Chicago and heckled him during a speech in Washington. in August, a handful of Adapt members rolled their wheelchairs along side Sullivan and haranged him as he participated in a fitness walk on Martha's Vineyard. Whether such methods will achieve Adapt’s stated goals is uncertain. But leaders of the group say that when they first began to put pressure on the public transportation industry, no one felt their methods would bear fruit. "You have to give complete and utter credit for that to Adapt," said Evan Kemp. Jr., the head at the Equal Employment Opportunity Commission. - ADAPT (378)

Title: APTA still says no to lifts Wheelchair activists cross into Canada Wheelchair militants chased their arch enemy over the border into Canada in October, but unfortunately for advocates of accessible transit systems, the American Public Transit Association (APTA) not only came back but found time in between dodging wheelchair barricades and attending panel discussions to veto mandatory lifts on buses. APTA's board of directors voted unanimously at their national convention in Montreal to reaffirm its policy of local option while continuing to study proposals made by its Elderly and Disabled Services Task Force. APTA has been fighting mandatory lifts since the Carter administrations' Department of Transportation (DOT) first ordered transit companies to install lifts in 1979. APTA lost in U.S. District Court in 1980 but won in 1981 when the U.S. Court of Appeals ruIed that the DOT regulations were not required by Section 504 of the Rehabilitation Act of 1973. In 1983 wheelchair activists in Denver formed the American Disabled for Accessible Public Transit (ADAPT) and picketed APTA's national convention being held in Denver. ADAPT chapters rapidly sprang up in other cities, and APTA delegates soon grew used to having their annual conventions and regional meetings disrupted by hundreds of demonstrators in wheelchairs. This year's meeting in Montreal was no different. As usual, local police threw up barricades in front of the conventioneers' hotels, and as usual, wheelchair demonstrators hurled their chairs and bodies at police lines. And, as usual, they were arrested. "City police crush wheelchair protest," headlined the Montreal Daily News, next to a picture of police removing demonstrators from their chairs and passing them over the barricades. Protester Lori Taylor said the police had no right to take her husband's chair away from him. "They separated him from his legs," she said. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Police maintained that they had a right to remove Lester Taylor any way they could after he deliberately crashed his way through a metal barrier in front of the Queen Elizabeth Hotel. Taylor was taken into custody, along with 24 other demonstrators. Many of those arrested were from Colorado, including Mike Auberger, who chained his wheelchair to a handrail in the hotel lobby. Also among those "arrested" was a seven-year-old-girl from Scottsdale, Ariz. Jennifer Keelan, who has cerebral palsy, was taken into custody along with her mother Cynthia. Both mother and daughter were released later that day without charges being filed against them so that they would not be separated overnight. Cynthia Keelan said the police lifted Jennifer and her chair onto a police van using the kind of lift she and Jennifer would like to see put on every bus. She said she was very proud of her "very, very brave little girl," although a police spokesperson was quick to point out that it was the mother, not the daughter, who was actually being arrested. Most of those arrested were U.S. citizens, although a few Canadians did join the pickets. Maria Barila, a Montreal resident who was arrested, said potential Canadian demonstrators had been warned by one government agency that they could lose their welfare checks if they were arrested. Montreal police had received reports from the six U.S. cities in which ADAPT had previously picketed APTA conventions and had prepared accordingly, down to issuing officers kneepads in case wheelchair militants attempted to run their chairs into police. If you have it and can send a picture we would be very grateful. ] Second article: RTD firm in commitment to accessibility RTD has been named one of the nation's most accessible public transit systems by the American Disabled for Accessible public Transit (ADAPT), and it continues to show every sign of improving that system. On Nov. 1, RTD became one of the first transit systems in the country to offer accessible public transportation on intercity routes when 35 lift-equipped buses began rolling between Boulder and Denver. The Neoplan buses replace Yellow Cab service. Critics of lifts on intercity buses argued that they were too costly and took up to much space on already crowded buses, but when Neoplan submitted its bid to RTD, the cost was so low that the transit agency was able to buy additional buses. RTD says its new regional service shouldn't cause any delays, since its buses are already operating at a 95 per cent on-time rate. The lift-equipped buses operate between Boulder, Broomfield Park-n-Ride, Market Street Station, Stapleton Airport. and Longmont. Regular fares on the Regional AFB arc: Boulder to Broomfield, $1.25; Broomfield Park-n-Ride to Denver, $1.25; Boulder-Denver-Stapleton, $2.00. The fare for disabled individuals traveling during off-peak hours (9 a.m. to 4 p.m.) is 104. Regular monthly passes are $68; disabled riders pay $44 with their RTD Handicapped I.D. card. Ten-ride coupons are also available for this service at a cost of $18. For additional information regarding the new accessible regional service or for trip planning needs, call 777-3343 until 10 p.m. RTD also announced a get-tough policy on non-function lifts on buses being operated by private contractors. Some buses on accessible routes are now operated by private companies, even though the drivers still wear RTD uniforms and the buses carry the RTD logo. Every time one of those buses gets stopped and its lift isn't working, RTD will automatically levy a $100 fine against the private transit provider. Rocky Mountain News RTD pleases disabled, reports wheelchair lifts on buses to be fixed By JOSEPH B. VERRENGIA Rocky Mountain News Staff Writer A Regional Transportation District committee voted unanimously Tuesday to fix the wheelchair lifts on 127 buses, ending a week of heated showdowns that led to the arrest of three disabled protesters. Amid cheers from the demonstrators who twice last week blockaded downtown buses, the transit directors reaffirmed RTD's policy that much of its regular service be handicapped-accessible. “lt was all emotional," RTD chairman William Rourke said of the events preceding the compromise. “Everyone kept reinforcing perceptions and speculation, rather than getting down to cases." The confrontations started last Thursday when three members of the militant handicapped-rights group ADAPT were arrested by Denver police for rolling their wheelchairs in front of buses along 17th Street and East Colfax Avenue. Mike Auberger, George Roberts and Renate Rabe face fines of $250 apiece or brief jail terms if convicted in Denver District Court next month for causing traffic hazards and disrupting a government agency. They were among 20 handicapped demonstrators protesting a Feb. 12 decision by RTD’s planning committee to delay fixing the balky electrical systems on 303 buses. RTD officials said the repairs would cost $753,059. With lifts on about half of its 750-bus fleet, RTD is one of the nations most accessible public transit systems. This winter, however, electrical and mechanical problems have made the lifts so unreliable that disabled passengers said they frequently suffered frostbite while waiting for an accessible bus. Handicapped protesters originally wanted all 303 broken lifts fixed. They relented Tuesday when RTD officials explained 176 of the buses with broken lifts would be retired next year. Fixing those lifts would be a waste, officials said. “If we had our druthers, we would like to see all of the lifts rewired," ADAPT spokesman Wade Blank said. “But those 127 (that will be fixed) are going to be around for 12 years, so we accepted in the interest of compromise.” Blank said the protests were sparked by rumors that some RTD officials wanted to scrap all of the wheelchair lifts and replace them with door-to-door vans. ADAPT members consider such “dial-a-ride” service“ to be unconstitutional because it would be separate from regular bus service. Rourke said two of the five bus manufacturers bidding to replace the 176 buses heading for retirement would include wheelchair lifts. RTD is required to accept the lowest bid. Rourke declined to comment on what RTD would do if the low bid does not include wheelchair lifts.
