Title: APTA still says no to lifts Wheelchair activists cross into Canada Wheelchair militants chased their arch enemy over the border into Canada in October, but unfortunately for advocates of accessible transit systems, the American Public Transit Association (APTA) not only came back but found time in between dodging wheelchair barricades and attending panel discussions to veto mandatory lifts on buses. APTA's board of directors voted unanimously at their national convention in Montreal to reaffirm its policy of local option while continuing to study proposals made by its Elderly and Disabled Services Task Force. APTA has been fighting mandatory lifts since the Carter administrations' Department of Transportation (DOT) first ordered transit companies to install lifts in 1979. APTA lost in U.S. District Court in 1980 but won in 1981 when the U.S. Court of Appeals ruIed that the DOT regulations were not required by Section 504 of the Rehabilitation Act of 1973. In 1983 wheelchair activists in Denver formed the American Disabled for Accessible Public Transit (ADAPT) and picketed APTA's national convention being held in Denver. ADAPT chapters rapidly sprang up in other cities, and APTA delegates soon grew used to having their annual conventions and regional meetings disrupted by hundreds of demonstrators in wheelchairs. This year's meeting in Montreal was no different. As usual, local police threw up barricades in front of the conventioneers' hotels, and as usual, wheelchair demonstrators hurled their chairs and bodies at police lines. And, as usual, they were arrested. "City police crush wheelchair protest," headlined the Montreal Daily News, next to a picture of police removing demonstrators from their chairs and passing them over the barricades. Protester Lori Taylor said the police had no right to take her husband's chair away from him. "They separated him from his legs," she said. "He can't walk, he's just sitting on the wet ground and all he wants to do is ride a bus like you and me." Police maintained that they had a right to remove Lester Taylor any way they could after he deliberately crashed his way through a metal barrier in front of the Queen Elizabeth Hotel. Taylor was taken into custody, along with 24 other demonstrators. Many of those arrested were from Colorado, including Mike Auberger, who chained his wheelchair to a handrail in the hotel lobby. Also among those "arrested" was a seven-year-old-girl from Scottsdale, Ariz. Jennifer Keelan, who has cerebral palsy, was taken into custody along with her mother Cynthia. Both mother and daughter were released later that day without charges being filed against them so that they would not be separated overnight. Cynthia Keelan said the police lifted Jennifer and her chair onto a police van using the kind of lift she and Jennifer would like to see put on every bus. She said she was very proud of her "very, very brave little girl," although a police spokesperson was quick to point out that it was the mother, not the daughter, who was actually being arrested. Most of those arrested were U.S. citizens, although a few Canadians did join the pickets. Maria Barila, a Montreal resident who was arrested, said potential Canadian demonstrators had been warned by one government agency that they could lose their welfare checks if they were arrested. Montreal police had received reports from the six U.S. cities in which ADAPT had previously picketed APTA conventions and had prepared accordingly, down to issuing officers kneepads in case wheelchair militants attempted to run their chairs into police. If you have it and can send a picture we would be very grateful. ] Second article: RTD firm in commitment to accessibility RTD has been named one of the nation's most accessible public transit systems by the American Disabled for Accessible public Transit (ADAPT), and it continues to show every sign of improving that system. On Nov. 1, RTD became one of the first transit systems in the country to offer accessible public transportation on intercity routes when 35 lift-equipped buses began rolling between Boulder and Denver. The Neoplan buses replace Yellow Cab service. Critics of lifts on intercity buses argued that they were too costly and took up to much space on already crowded buses, but when Neoplan submitted its bid to RTD, the cost was so low that the transit agency was able to buy additional buses. RTD says its new regional service shouldn't cause any delays, since its buses are already operating at a 95 per cent on-time rate. The lift-equipped buses operate between Boulder, Broomfield Park-n-Ride, Market Street Station, Stapleton Airport. and Longmont. Regular fares on the Regional AFB arc: Boulder to Broomfield, $1.25; Broomfield Park-n-Ride to Denver, $1.25; Boulder-Denver-Stapleton, $2.00. The fare for disabled individuals traveling during off-peak hours (9 a.m. to 4 p.m.) is 104. Regular monthly passes are $68; disabled riders pay $44 with their RTD Handicapped I.D. card. Ten-ride coupons are also available for this service at a cost of $18. For additional information regarding the new accessible regional service or for trip planning needs, call 777-3343 until 10 p.m. RTD also announced a get-tough policy on non-function lifts on buses being operated by private contractors. Some buses on accessible routes are now operated by private companies, even though the drivers still wear RTD uniforms and the buses carry the RTD logo. Every time one of those buses gets stopped and its lift isn't working, RTD will automatically levy a $100 fine against the private transit provider. Title: Police arrest 20 in transit protest by handicapped SAN FRANCISCO (AP) – Police arrested 20 protestors outside City Hall Sunday, including one man booked for investigation of assaulting a police officer, as 500 handicapped people from around the country demonstrated over restrictive public transportation. Hundreds of disabled people who are demanding access to public transit systems in every U.S. city have threatened to block city streets, hotel lobbies and entrances to the Moscone Convention Center through Wednesday during a national public transit conference. “If it were women or blacks who couldn’t get on the bus it would clearly be a civil rights issue,” said Kitty Cone of Berkeley, a member of September Alliance for Accessible Transit. An unidentified man was arrested for investigation of assault on a police officer when he got into an altercation with officers arresting protestors in wheelchairs who blocked the main entrance to the stately city building. A reception was being held for members of the American Public Transit Association inside. “The officer fell backward and received a slight concussion when he hit his head on the steps,” police spokesman Richard Galliani said. The other 19 people – all of whom were in the wheelchairs – were arrested for investigation of blocking a sidewalk, resisting arrest and failure to disperse, all misdemeanor charges, said Galliani. They were transported to San Francisco jail in several vans equipped to accommodate wheelchairs. - ADAPT (376)

Chung The San Francisco protests by wheelchair demonstrators seeking better access to public transportation finally rolled to an end yesterday in a Hall of Justice courtroom. Since Sunday, a total of 134 of the demonstrators have been arrested during a series of protests that ranged from a rally at San Francisco's City Hall to a 2 1/2 hour shutdown of the city's historic Powell Street cable car line by a wheelchair army Tuesday. The protests were staged to oppose the policies of the American Public Transit Association, which ends four days of meetings today in San Francisco. Groups representing disabled persons contend that all transit vehicles, even the historic cable cars, should be accessible to wheelchairs. Although there were more demonstrations yesterday, there were no new arrests.' The 43 protesters who were held Tuesday night in a Hall of Justice gym on misdemeanor charges stemming from their arrests were all released yesterday. They had pleaded no contest to a charge of obstruction. Municipal Court Judge Phil Moscone waived $50 fines in light of the time they had spent in custody. Some 90 other protesters who had been cited but not booked also pleaded no contest and their fines also were waived. Outside the courtroom, the hallway echoed with cheers and applause from nearly 100 other persons in wheelchairs as the first group of 14 wheelchair defendants to appear before the judge were released. "They're our heroes," said Connie Arnold of San Rafael. "They're standing up for us and everybody." Inside the jammed courtroom, 6-year-old Jennifer Keelan — the youngest person to participate in the demonstrations — sat in her wheelchair and watched the proceedings with her mother, Cynthia. "I am her parent," her mother said. "But this is her disabled family and these are her brothers and sisters." Earlier in the day, during a bizarre demonstration of just how tough the access problems of the disabled really are, a band of people in wheelchairs were denied access to the federal Department of Transportation offices at 211 Main Street. The entire building is leased by the General Services Administration. When they rolled into the building's elevators to visit the 11th floor offices of the Urban Mass Transportation Administration and the secretary of transportation's regional representative, electrical power to the elevators was abruptly shut off. The visitors were informed by a man in a blue blazer that they were in a private building and not a public building, and that police would be asked to remove them if they did not leave. He identified himself as the building manager, but refused to give his name. Amid cries that they were experiencing George Orwell's "1984," the protesters began chanting: "We will ride. We will ride." However, the elevators did not move. Shortly after noon, San Francisco police warned the demonstrators that they were "on private property, and we ask you to disperse." If they failed to leave, the demonstrators would be arrested, officers said. Protesters used their arraignment Wednesday before Municipal Court Judge Philip Moscone as a platform for a new attack against the American Public Transit Association, which they say has not done enough to provide the handicapped with access to public transit. Moscone allowed designated speakers to address the court after each group of blockaders entered no contest pleas to charges of obstructing a public thoroughfare. The $50 fine the charge carried was dropped as Moscone credited the night the 43 demonstrator spent in jail as "time served." A second charge of failing to disperse was dropped "in the interest of justice," according to Deputy District Attorney Randall Knox. Jane Jackson, who spoke on behalf the first group of 14 wheelchair-bound demonstrators arraigned Wednesday, seized the opportunity to charge APTA with denying handicapped citizens of their civil rights. "It is for this reason that we believe Jack Gilstrap (APTA executive Ace president) should be asked to resign or should be forced to resign," Jackson said. "APTA is not acting in good faith." More than 15,000 public transit officials from around North America attended the four-day convention. Officials of the transit group have said they feel the access question should be handled on a local level. Jackson also said the coalition of handicapped-rights groups, which captured national media attention with four days of protests and blockades across the city, was pulling out of a scheduled meeting with APTA officials Thursday. O’Connor, of the examiner staff Chanting “We will ride!,” 78 disabled protesters used their wheelchairs and their bodies to block the Powell Street cable car line for more than two hours Tuesday before police moved in to arrest them. Urged on by at least 100 supporters who ringed the cable car turnaround at Powell and Market streets and cheered like fans at a boxing match, some of the demonstrators chained themselves to the cow guards of the little cars as bemused tourists looked on. Forty-three of the protesters wound up spending the night in the not-yet-opened $1 million-plus gymnasium on the seventh floor of the Hall of Justice, Sheriff Mike Hennessey said. “There’s nothing but generally pleasant feelings among them,” Hennessey said after inspecting the facilities for the wheelchair-bound demonstrators, who had refused to sign citations issued by the police. Hollyann Fuller Boies, an organizer with the September Alliance For Accessible Transit, said the group selected the cable cars as the focus of their protest because they symbolized the general inaccessibility of all public transit vehicles. "This is a problem that needs attention now,” Boies said. “It’s not just the cable cars, it’s almost every form of public transportation, and nothing is being done to remedy the situation.” But MUNI spokesman Tom Rockert said the protesters’ wrath was misdirected. “A cable car is just the very last thing we could modify to accommodate a handicapped person,” he said. “It has no power. We’d need an awful lot of batteries to power a lift of the type they’d need. Besides, we’re committed to making our rubber-wheeled fleet more accessible to the handicapped.” Rickert said MUNI’s Elderly & Handicapped Advisory Committee, which is made up of elderly and handicapped people, decided “that cable cars could not be modified to be accessible and that from a technical point of view such a proposal is not feasible, practical or safe.” Boies said the people arrested were willing to stay in jail to draw attention to their cause rather than sign the citations offered by the police. By 5 p.m., most of those arrested appeared ready to do just that. Lt. John Gleeson of the police Tactical Detail said 48 of the 78 arrested had refused to sign and were preparing for a night in jail. Henessey said 43 were housed in the new gym. He said the rest were let go for a future court date because they had no prior arrests in the three days of demonstrations. Hennessey said he and his staff, knowing about the demonstrations in advance, had planned for the protesters to be housed in the gym by borrowing cots from San Francisco and Laguna Honda hospitals and other city-operated medical facilities. “Actually, we anticipated 75 to 80 persons,” Hennessey said. Outside the Hall of Justice on Bryant Street, 75 wheelchair-bound sympathizers held a candlelight vigil Tuesday night and chanted, “Let our people go.” The protesters, who also staged noisy demonstrations outside a convention of American Public Transit Association members at Moscone Center Monday and on the steps of City Hall Sunday night, said that they hope their actions will force APTA to adopt a national policy regarding handicapped access to public transit. Headline: Disabled protest transit group’s policies By Ken O'Toole of the Examiner staff Disabled people from across the nation took to the streets of San Francisco Sunday to demand better access to public transportation, rolling through downtown streets in a wheelchair caravan that stretched from Union Square to the downtown Hilton Hotel. Chanting, “We want access” and "We will ride," the crowd of several hundred disabled and their supporters rolled with police escorts to the hotel, where the annual meeting of the American Public Transit Association was taking place. The protesters were halted at the hotel's doors by a line of police, and after a brief rally moved on to City Hall, where they confronted transit association members going to a cocktail party. Police arrested 20 people, including 16 in wheelchairs, for blocking the sidewalk and failing to disperse. They were cited and released. One demonstrator. who was not wheelchair-bound, was booked for felony assault after he kicked a police officer in the chest. Police estimated that there were 500 demonstrators. The march, spirited but orderly, did not seriously disrupt traffic as scores of wheelchair-bound protesters voiced their displeasure with the associations policies and called for restoration of a national transit policy that would require wheelchair lifts on all public buses and trolleys. Both protesters and officials of the Municipal Railway noted the irony of the demonstration taking place in a city that has one of the best disabled-accessibility programs in the United States. California and Michigan are the only states that require all new buses to have wheelchair lifts. However, outside California, most disabled people are "segregated from public transit, and are often regulated to lengthy waiting lists for door-to-door van service" or no service at all, said a spokeswoman for the September Alliance for Accessible Transit. The group, in conjunction with American Disabled for Accessible Public Transit, plans more demonstrations as the transit association meets here through Thursday. Transit association Executive Vice President Jack Gilstrap said, “it's not a disagreement over whether we serve the disabled; it's how its to be done. Our position, and we're consistent with federal law and the courts, is for each community to decide how the service (to the handicapped) should be supplied." He said that lifts can cost $10,000 to $15,000 and that individual communities should be able to decide whether the money might be better spent on other transit woes. "lt's a very emotional issue," Gilstrap said, "but (public-transit agencies) have short resources. You're doing a good job here in the Bay Area, but with an extraordinary level of taxes." Muni spokeswoman Annette Wire said a total of 280 buses In the system have lifts, and 16 Muni lines are totally accessible to the handicapped. At a Union Square rally before the march, Lt. Gov. Leo McCarthy called for full access to public transportation. Saying laws that guarantee rights to all people have been undermined, McCarthy said disabled people have a right to access to school and work through public transportation. "Transportation means independence," McCarthy said, “and independence means opportunity." The Rev. Cecil Williams of Glide Memorial Church called on the disabled to take America to a new task... You may be called to set what's wrong right." A wheelchair-bound San Franciscan named Gill rolled into the crowd of demonstrators at Union Square and said he liked what he saw. But he said, “San Francisco is moving in the right direction. I travel sometimes miles a day (in the electric wheelchair) and I usually don‘! have any problems. except with the occasional inexperienced bus driver." Joe Carley, of Dallas, Texas, said since he was restricted to a wheelchair several years ago, at age 38, I realized: ‘This can happen to at anybody. Transportation is the A-Number 1 concern for anyone who's disabled. Federal and state governments don't really see transportation as a right. We want to live, not just survive."
