San Francisco Hundreds of disabled activists, demanding accessible transit, dramatically confronted “the world’s largest transit exposition” here September 27-30 as they blockaded streets, chained themselves to cable cars, and generally besieged the 15,000 mass transit officials and manufacturers’ representatives at the American Public Transit Association (APTA) Expo ’87. Over 100 protesters were arrested as they pressed APTA to approve a resolution by the September Alliance for Affordable Transit (SAAT) calling for the right of the disabled and elderly to access public transit. SAAT organizer Marilyn Golden called the APTA protests “the largest in disability rights history.” The disabled community has fought against APTA since 1979 when APTA brought a lawsuit that succeeded in overturning a federal regulation requiring that all transit vehicles be accessible to the disabled. Since 1983 the American Disabled for Accessible Public Transit (ADAPT) has organized demonstrations at APTA conventions in Cincinnati, Detroit, Phoenix, New York, and Washington, D. C. to urge a policy change. Until this year when they scheduled two workshops on the issue, APTA has been unwilling to even meet with protestors. Mark Johnson, a demonstrator from Georgia, drew the parallel between these protests and the civil rights movement saying, “There was something wrong when Black people weren’t allowed to sit in the front of the bus, and there’s something wrong when we can’t even go on the bus.” APTA claims that accessibility would cost $15 billion and would bankrupt the nation’s transit districts; they propose instead a system of “paratransit” which would theoretically provide disabled people with flexible door-to-door service but in fact translates into long waiting lists and call-ahead requirements, weekday-only buses and restricted ride purposes. SAAT counters that APTA’s $15 billion figure includes completely rebuilding subways in New York, Chicago and other cities, while the disabled community’s actual demand does not include rebuilding rail systems or even retrofitting existing vehicles, but only that new buses include wheelchair lifts. Also, while arguing that paratransit may be a useful supplement to public transit, Susan Schapiro of SAAT criticized existing paratransit systems as designed with a view of the disabled as “pathetic people in nursing homes going to see the doctor twice a month . . . . It all boils down to discrimination and the belief that these aren’t really people. The APTA delegates could not miss the powerful statement made by the tenacious lines of wheelchair bound demonstrators who spanned several generations in age, were multi-racial in composition, and came from every corner of the U.S. – including eight from Alaska. As demonstrators were being arrested they drove home the irony of being taken away in a lift-equipped paddy wagons chanting, “They can take us to jail but not to work.”

[Headline] Demonstrators ride paddy wagon, not buses By Yvonne Duffy When Mike Gambatto retired from the Detroit Police Department after an on-the-job injury, he probably never thought that one day he would be arrested for obstructing traffic on a public street. He felt so strongly about the importance of Detroit buses being accessible to persons with disabilities, however, that on the morning of November 23 he drove from Lansing to downtown Detroit to join other demonstrators, most of whom were users of wheelchairs or three-wheelers. In 1987, Gambatto was one of the plaintiffs in a class action suit in which the Wayne County Circuit Court ordered the Detroit Department of Transportation (DDOT) to purchase and maintain lifts on their buses and awarded $2.5 million in damages to the more than 1,110 people eventually included in the suit. This protest occurred because this October the MI Court of Appeals overturned the earlier decision, ruling in favor of DDOT and eliminating the monetary damages. The group of about twenty-five huddled at the intersection of Woodward and East Jefferson in hooded jackets, mufflers, mitts, and occasional afghans under a sullen grey sky punctuated by freezing rain and snow flurries. As the traffic light turned red, Gambatto and nine other chair and cart users rolled onto the road to arrange themselves so that when the light changed, traffic was completely blocked on the busy downtown street. Horns honked, and a few drivers got out of their vehicles. One driver, upon learning that the protestors were demonstrating for their right to use the city buses like everyone else, exclaimed, “I’m with you!” raising his hand in the victory sign as he returned to his car. The police were ready. Within minutes, the sergeant in charge approached Frank Clark, a post-polio retiree with a long history of activism to make Detroit more accessible, and informed him that if the group did not return to the curb they would be arrested. When they refused, the paddy wagon, which had no lift, was brought in, and officers began hoisting up the chair users. The chair of one tipped perilously to one side as he was loaded into the van. Gambatto asked to be lifted in separately from his three-wheeler, which sometimes comes apart when lifted. An assisting officer asked if Gambatto had been injured in the line of duty. The fourteen-year veteran of the force explained that a nerve in his neck had been injured when he had attempted to break through a chained door to apprehend a man who had just stabbed a little girl, resulting in a multiple sclerosis-like condition. The officer, visibly moved, replied, “I never actually met a policeman that was hurt on the job before. This hurts- it hits home.” Gambatto was elated about his participation on the demonstration. “I felt like we were doing something worthwhile out there,” he said. “We weren’t breaking a law just to break a law. We were making a point that really needed to be made- that the buses are inaccessible in the City of Detroit.” As mobility Coordinator at Michigan State University’s Program for Handicapper Students, he has become even more keenly aware of the financial and social costs of failing to make public transportation to accessible. “Instead of buying [unreadable], we, as a society, are paying for people to stay home- often for their whole lives. We waste human minds because we’re too cheap to buy wheelchair lifts.” The demonstrators were driven a few blocks to police headquarters where they were given the option of receiving tickets. During the two hours it took for processing, they were held in an unheated storeroom off the garage. There were no accessible restrooms. Nevertheless, there was general agreement among the demonstrators that the Detroit police displayed exemplary sensitivity and courtesy during the arrest and booking. “They were nice to the point of graciousness,” said Verna Spayth of Ann Arbor, an organizer of the action. According to Spayth, the police sergeant, whose late brother had been a polio quad, seemed aware that by his decision to arrest, he rescued them from the freezing rain and, at the same time, attracted attention to their protest by making it a newsworthy event. Ironically, George Harrison, a Detroit resident for 25 years and a wheelchair user for the last six, almost never made it to the protest because the bus driver did not know how to operate the lift. He was fortunate that a more knowledgeable bus driver riding to work came to his rescue. When Roger McCarville of Ortonville, whose both legs were amputated, heard about Harrison’s experience, he “knew he was in the right place.” Citing accessible public transportation as essential for a quality life, McCarville, who owns a company, Handicap Transportation, which carries people with disabilities to non-emergency medical appointments, says, “Lives go beyond medical. There’s a whole social aspect out there, and there’s no service available.” Many who live outside the metropolitan area put themselves on the line to demonstrate unity with their brothers and sisters with disabilities even though they personally did not need the service. For Spayth, Advocacy Coordinator at the Ann Arbor Center for Independent Living, who, last fall, chained herself with several other to buses in downtown Detroit but was not arrested, every opportunity to forge a sense of community is precious. She says, “Whether you get arrested or not, once you’ve chained yourself together with other people with disabilities, it’s totally impossible to look at those people again as separate individuals. Even without words, a bond is created there.” Scott Heinzman of Livonia, adds, “Even though I’m not expecting anything, there could be a time when I might need the help of people in other communities to bring attention to an issue.” For Heinzman, participating in the protest was important for other reasons. Sharing the view that Detroit has been hurt by the mass exodus to the suburbs, he feels that, as a suburban resident, he wants to give something back to the city. “People are people everywhere,” he says, “and if there are problems, problems can be solved.” Heinzman serves on the Advisory Council of the Great Lakes Center for Independent Living, whose offices are in Detroit. A 28-year-old quad, he is also bringing much-needed exposure of children to people with disabilities, through his activity with the Boy Scouts and his local Parent Teacher Organization. Ray Creech, a Canton resident, wanted to “show support for the people in Detroit who really need it [accessible transportation].” Occasionally, when he visits Trapper’s Alley or Greektown, he has tried to use the buses with mixed success. Spayth vocalizes a feeling shared by many in the disability movement: “The easy answer is that when we fight for disability rights anywhere, we fight for them everywhere, but, for me, it goes deeper than that. Every once in awhile, I feel the need to express my anger against my oppressors. What happens next in the fight to make DDOT buses reliably accessible and restore the monetary damages awarded by the lower court three years ago? The next step in the judicial process, according to Justin Ravitz, attorney for the plaintiffs, is an appeal to the Michigan Supreme Court. If the justices “have any sensitivity or allegiance to the law, they will surely hear our case,” he says. This process could take months or even years, however. Meanwhile, Detroiters with disabilities want to ride. The Denver Post Friday, Dec. 18, 1981 [Headline] Handicapped Will Protest RTD Wheelchair-Lift Ban By George Lane Denver Urban Affairs Writer The board of directors of the Regional Transportation District Thursday made it official – there will be no wheelchair lifts on 89 high-capacity buses expected to be delivered in 1983. The board actually decided a month ago there would be no lifts on the new buses, but they have been hedging on finalizing that action because of objections voiced by the area’s disabled community. Following the vote on the lifts, Wade Blank, co-administrator for the Atlantis Community for the disabled and organizer of the protest against the RTD action, told the transit directors that members of the handicapped community view the action as a violation of their human rights and they will respond to that violation Jan. 4. Blank later said members of the disabled community will be in “training for civil disobedience” between now and Jan. 4. He said beginning Jan. 4, 10 disabled persons in wheelchairs will stage a sit-in in the office of L.A. “Kim” Kimball, RTD’s executive director and general manager. “Everyday during the month of January, 10 disabled people will be occupying Kimball’s office,” Blank said. They won’t have any able-bodied people with them – and if they’re arrested they will be replaced by 10 more. At the conclusion of the board meeting, Kimball told the directors that the RTD staff will take steps to try to prevent this action, but he doesn’t think it proper to discuss those steps at this time. The RTD board during its Nov. 19 meeting voted to save more than a million dollars by not ordering the lifts on the new buses. The RTD staff recommended this action because they said the lifts are expensive (more than $12,000 per bus) and difficult to maintain. The staff proposal was to use the articulated buses on high ridership bus routes, freeing regular buses with wheelchair lifts to provide better service for the handicapped. A delegation from the handicapped community objected to this proposal, with arguments that RTD officials had promised several years ago that 50 percent of the district’s bus fleet would be made accessible to wheelchair-bound riders and all new buses would be ordered with lifts. About 25 disabled persons from Atlantis staged a wheelchair-bound sit-in following the November meeting until Kimball and three board members promised to attempt to get the entire board to reconsider the action. Thursday’s vote was the outcome of that promise.

Rocky Mountain News, Fri., Sept. 2, 1977, Denver, Colo p.6 [Headline] Handicapped seek ruling on RTD service By CLAIRE COOPER News Staff Wheelchair-bound witnesses Thursday urged a federal judge to order the Regional Transportation District to equip new buses with devices to facilitate transportation of the disabled. RTD has 231 buses on order. Only 18 of them will be outfitted for passengers in wheelchairs. Handicapped and elderly plaintiffs have filed a lawsuit in Denver U.S. District Court claiming RTD will discriminate against them if it fails to provide them with suitable bus transportation. The plaintiffs have asked that the buses be equipped with boarding ramps or hydraulic lifts and with interior devices to hold wheelchairs in place. During the hearing before Judge Richard P. Matsch, an arthritic youth complained that he faces “social isolation“ because of lack of transportation. ROBERT CONRAD SAID. “lf l don‘t get out, l’ll go crazy. I don't like looking at four walls." Conrad said it’s often impossible for him to board regular buses because oi‘ the pain in his legs. When he can do it, he said, he suffers embarrassment because it takes him three minutes to negotiate the steps. Other witnesses also complained about the social and psychological consequences of being unable to use the public transportation system. Glenn Kopp said he feels like “a second-class citizen.” Kopp is co-director of Atlantis Community Inc., an organization of disabled persons. His job is to help the handicapped become self-sufficient. But for Kopp to go to work, he said, "I have to depend on somebody to pick me up.” Carolyn Finnell said, “I just don't like using people as tools" for transportation. Marilyn Weaver said the lack of transportation isolates her from" her friends and her parents. "They do come to see me, but it would be nice sometime to go home," she said. Ms. Weaver and others testified that economic burdens are forced on them by the necessity of hiring private transportation. Ms. Weaver said she spends about $120 a month, one-fifth of her income, for “ambocabs," a private taxi service for passengers in wheelchairs. Ambocab charges $18 for a round trip, Kopp said. Ms. Weaver claimed the high cost deters all but essential use. “I should be getting therapy more than I do,“ said the 38-year-old polio victim, adding that her financial situation determines whether she can afford transportation to her therapist. SEVERAL WITNESSES said confinement to their neighborhoods means they have to pay more for groceries and other necessities. Kopp said he doesn’t like to ask friends to take him shopping because it takes along time him to go through the stores. The witnesses said RTD’s HandiRide service for the disabled isn't a good solution to their transportation problems because it makes only scheduled stops at medical facilities, schools and places of employment. Ms. Weaver, who works at Atlantis, said she takes the HandiRide to work because she starts at a set time. But she has no set quitting time, so she can't take it home. According to the complaint, HandiRide serves fewer than 150 persons. The complaint says about 17,600 persons in the Denver-Boulder area are being denied public transportation because of "unnecessary physical and structural barriers in the design of transit buses." Lawyers representing RTD have not presented defense testimony. The hearing continues Friday.

Glenn Anderson and held a second day of demonstrations in downtown Los Angeles protesting a lack of access to public transportation. About a dozen protesters, many of them in wheelchairs, crowded into the suburban Long Beach office of Anderson while others remained in the hall outside, said Anderson's executive assistant, Ann Ramirez. Anderson, a Long Beach Democrat, is chairman of the House Transportation Committee. Ramirez said the congressman had been scheduled to be at his office and at a speaking engagement in Los Angeles yesterday but had to cancel those plans and stay in Washington because of a heavy workload. ln Los Angeles, about 35 wheelchair-bound demonstrators protested peacefully while the American Public Transit Association held its annual conference. On Sunday, eight persons were arrested for investigation of failure to disperse and interfering with police as about 130 activists staged a demonstration. The arrests occurred after a procession of wheelchairs carried people with disabilities ranging from cerebral palsy to postpolio paralysis from MacArthur Park to the Bonaventure. "This is beautiful I am proud to be a disabled person. l am tired of being closed away," said Bob Kafka, of Austin, Texas, as he wheeled along. Kafka, a spokesman for the American Disabled tor Accessible Public Transit — and who has a broken spinal cord - was among those arrested later. The protesters had no permit to stage the parade, but Los Angeles police refrained from arresting paraders as they said they would. “Listen, how could we arrest all these people?" Capt. Bill Wedgeworth said. Along the parade route, motorists slowed to watch, The protesters targeted the convention because the transit association opposes a national policy mandating wheelchair lifts on buses, preferring to let each transit agency deal with access for the disabled locally. The protesters shouted, "Access now! Access now!" as police blocked them near the entrance, one floor above the main reception area. The Southern California Rapid Transit District has wheelchair lifts on 1,691 of its 2,445 buses, a spokesman said, and is retrofitting an additional 200. The eight arrested were not all immediately identified, but police said two were Edith Harris ol Hartford, Conn, and George Florom of Colorado Springs, Colo.

[Headline] Protesters hold workers hostage by Arthur Moczygemba, Express News Staff Writer Members of a group wanting improved access for the handicapped invaded the VIA office at 800 W Myrtle on Monday and used their wheelchairs to block all access to the building for about 90 minutes. Some 34 VIA employees held hostage inside their offices were released after police negotiated for a meeting with local and national transportation officials. The later session led to an airing of demands by about 60 members of the American Disabled tor Accessible Public Transportation. Police rented vans, in case the protesters were arrested. Bernie Ford of Chicago, president of the American Public Transit Association, and Wayne Cook, general manager of VIA, met with the ADAPT members Monday afternoon, but both sides stuck to their respective positions on public bus access for the handicapped. Ford was in San Antonio to attend the western conference of APTA, meeting at the Hyatt Regency Hotel through Wednesday. About 15 police officers were on duty there, Toscano reported. Ford refused to grant the ADAPT members 20 minutes of speaking time before the general transit membership, saying that a scheduled Wednesday work session on handicapped access was sufficient for consideration of the problem. Laura Hershey of Denver and Jean Stewart of Poughkeepsie, N.Y. listed the ADAPT demands, which included a policy change by the mass transit system that all new buses purchased be equipped with lifts that allow wheelchair-bound persons to use buses. ADAPT claims that it costs $8,000 to $10,000 to equip a new bus with lifts for the handicapped, while air conditioning a bus costs more “and doesn't always work." “It's a question of priorities," said Mike Auberger of Denver, where ADAPT is headquartered. After a 30-minute session, the only agreement between the ADAPT members and Ford was allow the group to publish an article in the September issue of the association's monthly newspaper. Cook was grilled about the San Antonio situation by Bob Kafka of Austin, a Texas ADAPT official. Cook said the VIA Para-Transit system used in San Antonio, which uses specially equipped vans to transport the handicapped was implemented upon recommendation by a 26-member task force, which included handicapped persons. “This is why you don‘t see San Antonians join your cause,” Cook said. Kafka retorted that numerous San Antonio handicapped members have contacted ADAPT, and refuted Cook's contention that the majority of the local handicapped persons support the VIA Para-Transit program because it is segregationist. “This is not to say you're lying,” Kafka told Cook, “but you are distorting the truth." The ADAPT members then read a statement submitted by Willis Williams on behalf of the San Antonio Citizens Concerned about Handicapism. The SACCH statement said the group declined to participate in the ADAPT demonstration but added: “It is our long-standing position to support the concept of a multimodal system with both lift-equipped mainline buses and door-to door service vans as the best and most economically sound approach for San Antonio." The statement was issued on behalf of Larry Johnson, chairman of San Antonio Independent Living Services, and Joyce Jenks, president of SACCH. "Twenty (VlA) vans cannot possibly serve 50,000 mobility impaired citizens," according to Jenks. The 60-member ADAPT group was composed mainly of Texans, with - others from Colorado, Illinois, and New York. Three people attending the protest identified themselves as San Antonians who came as individuals because their organizations are tax-exempt and do not participate in demonstrations. Tommy Leifester, 1100 Callaghan, said the VIA task force did not represent the majority of San Antonio handicapped. Leifester assisted Toscano in the negotiated settlement. Leifester stated that although local handicapped persons were not very visible at the protest, "This will help get our story out in public. VIA has been putting out only one side of the story." During the shuttle diplomacy segment the protesters chanted: “We will ride! Access now!" and demands for Cook to meet with them. Cook was not in his office since he was attending the mass transit convention at the hotel. He arrived at 12:10pm. Although the VIA employees were released about 12:30 p.m. and given the rest of the afternoon off, ADAPT members stayed until Ford showed for the meeting about 2:30 pm.

Cooley, Times Staff Writer About 20 disabled people blocked a Trailways bus for more than two hours Saturday at the downtown terminal until the terminal manager agreed to ask a company executive to meet with the disabled group concerning difficulties wheelchair-bound people have with bus travel. The group which represents American Disabled for Accessible Public Transportation (ADAPT), was in town to meet with members of the American Public Transit Assn. today. Representatives of ADAPT said they want a legislation requiring all new buses operated by private companies such as Greyhound and Trailways to be equipped with wider doors, lifts and ramps. Most public transportation operators, including San Diego Transit, provide wheelchair lifts on at least some buses. ADAPT member Claude Holcom bought a ticket to Los Angeles, but when Trailways' personnel told him they would have to fold his wheelchair and carry him to his seat, Holcom declined to board the bus. "We don't think a person should have to be carried aboard a bus," said Wade Blank, one of the protest's organizers. “It's very dehumanizing. They’re taking away their legs." Blank and fellow ADAPT member Mike Auberger said the group is trying to draw attention to the frustrations of traveling by bus and being in a wheelchair. Although both Trailways and Greyhound buses are not equipped to handle wheelchairs, Blank said ADAPT met with Greyhound officials last week to discuss the possibility of fitting new buses with lifts. “This is a symbolic protest, just like the civil rights protests of the '60s, but we have the right to travel the same as anybody else," Blank said. "The wheelchair is like somebody's legs." The Los Angeles bus, with its two passengers, was scheduled to leave the C Street station at 4:15 p.m., but by the time terminal manager Fred Kroner arrived and negotiated with the ADAPT members, it was nearly 7 o'clock before it departed. The two passengers appeared surprised and baffled by the protest and by queries from members of the news media. One man opted to go to the Greyhound terminal two blocks away and catch another bus rather than wait out the protest. The other passenger, Mich Galloway, 23, said he was sympathetic to the group wanting equal access to buses and waited patiently until the protesters dispersed. “I see where they are coming from." Galloway said. "I hope something is done about it." After several phone calls to the Trailways corporate offices in Dallas proved fruitless. the ADAPT members agreed to accept from Koner the name, address and phone number of the company‘s public relations officer. who they intend to call Monday. "l really can't do anything about the situation. l'm just this terminal's manager." Koner said.

Article reads: Washington -- It was a scene reminiscent of the 1960s civil rights demonstrations as angry protesters chanted slogans, picketed the White House and stopped traffic before they were finally dragged away by police. And the series of confrontations that ended with 27 arrests last month seemed to come down to a similar central issue— the right to sit on a bus, to have full access to public transportation. There was one striking difference, however. Unlike Rosa Parks and the black civil rights activist who battered down the Jim Crow barriers in the South, these protesters were in wheelchairs, and their goal was equal access for the physically handicapped. “It's a civil right to be able to ride public transportation," said Julia Haraksin, a wheelchair-bound Los Angeles resident who participated in the demonstrations. “In the ‘60s, the blacks had to ride in the back—and we can't even get on the buses." New, Radical Tactics Organizations representing handicapped persons long have urged Washington to require that new buses and rail systems built with funds from the Department of Transportation's Urban Mass Transportation Administration be equipped to accommodate handicapped riders. But Haraksin and other handicapped individuals like her now are beginning to press the old arguments with new, more radical tactics. Frustrated by years of negotiating, lobbying in Washington, going through the courts and staging non-confrontational protests, some members of the handicapped community now are resorting more actively to confrontations and civil disobedience. Thus, early in October, 100 members of a newly formed coalition called American Disabled for Accessible Public Transit confronted a national meeting of city transportation heads here, using the kind of civil disobedience tactics used 30 years earlier by Dr. Martin Luther King Jr. Protesters were arrested when they blocked entrances and buses of those attending the American Public Transit Assn. convention. The strategy was to physically be a barrier because handicapped people have to face barriers all their lives," Wade Blank, a founder of Denver-based ADAPT said. Calling the protests here " Selma," leaders of ADAPT claimed victory and promised that their struggle has only begun. They already are focusing their efforts on what they hope will be a larger demonstration at the next meeting of the American Public Transportation Assn. a year from now in Los Angeles. But they and their cause may be in for a tough battle. Their opposition comes from the Reagan Administration, from many city governments and even from within the handicapped community. And as public attention focuses on the underlying budget choices involved, the opposition may swell with the addition of taxpayers concerned about the possible costs of a national full-access program. ADAPT argues that a legal right to full access for the handicapped already exists. Federal law states that Urban Mass Transportation Administration funds — which account for about 80% of the costs of new and replacement equipment in most municipal transportation systems—cannot be spent on programs that discriminate against, or exclude, the handicapped. The law does not make clear, however, whether handicapped persons must be provided with access to regular bus lines or whether they can instead be provided with alternative transportation systems. Nor does it indicate who should make that decision. Cities Make Decisions Current Transportation Department policy, which is strongly supported by the American Public Transportation Assn., allows each city to make its own decision on what type of transportation it will provide for the handicapped. This is in sharp contrast with Carter Administration policy, which in 1979 interpreted federal regulation to mean full access. Members of ADAPT, opposing the separate-but-equal philosophy of paratransit argue that it does not meet the needs of the handicapped and that it is inherently discriminatory. "It segregates the disabled people from the able-bodied community," Mike Auberger, an organizer for ADAPT, said. Because paratrasit requires advanced scheduling [unreadable] a ride is needed, he said, “you have to schedule your life according to the system. No one else has to do that. That shows the inequality right there." He and other members of ADAPT contend that because of long waiting lists for paratransit, some cities refuse to offer the service to new users - thus cutting off thousands of handicapped persons from any public transportation. Transit authorities, on the other hand, argue that full access can be too expensive, given the low percentage of handicapped riders in many cities. Lift-fitted buses cost an estimated $8,000 to $10,000 more than regular buses. Furthermore, lift systems are often unreliable and time-consuming to operate and maintain, transit administrators say. In Denver, for example, the transportation district has spent $63 million to purchase or retrofit buses with lifts. 80% of which was paid for by the federal government, according to spokesman Gene Towne. Since it started mainline access in 1982, the district has spent close to $1 million in maintenance of the lifts and expects to spend an additional $900,000 this year. Yet of the district's total annual ridership of 38 million, only 12,000 use the lifts, according to Towne. ADAPT counters that the issue is not cost but civil liberties. “In America we have a way of hiding, our prejudices with pragmatism," said Blank, a Presbyterian minister and veteran of the civil rights and anti-war movements of the 1960s who now supports handicapped activists. Variety of Approaches Across the country, cities are using a variety of approaches to the problems of providing mass transit for the handicapped. In Los Angeles, mainline access is required by state law. Although 1,850 of the Southern California Rapid Transit District‘s 2,400 buses are fitted with wheelchair lifts some local advocates charge that the RTD gives only "lip service" to access, complaining of broken lifts, drivers who do not know how to use the equipment or refuse to do so and an overall lack of commitment to providing access. The system provides only about 1,400 rides a month according to the RTD. Handicapped activists charge that the low ridership is attributable to the system's poor management. There were and are people in the operation department (of the RTD) back there who were and are opposed to the idea of access from day one," Dennis Cannon, a Washington-based expert who helped to plan the RTD's access program in the 1970s said. But in the last six months, the RTD has made "a major effort" to overcome the problem, according to RTD General Manager John A. Dyer. The system boosted its fiscal year 1985 budget for handicapped service by $3 million, to $4.9 million, to provide for a program to educate drivers and upgrade the quality of equipment and service. In Oakland, half the city's 800 buses are lift-equipped and all of the Alameda — Contra Costa Transit District's new buses will be lift-equipped. Seattle’s Services In Seattle, 570 of 1,100 buses are accessible to the handicapped, providing about 5,900 rides a month. The Municipality of Metropolitan Seattle also contracts with private groups to supply paratransit bus and half-fare cab service, providing a total of 8,400 rides a month in Denver. 432 of the city's 744 buses are lift- or ramp-equipped, providing more than 1,000 rides per month. The city also uses 13 vans and small buses in a paratransit system that provides 3,200 rides a month. In New York City, where an estimated 35% of all the transit passengers in the country use Metropolitan Transportation Authority vehicles each day. half of the city's 4,333 buses are fitted with lifts. The city has no figures on how many handicapped riders use the system, but one official calls the number minuscule. A new state law calls for $40 million over the next eight years to retrofit “in the neighborhood of 30" subway stops for handicapped use, according to a transit authority official. In addition the law will increase the percentage of lift-equipped buses to 65% of the fleet, as well as provide a paratransit system in the city by 1988. Minneapolis-St. Paul uses 45 paratransit buses and contracts with private cab companies to carry handicapped persons in all, the city provides 40.000 trips a month. None of Chicago's 2.400 regular buses are fitted with lifts. Instead the city provides 42 paratransit buses, which offer 12,000 rides a month. Additionally, 14 of the city's subway stops have been retrofitted for handicapped access and 300 of Chicago's 1,100 subway cars are accessible. If there is a diversity of approaches to the problem, there is also a diversity of views on the militant new tactics used by ADAPT and its supporters. The views of the handicapped people are all over the lot on what type of transport they'd like," Bob Batchelder, counsel for the APTA, said. But transit specialist Cannon, himself a wheelchair user, counters: “I'm talking to disabled people who wouldn't do what ADAPT does ... but who support what they are doing and think it needs being done." Whether ADAPT's controversial style will work remains an open question. While no negotiations are scheduled, ADAPT leaders vow to continue to harass association meetings. But in Los Angeles, the RTD's Dyer indicated that he hopes demonstrations will be replaced at next year's convention with “serious dialogue and discussion of the issues." "It’s a new thing for the disabled to see themselves with power," ADAPT's Auberger said, "but it's also a new experience for the powers that be."

Police Arrest Denver Disabled Protestor MIKE AUBERGER, a community organizer for the Atlantis Community in Denver and a member of the American Disabled for Accessible Transit (ADAPT) is arrested by Washington, D.C., police outside the Washington Convention Center where the national convention of the American Public Transit Association (APTA) was just getting under way. A spokesperson for APTA said that the demonstrations only delayed the start of the convention by a few minutes. Inside the convention hall Secretary of Transportation Elizabeth Dole abandoned her prepared text and said the administration was working to provide public transit for the disabled. Outside the hall, demonstrators branded the secretary's plan as another “separate but equal" scheme and demanded that the federal government require all public transit systems be made accessible to the handicapped. Demonstrators not only blocked the entrances to the convention but also surrounded chartered buses that took delegates from their hotel to the convention center. The disabled activists represented a number of cities, including Denver, Syracuse, N.Y., Boston, El Paso, Los Angeles and Chicago. Additional photo on page 4. 28 Busted in D.C. The 28 disabled activists who were arrested for civil disobedience during the national convention of the American Public Transit Association (APTA) in Washington, D.C., last month are trying to raise $1500 to make their bail money by a Dec. 3 deadline. At the same time, they're preparing to carry their demand that the APTA members buy only wheelchair-lift equipped buses to the transit organization's regional convention in San Antonio on April 20. The Texas contingent from the American Disabled for Accessible Public Transit (ADAPT) under the leadership of Jim Parker of El Paso has been especially militant in their demands. Taking their lead from an editorial in the September Handicapped Coloradan, a coalition of of Texas disabled groups met in San Antonio and voted to ask transit systems in Texas to withdraw from APTA unless it goes on record supporting accessibility. The Colorado chapter of ADAPT was planning to introduce a similar resolution to Denver’s Regional Transportation District (RTD). APTA's position is that accessibility should be left to the discretion of the local transit provider, Although the Carter administration mandated accessibility in public transit, APTA was successful in getting that ruling thrown out in a l98l court battle. ADAPT maintains that the disabled have a civil right to public transit. Jack Gilstrap, APTA's executive vice president, reiterated that position as wheelchair demonstrators seized buses in front of the White House and hurled their chairs at police lines outside the Washington Hilton and Washington Convention Center during APTA's late September meeting. Gilstrap said that the funds just weren't there to support a mandatory system, adding that the additional burden might jeopardize some transit systems. However, since the convention ADAPT has been approached by APTA's new president, Warren Franks, the director of the Syracuse, N.Y., transit system, who has requested a meeting in Denver with wheelchair activists. "The Syracuse ADAPT group has been pretty active," said ADAPT spokesperson Wade Blank. "Franks must be pretty worried about what might happen there if he wants to meet with us.“ ADAPT was organized in Denver one year ago by some of the same groups and individuals who had been involved in forcing RTD to adopt a pro-accessibility policy when purchasing new buses. That battle too was highlighted by militant demonstrations with wheelers chaining themselves to the doors of RTD headquarters. In contrast, demonstrators restricted themselves to orderly pickets when APTA held its national convention in Denver in 1983. But ADAPT only abandoned its plans for civil disobedience after APTA met its demands to address the entire convention on accessibility. APTA's national staff fought that request and allegedly threatened to pull the convention out of Denver at the last minute, but finally agreed to allow ADAPT to address the meeting after Denver Mayor Federico Pena intervened. There was no question that ADAPT would be offered the same treatment at the Washington convention. Although they didn't get a spot on the agenda Blank said his group made their point by capturing the attention of the capital's media. Even before the convention opened, ADAPT made its presence known by joining forces with local D.C. activists to seize seven Metrobuses and block the five blocks along Pennsylvania Avenue in front of the White House during the afternoon rush hour. Demonstrators released the buses an hour later when D.C.’s Metro General Manager Carmen E. Turner agreed to meet with Washington disabled leaders to discuss their demands for a fully accessible system. No date has yet been set for that meeting, which ADAPT said marked an historic first in the Washington area. No arrests were made during that demonstration, although Washington police moved several demonstrators out of the street. But on the following Monday and Tuesday 28 demonstrators were arrested as they tried to block buses leaving the Washington Hilton for the convention center and again at the convention center itself. The police threw up lines as picketers arrived but were unable to halt the advance of the demonstrators, who wedged their chairs in the hall's doors or hurled their bodies onto the ground. Mike Auberger, one of those arrested, said the police "were abusive -- there's no doubt of that," but he added that this was probably pretty typical. “Let's face it," he said, "these guys probably have to deal with demonstrators all the time." They don't mess around when they get started. Auberger said he was grabbed by the hair and pulled back so that his chair was resting on its back wheels. Two other demonstrators were thrown from their chairs and taken to local hospitals where they were released after being treated for minor injuries. Police had to bring in special vans with wheelchair lifts in order to cart demonstrators off to jail, where they were fingerprinted and rushed into court. "Only the doorway between the holding cells and the courtroom was too narrow to get our chairs through," Auberger said, "so they had to take us in the back way." Some of the disabled picketers were surprised that the police reacted with such force, according to Auberger. "l think it opened a few eyes," he said. ADAPT filmed the demonstration, and a 20-minute edited version is being shown as part of a fundraiser to pay the bails of those arrested, about half of whom were from Denver. Congresswoman Pat Schroeder (D-Denver) has agreed tn help raise money, but because of previous campaign commitments said she would be unable to participate until after the first of the year.

The hour-long protest was aimed at demonstrating the lack of access to buses that handicapped persons endure both locally and nationwide. The demonstrators agreed to release the buses—by abandoning their position in front of the vehicles—only after Metro General Manager Carmen E. Turner agreed to meet with them. The demonstrators. representing a national group called American Disabled for Accessible Public Transit, said they wanted all new Metrobuses to be equipped with power equipment that lifts wheelchairs into buses. AIso, they said, they want the Department of Transportation to allocate more funds for equipping buses nationwide with the lifts. "We say it's a civil right, just as they denied black people the right to get on a bus and now allow them access." said Mike Auberger of Denver, a spokesman for the group. “It's a right like being able to go to school." Presently, Metro schedules a limited number of runs with buses equipped with lifts, or dispatches the buses if a handicapped person requests on the day before. The protesters said a lift costs $8,000 on a $180,000 new bus. an amount they said is far below the cost of an air conditioner. "I’ve called for buses, and they break down said Ronald L. Smith, who sat in a wheelchair in front of the Old Executive Office Building. "We want all the buses to be for the handicapped." Beverly Silverburg, director of public affairs for Metro, said last night that the group will meet with Assistant General Manager Theodore Weigle and Turner "will probably meet with the group." The protest began at 1:15 p.m., when the demonstrators announced to reporters that they were going to surround the next bus that stopped in front of the White House. It happened to be one marked "Brookland." Several demonstrators lay down on the street or leaned against the front of the bus while supporting themselves on crutches. A second contingent blocked another bus that had just pulled up behind the first. "What's going on?" Theodore R. Wright, the driver of the Brookland bus, said to no one in particular. The protesters told him they wanted to meet with Turner to present their grievances. As riders disembarked, Wright called his dispatcher. "I'm looking at two buses that are blocked," he said "They want Carmen Turner." Wright said he once drove a bus equipped with a power lift for six months and never had a handicapped rider. But he added, "l sympathize with these people. Probably they have some legitimate beefs." As the impasse dragged on, the protesters took over a third bus as it was trying to pass the first two. Police persuaded the protesters to let it go, but they became more agitated and began blocking buses across the street in front of Lafayette Square. By 5 p.m., police had cordoned off the section of Pennsylvania Avenue NW in front of the White House, disrupting rush-hour traffic in all directions. Metro supervisors came and went, and one protester was taken to George Washington Hospital after he fell off his wheelchair. By 5:30 p.m., the protesters had corralled seven buses, would-be passengers were complaining that they could not find a bus, and bus drivers were lining the streets. At 5:35 pm., D.C. Police Lt. W.R. Sarvis passed the word that Turner had agreed to the meeting. The demonstrators uttered whoops of joy and hugged each other. “No confrontations, no problems," said Sarvis. The protesters said they also plan to present their demands to the American Public Transit Association, which meets here Sunday.
