[Headline] The eyes of Texas are on outside agitators -- and a lot of folks from down the street There's never been much love lost between Coloradans and Texans, at least not since those folks from the Lone Star State first wandered into the Rocky Mountains and discovered deep powder in the winter and cool valleys in the summer. As Winnebago after Cadillac after pickup poured across Raton Pass, Coloradans greeted Texans with open cash registers and - increasingly -- ridicule. Our scorn for Texans even reached into the highest office in the state when Governor Dick Lamm greeted his Texan counterpart with this joke: A Texan died here recently and we couldn't find a coffin large enough, so we gave him an enema and buried him in a shoebox. Texans were not amused, though by now they should have come to expect such treatment. We've been squabbling ever since a detachment of Colorado militia turned back a Texas Confederate army at Glorietta Pass during the Civil War. Each summer now we give Texas a chance to even the score down near Alamosa in a rotten tomato battle. OF course we always make sure our army's bigger. That animosity, however, doesn't carry over to the disabled population of the two states. In fact, a dozen or more militant wheelchair activists from Colorado have been rolling onto the streets of several Texas cities during the past couple of years to aid their counterparts in the battle to force Texas transit systems to make their buses wheelchair-accessible. "After Colorado, Texas is out best organized state," Wade Blank, the long haired ex-preacher who helped found American Disabled for Accessible Public Transit (ADAPT) in Denver two years ago. ADAPT chapters have sprung up in several other states, notably Illinois, Maine, and Connecticut, but none have garnered as many active members as Texas. Scores of Texans have blocked buses in San Antonio, Houston, Dallas and El Paso in recent months to focus the attention of the state's media on the lack of accessible buses. Part of ADAPT's success in Texas lies in the fact that there are so few lift-equipped buses in this huge state. Some Texas cities did order accessible buses when the Carter administration's Department of Transportation ordered mandatory accessibility in the 1970s. However, most of these lifts were never used as the American Public Transit Association (APTA), a national lobbying and policy making organization for transit systems, successfully fought the regulation in federal appeals court. APTA maintains that the local transit provider is the best judge of whether or not accessibility is feasible. Adverse climatic and geographical conditions are generally cited as the chief obstacles to lifts. Texas ADAPT leaders point out that few areas in Texas experience severe winter storms and that the state's larger cities are generally laid out on flat plains. That was one of the points wheelchair activist tried to make when they picketed in April 1985 regional APTA convention in San Antonio. A sizable contingent of Coloradans joined those picket lines, leading to a charge by the local newspaper, the San Antonio Light, that the demonstration was the work of outside agitators and that most of the city's disabled population was quite happy with using paratransit. Spot demonstrations and bus seizures soon followed in other Texas cities, while some Texas ADAPT members turned outside agitators themselves by participating in demonstrations at the APTA national convention in Los Angeles in October 1985. Several Texans including Jim Parker of El Paso and Bob Kafka of Austin, were among The dozens arrested. Supporters of lifts point to cities like Seattle and Denver where most of the buses are accessible -- and increasingly free of breakdowns. Denver's Regional Transportation District (RTD) maintenance crew made a few simple changes in some of their lift systems and managed to operate experimental buses without a single breakdown. ADAPT argues that some transit providers have deliberately sabotaged their lift systems to justify removing them. Opponents of lifts argue that paratransit--usually vans that pick riders up at their residences -- is more cost effective. Supporters point to Seattle where the cost per ride on mainline buses is less than $15 a trip, which compares very favorably with the best deals offered by paratransit systems. Convenience is a major factor too, according to Mike Auberger of ADAPT-Denver, who points out that most paratransit systems require two days' advance notice and users might have to travel all day just to keep a 15 minute dental appointment. "Me, I like being able to roll down to the corner bus stop," Auberger said. ADAPT grew out of coalition of Denver disabled groups who were successful in battling RTD over wheelchair lifts. Protestors seized buses and chained themselves to railings at RTD headquarters before the battle was won. Two years ago they went national when their arch foe, APTA, held its national convention in Denver, APTA refused to allow ADAPT to present a resolution to the convention calling for mandatory accessibility until pressure was brought to bear by Denver Mayor Federico Pena, a pro-lift advocate. APTA declined, however, to vote on the issue, and ADAPT picketed the group's 1984 national convention in Washington, DC, in October. Twenty-four protestors were arrested during the demonstration, including Parker. Parker, who was joined in Washington by four other Texans, isn't through with APTA yet. When that group holds its Western Regional Convention in San Antonio April 20, Parker said they can expect almost as many demonstrators as went to Washington. "I can't think of any place in Texas where it (public transportation for the disabled) is as good as it is here in Denver -- in fact it's poor everywhere here. Dallas just decided to buy 200 or 300 new buses without lifts." The situation isn't any better in his home city of El Paso, according to Parker. "It's very poor here," he said. "There are 30 city cruisers here with lifts but the city has shown no desire to use them." Parker thinks too many people in wheelchairs are too passive. "They're not used to pushing people, but we're starting to see some changes." However, Parker points out that Texas is a very conservative state and people -- including the disabled -- are slow to change. Dallas Times Herald, Saturday Nov. 24, 1984 [Headline] Wheelchair activist adopt radical tactics Los Angeles Times WASHINGTON — It was a scene reminiscent of the 1960s civii rights demonstrations as angry protesters chanted slogans, picketed the White House and stopped traffic before they were finally dragged away by police. And the series of confrontations that ended with 27 arrests last month all seemed to come down to a similar central issue —- the right to sit on a bus, to have full access to public transportation. There was one striking difference, however. Unlike Rosa Parks and the black civil rights activists who battered down the Jim Crow barriers in the South, these protesters were in wheelchairs, and their goal was equal access for the physically handicapped. "It's a civil right to be able to ride public transportation," says Julia Haraksin, a wheelchair-bound Los Angeles resident who participated in the demonstrations. Organizations representing handicapped persons long have urged Washington to require that all new buses and rail systems built with funds from the Department of Transportation's Urban Mass Transportation Administration be equipped to accommodate handicapped riders. But Haraksin and other handicapped individuals are beginning to press the old arguments with more radical tactics. Frustrated by years of negotiating, lobbying in Washington, going through the courts and staging non-confrontational protests, some handicapped activists now are resorting to confrontations and civil disobedience. Thus, early in October, 100 members of a newly formed coalition called American Disabled for Accessible Public Transit confronted a national meeting of city transportation heads here, using the kind of civil disobedience tactics used 20 years earlier by Dr. Martin Luther King Jr. Protesters were arrested when they blocked entrances and buses of those attending the American Public Transit Association convention. “The strategy was to physically be a barrier because handicapped people have to face barriers all their lives," Wade Blank, a founder of Denver-based ADAPT, said. Calling the protests here “our Selma," leaders of ADAPT claimed a public relations victory and promised their struggle has only begun. They already are focusing their efforts on what they hope will be a larger demonstration at the next meeting of the American Public Transportation Association a year from now in Los Angeles. But their cause may be in for a tough battle. Their opposition comes from the Reagan administration, from many city governments and even from within the handicapped community. And as public attention focuses on the underlying budget choices involved, the opposition may swell with the addition of taxpayers concerned about the possible costs of a national full-access program. ADAPT argues a legal right to full access for the handicapped already exists. Federal law states Urban Mass Transportation Administration funds — which account for about 80 percent of the costs of the equipment in most municipal transportation systems —- cannot be spent on programs that discriminate against, or exclude, the handicapped. The law does not make clear, however, whether handicapped persons must be provided with access to regular bus lines or whether they can instead be provided with alternative transportation systems. Nor does it indicate who should make that decision. Current Department of Transportation policy, which is strongly supported by the American Public Transportation Association, allows each city to make its own decision on what type of transportation it will provide for the handicapped. This is in sharp contrast with Carter administration policy, which in 1979 interpreted federal regulations to mean full access. Members of ADAPT, opposing the separate-but-equal philosophy, argue that paratransit does not meet the needs of the handlcapped and is inherently discriminatory. “lt segregates the disabled people trom the able-bodied community," Mike Auberger, an organizer for ADAPT, said. Because paratransit requires advanced scheduling, sometimes weeks before a ride is needed, he said, “you have to schedule your life according to the transit system." Transit authorities, on the other hand, argue full access can be too expensive, given the low percentage of handicapped riders in many cities. Lift-fitted buses cost an estimated $8,000 to $10,000 more than regular buses. Furthermore, lift systems are often unreliable and time-consuming to operate and maintain, authorities add. In Denver, for example, the transportation district has spent $6.3 million to purchase or retrofit buses with lifts, 80 percent of which was paid for by the federal government, according to spokesman Gene Towne. Since it started mainline access in 1982, the district has spent close to $1 million in maintenance of the lifts and expects to spend an additional $900,000 this year. Yet only 12,000 of the district's 38 million riders use the lifts, according to Towne. ADAPT counters the issue is not cost but civil liberties. "In America, we have a way of hiding our prejudices with pragmatism," said Blank, a Presbyterian minister and veteran of the civil rights and anti-war movements of the 1960s who now supports handicapped activists. Across the country, cities are using a variety of approaches to the problems of providing mass transit for the handicapped. ln Los Angeles, mainline access is required by state law. Although 1,850 of the Southern California Rapid Transit District's 2,400 buses are fitted with wheelchair lifts, some local advocates charge that broken lifts, drivers who do not know how to use the equipment or refuse to do so and an overall lack of commitment to providing access limits the system. [The] Municipality of Metropolitan Seattle also contracts with groups to supply paratransit [vans] and half-fare cab service, [providing] 8,400 rides a month. In Denver, 432 of the [city's] buses are lift- or ramp-[equipped] providing more than 1,00[0 rides] per month. The city also [uses] vans and small buses in a transit system that provides [x number of] rides a month. None of Chicago's 2,400 [mainline] buses is fitted with lifts. [Instead] the city provides 42 [paratransit] buses, which offer 12,000 [rides per] month.

San Antonio's convention calendar features an unwanted bonus this weekend: some out of town demonstrators who have vowed to disrupt a conference at the Hyatt, in order to focus attention on a neglected national issue. The American Disabled for Accessible Public Transit (ADAPT) are the unwelcome guests at the American Public Transit Association's western regional conference. They have been similarly unwelcome guests at APTA conferences in Denver, San Diego, and Washington, D.C., where 28 members were arrested for civil disobedience last October. So now San Antonio's VIA Metropolitan Transit gets to take its turn playing cat's paw to make their point. ADAPT's demand is a simple one: civil rights for the handicapped, specifically the right to ride the same bus as everyone else. This means requiring public transit systems to make all of their mainline services fully accessible, particularly by installing wheelchair lifts instead of relying exclusively on separate “para-transit” services like VIA-Trans. They contend that this dual service system is a segregationist anachronism: 25 years ago blacks could at least ride in the back of the bus: today the handicapped still can't even get on board. At first blush, it may seem hard to believe that a person who is wheelchair-bound would really prefer to struggle to and from the bus stop in order to ride a regular bus, rather than being picked up and delivered door-to-door in a specially equipped van. But there are some real problems with a van service which makes it inherently less usable than full access to the regular transit network. First there is the matter of registration. In order to ride VIA-Trans, you have to be certified by a physician or a social service agency as completely unable to use the regular bus. As a result, there are only about 7000 people registered in Bexar County. Estimates of the potentially eligible “mobility-impaired" population range from 12,000 to 52,000, depending on whose definition you accept. Out of town visitors, of course, have a special difficulty of making arrangements in advance. Then there is the matter of time. You have to call and make a reservation at least two hours ahead, and preferably a couple of days. This may be okay if you know you have a doctors appointment every Wednesday at 2 o'clock. but it is no way to go out drinking with your friends on the spur of the moment. And since this is a shared-ride system, you will probably have to leave a lot earlier than you would like, and then to endure a long, circuitous journey to your destination, while other passengers are picked up and dropped off en route. So imagine yourself now in a wheelchair. Which would you rather do: Wheel yourself down to the nearest bus stop to get on a bus and go whereever it takes you, or call VIA-Trans a couple of days in advance to make a reservation? You don't have to buy ADAPT's tactics in order to see their point. Handicapped people naturally want to be as independent as possible, with a minimum of degrading “special privileges." On the other side, transit authority spokesmen ridicule the demand for wheelchair lifts as economically prohibitive and technically impractical. A study by the National Research Council's Transportation Research Board estimates the total additional cost of operating a fully accessible fixed-route bus system at about $2,000 per year per lift-equipped bus. But unlike VIA-Trans, where more riders automatically mean more vans and drivers - at an average actual cost of $l0.70 per trip — this cost does not increase appreciably with greater use by the handicapped. Opponents of accessible transit also object that the wheelchair lifts break down too often. And, you would have to take some regular seats out of the bus, to provide space to secure the wheelchairs. And the requirements of operating the lift would throw the bus off schedule, because the driver would have to take extra time to assist the passenger. In reality, the actual number of times per day you would have to stop the bus to use this lift makes nonsense of this argument. But what about the problem of getting to and from the bus stop, along streets without curb cuts and often without sidewalks? This objection is an excuse for not solving one problem because there are other problems beyond it. If you were in a wheelchair, you would probably need to live in a different house, too. You would consider this a factor before you moved. Note that this is not an either/or proposition, between specialized vans and lift-equipped buses. The same study by the Transportation Research Board estimates that only 30 percent of the "severely transportation handicapped" could use an accessible fixed-route bus. The other 70 percent — those on medication, with mental impairments or multiple handicaps — would still need to rely on VIA-Trans, taxicabs, or other means to get around. To me. this whole argument is pretty one-sided. The real clincher is the simple fact that other cities have already done what VIA says is impossible: to provide full accessibility on their mainline services. The old excuses won't wash anymore. it's time we stopped putting a price tag on people's dignity and independence. Tom Brereton is a former professor of urban studies at Trinity University.

[Headlines] Group protests curb construction [Subheading] Advocates for disabled say work violates Irving ordinance By Mercedes Olivera IRVING — Members of a support group for the disabled staged a protest Wednesday against recent sidewalk construction and repairs along Rochelle Road that do not provide curb cuts for wheelchair bound citizens. Armed with a can of red spray paint, five people from American Disabled for Accessible Public Transportation, or ADAPT, sprayed four recently repaired curbs with a stencil-lettered sign reading, “This curb is illegal." In recent weeks, Rochelle Road has been resurfaced and had curbs torn out and replaced, city officials said. "This curb is a clear-cut violation of their own ordinance," Dan Thomas, president of the Handicapped Association of Texas, said as he pointed to a recently poured curb. He accompanied his sister, Cathy, who must use a wheelchair. Group members said they have monitored the city's compliance with its ordinance, adopted in—1981, requiring that curb cuts and barrier-free ramps be included in all street construction. Sandy Cash, assistant city manager for development services, said the issue revolves around “what constitutes ‘maintenance’ and ‘new construction’ " of city streets. He said the ordinance was meant for streets in new subdivisions, not for existing thoroughfares. But "anytime we come in and have to remove a (large portion of) sidewalk and curbing, as a general rule we install a curb cut," Cash said. The city staff is looking to the City Council for direction on this issue, he said. He said city staff members have been preparing information on the cost and number of curbs torn out and replaced last year. The information will be given to City Council members, but Cash said he did not know when the report would be completed. However, Thomas said ADAPT members have become frustrated by what he called the city's slow response to their requests. “We ‘have never before asked that old barrier structures be rebuilt," Thomas said. “But now we are asking that all curbs placed since 1981, which are not in compliance, be replaced."

The Irving Daily News Thursday, November 13, 1986 [Headline] Curb cut policy called 'slap in the face' continued... Installation of the ramps would cost utility companies $300-500 over the costs of the work being done, he said. The city would have to change the present ordinance if utility companies are expected to install the ramps, he said. The additional costs arise in most cases because both utility companies and the city tear out only a portion of the sidewalk corner. In order to install a ramp, 14-15 feet of the corner must be torn out, said Lewis Patrick, director of Public Works. But Thomas and other handicapped representatives present at the meeting said some action must be taken by the city, either to change its policy or correctly interpret the policy. “It is the ultimate in stupidity and asininity to tear down a structure and re-create it with as much of a barrier for the disabled as existed before,” Thomas said. The lack of action by the city is a “slap in the face, a spit in the face and the ultimate insult,” he said. “It says to the handicapped, ‘We don’t want you around.’ Without the ramps, transportation does us no good.” Thomas said every corner in the city without a curb cut needs to have a ramp installed. His argument apparently was convincing to City Council members, who agreed to look into the current ordinance to see if changes are needed. “It appears to me as time goes on whether we choose to accept or resist changes, they’re going to come about,” Councilman Jack Nulty said. “It would behoove the city in the long run to try to be ahead of the game and lay the curbs. It is inevitable that it will have to be done because of the growth in the handicapped population." Nulty said that any work being done on a curb at an intersection warrants installation of a ramp. The city can come up with the extra funding that will be needed, he said. Council members agreed that the ordinance could bear some examination. “We need to look into an ordinance change so that the curb can be done right while we‘re already doing the work,” Councilwoman Fran Bonilla said.

Dallas Times Herald Wednesday, January 14, 1986 [Headline] Community Close-Up [Subheading] Police on sidewalk wheelchair ramps changed By Lori Montgomery After months of controversy and numerous protests by handicapped residents, the Irving City Council agreed last week to build wheelchair ramps when curbs near intersections are dismantled for any reason. Without amending a disputed 1981 ordinance that requires the city to build ramps only during new sidewalk construction, the council reached a “policy consensus" at last week's work session ordering city road and utility workers to replace curbs with ramps in the course of routine maintenance, said Public Works Director Lewis Patrick. “Any time 50 percent of the curb or 75 percent of the sidewalk is disturbed, we will go to the additional expense of taking the whole (curb) out and replacing it with a ramp," Patrick said, adding that the new policy will “eliminate the guesswork" of deciding when to replace a curb with a ramp. Construction of a standard curb costs about $103, Patrick said, while wheelchair ramps cost as much as $600 to build. The new policy, which takes effect immediately, could cost the city an additional $212,478 annually, Patrick said. “We have no objections to building ramps, but we need these guidelines to determine where you draw the line to spend that extra $500," Patrick said. Most council members dismissed the added financial burden as a necessary expense. "Let's not quibble" over when to build a ramp, Councilman Lars Ehnebuske said. “If a curb is 49 percent (disturbed), let’s go ahead and do it right. We ought to err in that direction rather than err the other way." Councilwoman Jackie Townsell recommended that the council immediately increase the budget for the Department of Public Works and review the financial impact of the new policy when the council meets for its annual budget session this summer. “The idea is to make the entire city accessible,” Townsell said. Townsell also suggested that the city take on the additional responsibility of building ramps on curbs destroyed during maintenance work by utility companies. The council agreed to ask utility companies to notify the city when such work is planned. "I think that's the minimum we can do because l think our city’s really behind in this area," Councilwoman Fran Bonilla said. The dispute over wheelchair ramps erupted last fall when handicapped residents charged at a meeting of the council's Community Services Committee that the city was violating the spirit of a 1981 ordinance by refusing to build ramps on curbs torn up during the course of maintenance projects. Such projects were under way throughout the city. In early December, a small group of protesters rolled in wheelchairs past maintenance workers on Rochelle Road, painting newly replaced standard curbs with the slogan “This curb is illegal." Although the city violated neither state law nor, technically, its own ordinance in rebuilding standard curbs, state officials said last month that most cities in Texas replace curbs near intersections with wheelchair ramps at any time a curb is disturbed. Cathy Johnson [Cathy Thomas], who was among seven handicapped residents at last week's work session, said the City “is on the right track" with the new policy. But, she said, the policy should be expanded and made permanent by amending the 1981 ordinance to require the city to build ramps when even a small part of the curb is disturbed. “I don't see what kind of criteria they're going to use to say what's 30 percent (of curb destruction) and what's 50 percent," Johnson said. "If this were the golf course, they'd go ahead and spend the money."

Handicapped block buses 2 protesters are arrested; talks planned By Judith Brimberg 2/16/85 Denver Post Staff Writer For the second day in a row, wheelchair-bound protesters blocked an RTD bus in downtown Denver Friday. They were demonstrating against possible discontinuation of accessible bus service for the handicapped. Despite efforts by the Peña administration to mediate the dispute, the protest went off as scheduled, and two handicapped demonstrators were arrested. Denver police identified them as George Roberts, 36, and Renate Rabe, 30, who live in the same apartment complex at 1255 Galapago St. The pair, afflicted with cerebral palsy, were charged with impeding traffic and disobeying a lawful order. Rabe was released on her own recognizance, but Roberts, who participated in a similar demonstration several years ago, was held overnight in Denver County Jail. Thursday, another member of the disabled-rights group known as ADAPT, Mike Auberger, 30, was arrested at East Colfax Avenue and Cherry Street for impeding traffic. But efforts by Dale Saddler of the Mayor’s Commission on the Disabled ultimately paid off. Late Friday, both sides agreed to meet early next week to try to resolve the dispute. Demonstrations scheduled for this weekend were called off. The handicapped community contended that RTD failed to understand that separate, private transportation for the handicapped doesn’t meet everyone’s needs, said Wade Blank, an able-bodied demonstrator who organized the protests. On Tuesday, an RTD committee is to review policies affecting the elderly and the handicapped. Among the options to be considered are discontinuing accessible service on public buses and expanding handyride services or brokering services to private providers. In an interview, Blank said he organized the protests because “the handicapped aren’t going to be the stepping stones to a new budget.” More than two years ago, he and others obtained a commitment from RTD to install wheelchair lifts on 50 percent of the peak-hour buses. But RTD, like other transportation districts across the country, is facing severe cuts in federal aid and Blank fears the agency may try to balance its budget at the expense of the handicapped. Many wheelchair lifts have proved unreliable and costly to repair. Larry Perry, chairman pro tem of the RTD board, said Friday that Blank’s fears were groundless. “If they will sit down and talk with us, they will learn they won’t be hurt,” he declared. Earlier this week, however, General Manager Ed Colby told board members it costs $72 a year to maintain bus lifts because 12,000 disabled persons ride the buses each year. It’s cheaper to maintain lifts on the handy vans, Colby said. Blank countered that RTD is sabotaging its accessible program by refusing to perform inventive maintenance on the Colby’s handyride figures are distorted, he added, because they include the elderly as well as the disabled.

The Selma of handicapped rights By Melanie Tem One recent Sunday morning, Kathy Vincent, a 41-year-old Denver woman with cerebral palsy, decided to go to church. She left her apartment, which she had just moved into after spending years in a nursing home, and propelled herself to a No.15 bus stop downtown. She saw "what looked like a wheelchair bus" approaching, and prepared to board it via the hydraulic lift. Instead, the driver told her the lift had been disconnected and, "this isn't a wheelchair bus anymore." The next wheelchair-accessible bus would arrive, he told her, in 30 minutes. "By that time," Vincent later recalled, "church would have been over." That incident has made Vincent a sympathizer with the more militant of Denver's disabled community - led principally by the Atlantis Community and HAIL(Holistic Approaches to Independent Living) - who are demanding that Regional Transportation District dramatically increase the number of wheelchair-accessible buses in its system. Specifically, they want the 89 new "articulated" buses on order to be equipped with wheelchair lifts, and have filed a lawsuit to force the issue. Articulated buses aren't suitable for conversion to wheelchair accessibility, according to RTD spokesman Kathy Joyce. Since they can carry more passengers and travel at higher speeds - their articulated (bendable) design allows them to take corners faster - they are intended for use on heavily traveled express routes. Joyce estimates it takes 5 to 7 minutes to load a passenger in a wheelchair, and another 5 to 7 minutes for unloading - delays which RTD considers unacceptable in a high-speed, efficient transportation system. FOR STEVE SAUNDERS, the issues go beyond personal convenience and articulated buses. Saunders, 31, also has cerebral palsy. He lives alone in a Capitol Hill apartment and works at HAIL. Saunders, along with other demonstrators assembled in RTD offices a few months ago, protested the board's decision to order the articulated buses without wheelchair lifts. Demonstrators blocked stairways and chained themselves to doors, to dramatize their point they said. Saunders was the only demonstrator to accept a summons from the police, an action which guaranteed a day in court. Last month he got his day, but had little opportunity to express his views, as the charges against him were dismissed. But, he said later he views the conflict as “a clear human rights issue. What we're demanding is equal access to public transportation, just like everybody else." Many bus drivers and able-bodied passengers seem skeptical about this view of the situation. While all sides in the dispute agree that so far public reaction to the wheelchair-accessible buses has been positive, there seems to be some sentiment now that the activists have gone too far. Several drivers put it this way: "They keep saying they want to be treated like ordinary people, when the fact is they're not ordinary people and they'd better accept that." Attitudes like that are, said Wade Blank of the Atlantis Community, disturbingly reminiscent of earlier civil rights struggles. He calls Denver, "the Seima of the handicapped rights movement." Similar battles have been or are being waged in Los Angeles, St. Louis, Washington, D.C., and other cities across the country by the handicapped. The 90 percent accessible transportation in Seattle is lauded as proof of what can be done. Blank, who is able-bodied, thinks of himself as a "liberator," and contends the issue of full accessible public transportation is critical as disabled people across the nation organize and develop their power. RTD's Joyce, whose younger sister Heannie is disabled and a member of Atlantis, seems to echo this perspective when she says, "We feel that all this has less to do with RTD’s commitment to accessibility, which goes back a long way and hasn't changed, and less to do with articulated buses than with politics and economics." As corporations bring new money into Denver, she says, Atlantis and HAIL are moving to ensure that disabled citizens will be taken seriously. "They're making a statement," she says. "We understand that. But we can't allow it to change what we do." RTD, she says, is committed to making half of its entire system wheelchair-accessible by July of this year. ANOTHER POLITICAL FACTOR is RTD's first board election, to be held in November. Members of the disabled community are interviewing candidates to determine their willingness to support issues of concern to that constituency. HAlL's Saunders already has announced his candidacy. In other cities, much has been made of the low usage of wheelchair-accessible vehicles by the disabled. RTD's records indicate that of a total 160,000 rides per average day, disabled riders average between 90 and 260 per week. Neither RTD nor the disabled seem alarmed by this fact. Training, they agree, is the key. Saunders and others provide one-on-one training in bus riding to disabled passengers, and RTD trains both drivers and potential passengers. Both sides also seem willing to be patient with the equipment failures that plague any intricate mechanical apparatus. The issue ls complex, emotional and, for the disabled, very personal. Says Kathy Vincent, who can't travel anywhere on her own and has to rely completely on wheelchair-accessible buses: “l never was militant before. But now l don’t have any choice."

RTD bobbles budget, buys rejected lifts By: Burt Hubbard News Staff The Regional Transportation District board of directors rejected to move to equip its new buses with wheelchair lifts but unknowingly included $1.2 million in its budget to buy them. The revelation came one day after the RTD board approved a $185.8 million budget that includes $21.4 million to buy 89 articulated buses for 1983. But the buses will cost the district only $20.2 million. The remaining $1.2 million is slated for wheelchair lifts that won’t be put on the buses. RTD Executive Director L.A Kimball has said that handicap ridership on the more than 300 buses that now have lifts do not justify the cost for the new buses. “WE HAVE CARRIED as many as 50 (handicapped) individuals on any particular day using 331 vehicles,” he told the board Thursday. RTD board member Charlotte Houston said Friday she didn’t realize that fact when she made a motion Thursday to add $1.3 million to the 1983 budget to outfit all 89 buses with lifts. The board defeated the motion 10-5. Those voting against the lifts said current low-frequency ridership by handicapped people doesn’t justify equipping more buses and cited increased maintenance costs of the lifts. Asked about the snafu, Houston said, “I guess I should have known.” Nor did RTD board member Tom Bastien know the lift money had been kept in the budget when he moved to equip half of the new buses with lifts. The board rejected the move 8-6. “THAT’S INTERESTING,” said Bastien Friday. “Why didn’t the (RTD) staff tell us?” Even Kimball said he wasn’t aware that the lift money was still in the budget. Kimball blamed the error on a staff member who, he said, apparently had failed to delete the money for the lifts from the budget. The confusion dates back to July 1981 when the district signed a contract with M.A.N. Truck and Bus Corp. to buy the 89 buses for $21.4 million with the lifts included. The buses were to be delivered between June and September 1983. But in December 1981, the RTD board voted to take the lifts off the buses and reduce the total price by $1.2 million. The 1983 budget, however, failed to reflect the reduced price. Kimball said the omission won’t alter the budget. “THERE’S NO NEED to change it,” he said. “We won’t spend it.” About 80 percent of the cost of the lifts would have been paid by a federal grant. And Houston and Bastien said the fact that they wouldn’t have had to increase the budget to get the lifts didn’t affect the vote. “I don’t think it would have made much difference,” said Houston. “We needed 11 votes to pass it.” The votes on the lifts came after about a dozen people, including several politicians, urged the board to make the buses accessible to the handicapped. The handicapped community has vowed to try again for the lifts after a newly elected RTD board takes office in January to replace the appointed 21-member board.

Caption: An RTD bus with wheelchair lift provides mobility for Mel Conrardy Title: Leaders of handicapped rate RTD service best in country By Norm Udevitz, Denver Post Staff Writer Disabled Denverites just a few years ago had as much chance of riding a bus as they did of climbing Mount Everest. “It was brutal the way RTD treated us,” said Mike Auberger, an official in the Atlantis Community, for the disabled and a leader in the fight that has turned the Regional Transportation District’s handicapped service around. In the 1970s and early 1980s, RTD busses then rarely equipped with wheelchair lifts, often left wheelchair-bound riders stranded on streets. Drivers, lacking training in dealing with visually or language impaired people, panicked when blind or deaf riders tried to board buses. “It used to be that even in the dead of winter, when it was below zero, those of us in wheelchairs would wait 2 or 3 hours for a bus to finally stop," Auberger recalls. “And often the lift was broken and we couldn't get on the bus anyway. And usually the drivers were rude and angry. They would tell us that we were ruining their schedules." But conditions have changed, Auberger says: “Right now, Denver has the most accessible public transit system for the handicapped — and all the public - in the country." Debbie Ellis, a state social services worker who heads the agency's Handicapped Advisory Council, agrees, saying: “It took a lot of pressure, but RTD has responded and now the bus system is doing a good job of serving the handicapped." Leaders of national programs for the disabled also agree. In fact, the President's Committee on Employment of the Handicapped will bring 5,000 delegates, many of them handicapped, to its national conference in Denver in April. This will be the first time in four decades the group has held its national session outside of Washington DC. “One of the key reasons we're meeting in Denver this year is because it just might be the most comfortable city in the country for the handicapped,” says Sharon Milcrut, head of the Colorado Coalition for Persons with Disabilities, which is hosting the conference. “A very important aspect of that comfort," she notes, “is how accessible the transit system is for the handicapped.” It didn't get that way easily. In the decade between 1974 and 1984, handicapped activists had to pressure indifferent RTD administrators and directors. Each gain was hard won. “We used every tactic in the book, from lawsuits to bus blockades on the street and sit-ins at the RTD offices," says Wade Blank, an Atlantis group director. “The lawsuits didn't help much but when we took to the streets in the late 1970s, I think that's when we started getting their attention." Blank and others also say the 1984 hiring of Ed Colby as RTD general manager helped. Before he arrived, less than half of the 750 RTD buses had wheelchair lifts, which often were in disrepair. Training for drivers to learn how to deal with handicapped riders was minimal. Agency directors resisted change. RTD relied heavily on a costly special van operation called Handyride - a door-to-door pickup service for handicapped. It has cost $13[? glare makes number hard to read] million to run since it began in 1975. “Over the past couple of years the turnaround has been phenomenal," Auberger says. “All of RTD's new buses are being ordered with lifts and older buses are being retrofitted." By 1986's end, almost 80 percent of the bus fleet — 608 of 765 buses — had wheelchair lifts; 82 percent of the fleet's 6,242 daily trips are now accessible for the disabled. Plans call for the fleet to be 100 percent lift-equipped by 1987's end. “The lifts aren't breaking down all the time now, either," Auberger said, noting that agency officials found drivers had neglected to report broken lifts: “That way the lifts stayed broken and drivers had an excuse for not picking us up. A bunch of people were fired over that and others realized that Colby wasn't kidding about improving handicapped service." Driver training also has improved dramatically. “It isn't perfect yet,” Ellis of the advisory council says. "But everyone is working hard at it. What we are finding is that 20 percent of the drivers understand that they are moving people, all kinds of people, and they're really great with the handicapped. “Another 20 percent figure their job is to move buses and to heck with passengers, all kinds of passengers. That bottom 20 percent probably won't ever change. So we're working real hard on the 60 percent in between," Ellis says. Drivers, for example, learn to help blind riders. “That’s an improvement that helps the disabled, but it also helps regular passengers who are newcomers to the city,” Ellis says. All the improvements haven't come cheap. Since 1974, more than $5million has been spent on lifts and lift maintenance, most of the expense was incurred in the last three years. RTD plans to spend $9 million more in the next six years to keep the fleet up to its current standards and pay for more driver training. Another $4 million will be spent on HandyRide service. Ironically, Auberger and Ellis both say one of the biggest problems remaining is getting more handicapped people to use mass transit. “There are no reliable figures," Ellis says. “But we think there are about 20,000 handicapped people in the metro area and only about 200 or 300 are using buses on a regular basis." Auberger, confined to a wheelchair after breaking his neck in an accident ll years ago, complains: “The medical system builds a bubble around handicapped people and makes them think they have to be protected. "That's just not true in most cases. So one of the things we're doing now is educating the handicapped to overcome their fears. We've finally got a bus system that works for us and we want the disabled to use it." OH 45202 (513)352-2000 Editorials Title: Buses and the disabled Shades of the civil rights movement returned to Cincinnati yesterday when members of ADAPT, which stands for American Disabled for Accessible Public Transportation, interfered with the operation of Queen City Metro buses. One latched onto a wheel well, and two others boarded and refused to leave. The protesters say members of the American Public Transit Association, who are meeting here this week, are moving slowly or not at all toward making all buses and trains fully accessible for the handicapped. They point to Metro, which has many buses without wheelchair lifts and 87 with lifts that it refuses to operate, as a microcosm of the problem nationwide. Some may condemn the protesters’ tactics of interrupting normal transit service, albeit by relatively non-violent means. The larger question, however, is whether the transit systems are going out of their way to leave the handicapped at curbside. That's certainly not the case with Metro. Metro has contracted with a private company to provide door-to-door (more accurately, curb-to-curb) service for the handicapped within Cincinnati. The system isn't perfect, but it is growing. Complaints abounds that scheduling the Access vans is difficult, and Metro has failed to meet a five-year goal of providing van service to all of Hamilton County, says general manager Tony Kouneski. The problem, here and elsewhere, is one of money. ADAPT wants the lifts as well as the door-to-door service. It’s tough to have it both ways, especially since federal dollars for mass transit have been cut almost 25 percent by the Reagan administration. States have been hard-pressed to fill that gap, and a sales tax increase for Metro failed miserably in 1980. Kouneski says if Metro did, indeed, have an extra $350,000 for operating and maintaining the 87 wheelchair lifts, the money would be better spent on door-to-door service. That's a decision that groups such as the Greater Cincinnati Coalition of People With Disabilities and Metro's own advisory council for the handicapped should help make and implement. Members of national groups such as ADAPT, meanwhile, have made their point. They should now turn their efforts to such things as legal parades and peaceful picketing. Instead of continuing their Cincinnati protest, they should devote their energies to lobbying Washington and the legislatures to fund their full-access plan before someone is seriously injured.

January / February 1987 METRO Magazine [Headline] Handicapped Rights and APTA Highlighted text: A seeming fixture at APTA conventions is a demonstration by the handicapped. In this exclusive interview with METRO Magazine,Rev. Wade Blank describes the movement’s goals and objectives. Shortly before the APTA Annual Meeting in Detroit last October, the General Assembly of the Denver Presbytery of the Presbyterian Church unanimously passed a resolution favoring 100% accessibility to all publicly funded transit buses. The resolution calls upon the" U.S. DOT “to mandate that all public buses bought with federal monies be accessible to all people, specifically including those persons who use wheelchairs for mobility." The resolution declares that equal access to public transportation is a basic human right. It urges the American Public Transit Association to support total accessibility, and calls on all public transit systems to work toward the goal as well. According to sponsors of the resolution, 14% of U.S. citizens are disabled and thus denied full access. The resolution also recommends to all churches and church agencies to consider adding equal access facilities to all their church buses and vans. Wade Blank, a Presbyterian minister and leader in the disability rights movement for 11 years, said the resolution is the latest effort in the struggle to enable disabled Americans to integrate into their communities. According to Blank, disability rights is a civil rights movement similar to the black political movement of the 1950's and 60's. Blank is a leader of ADAPT, the Denver-based American Disabled for Accessible Public Transportation, an organization which has demonstrated on behalf of disability rights at several APTA conventions in recent years. Blank said his organization has about 800 people who actively support it, though he believes many thousands more wheelchair-bound people would do so if they could. What follows is an interview with Rev. Blank conducted in Detroit during the APTA Annual Meeting there during which 18 disabled individuals were arrested for demonstrating at the city hall. METRO: Mr. Blank, what is your organization trying to accomplish at this APTA meeting? Blank: First of all, in 1983 we introduced a resolution before APTA in Denver, Colorado, in which we said that we wanted APTA to vote in favor of having public transportation accessible to people in wheelchairs. That resolution said three things. First, that APTA should inform all its members that it will now endorse accessibility; second, that they should take a public vote member by member (about the issue); and third, that they should inform the transportation industry that accessibility is their position. They have refused since 1983 to act on the resolution, so we assume that that means they don't favor accessible public transit. Now as to what we are doing here. Whenever APTA goes into a community (to hold a convention) we do two things: we demonstrate against APTA, and we use the occasion to illustrate to the public that their local transit system is not wheelchair accessible, in other words, every bus being wheelchair accessible. METRO: Over the years your organization has demonstrated at a number of APTA meetings and very often the demonstrations have been very disruptive. Do you think that your activities have paid off? Blank: They've paid off in the sense that first they are directed to other people with disabilities in order to raise their consciousness about their rights. Our group has grown three times over the last few years. Secondly, it tells the able-bodied public that people in wheelchairs cannot board transit, which most people never even think about. And thirdly, it teaches the community at large that our political movement is in fact a civil rights movement. METRO: Your organization demonstrates against APTA. But isn't it true that you're also hoping for action on the local level wherever you mount a demonstration? Blank: Yes. In effect, APTA does our organizing for us by picking the cities it goes into. We follow and go in and raise consciousness for our cause. I don’t think anyone can understand how alienating it is (to be disabled). My daughter is in a wheelchair. If she goes to a bus stop and the doors open and shut and the bus drives off without her, there's no way of expressing to people how alienated, how shut out that makes her feel. Of course, the transit people want to make it an economic argument...but that didn't cut it with the black movement and it's not going to cut it with the disabled movement either. METRO: How is ADAPT funded? And what is your annual budget? Blank: Mainly from the Roman Catholic Campaign for Human Development, the Presbyterians, the Lutherans and the United Church of Christ. ADAPT itself doesn't have a budget per se. A trip like this (to Detroit) will run us approximately $15,000 for all the logistics involved, hotels, food, attendant care, just the logistics of moving that large number of disabled. METRO: How big is your staff? Blank: We don't have a staff, we don't have bylaws, we don't even have officers. It's just a consensus group. For example, in Denver, the disabled groups each do their own thing, and there's a lot of individuals who have joined ADAPT by simply saying, I want to be part of it. That's all it takes. We have a list of names of who those people are. METRO: You mentioned the logistics of moving the disabled. Do you bring people along with you to do the demonstrating, or do you seek to have local disabled join in? How does this work? Blank: In July we flew here with some disabled and met with the local disabled. They basically said they'd recently filed suit and were trying to get access to the buses, but that they didn't believe they could support any demonstrations because they'd be afraid to lose what they have now. That's almost to the letter the situation in every community we go into. The disabled are very afraid to lose what little they have. Plus, a disabled person in a wheelchair is by definition passive about the way they see themselves. But before we leave Detroit we will have a few people who will dare. By seeing the press, they'll see it's pretty amazing and they want to be a part of this. It changes the way they view themselves. That's how we recruit members. METRO: Tell me how the organization started? Blank: It started in Denver in 1975 when we announced we were going to make the transit system there accessible. Everybody laughed at us. We had about 20 members. We filed suit and lost. On July 5, 1978, the day after the suit was lost, we went down and blocked the first two buses in the whole movement. We held those buses for two days, sleeping on the streets. The battle in Denver went on in spurts. We started in 1978. In 1979 (Denver RTD) announced they'd make their transit buses accessible, but in 1980 when Reagan took office they went to a posture of inaccessibility. We hit the streets again and they reverted back to accessibility. In 1982, they finally signed an agreement with us that they would be totally accessible. So then other groups asked us: how did you do that? we'd like you to teach us how. Rather than just sit in Denver and enjoy our system, we decided to export what we'd won there using the same tactics on a national basis. METRO: You said earlier that the economic argument against accessibility doesn't fly. Yet to APTA and the transit industry the economic argument is very real. After all, the funds to pay for accessibility come out of their budgets. They can cite some very dramatic statistics of how much subsidy each handicapped ride costs. So how can you say the economic argument doesn't carry weight? Blank: Because those figures are not true. Denver, for example, bought 160 buses. The lowest bidders (for that contract) bid accessible buses. Neoplan undercut everybody else’s bid and they bid accessible. So you can't go just by the lifts themselves, you go by the total cost of the bus. METRO: But you also have to consider the maintenance costs and personnel costs too. In San Francisco. for example, one of the agencies there has two maintenance workers who do nothing but service the lifts, that's all those individuals do. Blank: That's true. But they have people who work on the motors, and people who work on the brakes, and people who work on every aspect of the buses that service the able bodied. The figures out of Seattle and Denver on maintenance per lift is under $400 a year, if they do preventive maintenance. Now that's a lot lower than APTA's figures of $2,500 per lift (per year). That figure is correct if you don't ever fix the lifts. In other words if you drive around and they break down and they're all gummed up, then you have to put new hydraulics in because you haven’t changed the oil. Then you're going to top out at $2,500 the same way if you don't keep your car up. METRO: During his remarks to APTA, CBS correspondent Ed Bradley charged your organization had mounted a mailgram campaign against his coming. He went on to give a presentation about apartheid in South Africa Your comments? Blank: The disabled community in the United States is suffering from a form of apartheid. The disabled live in section 8 housing, high-rise housing which is for disabled and elderly, They live in nursing homes. They go to workshops like Goodwill where they're segregated, and they are paid under 10 cents an hour in the average workshop in the United States. That's what the salary is. The disabled can't ride public transportation, so you have a form of apartheid. METRO: Thank you.

Thirteen protesters spent the night in a gym at Detroit Police Headquarters after the Wayne County sheriff's department refused to admit them to the county jail. A spokeswoman for the sheriff's department said the protesters weren’t accepted at the jail because over-crowding forced the county on Friday to stop incarcerating people accused of misdemeanors. MEANWHILE, UP to 60 people -- most in wheelchairs — descended on the area around Police Headquarters to protest the jailings. They wheeled slowly along the sidewalks around the building, chanting, “Let our people go" and vowed to spend the night. About 20 police officers stood near the protesters but did not intervene. The 13 protesters were among 37 people arrested Tuesday, after they blocked one of two entrances to the McNamara federal office building in downtown Detroit. Of the 37 people arrested, 31 were in wheelchairs. Police said the 13 jailed protesters were being held in lieu of $1,000 cash bail each. The rest of the protesters were released on $100 [personal bond]. BAIL WAS set at $1,000 for the 13, a police spokesman said, because their arrests Tuesday violated the conditions of their release Monday on $100 personal bond after a similar protest. They had been ordered to avoid further arrest until a court appearance set for Oct. 24, police said. Their incarceration posed special problems for police. The protesters were being held in a gym at Police Headquarters, which has barred windows and doors and is occasionally used to hold prisoners temporarily when processing of prisoners is backed up at the jail, police said. The bathrooms in the gym are not equipped for the handicapped and guards were carrying the protesters in the toilets, police said. The protesters were arrested early in the afternoon. By the time they had been processed and carried into the gym by police, the cafeteria at the Wayne County Jail had closed, police said. Officers at Police Headquarters, who declined to be named and who wouldn't provide details, said they secured from the county jail meals of roast beef and pot roast with lettuce, salads, ice cream, milk and juice. The protesters ate about 8:30 p.m. Title of second article: Costly bus lifts are key to dispute By Louis Mieczko, News Staff Writer It costs an estimated $20,000 to install wheelchair lifts on a typical city bus, and sometimes they don't work. That's the crux of a dispute between transit agencies across the country handicapped groups protesting the lack of access to public buses and rail cars. Americans [sic] Disabled for Accessible Public Transportation (ADAPT) wants every bus and rail car in the county available to wheelchair-bound people, a move which transit officials say would bankrupt most agencies. HANDICAPPED ADAPT demonstrators clashed this week with the American Public Transit Association (APTA), which is holding its annual convention in Detroit. It was the fourth such confrontation in as many years tied to the APTA conventions. Dozens of protesters have been arrested since Sunday for interfering with bus traffic and blocking entry to the McNamara Building as they sought to meet with staff members of U.S. Senators Carl Levin and Donald Riegle Jr. ADAPT has strongly criticized Detroit's Department of Transportation (D-DOT), which serves the city, and praised the suburban Southeastern Michigan Transportation Authority (SEMTA). “We fought for five years in Denver to get wheelchair lifts on all city buses there, and when we won in Denver, we went national," said Wade Blank, a Presbyterian minister whose 15-year-old daughter is confined to a wheelchair. THE PROTEST group, which Blank helped start, is upset with APTA for opposing its goal of wheelchair lifts on all buses. Five years ago, APTA won a lawsuit knocking down a requirement that the devices be installed on buses purchased with federal funds. Jack R. Gilstrap, APTA executive vice-president, called that too costly. “In Washington, D.C., $60 million was spent to provide elevators for the ‘subway stations, but only 36 handicapped people use those elevators on a given day," said Gilstrap. “We would much rather let each transit authority develop dial-a-ride and other more cost-effective services.” Gilstrap said it costs an average of $20,000 a bus to add wheelchair lifts, which often are unreliable. "THEY’VE NEVER given the wheelchair lift system a chance to work," said Frank A. Clark, chairman of the Detroit-based Coalition for the Human Rights of the Handicapped. “How much does it cost to keep these people at home or in a nursing facility." A 10 year old Michigan law, one of the most stringent in the United States, requires that all new buses bought with state funds have wheelchair lifts. California is the only other state with such a requirement. According to the Michigan Department of Transportation, 1,186 of the 2,127 publicly owned buses in the state have wheelchair lifts. Detroit recently bought 100 buses, but equipped only 20 with wheelchair lifts. The city did not have to follow the state law because it used city funds. ONLY 196 of the city's 606 buses — about 32 percent —— have the wheelchair equipment. By comparison, 140 of SEMTA’s 202 buses — more than 69 percent — are equipped with the lifts. And 440 of Denver's 760 buses — 58 percent — have the lifts. Denver's policy is to equip all new buses with the lifts: and the handicapped groups say they consider Denver's system a model that should be adopted by others. Clark complained that the Detroit lifts often don't work. “They don't maintain them at all," Clark said. “We'll be going into federal court soon to complain about the situation." CLARK’S GROUP has a five-year-old lawsuit pending before Federal District Judge Richard Suhrheinrich, charging Detroit with violating U.S. handicap access laws for mass transit, public buildings and walkways. The law requires that public property be accessible to the handicapped. Clark said members of his group monitor Detroit buses for operating lifts by attempting to board them while in wheelchairs. He said the group annually checks five routes Gratiot, Woodward, Grand River, Crosstown and East Warren — designated by D-DOT for handicapped access. "But even on those routes," Clark said, "we can't find any that work." By contrast," he said, "SEMTA maintains its lift equipment. D-DOT officials could not be reached for comment. Mayor Coleman A. Young’s press secretary, Robert Berg, referred questions on Detroit's recent bus purchase in state officials. NEIL LINCOLN, a spokesman for the Denver system, said it has come a long way quickly. “The lifts still break down," he added, “but not nearly as often." However, some cities like Chicago and Cleveland have not bought any wheelchair lifts because of the cost and maintenance problems. Spokesmen for those cities said they prefer to develop dial-a-ride and van service for the handicapped. Detroit has no dial-a-ride or van service. San Francisco Bay Guardian 9/23/87 Disabled to march for transit access By: Cheryl Davis When members of the American Public Transit Association gather in San Francisco during the last week of September, they will be met by disabled people from across the country who plan to demonstrate against a national transit policy they say is unfair because it separates them from other transit users. Specifically, disabled activists intend to protest the widespread use of special vans to transport disabled riders door-to-door, a system commonly referred to as “paratransit.” That system, they say, is a form of segregation. In its place, they argue, all buses and trains should be equipped to accommodate people in wheelchairs as part of as overall policy fully integrating the disabled into society. “Full accessibility,” they argue, is a right that should not be denied because of cost. Paratransit is impractical as well as offensive, disabled transit riders say. Burr Overstreet, a Santa Rosa man who uses a wheelchair, called paratransit “a paternalistic system that screws people over, costs a fortune and it’s the first thing cut during economic downturns.” Paratransit users “are made to feel like helpless hospital patients,” Les Treece-Sinclair, a wheelchair user and staff person at the September Alliance for Accessible Transportation, a Northern California coalition, told the Bay Guardian. Most Bay Area transit districts, including the San Francisco Municipal Railway, use a combination of buses with lifts and paratransit vans for disabled and elderly patrons, and California law requires that all new buses be equipped with lifts. Local transit agencies have a good reputation nationally for working closely with disabled and elderly patrons. But, even so, there are problems. “Supposedly we [in Marin] have one of the better systems,” Overstreet said. “The combination of fixed-route and paratransit should in theory be fairly effective, but it’s not. The paratransit only runs Monday through Friday, 9 am to 3 pm. Disabled riders have to reserve in advance and disabled people who work cannot use such a paratransit system either to work or to socialize.” “Paratransit doesn’t come close to meeting the transport need of elderly and handicapped people,” said Treece-Sinclair. “At the moment, on many bus lines only every third or fourth bus will be accessible.” Jose Rodriguez, a public information officer for the Metropolitan Transit Commission, told the Bay Guardian Bay Area transit districts “are working hard to meet a basic level of service but we are aware of the need for improvement. As always, this is contingent on securing needed funds.” The debate between disabled people and much of the public transit industry centers around interpretations of Section 504 of the 1973 Rehabilitation Act, which states that persons with handicaps cannot be discriminated against under any program receiving federal funds. Since mass transit relies heavily on federal funds, Section 504 serves as a rallying point for disabled activists who argue for making all public transit wheelchair-accessible. The U.S. Department of Transportation in 1979 issued regulations that required full wheelchair access on newly ordered buses and called for retrofitting existing buses and modifying portions of existing rail systems to accommodate disabled users. Disable activists applauded the regulations, but APTA lobbied Congress vigorously, claiming the regulations were costly, unworkable and designed to reach only a small percentage of the disabled population. A 1979 Congressional Budget Office report supported APTA’s claims and called instead for paratransit systems. APTA sued to overturn DOT’s regulations and the U.S. Court of Appeals for the District of Columbia ruled in 1981 that the regulations exceeded the scope of the Rehabilitation Act. DOT interim regulations gave local communities the option of determining levels of accessibility and many transit districts opted for paratransit. Paratransit advocates argue that outfitting buses with lifts and other special equipment is too expensive, given the number of disabled riders. Santa Clara County Supervisor Tom Legan, for example, said at a January board meeting, “We’re spending $3.5 million per year [maintaining] lifts for what amounts to 57 boardings per year.” But disabled activists say the official estimates of disabled ridership are too low. Palo Alto resident Brian Bolitho, who uses a wheelchair, told the Bay Guardian his commute to work alone account for more than 200 boardings per year on Santa Clara buses. Dennis Cannon, a transportation, specialist the federal Architectural and Transportation Barriers Compliance Board, told the Bay Guardian, “The actual use of accessible buses could be five times higher, or more, than transit agency estimates. The driver often simply guesses the number of obviously disabled passengers.” Much of the expense of repairing lifts, Cannon added, could be avoided by improved maintenance and better training of bus operators. Some APTA members, Canon said, are reappraising the adequacy of paratransit. James Lee, accessibility coordinator for Alameda County Transit, agreed. “Since 1976, study after study has documented the inadequacy of paratransit. It is not cost-effective, nor is it demand responsive,” he told the Bay Guardian.
