Title: Disabled arrested in SF protest By Donna Hemmila Staff writer SAN FRANCISCO — Protesters in wheelchairs, chanting "If you can take us to jail, take us to work," were arrested Sunday at City Hall where they disrupted the opening of a national public transit convention. More than 35 disabled people were hauled into special wheelchair-lift equipped vans on charges of disturbing the peace. Groups of demonstrators blocked the entrance to the City Hall rotunda where delegates from the American Public Transit Association kicked off a five-day convention Sunday. As San Francisco police officers pushed the wheelchairs into the waiting vans, other wheelchair riders parked in front of the vans to keep them from driving away. Captain Michael Pera said the demonstrators would be given citations at the Hall of Justice and released. "The situation was getting out of hand," Pera said. "My understanding was by the demeanor of the crowd, they wanted to be arrested." More than 150 disabled protesters and their families had marched from an afternoon rally at Union Square. The parade of wheelchairs had stopped traffic on downtown streets and demonstrated in front of the Hilton Hotel on Powell Street, where convention delegates are staying. The five-day transit convention is expected to bring nearly 15,000 representatives from transit agencies across the United States to the Bay Area. Disabled organizers have vowed to disrupt the convention, being held at the Moscone Center, to call attention to the transit organization's policy on access for disabled people. Disabled organizers say the APTA is responsible for weakening federal laws that require public transit agencies to equip their buses and subways to carry disabled passengers. A successful lawsuit brought by APTA changed federal law to give local transit agencies the right to decide what type of accessible transit to provide. Many transit districts have chosen to carry wheelchair passengers in dial-a-ride-type vans rather than equip their regular buses with wheelchair lifts. Members of the American Disabled for Public Transit and the September Alliance for Accessibility are demanding to ride the same public transit system that able-bodied passengers use. At the rally in Union Square, the protesters heard pledges of support from Lt. Gov. Leo McCarthy, feminist Eleanor Smeal, the Rev. Cecil Williams from Glide Memorial Church in San Francisco and labor leader Jack Henning. During the rally the protesters chanted curses against APTA and waved signs with slogans such as "No Taxation without Transportation." The songs and chants were punctuated with the clanging bells of passing cable cars, a San Francisco attraction none of the wheelchair riders can board because the cars lack lifts. McCarthy said he backed the disabled community in its fight for independence. Many disabled rely on public transit to go to work and are being denied opportunities because they don't have transportation, he said. "There is no footnote to the Constitution that says everybody gets these civil rights except the disabled," McCarthy said. Disabled speakers fanned the crowd's anger with accounts of their morning meetings with APTA representatives at the Hilton Hotel. Disabled representatives said the wheelchair-accessible door to the hotel was barricaded and they were told to exit through the garage. "The backdoor entrance went out in the '60s with the civil rights movement," said Judy Heumann, of the September Alliance. "We're not going to go through the back door anymore." Albert Engelken, deputy executive director of APTA, denied his organization had ordered the hotel barricaded. "This is not a happy situation," Engelken said as he watched wheelchair users demonstrating on the streets below from the fourth floor window of the Hilton. "Obviously it's a sore spot. Nobody likes this." APTA's executive board has agreed to set up a task force to study their policy, but Engelken said the organization is not ashamed of its stand on disabled access. Only California and Michigan have laws that mandate full accessibility on public buses and rail systems. "You folks in California chose Artie you want and APIA thinks that's great," Englenken said. "We just wonder if the people in California should be telling the rest of us what to do." APTA has estimated it would cost $13 billion to make every public transit system in the United States accessible to the disabled. Chung Thirty-four disabled people, deliberately blocking streets in a bitter demand for better access to public transit, were arrested yesterday by San Francisco police officers. Twenty-five protesters, many in wheelchairs, blocked Howard Street yesterday morning outside the Moscone Center where the American Public Transit Association is meeting through tomorrow. Then. in the afternoon, nine more disabled people blocked the street outside the downtown Hilton Hotel, where the transit officials are staying. On Sunday 22 protesters were arrested making a total of 56 cited in two days. Calling themselves the September Alliance tor Accessible Transit, the disabled wheeled themselves a mile to Moscone Center, under police escort, to protest, chanting, "Up with Access! Down with APTA!" For more than 10 years disabled people nationwide have pressed for wheelchair access to local buses and trains. However, APTA, in 1981, managed to overturn a federal mandate requiring wheelchair lifts on all new buses. APTA, instead, got a “local option" allowing each transit organization to determine the best way to serve the disabled. At yesterday morning's protest, Judy Heumann of the Berkeley-based World institute on Disability, said, “It‘s a very emotional issue for disabled people to have to come out here and do this." She was not arrested. Police gave the protesters outside Moscone Center three warnings to disperse, then started arresting them. They were taken to the Hall of Justice in a specially equipped Municipal Railway bus that had a wheelchair lift. A special police van with a lift handled the protesters outside the Hilton Hotel. All those arrested for blocking a street and falling to disperse were cited and then released. The protesters said they will be back demonstrating until the convention ends tomorrow. More than 11,000 public transit officials from across the United States and about 50 countries are attending the convention.

Passenger Transport 4/3/98? At San Francisco Meeting Agreement Reached in Suit By Disabled over Access San Francisco, Calif.- A settlement agreement of a class action suit brought by two individuals with disabilities against the Hilton Hotels Corporation, APTA, and Executive Vice President Jack Gilstrap was reached recently. The February 1988 suit stemmed from a protest by persons with disabilities at the San Francisco Hilton Hotel during APTA’s 1987 Annual Meeting. “We are pleased that this litigation is being settled and that we can, hopefully, put it behind us and move forward,” said Mr. Gilstrap. He emphasized that the settlement agreement stipulates that APTA entered into this agreement without admitting any liability in connection with the incident. The plaintiffs who brought the suit in the California Superior Court claimed that their right of access to the San Francisco Hotel was violated during a Sept. 27, 1987, meeting and protest at the hotel. Persons with disabilities had been invited to attend a meeting with APTA that morning, but an accessible hotel entrance was temporarily closed. The protesters sued under California law that guarantees full access for individuals with disabilities. The Sept. 27 incident came during a week when disabled activists held a tumultuous demonstration at San Francisco city hall and also blocked operation of the city’s historic cable car system. The settlement, reached on March 3 and preliminary approved by the court, provides monetary damages to disabled individuals who feel they were denied access to the hotel. The preliminary court approval clears the way for announcement of the settlement in publications distributed throughout the disabled community. Individuals who were invited to the Sept. 27 meeting and were denied access through the temporarily closed entrance are entitled to a minimum of $1,250. Persons who sought access or would have sought access to the hotel but for the temporary closure will have an opportunity to identify themselves and file proofs of claim for damages of up to $250. The damages will be paid out of a settlement fund established by Hilton Hotels and APTA amounting to $100,000. A hearing will be held this June for a final determination by the court concerning the fairness of the settlement.

Headline: Disabled protest transit group’s policies By Ken O'Toole of the Examiner staff Disabled people from across the nation took to the streets of San Francisco Sunday to demand better access to public transportation, rolling through downtown streets in a wheelchair caravan that stretched from Union Square to the downtown Hilton Hotel. Chanting, “We want access” and "We will ride," the crowd of several hundred disabled and their supporters rolled with police escorts to the hotel, where the annual meeting of the American Public Transit Association was taking place. The protesters were halted at the hotel's doors by a line of police, and after a brief rally moved on to City Hall, where they confronted transit association members going to a cocktail party. Police arrested 20 people, including 16 in wheelchairs, for blocking the sidewalk and failing to disperse. They were cited and released. One demonstrator. who was not wheelchair-bound, was booked for felony assault after he kicked a police officer in the chest. Police estimated that there were 500 demonstrators. The march, spirited but orderly, did not seriously disrupt traffic as scores of wheelchair-bound protesters voiced their displeasure with the associations policies and called for restoration of a national transit policy that would require wheelchair lifts on all public buses and trolleys. Both protesters and officials of the Municipal Railway noted the irony of the demonstration taking place in a city that has one of the best disabled-accessibility programs in the United States. California and Michigan are the only states that require all new buses to have wheelchair lifts. However, outside California, most disabled people are "segregated from public transit, and are often regulated to lengthy waiting lists for door-to-door van service" or no service at all, said a spokeswoman for the September Alliance for Accessible Transit. The group, in conjunction with American Disabled for Accessible Public Transit, plans more demonstrations as the transit association meets here through Thursday. Transit association Executive Vice President Jack Gilstrap said, “it's not a disagreement over whether we serve the disabled; it's how its to be done. Our position, and we're consistent with federal law and the courts, is for each community to decide how the service (to the handicapped) should be supplied." He said that lifts can cost $10,000 to $15,000 and that individual communities should be able to decide whether the money might be better spent on other transit woes. "lt's a very emotional issue," Gilstrap said, "but (public-transit agencies) have short resources. You're doing a good job here in the Bay Area, but with an extraordinary level of taxes." Muni spokeswoman Annette Wire said a total of 280 buses In the system have lifts, and 16 Muni lines are totally accessible to the handicapped. At a Union Square rally before the march, Lt. Gov. Leo McCarthy called for full access to public transportation. Saying laws that guarantee rights to all people have been undermined, McCarthy said disabled people have a right to access to school and work through public transportation. "Transportation means independence," McCarthy said, “and independence means opportunity." The Rev. Cecil Williams of Glide Memorial Church called on the disabled to take America to a new task... You may be called to set what's wrong right." A wheelchair-bound San Franciscan named Gill rolled into the crowd of demonstrators at Union Square and said he liked what he saw. But he said, “San Francisco is moving in the right direction. I travel sometimes miles a day (in the electric wheelchair) and I usually don‘! have any problems. except with the occasional inexperienced bus driver." Joe Carley, of Dallas, Texas, said since he was restricted to a wheelchair several years ago, at age 38, I realized: ‘This can happen to at anybody. Transportation is the A-Number 1 concern for anyone who's disabled. Federal and state governments don't really see transportation as a right. We want to live, not just survive." Disabled Protesters Arrested New York Times 9-29-87 San Francisco, Sept. 28 (AP)- Disabled people demanding better access to mass transit systems across the nation blocked buses today at a transit association convention, while the number of arrests in two days of protests rose to at least 54. Sgt. Jerry Senkir of the San Francisco police said 25 to 30 people were arrested today for failing to leave the scene of an unlawful assembly and for blocking the sidewalk and street. Nine others were arrested later in the day for failing to disperse outside the Hilton Hotel, where the American Public Transit Association was holding some of its meetings, the police said. On Sunday, 20 protesters were arrested for blocking the sidewalk outside City Hall during a rally of 500 disabled people. One of the demonstrators, Allan Shipley of San Francisco, 40 years old, was arrested for investigation of assaulting an officer. About 150 people, most of them in wheelchairs, traveled about a mile today under police escort to the convention center where the transit association was meeting. “It’s a very emotional issue for disabled people to have come out here and do this”, said Judy Heumann of the World Institute on Disability, an organization based in Berkeley. For more than 10 years, `groups` of disabled transit riders have urged the association to declare a national policy giving disabled commuters access to the same buses and trains that the rest of the public rides. Some local transit districts carry disabled riders on buses specially equipped for passengers in wheelchairs.

The Denver Post? [Headline] Atlantis Residents Train for Hot Line Handicapped persons residing in the Atlantis Community in Denver are being trained to man a telephone hot line to respond to the emergency needs of all the disabled in Denver. Wade Blank, Atlantis co-director, said the hot line -- soon to be put into service -- is being funded by the Colorado Vocational Rehabilitation Division. [Subheading] FURNITURE GIVEN In other developments at Atlantis, the Denver Hilton Hotel ls donating furniture for the apartments in which the handicapped persons reside at the Las Casitas Public Housing Development here. The furniture is being made available by the hotel as the result of remodeling of some of the Hilton’s rooms, Blank noted. Atlantis ls a nonprofit organization which began operations last spring to offer the handicapped the opportunity to live in apartments so that they might attempt to realize their full potential. Blank also said the IBM Corp. in Denver, through its staff member Burt Lipell, donated a new washer and dryer to Atlantis. This equipment is operated by George Roberts, one of the Atlantis residents. The Denver City Council, Blank said, is being asked to appropriate $2,000 for installation of sidewalks among all the Atlantis apartments before winter comes. Atlantis has received three new electric wheel chairs and one manual chair through the efforts of Dr. James Syner of Medicaid’s special Medical Equipment division. [Subheading] COMMUNICATIONS A communications system also ls being planned among each of the apartments at Atlantis. And one of Atlantis’ most severely disabled residents is the coordinator of a wheel chair van which Atlantis leases from this resident, Blank said. This project also is funded by the rehabilitation division. Five Atlantis residents are attending local schools or colleges - one resident attending Metropolitan State College, one at Red Rocks School, two at Boettcher School and one at Opportunity School. Next article on right Disabled Helped by Wirth's Compassion To the Denver Post: IN A RECENT LETTER to the Forum (April 27), Rita Jackson complained that Representative's Wirth office is not accessible to the handicapped "via the front door." A partial truth can be a big lie, and the whole truth should be told. It is true that the front door is hard to negotiate in a wheelchair, but the office building is accessible from the rear, which is where the parking lot is located. Here, as in many office buildings, the "rear" is the normal, preferred building entrance, and as no "second class" connotations. What is more important, Tim Wirth is not the kind of ivory tower legislator who hides in his office and expects the world, disabled included, to bring its problems to him. Tim Wirth constantly leaves his office, goes out into the community, and talks to the people about their problems in their own environment. The disabled have often been helped by his blend of energy and compassion. Atlantis has found that Tim Wirth's heart and mind are always accessible, and that is what counts.
