Official contends transit funds scarce by Judith Brimberg If metropolitan Denver wants federal help for something like light rail, it must come up with a combined highway-transit plan for improving transportation in the region, the head of the federal Urban Mass Transportation Administration said Wednesday. Even then, administrator Ralph Stanley acknowledged, officials would be better off to rely on local money and public/private partnerships to finance light rail or some other system of mass transit. In Denver for the opening of the turnaround facility at the Civic center shuttle station, Stanley said in the interview that the days of big federal money for such projects are past. Because of tight federal budgets, cities must rely on the income from the 1982 gasoline tax increase for new projects. The 1 cent dedicated to public transit amounts to 1.2 billion a year, only 400 million is for new transit projects nationwide. Noting that cities asking for $36 billion worth of projects are ahead of Denver, RTD board chairman Bryon Johnson said in a separate interview, “it’s clear we will have to do it with our own money. Waiting for federal money is like queuing up in a store that is running out of merchandise.” Stanley said if gasoline tax were raised again, more money would be available for new projects. But noting that the 5 cent a gallon tax barely got through Congress two years ago, he said he thought waiting for another increase in the near future would be a waste of time. There still is federal money available for construction projects, and Stanley announced Wednesday that RTD will get more than $6 million to plan and construct a new central shops facility. Buses now are repaired and painted in shops at the Alameda and Platte garages. RTD General Manager Ed Colby said the new centralized facility would have more sophisticated repair equipment.

Rocky Mountain News RTD pleases disabled, reports wheelchair lifts on buses to be fixed By JOSEPH B. VERRENGIA Rocky Mountain News Staff Writer A Regional Transportation District committee voted unanimously Tuesday to fix the wheelchair lifts on 127 buses, ending a week of heated showdowns that led to the arrest of three disabled protesters. Amid cheers from the demonstrators who twice last week blockaded downtown buses, the transit directors reaffirmed RTD's policy that much of its regular service be handicapped-accessible. “lt was all emotional," RTD chairman William Rourke said of the events preceding the compromise. “Everyone kept reinforcing perceptions and speculation, rather than getting down to cases." The confrontations started last Thursday when three members of the militant handicapped-rights group ADAPT were arrested by Denver police for rolling their wheelchairs in front of buses along 17th Street and East Colfax Avenue. Mike Auberger, George Roberts and Renate Rabe face fines of $250 apiece or brief jail terms if convicted in Denver District Court next month for causing traffic hazards and disrupting a government agency. They were among 20 handicapped demonstrators protesting a Feb. 12 decision by RTD’s planning committee to delay fixing the balky electrical systems on 303 buses. RTD officials said the repairs would cost $753,059. With lifts on about half of its 750-bus fleet, RTD is one of the nations most accessible public transit systems. This winter, however, electrical and mechanical problems have made the lifts so unreliable that disabled passengers said they frequently suffered frostbite while waiting for an accessible bus. Handicapped protesters originally wanted all 303 broken lifts fixed. They relented Tuesday when RTD officials explained 176 of the buses with broken lifts would be retired next year. Fixing those lifts would be a waste, officials said. “If we had our druthers, we would like to see all of the lifts rewired," ADAPT spokesman Wade Blank said. “But those 127 (that will be fixed) are going to be around for 12 years, so we accepted in the interest of compromise.” Blank said the protests were sparked by rumors that some RTD officials wanted to scrap all of the wheelchair lifts and replace them with door-to-door vans. ADAPT members consider such “dial-a-ride” service“ to be unconstitutional because it would be separate from regular bus service. Rourke said two of the five bus manufacturers bidding to replace the 176 buses heading for retirement would include wheelchair lifts. RTD is required to accept the lowest bid. Rourke declined to comment on what RTD would do if the low bid does not include wheelchair lifts.

Accent on Living Summer 1983 Transportation Denver Busing Its Disabled Highlighted text: A failure in many cities, Denver has made accessible mass transportation work as an increasing number of disabled use it everyday. The Rapid Transportation District (RTD) in Denver is one of the most accessible transit systems in the nation – and the disabled community will take credit for it. For the last ten years, since 1973 when the RTD initiated “Handy-Ride,” a door-to-door subscription service, accessible buses have been a real issue. To date, disabled advocates have been the winners. “It has been a political victory for us,” says Wade Blank, co-director of the Atlantis Community, a highly active disabled group in Denver. He explains that they did not rely on 504 but instead used a successful strategy. Blank said that in 1973 when HandyRide was implemented, the disabled took the same stance the Blacks took during the civil right movement. “Separate in not equal. We agree that this type of service was fine, but what we really wanted was to have the entire bus system accessible. HandyRide would just be an extra.” Disabled people began demonstrating for accessibility on public buses – and in 1978 RTD agreed to develop mass transit accessibility. By June, 1982, it had met its commitment of having fifty percent of the buses accessible (two hundred twenty buses were retrofitted with lifts and one hundred twenty-seven new buses purchased in 1981 had lifts). In the meantime, however, Blank said the RTD reneged on its commitment of total accessibility because it announced in November, 1981, that eighty-nine buses to be delivered in late 1983 would not be lift equipped. These new buses are articulated buses, twice as long as regular buses. Wheelchair Ridership Graph - Shows ridership by month in 1981, 1982, and part of 1983 (up to April. ) Ridership pretty much rises except in fall and winter there is a downturn, and July of 1982 a sharp drop to a low point of about 300. Rocky Mountain News 8/5/83 RTD proposes bus changes for disabled By Tony Pugh, Rocky Mountain News Staff Writer The Regional Transportation District, in an open forum with handicapped citizens Thursday, introduced changes designed to make buses more accessible for disabled riders. Mike Smith, director of transit operations, outlined the proposed improvements, which include a new material to improve traction on bus wheelchair lifts and a metal “kickplate,” designed to minimize wear on lifts from hitting curbs. A new rotary control panel, said to be easier for drivers to operate, and a new lift wiring system also were introduced. Although many people in the attendance voiced displeasure with bus driver insensitivity and mechanical failure of the lifts, others expressed gratitude to RTD for its efforts in accommodating handicapped riders. Bill West, chairman of RTD’s handicapped advisory council, said he is reasonably pleased with RTD officials’ commitment to the disabled community. “I think they’re committed to making the best of what they’ve been mandated to do, but I believe they have a tendency to focus more on the lifts rather than better driver training,” West said. Larry Ruiz, 29, typified the problems encountered by handicapped riders. Earlier this week, he was passed up by four buses as he waited at a stop outside Colorado General Hospital, said Ruiz, who is confined to a wheelchair. The first bus had no lift, the next two buses had lifts, but the drivers did not know how to operate them. After waiting more than two hours, the driver of the fourth bus called a HandyRide disabled vehicle which took Ruiz home. But that lift malfunctioned, Ruiz said. He had to be removed manually. This gathering was a forerunner to a meeting in late October between the American Public Transit Association and the newly formed American Disabled for Accessible Public Transit. A spokesman for the access group, Wade Blank, said it will made three demands to the association: * “Wheelchair accessibility by all public transit systems in the nation.” * “To serve notice to all bus manufacturers that only wheelchair accessible buses will be purchased by its members.” * “For the federal government to stand behind this moral position and develop laws and regulations supporting total access for the wheelchair bound public on public transit.”

By Terry Kilewer Denver Post Stafl Writer Denver’s Regional Transportation District, which is contracting 20 percent of its service to private operators, may be a step ahead of other public transit systems with dwindling public money, delegates to a transit symposium were told Monday. Alfred DelliBovi, outgoing head of the Urban Mass Transportation Administration, praised Denver’s move to the forefront of privatization -- a trend toward government disengagement from transit that is catching on nationwide. RTD expects to save millions in future operating costs by farming out some bus routes to private companies, state Sen. Terry Considine, R-Cherry Hills Village, told an audience of 800 at the opening session of the two-day conference. Considine sponsored a bill last year to privatize a fifth of RTD's service. Now he wants to go even further by redirecting RTD tax revenues toward other transportation needs, notably a Denver encircling beltway. He said it’s time to reevaluate public transit, which is “21 times the tax cost per passenger-trip taken by private automobile." And he charged Gov Roy Romer with failing to “tackle the tough decisions that need to be made“ in state transportation legislation. A transit-and-highways bill Romer favored and Considine opposed died in the legislature last week. Romer disputed the senator's claims in remarks to the conference. Later, in an interview he said Considine is "out in left field" and out of step with his own political leadership on transportation issues. I agree you‘ve got to take advantage of all the savings you can. You've got to innovate with RTD; I signed (Considine’s) privatization bill last year. But more privatization won't take care of our highway problems." Considine and DelliBovi seemed in-step on privatization; though. The UMTA boss said the key to emerging federal policy in the public arena is "dwindling resources." During DelliBovi's two-year tenure at UMTA, the agency maintained the Reagan administration's bent toward frugal funding for transit construction and operations.

VERRENGIA Rocky Mountain News Staff Writer As handicapped demonstrators blocked Regional Transportation District buses with their wheelchairs for the second straight day Friday, Mayor Federico Pena's staff stepped in to referee a growing dispute over broken wheelchair lifts. “Perhaps part of the ultimate answer will be to allow the disabled community to be part of the decision-making process," Pena aide Dale Sadler said Friday. “What we're hoping for now is to get everyone to talk." But Sadler could only watch as Denver police quickly arrested George Roberts and Renate Rabe as the pair rolled their wheelchairs in front of an RTD bus at 17th and California Streets at 12:25 p.m. Roberts and Rabe were the second and third members of the militant disabled-rights group known as ADAPT to be booked into city jail in two days in connection with obstructing a government agency and blocking traffic. Mike Auberger of Denver was arrested Thursday at the intersection of East Colfax Avenue and Cherry Street when he rolled his wheelchair in front of a bus with a broken lift. Auberger, who was jailed for about three hours, is scheduled to appear in Denver District Court March 12. He faces $250 in fines. Roberts and Rabe were released Friday afternoon. Roberts is scheduled to appear in court Feb. 25. Rabe is scheduled to appear March 15. ADAPT protesters have vowed to block buses at busy intersections throughout the six-county transit district for 80 days — or until the RTD board of directors agrees to spend $753,059 budgeted to fix the balky electrical systems on 303 lift-equipped buses. RTD has one of the nation's most accessible public transit systems with lifts installed on about half of it's 750-bus fleet. However, disabled passengers complain that they frequently suffer frostbite in the winter as four or five buses with broken lifts pass them. They said they have a right as taxpayers to ride regular bus service, rather than plan their lives days in advance around the limited schedules of van services. “A wheelchair lift on a bus means a disabled person can live wherever he wants and shop wherever he wants," Auberger said. “The (RTD) board doesn't have the right to tell me where to live and shop. They might as well put me back in a nursing home." The demonstrators offered to cancel Friday's rally in exchange for a meeting with RTD General Manager Ed Colby. RTD officials said Colby had taken the day off Friday, but agreed to meet with the protesters minutes before their scheduled protest. That wasn't good enough, ADAPT leaders responded. “Colby had all last night and this morning to respond to us,” said Wade Blank, an able bodied demonstrator who organized the protests. “He was just a little late." RTD board members will discuss the transit agency's handicapped access policy for the handicapped and its lift repair record Tuesday at a committee meeting.

VERRENGIA Rocky Mountain News Staff Writer Regional Transportation District officials say they want to send a message that RTD can't be bullied. So they're considering whether to sue several contractors and consultants that they believe performed unsatisfactory work on the 16th Street Mall. "RTD is famous for saying, ‘Who? Me?“ RTD general manager Ed Colby said. “Those days are over. We're going to be proactive. RTD is going to be accountable to the taxpayers." RTD sources said that among the firms the agency might challenge on the $70 million mall project were Hill International Inc., management consultants for the mall complex; Johnson-Hopson & Associates, architects of the Civic Center bus station at the east end of the mall; and B.B. Andersen Construction Co., general contractor for the station. Colby terminated Hill and Johnson-Hopson last month when he said they allowed construction work at Civic Center to stop or slow repeatedly while haggling over construction changes. He also made Andersen promise to finish Civic Center, at the intersection of Broadway and Colfax Avenue, by Oct. 25. RTD officials filed suit Tuesday in Denver District Court against Weaver Construction Co. of Denver and the I.M. Pei architectural firm of New York City for their work in designing and installing the mall's granite paving. Unforeseen flaws and cracks have appeared in an “unusually high" percentage of the mall's granite paving slabs, officials say. Replacement and repair of the slabs along the 13-block mall-could cost $2 million to $8 million, they say. Colby said RTD is “evaluating potential suits against other firms but would not name the likely targets. The granite-paving suit and the consideration of other suits is the first of many steps RTD will take to erase its reputation for being inefficient and irresponsible managers of major construction projects, he said. “RTD is going to stand up for its rights," Colby said. Civic Center, which is supposed to be open for passengers by early December, is at least eight months behind schedule. Its cost overruns, RTD officials said, are still being tabulated. If it sues the companies it hired to build the mall, RTD would continue a long tortured history of litigation that has plagued [? word hard to read] the project since 16th Street was first torn up four years ago. Those suits and settlements include: * A 1983 settlement with Weaver for $2 million for more than l00 construction changes as-well as the delivery of improperly cut granite. * A $14.1 million lawsuit by Beaudoin Construction Co. of Denver for delays and cost overruns on the Market Street bus station. * A $400,000 settlement last month with B.B. Andersen that included payment of union-level wages to Civic Center construction workers, despite a regulation to that effect on all federally funded construction projects. Federal transit administrators, who have cited the mall as an example of how transit can galvanize a downtown area, said they will demand that [realistic?] building materials be used in future projects and that they and be kept within budget. “We raised questions at the outset about the wisdom of granite," said Ralph Stanley; director of the-Urban Mass Transit Administration. “We are now requiring construction oversight in all federally funded projects and an independent review by our agency of projects costing $25 million and over. VERRENGIA Rocky Mountain News Staff Writer When the ceremonial ribbon was snipped and the yellow sash fluttered to the pavement, the beleaguered Civic Center bus station remained standing. And more than a few Regional Transportation District officials joined in a collective sigh of relief. “There have been a number of headaches (on the project),' RTD chairman Byron Johnson said Wednesday at the station's formal opening. “But we're not worried about the headaches from this day forward. We see this as a tremendous breakthrough." Buses were supposed to be pulling out of the $20 million station, located at the intersection of Broadway and Colfax Ave., in April. But hundreds of complicated construction changes and bitter negotiations between contractors and consultants delayed its opening by six months. Last month, RTD general manager Ed Colby fired the station's architect and management consultant when parts of the concrete building had been left unfinished for 14 months and others had been ripped out and replaced as many as four times. Colby and his assistants took over management of the station themselves and demanded that the exterior be ready for Wednesday's ceremony and the arrival of President Reagan's mass transit director, Ralph Stanley. Stanley used the occasion to announce $6.5 million in federal grants to RTD and the Denver Regional Council of Governments. His brief speech was picketed by 10 handicapped demonstrators. Some of the the demonstrators were arrested in Washington last week when they disrupted a national transit convention where Stanley as a featured guest. "When you're putting on a party, nobody likes a crasher," said Wade Blank, who organized the silent vigil. We're here to make a statement." Workers were, at the site until 10:30pm Tuesday scrubbing the bus turn around out front and planting 17 trees along the Broadway facade.

Billings Gazette 6/15/83 Disabled learn persuasion tactics by ROGER CLAWSON, of the Gazette Staff Disabled persons have a right to ride public buses, and — with a bit of political savvy - they can enforce that right. That was the message Wade Blank, a Denver handicapped association activist, brought the Montana Independent Living Project conference in Billings Tuesday. Blank said it would cost $180,000 to equip Billings’s Met transit system buses with wheelchair lifts. The federal government would pay 80 percent of that cost. Blank said public buildings have been made accessible to handicapped persons, public transportation should also be accessible. He outlined how his group, the Atlantis Community, fought to make the Denver bus system provide wheelchair lifts and suggested tactics to those who would make the Met accessible to handicapped: * Lobby for support. In Denver, Blank said, major churches endorsed the Atlantis crusade. * Build public awareness. Because handicapped people are unable to ride the buses, they are never seen by bus drivers or transit officials. Blank suggested putting a person in a wheelchair on every bus to spend the day riding and handing out literature calling for equal access. * Lawsuits may be needed to force public officials to explain how federal money, given with certain strings attached, has been spent. * Serve notice that you won’t be bought off with special transportation systems. “They do not run special buses for blacks,” Blank said, "they should not be allowed to segregate the handicapped.” Participants of the conference noted that the only transportation available to the handicapped in Billings is furnished by Special Transportation Inc. (STI), a private, non-profit corporation that provides transportation for the elderly and handicapped under contract. Use of STI by handicapped adults is confined to trips for medical appointments.

Bus Plan Protesters Chain Selves By GEORGE LANE, Denver Urban Affairs Writer Wheelchair-bound protesters chained themselves to stairway railings and blocked the main entrance to local transit offices for about 90 minutes Monday until police removed them from the building. Two persons were cited for trespassing as 13 disabled persons in wheelchairs and about an equal number of attendants and supporters participated in the protest at the offices of the Regional Transportation District. Spokesmen for the group vowed they will return today. The demonstration was organized primarily by members of the Atlantis Community for the disabled and Wade Blank, co-administrator of Atlantis, to protest a decision by the RTD board of directors not to put wheelchair lifts on 89 high-capacity, articulated buses slated to be added to the RTD bus fleet in 1983. RTD officials allowed the demonstrators access to the building at 1600 Blake St. about 11 a.m. and raised no objections as the protesters held a press conference. During the press conference RTD was accused of reneging on a promise and violating the civil rights of the disabled by not ordering the lifts on the new buses. Following the press conference, “out of order" signs on two elevators foiled the group's plan to stage a sit-in at the third floor offices of L.A. "Kim" Kimball, RTD's executive director and general manager. “Kimball is as accessible as his buses," remarked one of the demonstrators. A brief scuffle occurred about 11:20 a.m. when Blank and several attendants attempted to carry three wheelchair occupants up a spiral stairway to Kimball‘s office. Mike Hughes, an RTD security officer, blocked the trip up the steps. The three wheelchairs with their occupants eventually were chained and padlocked to the handrailing of the stairway. Two more wheelchairs later were chained and padlocked to the landing of another stairway. The front entrance to the building was then blocked by five or six motorized wheelchairs as about a dozen policemen waited across the street. Capt. Bill Brannan ordered the demonstrators to leave the building. He then said those refusing to leave the building would be cited and ordered to appear in court it he believed they understood what they were doing. When the policemen and paramedics entered to evacuate the building, only Stephan Saunders, 31, and Mark Johnson, 30, would give their names to police. Both men were given misdemeanor citations for obstructing a government operation and obstructing a public passageway. The charges against Johnson, however, weren't filed because he later decided to leave the building voluntarily.

Handicapped reach accord RTD Wheelchair-bound demonstrators and the Regional Transportation District reached an “understanding” Friday in a conflict that led the bus company to seek a restraining order against the demonstrators a week ago. Both sides “agreed to agree,” according to RTD spokeswoman Kathy Joyce, who said they would work out the details of the agreement before the issue comes before Denver District Judge Daniel Sparr on Feb. 2 During that time, Sparr will make no decision on RTD’s request for the temporary restraining order. If a formal agreement is reached by Feb. 2, Joyce said the request would be dropped. The demonstrators began staging a sit-in at RTD’s headquarters Jan. 4 over the company’s decision not to place wheelchair lifts on 89 new buses scheduled for delivery next year. The wheelchair-bound activists were from the Atlantis Community and Holistic Approaches to Independent Living Inc. Several of the demonstrators chained themselves to stairwells in the main lobby of the building at 1600 Blake St., and others blocked the front entrance during the demonstration. Their anger was directed at RTD Executive Director L.A. Kimball, whom they blame for the decision to omit the lifts from the new buses. During the sit-in, the building’s elevators were shut off, making it impossible for the demonstrators to reach Kimball’s office. The demonstrators weren’t arrested, but they were escorted from the premises by police and paramedics. RTD requested the temporary restraining order against the demonstrators after the third day of protest, claiming the demonstration caused “disruption, obstruction and interference.” John Holland, an attorney representing the demonstrators, said the issues that led to the demonstrations are still alive, but that both sides will work out their differences in the next two and a half weeks in a climate of more open communication. He said that during that tie his clients will not be “disruptive.”

"Talk,” Judge Tells RTD, Atlantis By Howard Pankratz Denver Post Legal Affairs Writer Citing what he fears to be increased “polarization” between some of the Denver’s handicapped citizens and the Regional Transportation District, a Denver judge Thursday abruptly halted a hearing involved the two parties, called them into his chambers and asked that they negotiate a settlement to their dispute. The unusual action by Denver District Judge Daniel Sparr came in the midst of a hearing on RTD’s request that Sparr ban some handicapped people from engaging in disruptive demonstrations on RTD property and buses. At all cost, said the judge, he wanted to avoid an “us against them” climate. “It appears it is a confrontation that is not going to do anybody any good,” he said. On January 4, 5 and 6, handicapped individuals, some organized by the Atlantis Community for the disabled, demonstrated at various RTD offices protesting a decision by the RTD Board of Directors not to place wheelchair lifts on 89 high-capacity, articulated buses slated to be added to the RTD bus fleet in 1983. Many of the estimated 16,000 handicapped people in the Denver area feel that the district broke a promise to them when the lifts weren’t provided. Sparr said he felt that if he had to issue a temporary restraining order against the handicapped at the end of the hearing it could only lead to increased polarization and animosity between the district and the handicapped, something he said needs to be avoided. The judge noted that if that order, or subsequent orders were violated, it might result in contempt citations, fines and jail terms for handicapped people.
