Headline: Disabled protest transit group’s policies By Ken O'Toole of the Examiner staff Disabled people from across the nation took to the streets of San Francisco Sunday to demand better access to public transportation, rolling through downtown streets in a wheelchair caravan that stretched from Union Square to the downtown Hilton Hotel. Chanting, “We want access” and "We will ride," the crowd of several hundred disabled and their supporters rolled with police escorts to the hotel, where the annual meeting of the American Public Transit Association was taking place. The protesters were halted at the hotel's doors by a line of police, and after a brief rally moved on to City Hall, where they confronted transit association members going to a cocktail party. Police arrested 20 people, including 16 in wheelchairs, for blocking the sidewalk and failing to disperse. They were cited and released. One demonstrator. who was not wheelchair-bound, was booked for felony assault after he kicked a police officer in the chest. Police estimated that there were 500 demonstrators. The march, spirited but orderly, did not seriously disrupt traffic as scores of wheelchair-bound protesters voiced their displeasure with the associations policies and called for restoration of a national transit policy that would require wheelchair lifts on all public buses and trolleys. Both protesters and officials of the Municipal Railway noted the irony of the demonstration taking place in a city that has one of the best disabled-accessibility programs in the United States. California and Michigan are the only states that require all new buses to have wheelchair lifts. However, outside California, most disabled people are "segregated from public transit, and are often regulated to lengthy waiting lists for door-to-door van service" or no service at all, said a spokeswoman for the September Alliance for Accessible Transit. The group, in conjunction with American Disabled for Accessible Public Transit, plans more demonstrations as the transit association meets here through Thursday. Transit association Executive Vice President Jack Gilstrap said, “it's not a disagreement over whether we serve the disabled; it's how its to be done. Our position, and we're consistent with federal law and the courts, is for each community to decide how the service (to the handicapped) should be supplied." He said that lifts can cost $10,000 to $15,000 and that individual communities should be able to decide whether the money might be better spent on other transit woes. "lt's a very emotional issue," Gilstrap said, "but (public-transit agencies) have short resources. You're doing a good job here in the Bay Area, but with an extraordinary level of taxes." Muni spokeswoman Annette Wire said a total of 280 buses In the system have lifts, and 16 Muni lines are totally accessible to the handicapped. At a Union Square rally before the march, Lt. Gov. Leo McCarthy called for full access to public transportation. Saying laws that guarantee rights to all people have been undermined, McCarthy said disabled people have a right to access to school and work through public transportation. "Transportation means independence," McCarthy said, “and independence means opportunity." The Rev. Cecil Williams of Glide Memorial Church called on the disabled to take America to a new task... You may be called to set what's wrong right." A wheelchair-bound San Franciscan named Gill rolled into the crowd of demonstrators at Union Square and said he liked what he saw. But he said, “San Francisco is moving in the right direction. I travel sometimes miles a day (in the electric wheelchair) and I usually don‘! have any problems. except with the occasional inexperienced bus driver." Joe Carley, of Dallas, Texas, said since he was restricted to a wheelchair several years ago, at age 38, I realized: ‘This can happen to at anybody. Transportation is the A-Number 1 concern for anyone who's disabled. Federal and state governments don't really see transportation as a right. We want to live, not just survive." By Richard Chin, NEWS Staff Writer Using a back entrance to Greenfield Village, a convoy of SEMTA buses filled with delegates to a national transportation convention avoided a confrontation Sunday with about 100 members of a militant disabled-rights group. The buses, under police escort, slipped into Greenfield Village along a service road from a nearby Ford Motor Co. facility. The protesters were waiting in front of the main entrance to Greenfield Village. THE BUSES were en route to a dinner reception for members of the American Public Transit Association (APTA), which met in Detroit over the weekend. The protesters are members of American Disabled for Accessible Public Transportation, which has been trying to disrupt APTA meetings for three years. They demand improved access for the disabled to buses and other public transportation. Sunday‘s protest began with a wheelchair march from Rosa Park Boulevard down Michigan Avenue to the Westin Hotel in the Renaissance Center, where the APTA delegates are staying. The group had planned a wheelchair parade on the street but Detroit City Council rescinded the group's parade permit Sept. 29, fearing the protest would disrupt city transportation. AS THE GROUP wheeled along the sidewalk, up to 15 city police cars worked to keep them from spilling onto the street. Once they arrived at the hotel, the protesters were quickly herded into a barricaded area that kept them from entering the hotel. Group leaders said once they realized they couldn't enter the building or keep the buses carrying the delegates from leaving, they left themselves for Greenfield Village to try to block entrances. However, the SEMTA buses slipped through the back entrance. THE GROUP did manage to turn away several cars carrying late arrivers at the dinner, and after Greenfield Village was closed to the public at 6 p.rn., restricted all but guests at a private wedding from entering. APTA raised the ire of the protesters through what the protesters said were policies discriminatory against the disabled. They said APTA opposes making all buses wheelchair accessible. “l think they're afraid some of the riders don't want tn ride with diaabled people because some diaabled people are not attractive," aaid Jack Warren, 43. of Cincinnati. He said the stance reflects that of many public transportation users. APTA officials could not be reached immediately for comment. Harry A. Cassidy, a bus driver from Capital Area Transit Authority in Lansing, said he understands the protesters' complaints, but said making all buses accessible to the disabled makes it difficult to keep buses on schedule. Michnel Niemann, communications manager for SEMTA, said all that company’s small buses and 70 percent of its large buses are wheelchair accessible. By Al Knight Denver Post Perspective Editor Now, while the Americans with Disabilities Act is awaiting President Bush’s signature, would be a good time to reflect on what has been learned by this city's experience in attempting to provide full wheelchair access to public transportation. Assuming the president signs the bill as he says he will, public transit systems all over America will have to begin purchasing new buses equipped with wheelchair lifts, as well instituting a variety of other steps designed to enlarge employment opportunities for the disabled, improve services in state and local government, enlarge public accommodations, and create a national telecommunication relay service to aid the blind and deaf. Critics of the bill have argued that the nation is embarking upon a program without the vaguest clue of what its ultimate cost will be. In many ways, the dispute is a duplication of what took place in Denver in the early 1980s as the Regional Transportation District developed its policy on how rapidly to expand wheelchair access. There were a number of protests in which disabled residents in wheelchairs disrupted RTD service and were arrested. The protests were particularly disturbing for all concerned — RTD, the drivers and the police. The sight of an abled-bodied police officer toting away a wheelchair-bound citizen is not the stuff for law enforcement scrapbooks, nor is it the kind of publicity designed to attract bus riders generally. In 1982, the RTD board, which then was an appointed body, voted against equipping 89 new buses with special lifts capable of handling wheelchair passengers. That vote set off the protests. An elected board took over in 1983 and one of its first acts was to reverse that vote and authorize the purchase of the lifts at a cost of well over $1 million. At the same time RTD struggled with the issue of whether to retrofit existing buses with lifts, and in 1985 resolved it with a resolution that it would buy lifts for all new buses, but not pursue a retrofitting program. There had been a history of mechanical problems with some of the lifts, and on more than one occasion a lift would fail, dumping the wheelchair passenger in the process. In 1982, then Gov. Dick Lamm refused to go along with a proposal by the American Disabled for Accessible Public Transportation, which was demanding wheelchair access to “all U.S. public buses." Lamm suggested in a speech to the American Public Transit Association that such a policy might result in rides costing $600 each: “If America can't say no to a system that costs $600 per ride, we don't deserve to continue as a great nation.“ But as they say, that was then, this is now. Just last fall, RTD was awarded a special citation for having "the finest accessible bus service in the nation." The award came from the President's Committee on Employment of People with Disabilities. Indeed. it is beyond dispute that RTD has in some respects led the nation. Its experience in developing its current fleet of buses was the prime example used by congressional supporters of the Americans with Disabilities Act. In addition, it is a fact that RTD was the first agency to order its over-the-road buses equipped with lifts. Until RTD's first order, these larger vehicles had been built without lifts. The RTD program hasn’t been accomplished without significant expense. It has cost about $8 million for the lift equipment and millions more for parts, maintenance and training. But the latest figures show per-ride costs are far below the $600 figure mentioned by Lamm. The lifts cost about $13,000 a copy. Because the life of a bus normally is calculated at 12 years, this works out to a little more than $1,000 a bus per year. To this must be added the maintenance cost, which has been dropping each year. As recently as 1985 the cost of maintaining an individual lift was $1,798. This year the average is just over $500. Even without the retrofitting program rejected by the board in 1985, RTD has managed to increase greatly its percentage of lift-equipped buses. In 1985, only 54 percent of buses were so equipped. This year 81 percent are. In recent years, disabled ridership has gone up sharply. In 1982 it was just over 9,000 wheelchair boardings, but last year it reached an estimated 45,000. According to RTD figures, the per-ride cost may have reached $80 in 1984, but with the increase in ridership and the drop in maintenance cost, the cost per ride now has dropped to about $19 a ride, according to the latest calculations. What is not known is how many of Denver’s disabled community actually are served by the lifts. In the mid-1980s, it was estimated that only a few hundred wheelchair-bound residents were regular bus riders. Even as RTD has fitted new buses with the lifts, demands for its HandyRide service have continued to increase. This door-to-door service is available to both the elderly and the handicapped. Some of its wheelchair passengers could be served by regular buses, but many others are unable to get to the bus stop and therefore require the HandyRide service. Precise calculations aren’t available, but it is estimated the cost per ride for using the van service is about $50. Lamm, contacted this week, said he basically hasn’t changed his position on the issue. He said the $600 figure he used in 1982 was based on the experience of the St. Louis bus company. “To govern is to choose," he said, "and I don't believe this nation should make every bus wheelchair-accessible. Should the handicapped be provided transportation? Of course, but it should be provided in the most cost-effective way possible.” Lamm mentioned the expensive elevator system that is a part of the Washington, D.C., subway system as an example of a method that isn't cost-effective. The Denver experience does indicate that the costs of accommodating the wheelchair-bound citizen may not be an endlessly upward spiral. But the key indicator that needs watching is the number of passengers using the service. The taxpayers, the RTD board and staff members clearly have done their part. The wheelchair service is now available on nearly every bus, yet ridership has flattened out. The estimate of 45,000 wheelchair passengers for 1989 is just a few hundred higher than the 1986 level. More persons must be encouraged to use the service. Now that maintenance costs are down, the only way to decrease the still-considerate per-ride cost is to increase the number of passengers using the lifts. The most compelling case the disabled community can make for greater access is to demonstrate an even higher usage of the existing facilities. Rocky Mountain News [Headline] Disabled group calls off talks with McDonalds's By Angela A Dire, Rocky Mountain News Staff Writer Representatives of a nationwide group for the disabled Tuesday refused to meet with McDonald's executives, saying it’s time rhetoric stop and work begin on making the chain's 6,300 restaurants uniformly accessible to the handicapped. Members of the Access Institute gave the executives a letter calling off the meeting; which had been scheduled since May. Access members, who have picketed McDonald’s restaurants around the state six times in the past month, said McDonald’s executives reneged on a promise to negotiate. The group wants McDonald’s to make entrances, bathrooms and tables in all of its restaurants fully accessible to the handicapped within an agreed upon period, and to show disabled people in 10 percent of its advertisements. Company officials who came to Denver from the McDonald's headquarters in Oak Brook, Ill., said they were disappointed Access would not meet to suggest ways to improve accessibility in the restaurants. The meeting was never intended for negotiations -- just discussion, they said. "We will do our educating in the streets,” said Access members, who plan to continue picketing restaurants around the country until McDonald’s meets their demands. About 17 people have been arrested in the group’s'protests. But the demonstrations and arrests won't influence McDonald’s, said Tom Glasgow, vice president for operations and product development. “We run a sound operation," he said. “We can't run our business by reacting to demands arid demonstrations." He said McDonald's has used a standard design for accessibility in its restaurants since 1979, including special parking, ramps, accessible bathrooms and drive-through windows. Each restaurant may not have all these features, but will have them eventually, McDonald’s officials said.

The agreement to hold higher-level discussions was reached Monday in a wheelchair-packed room of the Denver Holiday lnn, where two dozen disabled people bargained for several hours with regional officials of the fast-food company. Both sides said afterward that the McDonald's national marketing and construction directors, as well as the vice president for store licensing, would attend the next meeting, which isn't scheduled yet. The outcome of Monday's meeting suggested that McDonald's is taking seriously the demands - and the threats — of ACCESS, a small, loosely knit coalition of handicapped-advocacy groups nationwide. Last week ACCESS members, most in wheelchairs, picketed two McDonald's restaurants in Denver. Led by members of the Atlantis Community, ACCESS vowed to begin a campaign against McDonald’s in several cities unless certain demands were met. “They can stop this thing from spreading today, or they can stonewall us and it will spread,” the Rev. Wade Blank, Atlantis Community leader, said Monday before the meeting. Jim Parker, a 38-year-old quadriplegic from El Paso, Texas, said afterward that ACCESS wants McDonald’s to promise that: * Entranceways,‘bathrooms and seating in all future outlets be “fully accessible" to the disabled. * Handicapped people appear in 10 percent of the company's advertisements. * The company make restaurants handicapped-accessible within a period yet to be agreed upon. McDonald’s regional officials declined comment Monday beyond saying that negotiations will resume within 30 days to address "the issues brought to our attention today." The regional office oversees operations in Colorado, New Mexico, Utah and part of Arizona. The company's national media office failed to respond to a request for information about McDonald's policies toward the handicapped. Behind the decision by ACCESS to target McDonald's are several factors, said Blank, not the least of which is the ripple effect that could occur if an accord is reached with a large, visible symbol of industry. If you can beat the big ones," said Blank, “the others will fall in place.” McDonald’s inaugurated the fast-food industry and leads competitors in the world market. Blank said the move on McDonald’s, which he called “symbolic of free enterprise," also represents a decision to take on the business sector after winning gains, such as bus lifts and curb ramps, from government. He acknowledged that last week's demonstrations were timed to coincide with the presence in Denver of about two dozen disabled people who arrived May 1 to study at the ACCESS Institute. The Atlantis Community uses the institute to teach its methods of advocacy. Alongside these political considerations is criticism of McDonald’s policies toward the handicapped, particularly what Blank called delays in remodeling older stores. “My daughter is in a wheelchair, and I can’t get her to a table," he said of one local McDonald's outlet “The only place she can eat is in the restroom, because it’s accessible."
